In 2021 I started an account with BlockFi, who provided interest bearing accounts on cryptocurrencies you deposit with them similar to savings accounts. They provide crypto wallet addresses specifically for the account holder to send the deposits to, and those wallets are maintained by a third party custodian, I believe either XXXX or XXXX are who they use for custodial services. Back in XXXX of XXXX, I deposited just short of {$10000.00} worth of the stablecoin XXXX ( XXXX XXXX ) over a couple days to my deposit address they provided me for XXXX. At the time however, the deposit page they provided did not specifically say to only deposit the XXXX XXXX version of XXXX ( XXXX ) to the address given to me. Since it did not specify that, I sent the XXXX XXXX XXXX version of XXXX ( XXXX ) which was made to be compatible with XXXX XXXX wallet addresses. My deposits made it to my provided deposit wallet address successfully. I can see the transactions on the XXXX just fine when looking up the wallet address. My nearly {$10000.00} worth of XXXX is still sitting in that address untouched and safe, but since it wasn't sent in XXXX, they refuse to credit it to me and claim that it is lost money that they hold no liability for and can do nothing to recover it. That however is not true, and they simply just don't want to help recover it, and say they can't because the wallets belong to their third party custodian who provided them with the addresses they gave to me. Now when I try to contact the custodians about it, they won't even talk to me because I don't actually have an account with them, BlockFi does, yet BlockFi refuses to contact them on my behalf to remedy the situation. Fixing this can be done in a matter of a few minutes if they wanted to be cooperative and it can be done in 2 different ways ... the first way would be for BlockFi to ask their custodian maintaining my deposit wallet address, to provide me with the recovery passphrase key, so that I could import that wallet address into a wallet app on my phone like XXXX, so that I can have access to the contents of it and just send that XXXX back to my wallet I had sent it from. The other simple way to fix it would be for the custodian to simply switch the network on the wallet from their app from the XXXX network to the XXXX network, which can be done in less than minute, so that they can see the XXXX that is being held by that address which isnt visible while on the XXXX network, and then just send that XXXX back to the same address which it came from. Recently I even sent some XXXX to that wallet address, which would be needed to pay for the transaction fee to send that XXXX back to me, just to make it a quick and hassle free process for them to take care of. I should point out that there have been multiple other people who have had the same exact problem here with BlockFi that I am having, sending XXXX XXXX instead of XXXX XXXX and BlockFi was not willing to help them either and claim they hold no blame and did nothing wrong. However if that were true, then they wouldn't have had to later update the deposit address page to start specifying XXXX tokens only, which you can see in the photos I've attached. They changed it because after this happened to multiple people they realized they partially negligent by not being clear on the original page, and they wouldn't have needed to change it if they did no wrong. BlockFi pays a third party to provide and maintain these wallet addresses for them, to provide to us.. If part of their agreement dictates they can't be given the recovery keys by the custodian for the wallets to provide me with or can't have the custodian directly provide me with the keys to my deposit wallet address so that I could have access to recover my digital assets instantly, they can at least ask the custodian to simply open the wallet on the XXXX XXXX really quick, so they can see the XXXX in there, and just send it back to the same address it came from, using the XXXX I recently added to more than cover the transaction fee. It isn't some complex and impossible task like they claim.. but they insist on not helping and so for over a year, a large sum of valuable digital assets of mine have been sitting there, not collecting interest, and being held hostage from me which someone would eventually get to just pocket if I were to die or something.

