Dispute with Bay Equity ( see attachments for contact information ). I closed on a house in Montana on XX/XX/XXXX. I was supposed to close on XX/XX/XXXX ( and had loan approval ). About XXXX hours before I was to close, I was notified by the mortgage company that they wanted to see a Judgement that is with the courts in CA, related to my divorce in XXXX. They went through each line of this Judgement and asked that I produce a XXXX IRS tax transcript. I went to the local IRS office, and they pulled this transcript which showed an outstanding liability for this tax year, which I was not aware of, prior to receiving the transcript. Related to this liability, there is no tax lien. I have never received a tax bill. I have received IRS tax refunds for the last three years. This was the second loan I did with the same lender, and this issue never came up before. This judgement is currently under review with a CA Family Law Attorney, and we are working with the CA court to get a hearing so this liability, along with other issues related to my Judgement can be reviewed and ruled on by a CA judge. The mortgage company instructed the title company to withhold $ XXXX ( in the form of a check made out to the US Treasury ), as they stated, it was to protect their position, should the IRS decide to place a lien on the home I purchased before the deed recorded. The deed has subsequently been recorded ( XXXX XXXX Montana ), and then I did a Quit Claim Deed to place my home in our family Trust, which has also been recorded ( XXXX XXXX Montana ). I was told after closing that the $ XXXX was withheld due to a lien ( which there is/was none ), then I was told it was a loan condition. The mortgage company keeps telling me different reasons and changing the terminology as to why they believe they had the authority to withhold this $ XXXX from me. I have been trying .to get them to authorize the title company to release the funds back to me, they will not. Because there is no tax bill, there is no way to attach this money to a specific debt ( as stated by the title company ), because there is no bill or proof that the money is actually owed by me. Therefore, the check has been voided and is currently being held by the title company in a " holding account ''. I worked with an attorney ( Montana ) who provided the mortgage company two Demand Letters to release the funds back to me ( attached ), which the mortgage company has not complied with. I also talked to my CA attorney, and he agrees that the mortgage company has no jurisdiction over the Judgement in the CA courts, therefore, they need to release the money back to me so it can be handled by the appropriate state court. The house sold had no lien, the house purchased is now in my Trust. The Judgement is with me as an individual. A transcript is not a bill ( as confirmed by my attorney and the title company ). I don't even know if it is me that owes the money, as it was a joint return, and for all I know the IRS is working with my ex, which is why they have not reached out to me. I paid all other obligations under the judgement, so they may be working on with my ex on this one outstanding liability. All attorney 's, the title company, and my realtor, agree that the mortgage company has overreached their authority and has none over the judgement or what is happening in the CA court. In addition, the loan has now been sold to a new lender. I asked the question to the mortgage company why they think they still can withhold this $ XXXX from me, and they will not reply. I want this $ XXXX returned to me because XXXX ) they had no right to withhold it in the first place ; XXXX ) there was no IRS tax lien ; 3 ) I had loan approval 8 hours before I was set to sign, then they requested information from me at the last minute and all I was able to produce was an IRS tax script ( which is not a bill ) showing an outstanding liability based on a judgment filed in the CA court ; XXXX ) the Montana transaction has no jurisdiction in CA ; 5 ) two Demand Letters have been sent by a Montana attorney and they refuse to comply with the demands ; XXXX ) the Judgment is currently under review in CA to resolve the liability by a CA judge ; 7 ) I had no choice but to move forward with the loan because if I didn't close on the home purchased we would have been homeless ; XXXX ) this delay caused me tremendous stress and financial burden because we had to move out of the old house with nowhere to go because of the delayed closing and pay unnecessary storage and moving expenses ( we had to be out of the old house and could not close on the new one timely ; XXXX ) the mortgage company no longer has an interest in the loan, as it was sold ; XXXX ) the house is recorded in Montana under my Trust, and therefore no lien can be placed on the house for anything that is potentially owed by me personally ; XXXX ) I don't even know if this tax liability is mine to pay. Bottom line, Bay Equity completely overstepped their authority, and this is a complete overreach related to withholding money that was not for them to withhold. The title company stated yesterday that the instructions at closing to withhold this $ XXXX made no sense, as there is no corresponding lien or tax bill to attach the check to. If the check was sent into the US Treasury, it would go into some black hole and not be applied properly. Bay Equity has made several attempts to get the title company to send in the check to the US Treasury, they will not, as there is nothing related to what is simply called out in a transcript.

