To Whom This May Concern : Dear Sir/Madam, I had previously made a complaint to the CFBP, the bank responded with the same response that they have been giving me, which is that I should have reported the issue back in XXXX through XXXX when they claim they notified me. Bank United never notified me of the issue. I have revised my complaint to make it abundantly clear that Bank United never notified me that they had to force place insurance on my property and that the property was fully and completely covered by me during the time that they claim they had to place the insurance. MY REVISED STATEMENT IS BELOW. I had a mortgage with Bank United XXXX XXXX XXXX XXXX, XXXX XXXX Florida XXXX. I made all of the 180 payments as per the terms of the mortgage and the note ; all payments were made on or before the due date. The maturity date of the loan was XX/XX/XXXX. I contacted Bank United a few months before the maturity of the loan, approximately XXXX or XXXX of XXXX, as I had noticed a discrepancy on my mortgage statement. This was the first time that I had seen this discrepancy on the mortgage statement ; the discrepancy was that there was more owing on this loan, other than the principal and interest payments that I was making throughout the life of this loan. I had never received any information from Bank United stating that I had any issue with my loan or that there would be more payments owing than the payments that I was making. At no time during the life of this loan did I get any letter or information from Bank United stating that there was an issue with insurance during XXXX, XXXX or XXXX. I called the bank and spoke with an agent. The agent told me that Bank United had to put forced place insurance on the property during XXXX to XXXX as the property was not insured during that time. This was not accurate information as the property was in fact insured during that time. I produced all of the evidences of insurance proving that I had insurance on the property during this period. Bank United accepted the fact that the forced placed insurance was an error on the part of the Bank and I was told that the statement will be revised and the additional amounts removed. I then received the mortgage statement for the following month, showing that I still owed an amount over and above the principal and interest payments. I again contacted the bank and inquired about the balance owed, I was told that the amounts are linked to the misplaced insurance that the bank placed on the property during XXXX. I requested to speak with a supervisor and was told by the supervisor that the mortgage statement will be reviewed and that all amounts that relate to the misplaced insurance will be removed. At this time I had 2 remaining payments on the loan. After a number of weeks I received another mortgage statement with the same incorrect balance owing. I requested that the bank break down the figures so that I can see exactly what the bank is claiming I owe as I was being told conflicting information about the amounts being removed and what exactly the figure represented. I received from the bank a history of my payments. The history of my payments does not reflect the amounts that the bank incorrectly added to the loan. It does, however, reflect that I made all of the required 180 payments pursuant to the mortgage and the note. I then received a letter from Bank United stating among other things that I should have reported the matter of the misplaced insurance during the time that the amounts were added to the loan. I was not aware that the bank put forced place insurance on the property during that time. I only became aware of this issue a few months ago and I immediately contacted the bank. At no time did I receive any letters from the bank regarding this insurance issue and it was not on any of the mortgage statements during the period of time in question. I requested that the bank send me copies of all the statements and letters that were sent to me by the bank in XXXX. The bank resent to me the history of the payments made to the bank. Again, this document does not reveal any of the requested information. The history of my payments only shows the amounts that I paid throughout the life of the loan, all 180 payments. Bank United continues to send statements to me showing that I owe {$3500.00}, this amount continues to increase. I have not made this payment ; this amount is as a result of a mistake made on the part of Bank United and ought not to be my responsibility. The bank has indicated to me that the forced placed insurance was done in error by Bank United. Bank United ought properly to remove all the costs that would have been incurred as a result of their mistake. I am requesting proof of payment of the forced placed insurance on this property showing that Bank United did in fact make this payment on this property. I am requesting information as to whether or not Bank United made a claim on their insurance regarding this issue and if an insurance claim was made whether Bank United has received payment on the claim. I am requesting that Bank United send me all the letters and statements that they claim they send from XXXX through XXXX showing that they had included the forced placed