I started investing in Blockfi in XXXX and moved my money over from XXXX. I did this because Blockfi had promotions for their interest account. They were offering over 10 % interest on some of their products, so I brought over my bitcoin and XXXX. During that time at Blockfi, they were growing in their business, and everything seemed to be going fine. I even started a loan with them where they would essentially give me the cash and hold my bitcoin as collateral. I also started using their new product, which was called the Blockfi credit card through XXXX. My first loan started on XX/XX/XXXX, for {$10000.00}. I specifically used the money to buy more bitcoin on the Blockfi platform in hopes that bitcoin would go up. Nonetheless, I made the decision to re-up my loan for {$10000.00} on XX/XX/XXXX. I currently hold XXXX Bitcoin and XXXX XXXX on the Blockfi wallet. With XXXX Bitcoin held as my collateral for the loan. Now with all that being said, I was depositing my hard-earned money into Blockfi over a two-year period. I believed everything that they said was true, they were growing as a business, and I believed and trusted that they would hold my crypto safely. The reason for this complaint is that they were dealing with XXXX, which is a crypto company that filed for bankruptcy due to fraud and scam. The former CEO of XXXX was charged with over eight counts of illegal activities, including wire fraud. XXXX essentially bailed out Blockfi over the summer which commingled customer funds, including mine, which is illegal. My life savings were held in Blockfi and unfortunately, I do not have access to them now due to Blockfi bankruptcy hearings. Another reason I believe this complaint will be heard is that Blockfi continuously tweeted on XX/XX/XXXX that all the customer funds were safe and there were no problems during the XXXX collapse. I decided to keep my funds with Blockfi and not make any drastic moves because I believed the company and trusted him. But literally the same day that night they tweeted out that they had paused withdrawals due to the XXXX collapse. I have been investing in stocks and crypto for over six years and this is the first time that I realize that my money is not safe due to centralized entities controlling my money. I do not know if I should sue Blockfi or XXXX but I surely do not have the funds to do that. Hopefully, this complaint can be heard and I can get some clarity on what will happen with my money. It is unfortunate that the former CEO of XXXX collapsed a {$32.00} XXXX company and lost over {$15.00} XXXX in customer funds. He even gave XXXX of dollars to celebrities and politicians to use their platform. It could have been customer funds of Blockfi as well. I am scared that I will never get my money again. Please help and acknowledge this complaint, thank you.

I signed up for a BlockFi credit card with cryptocurrency rewards program in XX/XX/XXXX. They initially offered a very high reward interest rate of 6 % for up to XXXX XXXX as shown here : XXXX XXXX XXXXXXXX Over time, they continued to lower the reward interest rate and the amounts, with the latest rate change being shown here : XXXX XXXX XXXX XXXX appears that this credit card and rewards program is part of an elaborate Ponzi scheme where BlockFi offered high interest rewards in order to acquire real assets and liquidity. They then freely chose to spend and use customer 's assets for their own risk and benefit. While this was described as a custodial account service that I maintained ownership to, funds in my BlockFi deposit address ( XXXX ) began transferring out without my consent on XXXX as shown here : XXXX XXXX XXXX It is unknown who is in control of this address and the other addresses where my assets continued to transfer to, but this address is currently empty : XXXX On XX/XX/XXXX, XXXX XXXX XXXX XXXX of BlockFi, assured customers in a long XXXX thread that all BlockFi products were fully operational and that they were an independent business entity, stating they have a $ XXXX line of credit from XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ) and will remain an independent entity until at least XX/XX/XXXX. XXXX XXXX XXXXXXXX On XX/XX/XXXX, BlockFi posted the following status stating they were limiting platform activity due to lack of clarity with XXXX XXXX XXXX : XXXX On XX/XX/XXXX, I received multiple communications from BlockFi stating my credit card was deactivated and that I was still responsible for payments. The card had been declining for about a week prior due to non-sufficient funds errors, while having sufficient funds. It is my belief that they began deactivating card services prior to any public announcement about XXXX and also lied to customer 's on XXXX in hopes to keep as many funds on their exchange as possible. It is my further belief that cryptocurrencies paid for rewards may have been obtained illegally and actually paid out with customer 's assets. The sources of all rewards payouts needs to be investigated by blockchain analysts. Where these assets came from and where they all moved is very easy to determine and all recorded on the blockchains involved. Additionally, due to BlockFi suspending and limiting activity, no cryptocurrency assets from the rewards program are currently accessible. It is my belief that the entire program was setup to operate an elaborate Ponzi scheme where BlockFi freely chose to operate on a fractional reserve system. No assets they used and stole were backed with like cryptocurrency.