Bay Equity Mortgage botched my mortgage application process. I had professional behavior issues with a loan officer and it was escalated to XXXX, the Compliance Officer at Bay Equity Mortgage. The remediation discussed with XXXX was also fumbled. I have requested that they terminate the loan process. I also requested that the " Compliance Officer '', XXXX, confirm that all PII data no longer required be removed from their systems. As with my recent emails, she will likely ignore my request. This is unacceptable and it represents a pattern of unprofessional behavior from Bay Equity. Ignoring problems does not make them go away, it just permits them to happen with the next consumer. My Realtor XXXX XXXX with XXXX XXXX XXXX, tele # XXXX, XXXX received a flyer from XXXX XXXX XXXX # XXXX and GA # XXXX c/o Bay Equity Mortgage stating part of there products and services was 100 % Financing with XXXX months Bank statements , which is what I was looking for. I contacted XXXX XXXX on the same date and he sent me the same flyer, that we have as evidence. He sent me the information to register and begin the application process, which i completed the application on XXXX/XXXX/21. On the same date of XX/XX/XXXX21, I received an email stating that I needed a XXXX XXXX XXXX and to meet that requirement. I needed to pay down XXXX XXXX XXXX {$2000.00} dollars ( I have documentation of that transaction ). I was puzzled by the credit score and contacted XXXX XXXX as I had pulled my credit and it was XXXX. He stated that they use a middle score and I was a XXXX and needed XXXX points for there program and paying down the card he could re-score me and I would be over XXXX XXXX score. On XX/XX/XXXX21, I paid the card down the $ XXXX and submitted him the letter from XXXX XXXX showing the balance.. I didn't hear from XXXX XXXX and contacted him and he then requested the proof of ownership and existence of the business. I submitted those documents to him. After I had not heard from him, my realtor contacted him as well and he didn't reply to either one of us and when he did eventually reply to my realtor it was with some sarcastic remark regarding the length of time it was taking for the re-score. Because of my work as a XXXX XXXX XXXX and XXXX, I travel extensively. I had emailed and called XXXX XXXX on several occasions with no response. On XX/XX/XXXX2021, I contacted his supervisor XXXX XXXX XXXX # XXXX -XXXX # XXXX, Tele # XXXX and email XXXX. I stated to XXXX XXXX that I was having problems with XXXX XXXX and couldn't get him to respond to myself or my agent. XXXX XXXX stated that they had terminated XXXX XXXX XXXX for misrepresentation??? I inquired as to when he was terminated and he stated XX/XX/XXXX2021. I then inquired as to what exactly did he mean that XXXX XXXX had been terminated for misrepresentation. He went on to say that the program that I signed up for DIDNT EXIST, they don't offer 100 % financing with XXXX months Bank XXXX? I was incredulous and asked him what did he mean when I was looking at a flyer with XXXX XXXX and Bay Equity 's name stating he worked for Bay Equity Mortgage and they offered 100 % financing with XXXX months Bank statements along with other products and services. XXXX XXXX stated that was why they fired XXXX XXXX, they don't offer those services. I was furious and had him contact my Realtor/AgentXXXX XXXXXXXX and we conducted a three way conversation and he apologized and stated that they didn't offer those stated programs. My agent, told him that I had turned in a XXXX day notice to my landlord in anticipation of buying and closing on a house and we both stated that they had a Fiduciary responsibility not to have him misrepresenting the company to the public.. We asked him what kind of resolution were they offering and he stated that they were in the process of cleaning up the mess XXXX XXXX had left as he had numerous clients that he made the same misrepresentation too, but he would see what he could do and would call us back. On this same date of XXXX XXXX called and stated that they couldn't offer any resolutions. Upon further due diligence we learned they have a 1 star out of five star rating with the XXXX XXXX XXXX This company is clearly committing bait and switching and Fraud and Misrepresentation in advertising and offering products and services that do not exist!!!

