This has been going on for too long. If this is not resolved I will be obtaining legal help to go after XXXX as well as Preferred Leasing. I am the victim and I have to jump through hoops while the person that used my good name and information is spending their time on some type of new furniture. Why did I get the below email? The police report was done with the XXXX County Sheriff 's Office, which is my local police department, I am confused as to how that is not a law enforcement agency. I also filed a report with the Federal Trade Commission, which was also included in the pdf file that I sent. All the information you state you needed, which I copied and pasted below ( all of the bulleted items ) was included in what I sent to XXXX via this same email address at XXXX on XX/XX/2021. The specific dates are in the police report and Federal Trade Commission report, how I discovered the fraud is in both reports, the known information about the perpetrator is in the reports, the name of the fraudulent creditor and the fraudulent account number is in the police report, the name of the deputy that filed the police report IS IN the police report, the date the report was filed and the police report number IS IN the police report. A copy of my driver 's license IS IN the file that was sent to XXXX on XX/XX/2021. A copy of my utility bill was sent IN the same file that was sent to XXXX on XX/XX/2021. I spent an hour and a half on the phone today ( XX/XX/2021 ) with XXXX a Fraud Resolution Supervisor, going over all of this, therefore, I am thoroughly confused and beyond frustrated that I am receiving this email from XXXX at XXXX on XX/XX/2021!!! In addition, I received another email from XXXX at the exact same time as the one below at XXXX, stating that you will not remove the fraudulent address that's associated with the fraudulent account from my credit report because other accounts on my credit report have that address, THAT IS SIMPLY NOT TRUE, NO OTHER ACCOUNT OF MINE IS ASSOCIATED WITH ANY ADDRESS OUTSIDE OF MY XXXX XXXX XXXX XXXX, TX OR MY ACTUAL PHYSICAL ADDRESS IN XXXX, TX ( WHICH IS A SUBURB OF XXXX , TX ). I have lived in the XXXX, TX metropolitan area for 16 YEARS!! Specific dates such as when the loss or theft of personal information occurred or when the fraud ( s ) occurred, How you discovered or learned of the theft, Any known information about the perpetrator, The names of creditors and account numbers involved in the theft ; Name and/or badge number of the law enforcement personnel who processed the report, The filing date and case number. In addition, please enclose one copy of the below information along with your valid identity theft report : One copy of a government issued identification card, such as a drivers license, state ID card, etc. One copy of a utility bill, bank or insurance statement, etc. Please also include the following identification information : Your full name including middle initial ( and generation - JR, SR, II, III ) Social Security number Date of birth Complete addresses for the past two years -- -- -- -- -- Forwarded message -- -- -- -- - From : XXXX XXXX Date : Wed, XX/XX/2021 at XXXX XXXX Subject : Important Information To : XXXX XXXX XXXX XXXX XXXX XXXX, It was not filed with a law enforcement agency which subjects the person filing the report to criminal penalties relating to the filing of false information. We are responding to your request that information in your personal credit report be blocked due to alleged identity theft. We are requesting additional information that you must provide in order for us to act upon your request. However, we have conveyed your dispute to the furnisher ( s ) of the information directly. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Merchant 's Preferred / Preferred Lease is a company I leased a mattress through to earn credit 3 years ago. I made my payments on time under an automatic payment method. After my last payment, I was still being charged. I called and was told my last payment was late ( for the interest free period in the contract ) and that I owed them over {$3000.00} of interest. This was almost a month after the last payment would've submitted, and I had never been contacted about the late payment. I believed them at this point, without asking for proof, and agreed to either pay the late fee or to turn in the property to resolve or absorb any debt ( an option stated in my contract ) as I was not paying over {$3000.00} worth of interest on a {$2000.00} mattress, a mattress that was still sealed and wrapped as it was a gift not yet opened. After speaking with their supervisor about my situation, they agreed to take a final payment covering the late charges and not to charge me interest nor repossess the mattress. I paid over the phone. Months later, it comes up on my credit report that I have an open account of over {$3000.00} with them. I called, challenged this, and was told they would contact the credit union and to expect a change in 30 days. 30 days came with no correction. I called again, challenged this, and was told it can be 30-90 days. I requested proof showing I completed all my payments and had no outstanding debt with them. They emailed me a completion letter poorly stating this, not including a payment history nor the full amount they collected from me ( including taxes ). 