AVID ACCEPTANCE has been at will changing late payments, deciding that after 4 months a payment was made late already reported and made on time. To this effect, they now have me in a delinquency status, that is reporting to each bureau inaccurate, accosting, damaging 30 day late payments that are completely in violation of the FCRA, as I made payments on the date due. Having the date due moved took 4 months after initially attempting several times to have this adjusted to match my pay period, a threat of next day repossession even though the loan was not 31+ days late aka officially DELINQUENT PAST 30 DAYS/1 month from the last due date. Ive had lies told to me that they could not change what was being reported or has been, even though I have proof they did and do at will. I suspect this is to punish me as the XXXX late that was an on time pay, changed in XXXX when they reported and posted my payment on day XXXX out from the last payment due date and have been doing so since. This has crippled my post bankruptcy standings with my apartment complex as I am not able to credit qualify to add a unit lease due to these falsely reported delinquencies. They stated that because XXXX had 31 days, my payment was 31 days late on the due date of XX/XX/XXXX which is when I made the payment, on the date due. Then stated that it takes months for the CRAs to post late payment history which is flat out misinformation and lends to their lack of knowledge on how creditor/debtor tradeline credit reporting is 100 % on the creditor to validate, update, adjust, delete, fix and or change ANY tradeline history accurately and responsibility or not at all. Their website does not allow for posted date payments nor do they have any understanding of how the number of days does not float a fixed rate simple interest loan monthly due date. Besides them not actually moving the due date to a comfortable XXXX, they have misrepresented dates Ive made payments, not recorded payments in statements, and I have attached proof of archived credit reports, debits from my accounts, the dates to show that AVID ACCEPTANCE is playing fast and loose with my credit and the FCRA. Besides me being denied credit as this tradeline is my ONLY post BK creditor reporting negative information, accosting me in more ways than just the stress of dealing with your lienholder lender that is highly resistant to work with their debtor for the best outcome without having to escalate, intervene and educate via third parties. Instead, just lie or make up laws rules and regulations on credit reporting, just continue to damage my post BK standings, as if I am going to allow them to do so because they are unhappy that I fell less than 1 payment behind. Mind you our last convo after the XXXX was involved, they agreed to fix the XXXX payment back to paid as agreed, remove the erroneous other lates, offered a deferment and a due date change to the originally requested XX/XX/XXXXafter 6 on time payments. Credit reporting is not a tool to be used at whim to report inaccurate information because I stopped taking phone calls from them during rapid withdrawal from xanax in which I answered no phone calls from anyone due to the stress of increased anxiety via acute withdrawal. This is when they went and reported XXXX late 4 months later, and put my loan in 30 day late status for months, sometimes accidentally reporting correctly before changing it to 30 days late. I have all of the proof from my archived credit reports, and payments from my debit accounts. DUE DATE XXXX XXXX - XXXX AND XXXX REpoRTED LATE 31 DAYS+ PAYMENT MADE on DAY 30 XXXX - 1 FULL loan PAYMENT MADE before day 31, REPORTED LATE 31+ XXXX - ALREADY LATE - AFTER DEFERMENT, AFTER PAYMENT MADE ON TIME with 0 DAYS LATE! AVID decides to debit my account whenever they like even if it's debit the charge will not be taken for sometimes a full 4 days after I submit payment online. Their statements report no payments but the payment portal has some of my history. I will upload secure bank docs at request if needed

I purchased a vehicle in XXXX, Avid Acceptance became my lender. Since maybe XXXX I stated having more problems making my payments and when I first contacted them to see if I could get some help, I was they dont refinance, I started having problems because the building I was living was infested with mold and making me and my child sick. In moving my rent increased but I had not had a pay increase in three years. I worked for out local housing authority which is non profit. During this time I also started school to increase my changes at gaining higher pay which some of my schooling was coming out my pocket. After struggling to make my payments, on XX/XX/XXXX, I spoke with Avid representatives and was told I could get deferment for one payment but my payments must be up to date. During this time, my employer was firing people left and right and I had to race to get a job. Here where I live, they dont keep people with proper KSOAs, they hire family and friends. I finally had to take another job which was less pay like {$200.00} less a month and I had to commute which meant more out of pocket such as gas, maintenance, oil changes are more frequent and trying to keep a roof over my head and pay my way through school so that {$200.00} really hurt to where Im borrowing money from friends for gas and have to pay that back. I never heard anything back about the deferment I submitted. They never sent anything in writing on if I was approved or not. When I mentioned this in a email, they said if I call them we can talk about it. In XXXX of XXXX, I made a XXXX dollar payment which was my school money and I have made payments after that which I found out they were planning to repo the car. Now I owe them XXXX after dropping that XXXX. I feel I am being taken because of my situation and feel Im getting punished. I told them I have paid off four other cars, the difference was the other company made it possible for us to make out payments by refinancing when we get into trouble out of our control. I have never heard of a company that dont refinance so the customer can be in control of their money and still live. I have a year left on this car, I told them I already know what they are going to do. They will set me up for failure then repo the car, I lose my job then they gon na want money. I have ask and explained what I was going through without success. Only thing I get from them is finger pointing and accusations about me not contacting them. Who do I talk to, I have like two and three people on my back either emailing me or calling all day. I have told them I cant answer my phone at work, we signed a document that we will not have our phones out. Right after work, I go feed my mom who has XXXX then class. Im tired of the harassment especially when I have called and tried to get them to help me. They want to control what I do. I told them Im starting a new job but I wont start until XX/XX/XXXX and they already asking for the address, I dont know the address yet. They want to know when Im going to pay the XXXX which I already to them in a email when Id be trying to make a payment. I can only it when I get my taxes and school money, this is keeping me from paying my medical bills and according to a budgeting specialist the car note needs to come down and they wont do it unless I refinance with someone else. This is not fair. I thought I saw a post on their reviews that they helped another person so what mays me different? Im over qualified for work here at home so I have to commute to jobs that pay more. Commuting cost! I have severe XXXX and XXXX and when I go through this, it affects my job and schooling, I start XXXX from XXXX and cant think straight because Ive been set off. There are other emails and this is another reason why I email, for records because I dont trust companies today.

