On XXXX XX/XX/XXXX, I was issued a loan from XXXX XXXX for {$1000.00}. I was in a financial hardship, received a mailer and thought it was my only option. The payments were set at {$200.00} bi-weekly on my paydays. I paid this amount through automatic bank debit on XXXX XXXX, XXXX XXXX, XXXX XXXX and XXXX XXXX. I then requested the automatic debit be cancelled and I began filing complaints as XXXX XXXX/ XXXX XXXX , XXXX/ Braviant Holdings is clearly a predatory payday loan lender. While I was disputing my loan, I mailed a payment for {$200.00} which cleared on XXXX XXXX. I then entered into the dispute phase and awaited mediation with XXXX XXXX/ XXXX XXXX , XXXX/ Braviant Holdings . To date, I have paid {$1000.00}. I mailed the XXXX XXXX payment of {$200.00} which was returned to me for some reason ( I suspect due to Hurricane Florence ). I placed that payment in the mail again on XXXX XXXX. This payment will bring the total paid to {$1200.00}. Per South Carolina law ( where I reside ), payday loan lenders can only charge up to {$15.00} per {$100.00}. XXXX XXXX/ XXXX XXXX, XXXX/ Braviant Holdings is very clearly a payday loan lender. On the {$1000.00} loan, the fees collected should be {$150.00}. Once the payment I mailed XXXX XXXX clears, I will have paid {$1200.00} exceeding the {$1100.00} allowed by South Carolina law. The XXXX website does not show a balance due, however, indicates payments of {$200.00} are to continue bi-weekly until XXXX XX/XX/XXXX. After the XXXX XXXX mailed payment, this means I will have to pay another eleven payments of {$200.00} or another {$2200.00}. This will result in my paying {$3400.00} for a {$1000.00} loan. This means I will pay {$2400.00} in fees ( 240 %!!!!!! ). This is PREDATORY, OBSCENE and APPALLING!!! XXXX XXXX preys on individuals in dire financial situations and profits astronomically and excessively on those situations. It is DISGUSTING and CRIMINAL. On XXXX XXXX, I filed a complaint with the Consumer Financial Protection Bureau and with the XXXX XXXX XXXX. XXXX XXXX responded : We pride ourselves in providing our customers and potential customers with excellent service and we regret that you are unhappy with your experience with us. We take all complaints seriously and, as such, conducted an investigation into this matter. They claim they are not a payday loan company when clearly they are by charging 240 % in interest and collecting payments on paydays! They did not take my complaint at all seriously and closed the case. On XXXX XXXX, I notified XXXX XXXX that I was in an area impacted by Hurricane Florence and to note my account that my payments would be impacted. I received no response. On XXXX XXXX, I notified them again. On XXXX XXXX, I notified them again. I never received any response of any kind. On XXXX XXXX, XXXX XXXX sent me an email stating We look forward to getting you back on track. The email advised to email XXXX for assistance. I have REPEATEDLY emailed XXXX XXXX to resolve this matter with zero responses. On XXXX XXXX, I emailed XXXX XXXX and advised that I have continually reached out for assistance and have continually been ignored. I advised I am in dispute, but could a payment arrangement be made while the dispute is processing. On XXXX XXXX, I forwarded my XXXX XXXX email to XXXX XXXX indicating that I had received no response. I once again informed XXXX XXXX that I have been reaching out for assistance with zero response. On XXXX XXXX, XXXX XXXX sent me an email threatening action. The email said to contact them. I called on XXXX XXXX. I spoke to someone whose first language is clearly not English. I could not understand anything she said. I informed her I was trying to reach a resolution and that I have been reaching out repeatedly. She said she could not help me and transferred my call. I sat on hold for several minutes and then it certainly sounded like the same person answered again. She stated someone would call me in two days. I demanded to speak to someone about my account. She refused to transfer me and hung up. I called back. I sat on hold for 15 minutes. I was then told someone will call me in two days and was hung up on again. So, I reached out repeatedly. I called. XXXX XXXX is threatening me, but XXXX XXXX REFUSES to speak to me. Once my XXXX XXXX mailed payment posts to my account, I will have paid {$1200.00}. XXXX XXXX will have received the {$1000.00} back plus {$200.00} in fees. At that time, I want my account marked " Current/Paid in Full/Closed ''.

