Complaint Facts : TRINITY FINANCIAL SERVICES , LLC, XXXX XXXX XXXX and PXXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX commenced a foreclosure lawsuit on XX/XX/XXXX, to foreclose on me and my wifes property located XXXX XXXX XXXX XXXX XXXX, XXXX. TRINITY FINANCIAL SERVICES , LLC, was assigned the mortgage from US Mortgage Resolution LLC XX/XX/XXXX, per document # XXXX recorded XX/XX/XXXX, but never sent any notice to us that this assignment had occurred. TRINITY FINANCIAL SERVICES , LLC never performed any of the servicing functions like introduction, notices, billing statements or account related updates breaching an assignees fiduciary duties and never creating a contractual agreement with my wife and I. After reading the XXXX XXXX XXXX claims from people with similar complaints as ours and the fact that TFS has an F rating but is still being allowed to operate is very upsetting and very troubling. This is why people are losing or have lost faith and confidence with banking and lenders. TFS is a predatory stalker of properties with low dollar amount second mortgages that contract document preparation service companies like XXXX XXXX and in this case XXXX XXXX using fraudulently prepared assignments to basically steal unsuspecting homeowners property. The long explanation TFS submitted in their response to Consumer Financial Protection Bureaus follow up is generic and probably routine. The documents provided in TFSs response that raise a red flag are what I will highlight in this rebuttal response to CFPB. The date and signers of the Mortgage and the Note : 1. XXXX XXXX XXXX XXXX XXXX clearly shows it was signed by both myself, XXXX XXXX, and my wife, XXXX XXXX, on XX/XX/XXXX XXXX. The next document TFS references as the Note is a generic looking document. It has XXXX XXXX XXXX XXXX XXXX XXXX at the top and is dated XX/XX/XXXX, the same date as the Mortgage, but there is no account number and our names ( XXXX & XXXX XXXX ) are not inserted within the first page, nor the body of the 6-page document that contains terms and conditions similar to a Mortgage for different states that dont include XXXX. The suspicious part is, it was pre-drafted with my wife, XXXX XXXX, name and is signed by my wife XXXX XXXX only but not by me, XXXX. I am on the mortgage and was present on the XX/XX/XXXX, date. The other red flag is it was endorsed by XXXX XXXX, Vice President of XXXX XXXX XXXX XXXX XXXX with a Pay To The Order of to XXXX XXXX XXXX on the XX/XX/XXXX date, but XXXX XXXX XXXX did not merge with XXXX XXXX XXXXXXXX until XX/XX/XXXX, plus when a Pay To The Order Of. is applied to a financial document the obligator, XXXX XXXX, my wife is being released of that obligation. There is no other date within the 6-page document to reference when the transaction occurred and no-account number attaching to the mortgage account. The XXXX XXXX XXXX XXXX Assignment : 1. The XXXX XXXX XXXX XXXX Assignment is a very questionable document because it was prepared by, requested to be recorded by and executed by XXXX XXXX XXXX, Vice President of XXXX XXXX and returned to XXXX XXXX, XXXX XXXX, a division of XXXX XXXX, all in-house. Why was XXXX XXXX XXXX XXXX left out of the loop? 2. The XXXX Attorney General, Consumer Financial Protection Bureau and The Federal Tade Commission should seek evidence that XXXX XXXX XXXX XXXX XXXX XXXX, Owner and XXXX XXXX, Co-Founder & Managing Director were really participants in the transaction since we never received any notices, acknowledgements or statements from XXXX XXXX XXXX XXXX after the executed assignment on XX/XX/XXXX, and recorded document # XXXX on XX/XX/XXXX, with the XXXX XXXX Recorder of Deeds. 3. XXXX XXXX XXXX XXXXXXXX officers XXXX XXXX, Vice President and XXXX XXXX XXXX, Vice President both need to be contacted to request notarized statements on their participation in this transaction and specifically why a closing for the buying and selling of this account did not include us since it is our property. This is a remedial oversight action the Attorney General, Consumer Financial Protection Bureau and The Federal Tade Commission should request from both of the XXXX XXXX XXXX employees and the XXXXXXXX XXXX employee. There are 2 letters that are referenced : 1. The RESPA Welcome Letter from TFS sent to my wife XXXX XXXX dated XX/XX/XXXX. XXXX, in the TFS response states that it was sent to XXXX XXXX because she was the signer of the note, but why was she the sole signer of the note when I, XXXX, am on the mortgage and was present? 2. The RESPA Goodbye Letter sent from XXXX XXXX XXXX XXXX dated XX/XX/XXXX, states that XXXX XXXX XXXX XXXX will no longer be servicing the loan, but it never was a servicer. When did they even become a servicer? Where is the RESPA Hello Letter? 