Avid Acceptance has contacted me numerous times this month and are contacting my 3rd party references repeatedly when I have already contacted them, they have acknowledged my contact with a response, and have set up a payment arrangement. Please see chronology : XXXX : XXXX XXXX at Avid emailed stating my account has a late fee and to contact them. XX/XX/XXXX : XXXX XXXX at Avid emailed statement the account has a late fee and it was imperative to contact by end of day to discuss payment options XX/XX/XXXX : XXXX emailed XXXX back stating " I have scheduled a payment for my XXXX payment to be pulled out on XX/XX/XXXX when I get paid again. '' XX/XX/XXXX : XXXX XXXX at Avid contacted 3rd party reference XXXX XXXX XX/XX/XXXX : XXXX XXXX at Avid emailed back stating " We would need more than the post dated amount of {$490.00}. AVID ACCEPTANCE -XXXX XXXX XXXX XXXX XXXX ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX IL XXXX Dear Sirs : On the XXXX day of XX/XX/XXXX I signed a contract with XXXX XXXX XXXX XXXX XXXX XXXX purchase A XXXX XXXXXXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX at the price of XXXX XXXX with a down payment of XXXX. I wish to cancel that contract because the dealership knowingly withheld information from me and falsified documents. I have informed Avid Acceptance and other parties that I have been requesting the original contract that set the security interest in place. You keep sending me the retail installment agreement and the security interest- I am requesting the agreement that was set in place for the security interest. It has been 2 years and I was told a copy was going to be made and sent to me. You all included coverage for insurance in my numbers and these were not the original numbers that were agreed to. I have now included the lending party on the email because I have made them aware of the fraud that has taken place while Im still paying on the contract. You all at XXXX knowingly withheld information from me as well as told me my down payment would be returned to me and I still have yet to receive anything back. I have placed you all on notice for over the past 2 year now I am asking that you please provide me with the above-mentioned information as I will seek legal representation because you are and have been committing fraud and not giving me the appropriate documentation to provide to Avid acceptance. I have requested on a number of occasions that XXXX, please advise or XXXX can you provide me with the contract that set the security interest in place. I hereby exercise my right to rescind the agreement under the provisions of knowingly withholding information and falsification and fraud and ask that you return my deposit/down payment of {$1000.00} within XXXX days as required by law. Under Section 15 U.S Code 1605, the amount of the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges, payable directly or indirectly by the person to whom the credit is extended and imposed directly or indirectly by the creditor as an incident to the extension of credit. The finance charge does not include charges of a type payable in a comparable cash transaction. On XXXX XXXX, XXXX I was in a car accident. The deductible to repair my car was {$500.00} so on XXXX XXXX, XXXX I contacted the company the car is financed with to notify them what had happened and I requested a payment extension for the month of XXXX to help cover the deductible. The finance company is Avid Acceptance and the agent I spoke with is XXXX XXXX. The contact info I have is XXXX ext XXXX. I was told I could have an extension for the month of XXXX and he emailed me a document on XX/XX/XXXX stating as such. The email and form said to reply to the email that I accept the terms and it would be processed, which I did. I assumed the matter was taken care of until I received a voicemail from someone at Avid Acceptance named XXXX, same number but her extension is XXXX, on XX/XX/XXXX claiming to be XXXX XXXX supervisor and stating that I had not responded to the extension document, which I had. Upon returning her call that day I was connected with XXXX again who informed me that the XXXX extension had not been processed and I would need to make the payment and he would try to defer XXXX to get me on track. This was also sent in an email from him to me on XX/XX/XXXX. On XX/XX/XXXX I was again contacted by this 'XXXX '' who never seemed to want to talk after leaving a message to contact her ASAP, again I was connected to XXXX who gave me the run around again and was adamant about me making a payment for XXXX. My credit report was also reported as a late payment over 30 days at this time. On XX/XX/XXXX I submitted a payment in the amount of {$400.00} which was supposed to be my XXXX payment due on the XXXX but was in fact credited as payment for XXXX. I began calling everyday to speak with either XXXX or XXXX and emailed also with no response as of today. I have recorded phone conversations being told over and over that XXXX and/or XXXX are busy or out of the office with different agents asking to help me until I explain the situation and its passed on. I am concerned they are avoiding the extension that was promised and trying to destroy my credit in the process. I am currently in Chapter XXXX and this finance company was selected by my trustee as the car was purchased while I am in bankruptcy. My monthly funds are limited and I requested one simple extension which In writing looked legit but no one can seem to make happen in reality. I have documentation, voicemails and recordings to support my claim.

