This was originally a pre paid credit card. If anything they owe me {$500.00}, if they can prove this is mine. I never had a card with this company. I am requesting validation, made pursuant to the Fair Debt Collection Practices Act and the Fair Credit Reporting Act, along with the corresponding local state laws. This concerns property I have owned since XXXX. The property is in a flood zone and it has had FEMA NFIP coverage every year since. The property has had mortgages since XXXX through numerous banks as they were bought and sold : XXXX XXXX XXXX, XXXX XXXX , XXXX XXXX XXXX XXXX XXXX, and now Berkshire Bank. While I was at XXXX XXXX XXXX XXXX XXXX I took out a HELOC. I believe is it going on year 4 I continued with the same Flood Insurance and increased each year along with my Home Hazard Coverage to always cover the lenders interest as that is what I was told from XXXX XXXX XXXX XXXX XXXX. But XXXX XXXX XXXX XXXX XXXXt also told me that both the Mortgage and HELOC would just transfer over to Berkshire Bank. That did not happen and I found out on my XXXX statement that no payments were made and Berkshire Bank was expecting not only the interest payments but a penalty besides. I visited the XXXX XXXX XXXX XXXX to find out what was going on because my checking account showed that both in XXXX and XXXX they automatically withdrew {$200.00} to not only cover the required interest but the rest was to go against the principal. I stay from XXXX to XXXX and the loan manager that was helping me became really nervous that we were going to set the alarm off if we were not out of the bank by XXXX. She finally saw that they were applying the {$200.00} to the mortgage despite the account was set up and stated it was to go against the HELOC. I asked for the checking account statement to be mailed as both the mortgage and HELOC were but I have no idea why the checking account just stopped. Well I then got a letter XX/XX/XXXX stating they did not have a copy of property insurance policy on file. I took the letter with a copy of my home owners policy for them to copy and forward to XXXX, NY. XX/XX/XXXX another letter came. This was now a FINAL NOTICE stating now the Flood Insurance was not sufficient coverage at {$110000.00} even though the outstanding principal balance of the loan was less. I made a telephone call and spoke to a XXXX at the XXXX XXXX Berkshire Bank Branch at XXXX and she confirmed I was OK because my balance was at {$110000.00} I took it as all was OK Well, XX/XX/XXXX another letter. FLOOD SECOND NOTICE. This has a paragraph for Massachusetts, and it states HELOC should be for the full value of the credit line, outstanding principal on the equity loan etc. This Property is in Rhode Island and from what I was told : Page 27 of the N.F.I.P Mandatory Purchase of Flood Insurance Guidelines also list first : To meet compliance requirements, the amount of flood insurance must at least be, but is not limited to, the lowest of : The outstanding principal balance of the loan ( s ) ; And from page 28 of the Mandatory Purchase of Flood Insurance Guidelines : A Federally Regulated Lender is not required to escrow for flood insurance unless they are escrowing for other items. I pay this bill every year in full usually in XXXX. {$1700.00} was paid XX/XX/XXXX for {$110000.00} coverage XX/XX/XXXX another letter. FLOOD PLACEMENT NOTICE Now let me say this. I am XXXX, XXXX, a female, and a 20 year XXXX veteran. I am sick that they are basically discriminating against me. No one has sent me any replies. I was told they called me from New York. However, I have caller ID and do not answer the various XXXX numbers that come in daily. There is no excuse for anyone not to have continued mailing as to exactly what was needed. The worst is yet to come as they have written even if I were to get additional insurance I will not get a full refund of what they took from my account without my written permission. Instead they state they will credit or refund any unearned premiums on a pro rata basis. This is totally wrong.