I've initiated Transfer Requests from the Blockfi Wallet ( " Checking account '', so to speak ) on the XXXX of XXXX at XXXX XXXX, for the amount of XXXX XXXX, XXXX XXXX XXXX, for the amount of XXXX XXXX and at XXXX XXXX XXXX XXXX. All of the above sums represent the present values on the account and the completion of the transfer would also mean a transfer fee for each transfer would apply. The Destination of the transfer is towards equivalent denomination in XXXX equivalent account and the Pending Transfer Request marked with the Date of delivery : XXXX of XXXX. These were initiated whilst the platform was still operating as normal, at the cusp of the XXXX scandal coming into play. It would take a few more days until there would be communication on the platform that operations are paused from Blockfi 's point of view. It appears all transfers are blocked, per the following 5. of terms of service, with : " 5. BlockFi and our third-party partners may experience cyber-attacks, extreme market conditions, or other operational or technical difficulties which could result in the immediate halt of transfers and withdrawals of cryptocurrency either temporarily or permanently. BlockFi is not and will not be responsible or liable for any loss or damage of any sort incurred by you as a result of such cyber-attacks, operational or technical difficulties or suspensions of transfers or withdrawals. '' This is extremely misleading. Also it appears that there is a looming XXXX XXXX for this company ( potentially ). From the point of view of the withdrawal process, the funds are in Pending and seeking any support on Blockfi end results in a dead end. An example being the Support chat which for Withdrawals ends in a dead end for the withdrawal process by asking that there can be a validation email sent that can be confirmed. No such email has been requested, have also canceled and retried the transaction for the BAT, on the XXXX of XXXX, in the amount stipulated above, where at both the initial and re-attempt, no such email was sent to validate identity or security related aspects. Also, " BlockFi Phone Support is currently unavailable. '' plastered on the website. I would like to mention, if at all makes any difference, those wallets are in my name and that they should represent the equivalent of a checking account. I would strongly urge them not to be used to satisfy secured creditors if bankruptcy comes.

I have funds in XXXX currencies ( about XXXX XXXX and XXXX XXXX ) in my personal online wallet with Blockfi company. According to the companys terms the funds that are in the wallet belong to me and me only and are preserved in the cold storage, which means that no one else, the company included should be able to access or use them ( as opposed to the interest account that receives interest payments for the money being used by the company for investment ). On XXXX XXXX at XXXX XXXX I tried to withdraw all my funds from my Blockfi wallet to my external cold storage. About 3 hours later the company published on XXXX the announcement that it pauses all the withdrawals due to unexpected circumstances and exposure to another company ( XXXX ), who had announced bankruptcy. My withdrawals are still pending as of today and the company isnt communicating about whether they will be honoured. I tried to contact Blockfis customer support by email and twitter, but havent received any response. There is a discussion now in the news that Blockfi is likely to file for bankruptcy soon, though there hasnt been any official announcement. Since the announcement of the pause in withdrawals, Blockfi has processed some of the withdrawals submitted before the announcement at the same or even later time than my withdrawal request, but mine is still pending. It is not clear how those withdrawal requests are selected, as there is no explanation from Blockfi. I would like to complain about this inconsistency and the fact that in case of the bankruptcy the funds sitting in the wallet should not be used for compensating the secured clients, as they are supposed to belong only to me. I lent {$200000.00} to an investment company called Blockfi Inc. It has a private client program, a premium service where the investors have individual contracts. Unfortunately, just a few days after I delivered the {$200000.00} funds, Blockfi has become unresponsive and defaulted my contract already incurring additional penalties. They are unresponsive to my request just to transfer my funds to the Wallet account. How can we file a lawsuit against Blockfi given the bankruptcy proceedings? My legal demands below remained unresolved. =========================== Re : Blockfi Private Client Terms of Contract XXXX ( Client : XXXX XXXX XXXX ) According to Section XVIII. Term and Termination : The term of the contract Agreement shall terminate ( i ) as set forth in Section VIII or ( ii ) upon 10 days written notice ( email sufficient ) by either party to the other party ( the Term ). The client made multiple requests 3 weeks ago in written forms to transfer his {$200000.00} USD funds from the Private Client to the Wallet according to contract XXXX. The first written request was made on XX/XX/XXXX, XXXX XXXX XXXX, followed by XX/XX/XXXX, XXXX XXXX XXXX, etc. According to Section VIII. Default of contract, Blockfi 's failure to respond to the lender 's multiple requests to transfer the funds to his Wallet Account continued unremedied for the period of five ( 5 ) Business Days incurred an Event of Default, with the penalty of 1 % per month remaining on contract. Client 's funds should have been in the Wallet by now. I repeat this demand. The contract is attached for your reference.