30-90 days later there was still no correction on my credit report. I called again and this time was told that the open account was reporting correctly, that I had agreed to a " settlement '' with their repo department and that the left over interest was now in collections, reporting on my credit, and that I had agreed to this. I asked for proof that I ever agreed to such a thing with any repo department, specifically the phone call ( they record all calls they say ) that entails the entire conversation I had that day with the agent to prove I agreed to this, ever. I also asked for proof of my payment history with them. The first time I was told these things would be emailed to me, ending the call. Nothing ever was. The second time I was told the same by another agent 's supervisor, and was given an email and phone number in case it never came after a week or so. It never did, and I never received a reply after contacting her to follow up. The phone number she gave was one of the the company 's standard customer service lines too, not the agent 's direct line. The third time I called and requested this information I was treated exactly the same. The agent gave me her name, email, and phone number. She, too, never sent me the information and never responded to any of my attempts to contact her after weeks. I then filed a dispute with XXXX. The results concluded a " charge-off '', with no history of any payments I made but one. This affected my credit even worse. I called one last time requesting proof of my payment history and proof that I ever agreed to a " settlement '' ( by the definition they later gave me ) and that I would not get off the line until it was sent. I was told, literally, that they were currently having problems and couldn't access this data, including my payment history, due to a migration of data under a new partnership ... and that the company would not release the recorded phone calls either as they were the company 's property, not mine. I contacted XXXX XXXX dispute specialists and was told that no information was shared with them during the dispute either ; they were given no proof of payment history nor proof that I agreed to the " settlement ''. The conclusion of a " charge-off '' was based solely on the leaser 's word that what was being reported was accurate. XXXX told me that I could file a fraudulent dispute next, in which Merchants Preferred/ Preferred Lease would be asked to provide the information proving their account of my history with them was accurate. That is where I am now, waiting another 30 days. Update XX/XX/XXXX These are the documents I have available and have submitted below previously and as you can see I did not ever receive the entire product and the full product is still reflecting on my credit account of {$3400.00}. If that is the case, I will be more than happy to return the half unused product so this can be removed from my credit. Otherwise, this needs to be changed as an Installment Loan as I was making payments to Own the Product. I am writing to dispute a billing error in the amount of {$940.00} on my credit reports. The amount is inaccurate. I order a sofa from XXXX XXXX XXXX company on XX/XX/XXXXit was supposed to be delivered onXX/XX/XXXX. I waited a couple weeks after the delivery date before I call them to let them know that I never received the sofa. I called the furniture store several times and got the run around about when they would delivery the sofa. When I finally spoke with management, he said they tried to delivery it twice. I asked him when and did they call, and he was not able to answer the questions. I told him I did not believe that they would try to deliver furniture without calling to make sure the customer is at home. He was not able to tell me where the sofa was or if they could deliver it again. I told him to cancel the order because of the poor communication and incompetent about the order. He quickly agreed to cancel the order and assure me he would take care of it, I spoke with him onXX/XX/XXXX. When the manager agreed to cancel my order so quickly that was an indication to me that they never tried to deliver this sofa, I am not sure they every order it. Preferred lease charged me for the furniture twice. I called preferred leasing and told them I never received the furniture, after talking to several people there they all said they was waiting on management to provide the information that the furniture was not delivered to me and to return the money to them. After calling and speaking with several customer services representatives and mangers I concluded that these companies may be running scams or intentionally committing fraud. I have spoken to both companies ; they keep blaming each other and claiming that they are waiting on documentation to prove I did not receive the sofa. Once again it is not hard to prove that something has been purchased and delivered. I am sure both companies know that it does not take 6 months to provide documentation about a transaction for this reason I believe both are involved in scamming and fraudulent activities to consumers. I called XXXX XXXX XXXX on XX/XX/XXXX and spoke with XXXX and he claims this is the first time he is hearing about the incident. He told me he would contact his driver and preferred leasing to resolve the issue. However, I have heard this too many times and nothing has been resolved. In the meantime, Preferred Leasing is still reporting to the credits bureaus that this is a delinquent account. I also was told by management at preferred leasing that they have been getting many complaints from customers about not receiving their merchandise. Once again If you know they are scamming customers why would you continue to do business with them. It is unethical for the company to do business with the furniture company when you are aware, they are scamming consumers. Unless you are part of the scams. I am requesting that the error be corrected, that any finance and other charges related to the