XXXX XXXX lent me 1st & 2nd mortgages in XXXX to purchase home at XXXX XXXX XXXX XXXX , CO XXXX. Both servicers began misapplying funds in XXXX and XXXX on each loan respectively and it took years to straighten out. I submitted a CFPB complaint about the 1st mortgage in which they foreclosed in the middle of a modification -- XX/XX/XXXX OMB Control No. XXXX -- XXXX XXXX was the servicer. Foreclosure was eventually reversed. A similar circumstance is now happening with the 2nd mortgage. XXXX XXXX sold the loan and it has been sold 6 times since and is with a collection agency called XXXX XXXX XXXX. The last I knew of this 2nd mortgage was when XXXX had it and offered me an {$11000.00} payoff ( which I have attached ) to be paid when modification of 1st mortgage was complete. They also told me that I didn't have to make payments until we started the trial period of the modification after the 1st mortgage was complete -- therefore I should not be in default. XXXX XXXX took 6 years to complete the modification on the 1st mortgage and meanwhile XXXX sold to XXXX XXXX in XXXX. XXXX XXXX had told me they could absorb this 2nd mortgage in the modification and that they would contact them to discuss it. I'm not sure that ever happened ; the modification is very complex. Meanwhile, XXXX had been sending letters to my previous address and I didn't get them until recently. We were negotiating, they were calling it a modification, then I got a phone call from a women wanting to buy my house saying it was in foreclosure which was a shock to me. They started foreclosing while I was out of town for the holidays and they knew it becauseI let them know I would contact them when I returned. I have offered to pay them the {$11000.00} that XXXX offered ( which I have in writing ) and they refused and want me to pay {$38000.00} with interest ( rate changes each week ) and thousands in fees ( the number keeps changing each week ) and their attorney 's fees for the foreclosure. I feel they should honor their predecessor 's offer since when they bought the loan -- likely for 5 cents on the dollar -- around {$1900.00} according to a bankruptcy attorney I spoke to. I believe that if I called XXXX today, they would accept the previous offer of {$11000.00} cash ( if they hadn't sold the loan and closed their business ). They bought not only the benefits of the loan, but the responsibilities too. Again all my day is spent over the past several weeks on only trying to save my house because of a debt collector who is unreasonable and unfair in their practices and my family is being effected including my XXXX year old son. There is no reason for them to be foreclosing while we are actively involved in negotiations.

In XXXX I received a letter saying that my second mortgage, that was discharged in a chapter XXXX bankruptcy, was transferred to XXXX XXXX XXXX, I had not paid this loan since XXXX.The new creditor contacted me and wanted me to make monthly payments and advised me that he would be " coming after me '' XXXX XXXX was the principal of XXXX XXXX XXXX.He called and emailed about payments in violation of the Bankruptcy injunction.I advised that I was not obligated on the debt and his only remedy was through the property but he insisted I start making monthly payments.He advised that he would foreclose but with a 1st mortgage of XXXX and a value under 500k no one would do that as they wouldn't get any monies after all was said and done.WXXXX talked of some type of a lien release settlement but he wanted more monies than he new I had and I advised him of a previous settlement offer that a previous servicer had reneged on ( see your case XXXX ) but he was still insisting on monthly payments.I did some research and he is not registered with the state of Massachusetts as required nor licensed with the state of Mass as required by 209cmr 18.16, I don't know if he ever applied or was denied due to him previously being sanctioned and having a cease and desist issued by The Office of Thrift Supervision case XXXX XXXX. He then sent a notice to cure saying " you have 30 days thereafter a foreclosure action will be initiated. This is also against Massachusetts law requiring a 150 day 1st notice to accelerate and cure so in summation He is operating illegally, violating the FDCPA, threatening legal action that he cant take and violating UDAAP, and trying to collect on debts not owed, and violating the CFPBS directive on deceptive acts and practices.He must know the laws about notice in Massachusetts so he is threatening what he know cant happen, or if he doesn't he shouldn't be trying to foreclose on homes..

My current mortgage company XXXX XXXX company sold a ten10 year old debt which was a second mortgage I stopped paying in XXXX. The debt was transfered to First American National LLC. To me they pass themselves off as a mortgage servicing company, but they are really a collection agency. They are currently in the process of foreclosing on the house we live in. My first mortgage is current. I contacted my mortgage company concerning First American National LLC about the foreclosure, but the people I talked to on the phone could not pull up any information with the account number that I was giving them. I don't know the process of course and I am concerned. There's more concerning the mortgage, my first and secon. In XXXX of XXXX my wife and I went to the table to to purchase the home we currently live in. Five months later I a new first and second mortgage was taken out for even higher amounts in our names with our signatures that we did not sign for. What I realize is that we have been paying on this mortgage for years that we did not sign for. My question is, how was the original mortgage that me and my wife signed for be paid off with in five months for and even higher amount? I need answers to these questions because I have'nt been able to get legal help over these many years concerning this matter. Now I'm faced with First American National LLC trying to foreclose on a debt that in reality me and my wife never signed up for. I just can't understand how a collection agency can pass themslves off as a loan servicer and XXXX XXXX my current mortgage company say it in a letter stating that they are. IS THIS TRUE?

XXXX claimed to be my mortgage servicer and for years my mortgage payments have been misapplied, misappropriated and flat out stolen from me, and now the XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, I demanded a Qualified Written Request ( QWR ) and dispute of Debt, validation of debt pursuant to the Fair Debt Collection Practice Act and other Federal and State Laws from the XXXX XXXX XXXX XXXX XXXX which I have attached I never received anything from The XXXX XXXX XXXX XXXX stating the validity of the Debt nor did I receive proof of standing to foreclose from the XXXX XXXX XXXX XXXX XXXX nor the exact date in which they say I went into default or the exact dollar amount thereof. I believe I am a victim of predatory lending practices, illegal foreclosure practices, toxic Mortgage-backed securities, violation of Federal Trust Indenture Act. my payments made were not properly applied by these related companies, based purely upon oversized ambitions, greed and corruption, which led to economic XXXX, they were lax and rife with hidden fees and deceptive practices, fXXXX XXXX practices which imperiled borrowers. they went against their own underwriting guidelines and that override federal lending standards!!

B & B Funding contacted me in XX/XX/XXXX. Stating that they are going to foreclose on my property for a second mortgage that wasn't paid. I was advised that the second mortgage was charged off by the original lender. This was back in XXXX. I didn't hear a word from anyone regarding that second mortgage until XXXX. I thought it was canceled. The person I spoke to said I had to sell my property before they foreclosed on it. The person I spoke to wanted proof I had put it up for sale on the real estate market. He had me send him a picture of the listing, whish I did. He also said the property needed to be sold by a specific time frame. My property sold for {$500000.00} ( XXXX XXXX XXXX ). B & B Funding took {$220.00} ( XXXX XXXX XXXX XXXX XXXX ). The rest was paid to the first mortgage. I received a small amount. I was not aware of this bureau ; I would have contacted you if I was aware of this bureau. I believe it is a zombie mortgage. I was force to sell that was so UNFAIR.

XXXX XXXX XXXX took over my second mortgage on XX/XX/2019. XXXX billed me an overdue amount of {$1400.00}. XXXX alleges First American Funding misapplied payments via ACH wire transfer payments that Fiurst American collected during the time First American serviced this loan. Further, XXXX alleges this loan was 115 days in areas when transferred from First American. At no time did First American notify me this loan was in arrears. In addition First American set up, maintained, and managed the ACH wire transfers, and at no time did First American report any problems whatsoever. First American never reported any negative account information to me or to any credit reporting agencies.
