DATE : XX/XX/2021 TO : XXXX XXXX, Valley View Home Loans, XXXX, CA FROM : XXXX XXXX XXXX RE : Refinance for home at XXXX XXXX XXXX XXXX, XXXX, CA XXXX XXXX, As I receive my check from XXXX XXXX, I think it is important to clarify facts in our transaction. Our first meeting was on XX/XX/XXXX to discuss a simple refinance, to reduce the mortgage interest rate on my personal home which was 4.25 %. I requested a lower rate, and wished to take out $ XXXX. ( See Attachment A ) ) On XX/XX/XXXX all materials you requested to complete the loan application were hand delivered to your offices. The home appraisal occurred until Monday, XX/XX/XXXX with the report delivered to you on XX/XX/XXXX. After that time, and until signing on last Wednesday, it has been a battle to get this refi finished in a professional and timely manner. Your lack of communication and availability created a problem where none needed to exist. I will not overload this letter with the hours of endless subterfuge on your part, including misleading information, not making appointments or returning calls or texts when you confirmed that you would. The amount of time I have lost having to manage this process is quite frankly unbelievable. My agent, XXXX XXXX, you and I all agreed that the refi was not handled in a timely and professional manner. You waived some fees and offered to give me {$300.00} credit to the home appraisal. That however did not tell the entire tale of this tangled web with you. I cancelled many appointments, business meetings and family events in the month of XXXX to clear my schedule as you told me repeatedly that my refi was third in line, next in line, we would be signing the following daynone of which happened. As time went on and my XXXX mortgage was coming due and payable and late on XX/XX/XXXX I asked you several times if I should pay my mortgage. You said no. See attached text mail above. Imagine my surprise when I came into your offices to finally sign docs and not only was the $ XXXX cash out not included in the loan, I was incurring additional closing costscosts that were directly due to the fact that I did not pay my XXXX mortgage as you instructed. When I left the offices on Wednesday you told me that would let me know when I need to pay the additional closing costs to the title company. You never did so. I became concerned on Friday as the deadline to fund before the end of the month was at hand. Not paying by the end of XXXX would have had a huge negative impact on my credit rating and future ability to purchase real estate at competitive rates. The title company advised me that I had to have a cashiers check to them before XXXX XXXX on Friday or the refi would not fund in time to avoid negative consequences. I cancelled my plans for that day, drove to the bank, obtained the cashiers check ( charge of {$15.00} ) and hand delivered it to XXXX XXXX XXXX. I advised you of this fact and you were upset that I had paid the additional charges as you were taking care of it, and I should pay on Monday. Monday would have been too late. And your offer to reduce these additional charges caused by you was to apply a {$350.00} credit for the home appraisal to the title company charges! At no time in my adult business life has anyone offered to reduce charges they incurred on my behalf by applying a credit they refund to me due to earlier lack of performance. As we discussed on Friday, I will be in your office today at XXXX XXXX to conclude our business transaction. I expect to pick up a cashiers check from you in the amount of : 1. Additional Closing Costs : {$1200.00} 2. Bank Fee Late Charges for XXXX Mortgage : {$66.00} 3. Credit towards Home Appraisal : {$350.00} 4. Fee for Cashiers check : {$15.00} TOTAL : {$1600.00} As of Monday, XX/XX/2021, the refi was scheduled to fund. However, the lender is still missing information from your offices. I texted you and emailed the title company to determine what information is outstanding. You now have texted that you have a doctors appointment at XXXX XXXX today and can not meet me as agreed upon at XXXX XXXX. You have pushed the appointment out until noon. And you will not provide information on outstanding data until XXXX XXXX. I add this note as this is a typical response from youdelay and duck tactics. UPDATE : XX/XX/2021 I received a check from XXXX XXXX XXXX this morning in the amount of {$1400.00}. This includes the originally agreed upon credit from you for the {$1200.00} closing charges and {$15.00} for the cashiers check ( {$1200.00} actual charges ; you only credited {$1200.00} ) AND credit back to me for lower than estimated county recording fees ( Title company check total {$1400.00} ). You still owe me {$350.00} credit towards my home appraisal and {$66.00} for bank late fees on my XXXX mortgage account. In addition, you are short {$.00} on the closing costs. You only credited {$1200.00} instead of {$1200.00}. Imagine my shock when I texted you today and asked to come get a check for the balance. You texted me and said that the additional {$270.00} in my final check from XXXX XXXX ( full amount {$1400.00} ) was to be applied to the amount you owed me and that we were even. See attached text message. XXXX, taking credit for a refund I was due as money you owed me is fraudulent. You owe me a balance due of {$410.00}. I will be in your offices at XXXX XXXX tomorrow to collect a cashiers check in that amount. Sincerely XXXX XXXX XXXX