XXXX ) Except as required by a valid court order or applicable law, BlockFi shall not sell, transfer, loan, hypothecate or otherwise alienate cryptocurrency held in your BlockFi Wallet unless specifically instructed by you. Recently BlockFi have been financially impacted by the collapse of XXXX ( another cryptocurrency exchange ), and have made the following announcement : " Until there is further clarity, we are limiting platform activity, including pausing client withdrawals as allowed under our Terms. We will share more specifics as soon as possible. We request that clients not deposit to BlockFi Wallet or Interest Accounts at this time. '' I have a withdrawal transaction in a 'Pending " state, that I created on XX/XX/XXXX at XXXX XXXX, which I initiated a number of hours before receiving this announcement in an email from BlockFi. BlockFi have been silent for the past week, and there have been news articles circulating that suggest that BlockFi is likely to declare bankrupcy in the coming days/weeks. I would argue that BlockFi are in violation of their terms of service by preventing me from withdrawing my asset, and I'm worried that my asset will become completely inaccessible to me if BlockFi were to declare bankruptcy.

Dear Sirs, We are all well aware of the ramifications of the suspension of accounts at Block Fi both investing and credit accounts. As a result, I find that Block Fi and its partners are in violation of the agreement between parties and as such all contracts or obligations are null and void. Block-Fi is in XXXX XXXX Bankruptcy as such I am a creditor looking for the recovery of assets same as all other creditors. No access to money in Block-Fi account No access to the use of Block-Fi Credit card No payments of XXXX credits or Interest due from Block-fi card transactions. No way to trade buy or sell on my accounts Are all failures of Block-Fi and its partners to keep up their end of the agreements My money is in Block-Fi accounts and when I have access to that money I will pay the Block-Fi card. However, I offer these options in a fast and reasonable solution to the situation. 1.You can recover the balance from my Block-Fi account in house XXXX XXXX XXXX XXXX on the dollar for the balance owed in full. I have filed a copy of this e-mail plus a full complaint with the Federal Trade commission, The Federal consumer protection agency, the three credit Agencies and other state and Federal agencies. '' I have a wallet under my name on BlockFi with approximately : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX I've tried to withdraw everything on XXXX and my transactions are still pending even though they were supposed to be delivered on XXXX I've contacted customer support at BlockFi several times but it seems like BlockFi is not responding to anyone anymore and not communicating in any sort of way. I want to make clear that these balances are on my investor wallet on BlockFi ( not my interest wallet ) and I would like to state my concern about the ownership in cold storage, these wallet are in my name and should not be used to satisfy secured creditors should a bankruptcy come. I'm not a US resident, I'm Italian resident and I'm really concerned about what is going to happen in case they will file for XXXX. This is a follow-up on my prior complaint with blockficom so if you look prior you will see a complaint. Now they are supposedly allowing people to withdraw their cryptocurrency however the problem is is that they require a verification that in my opinion and experience of trying over and over XXXX plus times is impossible to meet. I have submitted as per their directions a front and back of my driver 's license which is a brand new driver 's license that has my current information on it. I've tried with multiple smartphones and also my computer with different cameras to take pictures of the front and back of my driver 's license. I have also scanned the front and back of my driver 's license and made sure that the doctor inch where is high resolution as possible to meet the verification. No matter what I've tried it always says at the end that it can't verify my Identity or can't verify the photos. I have also reached out to blockfi.com customer service and they were at no help at all is it didn't even look like they knew what they were talking about. They responded that I tried to upload pictures of a national ID and not a driver 's license which is not true it is a driver 's license and I have pictures to prove this.