insurance. Bank United has begun to report this nonpayment to the credit reporting bureaus and my credit has been and continues to be negatively impacted. This is affecting my creditworthiness and my ability to access credit. I am hereby demanding that : Bank United, N.A. remove all amounts related to their error and the forced placed insurance that was placed on the property ; Cease and Desist from reporting to this to the credit reporting bureaus ; Contact the credit reporting bureaus and tell them that the negative reporting was done in error ; Revise the statement on this account showing that all payments have been made pursuant to the mortgage and note and that there is a XXXX balance ; This property had all the required insurances during the time in question, XXXX through XXXX, I have furnished proof of the insurance. Bank United never sent any notice, letter or statement which showed that they had to place this insurance on the property. Bank United is destroying my credit rating and is attempting to extort money from me. This is highly unfair and Bank United ought to be audited and punished for this. XX/XX/2015URGENT MATTER pertaining foreclosure of my property XX/XX/2015 ( Short sale ) I am trying to get a short sale completed on my principal residence and have been for almost 2 years. Bank united is the lender and Fannie Mae is the investor. I have attached letters, the cash offer of XXXX, the HUD-1, Addendum to the purchase Contract that the buyer will close on or before the foreclosure date. In addition, pictures and a value dispute conducted by legal counsel and a licensed contractor. The way I am being treated is unfair and borderline neglect by the bank and investor fannie mae. I am in hardship and have lost business been divorced and going through struggles to the utmost degree. I am a single parent of XXXX children. Life is hard and the demands of my bank to get them all of the information I have been punctual to meet their requests. I do my best and for it to come down to this is unreal unfair and verified fact of unfair lending practices by a servicer and this is fannie mae setting themselves to be sues pro say by me. To be clear these are things that have happened. I have went through XXXX buyers on my home all canceled because things took to long and Fannie mae wanted too much for my home. The current appraisal is XXXX of my property. There are no closed sales that compare to this on the ARMLS. I have sent these evidences to the bank united. The previous buyer XXXX XXXX was going to purchase property at XXXX and he was denied by his lender : because the lender for his loan conducted an appraisal for fannie mae and it did not appraise at the XXXX, let me repeat this fannie mae did an appraisal for a homebuyer to purchase this property so he could get his loan and the APPRAISED VALUE WAS XXXX. THE SELER DISPUTED THIS VALUE AND THE APPRAISER STATED HE COULD LOSE HIS JOB IF IT GOES any HIGHER. This is proof that the value or appraisal bank united or fannie mae conducted to determine a value for the short sale of XXXX is overpriced and utterly absurd how they are so greedy. I am not asking for too much at all. All I ask is that you approve the current cash offer of XXXX that is submitted to bank united directly. Bank united said they have to close before the foreclosure date and this can happen before XX/XX/2015. I can not believe this is happening. I was told this is a solid offer and can get approved and now we have a foreclosure auction the bank united tells me so nonchalantly that we are going to foreclose because fannie mae want XXXX offer. No buyer is going to pay this. The realtor has XXXX back up offers. It is active at XXXX on the ARMLS. I need your help to get the shortsale approved at the XXXX. I am going to file complaint o the XXXX and contact the CFPB also. Please reach out to me I do not want to foreclose and feel a solid remedy to this is fannie mae not be greedy and unfair avoid legal suit and approve my short sale. i got 2nd morgage on my house about 10 years ago. when i signed up for the loan i was told it was a 20 year loan. about 8months ago bank united started sending menotices that the loan with up. i went into the local branch to speak to them about this. they stated they do n't do loans anymore and ca n't help me. i was signed a agent through the corp office, who never returned my called or gave me straight answers about the loan, i ask and faxed over on XXXX different times for a copy of my loan still to this day i not received a copy. the loans officers lied to me repeatedly. i tired to make payments on my account and the bank refused to take my payments, now there reporting me to the credit agency .they advised me to do a modification to the loan, they started sending me a notice for a late fee for $ XXXX if not paid in full. when speaking to XXXX XXXX he states if i do there modification they will wave the fee. i told them i went to my bank XXXX XXXX ) and would take 30-60 days to finalize the new loan. XXXX told me just do the modification, i ask on at least XXXX different times about affecting my credit he told me it would not. now 4 months latter after nemous times of them states they did receive the paper work i mail and faxed to