I am filing a complaint against Bank of Ozarks as I believe they are attempting to or in the process of engaging in malice, predatory behavior on my mortgage loan. Their actions and incompetence have caused a negative impact on my near perfect credit score which has dropped significantly. I have organized this complaint into five parts. The details are as follows : PART 1 : THE BACKGROUND AND PROBLEM -I received a notice in XXXX that my XXXX mortgage would increase from {$750.00} to {$1100.00} an increase of 47 % ( forty-seven percent ). I contacted the company to find out why. I initially corresponded with XXXX XXXX. I asked XXXX XXXX what caused the increase and after extensive research by XXXX XXXX which began on XX/XX/20 until XX/XX/20 ( email is attached for reference ) he explained that there was a deficit of {$2900.00} due to the mortgage company having to pay two years of trash/water and they underpayed on the taxes or something to this effect. It still is not crystal clear to me how this happened. However, the mortgage company spreading the deficit out over the next 12 payments is what caused the increase from {$750.00} to {$1100.00}. This part made sense. -Despite the explanation, I was in awe that no one at the company reached out to me about this {$2900.00} escrow deficit and that it was now due all at once. As stated it appeared to be almost two years worth of bills from the city and county and that the company waited to the last minute to let me know about. I could not afford a payment of {$1100.00} for the next 12 months as we had not budgeted for an almost 50 % increase in our mortgage payments. XXXX XXXX and I talked extensively between XX/XX/20 and XX/XX/20 and he informed me that an escrow deficit was common and Bank of the Ozarks has a process for this in which they would pause the regular mortgage payments and then allow me to catchup by paying off the escrow deficit and once that was done regular mortgage payments would resume. There would be no impact to my credit with this arrangement. -I reached out toXX/XX/XXXXagain on XX/XX/XXXX approximately 6 days before the payment due date for XXXX mortgage to explore this option. I called XX/XX/XXXX and sent him an email. XX/XX/XXXX got back to me on XXXX and explained to me he would send the request over to the assets department and that I should be getting some paperwork shortly regarding this program. I expected it to be something short and sweet that would just take a few minutes. I expected XXXX to send this immediately. He did indicate they were stressed out because of COVID19 and there may be a delay. I did not expect it to be too long. On XX/XX/20 I had not heard back from XXXX or anyone at Bank of Ozarks and made my previous regular payment of {$750.00} to the bank on XX/XX/20. I sent XXXX an email on XXXX informing him of this payment and letting him know that I was looking forward to this paperwork from the assets people and that I had not heard from anyone yet. -I received an email from someone named XXXX XXXX on XX/XX/20 ( I assumed correctly that this was the assets person? ) and he attached something called an application for assistance and his email stated the following : Good morning, Please find attached an application for assistance and a list of the items needed to underwrite the loan for loss mitigation options.I do not need originals so please just scan back to my email.This process takes 30 + days in normal circumstances but due to hgh volume of submissions related to the Pandemic 19 crisis I would allow for 45 days to get an approval.I recommend making payments during this time as there is no guarnatee of an approval.Thank you. I look forward to working with you. - My husband and I reviewed the loan application and noticed that it was a FULL re-underwriting of the loan. In other words a BRAND NEW loan application from scratch. We decided that this after all may not be a good fit for us. This was in stark contrast to what XXXX XXXX told me this would be. After my husbands and I review I decided to call XXXX XXXX to get some additional clarification on what this was and how it would show up on my credit report ( according to XXXX this particular program did not show up on the report as a forbearance or anything like that ). This conversation with XXXX was very long he seemed empathetic, friendly, and really wanting to be helpful. I explained that we are not necessarily experiencing hardship at the moment, but we did have some anxiety around our future employment due to COVID and was not comfortable with a new underwriting process just for this issue. I told XXXX XXXX we would just go ahead and ask family for the money and pay off the deficit in full because I was uncomfortable going through a whole underwriting process again which included paying some upfront fees and a modification to my credit report ( in contrast to what XXXX told me! ) At this point in the conversation, XXXX XXXX mentioned that due to COVID19 that they had a new program in place where borrowers could pause their mortgage payments for up to 60 days and pick them back up again at the end of that period. He stated that I could take advantage of this program to take care of the escrow deficit. This would pause my regular mortgage payments and during this time I could go ahead and pay off the escrow in full. In this way, I did not have to go through a reunderwriting process again. I asked XXXX XXXX what would the impact be on my credit. He said he did not know but he did not think it would be negative. He stated that it was up to the credit bureaus to determine how they were going to report this IF they reported it at all. He emphasized that there probably would not be any reporting at all. XXXX XXXX gave me the perception that this was manual process that he would personally handle and that there would be no impact to my credit score or report. He even told me to inform him of every time I made a payment towards the escrow balance so that he could manually go in and credit the account. -I told XXXX that I would be making two payments of approximately {$1500.00} to cover the escrow deficit during the time the payments were paused ( remember the escrow deficit was {$2900.00} ). XXXX XXXX and I exchanged emails and talked about this through XX/XX/20. Here is the message that I received from XXXX XXXX : Hello MyNAMEREDACTED, It was a pleasure speaking with you. Please find attached the EXT. agreement we discussed. Please sign and return back to me via email.Please mail the ORIGINAL back to the address in my email signature.During this time frame from XX/XX/XXXX you can pay your escrow in full. When you make a lump sum payment towards escrow send me an email so I can make sure it processes properly. - XXXX XXXX sent me a one page agreement to digitally sign and also to sign and mail in that would enter me into the COVID19 payment program with the understanding that I would use the pause in regular mortgage payments to pay off the FULL escrow balance ( email is attached ). I left my conversations with XXXX XXXX with the understanding that I would make the two installments of approximately {$1500.00} at the regular payment period e.g. anytime between the XXXX and the XXXX. With this in mind we assumed our next payment would be due anytime between XX/XX/XXXX-XX/XX/XXXX and a final installment of {$1500.00} ( less the payment already made on XX/XX/XXXX ) anytime between XX/XX/XXXX-XX/XX/XXXX. There was no particular deadline attached to turn the COVID19 one page form in and we were going to sign and return it at the same time we made our first installment. I figured since I had already spoken and agreed to things with XXXX XXXX that we were already under contract so to speak. We received no additional information from the company that anything else was needed in terms of paperwork or payments or any other deadlines outside of what already was discussed ( emails are attached ). - On XX/XX/20 I received a frantic phone call from XXXX XXXX indicating we had an outstanding balance of approximately {$350.00}. I was very busy working when he called me I am a XXXX and was trying to wrap up the XXXX XXXX and not quite paying attention to things. I figured it was maybe a gaffe XXXX XXXX made that he was trying to clean up. I know that they had been under stress and I decided to give grace if he made a