I, XXXX XXXX, submitted an offer to purchase the property located on XXXX XXXX XXXX XXXX XXXX, CA XXXX. I was informed by my agent, XXXX XXXX, that if I used their preferred lender I would receive {$5000.00} credit toward my closing cost. After I did the math I realized I was going to be short so I offer {$5000.00} above asking price to get that additional credit from the seller. All thru the transaction I never once spoke with the lender or their representative. All deals were completed thru the real estate agent, XXXX XXXX .While we were completing the loan and the escrow period I would ask final closing amount but never received straight answer from XXXX XXXX . Until I was presented with what I know now to be the final closing documents. I noticed the lender cost were too high and I was not getting the agreed upon credit. I attempted to connect with the lender XXXX XXXX XXXX, XXXX XXXX to express my concerns, XXXX XXXX did respond with an email itemizing the cost and the answer to the discrepancies but never attempted to correct the high cost. I was not given the opportunity to shop for a loan I was told i had to use XXXX XXXX as my lender if I wanted to purchase the property. The problem is that I was never told the cost of my loan until I received the final closing documents and was told to sign them and that the amount I was questioning will be credited at the close of escrow and I would receive a full refund. I refused to continue with the purchase until the errors were corrected. I was told the wire {$12000.00} to escrow when the final escrow estimated requested {$10000.00}, The seller did not credit me {$5000.00} as agreed and neither did the lender credit the {$5000.00} for using him. What is worst the lender cost and escrow cost are not comparable to the industry. The listing agent and the escrow are owned by the same person and the lender is selected by the listing agent. Because of the problem of not receiving the credit I was promised, the lender and escrow cost being too high the person donating my down payment refused to continue with the gift .Since I was not able to get the gift from the donor I was not able to continue with the purchase. When I advised the lender, my agent, and escrow, their response was that I was confused and that I had to proceed. I was not informed ahead of time the cost of purchasing my home, the cost of doing the loan with Valley View Home Loans, XXXX XXXX, the cost of the escrow and I was asked to send different amounts to escrow from what the documents showed. Also the documents showed my agent XXXX XXXX, was crediting me from her commission, but she requested I give her the money back out side of escrow, which I gave her a personal check and she still has. I canceled the escrow because my donor will not continue with the transaction thus not giving the money to purchase the home. I am being forced to continue with the purchase or I will be sued for the commissions. If the lender would charged the normal fees, credited back what he promised, the escrow charged a standard fee and my agent represented me I would not have lost my donor. I ask if this file can be reviewed as I am being forced to purchase something that is not beneficial to me or my family

Bay Valley Mortgage Group Inc. dba Pacific Bay Lending NMLS id XXXX was the lender our company submitted a conventional loan too. On XX/XX/XXXX we submitted a refinance in the amount of XXXX with a loan to value of 78 %. The borrower resides full time in XXXX XXXX Arizona. The borrower provided us numerous documents to support this home as there primary residence. On XX/XX/XXXX our company requested an update as to when the LE would be sent out to the borrower. The lender provided us a screen shot of there turn times, along with the date of XXXX they LE would be sent out. Per the disclosure department they claim disclosures turn times are 48-72 hours. This would mean they disclosures should have been emailed out on no later than XX/XX/XXXX. The first area of issue was during this time. The lender tells us the borrower must wet sign them and mail them back to them. BUT our AE, and disclosure team tell us they had to " back date '' the disclosures to insure they were in compliance. This is the first area of business concern we have. Next, was the loan underwriting disposition. On XX/XX/XXXX the lender partially underwrites the file and immediately suspends it over occupancy concerns. Immediately our company asks questions. The lender and there staff refuse to respond and address the concerns. For example, we asked about XXXX XXXX guidelines, DU approval and the findings and so on. We submitted over 13 different documents to support the loan as a primary residence and this lender demanded XXXX tax returns. We informed the lender the borrower is on a extension and the response was if you can not provide XXXX returns the loan is declined for credit. We attempted to work through this but the lender refused. Finally, after 19 emails, and calls to many higher up people we got a response. The lender countered the loan to 2nd home occupant and the loan rate and pricing would remain the same. Well, then we asked what the ETA was for this correction the the AE and account manager refused to answer. Again we escalated. At this point the lender inserted there legal counsel. Mr. XXXX. He was less than helpful and threatening too. He claim that the senior manager XXXX XXXX just did not want to do the loan unless we provided the returns. We asked to speak to Mr. XXXX and was told he doesn't talk to anyone and will not talk to you. At this point we felt the lender was discriminating against us as a originating party and penalizing the borrower. Also we feel mortgage redlining is involved in this loan too. Our borrower is a highly qualified borrower and ultimately the lender said your terminated we will NOT deal with this loan or your company.