them, not to counting how many times i would leave messages and never on avg on 4-6 times before a return phone call if ever ( i would leave XXXX a day ) after about 4 months of dealing with them giving me a run and round lying to methey send me a statement of the modification my payment was about $ XXXX monthmy XXXX loan is {$1100.00} mo. the new payment jumped up to {$2800.00}. mo, when i tryed to call to discuss the new payment and how obsurd it was. same story as before no return calls. so i went back to my bank XXXX XXXX ) about doing the refines .i find out they be reporting to the credit bureau no payments, when i tried to pay and they refused to pay. and i ask them scenes they would not take the payment will this affect my credit? i was told on several different times " NO '' by XXXX XXXX. and i stated on a few different times to him about messing up my credit. he told me it would not affect it. anther time he lied and missed lead me, now my credit went from a XXXX to a XXXX so i ca n't even refinance my house to pay them. i called bank united to fill a complant with them. and they transferred me to the agent XXXX XXXX who refused to help me he keep saying pay the note or sell your house. i ask to speak to his boss, he stated that XXXX XXXX. i ask him to transfer me to him and them he trained me to a fake voicemail. i had to call back and get his direct number and called and left him a message, XXXX messages latter he called me back and i spoke to him in depth about what was going on, he told me he will looking to this matter and get back to me by the weekend this was on Wednesday. a week latter i still did not hear back from him same store as his employee he does not return my called XXXX message latter, i called him and he finally answer the phone and i told him again about asking for a signed copy of the loan to review what did i sign? he now tells me there nothing he can do about his employee lying to me. there more stuff i probably left out or forgot, please feel free to call methanksmike XXXX

BankUnited failed to answer a " Qualified Written Request '' under Section 6 of the Real Estate Settlement procedures Act ( RESPA ). This office has jurisdiction over the matter. BankUnited have been in receipt of various " Qualified Written Request '' under ( RESPA ) and are refusing to answer any of the questions. On XXXX XXXX BankUnited communicated that we did not sent a " valid '' written request and further alleged we did not include either a statement of reason for the belief of the borrower that the account is in error or sufficient detail to the servicer regarding information relating to the servicing of the loan. Clear and convincing evidence was provided to BankUnited were we can established that statement of reason is sufficient for BankUnited to have answer the " Qualified Written Request '' under Section 6 of the Real Estate Settlement Act ( RESPA ). On XXXX XXXX, XXXX a foreclosure complaint was filed against my property. The plaintiff introduced into evidence an allege copy of XXXX allonges with the purpose to establish ownership. As per Florida Statute a lender may submit any of the following as evidence of ownership ; 1. Special indorsement payable to the plaintiff 2. Blank Indorsement 3. allonge On XXXX XXXX, XXXX, BankUnited FSB XXXX FL, was closed by the office of Thrift Supervision ( OTS ) and the Federal Depository Insurance Corporation ( FDIC ) was named Receiver. Subsequent to the closure, BankUnited, a newly chartered federal savings bank, acquired the assets and most of the liabilities of bank united fsb. According to The Purchase agreement between the newly BanUnited and the FDIC, BankUnited was given 180 days to repurchase the assets. According to BankUnited they acquired our loan from the FDIC in XXXX and because of this information a Judge enter a final judgment on my property and placed for auction. The record reveals that BankUnited did not acquire the asset from the FDIC until XXXX XXXX, on which time was outside the 180 days per the agreement and not in XXXX as they stated in open court. According to the Purchase agreement Section XXXX proof of transfer is required from the register of deeds. The record reveals no assignment of mortgage " recorded '' in the state of Florida. The XXXX allonges provided in court, reflects an incorrect property address and therefore makes the final judgment " voidable '' as a matter of florida law and must be reverse. As per Florida Statutes when a mortgage contains an incorrect legal description a court may correct the mistake before foreclosure. If, however the mistaken legal description is not corrected before final judgment of foreclosure, and the mistake is carried into the advertisement for sale and the foreclosure deed, a court can not reform the mistake in the deed and judgment, rather the foreclosure process must begin anew. XXXX v XXXX XXXX., XXXX XXXX XXXX XXXX, XXXX ( XXXX XXXX XXXX XXXX ). I am attaching copy of the tax property appraisal so you can see that an incorrect property address is reflected on the allege allonge fabricated on XXXX XXXX and not in XXXX as the BankUnited claims. BankUnited is refusing to answers the questions because are aware of its own fraud and have deceived the Courts.