3. Neither XXXX XXXX XXXX or XXXX XXXX XXXX of XXXX XXXX XXXX XXXX or any other employee signed the letter sent saying Goodbye, and what verification can TFS provide to prove the letter was actually sent from XXXX XXXX XXXX XXXX to and received by XXXX XXXX? XXXX XXXX and XXXX XXXX Through our research it was discovered that the assignment and allonge signed by XXXX XXXX are fraudulent documents. The assignment and allonge were prepared by XXXX XXXX XXXX XXXX and XXXX signed by XXXX XXXX who list herself as Assistant Vice President of Trinity Financial Services , LLC, Assistant Vice President of XXXX XXXX XXXX XXXX and Assistant Vice President of XXXX XXXX XXXX an unrelated assignment, when she is actually a seven-year employee of XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX MO XXXX XXXX ( XXXX ) XXXX E-mail : XXXX XXXX unrelated assignments are enclosed for review showing XXXX XXXX as the Assistant Vice President of 3 different companies within months, and even days apart. XXXX XXXX should be investigated, interviewed and required to submit a notarized affidavit of her role in this document forging scam. This is a remedial oversight action the Attorney General, Consumer Financial Protection Bureau and The Federal Trade Commission should act on immediately before our family and other families are further damaged. This one factor really should be enough to dismiss TFSs claim and demand the XXXX XXXX XXXX start the process of Quiet Title on my property by the oversight governing bodies. This is Dishonor in commerce, Theft, Fraud, Conspiracy, and Racketeering. All the points included in this oversight requires remedial investigating action by the Attorney Generals Office, Consumer Financial Protection Bureau and The Federal Trade Commission because the chancery administrative judges with no legitimate authority because chancery is not a land jurisdiction court, possesses no subject matter jurisdiction and is adjudicating cases in an improper venue, is accepting third party hearsay testimony from legal thugs co-conspirators, are signing off on their complaints and orders to evict legitimate homeowners from their homes, that the sheriffs carryout giving us no recourse but to fight this by reporting it to oversight agencies, otherwise we will be forced into using unconventional means. TRINITY FINANCIAL SERVICES , LLC, was assigned the mortgage from XXXX XXXX XXXX XXXX XX/XX/XXXX, per document XXXX XXXX recorded XX/XX/XXXX, but never sent any notice to us that this assignment had occurred. TRINITY FINANCIAL SERVICES , LLC never performed any of the servicing functions like introduction, notices, billing statements or account related updates breaching an assignees fiduciary duties and never creating a contractual agreement with the XXXX XXXX. We have since discovered that The Department is the XXXX of Pennsylvania 's administrative agency authorized and empowered to administer and enforce the Mortgage Licensing Act sued Trinity Financial Services , LLC after a review of the business practices of Trinity Financial Services , LLC ( " TFS '' ). Based on the results of its review, together with certain disclosures TFS has made to the Department, the Office believed that XXXX operated in violation of the Mortgage Licensing Act ( the " XXXX '' ), XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. The Mortgage Serv1cer licensing requirement found in Section 611 l ( a ) of the MLA became effective XX/XX/XXXX. TFS filed its application for License as a Mortgage Serv1cer on XX/XX/XXXX. TFS was servicing loans which TFS did not negotiate or originate at the time of servicing. By servicing mortgage loans which TFS did not negotiate or originate at the time of servicing, TFS acted as a mortgage servicer when it was not licensed to do so. The Affidavit of Amounts Due and Owing that carries a notarized signature by TLS XXXX XXXX XXXX filed in case XXXX XXXX XXXX falsely states, Lender acquired the servicing rights for the Defendants loan effective on XX/XX/XXXX from XXXX XXXX XXXX XXXX XXXX XXXX At the time of this transfer, the Defendants loan was in default. This notarized affidavit statement is contradictory to the XXXX XXXX XXXX of Deeds document # XXXX filed XX/XX/XXXX showing the Assignor as XXXX XXXX XXXX XXXX, not XXXX XXXX XXXX XXXX XXXX XXXX and XXXX XXXX executed on XX/XX/XXXX, not XX/XX/XXXX, proving that XXXX XXXX provided false evidence to the court. This clearly exposes that the TLS assignment was fraudulently executed because TLS was in violation of the MLA and was not a legitimate servicer in XXXX. TFS violated the MLA when it engaged m the business of a mortgage service while not licensed as a Mortgage Servicer 7 Pa CS 611 l ( a ) Claimant has reason to believe