I started working with Bay XXXX XX/XX/XXXX. I came to them seeking a refinance of my current mortgage in order to lower my interest rate and secure a better financial standing with the consumer credit bureau for credit reporting because my current mortgage is with a private lender. I was advised XX/XX/XXXX that my closing would be on XXXX XXXX. Both verbally and in writing. With hopes of earlier if they could get underwriting to finalize everything sooner. They were made aware that I would be traveling with my family from XXXX XXXX - XXXX and would be unavailable during those dates. XX/XX/XXXX, my current mortgage company provided a pay off letter through XXXX XXXX that did not include my XX/XX/XXXX payment because if closing took place XX/XX/XXXX, payment could be postponed in order to process the closing documents correctly using the current payoff letter. I was advised that not paying the XX/XX/XXXX payment was acceptable ( both by Bay Equity and my current mortgage holder ) due to the closing schedule. We were not made aware of the cancellation of the XXXX XXXX closing until a few days prior. We set another closing date for XXXX XXXX when I returned from my travels. Upon approval and constant contact with my current mortgage company, my XX/XX/XXXX payment was again not made due to my travel plans keeping me from mailing a payment and getting another closing date set for the day of my return, XXXX XXXX. Mailing the payment would delay the XX/XX/XXXX closing because a new pay off letter would be needed and documents proving the XX/XX/XXXX payment was made and cleared and there was no time to provide these with my travel plans. We were advised days before XXXX XXXX that the closing date had been cancelled again. When I returned on XX/XX/XXXX from my trip, I promptly mailed my current mortgage company the XX/XX/XXXX payment. My current mortgage holder sent over a new payoff letter with the XXXX payment showing paid. Another closing date was discussed for XXXX XXXX. I did not find out that this date was cancelled until late on XXXX XXXX and I was out of town on business XX/XX/XXXX -XX/XX/XXXX and on XXXX XXXX when I returned, I sent an email to my current mortgage company asking why my XX/XX/XXXX check had not cleared my account. They received this payment XX/XX/XXXX but misplaced the check and it was never cleared through my checking account XX/XX/XXXX due to the misplacement. Upon this news, a new payoff letter was sent along with an email explanation direct from my mortgage company Bay Equity explaining the XX/XX/XXXX payment situation. Each day/week from this date, I have emailed and called Bay Equity to get a status check on the closing and why we were so delayed. I have done requested of me to finalize this loan in a timely manner. I was assured multiple times by my loan officer and his staff that my loan was fine and it was internal issues that were causing the delay. I was told that refinances were always pushed back at the end of the month to finalize new purchases. I provided all requested documentation and/or responses to questions within minutes of the requests in XXXX, XXXX and prior to XXXX XXXX. Nothing has been requested of me since then. I have complied with each and every request asked of me. Each day/week, since XX/XX/XXXX, I expected a closing to be set and documents to be sent. My XX/XX/XXXX and XX/XX/XXXX payments have been mailed to my current mortgage holder and proof of payment can be provided. I am not sure what happened to my loan and why I am being denied due to the XX/XX/XXXX payment situation but I strongly disagree with this denial of loan and feel that something unethical has taken place.

XXXX XXXX XXXX XXXX XXXX XXXX XXXX, TX XXXX XXXXXXXXXXXX XXXX/XXXX/2016 The mortgage lender Bay Equity made many mistakes and treated me very poorly. I have many recorded phone conversations and emails. Here is a list of things they did wrong : - They told me they would easily close on the house within 45 days. However, I had to get multiple extensions and had to finally cancel the contract with the seller. - There were lots of unnecessary delays. They would contact me after days and weeks of no communication and would tell me to hurry on my end and sign documents and get new requirements from the contractors. Instead, the lender should have kept in constant communication with me and told me all or most of the requirements up front. - I was told multiple times that this little loan was taking too long and too much work to close on. The Loan Officer mentioned he normally deals with larger loans and did n't want to spend too much time on this smaller loan. This is discrimination against poor people that do n't have money to purchase expensive houses. He belittled me many times. - They told me the house had plumbing issues and a plumber was needed when that was not the case. They did n't want to read/analyze the appraisal report and realize there was no plumbing issue, just rotten wood from previous issues in the house 's history. If I was to get a plumber, they would n't have done anything. There was nothing to fix. - They told me the estimates from the licensed contractor were too low and wanted me to get more expensive quotes. They were pushing for larger bids/quotes. The contractor decided to drop out after too much back and forth. I had to then find more contractors, delaying the whole process and having me to get more extensions with the seller. - I wrote them an email and also had a phone conversation where I locked my loan@3.99 % but was told later that was not the case. The rude Loan Officer was XXXX XXXX. I have phone conversations saved where he says he knows better than to trust me and other nonsense like that. I had to go above his head and his superiors gave me a 4.125 % interest rate. - Eventually after a few weeks, they decided to change the loan to a XXXX streamlined. This was so because of nonexistent plumbing issues they said and the house was not inhabitable, which was not the case. My interest rate went up. - The lender told me after my 4th extension with the seller that I would need to check the foundation. They should have told me from the beginning. - XXXX XXXX was very rude to my realtor and me throughout. - They were uninterested in closing as soon as possible, costing me time and money. - I would ask questions and either I would receive responses a few days later or I would never hear from them. - Made me email my personal documents instead of uploading to his website. I had to remember myself to upload instead of emailing. My realtor kept in contact with XXXX XXXX, the Loan Officer, much more than I did, I 'm sure she also has a list of things they did wrong. Please review our case ; people should n't have to go through this type of process and be treated as I was. I believe I should be refunded all my expenses by Bay Equity and the XXXX and Loan Officer should be fired. This has probably happened to many other home buyers and will continue to happen.