We experienced water damage at our home that was covered by insurance. We filed a claim with our insurance company and were paid on the claim. As per the routine process, we submitted the claim check to BankUnited to be held pending the completion of the work. We hired a licensed contractor to complete the work and the work was performed the summer of XXXX. Mid way through the project, we requested payment for our contractor. We provided evidence that work had been performed, including conditional lien releases. Despite confirming BankUnited had all the necessary documentation and repeated follow ups, BankUnited did not send payment in a timely manner. We followed up on the payment on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. A check was finally sent to us in mid XXXX. Work was completed in the end of XXXX and we requested the final payment to our contractor. BankUnited performed an inspection of our property to confirm the work was completed. We also submitted all the necessary documentation to evidence that the work had been performed by the contractor, including conditional lien releases. We did not receive a check for our contractor in a timely manner. As a result, to prevent a lien from being placed on our home, we personally paid the contractor. After making the payment to our contractor, we contacted BankUnited to have the funds disbursed to us. BankUnited asked for documentation evidencing that the payment had been made. BankUnited also contacted our contractor to confirm payment had been made and he confirmed the same. In response to BankUnited 's request, we provided the evidence of final payment in XXXX. BankUnited didn't release the funds in a timely manner. Thereafter, we followed up repeatedly from XX/XX/XXXX - XX/XX/XXXX. We left dozens of messages with BankUnited 's insurance department ( specifically, XXXX XXXX XXXX ) and never received a call back. We also resubmitted evidence of the final payment on several occasions, including XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. BankUnited has yet to release the funds ( totaling over {$17000.00} ). On my last call to BankUnited I was told that servicing for our loan had been transferred to XXXX XXXX XXXX effective XX/XX/XXXX and that I would need to deal with XXXX on the issue. I am confident that BankUnited has been earning interest on my money over the period. Certainly, for this reason, the delays are in BankUnited 's favor - probably a systemic problem for the bank 's benefit. This company should not be allowed to service loans.

The case is centered on the bank refusal to honore our TILA rescission. For over five years we 've been fighting them in their attempts to take our home. We initially purchased our homestead property on XXXX XXXX, XXXX from XXXX XXXX with a XXXX mortgage and a XXXX mortgage. We subsequently consolidated the XXXX loans on XXXX XXXX, XXXX and took a new mortgage with a different " lender '' called XXXX. On XXXX XXXX, XXXX, Florida XXXX XXXX XXXX XXXX terminated XXXX XXXX XXXX ( " XXXX '' ) mortgage lending license due to questionable lending activities ( Exhibit-XXXX ). On XXXX XXXX, XXXX, after discovering irregularities in our mortgage loan we rescinded our loan by notifying XXXX and BankUnited XXXX via certified mails with return receipt requested ( Exhibit-XXXX ). Neither XXXX nor BankUnited XXXX/BankUnited N.A. responded to the letter of rescission. On XXXX XXXX, XXXX, based on our rescission, we filed our quiet title action in XXXX XXXX, Florida. A default final judgment was entered on XXXX XXXX, XXXX. On XXXX XXXX, XXXX, BankUnited N.A. a newly formed bank, filed a foreclosure action against me and my wife in the Circuit Court of XXXX XXXX, Florida. On XXXX XXXX, XXXX, BankUnited N.A, filed a motion to vacate the default final judgment of quiet title and the state court vacated the judgment. On XXXX XXXX, XXXX, the FDIC, in its capacity as receiver for BankUnited XXXX removed the case to XXXX XXXX Court for the XXXX XXXX XXXX Florida. On XXXX XXXX, XXXX, the federal court erroneously dismissed our claim of rescission. The court granted summary judgment in favor of BankUnited N.A. The XXXX XXXX XXXX XXXX XXXX affirmed the lower court decision ( Exhibit-XXXX ). With the money judgment BankUnited N.A. obtained a foreclosure judgment and scheduled the sale of our property. We are currently appealing that decision. BankUnited N.A with the help of the law firm of XXXX XXXX XXXX and XXXX XXXX XXXX. have consistently ignored our rescission and caused us to defend an illegal foreclosure for years. The Supreme Court decision in XXXX, No. XXXX ( U.S. XXXX XXXX, XXXX ) confirmed that we properly rescinded our loan. The bank and its lawyers continue to harass and threaten us with the foreclosure of our home. We seek the help of the agency to resolve this matter once and for all.

