UNFAIR FTC COLLECTION VIOLATION REF # XXXX BASS & ASSOCIATES P.C., illegally seized my XXXX tax refund, after I made a dispute in XX/XX/XXXX. I disputed that I owed a Student Loan, from XXXX College, NY. I paid this debt in full between the dates of XXXX - XXXX ( approximate ). I confirmed with the XXXX XXXX XXXX XXXX, that this debt was no longer owed. It was paid by confiscating all tax refunds through the period of XXXX - XXXX ( approximate dates ). Once I received a refund from the Federal Government, I call the Student Loan Department, and was told that I no longer owe this debt. Now, I receive a letter, almost 28 years later, from Bass & Associates P.C., stating that I still owe this debt. It became very confusing, thus, I faxed a letter to Bass & Associates P.C., disputing this claim. I never heard another word back from Bass & Associates P.C., either to confirm that I did not owe this student loan, or that there had been some type of mistake made. On XX/XX/XXXX, I discovered that Bass & Associates P.C. illegally seized by XXXX Tax Refund. No notices, judgment, nor factual and historical financial data was given. How can an collection agency confiscate my tax refund, without providing me with proof of this debt? Bass & Associates P.C., provided me nothing! No notices, no proof of owing this debt, absolutely nothing was provided to me, supporting that I did owe this debt. Bass & Associates just took my XXXX tax refund. If I had owed this debt, why didn't they do their research into this matter, then make contact with me on their updated information? I would have then asked for an installment plan, due to the facts that I'm no longer employed, and am living off Social Security Retirement Benefits. I have very little income to spare. There were no notifications at all, coming from Bass & Associates P.C., in response to my letter faxed over on XX/XX/XXXX, disputing their claim of debt owed for a student loan. UNFAIR PRACTICES according to FTC, and ILLEGAL CONFISCATING OF MY XXXX TAX REFUND. I DEMAND TO BE REFUNDED IMMEDIATELY. Once finished with Bass & Associates research to find this discrepancy in my payments for this student loan is over, and there is a difference that I owe, then I will set up an installment plan for ONLY THE PRINCIPAL OWED, NOT INTEREST, NOR COLLECTION FEES. I say this because, it was not my error in how I re-paid the student loan owed to XXXX College. Somewhere, there was a mistake made, and not by my fault. I will only pay any differences based upon the principal balance only. I DEMAND JUSTICE FOR WHAT BASS & ASSOCIATES DID, ILLEGALLY CONFISCATING MY XXXX TAX REFUND, WITHOUT RESPONDING TO MY DISPUTE MADE ON XX/XX/XXXX.. In XX/XX/XXXX, after finding out my student loans had went into default, I contact Bass & Associates, the collection agency that my loans were sent to. They offered me a 9-month rehabilitation program in order to get out of default. I was told that I could have 9 payments auto-withdrawn from my account each month, upon completion of the rehab program, the loans would be sent in good standing to a loan servicer once being returned to Dept of Ed. I agreed to this, they had me log onto their website and electronically sign a rehab agreement form. From XX/XX/XXXX-XX/XX/XXXX, I paid every payment on-time. I then waited for correspondence from either Bass and Associates, Dept of Ed, or a new company on the next steps. XX/XX/XXXX I was shocked to discover my taxes were offset. I thought my loans were out of default? I attempted to contact B & A multiple times and could never reach anyone in their office. In the beginning of XX/XX/XXXX, I realized I could log onto the Dept of Ed website and check on my loans. At this time, it gave me an option to make a payment so I did. I contacted Dept of Ed to ask about the default status. They explained that they NEVER RECEIVED THE REHAB AGREEMENT!! from Bass & Associates and suggested I call to get that from them. I was told by the Default Resolution Group representative that day that IF they send that over, they will remove the default. So I continued my attempts to contact Bass & Associates. I called EVERY SINGLE DAY! Finally after 6 weeks, I was able to contact another department that obeyed my request for a call back. They told me that they sent my loans back to Dept of Ed and to contact Default Resolution Group AGAIN. They also explained they wouldnt be able to see if my Rehab agreement form was sent