Dear Court and whomever this may concern, I am writing to file a complaint seeking an injunction to stop the sale of my house and auction. I am the owner of XXXX XXXX XXXX XXXX XXXX, and I am writing this letter as a formal complaint.
My mother is elderly and sick, and I am her caretaker. We have lived in our home a nice amount of time and we have always lived together, and she suffers from XXXX. In here mind right now, it is the only home my mother has ever known. We had been making payments on the mortgage, but recently we were informed that the finance company did not receive the payments. We were told that the payments were lost in a wire transfer, and we have since been trying to rectify the situation.
We have been informed that there is a sale going under the underwriting process, and we are currently waiting on funds in the close of the sale. We believe that the sale of our home and the auction should be stopped until this matter can be resolved.
I am seeking an injunction to stop the sale of my house and auction, as my mother is elderly and sick and we have nowhere else to go. We have made every effort to pay our mortgage and have been working to resolve the issue with the missed payments. We believe that the sale of our home and auction would cause irreparable harm to my mother 's health and well-being.
I respectfully request that you consider our situation and grant the injunction to stop the sale of my house and auction until this matter can be resolved. Thank you for your time and consideration.
