I got into contract in XX/XX/2023 to purchase an investment property, and locked in a mortgage rate a few days later with " CalCon Mutual Mortgage LLC dba OneTrust Home Loans '', led by XXXX XXXX as the Loan Originator. Leading up to the rate lock-in, I was provided confusing, mixed information about seller credits, where I was told by the Sales Manager that I could likely get my closing costs covered completely by the seller by increasing the purchase price to offset the seller 's credit. This sounded great, as I was hoping to put all the cash towards at 25 % + down payment only, while having the seller cover all the one-time closing costs. After a few days already being in contract, I found out that the original loan estimates and seller credits were not feasible, as there is a 2 % cap on seller 's credit for investment properties. Yes, I could have done more research coming in to know such a cap existed, but I was explicitly advised to make an offer that was not possible. The other nebulous action that this team took right from our first conversation, was providing enticing rates below 6 %, even though the PAR rate was above 7 % for investment properties at the time. As a less experienced investor, they did not explain that there were large point buy-downs built in right from the start. I ( somewhat naively ) asked the Sales Manager how they were able to provide a rate so much lower than the other lender I was considering, to which they said, " To be honest, I don't really care what other lenders are offering. We know we offer the best. '' This is not an exact quote, and I do not have proof of this, so I understand it carries little weight. But I do remember that moment vividly, as it reflected the salesperson 's quick and frank confidence. My other lender that I nearly selected did not mention the seemingly unlimited seller credits, nor did he start our conversation with the heavily bought-down interest rate. In retrospect, I now know that the other lender was not skipping any steps to get me to the right decision, and would have been the more prudent choice to step through each decision with. I understand I could have walked away at any moment, but I had committed in my mind to securing the purchase of this property, so it would be difficult to back out at this time and start over. With this background in mind, when my offer was accepted, it included {$20000.00} in seller 's credits, which was more than double the 2 % maximum for this investment property. Yet somehow, for the next month as we worked through inspection and repair negotiations, revised closing documents continued to have this {$20000.00} appear in closing disclosures, or other over-inflated credit amounts that were clearly above 2 %. I had asked them on multiple occasions if they would be willing to cover some of the costs as a courtesy, due to the multiple errors I'd faced. They said they would, but it was done in a very nebulous way that was not clearly itemized. Therefore, I thought that the over-inflated seller credit amount itemized in loan estimates was actually just showing that the lender had combined some of their credits with the seller credits that I'd originally been promised, as a courtesy for the mistake. However, it turned out that that all the over-inflated seller credits were true errors, and not the lender 's attempting to provide courtesy coverage of costs. I repeatedly asked if they could provide a straight forward, itemized lender 's credit, or cover my appraisal fee in some way. No one could give me a straight answer for days, until finally the VP of Lending called me and explained that the 2 % cap applies to all parties, not just the seller credit. So finally it was clear why they could not provide a courtesy lender credit, after multiple days were lost in back and forth confusion and incorrect documents. Up until nearly a month into the process, they were still providing disclosures with overinflated seller 's credits. We were working with a slower-moving corporate i-Buyer as the seller, and so having to correct the offer and clarify loan estimates likely costed us days in negotiations with the seller. While this team was not the only reason the escrow period took longer than anyone expected, the ambiguity in their terms and mistakes made in their processing ultimately costed me time, and money. This brings me to the final point of this complaint. The lock-in agreement that I signed, had no mention of the fees that would be incurred with lock-in rate extensions. Yet, as the lock-in rate was nearing its expiration, the only person that mentioned the expiration was my realtor. No one from the lending team reminded me that the rate was expiring soon, nor did they notify me that I was being charged daily fees once the rate did ultimately expire, and needed to be " extended ''. Extensions are commonplace in real estate, and no where did it mention that " extension '' meant " daily extension fees ''. After I'd already been quietly charged 2 days worth of extension fees, the team finally contacted me via text near close of business on Friday, asking if I could sign closing documents via a notary that very evening, in order to prevent further extension fees. This left me no time to organize the signing, so I worked with Title to schedule a Saturday signing. Then, the lenders informed the Title company that they would need to redraw documents ( without telling me ), in order to add the next day 's extension fees to the the closing costs. However, the team did not make the time to redraw the documents before