the TFS and XXXX XXXX XXXX XXXX XXXX XXXX are fraudulently conspiring to foreclose on Claimants home because servicer TFS did not negotiate or originate the loan and therefore, is not the owner-in-due course and lacks standing to foreclose. Basically, the court is complicitly allowing TFS through XXXX XXXX XXXX XXXX XXXX XXXXXXXX to steal property fraudulently because I am representing myself in the foreclosure case and have filed counterclaim case XXXX XXXX XXXX XXXX. My property has an estimated value of over {$400000.00} with all the remodeling Ive done, yet TFS is foreclosing with an Amounts Due and Owing stated principal amount of {$18000.00} and a gross amount of {$33000.00}. Claimants are not obliged to pay the instrument if the person seeking enforcement of the instrument does not have rights of a holder in due course and the obligor proves that the instrument is a lost or stolen instrument. My home is being auctioned off by Trinity Financial LLC in XXXX XXXX, Ca. My loan with XXXX during the time I modified my loan during the year XXXX is period of modification. I had XXXX & XXXX loan. Representative of XXXX told me that XXXX was charged off & there 's only XXXX loan to pay. Once XXXX approved & modified my loan, few months later they notified me via mail the loan was sold to XXXX XXXX & would be servicing my loan now. I was told clearly by XXXX XXXX no longer existed since it was charged off. Once sold to XXXX I continued to pay ON TIME on mortgage payments. To my shock I kept receiving mail from investors and lawyers to help my save my home. I called XXXX they said they were not foreclosing on my home. I found out that this bottom feeder investor company Trinity Financial was foreclosing on my home. How is it legal for this company to foreclose on are home for the XXXX loan. They never notified me or gave me any warning they were foreclosing. Trinity said that we had by XXXX XXXX to contact them to resolve this matter. They requested my financial information which I complied gave them all they needed. Once they received my financial info & felt I ca n't afford to pay what they are asking they cut all contact and put a sale date to auction my phone off by XX/XX/XXXX. Trinity Financial had no intention to try and work with us they had full intention to foreclose and sale my home. There is this boom in Real Estate now where there are bottom feeder investors like Trinity Financial purchases charged off unsecured loans & sits on them for a few years if the house is upside down and wait till the market goes up & the home gains equity then they go after homeowners and I am a victim of this. Trinity Financial has NEVER made attempts to reach out to notify me that they purchased the loan. Do n't homeowners have the right to know who purchased the loan so they know who to make payments to. They sat on the loan for 2 years then they foreclosed then notified me & now are trying to auction my home. Trinity financial requested my financial info from me, made me believe they wanted to work with me. Come to find out they just wanted to see what we can afford then STOPPED all contact with me. When I called the office to speak to XXXX XXXX or XXXX XXXX I was told not to attempt to contact them. I would have to contact their lawyer XXXX XXXX XXXX which I did to confirm they received my financial info & thats when he stopped taking my calls. Not the attorney nor XXXX XXXX President of company nor XXXX XXXX the loss mortgage manager would speak to me. How am I suppose to resolve this if they wo n't speak with me. I personally wrote XXXX XXXX a letter asking to work me & received no response. They only option they gave me is to pay XXXX or home will be auctioned off. I hired lawyer to speak to their lawyer to resolve this & their lawyer wo n't respond to my lawyer calls. XXXX XXXX president of Trinity Financial prides himself on there website that Trinity Financial purchases assets or unsecured loan of pools of non-performing second mortgages with expectations of converting a high percentage to performing status. Trinity says it achieves this by BUILDING RELATIONSHIPS & WORKING CLOSELY W/HOMEOWhichWNERS through variety of workout options including modifications & settlements yet they 've done none of these w/me except have NO communication with me nor accept my calls to Trinity or their lawyer. Under the law ( XXXX ) requires party listed ( Trinity ) to validate the right & authority to foreclose before recording notice of default. I have reason to believe that Trinity has any legal right to collect loan payment & /or to initiate foreclosure/auction proceedings. Under Calif law, only " holder '' in possession of original endorsed note has legal right to auction home. Their in material violation.