I obtained a {$1000.00} personal loan from Balance Credit on XX/XX/2022. Application number XXXX. During the application process I was shown loan offers in the range of 28 %, while high, I thought that since it was such a small loan that I could pay it off quickly. I electronically signed the documents and the funds hit my account a few days later. After making payments as agreed, I noticed a new days ago that the interest rate on this loan is not 28 %, but 280.0068 %!! I did not willingly agree to pay such a high interest rate. No one in their right mind would. I am a resident of Mississippi. Mississippi has usury laws ( inter alia MS Code 75-17-1, 75-67-101 et seq ) that prohibit this type of predatory leading, with the exception of payday loans. This is not a payday loan, it is a personal/installment loan. If you scroll to the bottom of the Balance Credit splash page using a mobile phone, you'll see that they advertise personal loans. MS Code 75-67-109 and 75-17-21 forbid creditors like Balance Credit from engaging in misleading advertising. As stated above, nothing on Balance Credit 's public facing website would lead one to believe that they are about to involve themselves with a 280 % + interest rate personal loan. MS Code 75-17-21 ( 1 ) states in pertinent part : ( 1 ) Notwithstanding any provision of law to the contrary, the maximum finance charge which may be contracted for and received for any loan or extension of credit made by a licensee under the Small Loan Regulatory Law XXXX Section 75-67-101 et seq. ) and the Small Loan Privilege Tax Law ( Section 75-67-201 et seq. ) may result in a yield not to exceed the following annual percentage rates calculated according to the actuarial method : ( a ) Thirty-six percent ( 36 % ) per annum for the portion of the unpaid balance of the amount financed that is not greater than XXXX XXXX Dollars ( {$1000.00} ) ; https : XXXX By the authority of MS Code 75-67-119, usurious interests and finance charges will be forfeited and can be recovered and in relevant part states " [ i ] f any finance charge in excess of that expressly permitted by Section 75-17-21 is contracted for or received, all finance charges and other charges shall be forfeited and may be recovered, whether the contract be executed or executory. If any finance charge is contracted for or received that exceeds the maximum finance charge authorized by law by more than one hundred percent ( 100 % ), the principal and all finance charges and other charges shall be forfeited and any amount paid may be recovered by suit ; and, in addition, the licensee and the several members, officers, directors, agents, and employees thereof who shall have participated in such violation shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not more than XXXX XXXX Dollars ( {$1000.00} ) and not less than XXXX XXXX Dollars ( {$100.00} ), in the discretion of the court ; and, further, the Commissioner of Banking and Consumer Finance shall forthwith cite such licensee to show cause why its license should not be revoked... '' https : XXXX Therefore, the maximum rate that I should be charged is 36 %. Today, XX/XX/2022, I spoke with a customer service rep at Balance Credit named " XXXX. '' She do not provide a last name. In response to an email that I sent to the creditor to ask them to lower my interest rate to comply with what was advertised to me initially and such that it would be in keeping with Mississippi law, I was told " we will not be lowering your interest rate '' and " we are licensed in your state and follow your states law '' without further explanation. In my email, I also explained that, aside from the XXXX XXXX usury laws, that Balance Credit lower my interest rate in recognition of my status as a XXXX veteran and offered to provide evidence of that status. This was ignored. Thus, I'm left with turning to the Consumer Financial Protection Bureau to take action on my behalf. I ask that my interest rate be lowered to 28 %, as was advertised to me. I further ask that any interest that I have already paid over 28 % be credited to my outstanding balance. As I type this, my outstanding balance is {$920.00} after making three payments of {$110.00} and one payment of {$140.00}. This company sold a collection debt to XXXX XXXX dba XXXX XXXX XXXX or they greedily bought this debt. A law suit was electronically filed on XXXX by one of their Attorney staff XXXX XXXX against me for {$2100.00}. However the original outstanding debt I owed to Balance Credit was included in my Chapter XXXX, discharged XXXX and has been in an active amortization plan paid by my Trustee since XX/XX/. That debt amount owed and entered at the time was {$1400.00}. To date 43 % of that amount owed has been paid per my claim register sent to me by my trustee on XXXX. I attended the first court date on XXXX Attorney XXXX represented XXXX XXXX dba XXXX XXXX XXXX that day. I provided my Chp XXXX information on record. And all the collection communications I had with Balance Credit back in XXXX, and that there were no new accounts or no new debt owed to them since I filed my Chp XXXX. The Judge explained for myself XXXX XXXX dba XXXX XXXX XXXX to touch base with info given.Next Hearing was scheduled XXXX On XXXX I spoke with the XXXX XXXX XXXX secretary ( XXXX XXXX XXXX I explained this error to their law suit filing. I was instructed to email my documents and attorney information who filed the Chapter