For over 6 months RE : Dispute - Bay Area Receivables Original creditor YOUR DOCS IN, and XXXXXXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX, Maryland XXXX, under the Fair Debt Collection Practices Act ( FDCPA ), failed validate the alleged debt request has been over 6 months. I am aware that there is a debt from Bay Area Receivables, Debt does not include a breakdown of any fees or validation of debt. Additionally, under the Health Insurance Portability and Accountability Act ( HIPAA ) to protect my privacy and medical records from third parties. I do not recall giving permission to Bay Area Receivables, YOUR DOCS IN or XXXXXXXX XXXX XXXX XXXX XXXX for them to release my medical information to a third party. I am aware that the HIPAA does allow for limited information about me but anything more is to only be revealed with the patients authorization. Therefore, I requested twofold validation of debt and HIPAA authorization which you have failed to provide. The FTC has noted that providing a copy of a printout, bill, or alleged account documents does not constitute validation. Mere itemization of what you already have does not accomplish my requested debt validation Bay Area Receivables have failed to include Method of verification under FCRA 611 ( a ) ( 7 ). This should have included the following : * The How with which you verified the information *The name of the person handled your request and provided proof of ownership of Debt through physical verification * The address * Which documents you obtained to verify Ownership of Debt. If none are satisfied under federal law, you must delete file/ tradeline * Provided breakdown of fees including any collection costs and medical charges and physical proof from original debt. *Provided a copy of my signature with the provider of service to release my medical information to Bay Area Receivables or any other third party. * to Verify- through physical verification of the original signed consumer * Cease any credit bureau reporting until the debt has been validated. Bay Area Receivables failed to provide me with copies of all documentation associated with these Debts bearing this information in my credit report with my authorization of release bearing my signature. To be in full compliance with the FCRA laws and guidelines, all information listed needs to be immediately deleted from the credit file you maintain under my social security number, date of birth, and /or address. Be further advised that I am closely monitoring my credit file. Per the Federal Law, you have failed in 30 days to complete this investigation as outlined per the Fair Credit Reporting Act 623 ( a ) ( 3 ). You failed Per the Federal Credit Reporting Act. This item from BAY AREA RECEIVABLES, INC. on behalf of XXXX XXXX XXXX XXXX is inaccurate because I was overcharged on XX/XX/XXXX by {$13.00} ( $ XXXX- {$20.00} copay ) as per the provided bank statement. XXXX XXXX XXXX applied the {$13.00} to a date of service XX/XX/XXXX, but the issue is this is fraud as I was not even in the state of Maryland then so please see the attached complaint filed with the Maryland Attorney General on XX/XX/XXXX. In XX/XX/XXXX, after months of investigation the Maryland Attorney Generals office asked that the {$13.00} be credit to the date of service XX/XX/XXXX. Since this would make {$20.00} ( $ XXXX+ {$13.00} ) which is the copay. The account was XXXX out on XX/XX/XXXX and the complaint was closed as we thought it was settled. On XX/XX/XXXX XXXX XXXX XXXX XXXX ( XXXX XXXX XXXX XXXX billing company applied the {$13.00} to XX/XX/XXXX. A month later XXXX XXXX XXXX XXXX billed me again for {$13.00} as we went back and forth I was told this account would NOT go to collections. On XX/XX/XXXX XXXX XXXX ( supervisor for XXXX XXXX XXXX XXXX ) told me via phone, XXXX XXXX XXXX was again claiming I owed {$13.00}. I explained I did not owe that but wanted to prevent this from FRAUDENTLY being applied to my credit but she refused to take payment and said she would call me in two weeks ( XX/XX/XXXX ) but she never called. On XX/XX/XXXX in protest and with a note that I did not owe XXXX XXXX XXXX anything I paid them {$13.00} again to preserve my credit via their payment portal listed on the bill from XX/XX/XXXX. Now XXXX XXXX XXXX had been paid multiple times for the same thing they decided to again make false and fraudulent claims to XXXX, XXXX, XXXX via Bay Area Receivables. It was not until XX/XX/XXXX when I went asked for a home loan that I was told I had a collections account for {$23.00} from Bay Area Receivables so I was disqualified which was devastating as did not think I had any collections account on my credit. On XX/XX/XXXX I contacted XXXX at XXXX XXXX XXXX who put me on hold for a while and said someone would call me back which they never have since this whole issue started. I contacted XXXX XXXX XXXX XXXX and talked to XXXX who said my account with XXXX XXXX XXXX was XXXX out, I should not be in collections and she was going to have XXXX XXXX look into this as well as a refund for me. I then contacted XXXX XXXX of Bay Area Receivables who said I owed {$24.00} for date of service XX/XX/XXXX to XXXX XXXX XXXX and they would remove the account if I paid, so they extorted the money from me as I need to get this off so I can get a home loan and move on with my life. Bay Area Receivables did not send the letter ( email ) to confirm they sent a removal request to your company.