mistake. He told me to reach out to someone named XXXX XXXX and make the payment immediately because for whatever reason it showed that I missed a mortgage payment. I had the money on hand and I had no problem with XXXX at the time so without question I made the payment of approximately {$350.00}. I explained to XXXX during this call that we would be making a payment of {$1500.00} towards the escrow on XX/XX/20 and that we would also go ahead and make another payment of {$1500.00} by XX/XX/20. XXXX thanked me for the payment and I thought things were settled. XXXX ended the call by telling me to let him know when I made that payment to XXXX XXXX and to email him. I made the payment and emailed him a few minutes later. I emailed him the following onXX/XX/20 : XXXX, I just paid the XXXX balance. Will make XXXX installment on XXXX - XXXX responds with the following : Hi MYNAMEREDACTED, Are you not wanting the extension? Or will you be doing the extension and making an escrow only installment on the XXXX? Current Escrow Balance : ( {$1700.00} ) Please advise. I sent a revised EXT request earlier today.Thank you! -At this point I am concerned and very confused as to why XXXX XXXX would send such a response. I responded with the following : XXXX, I am confused can I call you in a bit? I thought our balance was around XXXX from escrow and that the " XXXX payment '' was to the mortgage not to the escrow balance. Sorry if I missed something when I was talking to you on Friday. My plan is to pay on the XXXX an installment of XXXX ( Im rounding here ) to the escrow and then again sometime between XXXX the second installment of XXXX ( I'm rounding here again ) to absolve escrow balance. Thanks, -XXXX XXXX and I speak and he send me another COVID19 form to sign. This apparently was some extension. I signed it because I just assumed that maybe XXXX had made ANOTHER error somewhere. I also told XXXX that since he is saying that the remaining balance was only {$1700.00} that we would just pay it off sooner rather than later. XXXX agreed and stated that if we did pay we would basically have the month of XXXX with no payments and escrow issue resolved with regular payments resuming XX/XX/20 -I made a payment for {$1500.00} on XX/XX/20 and another payment for {$220.00} on XX/XX/20 ( this totals {$1700.00} that was due ). XXXX indicated that he received the payment and he had forwarded it to the proper personnel. He than stated to let him know when I received the adjusted tax bill for 2020 ( we are expecting a tax decrease ). At this point I assumed the issue was resolved and our mortgage would resume to regular payments beginning on XX/XX/20 - We received a notice in the mail for that our XXXX bill would be {$1100.00}. I waited a bit to reach out to the mortgage company hoping that this was a mistake and something else would come in the mail. Nothing else came. I decided to contact XXXX XXXX on XX/XX/20 to ask XXXX what was going on. I made note of the following high-level points from my conversation and email with XXXX XXXX ( he stated that he did not have the nitty gritty details of the file pulled up ) : 1. XXXX XXXX told me that due to regulations ( unclear if it is federal or state ) even if the mortgage billing of {$1100.00} was a mistake I am obligated to make this payment amount for the next two months because proper notice was not sent to me that the payment would go DOWN. He said that they have to tell me 60 days in advance of any changes to the billing. They did not do that and that this is required by law. Since it is required by law no changes to the upcoming mortgage will be made. I told XXXX the reason for me entering into the COVID19 arrangements was to go back to our regular mortgage payments after the deficit was paid ( remember from above that the mortgage was {$1100.00} which was an increase of 47 % due to an escrow deficit from unpaid tax and sewer bills the reason for this fiasco was to avoid this new payment schema ). 2. XXXX XXXX told me that we still have an escrow balance of {$1100.00}. I asked XXXX where this was coming from, he said could not tell me. He said there was a balance somewhere of {$820.00} and then another balance somewhere else of {$360.00}. He said something about the {$360.00} is a cushion of some sort that they have to charge me. At this point I felt from XXXX tone that Bank of Ozarks and XXXX were becoming predatory, disrespectful, and insulting my intelligence. I asked XXXX how am I expected to pay for a balance that no one knows where it came from? 3. XXXX XXXX then suggested that in order to make this go away easily that I can enter into another COVID19 payment arrangement. He actually forwarded me the paperwork prior to our call. It was different than the previous COVID19 paperwork and I had not requested this. I immediately responded back with the fact that I had NO IDEA what he just sent me. I mentioned to XXXX that I would just want to go ahead and pay off the remaining escrow balance ( IF IT EXISTED ) if push came to shove I would just ask a family member or put it on the credit card. I felt however that XXXX XXXX was trying to coerce me into getting into another COVID19 arrangement. XXXX XXXX tells me that Bank of Ozarks does not accept credit card payments. I said ok, I guess I will pay by debit card. He then stated that none of that would be necessary and not to jump the gun but to wait until he hears back from their analysis unit regarding what is actually owed. 4. I just want this whole thing behind me. I am absolutely terrified now because I feel something weird is going on. Bank of Ozarks does not have an electronic system to keep track of anything and so I have to wait on their analysis unit to come back with everything. Again, I do not know what is going on and I feel that due to incorrect billing practices the company is being predatory at this point by forcing us into another unnecessary COVID19 arrangement. In other words, telling me I am on the hook for two payments of {$1100.00} and they cant change this even if it is incorrect due to legal regulations. PART 2 : THE NEGATIVE IMPACT ON ME 1. Later that night ( XX/XX/XXXX ) my husband was very concerned about what I told him and told me to check my credit. It appears that on XX/XX/XXXX I actually received a notice from XXXX that my credit score had decreased significantly from XXXX to XXXX. On XXXX report they actually did not have a reason e.g. there were no missed or late payments noted or any inquiries. As a matter of fact, the last note was from Bank of the Ozarks indicating that my mortgage was in good status. I did find that comment unusual but just let it go. Something still did not sit right regarding the drastic decrease in my credit score, so I decided to run my full report with XXXX. According to the report from XXXX, Bank of Ozarks reported me delinquent over 30 days for the month of XXXX. This is disgusting!! I do not make a lot of money, I am already a member of a marginalized group, and I only have my credit score to go off of in this life. I worked so hard for my score! I work out of town and I have to get an apartment in XXXX. This hurts me and my family very deeply to appear as if I am missing payments in addition there is a weird disaster declaration on my credit report. It also does not allow me to leave this mortgage company and refinance ( the current interest rate is quite high 4.75 I also am concerned that the bank is not digitized and is unorganized and I never want to be in a situation again with an escrow deficit ). The current perception on my credit report is that I missed a payment. This is NOT true. 2. I am unclear now HOW MANY COVID 19 arrangements have been entered on my mortgage it appears that it maybe more than one instance with fees being anywhere from around {$1000.00} to {$3000.00} that were added to the principle of the loan. PART 3 : WHAT IS A RESOLUTION FOR ME 1. The error on my credit report needs to be corrected immediately. It is completely FALSE that I was more than 30 days late on a mortgage payment. I WAS ALWAYS in contact with this bank from the very beginning entering into a formal payment arrangement beginning on XX/XX/XXXX. I always made a payment when they requested it. ALWAYS. Why in the world would they STILL indicate that I was delinquent. This reeks of malice intent and in my opinion is a ploy to keep me from shopping around. Who wants to refinance a loan where the credit report indicates a recent missed payment? 