XXXX that shows Balance Credit account was included. I submitted the XXXX XXXX XXXX copies of my Chapter XXXX plan, a Case Asset printout, & Claim Register provided by my Trustee ( showing debts being paid under the Chp XXXX ) I also provided contact information for the filing attorneys office I went through. The secretary verified email and documents were received and would forward to attorney and they would follow up with me I never received a follow up call. I was not able to attend the hearing on XXXX due to work demands. Per XXXX XXXX a judgement was still entered on my name for the FALSELY substantial amount ABOVE the original collection amount nor the amount filed in my Chp XXXX Plan. I immediately contacted the WI CIRCUIT COURT who explained I would follow up with the Collection Firm. I placed a call with the Collection Firm I spoke with their secretary who transferred me to an attorney who NEVER picked up the line. I was on hold for 15mins, I called back 3x and was thrown into a voice mail. I left a voice message explaining my disagreement to them entering a judgement for a debt that is being paid under a Chp XXXX and that I submitted them the proof they requested to verify this information. I then placed a call to the Law firm I utilized to file my Chapter XXXX I spoke with the paralegal she knew my situation right off and and told me she JUST VERIFIED with the collection firm on XXXX the debt for this company was actively being paid! She explained to me the many unfair loop holes that can take place with debt collectors selling debts and judgement tactics used. She asked was I served papers for this debt? I explained, No! I was mailed a copy of the Court Simmons. I was never provided any Original Account Terms Agreement showing this new debt, or Proof of any Collection attempts for this new debt, no proof of signatures from me on this debt to support their claim- NOTHING! Just a notification of a Court Summon showing the complaint and the account number is BLACKED OUT! ( Yeah thats because its the same account! ) She offered to contact this collection firm again to go over more distinct details and verify with them this is the SAME DEBT ACCOUNT! This entire situation has put me through so much mental anguish. I am taking this matter against this law firm as far as it can go!

I took out a loan for {$3000.00} with XXXX XXXX XXXX via Balancecredit.com on XX/XX/2021. At the time I had several other payday loans but was able to make my payments as scheduled. Sometime in XXXX my bank account was severely overdrawn and I contacted Balancecredit.com asking them to stop automatic payments because my account was overdrawn and asked what arrangements could be made so that I don't fall behind. I told the rep that on the website it says that if I can not make a payment on-time they would talk about payment extensions or other arrangements, however they said they could not do anything to help. The person on the phone said they would stop the payment, but that no alternative arrangement could be made and that interest would continue to increase. Balancecredit.com continued to send me emails reminding me I was past due. In the email it said " If you're unable to pay now, please reply to this email to let us know how we can help and when you may be able to make your next payment. We look forward to getting you back on track. '' After bringing my checking account positive again, and as suggested in the email, I responded to Balancecredit.com to ask how I can catch up, suggesting that at the moment I could only afford {$100.00} per month. Balancecredit responded, " Thank you for contacting Balance Credit. These requests must be processed over the phone ... Please contact our Customer Support Team at XXXX to complete this process. '' I followed up with a phone call to the customer service number they gave, and explained the situation to the person on the phone, but they completed ignored me and asked for the entire past due balance to be paid immediately via a debit card. I repeated myself indicating that I could not make the payment and they told me that until I made a payment and re-enabled automatic payments that no payment arrangements could be made. That made no sense to me because if I had the money to pay the past-due balance I would not have been asking for a payment arrangement. The 3 other payday loans I had made arrangements that reduced the interest rate so that it would not grow beyond what I could pay. I feel that balancecredit has no intention of honoring the statements on their FAQ ( https : //www.balancecredit.com/faqs/ ) where it offers to help get you back on track, or the statement in their email that asks for a response, but then they tell you to call customer service, but customer service asks for the full payment immediately. They continue to send me emails saying " Falling further behind will increase your balance on a daily basis, but we want to work together to get you caught up. '' But I have contacted them several times via email and by phone and their only proposed solution to getting caught up is to have me pay the entire past due balance immediately. I can not afford this and I would like to work to get back on track, but I feel all the statements from balancecredit.com either on their website, in their emails, or from their customer service reps are false statements to just get me to make any payment regardless if I can continue to pay or not.