Saturday, so we instead had to push the notary signing until Monday, adding 3 extra days of daily extension fees, despite my readiness to sign on Saturday. Due to this delayed signing that was out of my hands, I asked if they would cover the daily extension fees as a courtesy for those days, to which they very directly declined to do so, with no rationale. Then, when I probed for a reason, they blamed the lock-in rate expiration on my repair negotiation delays, and felt no reason to cover the fees as a courtesy, taking no responsibility for at least a portion of the delays. To be clear, I do not expect them to cover all the extension fees, just the days of Saturday, Sunday, and Monday, since those 3 extra days were added even though I had agreed to sign sooner. At this point, it was clear they were irritated with my request, as I'd asked for courtesy multiple times throughout the escrow period. However being irritated with a client should not rationalize burdening the client with undue financial costs. Ultimately, this entire lending experience bordered on negligence, as almost all communication after the initial sales pitch, I had to initiate contact and request corrections, or clarification of what I was looking at. This team works fast, which may seem good at the surface to get the deal, but too fast may lead to errors and neglect.

I had two refinance mortgages in process with CalCon Mutual ( One trust Home Loans ) and in the process of reviewing the application I was informed that they would not be able to execute one of my two loans. It was a XXXX XXXX refinance for a primary home. On XXXX XXXX I had a call with the loan officer of record and was informed that a commercial loan XXXX and my wife had would count against me under their guidelines as a " personal '' financed property and that my only option was to pay off a smaller investment property with cash to free up the space to finance my primary. After a lengthy discussion and obvious frustration on my part, because the commercial loan is not in our names personally as indicated by the documentation provided, I told the loan officer that I would just move on. About 30 seconds after the call ended I text the loan officer back and indicated to cancel the investment refi as well. About 5 min later I received notice from the loan officer that he was mistaken and the loan had not been reviewed for exception yet and did I want to hold off until that information was received. My response was in the affirmative. To hold off on all cancelations until we heard back. On XX/XX/XXXX I asked if there was any update via email to which I got a " Nothing Yet '' reply. Roughly the 5 days later I received notification in their loan portal of notice of cancelation for both loans. To that point, I never requested cancelation of the Primary loan, only the Investment. I also should have received a notification of Denial for the primary not cancelation. Lastly, I should not have received that at all since according to all communication I was still waiting on a reply on the exception. I received a reply from a corporate employee that indicated that the LO made a large mistake and was likely to be replaced as 'this would have never happened if a good LO was doing the loan '. On roughly XX/XX/XXXX I send the text message information to the corporate office for review. On XX/XX/XXXX I follow up again. Today is XX/XX/XXXX and upon checking again, I was informed that I would need to communicate with the XXXX. Upon being added to the email chain I was informed that nothing would be done. The additional background here is that I had this company do a purchase prior to this and was in the process of also exploring employment with them. Seeing how all of these loans were handled I had informed that that I was not interested in employment with them as I didn't feel there was a quality match. Again paraphrase. Upon notifying them of this decision, The loan simply stopped and all consideration ended. I would hate to think that this effected the review of the mortgage for accuracy in underwriting and closing but the timing and circumstances are certainly suspect at best. I also received notification that they were covering rate lock extensions and with the market turning it was getting expensive. I would suspect that hedge cost was also a consideration in the decision as the delay was not borrower related. This loan was to be a 2.875 % 30 year fixed on a XXXX primary loan. ( roughly ) The savings represents more than {$800.00} a month in interest and I certainly worth fighting for. The bottom line is that considering the communication I received, I strongly believe a mistake was made and the loan should not not have been denied. I also believe that it was inaccurately handled with regard to withdraw with denial and for those reasons I am asking the CFPB to open a case file and review the chain of events. I attached documentation from the corp employee indicating that a mistake was made in consideration of the commercial loan. See email from XXXX XXXX to me on Wednesday XX/XX/XXXX at XXXX For this reason alone, I strongly fee the loan should be reinstated and allowed to close as planned. I attached the " Notice of Denial '' which you can also see is incorrectly formatted to show Borrower requested cancelation. That is not accurate. I expressly wanted to continue and voiced that in the text message of which you have a copy attached. ( I am the thumbs up reply ) And again, I was told the loan was being denied and as a result only requested cancelation of the XXXX XXXX XXXX.