Blockfi 's payment portal was not working in XXXX and their customer support number ( XXXX ) listed on the back of the card is also not functioning. I called this number when the payment portal was down to check how I could make the payment but this number was not working at all. And then the card was reported delinquent ( 30days late ) by XXXX which is the underwriting company. How can i make the payment when blockfi 's payment portal and customer support number were not working at all. Then deserve opened a new payment portal and the card was paid off since then. The card has {$0.00} balance as of now. XXXX, the customer support manager who i spoke to in XXXX asked me to open a dispute with credit bureaus and told me the dispute department will fix delinquency reported issue. I have tried to dispute this with all three credit bureaus but XXXX is not fixing it. They keep sending the same result ( XXXX being late payment ) to all my disputes. I have called them several times and sent them several emails since then with no results. This has severely affected my credit score and has given me trauma as i was preparing to buy my first house. Please help me get this fixed.

To whom it XXXX concern, I am a customer and user of BlockFi Inc. I had digital crypto currencies stored in the BlockFi Trading LLC. Digital " wallet '' which was marketed by the company as a way to, and I quote : " Easily safeguard and store your crypto.. ''. as stated on their website. In light of recent events ( paused withdrawals ) BlockFi have not yet processed my withdrawal for crypto currencies, initiated on the XXXX XXXX, which were stored in the wallet PRIOR to any announcements by BlockFi of company uncertainty and withdrawal pausing. XXXX balances were XXXX XXXX and XXXX LT ( Litecoin ) respectively. Under the terms of XXXX XXXX XXXX stated on this page XXXX XXXX XXXX. My funds ( valued at a market price of almost $ XXXX ) were maintained by XXXX XXXX XXXX acting on behalf of XXXX XXXX XXXX. These assets were supposed to be safeguarded and the terms also states that there was no transfer of ownership from myself to BlockFi while I used this XXXX ' service. I formally request that XXXX honour the asset withdrawal in my name and I request that these assets are not used to satisfy secured creditors in the even of bankruptcy filings.