On XXXX while signing the closing documents to refinance my home, I was provided with copies of my credit report from the 3 major credit bureaus. On the XXXX report I noticed that it stated I had an account in collections. After closing, I immediately went to XXXX and requested a copy of my credit report from XXXX. On the report, I saw that I had been placed in collections for {$86.00} by XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, MD XXXX, United States ) with a debt collection agency Bay Area Receivables INC ( XXXX XXXX XXXX XXXX, XXXX, MD XXXX ). Since I had never been notified by XXXX XXXX XXXX or the debt collection agency of any outstanding balance, I immediately phoned the collection agency at the number listed on the credit report, XXXX. I spoke with a representative and advised that I had never received any notification of the debt, so I was upset that it had been reported to a credit bureau. He advised that a letter was mailed to me in XX/XX/2020 to my home address. I advised that I never received that letter. I requested that they resend the original letter and / or verification of the debt. He refused to do so and said that I had chosen to either ignore the letter or that I had misplaced it. I advised again that I had never received the letter. Further on in the conversation, he advised that the original debt was for {$250.00} and that my insurance had paid {$160.00} and the remaining balance was {$85.00}. This immediately concerned me, as that information was totally incorrect. I informed him that I was the one that had paid the {$160.00} out of pocket and that per my XXXX XXXX XXXX website account, there was no outstanding balance against the original debt from XXXX XXXX, as the insurance plan discount was {$85.00}. He asked that I email him this information, and I said I would not do so without some verification of the debt in writing and asked multiple times for him to resend me a copy of the original letter they claim to have mailed to me. Each time he refused and said that I had only 30 days from the date of the original letter to ask for verification of the debt or dispute the debt. I have attached a copy of the medical claim made with XXXX XXXX XXXX verifying the above stated amounts. In addition, I am also attaching a file downloaded from my HSA account website showing all of my transaction, on row 63 you can see that I paid the {$160.00} on XXXX on transaction number XXXX.

In XXXX discovered an erroneous/fraudulent mark on my credit report from XXXX XXXX XXXX ( XXXX XXXX XXXX , XXXX, MD XXXX ) and Bay Area Receivables ( XXXX XXXX XXXX XXXX ; XXXX, Maryland XXXX ). I contacted XXXX XXXX XXXX and informed them of the mistake. I contacted Bay Area Receivables and informed them error. I filed a dispute with the credit reporting agency XXXX. I mailed XXXX XXXX XXXX and Bay Area Receivables certified letters requesting they produce competent evidences that bares my signature to provide I owe this debt within a reasonable period. Furthermore, I requested until they could produce competent evidence no future actions should be against me. At the end of a reasonable time if they can not provide competent evidence proving the erroneous debt they remove the erroneous mark from my credit report. I filed a dispute with the credit reporting agencies simultaneously. I received delivery conformation both letters where delivered from the US Mail service, but no response from either XXXX XXXX XXXX nor Bay Area Receivables. XXXX removed the mark from my credit report. In XXXX I discovered the erroneous/fraudulent mark on my credit report. I responded by sending a second letter to both XXXX XXXX XXXX and Bay Area Receivables followed by another dispute with XXXX. I did not receive a response from any parties, so I contacted XXXX XXXX XXXX via phone. The accounting/billing department told me we had no record of the debt. I have no recollection of this debt nor have I ever received validation from either party to the validating the debt or the soundness of the report mark. This is a medical bill on my credit report! Today, I discovered the mark on my credit report once again. I contacted XXXX and filed another complaint. I contacted XXXX XXXX XXXX via phone. The Vice President is having a letter drafted stating this is an erroneous account. The alleged debt is a