On XX/XX/2021 I made a deposit of 5 separate checks in the amounts of {$9300.00}, {$7000.00}, {$12000.00}, {$2600.00}, and {$3100.00} totaling {$35000.00}. I could not go into the branch so when the teller told me that there would be a hold on the funds, I explained to her that we have been down this road and if she could just talk to her manager, or if I could talk to the manager I think we could resolve this to everyones satisfaction. She said it was not an option, I could talk to the manager but this is Federal Regulations and they have no options. Okay I left as the line behind me was wrapping around the bank. I called the next day, but it being Saturday I did not get a call back, and have not since. On Monday the XXXX those five checks cleared XXXX XXXX, yet even by Tuesday the funds were still held. By Wednesday not wanting to pay a large credit card interest bill I scheduled a payment for very late in the day. On Thursday Berkshire Bank returned the payment unpaid and charged me a fee for " bouncing '' a check. On Friday the funds were still not available, even though they had cleared the paying bank 5 days prior. Not being able to reach the bank by phone I sent an email to the website portal with my level of frustration. Today I gat a response that stated they had forwarded the message to the branch. This morning I went to the bank and asked for an appointment or if I could come and discuss this. I was told we will do this over the phone. The first women I talked to explained, once again that it was federal regulations and they have not control. I explained my history and a few of the details, primarily that if that is the case then you are in serious violation of those rules because for 11 years you have not applied them. That got me to XXXX, do not know his title. He again repeated the, " federal regulation '' and I again repeated that either they have been in breach of that or something just seriously changed. Here is the major frustrations : The deposited checks are all from the same bank, XXXX XXXX XXXX whose headquarters is about 15 minutes away. I have been making these deposits, in the some general amounts, from the same bank, into the same account, in the same time frames for 11 years at this branch, and into the same account number at a branch in Vermont for the prior 22 years. I have had previous conversation with whom I think was-is the branch manager there several times as to making sure we have this worked out. Never in those 33 years have any of these checks, drawn on only two entities have ever been returned. In fact I am not sure if I have ever bounced a check or deposited any check that has bounced. In that amount of time it must have but I can't remember it. So, it is now Tuesday, the XXXX, 11days after the deposit, and 8 days after the checks cleared the paying bank and the funds have not been credited to my account. My most major complaint is that in every case I was told these are federal regulation 's not the banks, and that is just not true. It took about 20 minutes of research between the federal reserve and your entity to establish that the Federal Government role is simply to establish how long they can hold funds, not how short they can ( past a day or two ). Which would seem pretty obvious to me as they have clearly been allowing me access to my funds in a timely manor for over 30 years. If my history is in any way disputed I can document all of it. I don't think the bank will dispute my history. Other wise I don't want to send you years of bank records documenting my deposit history.

From the entrance I went to the left hand side and grab XXXX loan slip and wrote down XXXX XXXX XXXX and in words, " XXXX XXXX dollars '' in numbers {$1000.00} dollars. I placed the loan slip on top of the money. and I went to the lady, XXXX and she set aside the slip and count the money by hand and put in the counting machine. After that she gave me a XXXX pages which I thought a receipt. Until I received a monthly statement dated XX/XX/XXXX till XX/XX/XXXX and how come the balance is still XXXX XXXX instead of XXXX, XXXX XXXX. I called the bank at once and went there. I spoke with XXXX and he opened his comp. and take a look and he said there's no XXXX dollars in their records and started to get nervous and upset and then left. That was Wednesday XX/XX/XXXX. And so I went in the other branch and spoke with XXXX, the manager and relate what was happened and he said he will talk to XXXX and call me. The following day she called me and told me that the reason why I was there is to asked a transaction history. And I told her I did not go there to ask transaction history and to tell you honestly, this is my first time to see this and why will I go there to ask that, the fact that I am getting a monthly statement so I know how much I still owe. I am writing what was happened in Berkshire Bank and hopefully, you can help me to solve this problem because the XXXX XXXX dollars is already big amount for me. XX/XX/2017 i called berkshire bank and asked them for guidance because my mother got old and sick and im XXXX. I asked if they could help me because my moms house insurance lapsed due to her illness and i did not know what to do. They said sure no problem we take care of. that for if we can automatically withdraw your monthly mortgage payment and we will send you the information on homeowners insurance also. i set the auto withdrawal for mortgage. Couple months later i got a letter giving me a price of XXXX a quarter for insurance. Great thank you for your help at this difficult time in our lives. I will be in to pay .About a year to two years later, after mom back home and better she will live. I noticed i have been very short of my money. My bank informed me that berkshire bank had been withdrawing my mortgage and homeowners insurance. They had put me on commercial insurance about XXXX a year and it was with their own berkshire bank owned subdivision ( under another name ) insurance.. They own an insurance company so they put me there.. Im not a commercial company and never agreed to it. so they profited all the way big time for their own personal gain. When i called and told them i know what they have been doing and to stop automatic withdrawal, they refused. i paid my bank to have it stopped and during that time i became 2 months late on mortgage and they sent me lawyer fees for XXXX dollars. this is only one bad thing they have done. Next i called and asked to borrow on my equity and a man named XXXX laughed at me and said " You are a left over mortgage from when we bought the bank we would never have approved you based on your social security income age and XXXX and laughed some more and hung up XXXX it goes on and on i have an entire notebook on how my elderly mom and me her XXXX daughter have been and are still being treated 6 to 8 calls a week just for harassment all thru covid. they prey on the old and XXXX. On XX/XX/XXXX I made two loan payments of XXXX ( by accident ) instead of applying the extra payment to my principle balance they carried it over every month so I have been paying a month in advance for 2 years. That's two years I have been paying more interest on my loan because the extra payment was just carried over. In late XXXX of XXXX I noticed that the {$390.00} was no longer being carried over, so I called Berkshire Banks customer service line and asked to speak to someone in the loan department. XXXX XXXX returned my call and informed me that XXXX was the last month they where carrying balances over and that they where applying any over payments to the balance. ( Which that is the way it should of been all along ). So I asked XXXX where the XXXX credit that I was carrying over was, he stated that they applied my XXXX payment to the principle balance because I didn't owe any money for XXXX. So I asked him when was the credit I was carry over applied to my principle balance. And he stated it was applied in XXXX. I asked XXXX to send me confirmation of that. He sent me two print outs. 1 showing that since XX/XX/XXXX I was always paying a month in advance. ( from the extra payment I made in XX/XX/XXXX } I have never missed a payment. The other was a break down of my payments since XX/XX/XXXX- XX/XX/XXXX. Which looks like this Date Pd Amount Paid XXXX XXXX XX/XX/XXXX XXXX. XXXX XX/XX/XXXX. XXXX XXXX XX/XX/XXXX XXXX XXXX XX/XX/XXXX XXXX XXXX XX/XX/XXXX XXXX XXXX XX/XX/XXXX XXXX XXXX XX/XX/XXXX XXXX XXXX XX/XX/XXXX XXXX XXXX On XX/XX/XXXX I spoke with XXXX XXXX and she states I am up to date and that I am no longer running a credit balance. So I no longer have a credit of $ XXXX ( XXXX overpayment from XX/XX/XXXX + a few dollars here and there that I paid extra a few times ) Yet my principle balance has not decreased by anything besides my monthly payments. Where is my XXXX?