This company ( SunUp Financial LLC ) which I hold No Contract with nor have received services from is a 3rd party agency who has no right to collect anything from the alleged debtor since there is no way they can prove they were on any original contract. 73 Amjur, 2nd, Section 90. You have no right to subrogate ( substitute ) yourself into a contract. Whether it be by purchase, assignment, transfer, or trade. If you bought the debt you did it on your own behalf. Not at the request of any alleged debtor, and therefore are a stranger to the transaction ( voluntary payee ). Reporting of this debt is a violation of the FCRA and the FDCPA. Ive conducted some research on this company and in the state of Missouri this company is not Licensed, Bonded, and does not have a Certificate of Authority to collect in the state of Missouri. This is against the state and federal laws. According to the FDCPA : Under the Act, a debt collector communicating with persons other than the consumer for the purpose of acquiring location information about the consumer shall not : use any language or symbol on any envelope or in the contents of any communication effected by the mails or telegram that indicates that the debt collector is in the debt collection business or that the communication relates to the collection of a debt ; 28. The Missouri Division of Finance is statutorily charged with the licensing, supervision and regulation of state-chartered financial institutions and enterprises. Rescission of Contract. Refused for a cause without dishonur. I hereby rescind my signature and do not consent to this contract with your corporate office. Required Proof of Claim I would be happy to settle any financial obligation I might lawfully have to you, as soon as I have received proof by way of the following Documentation : against me, a Flesh and Blood Man with my XXXX Given name ( XXXX XXXX : House of XXXX ). 1. Validation of the debt ( i.e. the actual accounting showing real losses, if any ) ; 2. Verification of your claim against me ( a Sworn affidavit or a hand signed invoice in accordance with The FDCPA, GAAP, and the FTC ) ; 3. A copy of the original contract signed by both parties and therefore binding both parties to the agreement. They are in Breach of Contract by violating the Arbitration Clause. Once a company charges off the account and sends it to a collection company they are in breach of their own contract. This is against the FCRA.

This company is violating both State of Arizona Laws and federal laws. For state of Arizona laws they are charging interest rates above the allowable state law. After speaking with a debt settlement company they advised me that Arizona caps small loan interest rates at 36 %, and that the interest on my loan far exceeds what is allowed under state statue XXXX XXXX. XXXX. XXXX. Which explicitly states that all the lenders wishing to operate in the state must adhere to 36 % APR small loan cap on loans less then {$3000.00}. After speaking with the state attorney General they confirmed this loan would fall under this statue. After advising the company of these they responded with the following : Our records indicate that on XX/XX/2021 you signed a consumer installment loan agreement with XXXX XXXX, which clearly discloses that the lending entity is XXXX XXXXt, a division of XXXX XXXX Bank, a Utah XXXX bank, located in XXXX, Utah, Member FDIC. Pursuant to the terms of the Loan Agreement with XXXX XXXX, you were funded a loan in the amount of {$1500.00} on XX/XX/2021. XXXX is a Utah state-chartered bank with the Federal Deposit Insurance Corporation as its primary federal banking regulator. Consequently, XXXX is governed by both federal banking laws and the laws of the State of Utah. Balance Credit is an authorized servicer of XXXX XXXX, a division of XXXX, retained to perform certain marketing functions for the benefit of XXXX XXXX. In signing the Loan Agreement, you expressly agreed that " You acknowledge and agree that this Agreement is subject solely to applicable Utah and Federal law. '' If the terms of the loan were not acceptable to you, the Loan Agreement provided for a recession period. However this set up is still illegal under federal law, the true lender rule repeal that happened in XX/XX/2021 made it clear that a bank can not be considered the true lender if the loan is managed by, sold to or sourced from a non-federally regulated financial institute. After the repeal, the instructions where clear. Lenders will no longer be able to get around consumer protection laws like interest rate caps just by putting a bank 's name on their paperwork. They are illegally trying to circumvent state of Arizona max cap rates, and their is laws that explicitly forbid their business model.

I have received several calls about this debt from XXXX. I was unable to locate the company online and the representative for the company would not provide any further information. I spoke to a XXXX XXXX at the number XXXX XXXX XXXX several times. He informed me that I owed a large debt and he was attempting to serve me as a result of the lawsuit XXXX reportedly filed. I asked for verification of the debt and instead of providing it Mr. XXXX used derogatory and abusive language suggesting that I was " wasting his time '' and that he doesn't have time to deal with " people like you ''. Mr. XXXX directed me to XXXX XXXX, the purported originator of the debt, and XXXX XXXX, the current owner of the debt, and told me to take it up with them. Mr. XXXX informed me that he would only accept payment for the loan over the phone but would not give me any information about the litigation proceeding that has allegedly been taken. I told Mr. XXXX that I would like to dispute the debt and that going to court was probably unavoidable because I don't recall ever doing business with any of these companies. He said the debt was undisputable and to either give him a credit card of " get the XXXX off my line ''. I again told Mr. XXXX calmly that I just wanted to get a copy of the documents that said I owe the debt but he would not provide them, instead he listed several bits of information, my bank account number, social security number, and place of employment. He said he was tired of " people like you '' trying to wiggle out of things. Upon examination of the form contract that I allegedly signed from the XXXX XXXX webpage, I noticed a mandatory arbitration clause that would preclude either party from filing a lawsuit. Noting this I called Mr. XXXX back at the above number and informed him of this and that I would like to use the arbitration process to dispute the debt. Though I don't recall ever doing business with XXXX XXXX, if that is indeed the case then I would be able to dispute the debt this way and the lawsuit that Mr. XXXX said that he had filed in " Federal court in XXXX XXXX '' was either a lie or not valid. I was alarmed at the strong arm tactics and the abusive language he used to try and convince me I owed something I don't recall owing.