because they didnt have my records. I contacted Default Res Group, they told me they STILL didnt have the Rehab form. So they advised me to write a letter and send whatever proof of payment I had to the Default Res Group for them to review within 21 business days. TODAY I called to find out that they will NOT lift my default because a ) they did not receive the rehab agreement form b ) I didnt continue paying after the 9 months was completed. I am a veteran, I just resigned from my job to finish the last 7 classes to obtain my degree. I am tentatively enrolled in classes to start in two weeks in which I will use my GI Bill however, I can not enroll in a Default status, regardless if Im not using loans. I was just told that you can only attempt the rehab program once, since I didnt follow through, I will have to pay my loans in full before coming out of default. I owe $ XXXX. This is 100 % mishandling on Bass & Associates fault, also Default Resolution for deceiving me through this process. I made payments to B & A for months that never made it to Dept of Ed, meanwhile, had Dept of Ed known I was in a rehab program, received payments, had the loans returned, ALL as promised, then I would have been notified of completion, notified of new servicer, and would not have had a tax offset. Most importantly, I would not be worried about the pending financial hardship I will soon endure, and worried I will never be able to finish my degree and advance in my career.

Let me first begin to tell that the loans were already written off and then reapplied in XXXX of this year. XXXX was closed because of Fraudulent activity by the United States Government for over charging there students as a student we had the opportunity to have that erased and that is what i did. This had already been erased and the way i found out that it was reistablished was that i went for a car loan recently and found out that my student debts were reapplied. So that you are aware i wrote the United States Supreme Court not just in regards to these loans but because of dealings with a debt collector who was hired to not only collects debts from me following an accident that i am the victim of but i am also the witness who can provide information that will prove that the death of a co worker was not an accident and could of been prevented. The debt collector in question here is XXXX and XXXX XXXX, they not only broke the Right To Fair Debt Practice but also violated my financial privacy and continues to do so for 5 years. The XXXX 's have also broken several communication laws including computer and cell phone fraud and this has been reported to police however since i have information as a witness to that accident XXXX XXXX Police and other local law enforcement agencies and First responders have instead harassed me. An officer failed in doing his job as did the company and it's employees and previous managers and i have knowledge of the cover up. XXXX XXXX was negligently XXXX because of money and greed. I am the person who attempted to save his life and took the driver home that night who did not possess a license to drive a truck. I am being told that because the DOT is involved as well that i am being extorted. Bass collection agency took {$230.00} out of my monthly check without contact. XXXX XXXX was given a note from my doctor which they asked for. I needed to notify them within a week of my signing up for classes which i did to let them know that i would not be attending that semester due to symptoms of XXXX. This is not about collecting a debt this is about oppression and trying to keep covering up a crime that needs to be brought to light. A former supervisor XXXX XXXX is still harassing me because i know for a Fact that due to his budget restraints that the building was not up to code and if it had been XXXX would have not lost his life. I was on the safety committee. The city attorney for XXXX XXXX is failing in doing his job and it is my goal to see this through. XXXX XXXX put a device inside my XXXX vehicle that had military software and it violated my 4th amendment rights and because they got busted with this ( i took a photo of it ) i am a constantly harassed by faceless XXXX. I am providing you a copy of the documentation given to the United States Supreme Court and the evidence that i have of what a cloned device looks like and how can catch the XXXX ( The XXXX and member of XXXX XXXX School District ).