i am XXXX veteran. On limited income. i count every penny i closed on my home in XXXX XXXX after closing i filed my XXXX exemption for my home which lowered my monthly taxes by about XXXX +/- a month. The mortgage servicer ( berkshire bank ) over paid my property taxes by 2 and half times the amount due. in XX/XX/2020 they received the refund back from the county of {$2100.00} which was confirmed with XXXX who works for Berkshire bank.When we asked why these funds were not refunded back to me the buyer since there were not due and my mortgage payment adjusted XXXX stated they didn't have to they kept it in the escrow account. why does the mortgage company need to keep 2.5 times the amount due for taxes in escrow? currently there is over XXXX in my escrow account and the tax bill for all of 2020 is {$960.00}. the homeowners insurance was just paid in XXXX. they are not refunding back to me the excess in escrow as i should have a check for over XXXX on top of that my mortgage payment should be a maximum {$550.00} with the adjusted taxes and they refuse to lower it from XXXX. due to Berker shire bank refusing to refund my escrow account and lowering my mortgage payment to the appropriate amount. i have had to sell my car which the payment was only {$300.00} since the mortgage company overcharged me by over XXXX i just couldn't afford it I need help as i have perfect credit and need to live with in my budget please help me as they are stealing from me. i need my money as i barely have enough just to buy groceries. i live in XXXX XXXX XXXX district and have reached out numerous time with no response form her office either as i thought public official where there to help citizens in trouble.

i deposited two checks on XX/XX/22 in the amounts of {$1900.00} and {$1200.00}. I waited until the checks 'cleared " the bank. They were in pending status until XXXX when the funds were made available to me. On XX/XX/22, I deposited a check in the amount of {$1900.00} via mobile deposit. I again waited until the funds were made available to me. These were checks mailed to me for products I sold. Since the funds were made available in my account, I spent the money. Then on XX/XX/22, these checks bounced and Berkshire Bank took the money from my account. I then made two more mobile deposits on XX/XX/22 for {$1200.00} and {$1800.00}. Again the funds were approved and made available to me. Then on XX/XX/22, the money was taken out of my account because the checks were not good. In all instances, I specifically waited until the money was made available to me prior to spending it thinking these checks were ok. When I contacted Berkshire, they told me that I should have known better not to use the money for a few days. How am I supposed to know not to spend money that is made available in my funds. What is the waiting period? This makes no sense. Once money is made available, I thought the bank made sure these checks were in good order prior to making the money available to me. Now to cover my bills, I had to move money from my savings to cover the money that Berkshire Bank made available to me, then took back. This is not right. Something needs to be done about this. I am out a lot of money and I need it back. This is not my fault that the back did not do a complete check on these funds prior to giving me the money. Any assistance you can offer me would be so much appreciated. Thank you.