2. Produce and send me an accounting of a full payment schedule for my records indicating both prior and future payments for this mortgage. In addition, I would like a FULL accounting of the total fees that I was charged due to entering into one or more of the COVID19 payment arrangement schemes. Related to this, I would like an explanation of HOW many total COVID19 payment arrangements occurred and the dates and fees for each arrangement. In other words, is this debacle considered one single arrangement or multiple arrangements. I am very concerned about the unclarity around this. PART 4 : PERSONAL REVIEW FOR THE BENEFIT OF THE GENERAL PUBLIC Bank of the Ozarks appears to be an up and coming regional bank. They are based in the XXXX U.S. and appears to be marketing itself as a competitor to the local established credit unions such as XXXX XXXX. The initial underwriting process for the mortgage loan was straightforward and as a new home buyer going through the process, they did provide excellent service around this. They are heavily focused on your credit score and employment history ; as a determinant for loan approval. I suppose this is why the process was relatively straightforward for me. I did get a bizarre underwriting question or two that my loan officer easily handled for me. The loan officer was easy to work with and Bank of Ozarks offered more products than my current credit union and to my great regret I decided to go with them for my mortgage. The banks accounting and record keeping systems are not digitized. For example, we still receive paper bills in the mail, my payments have to be made manually every month, there is no account login to keep track of prior payments on the mortgage, and obviously they have terrible record keeping. For example, they did not inform of an almost two-year-old sewer bill that they received. As a consumer, I would probably be concerned about potential data and privacy breaches from this company as well as they attempt to digitize their systems. The bank seems to be in some type of hyper-growth mode and I suspect that is what is fueling the aforementioned predatory behavior mentioned in this complaint. I think the moral of the story is that this is NOT a local credit union. They are an emerging regional bank and looking back may have a specific demographic in mind for their products. If you have good-to-excellent credit and stable employment history, you are better off going with the local credit union for your mortgage needs although you will pay a bit more upfront. I think the relationship I have with the manager at my credit union he would have NEVER put my family in a situation like this over an escrow deficit and would have easily handled this in a way that was manageable to my family and would have done so quickly, as I have been told this is a common occurrence. In addition to the clarifying emails I had to send regarding the escrow deficit and the resolution. I have easily spent 2-3 hours on the phone with these people getting basic information about what they have on file for me. If you do decide to go with this company be sure to keep records and exercise caution with any extemporaneous arrangements, you may have to get into in the future. You are better off sticking with your credit union OR one of the major national banks. My credit score went from XXXX to XXXX dealing with these people. PART 5 : CONCLUSION - XXXX XXXX told me the analysis department will get back to me by XX/XX/XXXX with the actual numbers and then they will explain to me what is going on. We made deposits to the Bank of OZK account using XXXX and XXXX, these are checks widely used in the transportation industry and blank ones can be found all over the place at almost every truck stop or place selling diesel and doing repairs to semi trucks including QTs. It's a form of a check where somebody issues you a code for a certain amount of money you write the code down and amount on the check. When a code is issued for a $ $ amount it is automatically on that code. Then one is supposed to Call XXXX or XXXX and obtain an authorization code which also goes on the check. When a bank receives these checks before depositing them in the account there is a big red box on the check that says do not deposit until you call to verify. All Bank XXXXf OZK was supposed to do is call the number on the check to verify funds and deposit it, instead they just deposited and did not verify. When the checks returned they said we were trying to defraud them. When detectives came over I explained to them how easy it is to get this done. The detective told us we just need to cancel all the checks and take the money into the Bank of OZK. By the time we got to someone that could cancel this for us, the detective went through and verified a couple of the checks and cashed them through Bank of OZK. How we know it was the detective is when you call to Authorize/verify you have to give a phone number and that phone number directly linked to the detective. I called XXXX and have a recording of speaking with the representative who stated that the funds are still on those checks, all that needed to be done is for the person or institution that has the original check to call and obtain the verification code. We had already obtained the verification codes, however I could have made a mistake in writing them down, as it was a lot of numbers and I had just gotten out of having had XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX However the funds were on the checks and all that needed to be done is just call XXXX all would have been cleared up. Bank of OZK failed to follow exact instructions on the checks and the detective proved to them funds were on the checks when he authorized them months later. It is easy to make mistakes on these checks as the money code alone can be 9-16 digits long plus a 6 dig authorization/verification code plus the date and amount. All of these are numbers that have to be put on the check before its valid. Mistakes are common but easily fixed by calling the number in the red box. However for us to fix this they would have had to send us the NSF checks which they did not and they kept the legal copies this is how the detective was able to authorize a couple of them. When the bank of OZK called us about these checks we also told them what to do, however instead of doing that they demanded we bring them cash without sending us the NSF checks and reporting it to police. They had plenty of checks before that went through without problems. Some that did have problems were immediately fixed if we found out, every time a teller called and questioned the checks we told them exactly what to do and it was fixed. not sure why they were not willing to do it on the ones in question. We specifically opened accounts with Bank of OZK because they told us they know how to deal with those checks. Also the detective was told by the bank of OZK that they feel like we wanted to defraud them because when we made deposits into the bank accounts we would turn around and spend the money right away. This was a business bank account and not a savings account ; funds are needed to operate a company. This is what we did. And it was not a personal account. They would send us statements in the same email and on the same day with different amounts. We could never get an exact amount of what needs to be recovered. I have called them and emailed them I don't know how many times. Even today when you call them they cant give the correct amount, I called bank of OZK in front of their fraud protection officer and he witnessed the confusion but they still wouldn't drop the charges. The attorney advised that it would be better to enter in to a plea agreement instead of fighting it in court because it would be hard to explain to a jury the complexity of these checks. Please find attached the communication with the bank, the detective and OZK fraud department. The only reason I took the plea deal after telling them that I'm not guilty because I was told its the only way to stay out of jail for sure. But they have done me wrong majorly in this case. It didnt matter that I was innocent it seemed like there was no justice only a way to play the system.