This is a second complaint filed -- the initial complaint resulted in the bank rescinding the original foreclosure. We discussed the payment required to enter into a forbearance agreement. The original amount discussed was significantly lower -- the amount that was offered by the bank was eventually much higher and the funds were not available to make such a payment. We agreed to sell the family home after making certain renovations : those renovations ( about 80 % ) were made at a cost of over {$40000.00}. We began listing the house a short while ago. It was our understanding that the bank would give us the time to try and sell the house at a reasonable valuation. The listing price was almost XXXX % below the tax appraised value -- I think it showed we were serious about selling the home as quickly as possible. A great deal of work went into the staging and removal of most personal items to a storage center. We were scheduled for a realtor open house last weekend when a stranger knocked at our door saying the property was listed in the paper for foreclosure just a a little over a week away and wanted us to retain him to fight the bank -- we declined. A couple of days later a letter arrived from the Bank 's law firm saying the foreclosure was re-instated and scheduled for XX/XX/XXXX. The bank officials with whom we had discussed the forbearance, etc.had out emails and telephone numbers -- they made no attempt to contact us an alert us they were moving in this direction. We in good faith made several investment renovations decisions in the prior week, including purchasing new counter tops and appliances for the kitchen and replacement windows. It appears that this investment has been for nothing and we will lose these money. The auction will only bring an amount close to the banks loan/lien and we will see $ XXXX - $ XXXX of equity disappear. Given our willingness to list and sell the house at a discount, I think it would only have been right for the bank to provide this time. Also they should have communicated sooner that they were moving forward with the foreclosure so we could have stopped investing in renovations to the home.

We purchased our house located XXXX XXXX , Texas on XXXX XXXX . The loan was initially with XXXX XXXX XXXX and then with XXXX XXXX , and then was transferred to BankUnited on XXXX XXXX XXXX . Shortly after that, the Insurance Dept. fro m BankUnited infor med that our property needs a flood insurance. We sent them two mail s on XXXX XXXX , XXXX to explain that we had a Survey from house builde r, XXXX XXXX , showing that the house is not on the flood zone. In those mails, a certified SFHDF ( Standard Flood Hazard Determination ), FEMA Fo rm XXXX , dated on X/XX/XXXX , which we submitted to XXXX at loan application, was also included to show that the house is marked as zone " X '' on the Flood Map and require no flood insurance. The answer from BankUnited t hen questioned that the SFHDF we provided was issued on XXXX , few months before XXXX XXXX , and so might be out of dated. To respond to their and our questions, we requested for another XXXX , dated on XXXX , again showing our house is on zone " X '' and needs no flood insurance. Meantime, we also contacted XXXX XXXX Floodplain Dept. Manager, XXXX XXXX to clarify. He sent us an email with proof, maps to show us the house is actually on zone " X '' .. On XXXX XXXX , we sent them another mail and provided all these findings and proof. Since then, no words from XXXX . Until, end of XXXX XXXX , when we received the annual Escrow Account Disclosure Statement, w e surprisedly found that {$1600.00} was charged for flood insurance payment. We called XXXX XXXX , manager of Insurance Dept., BankUnited, to disc uss the case and request them to reimburse the mischarged {$1600.00} back to our escrow account. She said they will do some investigation about the case. Since then, weeks after that, we called her twice a day to follow up. The answer from the Dept. has bee n always " She is not available and no one else can be responsible for the case. '' We have no other way to do but file this complaint to pursue a justice and our {$1600.00} back.