disputed amount be removed from my credit reports, and that I receive an accurate statement it has been resolved. On XX/XX/XXXX, I purchased furniture from XXXX XXXX XXXX XXXX in XXXX, MI and the furniture was financed through Merchant 's Preferred Lease-Purchase Services. The furniture was delivered to my home on XX/XX/XXXX, but the sofa ( 1 of 2 pieces of the sofa/loveseat set ) could not fit through my doorway. I was given the option to contact and pay an outside source to break the sofa down so that it could be brought in the house. I decided against it and the sofa has been sitting in my garage, brand new, still in the plastic since XX/XX/XXXX. I contacted Merchant 's Preferred in XXXX or XX/XX/XXXX, to let them know that I was being charged every month for furniture that I am unable to use because it didn't fit through my door. I was told that my account would be noted and to reach out to the furniture store to see if they could pick up the items. I was told that if I couldn't have the items removed from my contract and picked up by the furniture store, the items could be recovered by the recovery team at Merchant 's Preferred and resolved that way. I reached out to the furniture store and they told me that they are unable to pick up the furniture because they don't have a resale license and if they picked the furniture up and attempted to resell, although the items are brand new, they could get into legal trouble. They also said their system wouldn't allow the items to be returned anyway. I reached back out to Merchant 's Preferred to let them know what the furniture store said in XXXX or XX/XX/XXXX and they told me that the issue would be escalated and someone would reach out to me. I've called Merchant 's Preferred 4-6 times between XXXX and XX/XX/XXXX about having the items picked up but I have never been able to speak with anyone in the escalation department, a supervisor, or anyone in the recovery department. In the midst of trying to resolve the issue, I was affected by the Covid-19 pandemic, which they were aware of and I was told that my account would be noted for that as well. However, since I have been attempting to contact Merchant 's Preferred and waiting on a call back to resolve the issue, they are negatively reporting to XXXX that I am past due on my account 60 days, owing {$4700.00}. Preferred Lease has been falsely reporting information on my credit report for the past 6 months. I used this company to lease some furniture and after paying the balance of XXXX on XX/XX/XXXX, I requested to have it picked up. After speaking with the CSR on the phone, he assured me that the account would be marked for recovery status and that the payments would cease. More than a month later, Preferred Lease reports to the credit bureau and flags my account as delinquent. I had called several times because the furniture still wasn't picked up. I called almost weekly, some times more because it was never picked up. I was told that someone named XXXX would call and set up a pickup time. I sent the photos requested, I sent the information showing the payment made on XX/XX/XXXX. The next month, they reported to the credit bureau and showed I was late. I called again, the furniture still had not been picked up. I asked why were they reporting to the bureau when I had asked to have the furniture returned. XXXX said that I was still liable because they had not picked it up yet. I reiterated to XXXX that I had requested several times to have it picked up with no success. I again requested the furniture be picked up. 65 days later on XX/XX/XXXX, the furniture was retrieved. Again, they reported my account as late 60 days and filed as a voluntary repossession. I was told the return was allowed because it was a lease. When I called to ask what was going on, I was told that they were showing the account as CLOSED. On XX/XX/XXXX, Preferred lease was updated AGAIN! From {$300.00} to {$890.00}. The person I spoke with on XX/XX/XXXX, searched and stated that they had no open accounts in my name. It's reported that I owe XXXX and last payment was XX/XX/XXXX. The report dated XX/XX/XXXX shows last payment on XX/XX/XXXX. They are also reporting the account balance as {$3200.00} It should be XXXX because it was a lease, and I was given the option to return it. As of XX/XX/XXXX, this account is still on my XXXX credit report as 90 days delinquent and owing {$3200.00}. I filed a complaint with the XXXX on XX/XX/XXXX and received a response that said the company believed their information was accurate, but that they would request a deletion. The representatives in their customer service department did not seem willing to assist me with anything. I wasted a lot of time arguing with them. I explained that I intended to send supporting documentation and they refused to let me. I eventually ended up talking to someone I thought was very helpful. At first they told me that they'd have a regional manager reach out to the store and resolve the situation on XX/XX/2021. When I called back on XX/XX/2021 after waiting about a week, after their customer service told me to wait 48hrs for the regional manager to get back to me, they said that they couldn't do anything for me since, I quote " they said that they gave you the right mattress so there's nothing we have to do. '' At that point I ended up just paying the full amount because they " informed '' me that they would put the account in collections along with extra fees if I did not pay. I have clear evidence that the mattress set is not legitimate. They gave me a random mattress that's value is unknown and could be used or valued less than the mattress set I selected and purchased.