I purchased a home in XX/XX/XXXX at a price of {$410000.00} with a then appraised value of {$380000.00} using CalCon Mortgage. Within 6 months of buying the home, I paid down the principle to {$250000.00} ( a 65 % LTV ) and requested PMI be cancelled in XX/XX/XXXX. For 2 months, the company didn't response. Finally, the company told me that we needed a new appraisal to cancel the PMI ( which is not an industry-standard practice for a recently originated mortgage of under 12 months, and required me to pay a fee of {$150.00} to have your appraiser look at the home ). Their appraiser came back with a value of {$150000.00} on my home as of XX/XX/XXXX. This is complete nonsense and incorrect. Per the attached ( " scan copy.pdf '' ), the appraiser compared my home against 6 other homes in the area but they are not comparable properties. Here is my issues that I am disputing your appraised value based on : 1 ) All but one were older than mine. ( no compensation was made for this ) 2 ) The square footage your appraiser listed is incorrect for my home ( 1500 sq feet listed, but my home is 3800 sq feet ) 3 ) Appraiser listed my house as a 8/3/2.2 ( Total, Bed, Bath ), but the house is 11 rooms, 3 bedrooms, and 3.5 baths ) 4 ) Appraiser claimed no significant improvements were made to the home since purchasing, but a new $ XXXX solar/battery system was installed 2 months before the inspector arrived and no credit/compensation was made for this 5 ) Appraiser didn't account for air conditioning and heating ( which every room has ) Per industry-standard practices, a home that is paid down to at least 78 % of the LTV should be able to remove the PMI. Per the above mistakes on the part of the appraiser, I am once again requesting the PMI be removed from my mortgage as of XX/XX/XXXX ( my initial request to the company ). If you are unable or unwilling to meet this request, please provide the reason why you believe this appraiser is valid and that the home has dropped over {$250000.00} in value in under 8 months because the local market has not seen any decrease in values of the real estate market, in fact, real estate has been selling at higher prices recently. At this point, it is my belief that thecompany is simply trying to push me from department to department to delay the removal of PMI, even though the home covers the LTV even at a lowered appraisal than the purchase price ( but the value of {$150000.00} is not even in the ballpark of reality ). When I talked with the customer service team, they stated I needed to email my concerns ( which I did on XX/XX/XXXX ) to XXXX. It has been over 3 weeks and the only reply I received was the automated message within 5 minutes saying " Your email was received ''. I called the company this morning, was transfered from person to person for 45 minutes, and told, " we don't see your request or email, please submit again ''. There is no common sense being applied and the mortgage company is being unhelpful and uncaring. I believe they are doing this simply to continue collecting PMI every month. The PMI should have been removed back in XX/XX/XXXX when the principle was paid down to 65 % of the original loan amount, and now I am continuing to be told to jump through hoops. I am submitting this request to document the issues with this company in hopes that they can resolve the issue and warn others about these deceptive and dishonest practices being used by CalCon Mortgage. Contracted with XXXX XXXX in XXXX, NC regarding the construction of a new home. After speaking with the XXXX sales rep, decided to move forward with their preferred lender due to the incentives. Scheduled an appointment to talk with the lender, XXXX XXXX, with XXXX XXXX on Monday, XX/XX/XXXX. At that time I explained to him that I was looking to apply for a USDA loan and to pay off an installment loan with NC State Employees XXXX XXXX XXXX to improve my XXXX. He said he understood this and would get back to me in XXXX weeks since underwriting was behind. On Monday, XX/XX/XXXX, I learned from my realtor calling me that XXXX XXXX 's manager, XXXX XXXX, completed my file on Friday, XX/XX/XXXX since XXXX was out of office and denied