I want to purchase the home I 'm in now. I have a lease option to buy for XXXX I approached a mortgage company : Bay Equity Home Loans, a local franchise here in XXXX XXXX, XXXX XXXX XXXX. My situation is unique in that I 've been a victim of ID Theft with regards to my former employer : XXXX exposing my XXXX Tax information to overseas hackers and that the IRS Confirmed this with a letter in XXXX that my XXXX was submitted a second time in XXXX 2016 : SEE ALL ATTACHED. In speaking to XXXX XXXX, he assured me that since I 've got my case well documented that he " felt '' that he could overcome my low credit score and the massive inquiries from XXXX to XXXX 2016 which I 've written the XXXX bureaus about removing as of XX/XX/XXXX. I 've asked my real estate agent : XXXX XXXX ( XXXX XXXX XXXX, XXXX, XXXX ) who wrote my original contract and lease option to assist me with the purchase of the home. Now, due to my SHORT SALE of my previous home, I owe the VA XXXX due to the LOSS " BUT '', I 'm still eligible for SECOND TIER loan Guarantee according to the XXXX XXXX of a home up to XXXX. Here are the details of that phone call : 1 - The home needs to have the tongue and axles " REMOVED '' as this is a double-wide manufactured home : THEY ARE GONE! 2 - VA DOES NOT require an engineers report 3 - Remaining bonus entitlement = $ XXXX XXXX - XXXX of home to buy : {$200000.00} 5 - WE HAVE {$2000.00} in that the landlord/owner agreed to use towards a down payment 6 - The new certificate will be issued as a compromised CLAIM in the center section of my loan certificate NO MIN CREDIT SCORE REQUIRED and it 's based solely on investors and lenders overlay. THE PROBLEM : XXXX XXXX at Bay Equity REFUSES to now get me a load because the house was move to this location from the original location where it was set when purchased buy the original owner. THUS : They are DISCRIMINATING AGAINST ME as a VETERAN and REFUSING TO ALLOW ME TO BUY THIS HOME. This is NOT ACCEPTABLE and XXXX XXXX told me now I have to SHOP AROUND for a bank/lender the WILL allow me to buy this home because it was moved a SECOND TIME. IT 'S XXXX! PERIOD, END OF CONVERSATION. If the VA will GUARANTEE the loan and they could care less if it was moved a bazillion times to another universe, then why wo n't BAY EQUITY or even XXXX do it and shut me down wishing me " GOOD LUCK! '' I DO N'T HAVE TIME FOR THIS XXXX and DO NOT FEEL THAT I 'M BEING TREATED FAIRLY!. I can BE EVICTED and the HOME CAN BE SOLD FROM UNDERNEATH ME and I WILL NOT STAND FOR THAT.