I previously filed a complaint with you, it is the Case number : XXXX. My complaining is about unfair and deceptive business practices. Bankunited is offering in XXXX XXXX accounts an interest rate of XXXX for 3 months and afterwards, the interest rate is XXXX. However, I have a MM account with BankUnited for almost 20 years. XXXX has been lowering my interest rate until 0.3 %. This means that they have been giving me only a half of the return value, or interest rate that they should in relation with other customers. But, the market value of my money is the same as of those they called as " new money ''. This " new money '' is often the result of closing an account and re-opening it again. The first answer of my bank was they were unable to locate my account. Then, they said, that there were too many XXXX XXXX and they did not know who I am. Today, after 3 months dealing with them and waiting for a solution ... they offered me 3 months rate at XXXX and afterwards 0.6 %. I do not need the intervention of too many people or reps and 3 months waiting period for closing my account, sit in the lobby for XXXX min, and re-open my account again with " new money ''. I would like to know if the CPFP is able to provide me any help or assistance? I am XXXX and I have enough neurons to be graduated from an university and this " solution '' sound to me as a foolish. I would like to obtain your help if possible in handling this complaint. They are excusing behind an argument that customers has to be checking for " bank offers '', but instead, they do change " offers '' at its convenience b/c my XXXX account was openned at an interest rate of ( at least XXXX XXXX or higher. Then, the bank is able to reduce my interest rate without calling me and ask me if I agree or not with this change, but to increase my interest rate I have to be checking " often for offers '' with the account administrators. I XXXX XXXX I got a mortgage with PMI from BankUnited, XXXX. At that time I received the Federal Truth-in-lending disclosure and the PMI was set to {$370.00} for the XXXX XXXX payments and to {$67.00} for the next XXXX payments, and no PMI thereafter. In XXXX XXXX the PMI increased to {$410.00}. BankUnited did n't send any notification. In XXXX XXXX I noticed a very small decrease XXXX to {$410.00} XXXX, again without receiving any notification. Every year, in XXXX, after receiving the escrow account statement, I inquired about these PMI changes calling the bank. I spoke with several representatives asking about the PMI change and the reason for this change, but it seemed they did n't have the knowledge or responsibility to provide an answer. Every time after these phone calls, I was told to expect to be contacted by someone else from another department, but only thing that happened was to receive courtesy letters with the conditions to drop the PMI, totally not related with what I asked about. This year I insisted more and I got to talk to a representative that explained to me there 's another company that charge this PMI and she will contact this company asking for the answers for me. I called back few times and I was told that the PMI company did n't reply. It 's been three months since I 've started this endeavor this year and still no explanation. I called back XXXX about XXXX weeks ago and the representative told me she would follow-up with them ... again. I still have n't received any call back. I had XXXX loan modifications during these years, in XXXX and XXXX, but the new documents did n't contain anything regarding the PMI and there was no new document added that mentioned the change in PMI. Moreover, the dates when the PMI changed were not related to the dates the loan modifications occurred. I was told also during the discussions I had with the bank 's representative that the PMI was n't affected by the new loan conditions.

XXXX XXXX ASKED us to run the business until they could sell it. First they were going to Auction it off XX/XX/XXXX, then they cancelled the Auction & they were going to take keys XX/XX/XXXX. This went on until XX/XX/XXXX when we decided that something fishy was going on & we sought out legal council & filed for Bankruptcy. During the Bankruptcy proceedings we found that several of the XXXX Executives sold the {>= $1,000,000} loan to themselves for {$750000.00} under another bank name " BankUnited NA ''. We went through the court system and the day we were going to finalize the agreement, BankUnited brought in an additional lawyer that said he was hired by BankUnited to " Kill '' the business. We had an agreement with BankUnited the day before. My attorney, the attorney we had been working with AND the judge were shocked. We had done everything that we needed to do. After talking to some other XXXX/XXXX/BankUnited victums, they all had the same thing to say. There was no negotiation, just Foreclosure & personal bankruptcy. The group has been buying loans at a reduced cost, foreclosing & selling at a HUGE profit. It seems as though this group is double dipping at the tax payers expense.