Dear Sir/Madam- I have self-directed my retirement money ( from my traditional IRA ) and on XX/XX/2022, I opened an account with BLOCKFI, a crypto currency company, which guarantees interest on the cash and cryptocurrencies invested. Over the course of several months, I have transferred roughly around {$800000.00} and as of XX/XX/2022, the total balance on theaccount is {$630000.00}. Two weeks ago, I received notification that withdrawal has been frozen, as aresult of its " exposure '' to the now bankrupt XXXX. I would like your assistance to see if I may be able to withdraw all of this sum of money. I trusted the company with all its backings ; however, now I feel I have been deceived. It is my IRA money and would like to know if there is a chance I could still have access to it. I appreciate your understanding and help on this matter. I am a customer of BlockFi and have a bitcoin rewards credit card and a yield interest account ( which is frozen ). BlockFi filed for XXXX XXXX XXXX in XXXX XXXX and has frozen all their customer assets ; I have a balance owed which I can not withdraw of {$1800.00}. I also have a credit card which i continue to pay each month with a current balance of {$1000.00}. BlockFi continue to charge monthly interest on the credit card but have failed to pay the XXXX rewards for the recent purchases. I believe they are violating their side of the credit card agreement and are still punishing their customers, even though I am owed funds and they haven't paid out their assets. This seems unethical that they can still charge interest, but not pay owed rewards or release funds from the interest account, to customers who are already suffering from their bankruptcy. On XX/XX/XXXX I called BlockFi customer service to request they pause interest charge and they stated they would escalate my concern and follow up ; to date I still have not received a response. BlockFi has paused withdrawals and not honoring withdrawals done before the pause. On XXXX, I withdrew the amount of {$14000.00} in the digital currency XXXX on BlockFi they sent a ( clearly fake email ) saying it was canceled due to " not completing identity verification ''. I never received this verification. I was only sent texts to click a link if it was fraudulent or ignored and they would move digital currency to XXXX. Now I am unable to re-try the withdrawal due to the withdrawal pause. I made this withdrawal BEFORE BlockFi paused withdrawals for all my funds. This also included moving XXXX {$3800.00} and XXXX {$2200.00} to XXXX. These withdrawals have still not gone through but were initiated before the withdrawal pause they put in place. I'm guessing I will receive a " You did not complete the identity verification '' or some other notification to swindle me. I took a big chance on this company even defending them during these XXXX issues and they promised in online threads that our money was safe. I would just like them to honor my withdrawals.

BlockFi froze all withdrawals on or about XX/XX/2022 in response to XXXX declaring bankruptcy. Without any official notice, the company did not allow assets to be made available. In the days following, there was little communication or effort to update customer/clients on the status of our funds. Pending transfers have stayed pending. The website was updated without warning to prevent use of many website/app tools. The official social media website references customer support accounts that appear to be fake or scams, encouraging people to setup illicit access and be out of their money. I mistakenly transferred an amount of {$5000.00} of XXXX from my Binance.us account wallet address : XXXX into my Blockfi wallet address : XXXX on XXXX XXXX AM XXXX. I realized funds did not make into my account and contacted XXXX for status of my deposit. I was informed that the transferred amount that was transmitted onto wrong network ( BSC ). Per the terms, these rewards become my asset/ I have individual ownership once issued. BlockFi has frozen withdrawals from their platform since XX/XX/XXXX, citing their Terms of Service. While it may be the case that they have within their ToS that withdrawals can be paused, they are operating as a marketplace enforcing rules arbitrarily and to the benefit of their selected winners. They are custodians of assets owned by me. These assets are virtual currencies that are liquid in other marketplaces. Their decision to limit my ability to withdraw my own assets is anti-market behavior. Meanwhile, news sources report that select individuals and organizations have been able to withdraw their assets. This is selective enforcement. On or about XX/XX/21 I contacted Blockfi and informed them via email that my account, email addresses, phone and laptop had been compromised and to lock my account down. The Blockfi customer service representative I was working with at the time ( XXXX ) stated that the account was locked and no to worry because my cryptocurrency and funds would be safe and ready and waiting for me when I went to re-open the account. After repeated subsequent attempts to get in contact with Blockfi via phone, email and even via certified mail over the last 18 months, I have never received a response regarding regaining access to my assets or my account. The BlockFi terms of use state that a users wallet is their own property at all times, and not the property of BlockFi. BlockFi, however, has acted as if it is their property and refused to provide access to, withdrawals of, or otherwise has converted users assets contrary to its own terms of use and without authorization of the users. Blockfi is not following their terms and conditions by holding my crypto currency on the platform. There was consistency wrong information recorded when creating my business BlockFi account. The most important is that they recorded a personal SSN, as the ownership, and not a company XXXX when setting up the corporate account. Someone at the Deserve via BlockFi company fraudulently had an account under my name and social security number. Illegal and fraudulent charges were made and not paid on that card.