My loan was originally provided through a company named XXXX ( XXXX XXXX XXXX XXXX ). I approximately began getting garnished back in 2018, at that time I received a letter from a separate company than whom is now receiving the funds. There was a period of time when I was being garnished at a different rate and it stopped without notice and began back at a different interest rate/amount bi-weekly seemed to be based off of my Gross Amount earned. I have been contacted by the company Bass & Associates who has not provided me with any information concerning the Loan, and will not share terms of the loan, including a current balance owed. At the time I reached out to XXXX the Representative insisted that I set-up an account unknowingly of the terms or circumstances that I would be subjecting myself into, after already knowing I have paid approximately {$7000.00}. At some point in conversation I was told that I had a 0 % interest rate with a balance of {$5000.00} with no proof of statement or explanation of terms. The Customer Service included no empathy for the simple fact of speaking to an individual about what is supposed to be my information yet, I have no insight on what I am being demanded to engage in and agree to, also my income is being decreased significantly and it is out of my control. I am not saying and putting up an argument that it is not due, my argument is that I have been paying into this loan and actually have no idea where the funds are being paid to and with no information, a balance or know the terms. According to my Credit Report this debt is showing as Closed and over a course of the years the interest rate continue to increase. I am requesting help in Customer Service and equal opportunity from this company of knowing my obligations to be able to not let this affect me in ways of financial and health related stress. On or about XX/XX/XXXX my identity was illegally used to apply for a Federal Student Aid Loan. I did not sign for or apply for any loan with XXXX Universities or any Federal Student Officer. XXXX Universities created and process a XXXX Student Aid Loan fraudulently using my identity without ever having me sign a single document. Once they received the loan from the Federal Government through the Department of Education, I was never told about it. Once I learned of this after a year later, I tried to resolve this identity theft loan issue with the College, however they knew they had been caught, so they blocked all access to this matter of course. The debt was disputed and once removed from my credit file, only to be replaced back on my credit file serveral years later through the Department of Education and and company called Bass and Associates. This loan is a " Well Known '' identity theft case, involving www.pin.ed.gov. a former Website that was identified as the conduit that identity thieves could very easily exploit. The Department of Education took action against this after receiving my certified letter to the Department of Education OIG on XX/XX/XXXX. On XX/XX/XXXX this website was shut down and a new process put in place called the FSA ID. Since I discovered this conduit, it's been a consistent battle to get this undisputed illegal debt obtained under false pretenses by XXXX Univesity with the US Department of Education fully removed from my Credit File. They are deliberately trying to maliciously attack my Credit Rating by placing this back against my Credit File and it is still affecting my credit to this day nearly 10 years later. This needs to be addressed and actions taken against those involved in this injustice. It is in direct violation of the FCRA and is a total fraud that was fabricated through a well known conduit for identity theft to occur through www.pin.ed.gov.

My name is XXXX XXXX, since XX/XX/2019 i been in contact with Bass & Associates to try set up a payment plan to get in to Loan Rehabilitation program. Bass & Associates is a loan process for Department of Education. Since XX/XX/2019 i have being getting the run around to trying to complete the appropriate document, 1st i contact bass & associates XX/XX/XXXX, i was told to send pay stubs and student loan payment document, after submitting this documents Bass & Associates never contact me with my application update, 2nd i contact bass & associates XX/XX/XXXX to follow up regarding the document i submitted, i was my paper work is in process i will receive loan rehabilitation agreement in mail within 10 days 3rd i contact bass & associates XX/XX/XXXX to follow up regarding my status, again i was told everything is received i will receive rehabilitation agreement within 10 days 4th i contact bass & associates XX/XX/XXXX to follow up regarding my status, and again i was told all my document was received i will getting rehabilitation agreement within 10 days. 5th i contact Bass & Associates XX/XX/XXXX, i was told i am missing one document i should be re-submitting Loan Rehabilitation expense form ( which i did XX/XX/2019 ). All above contact was made by me via a phone the hold time to get bass