BankUnited wrongly reported a delinquent payment to the credit agencies. The bank created an escrow balance based on them having lost the condo flood insurance policy the management office faxed to them. The bank then wrote me a check in the amount of my XX/XX/2016 payment stating the bank would not accept payment that was short of the full escrow amount ( even though the bank incorrectly charged me escrow due to losing flood insurance policy ). The bank pretended as if I never made my XX/XX/XXXX payment which was clearly wrong. I then emailed the condo flood insurance policy to the bank on XX/XX/XXXX, and as of Friday, XX/XX/XXXX, they still have not cleaned up my account ( after receiving the bank check equal to my XX/XX/XXXX payment, I turned around and wrote XXXX checks - XXXX for XX/XX/XXXX & XXXX for XX/XX/XXXX ). Throughout this time, the bank continued to call & harass me as if I was not making my mortgage payment. Bottom line is I want the bank to report the delinquent XX/XX/2016 mortgage payment as a bank error since I actually did make the payment ( the bank seems to want to pretend that I did not make the payment because they would not acknowledge a payment that excluded escrow which I really did not owe because they lost my flood insurance policy and still have not fully updated my account with the documents I had to email them ). I 've never heard of a bank writing a check to a client and then turning them into the credit agencies. I find BankUnited to be grossly mismanaged in a tangled web of incompetent procedures, leading to the left arm not knowing what the right arm is doing. This bank should be investigated for inappropriate mortgage payment processing.

I have had an account with Bank United for over XXXX years. My account was overdrawn and I received a call from a very aggressive and disgruntled Bank United employee, XXXX XXXX XXXX who excoriated me for being overdrawn and demanded payment, of which I responded as soon as commissions came in it would be taken care of. I am in Hawaii since XX/XX/XXXX and am nowhere near a Bank United branch, none on the island. I set this account at Bank United to receive funds electronically to cover these eventualities, however XXXX XXXX restricted my account and I called customer service and spent over an XXXX trying to pay this and I was not allowed to do so. XXXX XXXX also made harrasing and somewhat threatening calls to the joint account holder including emails of that she must cover overdraft or she would be negatively impacted. I am pretty sure that these bully tactics are employed regularly, and I ask that in order to protect the public at large and prevent these immense institutions from basically garnering more fees improperly into their coffers that your organization look into to this and take any appropriate actions necessary. We are a family owned small buisiness. We have worked with Bank United since XXXX. We currently have a line of credit for $ XXXX and a term loan with a balance of $ XXXX. The original amout of the term loan was $ XXXX. On or about XXXX, we attempted to re-finance the loan and extent the line of credit. The local Bank manager helped us with the application and we provided all the paperwork requested by the Bank. The officer in charge of the final approval XXXX XXXX, disapproved the rquest. According to Mrs. XXXX, debt to income ration was too high. However, acording to the local Branch manager, our numbers were very close to their lending threshold. Subsequently, we began to make larger payments to all our current obligations and we were able to reduced the debt to $ XXXX less. In addition since XX/XX/XXXX, our business income as average XXXX a month. Our credit is excellent and we have never been late or missed any payments. I am trying to make my first mortgage payment to Bank United, to whom my mortgage was sold after origination. Apparently, in order to make a payment, I need to pay a {$10.00} " processing fee '' ( see text from their website below ) : " Your payment must be submitted prior to XXXX XXXX ET to ensure it is posted on the same day. If this day falls on a weekend or holiday, the debit will take place the next business day. Please note when scheduling your payment, you will be charged a {$10.00} processing fee. This service allows you to schedule a future loan payment, provided they are within 10 day ( s ). After your payment is submitted, it may only be cancelled by contacting Client Care Center - Opens Dialog at least two full business days prior to the scheduled payment draft date. '' {$10.00} is small in the grand scheme of things, but it seems ridiculous for them to charge me for the " convenience '' of auto payments to them. When I spoke with a representative, they told me that if I do n't do bill pay from my financial institution or send a check, then I have to pay {$10.00} every time I make a payment through their system. Perhaps this is perfectly legal, but it seems like a " hidden '' fee.