On XX/XX/18 I signed documents to refinance my mortgage from XXXX XXXX XXXX to XXXX XXXX XXXX company. My loan XXXX XXXX from XXXX XXXX had stated not to pay our monthly payment because XXXX XXXX would be paying off the remaining {$17000.00} balance per wire transfer. All accounts such as taxes, title company, credit cards were paid off by XXXX XXXX on XX/XX/18 which was the disbursement date. XXXX XXXX XXXX reported the payment late to the credit bureaus which caused my credit report to drop from XXXX to XXXX. I have called and sent XXXX XXXX the disbursement summary to show proof that it was disbursed on XX/XX/18 but they state that the payment was not received until XX/XX/18 since they are on the east coast. XXXX XXXX XXXX has now sold my loan to XXXX XXXX and XXXX will not return my calls or emails even though she stated she would help me resolve this. XXXX XXXX should have made sure that the payment would be received in a timely manner since XXXX the loan XXXX specifically stated not to make the monthly payment and they would handle it.Neither company will help me in resolving this matter. I have never been late on a mortgage payment and I trusted XXXX XXXX to payoff my balance on time. I don't know which company is at fault but how can I take a drop in my credit when I have never been late on any payments.I need help to resolve this issue. Thank you.

I applied to Pacific Bay Mortgage for a loan to purchase my first home in XXXX, Georgia. I recently graduated from college with a degree as a XXXX XXXX, and was looking forward to working near my new place of work ; XXXX XXXX. My loan was approved on XX/XX/2020 and the closing date was set for XX/XX/2020. The lender was unable and unwilling to get my loan closed on time so the seller imposed a {$100.00} a day per diem. The lender was notified in writing and by phone but despite my consistent XXXX calls, the lender gave no consideration to my urgency. They continued to misinform all parties involved and proceeded with no sense of urgency. The only reasoning they gave for their lack of urgency was that they were busy. I was finally cleared to close on XX/XX/2020 but had to borrow money from my parents to cover the {$3900.00} per diem for all the days I did not close. I believe the fair thing in this situation would be for them to reimburse me for all the additional expenses that I would not have acquired if I was able to close in a timely manner.

I contacted Pacbay Lending Group who is helping me refinance my home in which process started on XX/XX/2020. I called in to ask for update on my loan closing. I was advised only to leave a message for XXXX XXXX and left number and never received a call back. They advised me to connect with my referring broker and the broker said they haven't received any updates from this lender for several weeks already. I was advised by broker that i would be responsible for extension fees in which delays were all lender delays. I was also advised i would be charged a .5 % fee for loan not closing before XXXX. This is unfair and deceptive to charge additonal fees to borrower when it is clearly lenders fault for being unprepared and non compliant. My wife works at a bank and credit usually needs to be decisioned in 30 days not 45-50 days per this lender.

this is a follow request to my complain with Pacific Bay Lending. Based on my experience in mortgage industry. this company is not adhering to ECOA and Reg B guidelines. My loan was not decisioned within first 30 days of application. My loan is at day 45 and still no decision. Rate has now expired. Being in the business and industry when i spoke with the account executive XXXX he said " We were unprepared for this amount of volume '' and that since i am in the business i should understand this. This is not a valid excuse to not adhere to ECOA and RegB guidelines. I expect a follow up investigation in this companies untimely and " unpreparedness '' This is unfair to unknowing clients where fees and costs will be passed down to the client when the delays have all been on lenders end.

I am refinancing my home loan through Bay Valley, Lending who uses XXXX XXXX XXXX company. I was supposed to get a wire sent to my bank on Wednesday XX/XX/2020. As of XXXX XXXX on XX/XX/2020 I still have not received the wire. The Title company has not received the funds to wire. I have called and e-mailed numerous times to get the status and was told they would get back to me. That hasn't happened. I am worried I have been scammed.