associates on the phone is average 1-2hr. It have/has been extremely difficult to try to communicate and solve the problem with bass & associates and department education, my life have been put unhold, This has been trumades stress on my life, to the point i am seeking a medical help. The complaint is against Bass & Associates a debt collection agency out of XXXX, AZ and XXXX, TX. They are fraudlent and misrepresenting legal debts fees, they harass their customers and go behind customers back and file wage garnishers and sending wage garnishments while their asking for documents, no hearing but they are taking money without giving the customer a chance to set up a payment plan I also disputed some loans and they are trying to garnish my wages, I provided proof of why I did not owe and they sent it behind my back and told me the garnishment would proceed and im going to say it my name is XXXX XXXX and I feel my consumer rights have been violated, im filing for harassment, dishonest business practices, misrepresenting the legal status of a debt, threatnening with lawsuit and wage garnishment, demanding a amount thats not supported by law or the original creditor amount, this is a FDCPA violation. I provided proof of the dispute and they still proceeded with the garnishment without a hearing at a rate of 15 %. These people almost left me homeless. I want this matter taken care of as soon as possible I tried to reach out to them, but it was a slap in the face. After I provided documents I was told it would be a additional 60 days for a hearing while they proceeded with the garnishment, I even faxed paperwork and was told it would be 24-48 hours before it would be looked at. The school closed and I told them that and I disputed the other loans because they were too much for a XXXX XXXX loans totaling {$60000.00} dollars when the original amount was only {$12000.00} for the program. I also explained to them that I have been a victim of identity theft as well and I sent documents they dont care about that.

I, XXXX XXXX was contacted by letter from Bass & Associates. The letter was address to the Estate of XXXX XXXX. Now prior to this, I had been receiving treating phone call recordings from a debt collector on my cell phone but discarded as scams and blocked them each time from my cell or at times I did call back with no result. Now, once I received this letter I right away called this cooperation. I gave my name only and she confirmed with me that I was alive. I said yes, and wanted to confirm they were talking about me, due the fact that my mother and I have the same name. She stated this is a current debt and its with XXXX XXXX not XXXX XXXX ( my maiden name ). She started to ask me to confirm my social security and that I did not have to. I said, you should have this information. You sent me this letter. I asked her can you please tell me the debt so I confirm this is my debt or not. She said no ... But that she will forward the information to there client that I have not passed. And that they can continue with collection with this debt. That I will here from them. I feel as a consumer I have no where to go ... and no one to contact. I receive no collection notices, no bills, and yet this letter comes to my home, stressing my out, and now I have no idea what or who I owe money to. And this Bass & Associates will not tell either. How am I to solve this issue if no one will tell about it. Or contact me in a formal way.. these people are sending a letter of stating I am dead. Recently my Federal tax refund was offset by the US Department of Education. I have reason to believe that the contracted collection agency Bass & Associates and the US Department of Education did not send me proper notification. I never received any collection notices informing me of the days past due or the default procedures. On XX/XX/2018, I was mailed a Debt Statement with a Request for Review, and Notice of Proposed Treasury Offset. I am certain that this was the only notice that I received from the US Department of Education. Which in my opinion, did not give me enough information to verify the status of my account considering my Chapter XXXX Repayment Plan. I responded by mail on XX/XX/2018 with a Request for Review ( provided by the US Department of Education ) and detailed documentation that I was currently under a Chapter XXXX Repayment Plan. I never received any other correspondence or calls from the US Department of Education or the contracted collection agency Bass & Associates. Recently, I created an account on the US Department of Education website and it the wrong phone number was on file but my mailing address and email address were on file. After filing my 2018 taxes, I recently learned that the US Department of Education offset all of my much needed tax refund to repay the debt. I am currently faced with major financial hardship after not receiving my tax refund. I have received multiple utility cutoff notices and cancellations of my insurances. It is my hope that my complaint is forwarded and reviewed as a hardship.

