It is worthy to note that I did not reach out to this mortgage company. I am perfectly happy with my current monthly mortgage payments and can easily pay for them. This company uses predatory practices to lure people into believing the Federal Housing Administration has reached out to them, not a mortgage company. They do this by sending letters in the mail using the same font styles and letter head as a Tax Return, and they even claim they are the owners of the " FHA Streamline Rate & Term Program, '' something only the Federal Housing Administration owns. When I called this company, the first thing they did was ask me for my Social Security Number in order to find my file, and because I was under the impression I was talking to a government agency, specifically the Federal Housing Administration, I gave it without second thought. Then as the conversation continued, they tell me they can lower my monthly payments by {$600.00}, or keep the monthly payments the same but take 5 years off my loan. This sounded great, but I was skeptical and asked to see the details of this refinance in person. They agreed, and said they would send a notary to my house and I could see and read all the paperwork in detail. But before the notary arrived, this company already pulled my credit. They never asked me for my permission, and I was never told the detailed conditions of this refinance or the cost of this refinance. This is a strong-arm tactic aimed to force me to give in to their terms since my credit has been pulled. I will not be strong-armed, and I will not be taken advantage of. I have opened over XXXX credit cards in my lifetime, and I have pulled my credit even more times than that, and EVERY SINGLE TIME this has happened, it has happened with my explicit authorization, either by paper or by phone. When it is done on paper, there is always a disclosure paragraph or disclosure document that informs me that they are going to pull my credit, and where I identify myself and sign agreeing to their terms. When it is a phone call ( like has happened with me with XXXX XXXX, XXXX XXXX, etc.. ) the person on the phone always informs me that they are going to record the conversation, that I must identify myself over the phone, and that they are going to read a disclosure that I must agree to using the words " Yes '' and that no other word could be used ( for example, I am not allowed to agree by saying " Uhuh, '' or " okay '', or " sounds good '' ). But none of this occurred, and yet they pulled my credit on XX/XX/19. This is not best practices, or even common practices. Common practice requires explicit authorization, but they didn't do that because they are a devious, dishonorable company. They knew that if they had asked for my permission to pull my credit, that I would deny them. They knew I would deny them pulling my credit, so they never asked. I then called them and asked them to remove the credit inquiry by sending a letter to the FTC admitting that they had made a mistake. They told me " no, '' and that they had the right to pull my credit because they had " implied consent. '' Those were their words, " implied consent. '' They admitted they don't have explicit consent. They tried to send me a voice clip of my " implied consent, '' but it was just me agreeing to having one of their agents come over so I can read the fine details of the refinance myself so I can be better informed as to whether or not I want to move forward with this refinance -- that is not implied consent, rather it is clear hesitation and doubt as to whether I want to proceed with their refinance. Never in my life have I dealt with a company like this. Every other company uses clear, precise language when talking about topics that can have my credit pulled. Every other company asks explicitly for my explicit permission to pull my credit. Every other company has protocols for how to legitimately obtain my explicit permission. This method of pulling my credit is deceitful, underhanded, and immoral. Everyone knows that in order to purchase a home through a lender, you need to be pre-approved before any seller takes you seriously. You can get pre-qualified, but that will not mean anything to a seller. The pre-qualification is just for you, so that you can determine if you are ready to purchase a house before your credit gets pulled during the pre-approval process. That's the kind of impression I had when I made this call. I made this call thinking I was talking to the Federal Housing Administration, and they were going to give me some sort of pre-qualification letter letting me know a ball-park amount of what my refinancing options are ( exactly how it happened when I got my pre-qualified letter while shopping for my mortgage lenders ). As you can see, it is common practice to give people a ball park estimate in the mortgage financing world -- this is called a pre-qualification letter. That is how they trapped me, they trapped me into thinking I was on the road to pre-qualification, not the road to a pre-approval. To this day, I have not given them permission to pull my credit, and I have not signed or agreed to anything else. I have never even met anyone from this company.