After I financed the furniture me and my girlfriend split up and I left the house. They said they wouldn't send anyone out until I sent the pictures which I didn't do right away because I haven't been able to access the house to do it. At that point They turn my case over to recovery which never contacted me but claims they sent someone out to pick up the furniture which honestly is impossible because nobody contacted me and I never sent them pictures so they put my account back in active status and started charging me again. Payments were supposed to stop once it was in recovery mode which that never happened. The collection calls continued as I tried to explain that their account should have Been in recovery status. The customer service ages or bill collectors work extremely rude have hung up on me numerous times have called my phone and hung up as I answered and every time I ask for a supervisor no one can help me. 1 person took my information for a supervisor to call me and I never got a call. I've even Insisted they go back into the notes in C and I even mentioned that if all calls are recorded then it should be listed on the recorded call which nobody still has answered my questions. It gets to the point where if mentally abuse me and threaten me that if I don't pay them that They were not coming to pick the furniture up. This back-and-forth and threats or extremely uncalled for And therefore I would like to make a complaint. No one is still resolve my issue yet this has been going on for the past month. I had went to a furniture store on XX/XX/XXXX received it on XX/XX/XXXX. I would like for my bill to be started fresh in XXXX or I want my lease terminated. I have pictures to prove my case as well as legal papers I had filed for court. Good afternoon, I called Merchants Preferred Lease-Purchase Services several times, and I did not get a concrete answer or solution to my issue. In XXXX, I called and planed an automatic additional payment of {$150.00} of my agreement. The initial agreement was for {$1000.00}, including {$49.00} that I paid when I received the agreement. On XX/XX/XXXX I called to finish paying the outstanding balance of {$270.00} ( amount indicated by the company by phone on the previous call ). I made six payments in addition to the first one of XXXX XXXX already mentioned, so I paid a total amount of XXXX .

When I called to make the final payment, they told me that my final payment date was actually on the XXXX, not XXXX, the one thing that neither agrees with the information previously received, nor with the e-mail sent by you. The email sent by you onXX/XX/XXXX indicates that the recurring fee would be deducted on XX/XX/XXXX, so It is not consistent with the date they previously mentioned. In addition, in my agreement the first payment wasXX/XX/XXXX.

I contacted them not only by e-mail, but by phone a lot of time, and they always told me that the supervisor would contact me, which never happened. They told me that they would check my calls to verify the information they had been giving to me, however I never received that call. On XX/XX/XXXX ( yesterday ) they called to advise that I have to pay more.

I sent letters to them, which I am attaching to my complaint, however I never received response.

I have been not only punctual in my payments, but also I program additional payments with anticipation. I am a responsible person with my debts and my obligations and my intention is to keep myself as such.

For all the reasons stated above, I requested a stop payment on my bank and They are NOT authorized by me to debit any other payment from my bank account.

I have been waiting for their e-mail or call, since XX/XX/XXXX.