my application. Mr. XXXX called XXXX to inform them I did not qualify, but did not contact me. I learned on Monday from talking with XXXX at XXXX that my application for a FHA loan was denied due to Debt To Income and that they would be putting the home I contracted back on the market. This was in contradiction to what Mr. XXXX and I discussed regarding me paying off my loan and requesting a USDA loan. After calling multiple times, I finally got in touch with Mr. XXXX who informed me that my debt to income was high based on the information my HR submitted on the Verification of Employment. I emailed my HR on Monday afternoon and received a response Tuesday morning that they did not indicate on the VOE the things Mr. XXXX claimed and verified my income and other earnings on an email I CC 'd Mr. XXXX on. Due to OneTrust Homes not verifying the information on my VOE wth my HR and doing their due diligence, I have been unduly denied credit that I believe I would otherwise qualify for which caused me actual damages in losing my home. I have tried several times to rectify this issue with Mr. XXXX, including calling their corporate office. I finally reached him on Tuesday, XX/XX/XXXX in the evening and he said he would re-evaluate my application and get back to me in 3 hours. Two hours later, he texted me saying that he would contact me by noon on Wednesday, XX/XX/XXXX. It is now XXXX XXXX and I have not received any communication from him or his office. I believe I am purposefully being lead around as to allow time for XXXX to sell the home that I contracted to someone else since it has been made clear several times that OneTrust and XXXX are in communication and yet no one is communicating with me. Again, if the manager had any questions about my XXXX, he should have spoken with my HR instead of assuming and denying me credit based on what he believed and not what was verified. My name is XXXX XXXX, I have been seeking to purchase a home since last XXXX. I have researched a few down payment assistant programs that are available. After careful thought and research, I decided to pursue XXXX. I have been interested in purchasing the following property : XXXX XXXX XXXX XXXX, which I had under contract since XXXX/XXXX/2017 XXXX XXXX has had access to this loan since XXXX/XXXX/XXXX. I have been trying to Close on this property since, and it has been a heart-ache to say the least. Just to let you know I am aware that the process for XXXX is 60 days closing rather than the customary 30 day closing I have used ( Calcon Mutual Mortgage / OneTrust Home Loans ) in XXXX, GA region, because this is XXXX of InvestAtlantas preferred lenders : I was informed in the latter part of XXXX that the original Loan Originator was no longer with company, so it was transferred to another Loan Originator, the Loan Processor remained unchanged. Just to provide a brief run-down First, they appraised the home without including the renovations of the home. I requested to the loan originator that he re-submit the appraisal to reflect. It took them two weeks to re-submit, that was after I requested again that it be done so. I was scheduled to Close on this home XXXX XXXX, XXXX XXXX, and XXXX XXXX, each time I have been left in the dark by the Loan Processor, and unaware of the reason, no communication was initiated from the Loan Processor/lender of the explanation of why it wasnt going to Close. Sadly, the communication that I wouldnt Close came from my realtor and in turn he received it from the Closing Attorney. XXXX XXXX Close, I was informed by my realtor that the Closing attorney was advised by the lender that the loan was cancelled. When I reached out to the lender she advised that they would re-submit the loan due to the duration of the loan is too long and the new loan originator didnt want to Close, and the former loan originator is no longer with the company. At this point I just want my money back ( appraisal fees and earnest money at minimum ) which I have reached out to the lender and I havent received a response, other than to resubmit the loan process. I purchased my home in XX/XX/XXXX. My first payment was due XX/XX/XXXX. The first payment was