In XXXX I requested details about attempted withdrawal from account. I did not get details and sent many emails. I requested account to be closed. They refused to give me name of vendor attempting withdrawal and ozk kept charging fees on the attempts for withdrawal. The fees accumulated. They insisted I must bring current. When I brought current. They charged more fees. Again refused to close. Balance continued to grow in the negative. When I directed a XXXX deposit to account from vendor. Ozk closed account. Now my vendor is holding my deposit. That can not be deposited. When I called bank of ozk they said account went to collections and no deposits would be accepted. Since XXXX, the employees send emails to each other. They humiliate and imply and say things that are not true and correct. Then hurt me by not closing account when I was concerned about unauthorized withdrawal attempts and insinuations they were going to pay for the balance and I would owe them more. Then Ozk mailed overdraft statements to my neighbor. I requested they stop the mail. They kept mailing. They humiliated me. They knew about me having different ethnic groups at my vacation home. They view my postings on social sites. Then gossip and try to gang up to hurt or humiliate me. This is a small community and they seem to gang up and retaliate if we rent homes to minorities. Please also check and see the number of white people they have accounts at this branch. I am sure they do not have many minority customers. I see a deep prejudice and I see retaliation via humiliation in my community. Which I have great history and record. So I do not fear what they have done and what they continue to do. It is obvious if an agency can look at the local banks records. This I know is retaliation. Against a client that trusted the bank would be fair and honest. They closed account, after insisting they would not close. Then when I arranged deposit. They closed and sent my account to collections. Now to further hurt my good credit record since 1989 with my company. Having previous accounts with manufacturers like XXXX. with no complaints since XX/XX/1989. I believe this all boils down to prejudice and retaliation against me. Because I believe all nations should try and walk hand and hand. I see regulations being broke. But I see a deep prejudice that created hate against me. Retaliating because I refuse to be prejudice like they are. I think they need to BE investigated for these regulations they broke against me and others. But the real issue is that I bought a vacation home in a deeply prejudice community. I am selling this home and leaving this area. I can not understand how the banking Asst can do mortgages and also sift through all the clients personal information. I see the mortgage lady at this branch is using the confidential information to take advantage of poor people. By picking the clients that they can abuse or take advantage of. I see many regulations being broken. I can not understand how this bank can be sued in Arkansas and settle. Then change their name. Then continue doing things to hurt people I have made over 20 hours of phone calls and I still have my {$910.00} with my vendor. My checking account was closed after they refused to close. Then they rejected my deposit. Then sent account to collections which is fees that are not fair or correct. Then humiliate me at bank and my community. I have a lot to say and I am planning to continue complaints until this has been acknowledged and corrected. Thank you for your assistance

XXXX XXXX XXXX - XXXX XXXX XXXX On XX/XX/XXXX {$1400.00} was scheduled per the XXXX website to be directly deposited into my secondary account with the last XXXX digits of XXXX ( Bank OZK ). Never arrived to account so I reached out to XXXX XXXX XXXX office for assistance in this matter as I was not getting an answer from the IRS after numerous phone calls were made. I finally put a trace out on said amount on XX/XX/XXXX. On XX/XX/XXXX the XXXX XXXX XXXX XXXX XXXX received my request and found that {$1400.00} was sent to an account ending in XXXX ( at Bank Ozk ). The date the letter was completed and forwarded to me was XX/XX/XXXX. I had been corresponding back and forth with XXXX XXXX ( a representative from XXXX XXXX office ) in regards to speaking with the IRS to see if they had been returned these funds. The answer was no the IRS had no indication that the funds had been returned to them. The XXXX also had responded back to XXXX stating that they did not receive the return of funds either. So with this being said, I have documentation that these funds were indeed put into my account but were not sent back. According to IRS guidelines, they should have been returned. Instead, they were wrongfully used to pay for an accounting error that was made by Bank OZK administration in XXXX XXXX. The reason why I say this is that the account ending in XXXX ( our secondary account ) was closed in XXXX of XXXX. XXXX month prior to the direct deposit of the XXXX EIP. Here is an explanation of what happened with our primary account. The primary account ( which ends with the numbers XXXX ) was deemed to be closed by the administration of Bank Ozk in XXXX of XXXX. My husband is a service-connected veteran who had chosen to have his VA benefits direct deposited to this account every month. As of XX/XX/XXXX our account did have a negative balance of {$120.00} but that is all and we could have had this rectified on XX/XX/XXXX if it were not for the banking error that had wrongfully taken place on the first. My husbands benefits totaled {$3100.00} and were supposed to be listed as a CREDIT but as my sheet CLEARLY STATES it was treated as a DEBIT -Therefore putting the deficit even higher. ( They ) Bank Ozk administration sent my husbands VA benefits BACK to the VA then demanded that he pay the debt of the negative balance in the account that Bank OZK had intentionally created. Of course, my husband refused. How could he pay for it even {$10.00} when they sent it back to the VA. Now the other issue that needs to be addressed is as follows. The {$1400.00} BANK OZK intentionally took ( my EIP payment ) to partially rectify the negative amount that was in the account. How do I know this? Well, on XX/XX/XXXX at XXXX am I called the corporate office of Bank Ozk in XXXX XXXX and spoke with a representative by the name of XXXX XXXX female ) I explained the situation and she said that she would contact the ACH department to find out where it was. I never received a call back from her. So, I called back the next morning and started to get the run around again but finally put my foot down to get an answer. I called back a third time and XXXX and behold who answered the line it was XXXX the same person I talked to the day before. This was the final answer. The {$1400.00} was in fact used to pay for the deficit that was created by Bank OZK as stated earlier. My father opened an account with XXXX XXXX XXXX depositing {$50000.00} in a XXXX on XX/XX/XXXX. He was killed in a car accident in XX/XX/XXXX one month before the CD matured. My family only learned of the CD in XXXX XXXX XXXX while preparing a living will for my mother. I called the number for the bank only to find that it was now Bank OZK in XXXX, XXXX We went to the bank with all our documents and spoke with XXXX XXXX bank manager. XXXX made copies of all the documents and told us that some research would have to be done. When next we heard from XXXX she told us that no records were found. I later found two documents where XXXX XXXX XXXX stated they rolled the XXXX over and it would continue to accrue interest. I took these documents with my other originals to bank OZK and spoke with XXXX XXXX the assistant manager who then informed us that XXXX XXXX XXXX failed and was closed by the US government. We were then told that XXXX XXXX took over the deposits, but they later failed in XXXX. XXXX was far more knowledgeable than the bank manager. Then we learned that XXXX was sold off and purchased by other banks. I dealt with the FDIC this entire time and got the run around by every agent I dealt with and was told three different stories by their agents. Finally on XX/XX/XXXX the FDIC stated there was nothing they could do when I had my last phone