I signed closing paperwork to refinance my mortgage on XX/XX/2020 with my first payment being due on XX/XX/2020 through Bay Equity LLC. ON XX/XX/2020 I mailed out my first payment with coupon that was in my closing paperwork to the Bay Equity address listed. The check cleared my bank account on XX/XX/2020 in the amount of {$2200.00}. On XX/XX/2020 I received a statement from XXXX XXXX saying they now service my loan and first payment is due. I called XXXX and was told no payment from Bay Equity was ever forwarded to them. I then received a letter on XX/XX/2020 from Bay Equity dated XX/XX/2020 and postmarked XX/XX/2020 stating the loan will now be serviced through XXXX. I called the number immediately and spoke to XXXX XXXX ( Bay Equity ) at XXXX EST and told there was no payment showing in their system and he wouls look into and get back to me in the am. I then left voice mail for XXXX the next day XXXX XX/XX/2020 XXXX at XXXX XXXX with no call back. On XX/XX/2020 at XXXX ESTI finally reached XXXX and told no check was ever received per the accounting department. XXXX also informed me that his manager would look into and for me to email a copy of canceled check which I complied immediately after conversation. I then contacted XXXX XXXX from my local Bay Equity via email ( XXXX ) who is also looking into lost payment. Then on XX/XX/2020 at XXXX XXXX finally responded back to me and said " Yes the funds have been located and I am working with management to have these funds wired to your new servicer before the end of the day ''. As of today XX/XX/2020 XXXX EST funds still have not showed up in new account. I had to make another payment on XX/XX/2020 for {$2200.00} in order not to go in default since the grace period was over on XXXX. I can forward all emails if needed. Thank you, XXXX XXXX

I am attaching a detailed summary to include documents ; dates, amounts, attempts to resolve, and the hardship Bay Equity Home Loans has caused XXXX XXXX XXXX XXXX as well as XXXX potential buyer of our Duplex. On XX/XX/2023 a contract to purchase our duplex was received. In the packet was a pre-approval for the buyer for a conventional loan. An appraisal, which was supposed to be an appraisal for conventional, came back at {$410000.00}, well under the purchase price of {$500000.00}. We and the buyer wanted a solution. The lender suggested switch to FHA, agreed XX/XX/2023. 2nd Appraisal ordered by the lender came in at {$500000.00}. On XX/XX/2023 lender issued a credit denial. On XX/XX/2023 we received another offer to purchase with FHA financing. Listing broker provided the {$500000.00} appraisal. Through an email from the initial lender, email included as proof, that they filed the incorrect appraisal in error. As it was submitted to us that it was an appraisal for a conventional and the XXXX correct appraisal was filed with for the FHA. Our hardship, due to the first appraiser 's error, which he admitted, it is attached to our property for 120 days, which means we can not accept any offers from potential buyers until after XX/XX/2023. In addition we lost the ability to sell twice to buyers. This is a serious financial hardship to my company. As you will see in the attachments, we have tried numerous times to have this corrected. The lender 's agent refused to give us her supervisor 's name. Please review the attached documents. Our request is to have the incorrect $ XXXX appraisal removed and the $ XXXX correct one tagged to our duplex. Thank you.

Bay Equity -refinanced an existing loan previously held for 10 years with XXXX XXXX XXXX with notissues. New loan executed with Bay Equity -first servicer was Bay Equitty LLC , XXXX XXXX XXXX XXXX, NJ XXXX ( XXXX ). Received notification XX/XX/XXXX changing servicer to XXXX XXXX, XXXX XXXX XXXX XXXX XXXX GA XXXX ( XXXX ). Another mailing notification went out XX/XX/XXXX that we received the wrong mailing and to disregard and we were staying with the current servicer. Bay Equity LLC. Loan number changed from XXXX to XXXX. Received another notification XX/XX/XXXX and then another on XX/XX/XXXX. Each mailing had different instructions on how to make payments. Which I made all three timely. Issue I made a payment on XX/XX/XXXX as soon as I had the correct address to send payment to and check cleared, I made another payment XX/XX/XXXX for XXXX payment and check cleared. I then made a third payment for XXXX on XXXX XXXX electronically once I finally got access to the account electronically. One of my payments was not applied. I would not file this complaint but, I have made so many calls without any response. They do not answer the phone nor call back to the customer service line. I have called numerous times ( XXXX ) and have only made contact once. This is how I finally got the electronic account set up. They are showing late payment to my account and check number XXXX cleared my bank on XXXX from my checking account at XXXX XXXX but, not applied to my home loan. I have never had this much difficulty with a company never responding and their website has no other way to contact them but the customer service line they don't answer.