Trinity Financial, LLC contacted me via letter on XX/XX/XXXX regarding a second mortgage on my home. I was ask to contact them right away. I called the number on the letter, and spoke with XXXX. I stated that I was unaware of this loan, and did not have a second mortgage. XXXX offered to send me the proof. I received a deed of trust that originated on or around XX/XX/XXXX. The deed of trust was between the original lender in the amount of XXXX. However, it did not include a percentage rate, and the balloon note was not due payable until XX/XX/XXXX. I felt like a victim, since I had no knowledge of how bad the housing market really was during XX/XX/XXXX. I called XXXX back and explained that the note was not even due payable. I ask him to escalate this matter to his management. I did not here back from him. I called severl times again in XX/XX/XXXX, I spoke with XXXX. I ask him to please forward me a servicing instrument that showed my payments, how they calculated my interest in order to support missed payments or any payments at all for that matter. He said he would, I never heard back. On or around XX/XX/XXXX, I received a letter from Trinity Financial Attorney stating that they were going to suit me and possibly foreclose on my home. I called, and the attorney stated no foreclosure proceedings had started, and what would I like to do. I ask him to please provide me with proof that I had defaulted on this debt, since the debt was included in a Bankruptcy in XX/XX/XXXX. Also, the amounts were incorrect. He said he would get back with me. I never heard from him. I made over 14 calls from XX/XX/XXXX - XX/XX/XXXX trying to get this matter resolved, with no legitimate responses. On or around XX/XX/XXXX, A lien to foreclose on my house was filed by Trinity Financial, LLC. by the time I received documentation, it was the first of the year. I immediately responded to the Public Trustee. I filed the right to cure paperwork in a timely fashion. Since that time, I have reached out to Trinity for a settlement offer of the full principal of the loan, over 10 times. I was turned down because they wanted me to fill out a loan modification package, and due to my XXXX, I was unable too. I however, did send a letter of hardship, my mortgage payment slip for the first mortgage, and a couple of other documents. On XX/XX/XXXX, I received a second turn down to give me a settlement amount due to the fact I have a incomplete loan or borrows package. I contacted an attorney, who as a favor, reached out to their attorney to see if they could get a settlement amount based on the fact that 1. the loan amount is disputed, 2. the interest rate is not included in deed of trust ; 3 : they refuse to provide me a ledger of payments and how they calculated the interest ; 4.I am XXXX, and have experienced a serious hardship, that I will not recover from, and now I am being threatened by foreclosure to be put out of my only home, or file bankruptcy, this is a tragedy. It is sad to say, even their own attorney has not heard from them according to the last email. Trinity Financial, LLC is a corrupt collection agency. I have researched through the CFPB all of the complaints, in addition, their are many lawsuits that are placed against this company for the very reasons I am filing a complaint today. Based on the following reasons, wrong amounts, fraud, misrepresentation of what is owed, increasing amounts from {$34000.00} - XXXX, then it went up to XXXX as the final payoff, this is ludicrous. This 2nd mortgage was also apart of a bankruptcy in XX/XX/XXXX that I filed, and it was thrown out by the judge ( I only discovered this through my resent research ). Trinity Financial, needs to do the right thing, they have violated my rights, and I am in need of justice.

Cease and Desist from all collection attempts and cancel the scheduled illegal foreclosure sale of XX/XX/2019 In accordance with the Fair Debt Collection Practices Act, Section 809 ( b ) : Validating Debts : ( b ) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection ( a ) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. Although their websites states they achieve their success by " building relationships and working closely with homeowners through a variety of workout options including modifications and settlements '' this statement could not be further from the truth. Trinity 's MO is to bully the homeowner into paying the full unpaid balance plus ALL interest or suffer foreclosure. They lull you into thinking they 'll work with you by initially offering a modification or a reasonable settlement but it 's nothing more than a method of strengthening their position by gathering all of your personal information. It would have been ideal had they notified us in XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX but they chose to wait until XX/XX/XXXX, during the recent housing spike, to contact us in order to resolve this matter because it was in their best interest to do so. I blame XXXX XXXX XXXX for falsely leading us to believe we received a principal reduction and Trinity Financial Services, LLC for remaining dormant by intentionally failing to notify us over all these years for the purpose of maximizing their profits at the expense of the unsuspecting homeowner. Not to mention they have a HUGE problem with the chain of assignment as the assignment deed of transfer documents purporting lawful assignment and thus lawful standing to foreclose appear fraudulent and incorrectly dated rendering standing and the security instrument VOID under the law. With all the improprieties in the chain of assignment and it 's execution they still assert lawful standing yet fail to produce an original note. As a law abiding homeowner we are left with no choice but to defend our only family asset in legal court system. We have invested 11 years on paying this home down, investing our hard earned money on repairs and up keep, on improvements just to let our home go into the hands of these unethical debt collectors. Most homeowners do n't have the money to contest these wrongful foreclosures in court and Trinity knows that which is how they get away with their. They need to be STOPPED!

We had a 2nd mortgage discharge thru chapter XXXX bankruptcy in XX/XX/XXXX. we were not aware that after our property gain equity they could come back traying to collect the debt. in XX/XX/XXXX we received a letter that look suspicious with a company name that we didnt recognized as the lien holder we open the mail and they send us a past due notice for the full amount of {$280000.00}. After checking with the BK lawyer to see what we had to do we contacted Trinity Finacial services, llc. for the firt time trying to see how we can work this issue. they say they obtained the loan and wiil work with us refinancing the loan thru them they send us an application and we returned it to them XX/XX/XXXX. after that it was obvious that they were not trying to work with us it was either accept our terms or we will proceed to accelerate forclosure. we ask them if we could work a payoff amount and they said for XXXX they will settle. thru all this proces we keep asking them for copy of the note or documentation in how they obtained our loan and they never provide anything to us. they continue with the forclosure processed and we couldnt hire a lawyer due to lack of funds we pretty much continue making payments to our first mortgage and the foreclosure sale date from Trinity financial services was sent to as to be executed on XX/XX/XXXX. we do n't know how Trinity financial services, LLc. put their name on the trust deed of sale. we received a copy from the county of XXXX as a courtesy. Right after that we received an unlawful detainer from Trinity Financial Services, LLc. Lawyer, we went to court and the judge ask for as to request 30 days from Trinity Financial so we could leave the property and we did we obey the law and get out of the property by XX/XX/XXXX. we continue checking with the first mortgage to find out if Trinity Financial send them the payoff and they never received any information from them. second week of XX/XX/XXXX I received information from an ex neighboard letting us know Trinity Financial Services, LLC. accepted an offer on the property and I decided to contact our XXXX to find out if they requested a payoff and they informed me that no the only request was the one I submitted, i told them I did n't request any payoff to please email the information to me and they did to our surprise Trinity Financial Services, LLC. was requesting the payoff with the authorization to release information that we give them 2 years ago for the only purpose of refinancing our loan. Is this shady or what after all we being going thru we tought for our peace of mind we have to submit this complaint to this office the sense of failure by loosing our house is bad enough and if all possible we would like to know if this is legal. And maybe if other people read the complaints that will help them.