conversation with them. I was assured by every person that this money could not possibly be taken by anyone at the bank. It sure seems as if someone got the money and I was told that my dad must have gotten it by all of them. I reminded them he was dead and that was not possible. XXXX XXXX with the FDIC said we had to have withdrawn the money as did XXXX XXXX with the FDIC as did the people as Bank OZK Let me state as absolute fact NOBODY IN MY FAMILY KNEW THE MONEY EXISTED LET ALONE WITHDREW OR OTHERWISE OBTAINED THIS MONEY. I have been given the runaround at every turn about what happened to this money which the FDIC confirmed was in the account in my father 's name at the time of XXXX XXXX XXXX 's failure in XXXX in the amount of XXXX USD. Someone stole the money as I see it there is no other explanation. The FDIC claimed that since XXXX closed voluntarily they have no way of accessing the records and since the money was not turned over to the FDIC within 18 months then we must have gotten the money. This is not true. A theft has taken place by someone in all of this and it has to be within the banking system or the FDIC. I suspect this is a can of worms nobody wants to open as I keep being denied by every institution I have presented this information to. It would be a XXXX for me to claim monies that we had already gotten and I resent being accused of taking something which we only learned existed this year. We the victims have been accused of getting this money. I later learned that XXXX XXXX retired from the FDIC and never opened a case on this after I spoke with another agent. If Bank OZK took over for XXXX then where is this money? I don't see how it is possible to correspond with XXXX XXXX XXXX nor XXXX as they both no longer exist. If you are thinking of sending me to State of Georgia unclaimed funds then forget it I was already sent there by the FDIC. Georgia claims to have no money in my father or mother 's name. I am writing today regarding an unresolved dispute with Bank of the Ozarks. I noticed this information listed on my XXXX report and disputed the information with that reporting agency. They claimed that they verified the information with Bank of the Ozarks. I know this to be inaccurate information and that an error has been made on the part of Bank of the Ozarks. Therefore, I disputed this information with Bank of the Ozarks as an information furnisher, pursuant to Section 623 of the Fair Credit Reporting Act on XX/XX/XXXX. I know this to be an error because when I opened the account with {$400.00}, the first transaction was a deposit for {$260.00}, putting my balance at well over {$600.00}. The first two debt purchases I made of {$15.00} and {$19.00} after this over drafted the account by some error. I called the bank several times in XXXX and XXXX of XXXX in an attempt to resolve the issue. However, any representative I spoke with could not explain why or how this error occurred because of the positive balance on the account. She stated to me that it should not have occurred and that she was confused as to why it happened. She stated that she would be working to get the issue resolved for me. However, no one ever fixed this error. It is important to note that I have been disputing this information ever since this error occurred, and in writing after the account had been closed. The accounting of the balance after this incident of this error makes the whole amount of the balance, thereafter, incorrect. I have broken down the correct accounting of the balance, including adding the initial deposit of {$400.00} that the account was opened with, that the statement history provided by Bank of the Ozarks did not accurately reflect. However, the copy of the contract signed by me that was provided by Bank of the Ozarks, which I have attached as well, does reflect this information. I included the first transaction on the account which was a deposit of {$260.00}, which brought the beginning balance to {$660.00}. I removed the {$35.00} overdraft fees associated with the accounting error outlined above due to the fact that these fees should not have been assessed because of the accounting error on the part of Bank of the Ozarks, and the fact that the balance calculated after this error by Bank of the Ozarks is incorrect and none of the fees assessed to this account are accurate or appropriate. I subtracted all additional debts, and added all subsequent deposits in order, reflected by the statement history provided by Bank of the Ozarks to me in their response to my dispute, which I have also attached for your reference. The continued correct accounting of the balance, subtracting debts and adding deposits in the order they occurred on the statement, not only shows that the balance of this account never went into the negative, but that the Bank of the Ozarks actually owes me the exact amount of {$160.00}. I have made several attempts to resolve this issue with Bank of the Ozarks to no avail. I would like to give Bank of the Ozarks the opportunity to resolve this matter amicably in the hopes that they will do the right thing of their own accord, before further legal action becomes necessary on my part. I will pursue my rights as a consumer to the fullest extent pursuant to state and federal law and the FCRA as necessary.

Hello, This note is regarding my attempts to collect payment from either Bank of the Ozarks, or XXXX XXXX XXXXXXXX XXXX in the amount of XXXX . I am attempting to collect a refund because payments were made to closed accounts for a period of 6 months. The accounts in question had services and ownership transferred on XX/XX/ and 6 payments in the amount of XXXX $ were paid after that time. To summarize : 1. Bank of the Ozarks was the lienholder of my car note and provided loan servicing prior to XX/XX/. Automatic Bill Pay from my XXXX XXXX Checking account was set up with Bank of the Ozarks prior to the transfer of the loan servicing on this date. 2. According to a Bank of the Ozarks internal memo ( attached ), servicing on the loan was transferred to XXXX XXXX XXXX, XXXX. on XX/XX/. XXXX XXXX XXXX, acquired by Bank of the Ozarks through merger, maintained the lien according to the attached memo. I was never made aware of this transfer of loan servicing prior to collections call from XXXX XXXX XXXX in mid-XXXX. I proceeded to make the monthly payment to Bank of the Ozarks. 3. After the collection call from XXXX XXXX XXXX, I grew frustrated with the fact that my loan servicing had been transferred multiple times in the past two years. I requested refinancing of the vehicle through XXXX XXXX XXXX XXXX on XX/XX/. XXXX XXXX check to purchase the lien was cashed on XX/XX/. The lien was transferred in XXXX to my understanding. 4. Through an oversight of my own, automatic payments were still made to Bank of the Ozarks from XXXX to XXXX. I cancelled the automatic bill pay in XXXX upon learning of this discrepancy. 5. In XXXX, I began attempts to collect the funds that were paid into the closed account. I was told on the phone by Bank of the Ozarks customer service that the funds were forwarded to XXXX XXXX XXXX. Over the course of the following weeks, I was told via phone by XXXX XXXX XXXX ( XXXX ) that they did not have me in their system. On one occasion in mid-XXXX, one person at XXXX finally stated that a check would be issued to me and would arrive the next week. That check was never received despite me confirming my address on that call. 6. Today, I once again was told via a phone call with a XXXX representative that they would request authorization to refund the amount to me. Due to the history in this case, I feel I have reason to doubt that this will occur. However, it also concerns me that Bank of the Ozarks has been unable to produce documentation of fund transfer to XXXX despite my requests to provide such evidence. It is my belief that Bank of the Ozarks has cashed my checks into an account that they knew was closed. It makes no sense to me why they would forward funds to a third-party agency, when Bank of the Ozarks held the lien, either directly or through an acquired bank, during this period. I seek a refund of these payments in the amount of XXXX. I seek this payment from either Bank of the Ozarks, or XXXX XXXX XXXX. Thank you.