- Received an email on XX/XX/XXXX to contact XXXX XXXX within 10 days to do a refi and get the lowest interest rate - On XX/XX/XXXX I contacted XXXX via telephone and he explained he could get me the lower interest rate to save us a couple XXXX XXXX a month. He said that he would still need to pull our credit and as long as we were at a XXXX or higher that we would be good. He said that when you have an FHA loan that they need to let us know of our better options yearly. He then asked for my personal info to run the credit report. He said mine was fine, but my husbands was XXXX and he would see what he could do. His attitude started going down hill. It was odd. He emailed me the docs and stated that we should get them signed just in case we move forward. -On XX/XX/XXXX he called and said " Hey, what's up with you getting those docs to me ''. It was rude, but i took it as him trying to be kinda down to earth with maybe persuasive behavior. Big mistake. So, I signed the disclosures and sent them on. - On XX/XX/XXXX I emailed him stating that I hadn't heard from him and what was happening? His exact response : U never sent me any docs.. - I replied that I had signed everything His exact response " U never got me any docs id mortgage statement, Isnracne docs, Utltity billnothing '' I let him know that i signed the disclosures and i thought the rest would be submitted upon approval. His exact response " No I cant get ur loan approved without having docs. Weve been waiting for them and Ive called you about fifteen times in two weeks. Can you send them '' - At this point I realized that I had made a mistake by trusting this man. His professionalism and demeanor were horrid, not to mention all of the typos that stood out and made me feel like I was being scammed. I did respond to the email stating in question 15 times? Did you leave a message because I have zero message. I went on to tell him " No thanks, I'll pass and that his attitude is the reason for me to not move forward with him. '' - His exact response " Fair enough XXXX, I can only be me not who you want me to be. Sorry thats not good enough for you maam. Be happy to get the loan done for you. Just let me know. Sorry I didnt leave a voicemail, not really my style. Just get me the docs, lets leave all that other stuff at the door. '' - I did not respond as this was so rude. My name is not drea and he chose to disrespect me like this. I was shocked, I felt so stupid and that maybe he was scamming me and I would lose everything. I then filed a notice with the BBB. While I did that I read several of the same experiences, I couldn't believe it. People were saying that it was a SCAM! Now I am scared. - Jump forward to today, XX/XX/22, I received an email from him - exact words " Too bad u didnt wan na work with meI guess it never really matter cause ur husband has child support leins and u dont do a loan. There are child support leins on ur house '' When I asked for a copy he responded with " Sorry I cant do thatdidnt really like the way u handled our last convo '' - My husband and I have checked with child support XXXX county recorders office and our credit reports ... There are no liens. This man is a monster and may be taking further legal action against him.

I am requesting a refund of the appraisal for which I paid {$550.00} on XX/XX/2018, and of the {$44.00} late fee for our XX/XX/XXXX mortgage payment ( total {$590.00} ). Since learning that that we can not get approved for the refi, I contacted my loan specialist 's boss twice to request the refund, but it has been a week and no response. We were working on closing with the refi lender since XX/XX/XXXX, and after we provided everything that was asked for, we learned last week that the refi was not going to close. Earlier correspondence said the appraisal could not be refunded if we chose to not close, but this failure to close was not by our choice, and the company is not responding to our request to refund the appraisal. Additionally, I paid the XX/XX/XXXX mortgage payment before receiving the message that I should pay it and that the loan would not close, but the date was still too late to avoid the late charge. It was communicated to us in an earlier email to not make the payment and that the company would pay any late charges. Incidentally, the company solicited us by a letter that named the FHA Streamline, during the same month that we initially bought the home. We later learned that we were not home owners of the property long enough to qualify for the Streamlined, and so XXXX XXXX therefore attempted a Simple refi program instead of a Streamlined.

I received a " Understanding your available VA home equity Funds '' letter that appears to be from my current mortgage and names them " XX/XX/XXXX The mail fraud letter is from Caliver Beach Mortgage company. The letter explains that i have XXXX in available funds and i need to call to see how to disperse them. They are defrauding consumers to pretend they are from the current mortgage company to get you to call them and all they do is try to get you to refinance with them.

Caliber Beach Has sent me a request for loan with out me consent. The letter appears like the current Stimulous package from the Federal Government. it states Available funds {$1200.00}.