We took out a HELOC with a big box lender 10 years ago. Our property went under water and we lost household income so we filed Chapter XXXX which was discharged 8 years ago. We were told we were no longer responsible for the debt ... but that the lien would remain on the property. We found out in XXXX that the lien from XXXX did not record until XXXX we recently found out there was an issue in the assignment process as well ... .that the original big bank did not properly record the assignment transfer. In fact we got a call from the bank saying they were " correcting '' the error by recording another assignment to a company that was supposed to have been assigned originally. So not only did the deed record 5 years after signing but 3 years after BK discharge .... and with significant irregularities in recording. However, this is only part of our complaint. We have been attempting to settle with Trinity since XXXX ... .in the initial call their representative told us they will not negotiate ... .that they " would purchase my first mortgage then foreclose '' ... or they would simply " wait until the values go up then foreclose. '' In XXXX of this year Trinity filed an " notice of default '' against us. earlier this month we had offered a settlement amount which was declined via email and countered to {$70000.00} on XX/XX/XXXX. My wife and I have been scrambling around borrowing, liquidating XXXX and selling personal effects to come up with the XXXX ... ... I contacted XXXX via phone and had a conversation with XXXX yesterday. I explained we had done everything we could to come up with the money and that we wanted to know what we could expect in return for the settlement. XXXX said he would send me an email within 10 minutes of our call but what we got was an increase in the amount to {$77000.00} ... ... {$7500.00} almost to the dollar. So in summary, after accepting their email offer they used the verbiage in the email to say there was no actual offer ... just the " possibility '' of approval followed by another email with the higher amount. What is to stop them from doing the same thing again? We dont have XXXX but I feel like if we said we did they would simply raise the amount again. The ethics of this company and its representatives are suspect at best ... .and the individuals earning a living by foreclosing on families have dirt all over their hands ... at some point the CFPB and other government agencies need to get involved to stop the gorilla tactics taken. Trinity said that they would be sending me my billing statement a new account number along with current loan balance and next payment due. The date on this letter was XX/XX/XXXX. The letter stated that I owed {$49000.00}. The monthly interest rate is 0.06000 and the next due is XX/XX/XXXX. This is not true and I have never heard of Trinity Financial Services before. I tried to contact this company and it kept going into a voice mail that did not sound right. I was then contacted by an attorney named XXXX XXXX with XXXX XXXX XXXX XXXX XXXX XXXX on XX/XX/XXXX. This letter came from XXXX XXXX 6 days after I received the letter from Trinity Financial stating that i must bring my loan current within 30 days from the date of this letter or they will start foreclosure. I am an XXXX military personnel and I bought this house sometime in XXXX at XXXX XXXX XXXX XXXX XXXX CA. But unfortunately, after closing our escrow about ( one week after ), I received an assignment to go to XXXX immediately with my family. We left and we did n't even have a chance to live on the property. I was in XXXX for 5 years and then got another assignment to go to XXXX which I stayed for another 5 years. When we came back, I thought that the house went on foreclosure as we abandoned the house for 10 years and did n't pay anymore. The only time I found out that it was still in my name is when I was trying to cosign with my brother in buying a house, this property pop out that it is still in our names. I immediately called XXXX XXXX and told us that they ca n't foreclose the property as I am an XXXX military personnel. So they suggested to do a short sale in which they approved it right away in less than a month. Now, there was a 2nd with Trinity Financial, in which my agent was trying to talk to them and negotiate. The original balance is only {$74000.00} but because of the interest for 10 years it became {$130000.00} plus. So, XXXX XXXX offered them first for {$3000.00} but they did n't want to accept it and told my realtor that SHORT SALE Is not an option. We tried to communicate with them as to how much they are willing to accept as we already have a buyer that was approved for the loan already and ready to close, but they are insisting on getting the full amount of {$130000.00}. and didnt even want to come up with any amount except the full amount and told my agent that SHORT SALE