RE : Attentively review my formal writ composed declaration of not proven complaint misinformation that is all or in part : deficient of the adequate current status in the fullness of TRUTH, ACCURACY, COMPLETENESS, TIMELINESS, documented OWNERSHIP, certifiable RESPONSIBILITY, or otherwise irrefutable, complaint obligatory, and regulatory requisite reporting thereby mandating your immediate actions to rectify and remedy and any infractions behavior ( s ) by retaining or returning to demonstrate TRUE, CORRECT, COMPLETE, and COMPLAINT METRO 2 data field formatted reporting!!! I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX , XXXX , and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with The XXXX XXXX XXXX, Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C. 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. 1. BRISTLECONE XXXX LLC bal. {$4400.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted. I am writing to complain about a loan with Bristlecone Lending that was fraudulently taken out in my name. On XXXX XXXX, 2015, I went to XXXX XXXX. While I was at the store, I asked the salesperson, XXXX, if I had any credit history and could purchase furniture on credit. The salesperson asked for my social security number so he could check my credit history and see if I was eligible for a loan. The salesperson told me I could borrow up to {$3500.00}. I wanted to buy a mattress, but he said I should buy a more expensive item so I could improve my credit. I found a cabinet set I liked and said I would consider purchasing it. The salesperson told me it would cost {$1700.00} including delivery. He then took down my information on a laptop, and said I needed to sign an agreement authorizing the lending company to send me emails. I complied with his requests. I then told the salesperson that before making a decision on the set, I needed to check to see if the cabinet would fit in my living room and wanted to wait until I received by benefits check on XXXX XXXX. The salesperson said that was okay, and provided me a receipt, which I understood to be an offer to sell me the cabinet. I never signed the receipt, and did not pay any money to the salesperson. At no time was I told or did I believe that I had committed to taking out a loan or purchasing the furniture. When I went home, I realized that the cabinet would not fit in my house. I also received an email from Bristlecone Lending attaching a document saying the set would cost me around {$250.00} in monthly payments, and I realized that I could not afford this amount. Because I did not agree to any loan or lease agreement in the store, I did not think the document I received was a completed lease or loan. I immediately called the store and told the salesperson I did not want the cabinet. The salesperson told me that I had to buy the set, and said I would have to pay a cancellation fee of {$390.00} if I cancelled. When I told him I did not think I should have to pay a fee and I could not afford a fee, the salesperson told me there was nothing he could do to help and I needed to speak with the owner, his father. I went to speak to the owner in person, but he told me that I needed to talk to the salesperson, who was not there. The next week I again went to the store : The salesperson again said I could not cancel, but told me I could exchange the cabinet for other items of the same price. He also said I could pay as little as {$50.00} a month, so long as I continued to pay. I again said that I had not agreed to purchase anything and could not afford any payments. On XXXX XXXX, 2015, Bristlecone called me. The woman who called me said that I needed to make payments to Bristlecone, and that if I wanted to cancel the loan, I would have to pay certain fees. I explained to Bristlecone that the loan was obtained through fraud, that I never received any furniture from XXXX XXXX, and that I do not owe Bristlecone any money. Over the last week, I have continued to receive phone calls from Bristlecone seeking to collect debt. I am a single mother of XXXX children whose only income is public assistance, and I am XXXX due to XXXX. Disputing this fraud has caused me a lot of emotional distress. I am reporting this situation because Bristlecone is lending in New York without a license from the New York Department of Financial Services. N.Y. Banking Law 340. Further, Bristlecone has inadequate policies to prevent the issuance of fraudulent loans. Finally, Bristlecone is now calling me as many as XXXX times a day, which is harassing. I am also filing this complaint because XXXX XXXX has committed fraud by signing me up for a loan in my name without my consent and pressuring me into paying a cancellation fee even though I never entered into an agreement with the company.