On XXXX XXXX, XXXX, I purchased a mattress and box springs from the XXXX XXXX in XXXX, Texas. They had signs all over the store saying " 90 days interest free. '' When I asked the salesman about it, he told me that they had several sources for loans with 90 days no interest. He submitted my application and told me I was approved. He printed out the contract with the loan company, Merchants Preferred. The contract was XXXX or XXXX pages long and I just had to initial XXXX page and sign the last page and the Sales Receipt. The price for the bed was {$490.00}. He told me several times that there would be no interest until the 90 days was up, and that at that time, if I had not paid the bed off, that the interest would be pretty high. He turned the pages quickly, as he commented on what a certain page was telling me, and I signed it. He also said, " Just because you are paying {$41.00} every 2 weeks does not mean it will be paid off at the end of the 90 days. '' I laughed and said, well I would n't think it would be. While I admit that I should have been more cautious, I feel like I was not given all the information in order to make a better decision. I was not given a copy of the contract either. When I called the lender to find out my exact pay-off in XXXX, I was told it was over {$400.00}. I could not believe it. I said, but I 've paid over {$200.00} on this bed already. According to my calculations, I would have owed {$290.00} on XXXX XXXX, XXXX. It was then that I told the representative from Merchant 's Preferred that the salesman never said anything to me about interest being charged during the 90 days. What she told me was that for the first 30 days, the interest is 5 % and then each 30 days it goes up. I think I was not given all the facts about the loan, and I feel like I have been taken advantage of. I am a single woman and live alone, and I do n't have this kind of money to throw away. On XX/XX/XXXX I contacted Merchants Preferred now XXXX Preferred Lease to discuss the balance owed and to create a payment plan. I was in direct contact with a customer account specialist named XXXX XXXX who was able to send me a spreadsheet containing payments made towards the account. We discussed that I will review the spreadsheet and contact her with an amount that I can pay towards a payment plan and what it would look like. When I tried called Preferred Lease on XX/XX/XXXX ; I was on hold for approx one hour and never could reach a live customer agent, I tried again on XX/XX/XXXX and was on hold for yet another hour with no live customer agent. I sent emails inquiring about making a payment plan that went unanswered ; I decided to refocus my attention towards paying other debt that was more responsive. On XX/XX/XXXX, I received an email from Preferred Lease with the subject line reading " Use Your Stimulus Check and Settle Your Account ''. The email contained a settlement offer of {$740.00}, I sent them an email on XX/XX/XXXX stating that I did not want to settle, I would like to pay off the entire balance in full. On XX/XX/2020 I filed several disputes with XXXX using the online disputes portal. On of those disputes included an account known as XXXX XXXX XXXX which was reporting as a charge-off/ collections account. In my dispute I provided XXXX a letter which stated that XXXX XXXX XXXX account was paid in full and the account was closed. My dispute was a request to correct my Merchants Account. On XX/XX/2020, I received an email from the XXXX XXXX Department which stated that based on the documents I submitted with my dispute # XXXX, an XXXX Dispute Specialist modified the account information. When I logged into my XXXX account I observed that my XXXX XXXX XXXX account payment status was updated as now paying/ was a charge-off and I had multiple months of missed payments added to my payment history. On XX/XX/2020 I called to scheduled for furniture leased to be picked up from my prior residence. I established an agreement in XXXX to make payments via auto draft monthly. I was invited via email to take advantage of some payment arrangement options. I called in XXXX to accept the arrangements and make the payment requested. The first payment was made on that call. I opted in for the payment to be auto drafted from the account as they required. The collection calls and emails never stopped. Even after I made the payment in XXXX the company sent another collection email during the same month. The company send emails and calls me as well as my references weekly. I called into customer service and stated that if I'm currently in compliance why are the collection efforts continuing. I recently purchased furniture from a local store in TN and decided to finance it through one of there leasing companies ( 3rd party ) Merchants Preferred Lease out of XXXX, GA. I have almost completely paid off what i owe for the furniture, however recently I've been hit with financial troubles and have not been able to make the bi weekly payments that were agreed upon for the last month or so. I called the company to see if we could work something out or postpone a payment or two until i was able to pay the remaining balance in full but the company informed me they are unable to work with me or change any of the initial agreements. I politely asked for them to discontinue ACH payments via my bank account due to funds not being available in the account on the scheduled transaction dates. Due to that reason, i was receiving late fees & return item fees from both my bank and the lender. I called back again to ask again for this to stop and they declined to do