made to CalCon dba One Trust Home Loans on XX/XX/XXXX. XX/XX/XXXX I was notified that my loan was being transferred for servicing to XXXXXXXX XXXX payments were to be sent to XXXX on XX/XX/XXXX. XX/XX/XXXX a new transfer letter was sent stating that my loan was being transferred from CalCon ( acct XXXX XXXX to CalCon ( acct XXXX ). So on XX/XX/XXXX I made the XXXX payment to CalCon ( XXXX, as they they stated acct number XXXX would accept payments until XXXX ) On XX/XX/XXXX I received an additional transfer letter stating that the XX/XX/XXXX letter was sent in error and I should not send payments to the new account number ( XXXX XXXX, but should continue to make payments to acct XXXX. I then made my XXXX payment to XXXX on XX/XX/XXXX. XX/XX/XXXX, I received another transfer letter that the loan was going to XXXX. Throughout this process - XXXX was not notified they did not have my account and every time I called CalCon they said the account was theirs and not XXXX 's account. The issue is now XXXX actually does have my servicing of this loan but they are in belief they have had it since XXXX and they have now reported me as making a late payment and as of XX/XX/XXXX ( that is the date the payment was reported late ) my credit score has just dropped XXXX points as a result. The other issue of concern is that both XXXX and CalCon have been reporting to the credit bureaus the same loan and it looks as if I have over {$400000.00} in mortgages and I only have a {$200000.00} loan. At first it would have affected my ability to refinance as it looked as though I had 2 mortgages ... now it is seriously hurting me because I am being reported as late and I have made all of my mortgages on time. I sent emails to both companies and the only response that I receive from CalCon is an automated " we have transferred you loan to XXXX effective XX/XX/XXXX and if you have any issues, you need to contact XXXX ''. I have received this automated email at least 3 times and no one is addressing their mistake and the financial harm that they have caused.

I would like to be refunded my {$480.00}. I filed a complaint due to negligence on this company before that their staff didnt move forward with a home loan, they pushed off Closing on a home several times with no legit reason. In XXXX XXXX, I was assured by the CEO that his Sales team had spoken with the listing agent and seller and everyone was on board about selling the home to me and that the lending team would be right on it to Close on the home. Sadly, another broken promise, I happen to be surfing the web XXXX XXXX/XXXX/XXXX & notice that the house was up For Sale. Very disturbing I reached out to the VP of Loan Sales and Loan Processor to inquire. The VP of Loan Sales said that he wasnt aware, & that I needed to reach out to the Realtor. Ironically, VP of Loan Sales XXXX mention to me that neither the Listing Agent, Seller, nor Realtor agreed to selling the home to me, even though for the past 20 days he and his Loan Processor have been requesting documents from me going back & forth of information they needed from me. XXXX XXXX, XXXX I emailed him to inquire if there was anything else needed for t set a Closing date XXXX. Loan Processor mention that when she return XXXX she get all my paperwork that I sent to her ( per her request ) on XXXX she would review when she returns from being away from the office. Just as a note, in the event they may say, that there is miscommunication between CEO and VP of Loan Sales, not true. I was informed that VP would be handling in place of the previous staff, to assist me in getting this carried out. The VP of Loan Sales emailed me XXXX that the seller nor the realtor didnt agree to re-write up the contract to sell the home to me. I find very strange why would they have me go through all of this in the first place then. I received word that the house was under contract with someone else XXXX by another realtor, and another listing agent. I was thoroughly misled. Truly bad business. This has been ongoing for some 7 months, I just would appreciate, since the last resolution per the company was to sell the home didnt come to pass, that refund is in place.