I applied for an FHA loan through a company called Bay Equity. I dealt with a very unethical salesperson/scammer, named XXXX XXXX XXXX This person sent me a loan estimate and verbally told me that if I go with him, I would get a 4.5 % rate for my FHA mortgage ( no admin costs ). Within 2 hours, he said that he could no longer give me that rate because my credit score came back below their 640 cutoff. I had just pulled credit with another lender within that same 30-day timeframe and my credit was XXXX. I asked that he send me proof of my credit score and he said " I didnt believe him '' and that he would no longer correspond with me because he sells 30 loans a month and doesnt need my business. He did not send me this info even after repeated attempts to get it. I called and filed a complaint and a rep from their legal counsel called me. She said she would have someone reach out that could get me the rate agreed to and my credit info. A sales supervisor called and told me XXXX did lie and that they showed my credit score to be above their 640 cuttoff. He said he would look into a solution and call me and never called me back. Now, the rates have increased, I lost the home I put an offer on and still dont have the credit info I asked for. Additionally, XXXX tried to trick me by emailing me and stating that he could possibly " trick '' his system into giving me a XXXX credit score so I would qualify but that I needed to pay additional admin fees to him. I have saved all email correspodences.

I 'm purchasing and brand new home in XXXX XXXX and applied for mortgage loan from Bay Equity Home Loans since the end of XXXX 2016 and we received email and the package congratulation for the loan approval in XXXX 2016. It was supposed to close escrow in the week of XXXX but it did n't happen because at that time they then start asking for more and more proof of our sources and the time lengh that where my partner lived before.. Every time they ask, I provide it to them right away, NO delay but I never heard an update few days or week later then I contacted them, and every time I contacted them, they ask for more and more. I had documents sent over from XXXX and they said they need interperetor to translate and I still did n't hear nothing until 10 days later they still said that they still looking for interpretor then next day afternoon XXXX contacted me and told me to cantact some lady to pay {$250.00} for translation but that lady 's company do n't take credit card, the lady asked to to transfer the fee into her coworker that has the same bank with me to avoid the transfer fee for me, she said. I took care whatever I need to take care but until now they still telling me maybe next week, tomorrow. I took their words and assumed as it, I ordered appliance, furnitures and kept on reschedule so many time due to delaying on the loan at the point that delivery companies wo n't let me reschedule anymore

Back in XX/XX/2021, I contacted XXXX XXXX for a home purchase. They recommended their mortgage loan company/person of interest, Bay Equity, XXXX XXXX. It started fine, however when I started to shop for my own loan, XXXX was becoming very defensive, almost as if he was offended that I would do such a thing. At first, I knew it was just his mind games trying to make me concerned and go through him. But then as he pressed to continue the loan that he already told me I was approved for, he then takes it back and says " hey, so you actually aren't approved and I need you to forge some documents for me ''. I thought he was kidding at first, but then he continued telling me how I wouldn't have enough money without " renting out '' our property first. He said it's just " a little forgery '' and fraud isn't a big deal. I contacted my realtor to let him know, but then he echoed out " It's just a little fraud, it's not a big deal ''. I was done. I called his boss to let him know what was being asked of me, and he was shocked. He immediately removed my realtor from escrow and took over, and I went with another lender. He and XXXX were constantly texting me afterwards saying " it's not a big deal, we can still make this work '' ( I have all the text messages ) I wanted to report XXXX XXXX and will be reporting the realtor as well ) so he doesn't cause harm like this again.

I have closed on four conventional mortgages over the last year. This is the first time I was baited to join a mortgage company, Bay Equity. The loan officer I used was XXXX XXXX, XXXX # XXXX. I emailed him to see if they could beat a rate and the loan officer had me first upload all my information and then emailed me an edited loan estimate. When I say he edited, I used his numbers on his loan estimate and totaled {$69000.00}. His total on his loan estimate form was {$65000.00}, which did not make any sense. I confronted him about the numbers because the loan origination fees were significantly higher than the competitor XXXX mortgage, but he gave me a .01 % better rate. He claimed this rate was enough to offset the numbers. He edited the document to try and deceive me. I asked him to explain how he got to these numbers, and he told me the math adds up. He never could justify the numbers. The reason I am making a written complaint is that if he tried to do this to me, I bet he has done it to other people. I doubt most people would catch this, as closing on a home loan can be burdensome. I uploaded his loan estimate so you can verify that if you add up all the numbers itll total XXXX and not XXXX which was on the loan estimate form.