so. Recently, a federal law was brought to my attention that protects consumers in situations like this. I was informed that this federal law prohibits a lender from withdrawing payment after two unsuccessful attempts. I have contacted the company : XXXX XXXX on several occasions. Three times in XXXX, and once today XX/XX/2019. I explained to them that I was terminated from my job a couple of months ago due to discrimination/wrongful termination, and I asked them to please come by and pick up their furniture, which is a rent to own type of contract. I have also explained to them that I can barely make my rent payment because I am currently unemployed, and I have been now for over two months. I also told them that I do not want to have my credit damaged any further by them reporting my late payments due to my hardship situation. They don't listen, they haven't done a thing about it at all. I have begged them to come and retrieve their property so that any further payments can stop, and all that I would be required to pay is the rental amount up until this date. All that they tell me is that I must first bring my account current before I can have the property recovered. Preferred lease was mailed a check in the amount of {$280.00} for the 90 day payoff on my lease. They kep saying it was not recieved. The check was mailed from a title company as I inlcuded it in my home closing. I kept calling and they said it was not there so my 90 day payoff deadline arrived. I am writing Preferred Lease as I now have a better understanding of my rights and violations of FCRA and FCDPA. I had contacted preferred lease in XX/XX/2020 about declared disaster and loss of work. I was told I would have to speak with a manager. Missed the managers call and called back the number left on voicemail which didnt work. Im not sure if it was a personal number. In XXXX of this year I applied for credit with XXXXXXXX XXXX a week are two later I received a call from a lady name XXXX telling me I had been approved for XXXX. On XXXX an account was opened fraudulently in my name and using my social security number. I was notified on XXXX XXXX when a withdrawal in the amount of approximately XXXX was taking from my account. My bank gave my the merchant and telephone number and I contacted Preferred Lease to inform them this account was fraudulent. Preferred Lease directed me to their fraud department and took my information while also directing me to file a police report as well as a FTC report. I followed through but then they requested photo ID, social security card, and other information that I was uncomfortable with being as though this matter was already identity theft. I contacted the credit bureau and had them investigate the matter sending them the information they required. XXXX stated that the account was validated as belonging to me. I asked XXXX to send me what information was sent to verify my account and they stated that there was not anything sent to verify the account that Preferred lease just confirmed by email that the account belonged to me. Signed a contract in which I received merchandise in XXXX, provided checking account and routing number for my payment to be withdrawn from my account in XXXX. The company reported that I missed a payment to XXXX. How can I miss a payment that I provided information to debit my account!? Ive entered a dispute, but Im livid about the unorganized practice of this company. The company sent me a text that my first payment would be extracted in XXXX!!! They have a 90 day payoff term, so by their negligence that would mean I only have a few weeks to payoff my account. They breached the contract and the conditions of it. The company advised me that I received my furniture in XXXX! That information was false, I received my jewelry in XXXX. I have visited the local kiosk and confirmed there is no account. I have been told on several occasions the information would be updated with XXXX XXXX to take the fraudulent and erroneous delinquent account on my credit from Preferred Lease would be deleted. it has been 3 months and they have not corrected my report. They report a fictitious payment made in XXXX 2021. Again, I have no account and I never made a payment. Preferred lease will not provide me with a signed contract or validation of debt including said account where this payment was derived. Bottom line Preferred Lease is in violation as they are reporting fraudulent erroneous information to the credit bureau that is not validated. I previously had an account with Preferred Lease which I paid off in full XXXX month now. I paid off my balance in full in XXXX and the company reported my account as settled and delinquent. This information is not correct, I did not settle, I paid the full balance in full on XX/XX/XXXX, earlier than my leasing end date. They immediately made a report to the credit bureaus only 6 days later that this account is settled and delinquent. I have been in touch with the company and they stated that they would " look into this '' and I should hear something within 30-60 days. This has hindered me from closing on my house. If they were so quick to report inaccurate information, then I believe that they can quickly fix this error. I found out about the debt XXXX XXXX 2020. I contacted the company and as them to do a fraud investigation and they said only if I provide copies of ssn card and drivers license. Now, XXXX gave me items that is broken and I tried over and over to talk with a representative from preferred lease to resolve the issues and every time they transfer me to a number that never answers.