Ive already made a complaint about this company before but I just want to make another so everyone is aware from my awful experience dealing with Balance credit ( https : //secure.balancecredit.com/portal/payments/schedule ). So I got a loan in XX/XX/2020 with this company. The approval process is fairly quick. The interest rate is ridiculous 200 %. So I borrowed {$2000.00} and I had a payment due every two weeks for {$180.00}. Ive made extra payments and I tried to get the payment negotiated to {$100.00} a month which they did but then of course they dont tell you this they turn around and report a 30 day late to your credit report. So it doesnt matter if you and a payment plan or not they will still constantly call and harass and will still report a late. If youre even a day late or even if youre paying all the time theyll send you email constantly and call you all the time. The customer service is awful they are overseas they talk like robots dont understand anything. So this company is awful this is the worst online lending company by far. Like I mention if you struggling to make a payment or ask for a lower payment they will lower your payment but keep the interest-rate exactly the same but then will report a 30 day late. So I am writing this complaint again to hopefully warn others to stay away from this company dont do business with Balance Credit at all do anything that you can borrow from friends or family. Its not worth it at all because like I said in my case I borrowed {$2000.00} and before my last large payment I still owed {$2500.00} because of the interest rate. So anyone even considering this company dont do it it will be the worst mistake. So I repeat do not even consider getting a loan with this company you will regret it. Not only will they get you further in debt but then if you try to negotiate payment they will report 30 day late and like I mentioned they call and harass every day for payment if youre even a single day late or even if youre in a payment plan they still call and harass you. Im lucky I borrowed money from XXXX XXXX my help my dad as he cosign and I will be paying off this loan.

There are two companies involved here. One is SunUp Financial d.b.a. Balance Credit ; the other is XXXX XXXX XXXX. In XXXX of XXXX I took out a loan with SunUp/Balance Credit. It was predatory -- 227 % -- but I knew I would be paying it as soon as the funds from the sale of my house arrived. In XXXX I mailed a check to pay off the loan, but when someone from SunUp/Balance Credit told me of the hundreds of dollars of interest that would accrue while they verified the check, I canceled the check and sent a cashier 's check instead. When they received the cashier 's check, SunUp/Balance Credit sent me an email saying that my loan was paid off. The email said that I could get a paid off letter from their Website by logging in to my account, so I logged in and retrieved the doc. ( It is a copy of the original loan doc with the words PAID IN FULL superimposed across each page. ) Then two-and-a-half years later I was contacted by the collection agency XXXX XXXX XXXX saying to send {$5000.00} for this loan. Despite sending them my evidence and explaining to them that the loan is paid off, they continue to keep this on my credit report and continue to send me letters asking for payment. My son has two XXXX XXXX. If he were to catch the coronavirus, it would most likely be fatal. So when my employer reopens their doors, I will not be able to go back. For that reason, my wife and I plan on selling in Southern California and moving to Texas where things are more affordable. The problem is that my credit rating makes it difficult for me to qualify for a loan and Im not able to do anything to raise that rating due to XXXX XXXX XXXX reporting that I owe for a paid-off loan. My two-and-a-half pieces of evidence : 1. The email from SunUp/Balance Credit saying my loan is paid off. 2. The Paid in Full doc from Sun/Up Balance Credit. 3. I did not save the copy of the cashiers check ( I figured numbers 1 and 2 would be enough ). But I do have a bank statement showing a cash withdrawal of {$5000.00} ( used to buy the cashiers check ) on XXXX. The paid-off email is dated XXXX. This is my half piece of evidence.