To : XXXX XXXX XXXX I am writing to dispute fraudulent charge ( s ) on my account in the amount of {$2500.00}, and posted on XX/XX/2016. I am a victim of identity theft, and I did not make these charges. To date I have not received that information. I have received some documents from your office that includes a statement that is signed by someone other than myself. The notice also indicates that the bank account was linked to a institution named XXXX XXXX XXXX XXXX. I have never had an account with this bank. The letter also indicates this was an set up with a retailer XXXX XXXX, please provide a copy of my identification or other form of verification that was used with this retailer to confirm identity. I have also attached correspondence from the bank listed on the documents that also prove that this is in fact not my account. Enclosed is a copy of my Identity Theft Report supporting my position, and a copy of my credit report showing the fraudulent items related to your company that are the result of identity theft. Also enclosed is a copy of the Notice to Furnishers issued by the Federal Trade Commission, which details your responsibilities under the Fair Credit Reporting Act as an information furnisher to CRAs. The Notice also specifies your responsibilities when you receive notice from a CRA, under section 605B of the Fair Credit Reporting Act, that information you provided to the CRA may be the result of identity theft. Those responsibilities include ceasing to provide the inaccurate information to any CRAs, and ensuring that you do not attempt to sell or transfer the fraudulent debts to another party for collection. In addition, under the Fair Debt Collections Practices Act, I have the right to request validation of the debt you say I owe you. I am requesting proof that I am the correct party, and there is some contractual obligation which is binding on me to pay this debt. This is NOT a request for verification via E-Oscar or proof of my mailing address, but a request for VALIDATION made pursuant to the above-named Title and Section of the Fair Debt Collection Practices Act. Reporting inaccurate and unsubstantiated information to a credit reporting agency may constitute fraud under federal law. Compliance with this request is required under the laws of state and federal statutes. I requested Debt validation which was to include the following : 1. Who was the original creditor on this account, and what was the account number? 2. What was the original amount owed? A complete payment history, starting with the original creditor. 3. Documentation that indicates that I agreed to pay someone this sum of money. 4. What was the original date of delinquency for this account? 5. Agreement that grants you the authority to collect on this alleged debt, or proof of acquisition by assignment. 6. What did you pay for this account, and how did you calculate the current amount owed? I require compliance with the terms and conditions of this letter within 30 days of your certified receipt, or a complete removal from my credit profile, in writing, of your claim. In the event of noncompliance, I reserve the right to file charges and/or complaints with the FTC, and appropriate county, state, and federal authorities. I also hereby reserve my right to take private civil action against your company to recover damages. Please investigate this matter and send me a written explanation of your findings and actions.

XXXX XXXX XXXX offered me the option of One Road Lending to pay off the work that needed to be completed on my XXXX XXXX XXXX. The business offered me this option and I assumed when they were working on the computer that this was an online form and had no idea it was an internet company. I was approved for One Road Lending and was told that I had the option of 12 or 24 months to pay off my loan. I was approved for {$1700.00} maximum and {$30000.00} minimum. At this time I verbally agreed with the shop manager who then stated that my new account number would then be e-mailed to me with a phone number to contact the company with any additional questions. I contacted the company and provided them with my checking account information because they stated they had to make sure I had an active account. They then explained that they would pay the retailer and I would then pay them back. However, at this time no financial figures were provided because at this point we were unsure of how much the repairs would cost. On X/XX/17 I went in to pick up my car and make my final arrangements I was told that the total bill was {$1200.00} for the repairs. This was then forwarded to One Road Lending. The retailer then stated that he could not spread the payments over a period of 24 months and could only do a 12 month span. I then asked what this would make my payments monthly. When I stated that this was 50 percent interest he stated that nothing could be done by the retailer and I asked to contact the loan company. I tried to reach out to the loan company over a period of five days and only was able to reach a voicemail that stated that the company is currently closed. The day I picked up my car I also could not get in touch with anyone from the loan company. I tried contacted the collecting company and they stated they could not help me and I would have to work through the lending company. I paid the {$200.00} to get my car back and the manager stated that the contract would be sent to me via e-mail. I have reviewed the contract and have decided not to sign it. Total I would be paying {$2500.00} plus an additional {$170.00} at the end of the loan. I am confused regarding the difference between a lease and a loan as a " closed end consumer product lease '' is stated on the loan. On X/XX/17

