I was approved for a {$1500.00} loan with Bay Country Financial Services on XX/XX/XXXX and due to good payment history was approved for another loan of {$1000.00} on XX/XX/XXXX. In the midst of the COVID19 pandemic, I was unemployed and running late on making payments to the lender due to lack of funds. My car ( XXXX XXXX XXXX ) was repossessed by XXXX XXXX and XXXX XXXX, XXXX XX/XX/XXXX due to missed payments. Bay Country stated that I had to pay {$340.00} to get my car back. However, the tow company stated I had to pay about {$300.00} and an additional {$100.00} for everyday my car was left on their lot. I did not have this kind of money to pay at the time so in XX/XX/XXXX the vehicle was returned to the first lien holder ; XXXX XXXX XXXX and my car was sold, and the account was closed. On XX/XX/XXXX there was a Summons Issued to my former address stating that there was a small claims case opened against me. The tentative court hearing was scheduled XX/XX/XXXX, which I appeared to defend myself but was told there was no actual hearing just a judgment being made. I was given Bay Countrys Lawyer information ( XXXX XXXX XXXX XXXX and told to contact him for more information. I went to visit his local office in XXXX XXXX, MD twice, both times I was unable to speak with him or get to anyone in the office. I contacted the office via phone and was able to speak to XXXX XXXX XXXX XXXX. She wasnt able to give much information of clarity or help but told me to contact XXXX, the manager of Bay Country Financial Solutions. Upon doing my own due diligence ( because the summons was sent to my old address ) I saw on Maryland Case Search that Bay Country and XXXX XXXX filed a Writ of Garnishment against me on XX/XX/XXXX in an attempt to collect an alleged {$4700.00} of debt owed. On XX/XX/XXXX I visited XXXX at the Bay Country office in XXXX XXXX, MD ( please refer to recorded conversation available in documents section of this complaint ). When I spoke to XXXX, I was told that I had the option to set up a payment arrangement to finalize debt and it would stop the Writ of Garnishment from being processed. XXXX also told me that I only owed an amount of XXXX XXXX XXXX XXXX XXXX and something dollars, it might be cheaper. But once I informed him that that was not the information I saw on case search he referenced that he may have to call XXXX at the attorneys office. To me, he did not sound like he knew much of what was going on with my case. I also asked him if he could provide me with a letter giving me the exact day they repossessed my car for my records he stated he would give me a call in a couple days once he did more research. XXXX called me XX/XX/XXXX retracing all statements he told me in office and communicating now there was no way he could set me up for a payment arrangement. He also stated he could not give me a letter for my records because the company does not give out that information. He gave me the information to the tow truck company XXXX XXXX XXXX and XXXX XXXX XXXX XXXX ) and directed me to call them and stated maybe they can give me more information of when the repossession took place. I called the tow truck company and spoke with the manager and she communicated that she could not tell me when my car was repossessed because through their contract with Bay Country, they can not give out that information either. So, I felt like I was being given the run around. I have a few issues with this process. Bay Country Financial Services did not act in good faith throughout this whole process as I feel parts of our contract/agreement were intentionally left out throughout this entire encounter. I feel that there was also a lack of due process considering the attempt to garnish my wages for well over the loan amount borrowed and attachment of other fees without my defense. According to 15 U.S. Code 1692e A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. It further explains in ( 4 ) the representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful, and the debt collector or creditor intends to take such action. Which states that a debt collector can not seize my vehicle in an attempt to collect debt unless lawful. However, my contract was between XXXX XXXX and BAY COUNTRY FINACIAL SERVICES, with XXXX XXXX AND XXXX XXXX, XXXX nowhere in that agreement nor was it explained to me as a part of the repayment process ; Bay Country Financial Services again not acting in good faith. So, technically XXXX XXXX and XXXX XXXX XXXX XXXX has committed an unlawful seizure or Grand Theft Auto to be exact according to the law and had to nerve to attempt to charge me to retrieve my vehicle. This unlawful act also explains why they did not want to give me any proper documentation stating the date and time the retrieved my vehicle. Bay Country seized my vehicle and after many other unlawful acts as a debt collector committed by them throughout this past two years and dealing with them I do not believe they should have the right to garnish my wages today. I also owe the Maryland Vehicle Administration about {$1000.00} for a lapse of insurance during the time Bay Country had my vehicle due to them not submitting the proper documents to the correct authorities and still not being able to give me those documents once requested.

I am filing this complaint because I believe that Bay Country is guilty of deception business practices. On XX/XX/XXXX, I contacted Bay Country at XXXX because I received a second loan pre-approval notification. I asked a representative to verify the validity of the correspondence. The representative said that I was pre-approved, however, I would need to payoff a previous debt ; a debt that was included in a XXXXXXXX XXXX XXXX bankruptcy. When I challenged the accuracy of her statement, I was transferred to a Branch Manager who told me that even though the debt was included in a bankruptcy, I was still liable for the debt because the loan was a secured loan. I asked for this information in writing, was told they would send it ; to date I have not received. They did however send me another pre-approval letter. I am reporting this incident for two reasons. First, I believe that XXXX XXXX bankruptcy law is quite clear on this subject. Unless I re-affirm the debt ; it is discharged. However, this business is giving contradictory information. Secondly, I believe that this business is operating deceptively by sending out pre-approval notifications; telling people that they are pre-approved to trick them into applying for a loan. In my case, I believe it was a tactic used to try and deceive me into reaffirming a discharged bankruptcy debt under the pretense of a pre-approved loan.