On XX/XX/2019, I woke up with a knock on my door from two local law enforcement officers. They informed me that a family member had called in and wanted someone to stop by the house to " check on me '' after several family members had received several calls from a lady named, XXXX XXXX, who was requesting to verify my identity information such as my SSN, location, employment whereabouts, and other identifying factors. Immediately, I retrieved my phone and had several text messages from my dad, sister, and brother who had all received calls and voicemails from this individual stating that she was needing this information. My brother reported that he was contacted by her twice. I, myself, also had one missed call and voicemail from Ms. XXXX postmarked at XXXX on XXXX XXXX. She at time, threatened, that she needed to verify my information through a third party including my previous employer if unable to contact me and shortly began harassing my family members for information thereafter. I'm uncertain if she contacted my employer or not as that is the employer I no longer work with, When I contacted Ms. XXXX, she informed me that she was a representative with XXXX XXXX XXXX XXXX who was assisting a debt collector, XXXX XXXX XXXX, to obtain some past due money owed to an original creditor called Balance Credit. She informed that I should've received a letter from her agency in which I did not. She also threatened that a certain amount was owed or a judgement would be pursued against me. Her whole approach appeared to be threatening and harrassing in nature in order to obtain funds. She informed me the only way to stop the judgement would be to set up a payment arrangement through her. I have no issue paying my past dues if I would have received information from the original creditor and I have not. I feel my rights were extremely violated and that threatening and harassing means were utilized in order to obtain a debt which not only impacted myself but also caused extreme fear, stress, and worry in my family who had no idea what was going on.

On XX/XX/2020, I took out a payday loan for {$800.00}. I have taken out several loans in the past with this company and my employment and contact information has not changed including paydays ( XXXX and XXXX ) of each month. To date, I have made a total of 3 payments with 1 of the payments not being scheduled in order to help lower the finance fee. Here is the break down in payments. My initial contact with XXXX XXXX them was in XXXX when they called my brother, sister and mother and told them I have a debt and someone will be coming to their homes to find me. Then received over ten calls from someone who would not identify themselves but stated that a representative will be at my door to serve me with papers and I will need tow forms of ID to identify myself. I finally got through to a different representative who told me I owed a debt to Balance Credit and it was about to be submitted to court. I told them was unaware of this debt and to send me proof of the debt. I was told there wasn't enough time and it was being sent to court today. I was told if I did not submit a payment today i would owe triple the amount on court. I explained that I was unaware of the debt and did not feel comfortable paying it without proof or any explanation. I was then hung up on. I called again and was told if i paid XXXX today, I could set up payment arrangements and it would not go to court. I felt as if I had no choice but to pay because I would not be able to afford a lawyer and I had no way to prove the debt was not mine. I set up payments for XXXX a month. I had been okay paying them until XXXX when I could not make the payment and called to try to make alternate payment arrangements. XXXX I spoke to two representatives, who both threatened to have me arrested, threatened to take me to court for debt that I have previously stated is not mine. During the interaction I informed them that I was willing to settle the debt with them but to please call me back on XX/XX/XXXX when I get paid in order to discuss the terms of the agreement. On or around XX/XX/2020, I took out a loan with Balance Credit. I did this online with limited ability to confirm my information or see the full documents as increasing the size of the content on the documents wasnt available. On XX/XX/XXXX, I was informed by my employer that I would be laid off due to Covid-19. I contacted Balance Credit several times to ask about payment arrangements and to explain my current situation. I finally was able to contact customer service and tried to get some resolution to help with my current situation. I was told I could defer one payment but interest would continue. I asked what interest would be for the one payment ( 14 day deferred ) and was shocked to find out that the interest would be the amount of the actual payment {$220.00} for 14 days on a {$2400.00} loan. During the deferred 14 days, I received several calls a day everyday. I finally took a call from Balance Credit, only to find out my new balance was now over {$2800.00} and they wanted 2 payments approximately {$450.00}. I again asked that if I paid {$450.00}, what would be balance be, and was told it would now be about the same, {$2800.00}. What?? I was advised that my payments were only covering interest. How can they charge 200 % plus in interest and other fees? I feel that one, this loan was done over the internet without the ability to see the documents in larger font, and two this should be considered predatory lending. I cant afford this interest rate. Balance Credit is charging consumers interest and fees that are abusive and grossly inflated. Who protects the consumer? A loan with no end and to do this during the worst financial disaster since the Great Depression!! I now know why you are unable to see or change your application.