medical bill dating back 8 years. I was notified by XXXX XXXX with Bay Area Receivables , Inc. ( Address : XXXX XXXX XXXX XXXX, XXXX, MD XXXX ) Email : XXXX that I owed a debt from XXXX XXXX XXXX in the amount of {XXXX}. The agency had reported this debt to the collection agencies. I stated that this debt was originally sent via XXXX XXXX XX/XX/XXXX via XXXX ( XXXX ) but was not cashed. A check was resubmitted on XX/XX/XXXX and the check was finally cashed on XX/XX/XXXX. I sent this information via email with the claim details and check number on XX/XX/XXXX. On XX/XX/XXXX she claimed to have researched this information and stated the bill was not paid and I owed the balance and fees for collection. On XX/XX/XXXX I contacted XXXX XXXX and spoke with " XXXX ''. They handle the billing for XXXX XXXX XXXX. I gave her the claim details and check number. After some research, while I waited on the phone, she stated that she " found '' the check and would notify Bay Area Receivables. I again notified Bay Area Receivables. Then on XX/XX/XXXX I sent a copy of the check that had been submitted on XX/XX/XXXX and was cashed on XX/XX/XXXX. They did not notify the credit agencies and then I had to file dispute of claims with all 3 agencies. Bay Area Receivables has also not notified me that this was resolved and a correction made. I have Proof of Payment from XXXX that shows the cashed check for {XXXX} that was for payment of this claim. I also want to be refunded the fee that was charged to my credit card on XX/XX/XXXX for {XXXX} for " transaction fee '' as this was the error of XXXX XXXX, XXXX XXXX XXXX and Bay Area Receivables. I was using a month to month gym membership at a gym called XXXXXXXX XXXX XXXX at my seasonal home in XXXX XXXX Maryland. Started in XXXX and I called to cancel several times in XXXX through XXXX of XXXX due to Covid. Their voicemail simply just said they were closed due to Covid but I still left several messages saying I was canceling my month to month. They never got back to me and in XXXX I received an email from a company called XXXX XXXX out of XXXXXXXX MD saying that they were open and they started charging my visa. I disputed the charges and finally had to block them and called them to tell the I canceled my month to month with XXXXXXXX XXXX in XXXX but they told me I now have a 2 year contract with them and I can not cancel it. Its now at a collection agency who posted it on my credit report which Ive also disputed. I also called them and told them there is no contract, its not my account and I filed a formal complaint with the State Attorney General of Maryland. This looks like extortion considering I never signed anything with this mysterious company that I never heard of and Im curious how many other people theyre trying to pull this scam with. How are they allowed to attach it to my credit report without any proof of me being legally bound with a contract? I am very involved with my credit and have an exceptional credit history. Ever since Bay Area Receivables has had collections relating to me, they have not sent me a statement or documentation regarding the debt. I end up finding out by email since they had an old email on file. I have to ask them each month for a statement and they still don't send me a statement, usually they send me an email with the account number, collection name, base principle due, interest/fees and total due. I have received one statement after sending numerous request. I also have one account in collection that my ex-husband is responsible for and I notified them of this to be told, too bad the dentist office submitted my information as the responsible party. I was the primary parent providing housing/food/and daily necessities. My ex was court ordered to provide the insurance coverage and we split all quoted cost for services and any charges that the insurance did not cover he was also to have paid those cost. He was also to handle all discrepancies with insurance/medical office billing as he was the parent carrying the coverage and the one who received all benefit statements and documents on what the insurance did/did not cover. Making him the responsible party of medical debt. This was explained to the dentist office when we started seeing this dentist and the paperwork was completed in the manner that the staff instructed.