I applied for a land purchase mortgage on XX/XX/20 to the Bank of the Ozarks with XXXX XXXX. Application was sent via email. XXXX asked for sales contract, photo ID and mortgage statements with the application. On XX/XX/20 underwriting begun and XXXX XXXX emailed me asking for tax returns, w-2s, and pay stubs. A loan estimate was emailed the same day with terms for a 25 % down payment. On XX/XX/20 the loan estimate with the 25 % down was signed after I received an email with a counter offer for a loan with 40 % down asking me to accept or decline. Never received 2nd loan estimate. On XX/XX/20 email XXXX XXXX about why down payment changed significantly. He responded that the file noted past delinquent credit obligations with others. I asked whether the credit score of XXXX was within the guidelines used by the bank to issue loans for these types of purchases. He responded yes. I didn't understand why the down payment increased dramatically since the bank had the credit information, income verification and that information had been reviewed before the 25 % loan estimate had been created. I escalated to XXXX XXXX on XX/XX/20 because I was concerned about the transaction. I received a correspondence from the Bank of the Ozarks on XX/XX/20. The correspondence was dated XX/XX/20. The correspondence more information about the decision to counter offer. My last conversation with XXXX was on XX/XX/20. He advised me that his Bank 's procedure is to not underwrite before a loan estimate is issued, that credit reports and underwriting is only done after a signed intent to proceed, and the bank makes 40 % down loan offers to applicants with XXXX credit scores. No one with credit score of XXXX or below receives 25 % down payment loans for this type of transaction. There were other individuals that applied for the same type of loan during the same time period. I am an XXXX XXXX male concerned that I was treated differently during this transaction, and am asking that the Bank honor the terms of the first loan estimate, because I was truthful about everything that was on my application and nothing changed between the time of application XX/XX/20, underwriting XX/XX/20, the loan estimate, XX/XX/20 and the counter offer XX/XX/20.

My name is XXXX XXXX daughter, executor, administrator and personal representative of the estate of XXXX XXXX who passed away on XX/XX/2019 fifty eight days after his wife XXXX XXXX. At the time of his death Mr. XXXX had an unsecured personal loan with Bank of OZK with a remaining balance of {$2700.00} I was not assigned as executor by the court until XX/XX/2019, bank of OZK was immediately notified days after his death, I have filed notice to creditors the day after I took office. I was contacted by the bank branch that there legal department was going to freeze my joint checking account I had with my parents and the Estate account because no payment had been made on the loan and two checks came through the account. I am the survivor of the joint account which should not have been frozen Mr. XXXX 's portion of {$1200.00} had been transferred to the estate account, the estate account has only been opened less than two weeks and should have no been frozen preventing business of the estate, there are only two assets one with possible equity that will satisfy debt to creditors after sale but I have not been given the six months to determine the condition of the estate in order to protect the assets from foreclosure and repossession I made a payment to each to keep out of the ninety day window for foreclosure and repossession as I feel they had the highest priority to protect and Bank OZK has tried to make themselves a higher priority than support to the family, funeral cost and expenses of administration without warning and had been spoken with multiple times, I have not gathered and collected all assets and the ones I have I must protect, insure and manage, they are not the only creditor owed and I feel they took advantage of me knowing what they were going to do after I opened the estate account where my parents banked for years, all other creditors are working with me and giving me the time allowed by law to determine if there is enough cash and assets to pay them, Bank OZK should not have prioritized themselves and gave no warning I would like all funds returned to both accounts and unfrozen so I can continue with my responsibilities of the estate.

I was involved in an online relationship with a XXXX XXXX. It was my understanding that a person was going to deposit money into my account on behalf of XXXX XXXX and I was to withdraw that money and send them to bill collectors as directed by XXXX XXXX. When I got to the bank she informed me that the check for {$9900.00} was charged back to the bank. I inquired as to why the funds were released to me, the bank should have some sort of safe guard in place for things such as this. XXXX XXXX stated that the bank does but she was n't sure why the hold was n't placed on my account and that the teller that gave the money to me had been reprimanded. XXXX XXXX called me a thief and threatened to have me arrested and thrown in jail. She tried to force me to sign an agreement to repay the money. I refused, left her bank branch and contacted a lawyer. The bank as since turned me over to a collections agency. I was advised by my lawyer to file this complaint as the bank is at fault for not having safe guards in place to avoid things like this from happening. I went into the local branch today XXXX and was told that my account was closed and that i was to leave their building. i have video of them denying me access to my account and certified returned recepits showing how i was trying to communicate with them i also tried other means of correcting my acount and file by addressing the CFO. I opened a new checking account with Bank OZK using their website to open and establish the account. In doing so I transferred money from a different banking institution to establish the new account with Bank OZK. Bank OZK initiated the transfer from my outside account and the funds left my outside bank account. However Bank OZK then rejected the deposit into my new account because they said my account was " not verified ''. Since then Bank OZK has told me that I needed to go to an in-person Bank OZK location to verify my account so the 'restriction ' placed on my account opened online could be removed. This restriction was the reasoning given for why the deposit was rejected. I was never provided any communication that going to verify my new bank OZK account was a requirement of opening an account online. The transfer was initiated 2 days after i opened the account online and was 'rejected ' by Bank OZK that same day. This means i would have had to go to an in-person location the very next day to verify my account in order to have possibly prevented the transfer from being rejected. I was never notified by Bank OZK that the transfer was rejected. I have not yet gotten the initial transfer returned to my outside bank account. I have made multiple phone calls to both banks, and have requested multiple ACH trace numbers to determine the status of the missing funds. Bank OZK 's current system for establishing new accounts online does not work. They should not initiate transfers for new accounts if their system then will not accept them.

I am submitting a new complaint because CFPB closed my account without ALL issues being resolved from my bank. I submitted my follow up responses and you all took no regard to them. As a result in my account being frozen for no apparent reason I was not able to pay my bills which resulted in disconnections and cancellations. I am now faced with penalties from my creditors, which has caused me and my family emotional distress. My issues were NOT resolved. I reached out to your company for help and ALL my requests werent addressed. I am requesting that the bank be held liable for the additional expenses that I incurred as a result of their negligence in placing a freeze on my account. The bank also further informed me that they were not able to conduct an investigation because I waited too late to file a complaint. I NEVER authorized transactions that were debited from my account to be disbursed. A bank representative took upon themselves to distribute funds on 3 separate occasions ( XXXX XXXX, XXXX, and XXXX ) totaling {$11000.00} to my estranged husband, who was not an authorized signer on the account which caused my account to be overdrawn. I was forced to close my business account as a result. I made a payment to the Bank of the Ozarks on XX/XX/XXXX of XXXX, using the portal my Home owners association/property management provides in the email they send every quarter. The payment was withdrawn from my bank account on XX/XX/XXXX .The home owners association/property management payment is considered late if received after XX/XX/XXXX. On XX/XX/XXXX I received a letter from the home owners association/property management stating that my payment was late for XXXX. I called the accounting office on XX/XX/XXXX at XXXX and talked to the manager/supervisor and she told me, yes my payment was considered late since the payments that are made through the portal they provide from Bank of the Ozarks, the bank then sends them the ledger with the date of receiving the payment and then, posting it at their liberty could be 2-5 days after payments are made. I told the manager that my payment was made and funds withdrawn from my bank account indicating my payment was in fact made on XX/XX/XXXX at XXXX. She then told me it was my fault for not making my payment with sufficient anticipation. I told her I had the receipt stating my payment was made on time as well as the receipt of the funds withdrawn from my bank account for payment on XX/XX/XXXX. She told me that's how Bank of the Ozarks post the payments at their liberty, so I should talk them. I then asked her for the phone number that handles the posting of the payments, and she told me she couldn't provide it. And advised me to pay the late fee or I would be facing other interest charges.