I used this company for a {$800.00} loan in XXXX. I signed up for the loan payments to be automatically withdrawn from my checking account. I did not check to see if the company was withdrawing payments. I received the " Notice of Right to Cure '' letter via email on XX/XX/XXXX. I have not received any other emails nor any letters mailed to my home. When I talked to the company representative, she said that several calls were made to my phone. I have a payment agreement with Balance Credit, Acct number # XXXX. The payment loan amount is {$130.00}. The payment due on XX/XX/XXXX. 2023 could not be deducted from XXXX XXXX XXXX XXXX XXXX decided to close my checking account due to a scam transaction that happens few days earlier. The Rep took the new bank account number to make the payment. I receive an alert from XXXX XXXX notifies the charge debit of {$130.00} made on XX/XX/XXXX and another payment of {$130.00} from Balance Credit. I called the Balance Credit to dispute the {$130.00} charge, and the Rep agrees they made duplicate charge and apologize. They agreed to refunded charges electronically immediate. Today is XX/XX/2023, I have made more than 10 calls to their Customer Centre, I explained the hardship of my personal financial situations. No resolutions or refund payment, on XX/XX/XXXX they made the next charges payment. Finally on XX/XX/XXXX I speak to a supervisor promises to expedite by XXXX payment that I should be able to received Tuesday XX/XX/2023. Today I called again, they said That I have to wait 6 business days to payment post on their account and another 10 businesses days to a refund a paper check. We were notified we are in a federal disaster zone ( as of XX/XX/2023 ). I notified this company of the situation and to explore what forbearance or deferment programs they have available. The agent I spoke with informed me they do not have any programs available to assist me- all they can do is DOUBLE my next payment. I requested to speak with a supervisor to get clarity on WHY they do not offer a federal disaster zone victim any kind of forbearance ( the answer at this point was obvious - because they are a predatory loan scam company, but that's a different issue ) ... and this is where things got even stranger. After being placed on hold multiple times for several minutes ( the agent was polite but clueless ) she informed me no supervisor was available to assist me ( what a shock! ). After insisting to speak with a supervisor, I was informed 'someone would get back to me hopefully in 3 business days ). So after reaching out to this company in an effort to ensure that I do NOT default or miss any payments, to communicate that due to a federal disaster declaration I was attempting to work out something that at least is an arrangement that is suitable for them, not only could they not assist me but refused to put a supervisor on the line with me to provide any explanation whatsoever. Well I suppose this is the price people pay doing business with fly-by-night organizations like Balance Credit. If nothing else comes from this, at the very least hopefully others will learn from my horrible experience with them and avoid them like the charlatans that they are.

I have received many calls from an unknown number telling me to call XXXX which goes to the office of XXXX XXXX. I called and left a voicemail twice now to get additional information and my call is never returned. The messages the keep leaving specifically say a notice of intent IS scheduled to be delivered to your employer today between the hours of - and they repeatedly state I am scheduled to be served documents at my home this evening And my failure to comply could result in a missed court appearance. Some time in XXXX of XXXX, I received an alert on my credit report that I had a collection from a company I have never heard of. I called the number listed. It is XXXX XXXX XXXX. They said a debt was sold to them by a company called SunUp Financial LLC. I called them and they had no information for me. They said they could not provide me any documentation and that I had to call XXXX again. So I called XXXX again and they had nothing to provide me but an account number and a strange copy of payments due for some type of loan that is not mine. I begged them to provide me the amount, how did I get the money, something with my signature but all they have is some strange docusign paper with the amount of XXXX dollars on it. My name is not even attached. This is apparently from XXXX, and I have never taken a loan for XXXX ever! I even had my bank XXXX go through with me all any any deposits or money from this company or any company in this amount and nothing. I make allot of money and have a good job. There is no way I would ever take a loan for this amount of money. For my account, there is NO account information about my loan -- payments, when they are due, how much I currrently owe, etc. When I log in to my account, this is what I see : Loan number, application date, effective date, loan status, final due date, original loan amount and view documents. When I click on " view documents '' it is only the documents I received about the loan. I have to call to get my loan balance. THE PROBLEM : everytime my balance reflects I'm almost " paid in full '', the balance goes up. I only borrowed {$950.00}. I understand that I pay dearly to borrow b/c of the costs they must make. Since my first payment XX/XX/2019 of {$380.00} monthly, I've paid {$2300.00} as of today. I've basically given them over {$1500.00} as of today. However, for the past year this company has contacted me claiming I've " maliciously defrauded '' a company and need to pay them immediately. A prior rep of theirs did collect XXXX dollars from me and I have yet to receive any communication or documentation on the debt owed or who it's even owed to. They claim to be a " mediator '' and that I will be taken to court if I don't pay them. Again, I've asked for documentation and again, received none. They have continued for the past year to contact my ex-husbands extended family members both on their work and personal cell phones. Even after being told they don't know me. I had a loan with Balance Credit. I was behind on payments and they sent it to a collection agency, XXXX