IS not an option. My 1st Lienholder is not going to pay them the full amount as their taking a big loss of {$400000.00} based on the attached demand letter and the property value is {$290000.00} only. We tried to speak to them to tell us what amount are they willing to accept besides the full amount but did n't want to give us any respond except they send my realtor a denial letter saying SHORT SALE IS NOT AN OPTION. I did n't want and neither XXXX XXXX to foreclose this property considering that I have served and continously servicing our country for 21 years but Trinity Financial did n't want to cooperate to close this and be removed in my name. What can I do? I wrote the following email to the 3rd party collector. I have a SHORT SALE CONTRACT on the property. I had no idea that the 2nd mortgage was sold. IO was NEVER NOTIFIED. In response your email I received this afternoon sir and Friday what you're saying really doesn't make any sense. Since the short sale, is being held up by the second lien holder which you say is you. How can you say that the QWR has nothing to do with the short sale? When the QWR, has everything to do with the short sale. I need the validation that you are actually the second lien holder, how can authorize Trinity Financial Services LLC to get a payment from my first lien holder on a short sale if I have no validation that you actually own my debt. Because of everything previously stated this is holding up the short sale. I have no correspondence, no notices, no phone calls, nothing on this second lien in over 10 years. I was never notified or contacted in any way by any means on the selling and buying of this note. Now suddenly, after all this time, you come out of the shadows put an offer on the table with no validation of who you are. I have decided I need to short sell this property. Trinity is well aware of everything that is going on with this property through recent communications with me via email and phone calls, and my negotiating agents.. My realtor and negotiators have forwarded the first lien holders offer to you. You have rejected that offer without showing any validation of who you are. You have rejected the first lien holders offer and you want a extra {$11000.00} on the HUD and yet do you want me basically to take your word that you bought my note? It seems to me that if you want to put this offer, on the table in front of me, asking for the additional money which equals {$11000.00}, then you need to put forth the validation before we can settle the short sale. Again, this is why the QWR is directly connected to the short sale. No one knows who you are. You are mistaken ; this is directly affecting the short sale. I feel like I am being redundant. I bought my property in XXXX, my first mortgage was to XXXX and my second to ( XXXX ). The second mortgage disappeared and did not contact me for several years. In XXXX Trinity Financial, LLC, appeared on my loan and proceeded to collect payments. Trinity was charging about 12 % rate and they increased the principal balance from {$120000.00} to {$230000.00}. Trinity declined the loan modification, while in the process of a loan modification they sold my property. I appealed the decision and they never responded to my request. Through my own research of calling the companies involved, I found that on XX/XX/XXXX XXXX XXXX XXXX transferred 2nd deed to XXXX XXXX and XXXX XXXX XXXX ( now XXXX XXXX XXXX XXXXXXXX ext XXXX ), although the Trust hadn't been created until XX/XX/XXXX. XX/XX/XXXX XXXX XXXX/XXXX XXXX transferred to Trinity Financial oXXXX XXXX XXXX XXXX XXXX/XXXX XXXX XXXX XXXX. - XXXX It literally took 4 hours on the phone with XXXX for them to find it was sold to XXXX XXXX, which is now XXXX XXXX XXXX XXXX XXXX said they bought it from XXXX XXXX on XX/XX/XXXX, then sold it to Trinity XX/XX/XXXX. I don't understand how XXXX XXXX received the deed to begin with. The recorded papers filed with XXXX XXXX County do not match up either. Only filings are the initial purchase recorded XX/XX/XXXX between XXXX and myself and then nothing until two recordings onXX/XX/XXXX. The first, DOC # XXXX looks as if the companies stamped in their information and it still doesn't make sense. The " Note dated : '' is incorrect. The date of the Trust is XX/XX/XXXX, yet the letter was signed and notarized on XX/XX/XXXX The second one is between XXXX XXXX and Trinity Financial Services and this letter was dated XX/XX/XXXX. Even if Trinity turns out to have a legitimate claim to this heloc, they have only offered us two options to avoid foreclosure, come up with {$94000.00} to reinstate the original loan or pay off the total for {$260000.00}. Given we thought the loan was forgiven almost 10 years ago by XXXX ( XXXX Representative and a XX/XX/XXXX loan statement balance of XXXX ) and lack of transparency, we find this unreasonable and unfair.