Below please find a copy of an email recently sent to the lender. As you may understand, student loans can be barriers to many things as they have an extremely adverse effect on ones credit. I would like more than anything to pay the amount off or begin making payments - but I can not because this organization will not answer the telephone. I encourage anyone in your office to try to make contact with Bass & Associatee, PC via traditional means and you will see that it is impossible. Any assistance you can provide will be very much appreciated. -Thank you I have been forced to write this email as numerous attempts to contact your organization via telephone have been unsuccessful. As recently as a few moments ago, my constant calls to your office have been ignored. There has been no option to speak with a person or leave a message, the only option is to be placed on hold for up to an hour or longer. This is unacceptable. The loan on question has had a significant and large, extremely negative impact on my life including my ability to rent a place to live. I am trying very hard to rectify this loan via payments ( installments or lump sum ) but I keep hitting a dead end due to your willful reluctance to call me, a person who should be treated as a paying customer. I request to be provided with a working telephone number of someone I can contact regarding this issue. A copy of this email will be forwarded to the Ombudsperson and to any overseeing entities which regulate the loan servicing industry.

Bass and Associates has failed to prove its client the US Department of Education case. On XX/XX/XXXX, I reported a " well known '' Conduit for Identity theft and Fraud to the OIG of the US Department of Education. This website was www.pin.ed.gov. This Website allowed essential anyone with anybodies SSN, Date of Birth, and address to obtain a PIN ( Personal Identification Number ) This website not only failed to authenticate or verify by 2 part authentication the person behind a keyboard and monitor. It further was identified by the US Department of Education as a " Well Known '' Conduit since XXXX, according to the redacted report sent to my Virginia XXXX District Congressman. After my Letter to the OIG, explaining that this very Website caused me to become victimized of identity theft and a XXXX Federal Student Loan created illegally and without my knowledge or any signature. It was shut down on XX/XX/XXXX. XXXX and XXXX has been advised numerous times regarding this matter. In fact they have failed to produce any validity to this collection harrassment. They will deny they are required by law to prove that you applied for and signed for and actually receive money, which I did NOT receive a XXXX of money from the Department of Education or anyone else. This is identity theft and Fraud and needs to be removed from my credit file. In fact the redacted report sent to Congress confirmed that over 874 million in fraudulent loans was created by this very website in XXXX, so I'm not the ONLY Victim here.

Disputing derogatory student loans with the Department of Education, I get a letter in the mail from '' Federal Student Aid ''. " Federal Student Aid '' Is not the Department Of Education, though they use DOE letterheads.I was told in the letter that no matter what, collection efforts will not stop because the same laws do not apply to " The Department '' .The letter also stated that my request to cease communications in writing had to be put into writing in order to be valid.The letter was rounded out by saying I owe a additional XXXX in '' Projected collection fees '' and to contact XXXX & XXXX.I sent a response containing yet another request ( 3rd ) to cease communications via certified mail.My wife got a phone call with a angry message from a woman saying I needed to call her about my student debt a few days later, then a written response saying they tried to call me because the letter I sent certified mail was empty.Its a huge burden to have student debt without the added stress of dealing with shady collectors.Anyone can see these letters all originated from the same source, and it isn't DOE, its a collection agency impersonation of DOE.They haven't provided the Original instrument of indebtness, A valid breakdown of their fees, What is owed and being reported to the CBs , and have on several occasions violated my consumer rights.I felt intimidated by these actions.

On approximately XX/XX/XXXX, My wife took out a loan with XXXX XXXX XXXX XXXX to pay for a XXXX vacuum cleaner. First payment was paid on XX/XX/XXXX. After a few payments we wanted to pay off this high interest loan. So I took out a loan from my XXXX XXXX ( k ) to pay off this high interest loan. My wife XXXX XXXX XXXX XXXX to pay off the loan, via telephone. She made a payment of {$1500.00} to satisfy the loan. Then two years later on XX/XX/XXXX received a letter from XXXX XXXX. Stating that there was a remaining balance of {$61.00}. That was never paid and now there is a balance of {$560.00}, that includes late charges. I told financial services that I refuse to pay this amount. It doesnt make sense for me to take out a loan from my 401k to pay off balance of {$1500.00} and leave a remaining balance of {$61.00}. And if that was the case why did you take them two years to contact me about the remaining {$61.00}. They refused to work with me and only wanted to negotiate on a settlement and payment plan to pay for the {$560.00}. So now the have transferred my supposedly debt to Bass & Associates ... I contacted Bass & associates and explained my predicament. I offered to send them my paperwork I received from consumer financial. The best they could do was to lower amount lower amount by {$110.00} and offered me a payment plan ...