XXXX XXXX. The guy gave the account XXXX XXXX XXXX called me on Tuesday the XX/XX/XXXX. He was all over the place in what he was telling me. HE threatened me with a judgment or garnishment. Which legally he can not do.. He said he would get me a good deal if I agreed to a re-payment plan. HE DOES NOT have the authority to offer settlements. HE knew that I had unemployment coming in. HE said he would call me today the XXXX. as he had sent me a payment agreement to sign. I was not by my phone today when he called, SO what did he do he called my daughter on HER work no, which is a recorded line. HIS supervisor tried to say I must have put that number down as contact no. NO, I did not. That is her work no, and I never put that no down. So a woman claiming her name was XXXX XXXX called me this morning and left a message for me to return her call at this number XXXX which is fine normal collection practices. Right after she contacts my mom ( no big deal ) who contacts me and gives me her info. My mom then informs me that the agent XXXX XXXX told her that she just spoke with XXXX XXXX ( my fathers wife ) who would not have been my reference. She told my mom that XXXX verified my address in an attempt to get my mom to disclose information as well. So I called Ms. XXXX who was very rude. I was called 3 times in a row ( with no break in between calls ) from the same number XXXX today, and my husband, brother in law, and sister were also called. Today was the first time I had been called by this company and they left a message for me, my husband, and my brother that I was being served legal papers. They claim they are trying to collect on my Balance credit account, which I am paying another company on. On XXXX-XXXX-2017 I applied for a payday loan with Balance Credit. I was finally able to print off my contract. I was completely shocked at the 325.00% finance rate. The finance charge is $ XXXX. The initial loan amount was $XXXX which I received. On page 3 of the agreement is states that I agree to pay $ XXXX plus an additional interest of 25% per annum. This amount is not listed on the first page. This would be a total amount due of $XXXX. This is outrageous. They are taking $XXXX out of my bank account every 2 weeks. I also noticed a clause that states that they can take out a demand payment anytime and for no reason for anytime. I can't believe that I got myself into this rip-off trap. I can't afford it. I started receiving e-mails where someone -- not me -- was applying for a credit loan using my identity. Balance Credit proceeding with underwriting and the process to open a credit loan ( I'm not sure what type exactly ) under my identity. It appears the scammer proceeded all the way and is in the process of submitting back account verification. I did not apply for this credit or loan. I did not consent to anying doing so on my behalf. The business may also conduct business as SunUp Financial , LLC d/b/a BalanceCredit.com ( Balance Credit ). It has come to my attention that this lender is not legally licensed by the state of California. Upon checking the DBO, Balance Credit is not listed on the DBO website. I have received 2 loans where I was charged excessive fees that were not legal in the state of California. Although I am not legally required to do so, I am willing to repay the principal balance of this loan. I received multiple loans that dates back to XX/XX/2017 have had several bi-weekly withdrawal payments from my bank account. With the past and current loan taken out I have over paid due to the excessive interest accessed. Have called creditor several times to have credit report updated with the credit bureaus. Still being shown as open with a balance on XXXX. Have spoke with the Resolutions department at Balance Credit multiple times. Today being XX/XX/2022 spoke with XXXX. Said the account has been reported as closed paid in full as of XX/XX/2022 and was manually inputted to the bureaus. After I asked him what the purpose of the call was, he told me the call was about pending litigation against me due to a personal loan. I took out an installment loan through Balance Credit online. I paid it until COVID. I communicated with the company on numerous occasions and made partial payments. I was working on a settlement agreement with them and did not receive their last email due to it going to my spam folder. My complaint arises from the lending practices of online lenders. I have noticed numerous complaints regarding a similar company called XXXX XXXX XXXX. These predatory lenders are charging exorbitant A.P.R.s on small loans and not properly disclosing these A.P.R.s. to the consumer until after the fact. In my case, the rate was greater than 100 percentage points over the maximum A.P.R. allowed by Mississippi State Law 75-17-21, which is punishable by 75-67-119. To be specific, I was charged 280.01 % A.P.R for a {$650.00} loan. Our State Law caps that rate at 36 % per annum. The punishment for such a charge is for the lender to forfeit the principal and all interest received. Balance Credit refuses to comply and does not feel they have done anything wrong.

Every other week, by XXXX XXXX Mail, I get a pre-Qualified loan offer from Balance Credit. Over XXXX months ago I applied for credit and was declined. I ask them to stop sending me these pre-qualified offers going forward. Today I received another one. I want these offers to stop as they will not approve the loan but yet they keep sending the pre-approvals. When I log in to their website, it states I do not qualify for a loan with them prior to accepting an application. I received a pre qualified offer of a personal loan in the mail. I called the company to find out what their rates are because it is not in the letter and I could not find it online. I was told that I will be given the rate once I apply. I'm pretty sure that's illegal. So basically I have to take a hit to my credit to obtain a rate for a loan that I might not actually want because I don't want to pay their interest rate. Prior to accepting the payment the company was to delete the account from my credit. Instead they took the funds, and continued to report on the debt as paid in full with a {$0.00} balance which still shows up on my credit as if it is an open tradeline.