About a year ago I opened an account at Bank OZK XXXX XXXX XXXX XXXX, XXXX, GA ( XXXX ) XXXX. During this time I had several overdraft fees and got charged several XXXX dollars. I kept looking at my transactions and they never were in the correct chronological order. On XX/XX/XXXX I was had two transaction go through for under {$20.00}. My account went negative {$18.00}. I got cash and I went to an ATM in my town and I deposited {$20.00} cash to bring the account back positive. The next day I got paid by my employer. When I logged into my account I noticed that bank of OZK charged me {$70.00} ( 2 ) overdraft fees despite me bringing the account positive. I went by the bank at XXXX XXXX XXXX XXXX, XXXX, GA ( XXXX ) XXXX. I stated the same that the night before I deposited {$20.00} cash and the transactions were never in chronological order. The manager stated that her hands were " tied '' so couldn't give a refund for {$70.00}. Thank I asked her to close my account. Than she said if I kept the account open she could refund 1 time overdraft fee. I said no I'd like to close my account. They refused to give any refund. I also noticed that the bank changed the transaction for the overdraft for the prior day instead of the same day. On the XXXX the {$70.00} overdraft did not show. However on the XXXX they posted it as it was charged on the XXXX prior to me adding cash. This is like changing the chronological order after the fact. In an effort to recover the {$8000.00} hacked and stolen money from my checking account with OZK Bank of Arkansas who refused to return the money to my account. After numerous meetings and correspondence with the bank to resolve the issue they still refused citing an obscure " Regulation E '' of the Dodd-Frank Act as the reason. ( See attached " Certified Letter to the President, XXXX & XXXX, of OZK Bank of Arkansas, XXXX XXXX '' explaining what took place. I never received confirmation it was signed for! No response at all from XXXX XXXX. There are a number of personal reasons that occurred during the period in question of my hacked account that were not considered including : ( I should have been offered an extension to the " Regulation E '' considering the circumstances leading up to the hacking ) ( 1 ) Covid-loss of income. ( 2 ) XXXX XXXX. ( 3 ) XXXX XXXX Diagnosis & Treatment. ( 4 ) XXXXe- Problem sending and receiving texts, emails and internet. I filed a lawsuit with 9th District Small Claims Court in an attempt to recoup some of my losses ( up to {$5000.00} ). Bank OZK responded with an offer of {$500.00} to settle the case which is not acceptable. I then received a letter from the XXXX XXXX County, Arkansas Clerks Office 9th District, Arkansas ( Attached ) notifying me that the case was being transferred to Civil Court on OZK 's request. In XXXX of this year, I opened a personal checking account with Bank OZK. At that time, I made clear, and bank records show, I made the declaration to refuse Bank OZK 's overdraft protection. Not much later, I opened a business checking account with Bank OZK and ALSO refused the overdraft program. Months later, I receive a notice in the mail " Congratulations! '' you have been approved for a {$500.00} overdraft protection. And then the same letter came for my business account. I call multiply times, but was told call times were really long because of covid. I spent a lot of time trying to opt-OUT of this program. At one point, I had the perfect storm of client 's failing to deliver checks and XXXX would not disburse my funds quickly enough to cover. So my account began being drained by the cycle of overcharge- overcharge fee- draining my account. Effectively, Bank OZK was " helping me out '' despite my declaration to the contrary, by " granting me {$500.00} of overdraft protection '', and they then stole nearly {$300.00} from my account. These types of issues have been litigated and these programs have been found illegal, unless the withdrawal was a scheduled one. I have given bank OZK plenty of opportunity to do what is right here and XXXX XXXX at their XXXX, NC office has been impossible. I started my business a month before Covid hit and I knew it would be hard, but I didn't expect to have to fight my own bank.

This is regarding early pay off of my Mortgage. I closed on this loan in XX/XX/XXXX. I was told that this loan had a penalty if paid off before the one year anniversary. I attempted to pay off the loan in XXXX, XXXX which is 2 years and 4 months after the loan began, well after the one year anniversary. When I called to get the pay off amount, the agent first confirmed that there we were not in the early pay off penalty period. She then gave me the pay-off figure which included a 1 % penalty. She then said that the contract indicated that the pre-payment penalty was 1 % after the first year anniversary. She emailed me the contract. This was very concerning because our very clear recollection from closing was a 1 year pre-payment penalty period and we had a document from our mortgage broker clearly stating this. After many phone calls and intervention from our broker, we were told that there was a computer error and the issue was later corrected. However, this was not just a computer glitch as a person had viewed our contract and still indicated that we owed a pre-payment penalty. While I have successfully resolved this issue with the help of the broker, I am very concerned that others are being taken advantage by this lender 's unscrupulous practices. I am requesting an audit be completed of similar transactions ( pre-payment of loans and mortgages ) at Bank of Ozark. Thank you.

On Friday, XX/XX/XXXX my personal checking account was restricted ( frozen ). I went to the bank on Monday, XX/XX/XXXX and spoke with the account specialist for an explanation. The specialist stated that my personal account was restricted because I deposited a check made out to my business into my personal account. I purchased my home on XXXX XXXX is my first home, and I have been struggling to understand this bank and my payment status. I am not clear on why my mortgage payments are reporting late on my credit report. I have contacted the Bank OZK mortgage department numerus times, and were told that my payments were current, but when I receive the statements in the mail its always show a balance, a pass due balance. In XX/XX/XXXX, My wife and I submitted an application to the Bank of Ozark in XXXX XXXX for a refinance of a commercial income property, along with a copy of our XXXX tax return, rent roll, and lease agreement of property to be refinanced. Sometime in XXXX, We were told over the phone that our refinance request was approved and that they would order an appraisal of the property upon receipt of a signed lease agreement on the property being refinanced. We submitted the signed lease agreement XX/XX/XXXX. On XX/XX/XXXX, we received a call from loan officer XXXX, and he said that the bank need us to verify our bank accounts ( Verifications of Liquidity ) by submitting copies of our statements. I told him that we never had to verify accounts with any other bank in past dealings, and I asked if other customers were required to do the same, and that I think we are being treated different than other customers are being treated. He ask was I refusing and I said yes. the dates XX/XX/XXXX thru XX/XX/XXXX amounts up to 3000 in interest and extra fees i reached out to the bank of ozarks in regards to a late payment and extra fees. ( there is a time period for payments to be made in a month ) i spoke with the manager and they said for one time they can forgive/waive the late payment. ok i made a payment within the next time period. i get a notice saying i had a past due amount. i call the bank and asked them about the past due amount. they acknowledged an error and said everything would be corrected. i then get a 60 day past due notice. with fees and extra interest fees. this was around XX/XX/XXXX. i requested to speak with a manager again and explain the mixup and problem. we also discussed the problem it would cause my credit. they assured me it would be corrected. i told the bank i was disappointed with the bad service and accounting errors. i expressed to them that i would like my account to be reviewed, frozen, etc. i have tried to communicate with this company many times but the service is bad and their communication is worse. i think the company need to get their license revoked. this was by far the worst bank i have done business with.