On Sunday XX/XX/XXXX I received a text message from Berkshire Bank asking me to authorize transactions to my account. These were not me, so I quickly replied and said no. I then receive a call from Berkshire Bank asking once again to authorize the four transactions, all that I said no, I don't authorize. They closed my debit card and I thought it was settled. Today, the XXXX of XXXX, I notice all transactions were posted to my account, even though I did not authorize them. I call the bank and they tell me " well once it's authorize, all we can do is dispute it. '' even though I did NOT authorize TWO different times. So now I am out {$400.00} because the bank let these transactions get posted. My money was stolen by a hacker and now it's stolen by the bank. I am beyond livid with how this was handled. I have been a customer of this bank for nearly a decade and I feel completely robbed and unprotected. What is the point of their fraud service if they're going to take my money for the next 90 days? I'm disgusted with Berkshire Bank and their way of handling this situation. The amounts were : {$100.00}, {$73.00}, {$53.00}, {$50.00}, and {$100.00}, all to XXXX XXXX. It's obvious my account was hacked and used to purchase XXXX video games. This is {$400.00} of MY money and I want it back.

Dear Sir, I order XXXX products every month. In XX/XX/2022 I ordered products using credits I had. However, XXXX charged my checking account {$130.00}. I called them immediately and they said they would cancel the charges. They refunded my money however in the interim the money they took out of my account caused a number of my checks to bounce. The bank charged me a fee of over {$250.00}. I explained what happened and the bank said they could only refund {$110.00}. That means I have to come up with and additional {$140.00} to cover fees. XXXX has admitted that it was a mistake to charge my account. Yet the bank XXXX refused to give me a full refund. I am now unable to pay my bills this month. I have deposited over {$500.00} all ready to try to solve this problem. I am not a rich person. The bank lost nothing. Why should they make money of a stupid XXXX mistake. The bank manager XXXX XXXX. XXXX refused to help me. She was steadfast in her refusal. You understand no money was actually lost. Thank bank paid out nothing. They are happy to make money of a companies mistake. I didn't authorize the payment which normally triggers a refund of fees. However, the bank intends to make money off of me no matter what.

I contacted Berkshire Banks Collections department to request that they contact me to work out a satisfactory solution regarding the charged off account from XX/XX/XXXX on XXXX separate occasions. o XX/XX/XXXX Told the collections team would call in the afternoon of XX/XX/XXXX. o XX/XX/XXXX Told the collections team would return the call in XXXX mins. o XX/XX/XXXX Told the collections team would call back later. Berkshire Banks Collections department refuses to accept a transfer of the phone call when asked to speak with that department. Berkshire Banks Collections department refuses to return my phone calls after stating that they will do so. The loan was charged off in XX/XX/XXXX. The balance was not reported to XXXX. After the loan was charged off, the vehicle was sold. The amount the vehicle was sold for was not reported to XXXX. The balance amount reported to XXXX in XXXX of XXXX was {$16000.00}. The balance was subsequently increased monthly until the current balance of {$18000.00}. The balance amount should never have increased once the loan was charged off in XXXX of XXXX. Berkshire Bank continues to report missed payments despite not having a payment plan in place.

In XXXX of last year our bank, Berkshire Bank sold our mortgage to a company that services our mortgage. The " new '' company has Berkshire Bank on their letterhead and when we call them the phone is answered " Berkshire Bank ''. We have tried to go to Berkshire Bank to discuss our problem and they tell us they don't have our information and can't give us any information. Back in XXXX when our mortgage was transferred we started receiving information that said our escrow was short and they can't explain why. First they said it was homeowners insurance but we have ben paying our homeowners insurance since we purchased the house and was in full effect. Then they said it was for our real estate tax had gone up ( {$3000.00}? ). Our mortgage has always been around {$1000.00} since purchase. We then started to receive monthly statements that said our new payment was approx. {$1300.00} because our taxes went up. We have spoken to several people at the bank and they always see there is a problem and will call back. They never call back. We have done this so many times and explained this to many people and the issue still have not resolved.

