I received a collection letter containing a settlement offer from XXXX XXXX XXXX, a law firm representing Capital Alliance, dated XXXX XXXX, XXXX. The letter indicates they are collecting on my former XXXX XXXX XXXX account in the amount of {$880.00} and that Capital Alliance is my current creditor. I was extremely upset by this, I assumed they were going to sue me if I did n't pay them. I was too embarrassed to tell anyone and did n't know what to do. This proved to be XXXX some years back caused by XXXX which is why I fell behind on my XXXX card to begin with. XXXX. All of this caused because I was so afraid of being sued. I finally confided in my daughter about this and she started helping me. First she pulled my credit reports and found my old XXXX account was only reporting on one due to how old it is, it 's gone from that one now too. She did some research and this is what she found. My XXXX account is past Statutes Of Limitations for suing and was at the time of their letter. Their letter does not indicate that, it was supposed to. I thought if I made a payment it would reset the SOL clock, I now know it would not. Their letter gives a deadline date of XXXX XXXX, XXXX for payment, this is why I was certain they were going to sue me if I did n't pay by then. It was very misleading. Their letter indicates Capital Alliance is my creditor. They can not be, they are a debt buyer. XXXX XXXX owns XXXX XXXX XXXX as well as Capital Alliance. They have an unscrupulous reputation and are banned from filing suit in some states. Their letter does not include any of the information it should have. No dates as to when the account was originally opened, the last payment, first delinquency, charged off, when Capital Alliance supposedly purchased the account and from whom. They did n't even include the account number. The amount they are trying to collect is {$880.00}. The amount the XXXX account was charged off for was {$270.00}, a {$610.00} difference. My daughter found this court case that is very similar. XXXX v. XXXX XXXX XXXX , XXXX, XXXX XXXX XXXX ( XX/XX/XXXX ) My daughter also helped me with this complaint as well as a letter to XXXX & XXXX , dated XXXX XXXX, XXXX, sent via Certified Mail with a Return Receipt. They did not respond. When they pull these illegal, unethical scams I wonder if they ever think about what it does to the people they 're scamming. I doubt it. I 'm confident I would prevail in a court case against XXXX XXXX XXXX and Capital Alliance but would prefer to settle out of court due to my health. I have attached copies of the correspondence and the relevant credit report entry with the account number blackened out for legal reasons.

Good Afternoon, My name is XXXX XXXX and I'm a Michigan resident. I want to file a complaint and federal charges against Michigan State IRS. I receive XXXX and I filed a renters rebate with XXXX XXXX in XX/XX/2023. The Representatives for Michigan IRS have been discriminating against me. Every time I call them they make XXXX comments and held up my refund. I filed in XX/XX/2023 and in XX/XX/2023 they informed me that an unknown entity was garnishing me refund. When I asked for a copy of the Garnishment they refused to mail me a copy. I called the court that issued the Garnishment approval. The clerk informed me that I did not have a court date for the approved garnishment or a notice of service. I don't know how the lawyers got a garnishment without a court date? I asked the clerk to provide the address where I should have been served a notice of Garnishment with the court date and she said there isn't one. I called the Michigan IRS back and they said the lawyers don't have to follow the steps to obtain a garnishment. I don't know how they knew I was receiving XXXX?? The refund is {$1600.00}. It's not about the money. It's about their XXXX practices and the mission to try and oppress me because I'm not XXXX. I want my refund. They have no right to steal. They engage in criminal practices in order to enforce their agenda to oppress people that look like me. They stalk my social media, emails, and text messages. They're so miserable and wicked. Can you release my refund. I have places to go and people to see. My number is XXXX. I think they put spy ware on my phone to listen to my conversations. They always want to know what I'm doing XXXX XXXX days. It's so sad and pathetic. My patients is running low. I will look forward to a response and a resolution ASAP at your earliest convenience. I was sued and they won by default, was Never properly informed of the Default until I received a COURT ORDERED LETTER, I then wrote the Judge at the XXXX Court house, letting the Judge know I wasn't issued a 2nd nor 3rd notice to work out a suitable chance, because I'm going through a Hardship at this time in my LIFE, I have a ILL spouse I'm the SOLE PROVIDER IT'S IMPOSSIBLE too cut 1 pie in 12 slices, I'm being sued & Harassed by some many Debt collection agencies, I have already be Unlawfully defaulted suized Bank account once by XXXX XXXX so I guess the others learned that and trying to to the same thing to me and I have stated that my Wife has been Sick and unable to work for past 5 yrs. I've Not been treated WELL by most of these overbearing Companies, when we were able and more financially stable WE paid every card we both had among us BOTH, now we just don't have anything left after paying our main bills like Mortgage, Car note, water, light, gas, Grocery, medical, car insurance, that XXXX Garnishment, and Lunch and Gas to BARELY make to to work til bi-weekly wages. I'm 1 more check away from becoming Homeless. Please help me Stop them from XXXX me and causing a XXXX XXXX. Capitial alliance financial llc is owned by XXXX XXXX. Capital alliance financial buys debt, and is a debt collection company. Capital alliance financial is merely a shell company for XXXX XXXX law firm XXXX and XXXX. No response when you attempt to reach capital alliance financial only XXXX and XXXX. XXXX and XXXX turned for a civil judgement against me under the false pretenses they are acting on behalf of their client. XXXX and XXXX has a conflict of interest and should n't be allowed to deceive consumer 's that they are a law firm acting in behalf of their client. They are merely acting on behalf of themselves. Representative stated they were an attorney and when asked if capital alliance was connected to XXXX and XXXX denied any knowledge.

I recently received notice from a law firm, XXXX XXXX XXXX stating that a lawsuit was filed against me by Capital Alliance Financial LLC. Capital Alliance is first attempting to collect on a debt that was discharged in court because they failed to appear in court after I objected to the accused charges. Some time has passed and the debt that is claimed that I owe is now time barred. The statute of limitation to collect debt in Michigan is 6 years. I find it unreasonable for me to have to take off from work to file a counter suit against this collection agency when they are knowingly breaking the rules established by the FDCPA.

This place is a scam. They offered me a XXXX loan and said I had to buy XXXX XXXX because of problems with my credit. They took the logo and name, XXXX XXXX XXXX, from a machine finance company in XXXX which when confronted with they denied. He then asked me to go get a XXXX XXXX card to pay the XXXX XXXX which sent up red flags. The guy I was talking to was named XXXX XXXX and his number is XXXX. I'm sure it's not his real name as he had a thick XXXX accent. They are preying on people like me who are in financial straights.

In accordance with the fair credit Reporting act XXXX XXXX XXXX XXXX has violated my rights. 15 USC 1681 Section 602 States I have the right to privacy. 15 USC 1681 Section 604 A Section 2 : It also states a consumer reporting agency can not furnish a account without my written instructions. 15 USC 1666B : A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for purpose.

I had an account with XXXX XXXX opened in XXXX 2009. I defaulted on this when I got sick and was unable to work. I later became XXXX due to this illness. I tried to work with XXXX XXXX but they charged off the debt. Since that time, a debt collector purchased the debt and I have received XXXX Dismissals from my local District Court and then a Summons and Complaint from the same court today about this debt.

The lawyer filed the paper work stating that I have been served paper work to appearing court for a collection on a debt that I owe. I never had anyone from a court serve me paper work in person. I found out later that a judgement has been issued for me to pay, so I 'm filing a complaint against the law firm.
