On XXXX XX/XX/2023 I filed complaint XXXX against BetterNOI regarding a tenant screening. The complaint was returned with BetterNOI claiming it did not belong to them. The CFPB reviewed the contents of the complaint and sent it to BetterNOI for response. In the meantime I filed an additional complaint against BetterNOI ( CFPB Complaint XXXX ). In it I requested the inaccurate and/or unverifiable information supplied by one or more of the three major CRAs be removed from my tenant report. The response to that complaint was as follows : " If has a concern regarding the accuracy of that information they can dispute it with SRI, who will request that XXXX conduct a re-investigation. Alternatively he can dispute it directly with XXXX. Thank you for your attention to this matter. '' BetterNOI then marked CFPB complaint XXXX as a duplicate. On or around XXXX XX/XX/2023 I filed a new complaint against Screening Reports , Inc ( SRI ). The CFPB complaint number is XXXX. On XXXX XXXX XXXXSRI marked the complaint as a duplicate of the BetterNOI complaint. No re-investigation by SRI was conducted. Screening Reports , Inc. is a consumer reporting agency and as such is subject to 15 U.S. Code 1681i. Now, it could be the case that SRI determined my " disputes were irrelevant or frivolous. '' However, 15 U.S. Code 1681i ( a ) ( 3 ) requires SRI to provide notice to a consumer that contains : ( i ) the reasons for the determination under ; and ( ii ) identification of any information required to investigate the disputed information, which may consist of a standardized form describing the general nature of such information. That was not provided to me by SRI. The fact is the inaccurate information supplied by SRI to third parties has subjected me to housing discrimination. Considering SRI marked the item as a duplicate, it would appear SRI and BetterNOI are one-in-the-same entities, or closely affiliated. As an aside, my experience with inaccurate information supplied by SRI is not the first instance in which the failures in SRI processes has deprived consumers of housing. On XXXX XX/XX/2023 a Florida man filed a Fedral Lawsuit against SRI. The Plaintiff in that case alleged " Screening Reports had been reporting derogatory and inaccurate statements and information regarding plaintiff and his background to third parties. The inaccurate information included false criminal records for multiple felonies for XXXX XXXX and failure to register as a XXXX XXXX, as well as multiple XXXX for contributing to the delinquency of a minor, assault, and disorderly conduct. '' In the complaint plaintiff contends " Screening Reports violated the FCRA by failing to follow reasonable procedures to assure the maximum possible accuracy of the information it reported, which led to Screening Reports including derogatory and inaccurate statements in plaintiff 's consumer report. Moreover, had SRI followed reasonable procedures, it would not have reported the inaccurate information, '' ( see here : XXXX XXXX XXXX XXXX Thankfully, the false, misleading, and inaccurate information supplied by SRI to third parties regarding me, my finances, and my background are not nearly as horrifying as that of the Florida man because the inaccurate information supplied by SRI to third parties pertaining to me appears to deal with financial matters. Nevertheless, the derogatory information supplied is false and subjecting me to housing discrimination. As such, I dispute the information contained in my SRI screening report ( s ) for the following accounts/trade-lines : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX The basis for each of those disputes is in the attached pdf files that include the name of the firm.