XX/XX/17 and XX/XX/2017 contact was made with XXXX at Bay Area Receivables regarding incorrect information that was reported to all three credit bureaus regarding a debit I do not own nor is even affiliated with my name. I spoke with XXXX at Bay Area Receivables and requested a letter to provide to XXXX to document information on my credit report filled by Bay Area Receivables is incorrect and that I am not affiliated with the account nor name that was submitted to all three credit reports by Bay Area Receivables. Sue, in the special sevice department at XXXX stated I needed the letter along with the dispute to have the information removed. I was told, per XXXX, that " XXXX '' the owner of Bay Area Receivables would not provide me with a letter nor would she. Bay Area Receivables reported a debit to all three credit bureaus that show an alias name on my credit report along with a debit owed by another individual. I received a letter dated XX/XX/XXXX from a company called Bay Area Receivables about a debt they claimed I owed to them in the amount of XXXX, forwarded to them by XXXX XXXX. On XX/XX/XXXX, I responded with a debt validation sent as certified mail with return receipt. The company received and signed for that letter on XX/XX/XXXX. Bay Area then responded with the necessary documents to support the validation of the debt. However, the debt had already been satisfied - over two years ago. I mailed in a copy of the money order receipt ( dated XX/XX/XXXX ) on XX/XX/XXXX ; certified mail return receipt. The company received that letter on XX/XX/XXXX. They failed to respond to that letter however, they proceeded with putting the inaccurate debt on my credit report AFTER this letter had been received and signed for. I sent a direct dispute against the company on XX/XX/XXXX which was received and signed for on XX/XX/XXXX. I have allowed the 30 days to investigate PLUS the five days to mail and have yet to receive a response. This company has failed to comply with the dispute period set forth in FCRA 623 ( a ) ( 8 ). A debt collector is trying to collect money owed from 2016, though they took over the debt from a company that went out of business and never tried to contact me about the debt. I contacted the hospital who was the originator of the debt for them to tell me they have no record of one of the bills. I paid one debt in full to the hospital directly and let the debt collector know that the other bill did not exist in their system and that I need proof of the bill before I pay. The communication turned hostile via email and the collector told me that I was pulling a " pity card '' and began signing emails as " XXXX '' after I told the collector that they were XXXX for the shady business practice of never reaching out for payment, having all of my contact info on file as I've already tried to reconcile my accounts with them. On XX/XX/2021 I received a notification from XXXX, XXXX and XXXX that my credit score decreased due to company called Bay Area Receivables Inc reporting erroneous debt. I never received information in the mail in regards to this debt nor was I ever contacted via phone. Bay Area Receivables reported 6 items presumed to be medical debt ranging from XXXX to XXXX dollars reporting on XXXX XXXX and XXXX I proceeded to dispute information with all the three bureaus online, and XXXX was the only one to delete the information related to this company. On XX/XX/2021 I sent a validation/verification letter certified mail to bay area receivables to prove the debt. They did not respond within the allocated date of 30 days. I mailed certified letters to XXXX and XXXX requesting them to remove All negative accounts associated to Bay Area Receivables due to no response. XXXX Deleted all information immediately and XXXX did not. May Complaint is XXXX has yet to remove this negative items from my credit report following request to do so, and the fact it was removed by the other credit bureaus.

I was contacted by XXXX XXXX from Bay Area receivables saying that I owed {$1700.00} to my doctor for XXXX. This was 1 year after I received the bill. I told the man that I was sure I had paid it. I told him I would look for payment and call him back. I have perfect credit. Being older it took me awhile but for some reason I could not find the payment. I just knew I had paid it. I called XXXX XXXX back and told him I could not find the payment and paid him the cost of the bill. He wanted me to pay months of interest and he did charge me a filing fee. He said I also owed other bills from 3 years ago which I have not researched but I know were paid. 5 minutes after I got off the phone I found the cancelled check for {$1700.00} and immediately called him back. I sent him a picture of the cancelled check. I asked him to return my money and after 3 weeks he has not. He said I owe fees and late charges and is holding the money. The debt is not mine to pay, as I am and have been a consecutive recipient of XXXX. I have spoken with the insurance companies as well as the XXXX XXXX XXXX where the bill originated. There was a mix up with the insurance however, they have corrected then matter and it is being processed but the collection agency refuses to remove the account from my credit report. I was unaware of the existence of the matter since the information they have is dated. Both insurance companies are listed on the date of service but there was an error that led the insurance to submit the incorrect XXXX. Since they have fixed the issue and I spoke directly with the supervisor to ensure the company timely filing for their mistake. Either way I am not liable for a bill when I am insured current and retrospectively. I will fax in the correspondence I have received from XXXX XXXX which corrected the issue so that the correct insurance company which is XXXX XXXX can be billed. I also contacted the XXXX directly and they sent over a letter regarding the matter and dates of coverage.

XXXX of 2017, I attended a Nightclub/Lounge in Washington DC with friends and left my wallet in the car taking only my main Cash and Cell Phone. When we returned to the car the window was smashed out and several items including my wallet had been stolen. Had a balance with a XXXX XXXX XXXX 's office, for an oral examination of my right front tooth, on XX/XX/2021. I received a letter sometime in XXXX asking for {$92.00} for my visit. I discovered on my free annual credit bureau report a collection account # XXXX for {$560.00} by Bay Area Receivables. I dispute this entry item as Bay Area Receivables has not followed proper procedures under the Consumer Financial Protection Bureau 's Debt Collection Rule as to notification of alleged debt. Bay Area Receivables never requested payment from me. Before reporting an alleged debt to a credit reporting company a debt collector needs to contact the party either : in person, by telephone, mail, or electronic delivery.