on XX/XX/XXXX, Trinity Financial Svcs LLC, a foreign company registered in XX/XX/XXXX, is acting as the Trustee for XXXX XXXX XXXX XXXX, a company that was taken over by XXXX. This was part of the XXXX XXXX XXXX award in XXXX. The DOJ XXXX XXXX and other banks. There was a 2nd mortgage that should have been extinguished through the modification process award from the judgment and settlement. XXXX XXXX XXXX did not complete the process. They needed to release the lien through the modification that was approved on the first trust deed. The first and the second trust deed were from the same investor. It was a package deal to purchase the property. When the XXXX XXXX XXXX was award, the loss mitigation department from XXXX needed to correct and fix the mortgages if the consumer qualified. After applying, XXXX approved the modification as the property was approved to be included as part of the compensation awarded. When I got notified that everything was completed and I didn't need to worry on the 2nd because it was included in the Chapter 7 bankruptcy and it was settled, it didn't occurred to me to follow up on everything to make sure there was no mistakes on the modification. My Trust was in XXXX to get the job done. There was a special circumstances under the XXXX XXXX XXXX from XXXX to extinguish these 2nd mortgages. If the consumer filed a chapter 7 or chapter 13 Bankruptcy the lien was to be extinguished. It was a special program to assist the homeowner and fix the mortgages. When my modification was done, they said I didn't need to worry about anything and my mortgage was correct and fixed. Well it was not because it open the opportunity for a company like Trinity Financial to try and collect money they are not entitle too. They are trying to foreclosure on my property that was declared as a qualifying property under the XXXX XXXX XXXX. They are collecting on a debt that they are not entitle to do so. The Assignment of deeds might be a fraud document that was generated under false circumstances.

I was deceived, and my payments went to high. and I could not afford making payments on 2nd TD, I looked assistance to get a Loan Modification with 2nd TD, and 1st TD as well. lender of the 1st TD, they provided a Loan Modification, I am current with them now.for several years. on the 2nd TD, this loan has been sold several times, almost every company who had it, did not pay attention to my request for a Loan Modification. The current company who owns the account is Trinity Financial Services LLC, on or about XXXX XXXX, XXXX, they started to collect for this account, i spoke to them, and nobody paid attention, then I went to a XXXX XXXX HUD approved, who previously helped me to get a Loan Modification on the 1st TD, and on approximately XXXX XXXX, they helped me to submit a Loan Modification Package to Trinity Financial. They received the package and eventually they requested more income documents and more explanations, which I submitted. It has been taking very long time, and no decision, they took the file to Upper management to get an approval, they review the file, and requested more documents, which I submitted, they did not respond, i had to call every week to see if any decision. There are many other actions/activities that looks out of order, and would like to show you, that this company is not complying with Federal Lending Regulations. In future correspondence i can provide more information on this matter. But just as an example they denied me and Appeal to their Decision. I was told that after a Denial, I had the Right to Appeal to the their decision. I need CFPB, help, I do not want to loose my property. please help me. Trinity Financial Services is a company built on purchasing old debt and then threatening or proceeding with foreclosure as soon as the value of you home justifies them doing so. We attempted on several occassions to negotiate a settlement with them but their response was to file a notice of default against us and pursue a foreclosure. Even though the foreclosure would net the company less money than we were offering. Their website suggest work out programs but also touts how investors can receive amazing returns on their investments. The tactics and lack of ethics used in our case are well documented and repeated in several cases based on the number of complaints I saw on the CFPB site however they are currently in violation of Reg Z and the servicing laws designed to protect consumers. Since the notice of default was filed we provided the default amount and reinstated a HELOC that was taken out in XX/XX/XXXX ... ... yes they waited 9 years to file an NOD against us. in fact Trinity Financial did not even have the recorded assignment of the deed of trust when the NOD was filed ... which is a violation in an of itself. That said we reinstated the loan in XX/XX/XXXX and have since made two full payments on the remaining balance. to this date as of XX/XX/XXXX we have received absolutely ZERO communications from them regarding our loan balance, loan number, payment received and applied/or not applied ... ..NOTHING!!! I have sent at least 4 emails and made multiple calls with no response or direction. The fact is there is only one department ... ..loss mitigation. When you ask about loan servicing you get the same folks in loss mitigation. This organization is not equipped to service loans and at this time we believe they are violating the law with regards to providing the necessary statements and documentation of the payments received along with what the balance owed is.