I purchased my home XX/XX/XXXX. My payments are XXXX each month. The first week of XX/XX/XXXX I was informed by letter that my mortgage payments will increase from XXXX to XXXX beginning XX/XX/XXXX. I called to find information as to why the increase. No one could answer the question. All I could get was my escrow account did not have enough money to pay. They could not tell me why. I was sent to lost mitigation department to start the process. I was sent a packet to fill out. In the meantime I had to find out why. I learned that my taxes for XXXX was paid for the entire year and my insurance was also paid for the entire year. I contacted XXXX County in XXXX south carolina. I was informed that I was due a refund of XXXX because of the 2 % reduction of taxes. I called calcon and they didn't have any of the information, and was not willing to work with me. I again contacted XXXX XXXX to track down the issue. The check was sent to calcon on XX/XX/XXXX. I contacted calcon with the information and one office didn't have and I was referred to another office and they had just received the check on XX/XX/XXXX. I was told to give them a couple days and it should be processed. On XX/XX/XXXX I called to inquire and I was told that they had not processed the check and to give them a couple more days. I also inquired about the tax and insurance being paid out for the entire year of XXXX. She said that a analysis would have to be done. I requested that it be done because the error was on their part and they needed to correct it. It has been a week and still nothing has been done. Another payment is due XX/XX/XXXX. I had to borrow the money for my payment of XXXX, but I don't have the funds for the XXXX payment. After I did the math ... I don't owe anything extra. They have drug their feet for almost 2 months. How can I get them to correct this issue that they created.

Applied for financing a new home. XX/XX/XXXX Submitted all documents for a loan with XXXX XXXX Mortgage Loan Originator NMLS # XXXX TEL ( XXXX ) XXXX MOBILE ( XXXX ) XXXX FAX ( XXXX ) XXXX XXXX Asked whether I was approved and told via text that I was and on XX/XX/XXXX that an appraisal was due. On XX/XX/XXXX was told no appraisal and that by loan officer XXXX she would order a new report of appraisal. Via text on up to XX/XX/XXXX I am told that no appraisal has come but now the builder, XXXX XXXX will pay for a " new '' appraisal and asked to ok the extension while a new appraisal is done. I ask what about the first appraisal I paid for and told which ever one comes in first we could close the loan. XX/XX/XXXX I notify XXXX XXXX of XXXX XXXX that I have lost confidence with the loan officer as she has been stringing things alone and does not keep me informed. Am told that her company filed a complaint with the loan department on the delays and I asked to be a party on the complaint and where do I call. Then told it is not the loan department but it is the appraisal management company and I ask again what and how do I FILE THE SAME COMPLAINT. No answer XX/XX/XXXX XXXX XXXX meets with appraiser on new appraisal XX/XX/XXXX The Lending company ask me to sign more documents via their web portal and I am suspicious XX/XX/XXXX XXXX XXXX calls and tells me the appraisal is in and I need to esign with the lender XX/XX/XXXX XXXX XXXX Property Manager calls and I say I am seriously upset with all the delays and I have informed his sales rep, XXXX XXXX of XXXX XXXX and how delay after delay has cost me in buying a new home and renting my current home. Inform him how displeased I am and may need a loan officer I can trust.