We submitted a loan modification on behalf of our client on XXXX/XXXX/XXXX. On XXXX XXXX, XXXX we received a letter from Bank United stating that they were unable to offer the borrower another modification because his loan was previously modified. Originally when the borrower first submitted his modification in XX/XX/XXXX Bank United advised the borrower that he did not make enough income and that he needed to make more so the borrower was able to get more hours at work to satisfy this request and now the bank advised that a modification is not even an option. Bank United modified his loan in XX/XX/XXXX and he was struggling to make those payments but continued to make those payments consistently until he noticed in his paperwork that he had a balloon payment due in 5 years. It is my client 's intention to save his home however, the bank is putting him in a no win situation because even though they modified his mortgage last year they gave him a short term balloon payment making it impossible for him to pay back the full amount. My loan is being serviced by XXXX XXXX My original loan was approved with an appraisal on my home that was done on XX/XX/2018. As of XX/XX/2018 I had paid down my loan principal balance below the required 80 % LTV to remove PMI. I submitted a package to Bank United back on XX/XX/XXXX in request to mortgage assistance. They requested additional information in which I sent to them in a timely manner, as of XX/XX/XXXX, I was informed my application is with the underwriter and is in active review. I am facing a foreclosure sale date on XX/XX/XXXX and the lender nor the foreclosure attorney have postponed the trustee sale, leaving me in a panic and stressful situation. I am aware of the laws of dual tracking and I know I must be provided a decision prior to the lender proceeding with the foreclosure. If I am denied loss mitigation assistance, I have the right to appeal in a timely manner. I am not sure why Bank United can not postpone the trustee sale given there are only 2 business days left until the trustee sale and leaving me to be unsure of how things will proceed and to be in a panic. I keep getting calls from blocked/restricted numbers for which I send to voicemail. They leave a message saying call BankUnited at XXXX. They leave no name, no department, and no information what it is regarding. When I call the number, they immediately want my name, social security number, loan number, date of birth, property address. This is an extremely wreck less practice in 2016. There is no way to verify that this number belongs to BankUnited. The number does not appear on any website. There is no way to verify is this is a scam, yet they want my personal information. I instructed them not to call me anymore for which I continue to receive phone calls. I did verify by calling the main number that it was their Modifications department but they refuse to give me any information. It 's very irresponsible for BankUnited to be conducting business this way on the phone and soliciting people personal information for verification when there is no way for the person calling in to verify that it is legitimately BankUnited.

I was notified 6 months ago by the borough where my building is located that my taxes were in arrears. The taxes are paid through the escrow account at BankUnited so it is not something I reviewed on a consistent basis. I had not received any past due notices from the borough because they were sending them to the previous address where the XXXX was formed and not to the physical address where the building is located. I immediately notified the bank. After many calls and many months of waiting, I was informed that in 2019 in some sort of mishandling the borough returned the check to the bank and stated it was an overpayment. No one from the bank called me to help in solving this obvious error. The bank continued to pay but all payments were applied to the old balance. Unfortunately for me this came to penalties and interest that the bank said was my problem. In order to avoid any more problems with the borough and because the bank refused to accept any responsibility I paid over 4,000.00 in penalties and interest.

In the first week of XX/XX/2018 I received a note that my bank, BankUnited in XXXX, Florida, transferred ownership of my mortgage loan to a different service provider. In the letter I received, I was told that I had 30 days by federal law ( from day of notice of transfer ) during which I could send the original payment to the original bank and they would be obligated to forward it to the new loan holder and without incurring any late fees. BankUnited, however, refused to accept the payment in violation of federal law. I then called their helpline and both the person who answered the phone and supervising manager told me that they were under no federal obligation to receive the check and could also not tell me where to send the payment to. After the call, I researched the aforementioned law and found that BankUnited has in fact ran afoul of the law by refusing to accept my payment during the statutory allowed period. On XX/XX/XXXX when I closed this IRA account Bank United NA sent a check to me for {$210000.00}, payable only to XXXX XXXX the IRA custodian for the benefit of me. The check was supposedly delivered by XXXX on XX/XX/XXXX to my home. I NEVER received the check. Bank United has since refused to issue a 'stop payment ' on the check and reissue a new check. Regarding a loan with Bank United in XXXX , FL : The loan was originated for {$710000.00} in XX/XX/XXXX a nd was a negative amortization loan for a property in XXXX , VA. It peaked in cost at approximately {$760000.00 } ( du e to negative amortization ) in la te XX/XX/XXXX ( Bank United has been unable to provide me exact numbers to date ). In XX/XX/XXXX the loan was modified by Bank United to its current state ( Bank United did this of its own acc ord ). The property price was over-inflated and the bank did not use appropriated methods to approve the loan. Despite repeated requests over the years, the bank will not modify or refinance the loan and the home can not be sold for anything close to the outstanding amount of the loan.