On XXXX XXXX 2015, I filled out an application w/Bay Equity, LLC to refinance my home. On XXXX XXXX 2015, I paid {$490.00} to have my home appraised per Bay Equity, LLC instructions. The Lender notified me on XXXX XXXX 2015 that they had underwriter 's approval for my loan. Then, I was scheduled for 'closing ' on XXXX XXXX 2015. During the 'closing ' I talked to Bay Equity personnel 3 times at numbers : XXXX & XXXX ; while in the process of signing all relevant documents. At no time during this process did Bay Equity personnel cite any derogatory complaints concerning the funding of my loan. As of XXXX XXXX 2015, I have not received any official documentation from Bay Equity : As to why my loan did not fund? In XX/XX/2017, I purchased my current home through Bay Equity home loans. I was assured at the time of purchase, that all taxes and Melo Roos were impounded. After a year of having the loan, I received a letter from my current mortgage company stating a shortage in escrow. I went over my loan documents and found out that my Melo Roos were never impounded, as stated. I then contacted Bay Equity home loans. They acknowledged the mistake and offered to fix the escrow shortage ... Which they did. Then I was promised they would refinance my loan free of charge to correct the mistake that was made on their behalf because they didnt want a bad loan on their company. After providing all the necessary information that was requested, I was informed that they couldnt do the loan because of my debit to income ratio. I was assured that this problem would be fixed and they said it was nothing they could do. The only thing that I want was the original loan agreement that my contract states. I feel that its unfair to me that they left out the Melo Roos, so I would qualify for the loan with out my knowledge. If possible can you please provide information on who should I contact to resolve this matter. Thank you

I have made multiple attempts to resolve my statement issue with Bay Equity directly, and have also requested to speak with a supervisor regarding my concern and have not received any call back I continue to get excuse after excuse.I closed my loan back in XXXX and have not received any statements regarding my mortgage. I have received numerous life insurance offers from Bay Equity in the mail, but not my statements. When I called on XX/XX/XXXX to make a payment and question why I have not received any statements the explanation I was given was that Bay Equity had the address for the apartment that was on the loan application, which I then explained was incorrect the mailing address is the property address of the home I purchased, according to the agent this was then corrected, however I continue to not receive statements in the mail. I continue to question this on the following dates XXXX and the latest call was on XX/XX/XXXX. I am very concerned because I know my escrow will be ran soon and I will not receive any statement with the option to pay my shortage, resulting in a higher mortgage payment. Please help me resolve this issue that I have tried to resolve multiple time with Bay Equity.

On XX/XX/XXXX my husband and I finally bought a duplex. My sister ask if she could co sign for us. We moved to the duplex on XX/XX/XXXX, I live in the front house and my sister moved to the back house agreeing to pay XXXX per month. Bay Equity ( the mortgage broker ) stalled on the closing date long enough that the interest rate increased by .625 % and we were not able to go to another lender to get the promised interest rate. They told us that the stalling was because the underwriter needed a tax transcript rather than a color copy of the submitted tax return. In the end, they went with a different underwriter completely, so should have been able to do this at the outset. The total amount of interest we are now liable for is over {$20000.00} more than what we would have been liable for had we closed on time. After signing the documentation at closing, we were given a closing disclosure that was again incorrect and the processor refused to give me a straight answer about what numbers were actual. I have repeatedly asked questions to have them answered incompletely or not at all.

This is what I wrote the lender. I am writing to express my concern regarding the second trip of the appraisal, for which I have been charged. As you are aware, this trip was arranged between you and the seller, and it was never my responsibility to pay for it. I am extremely disappointed that I have been charged for something that was entirely out of my control. It does not make sense for me, as the buyer, to be held accountable for an expense that was not incurred as a result of my actions or decisions. I would appreciate it if you could review the situation and refund me the amount that I have been charged for the second trip of the appraisal. We recently purchased our home. Bay Equity is the mortgage holder. Bay Equity apparently sold the loan to XXXX. The sale of the loan, we are told, closes on XX/XX/2023 ; however, and for the past two weeks, both of the Lenders have reported the same loan to all three credit agencies. We have only one loan! We have tried to get this addressed and rectified ; however, we have been told essentially that " too bad '' and it will get fixed at some time in the future. This is entirely unacceptable.

My first months mortgage was due to XXXX XXXX but I had auto draft still activated at XXXX XXXX. XXXX XXXX withdrew the mortgage payment from my bank account and applied payment.