OneTrust Home Loans is actually the fictitious business name of Calcon Mutual Mortgage, LLC, a XXXX LLC headed by CEO XXXX XXXX ( XXXX ) and his brother XXXX. On XXXX/XXXX/2016 I recieved a solicitation telemarketing call from one of the employees, XXXX XXXX from his personal cell phone at XXXX. I asked XXXX how he obtained my personal cell phone number. He stated that he got it off of one of the tax returns of his mortgage loan client. I was shocked. I said " seriously you got ta be kidding ''!!! He actually pilferred confidential information off of a clients tax return. XXXX!!! If you use these wierdos your privacy is gone forever. To steal information off of a clients tax return and use it for telemarketing is beyond bizarre, it is likely criminal. Now for the wind up ... my cell phone is on the do not call list. I am registered. These OneTrust guys can not be trusted with your information and they do not follow the laws. It is in fact a crime to violated 47 USC section 227. Dear Sir or Madam, On XX/XX/XXXX I inquired about a home purchase with XXXX and my credit was pulled for a USDA loan only. This credit inquiry is currently showing on my credit file as XXXX XXXX XXXX XXXX XXXX. On XX/XX/XXXX I got another inquiry from their preferred lender, Calcon Mutual Mortage via XXXX XXXX also known as One Trust Home Loans. I immediately called them and told them not to access my file again and to remove the inquiry. XXXX XXXX advised me that the inquiry would only count as one and that he could not use the fie obtain thru XXXX XXXX although they are located in the same office. On XX/XX/XXXX the lender again accessed my credit file without my permission this time showing up as XXXX XXXX XXXX via XXXX XXXX. On XX/XX/XXXX an email was sent stating I wanted to cancel my application with this company due to numerous lies I had been told up to this point regarding the home, the loan etc.. The company responded by sending me a statement of change letter on XX/XX/XXXX stating my application has been withdrawn. On XX/XX/XXXX the company again accessed my credit fraudulently, without my permission this time using the name XXXX XXXX XXXX XXXX XXXX. On XXXX I was advised that XXXX XXXX could not approve my USDA loan but was able to get my approved for other loan types that I did not give him permission to inquire on my behalf for. My earnest money was refunded to me on XX/XX/XXXX and I have not had further contact with this company. The mortgage companies are running me ragged in a circle by saying the next company will received the transferred funds, but it has never met its final destination. I started off with Calcon Mutual Mortgage Dba OneTrust Home Loans ( XX/XX/2020 ) who sold it to XXXX/XXXX XXXX XXXX who sold it to XXXX XXXX ( XX/XX/2020 ). The final mortgage company who had recieved it had not recieved funds from either mortgage company. It felt like the two previous companies don't intend to transfer the funds at all as they keep saying it will get handled, but it never is. I have made two mortgage payments to OneTrust Home Loans of {$1500.00} on XX/XX/XXXX ( recieved via check # XXXX for XXXX ) and on XX/XX/XXXX ( via ACH payment for XXXX ) which was allegedly forwarded to XXXX XXXX XXXX since they said bought my loan in XXXX. After a bunch of poking and prodding they said that the first payment needed to have the principal of {$490.00} needed to be subtracted. Which would mean a transfer of {$1000.00} ( after doing the math myself ) needs to be transferred from OneTrust Home Loans ( and possibly XXXX XXXX XXXX if they are also adamant on keeping some part of the received funds ). So apparently they indirectly implied that it was my job rather than their accountant 's job to tell them to subtract the principal and and how much of the remaining funds that need to be sent, which tells me that they weren't planning to send the funds to XXXX XXXX at all unless I kept asking.

XX/XX/2022 we engaged with Schumacher Mortgage to build a new home and XXXX XXXX discussed with us a XXXX XXXXXXXX XXXX that we use 20 % of our home value down as a pre-payment for a new home. The numbers we discussed were our current home was appraised to sell at {$520000.00} and we owned {$300000.00}. The numbers on our contract are {$300000.00} + {$150000.00} for a total of {$460000.00} to pay Schumacher when we sold XXXX XXXXXXXX XXXX. We sold XXXX XXXX for {$540000.00} and made more profit than expected and Schumacher is trying to force us to re-finance and dictate where the additional funds we made from the sale will go without our consent or agreement. As we discussed {$520000.00} is the number that we would profit for our house Schumacher can not play XXXX with someone's profit and try to tell us as the consumers and homeowners where the funds should be allotted. My husband and I have both tried to talk to XXXX XXXX ( NMLS # XXXX ) and the XXXX XXXX XXXX ( NMLS # XXXX ) to resolve this and we are getting XXXXhree different reasons as to