I have an RV loan with Bank OZK. I recently realize that of the {$200.00} a week extra principle payments that I have been submitting, about half of them have been posted wrong thus making the current payoff higher than it should be. The only way you notice the incorrect postings is that when done correctly you see the difference in past balance and current balance is {$300.00} less. When posted incorrectly the balance only drops about {$120.00}. This over time keeps the balance higher and the payoff of the loan takes much longer. Bank OZK says they will only go back and adjust the figures for one year. If they have made errors as a legal banking institution it would seem they have a legal obligation to make it right. I'm being told that it was my responsibility to catch the error. In other words from OZK. " let 's see how long we can get by with doing this and if we get caught we will make a few adjustments to act like we are trying to help '' I'm guessing they have a legal obligation to do correct accounting for all of their customers and not simply see what they can get away with prior to getting caught. Hi. I set up a XXXX account within my bank and checking account, and ran a trial with the recipient, sending him {$1.00} on XXXX XXXX. To the same payee, I attempted to send {$700.00} on XXXX, XXXX XXXX. XXXX failed. On XXXX, XX/XX/XXXX, called up Bank OZK ( my bank ) and got, I thought, an expedited transaction of the {$700.00} being sent via XXXX to the same payee that was trialed with the {$1.00}. Bank OZK affirms that the money was sent, as does XXXX. The payee, according to him, has contacted his bank, XXXX XXXX XXXX, and states that they have no record of the XXXX transaction. I have tried, but XXXX XXXX XXXX will not talk to me. The XXXX agent stated that there was some fishy business with the payee 's cell # ( same as account # ), saying that it was unregistered from his account on XXXX XXXX and reconnected on XXXX XXXX. Now, I honestly believe that is what I heard ( telephone call ), but the agent ( XXXX ) had a rather thick accent, so I may have heard things in error. However, I don't think so. On XX/XX/XXXX myself, my fianance, and the gentleman who had the loan with The Bank OZK went to the XXXX branch to pay of his XXXX XXXX motor home. We took a cashier check drawn on XXXX XXXX XXXX in the amount of {$25000.00}, a cashier check drawn on XXXX Bank in the amount of {$130000.00} and {$29000.00} in cash to pay the loan off because we were purchasing the motor home from the the indivdual who had the loan with the bank. We were told by the woman at the bank that processed the payoff that she would ask that the title be expedited because there was a ten-day hold because the monies were not wired. We were not told that if the monies had been wired we would receive the title quicker until we were leaving her office. We were told by an employee at the call center that they also do a ten-day hold on wired funds. On XX/XX/XXXX, both cashier checks cleared the banks they were drawn, and The Bank OZK had the funds needed to satisfy the loan. On XX/XX/XXXX the man with the loan was told that the loan was satisfied and the lien had been cleared, but still they hold the title.

Bank OZK begins calling the day after a payment is due. Sometimes calling multiple times daily AND sending at least 1 email daily, sometimes 2. My husband lost his job and we got behind on 2 payments. They of course only attempt to call during the day and while I work longer hours than they state their business operates in, it is hard to get in contact with the company. Almost every voicemail that has been left on my phone is hateful and they seem annoyed to be doing their job. I have attempted to pay what was owed in 2 separate payments totaling {$900.00}, while the amount owed was {$750.00}. They sent a letter stating the original {$500.00} payment was refunded on XX/XX/22. Which as of XX/XX/22 it has not been, and the additional payment of {$400.00} made has not been posted to the account as of yet. In the letter stating they were refunding the payment they also stated they were moving forward to " repossess collateral ''. I highly doubt this is how a business should operate.

On XX/XX/2023 I visited a ATM outside the Bank OZK Branch at XXXX XXXX XXXX XXXX XXXX, XXXX XXXX AR. I attempted to withdraw {$200.00} from my checking account and the process was taking a very long time and the machine was making sounds that I have never heard before at a ATM. I then called the bank as I sat in my vehicle at the ATM to report a problem with the machine. The ATM then displayed the message " Your transaction can not be processed at this time '' and returned my debit card. I then went into the branch and let them know the ATM was malfunctioning and also made a withdraw for {$200.00} from the teller. I also filled out a report with the teller on what had happened. The {$200.00} that I never received was already withdrawn from my account. She was very nice and professional and did a wonderful job. I then came back the next day and did another report. My mortgage payment along with the escrow account are automatically deducted on the first of every month from my bank account. Thus, my payments have never been late. I received a notice of a lien for my 2022 taxes in XXXX of 2023. On XX/XX/2022 two debit card transactions were made with XXXX XXXX XXXX that had no relation to us. Both transactions were noticed before they were completed, the bank was contacted immediately, and the account was put on hold. All other accounts were also put on hold immediately, and all debit cards were cancelled. We verified with XXXX XXXX XXXX directly and confirmed that neither of the charges were related to us. A quick XXXX search shows that this is an extremely common fraud method that has happened thousands of times to others, in exactly the same way. After investigation, the bank explained that we have no ground to stand on, and that the charges would not be reversed.

Bank OZK charged me on 3 separate occasions overdraft fees for charges I reported as fraud or that were reversed due to fraud or mistakes. I have a Bank Ozk checking account. Per my understanding, Overdraft Protection is an opt in feature. During account opening, I said no to Overdraft Protection. Yet, the bank opted me in Bounce Proof and informed me by letter mail. Bounce Proof seems to be Overdraft Protection but with a different name. I visited the bank and asked a personal banker to remove the Bounce Proof feature. He suggested I keep the feature, and after a few mins, I insisted on removing the feature from my account. I believe I should not need to opt out of a feature by either calling customer service or visit a branch just because Bank Ozk signed me up for it automatically.