On XXXX XXXX, 2016, at around XXXX, an associate from Bass & associates called me at phone number XXXX. Upon answering the phone the the associate identified herself ( however I can not recall the name of the person ) as well as she was attempting to collect a debt for XXXX XXXX XXXX. She asked for my date of birth, which I gave her then preceded to harass me. She never told me the amount that I owed during the phone call. She for the most part hounded me asking how I make ends meet in my household. She stated that they have on file that I received child support, so I have a source of monthly income and they have every right to take it because it is a source of income, and we need to come up with a payment plan. I then informed the associate that I do not have a job, I have XXXX XXXX children and my only source of income was from the monthly XXXX that we receive from the government for the care of our children. The associate then told me that they would take the that from us to make payments. I then informed the associate that they are in direct violation of the FDCPA for implying that the would take funds from us and saying that they have every right to it. The associate then stated that they do n't care and they have every right to take away the XXXX from our kids since it is a source of income.

Bass & Associates, P.C. ( Bass ), sent me a a settlement letter dated XX/XX/XXXX for my defaulted student loan account with the U.S. Department of Education, Federal Student Aid. On page 1, Bass stated, " This notice confirms our offer to accept {$4400.00} as full settlement and satisfaction of your obligation on this debt. '' Page 2 at the end of this Bass letter ( XX/XX/XXXX ) states, " Loans included in this agreement : Nos. XXXX, XXXX, XXXX, XXXX & XXXX. This comprises the five loans, not the two they portend was agreed. Again, it's on their letter, and thus, the understanding was the five loans as full settlement for the total of {$4400.00}. In addition to this letter, phone conversations took place between Bass & my grandmother, XXXX XXXX, affirming the agreement. A cashier 's check in the amount of {$4400.00} was received by USDOE prior to XX/XX/XXXX deadline. Dozens of Times to try and speak with a representative and can never get anyone to answer. Wait times on a consistent basis of twenty minutes or more. Left voicemails multiple times over the course of months and no return call. Trying to debt resolved to stop further interest accruing and to help clean up credit. Finally get a hold of someone about 7 weeks ago to setup payment program and was advised of payment program and to setup payment program. Waiting on paperwork to be received and contacted rep after 35 minutes on hold. Advised my letter was just completed as it has to be hand typed????? Its been almost 4 weeks since last call and I received mail today XX/XX/XXXX advising the company Bass and Associates has been trying to reach me in which they havent. I have tired to get my loans permanently discharged due to my XXXX XXXX which basically bars me from a career in my field. I tried to make a payment arrangement with Bass and Associates to try to resolve my account. I was denied the hearing because if two pieces of documentation. Now my wages are being garnished from two different student loan one is XXXX that is already garnishing 15 % of my wages now Bass and Associates would not make reasonable accommodations on repaying back the student loan. I asked them for options one option was to pay XXXX in 90 days to close the account. I asked them what are the other options they stated i would have to pay XXXX a month current make XXXX a hour with a wife with a XXXX that work part time and a XXXX year old child. I thought by getting and completing my degree that life would be easier but it just made it worse. Bass & Associates, P.C. is refusing to provide the original promissory notes as requested by me along with the back side of the note. Ive sent them several letters which includes Notice of Rescission, Breach of Agreement, etc. They only send back a generic typed letter never giving me responses to my letters.