I signed a lease with XXXX XXXX back in XX/XX/2017. Once the beginning of the year came around the dog was just not working out. My husband called them and was told that the XXXX payment was going to process and our termination fee would be {$1900.00} something but that each time we paid on time ( they did ACH payments ) that it would go down that amount. So we decided to wait a little while. In XXXX he called again to find out what to do and was told that it was down to {$1700.00} something. I said that can't be right but lets call back and let them know they made a mistake when we decide to get rid of the dog. We give the dog to a no kill shelter because that was the only option we were given- later to find out we could have returned to the breeder at no cost. then when my husband called, suddenly he was no longer authorized to speak with them. So I called and they could not find my acoount even though I gave all of my information. They transferred me to another company- after telling me what to do with the dog and fee 's ( the last conversation said {$150.00}. They told me I needed paperwork and when I got it it was the wrong paperwork.They were clueless about my account until I forwarded them a bill I received after I told them numerous times that I did not authorize another payment. They still went through and tried to take a payment which resulted in me having to freeze and close my account. Before that I was told the amount has gone down to {$1400.00} something. so it's going down with the monthly payments it should be around {$900.00} since XXXX but the story always changes. I request the recordings and was told I could have All of them if I escalate my complaint which I agreed to do. Then was told I can't have any of the recordings. They had told me I could make payments and then I couldn't and then I could. This is a huge scam and because I have been fighting for the truth they have decided that I owe {$1900.00} something again! It is ridiculous!! I would like to send the emails with all the inconsistencies if someone can provide me with an email address. ( I can not attach documents but if I am given an email address I can show you all of the inconsistent correspondence )

This company needs to be held accountable for putting this information back on my credit file. I do not owe anyone for a cell or cable bill. I disputed your inaccurate entry on my credit file back in XXXX and it was deleted. Now you have once again put the inaccurate entry back on my credit file. I contacted the company in XX/XX/XXXX and the file was removed. I was told by a female rep that I wasn't found in their system and they also needed the account number which is only listed on my file as XXXX. They don't even have a complete account number in their system. Also, so never received any type of notice from this place or phone call. I was told the account was for cable or cell but they couldn't tell me which one exactly but it was for XX/XX/XXXX. I have been XXXX since XX/XX/XXXX so I don't have a home to have cable. I have never had cable in my life when I did have a home. I don't owe any cell phone companies either. I want this company to stop putting this inaccurate info on my credit file. I want this entry removed and not placed back on my file. I want them to show me bills with the address listed where they were sending delinquent notices and creditor letters notifying me of the account. They have produced nothing.

The amount due on this account is inaccurate. They are trying to charge fraudulent charges to get more money. The total amount of the product was for {$2500.00}. The amount already paid to them was 9 payments of {$240.00} + {$2200.00} plus initial deposit of {$640.00} bringing that to a total of {$2800.00}. Therefore, this account was paid in full. I have previous documents and statements proving this. I would like this removed from my credit score account. I have contacted them numerous times and all I have been told is that I owe them {$5600.00} more. They constantly threaten that if I don't pay it that they will making this appear on my credit score. They are continuously ruse on the phone to me. Wont try to help me or listen to my concerns.

on or around XX/XX/2017 I started receiving notices from this company XXXX XXXX stating that I had purchased a dog from them for over XXXX dollars at that time I became furious because i had not applied for credit and i have a fraud alert added to my report so before credit was issued they were to contact me. I requested paperwork from the company in regards to the dog all they could provide was a pre printed contract without my signature, I also filed identity theft in regards to this. This company has been very nasty to me and not providing much help. They have been contacted several times by my attorney in reference to this. I have made attempts to have this issue resolved with XXXX XXXX regarding a collection account listed on my credit file. I sent a letter to the company dated XX/XX/18 regarding this fraudulent account and my ID theft report showing that I am a victim of identity theft. The account is not my account and I have never had any business with XXXX XXXX ; which is indicated as the original creditor on my credit file. Going back to the choices of colleges, I never attended Any college, so I dont have Any student loans to pay back. I had to choose a school because the system wouldnt allow me to go forward. These calls for student loans are coming in at XXXX and go on All day long, not to mention home mortgage calls as well. Im getting harassed everyday all day in spite of me selecting the do not call button, they still call. They call and hang up, they call and leave messages, it just continues.

I got this loan for XXXX I made a couple payments on it before I ended up out of work due to medical reasons. I called to explain this the loan was actually a lease on a puppy. When I spoke to them the lady said if I could care for the puppy I should be able to pay my loan. The loan eventually was put into collection and now is totally XXXX. This is outrageous is there any thing we can do. I feel as if I have been taking advantage.