At the end of XXXX my husband and I paid off our mortgage which was held by XXXX XXXX XXXX. This total we paid was part of an earlier government modification. Mortgage was considered paid in full. In XXXX of XXXX we received a notice of foreclosure from Trinity Financial Services , LLC, a company I have never heard of. They did not have any information to give me such as an account number, dates of any transactions ( withdrawals or payments ). We had to retain a lawyer to the amount of several thousands of dollars to stop this foreclosure. Our attorney has requested documents to support this loan on several occasions with no resolution. On 2 occasions Trinity has sent me paper work asking for account numbers and social security numbers from me, which I will not provide. In XX/XX/XXXX I filed bankruptcy due to a predatory con man and all debts were discharged in XX/XX/XXXX. No where in previous paperwork does Trinity show up as a person I owe monies. Every time my lawyer has to contact this company we have high bills to pay. They have had 16 months to provide proof of loan and have not been able to. They should have to remove this debt from the system and be forced to remove the lien they have attached to our home. Recently received a letter from my mortgage company XXXX, saying that Trinity Financial Services LLC is attempting to authorize themselves on our mortgage account. I didnt know what this company was and started looking into it. I found that they filed a foreclosure against us as too. I never heard of this company before and never applied or gotten any loans from them. I havent received any communications before them filling the case either or even the service of lawsuit. I filed a police report and sent Trinity Financial cease and desist letter from attempting to access my information that they are not entitled to. Today I received another letter from XXXX that another request for third party authorization was sent to them by Trinity Financial Services again. It seems that this company has my private information and is using it for fraudulent purpose. It seems that they are ignoring all the rules and continuing to attempt to get the information. In summer of 2019 I had some charges assessed on my XXXX mortgage account. When I called them to ask about it, they told me that it was the charge for the payoff. I have never ordered the payoff. I have requested a copy of it. The form that XXXX sent me had a phone number listed under the requestor. When I searched that number, it came back as the number registered to Trinity Financial Services. This company seems to employ illegal methods to steal my house. Please help.

I purchased a home in XXXX, I had an 80/20 loan but only had one mortgage servicer and made only one payment to them - not two separate payments. In XXXX I had my loan modified, the modification states that I have a new loan with one payment and everything would be brought current, and I had a payment schedule. I have kept to that schedule and haven't missed payments, however, I recently found out that they didn't not include the 2nd mortgage in the modification - even though they told me they did, and my modification agreement states the loan will be current. I have never received a bill, or statement or even knew I had a 2nd mortgage since XXXX. But I recently received a notice of default from Trinity Financial from the XXXX agreement. They have never contacted me or asked for payment. My home has recently came up in value and so they are looking to foreclose, but I'm on time with my first mortgage and had no idea there was still a second. The company is Trinity Financial Services , LLC. The loan modification agreements states that $ XXXX would be added onto my loan, and that amount - as told to me - was to pay off the 2nd and my late payments in total. But when they modified my home loan, they only modificed my first home loan - which was never explained to me. And now the lender with the 2nd lien is coming to foreclose.

I am having a very difficult time with Trinity Financial. It appears I am a victim of mortgage fraud and a predatory lender that has placed a foreclosure sale date on my property and forcing us to do a short sale. In XXXX I had a 1st and 2nd with XXXX XXXX. In XXXX I refinanced with XXXX XXXX and received and 1st and a 2nd. Obviously when you refinance the lenders payoff the previous loans. And from the paper work I signed, that is what happened. I received a 80/20 refinance and no lender would ever subordinate to a line of credit for {$49000.00}. My refinance would have been declined if that lien was not paid or on title. Due to fraud my 2nd lien from XXXX stayed on my title. Apparently not recorded correctly or by illegal fraud. This lien was sold in XXXX to XXXX XXXX and then to XXXX XXXX XXXX who has placed a foreclosure sale date on my property through Trinity. I looked at doing a loan modification but was denied by Trinity Financial. Because of all this horrific fraud I now have to do a short sale to avoid a foreclosure. I am requesting that Trinity Financial place my fraud foreclosure on hold so I can complete the short sale process and avoid a foreclose.

Approximate 7 years ago, I did a XXXX XXXX XXXXs deal instead of going into foreclosure. My concern was that both the first and second mortgage would be paid for and I would be free an clear of the property. I was reassured by the real estate and mortgage company that both mortgages would be paid and I could walk away from the home. Now, I have found that I have an outstanding judgement from the second mortgage company, and they are now garnishing my wages. The only reason I found this out was due to me getting an W2 job ( I have always worked as XXXX ). I found the case online, the process server didnt serve me but a ficticious roommate, I never had a roommate and I dont know the person named that received my summons to court. I have never received paperwork from either the law firm or the second mortgage company requesting payment. I do know that the home was sold to another family, and no Foreclosure legal process ever happened, nor did a judge remove the second mortgage from title. I have been working on a short sale for almost 2 years. The first lien holder is XXXX XXXX and they have given several approvals but Trinity is the 2nd li en holder and they would never cooperate. They wanted it to go to foreclosure. After several attempts to get them to work with us, I tried to reach management and they would never reply to any of my messages or requests. As of Today XXXX XXXX 2017 , XXXX still has no documents transferred and I have made several attempts to get trinity to look into this. I sent Trinity Financial Services an offer letter dated XX/XX/XXXX, to try to settle and resolve an amount that has n't had payment since XX/XX/XXXX. In XXXX I closed on a 2nd mortgage for the down payment on the 1st mortgage with the same lender. I made on time monthly payments through XXXX. During that time the mortgage lender changed 3 times, from XXXX XXXXXXXX XXXX XXXX XXXX, to XXXX XXXX XXXX, to XXXX and Trinity Financial Services LLC, the last lender is attempting to foreclose on the XXXX mortgage stating that I owe almost double the amount of the original loan.