I am reporting that a background screening company has violated the Fair Credit Reporting Act by reporting inaccurate information regarding my credit history. The company is BetterNOI, located at XXXX XXXX XXXX XXXX XXXX XXXX XXXX, FL XXXX Summary of Facts XXXX. Better NOI reported to XXXX at XXXX XXXX that, in XX/XX/XXXX XXXX XXXX filed and dismissed an eviction in XXXX XXXX, in my name, for address XXXX XXXX XXXX XXXXXXXX XXXX XXXX. As a result of this inaccurate reporting, I was denied an apartment ( Attachment 1 ; Copy of Screening Report from Better NOI, page XXXX ) XXXX. XXXX XXXXXXXX is not, nor have they ever been affiliated with XXXX XXXX XXXX XXXX GA, XXXX. I did not live at XXXX XXXX XXXX XXXX Ga XXXX in XX/XX/XXXX or before. I moved in on XX/XX/XXXX. I reached out to NOI to inform them the information they reported is inaccurate and followed the dispute process. Better NOI failed to do their due diligence by verifying the accuracy of the information they reported. They opened and closed the dispute in less than 24 hours. ( Attachment 2 ; email from NOI Disputes Team stating the case is closed ). XXXX. A representative of Better NOI advised they went through XXXX XXXX XXXX to conduct the rental history screening. I contacted XXXX XXXX XXXX XXXX, they advised they do not have a reported eviction filing under my name. Better NOI did not provide me a copy of the information they received from XXXX XXXX Verify ; they provided a copy of the inaccurate report they prepared ( Attachment 1 ; Screening Report, page 2 ). XXXX. XXXXXXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX not XXXX XXXX where Better NOI states the eviction filing took place. In the state of Georgia, a landlord should start the eviction process by filing a dispossessory warrant in the county where the rental property is located. Better NOI failed to do their due diligence to validate the information they provided resulting in denial of my application. Their claim that I have an eviction filing for XXXX XXXX XXXX from XX/XX/XXXX is not accurate. Again, I moved to the property at XXXX XXXX XXXX on XX/XX/XXXX. Any and all information stating an eviction was filed for my name and social security number in XXXX XXXX for XXXX XXXX XXXX is FALSE. ( Attachment 3 ; Lease from XXXX XXXX XXXX, and a list that reflects the City of XXXX is in XXXX XXXX, XXXX ) XXXX. XXXX XXXX XXXX XXXX Provided a copy of my current XXXX XXXX. The screening reflects no records found for Evictions, Filings, or XXXX XXXX. ( Attachment XXXX ; XXXX XXXX XXXX Report, page XXXX ). Conclusion As a resolution to this matter, I ask that Better NOI correct the inaccurate reporting and update XXXX at XXXX XXXX with the correct information. Per the Fair Credit Reporting Act Consumer reporting agencies must correct or delete inaccurate, incomplete, or unverifiable information. Inaccurate, incomplete or unverifiable information must be removed or corrected If this is not corrected with in 30 days of my original notification to NOI, XX/XX/XXXX, I plan to file a lawsuit in XXXX XXXX XXXX. I applied for an apartment at XXXX XXXX in XXXX, GA, and was advised that my app was denied due to Screenin Reports, Inc. 's information claiming I was evicted in XXXX of XXXX. This is not correct. I was not evicted in 2023 from XXXX XXXX XXXX XXXX nor were any legal proceedings brought against me at that time. I just had a court appearance this month in which I am voluntarily moving on the XXXX of XXXX thud no writ of possession has been ordered and any funds I still owe the landlord has been agreed to be paid monthly between the landlord and myself starting in XXXX. The landlord is not renewing my lease because due to unfortunate circumstances my son had to move in with me so he would not be homeless. Since this is a senior citizen development and I knly have a XXXX bedroom apartment the XXXX will not renew my lease whether I owed rent or not ; but I was not evicted in XXXX, and no proceedings were filed in XXXX, thus the information that Screening Reports Inc. is reporting is inaccurate and should be removed immediately so that I can be approved for another apartment asap. On or around XXXX XXXX I filed CFPB complaint XXXX. In it I outlined how I was subjected disparate treatment and housing discrimination as a result of BetterNOIs decision engine which management companies/landlords use to approve or deny an applicant for an apartment. BetterNOI responded shortly thereafter claiming the issue did not belong them, despite it being BetterNOI proprietary algorthms that tell management companies/landlords whether or not to approve an applicant as a renter. The original complaint is attached, as is a copy of the complaint I have just filed with DOJ for XXXX and XXXX discrimination.