My problems all started when my wife and I needed more money than we had originally borrowed on a home equity loan. We applied for the new home equity in XXXX of 2021. We originally borrowed {$40000.00}. We asked for {$55000.00} on the new one, so they closed out the one for {$40000.00} and created a new loan. Instead of closing out the home equity loan they closed out my original mortgage. They took the money from the home equity loan to pay off the home mortgage. While all this was going on they were switching the mortgage payments over to XXXX XXXX XXXX XXXX I paid my mortgage in XXXX and XXXX for {$590.00}. They closed out the account in XXXX. There was also payments made on the Home Equity loan for {$400.00} for XXXX and XXXX. I also sent the bank {$2000.00}. I was sent some documents form the XXXX, NY office of changing my interest rates on both loans to make up for their mistake. They were going to change the mortgage to 2.5 % and the home equity to 3.125 %. They were also suppose to take out my mortgage and home equity out of checking accounts with XXXX XXXX and Berkshire Bank.

I paid my mortgage payment on XX/XX/01 in the amount of {$2000.00}, the payment was received and Berkshire Bank held the payment and did not post because of an increase in escrow. The bank made no contact with me to make me aware of the {$23.00} shortage due to the increase until XX/XX/01. I paid the {$23.00} to make the payment whole immediately electronically, Berkshire Bank had initially reported the entire payment 30 days late, theyve since reduced it it the {$23.00} delinquent and I do not agree with it to be late. Had they contacted me sooner, I would have paid it sooner and as it stands payment being made on XX/XX/XXXX with a XX/XX/XXXX due date is not over 30 days delinquent. I have had my mortgage with them for over 15 years and I think that I was late one time over ten years ago. It is a shame to have to be put through this but the negative impact to my credit is worth protecting. Ive enclosed my loan statement showing the transaction history as stated above. We paid off our Mortgage on XX/XX/2020 with Berkshire Bank. The bank owed us an escrow refund. They say they sent the check on XX/XX/2020. We did not receive it. We called on or about XX/XX/XXXX to report this. They told us we had to wait 30 days from the first mailing date to request a new check. We called back on XX/XX/XXXX and they said they would issue a new check. We called back on or about XX/XX/XXXX to report we had STILL not received it. We were told the check was not issued on XX/XX/XXXX but actually XX/XX/XXXX! So now we're waiting again, as we have still not received it. It has now been nearly 90 days since we paid off the loan and we have yet to received the refund of our escrow amount. They continue to hold OUR money and appear to have no clue what is going on. They further refuse to issue us the funds by some other means ( like a bank transfer ) and insist the paper check through the mail is the only way they'll do it.

We have a mortgage loan with Berkshire Bank in MA. The loan was underwritten in XX/XX/2018 for a single condo that we own which is in a condo trust with a total of 3 units. The Bank has asked for Master Insurance folder on XXXX. We sent them on XX/XX/XXXX the most recent folder from the Insurer. Back when XXXX first hit in 2020 I had missed a payment of {$350.00} in XXXX. The company I worked for had cut everyones hours in half and I struggled to pay my bills on time. I have since payed off entire loan and otherwise have great payment history. I reached out to BERKSHIRE Bank to request missed payment forgiveness and even provided proof of my hours being cut. They said they do not have to forgive missed payment. Now its a few years later but its still on my credit and I have learned they the federal government had left it up to lenders to do the right thing. Unfortunately birkshire bank did not.

Dear Sir, I was living on a fixed income. My roommate stole checks and food from me. When I went into the bank I found out I was overdrawn. I tried speaking with the bank they ignored me. I had a car loan through berkshire bank. In XXXX before my XXXX payment I bought a vehicle at a dealership and that dealership satisfied my loan with berkshire because I did a trade in. The bank was transitioning to a new system. A few days prior, I made a purchase for a vinyl record from the XXXX. Berkshire Bank received wire XXXX XXXXXXXX at XXXXXXXX XXXX. on XXXX XX/XX/2023. Their policy states that cash deposits and wire transfers are available immediately. However, they said it had to " process '' and the funds were not available the same day.