I was approved for an title loan through bay country in XX/XX/XXXX. My car was repossessed in XX/XX/XXXX. I attempted to get my vehicle out by paying what was due. My lender told me I I had to pay XXXX to get my vehicle back. Paid bay country only to find out I had to pay the same amount to the repossess company and XXXX-XXXX a day going forward. The XXXX I was paid to bay country was all I had which I explained to them. They told me its nothing they could do. I got my tax refund a month later and got my vehicle out for approximately {$950.00}. Pandemic began in mid XXXX which included an state wide Moratorium putting a stop to evictions and repossession. I was unemployed due to the COVID and told bay country I wont pay when I get funds. We spoke monthly to see if my situation changed it did not. XX/XX/XXXX I called to make a payment the very next month my account was sent to collections department. I was told that the full amount of my loan was due and I no longer qualified to make payments. My car will remain in repossession status until the full balance is paid. Original loan amount was XXXX now I owe XXXX.

So I entered into a car loan good faith agreement with bay XXXX finance Llc which is a subsidiary of bay XXXX finance about XX/XX/XXXX. For a used XXXX XXXX XXXX. Later down the line in about XX/XX/XXXX bay XXXX finance illegally repossessed my automobile first because they claimed they didint know where the car was since the police ended up taking my vehicle due to XXXX profiling and the XXXX police department ended up impounding my vehicle. After I got it out from the police 2 weeks after bay XXXX illegally repossessed my automobile violating my consumer rights usc 6802, 15 usc 1692 and 15 usc 1692k. Bay XXXX finance again illegally repossessed my automobile again in XXXX of XXXX without going through the court by getting a sheriff or a letter from the judge. From their actions I have since suffered mental damage and financial damage, I lost employment I had due to the fact I had no way of making it to my job. Bay XXXX finance is currently trying to sue me in large claims court to try and get the default amount of XXXX. These financial thugs im sure have done this to others as well.

XXXX XXXX XXXX XXXX, of XXXX XXXX, MD forced me to accept their insurance even though the car was completely insured prior to and after obtaining the loan. This increased the amount of the loan and in turn increased the amount of each payment that was owed, which ultimately let to my car being repossessed after missing two payments. The company that repossessed the car is called XXXX XXXX charges a flat fee of {$450.00} to return the car and they add a charge of {$25.00} per day to further deter someone from being able to retrieve their car. I had the money to pay the back amount owed to the loaner but not enough to pay the ever increasing amount of the company they used for repossession. This company uses very shady business practices. I showed them proof of my car insurance and they still added their own insurance to the car loan and increased my loan amount without my consent.

Received call from XXXX XXXX the beginning of XXXX about my not making my XXXX payment. I explained that I don't have the money until the XXXX Wednesday of the month ( soc.sec ck ). Received letter from them dated XX/XX/2018 saying I was two months behind, XXXX payment due XX/XX/XXXX have 5days grace. Letter stated that if I didn't make payment they were going to repo my car if I did not respond within 13 days from the date of the letter for the balance of {$280.00}. I borrowed {$230.00} added note that I would pay extra each month to get caught up. Didn't hear anything from them. Now I am receiving calls from them. I changed my phone number so I wouldn't get any more calls.

Bay Country Finance is a company that officers personal loans with collateral ( title ). I have been had this loan for about two years to get repairs done to my car. They charge surcharge fees to process payments using a debit card. It is {$12.00} per card transaction to pay the loan back. Example, loan is {$200.00} per month, I am being charged {$210.00} to process using my debit card. They provide an option to come into the store to make a payment but both locations are 30 mins away from me. I dont think this is legal or should be illegal.

According to 2 hard inquirys on my credit report one XXXX/XXXX through XXXX from XX/XX/XXXX this account is still activate, but in excellent standards which should show payments made on time and account balance was paid off to XXXX well ahead of time. Another inquiry is from Bay County Consumer which was paid off and account closed well over 10 years ago in XX/XX/XXXX or XX/XX/XXXX. I believe these 2 accounts begin hard inquiries are make my credit report through XXXX as low as it is at this time.

To whom it may concern, The reason for this letter it to dispute multiple unauthorized inquiries on my credit report. On XX/XX/2023, I retrieved a copy of my credit report XXXX and discovered multiple unauthorized trade that I have no knowledge that is on my consumer report. Because I did not apply for credit with BAY COUNTRY CONSUMER FINANCE, INQUIRY DATES : XX/XX/2023. I have also reached out asking that they remove the inquiry from my credit profile.

I took out an loan with Bay Country Finance and I don't think that I should be given the loan because I am still making car payments with my car company. I have fell back on my car payments because I am trying to pay off this title which they keep applying interest to and they are not very understanding. They are ripping people off.