Schumacher is saying that they can take our additional funds and I have read our loan papers and there is nothing, nor is it spelled out clearly and we asked them to highlight it and provide us the terms that show they can play XXXX with our profit. I REFINANCED MY HOME THROUGH ONE TRUST HOME LOANS IN XXXX. THEY FAILED TO ESCROW SUFFICIENT FUNDS TO COVER MY PROPERTY TAXES AND HOMEOWNERS INSURANCE FOR 2017. CLOSING DOCS SHOW THAT A PAYMENT IN THE AMOUNT OF {$710.00} SHOULD HAVE BEEN MADE TO PAY PROPERTY INSURANCE. PAYMENT WAS N'T MADE AND I CA N'T FIND OUT WHERE THAT MONEY IS. ONLY 6 MONTHS OF FUNDS WHERE ESCROWED TO PAY PROPERTY TAXES, PROPERTY APPRAISER WILL NOT ACCEPT PARTIAL PAYMENT AND THE CHECK WAS RETURNED TO THE TITLE COMPANY. OneTrust Home Loans has dragged out the loan approval process for months now, with no end in sight. I have applied for a {$260000.00} construction loan, which, after months of delay on the bank 's part, gained initial approval. They then proceeded to get phone numbers wrong, get emails wrong ( once sending my personal financial information to an unknown email address, which hopefully was not used in any bad ways ), continuously asking for items that they had never asked for before, repeatedly making mistakes on Disclosure Forms, repeatedly asking for information that they already received, changing the terms ( interest rate ) of my loan without explanation, ignoring my emails, and not accepting responsibility for any of it. I have taken quite a few mortgages in my time and this has been the worst process I have ever encountered. OneTrust seems to be completely lacking in systems and controls, unable to manage their work flow, unable to fit together all the pieces of a loan application, unwilling to pay attention to the details, and completely out of their league with respect to handling anything other than a straight w-2 single-family conventional mortgage. It is clear why the mortgage business caused such disruption and turmoil in XX/XX/XXXX/XX/XX/XXXXif everyone 's system is still as broken as that at OneTrust.

We sold our house and was buying a new one. We went through the whole process and got our final approval and the closing instructions but after we signed the paperwork the mortgage company did not send the funds and they called us the next day and told us that they could not go through with it due to our previous mortgage apparently was past due by 120 days. I had been advised once the lender had gotten the pay off on our mortgage to not make any payments as this would alter the payoff amount and they didnt want that to happen. On XX/XX/22 we submitted a request to our lender for our home to be reappraised. Weve completed a substantial amount of updates that would increase the value of our home and property. Once reappraised at a higher value than the original purchase amount, we would qualify for the removal of our PMI. We were asked to give an estimate in cost for the completion of our updates within the first 48 hours. We were told the process could take up to 60 days. Were now approaching the 90 day mark and the lender will not respond to our email asking why the process hasnt started. We believe our rights to have the value of our home reassessed is being stalled or denied.

XXXX XX/XX/2023 : Contacted HOA to inquire about a disclosure on my closing statement that says HOA dues are included the escrow account but the HOA 's official portal says I need to make the payment myself. HOA responded by inquiring with the lender if HOA is included in the mortgage payment and how they process that payment. XXXX XX/XX/2023 : Contacted the mortgage company copy-pasting the section that says HOA dues are included in the escrow account on my final closing statement. Company refutes saying HOA is not a part of monthly payment even though there is a section clearly saying it will go into my escrow account.

My wife and I decided to refinance our house to help lower our payment a little bit. When we met with the company to start the refinance process, we were told that there was going to be no cost to us. Then we get documents that said we needed to bring {$270.00} to closing. We then get communication that we need to bring {$870.00} to closing. We next get a Document to sign saying we need to bring over {$1000.00} to close. We get that issue resolved, but have yet to receive any documentation on anything else. We have had to constantly request updates on where we are in the Funding process.

We were told that by closing in XXXX, our first payment would be due XX/XX/XXXX. When we closed, the date for the first payment was XX/XX/XXXX on the closing documents. We were told by the closing attorney and the CalCon mortgage representative to cross out the date and put XX/XX/XXXX, then initial by the new date. Now, we are being told to make the payment by XX/XX/XXXX ( today ), but it would go to the XX/XX/XXXX payment. We don't wan to pay on what is being called an illegal contract. Please help!