I have had nothing but issues with Avid acceptance dealing with their customer service and how their staff treats the consumer. My account manager at Avid acceptance has been unprofessional, rude, plain out terrible. My car note payment is due on the XXXX of each month, And because of how my income I have coming in, I have been up to 10 days late for the last few months however based in my contract I was told that there's a 10-day grace. Before a late fee occurs recently for my payment that was due XX/XX/XXXX I was late about 5 to 6 days before I received a email from the account manager with Avid acceptance who I advised a supervisor that I dont want contacting me at all. I have spoken on multiple occasions with representatives there in their office asking for this account manager not to contact me do to her unprofessionalism that she has shown on multiple calls we've had the last communication with her happened in XX/XX/XXXX where I had some vandalism to my car and I requested for a deferment for that month in order to have the repairs done and not fall behind on my car note at that time.When I called Avid Acceptance she started yelling at me and hung up on me that day, I spoke with supervisor but was told the deferment was approved, however in the email I recently received XX/XX/XXXX again because I was past due on my XX/XX/XXXX payment I was threatened with having a post deferment review which I don't even know the definition of that but it seems as if their office wants to back out my deferment for my XX/XX/XXXX payment when it was approved prior to this situation. I was only 6 days past due for my XX/XX/XXXX payment and to send me an email about my deferment from XX/XX/XXXX will be under review, I find this is deceptive practice and I've asked for a manager to call me and I still have not received the call to this day, I dont think anyone should receive emails with this type of request period, especially when you are 6 days past the due date when in your contract you were given a 10 day grace period before a late fee, this company is absolutely the worst and i will continue to make complaints against them when something that seems deceptive and unfair happens. I was also told that a manager approved this email prior to sending it out. Also my account has been paid current as of XX/XX/XXXX

on XX/XX/XXXX my Son died at that time I was unable to work and my wife was temporary laid off from her job. Avid Acceptance is my car loan provider. After I became late with my payment was repeatedly contacted by XXXX XXXX with said company. Not only did she attempt to contact my by phone but also email on a daily basis. She even contacted both people that I gave as references discussing my matters. she has done this twice now contacting a 3rd party about my situation. I set up a payment plan to get back on track and she continue to call and email about 'are you going to make your payment ' 'I am going to escalate your case and you won't like it ' this is after i made arrangements to make 2 payment within 2 days of each other totaling {$1500.00}. She then proceeded to call and email saying I still owe {$200.00} for XXXX and that I need to pay that. I set up another arraignment for a payment were I told her that I will make the {$200.00} payment plus my normal payment which is due on XX/XX/XXXX. on XX/XX/XXXX email communication I told Mrs XXXX that payment will be made on XX/XX/XXXX. I can forward all email and phone records and still have voice mail messages. here is part of last email between Mrs XXXX and myself Me : Are you touching base with me why are you calling references that were provided because if I say Im going to pay the bill on the 16th like I did Im going to pay the bill on the 16th the same way I told you I was going to pay the bill last month and it was paid so please if youre going to sit and call references again Im gon na sit and file harassment charges with the attorney general in the state of Colorado Mrs XXXX : If I dont get ahold of you I have to get in contact with a reference. I have been calling and emailing with no response. Me : And actually theres no need for you to get a hold of me considering we already had a agreement I am not now its considered carafe minutes ( voice to text was suppose to be HARASSMENT ) if you want to keep doing it go ahead but this will be my last response to you either way. Agreement to pay was made. Now its harassment after the last email she finally stopped

The auto loan we have with avid acceptance has been in great standings from the first date of open. This month someone emailed me about the payment, I am still within my 10 days before it becomes late. I expressed to the representative that the car was being paid off and requested a 30 day payoff. This was their response. Thank you for getting back to me. The 30-day payoff amount is {$8400.00}, good until the XXXX of XXXX. While you are in the process of paying off the loan, we will still need the payment within the grace period ending Friday XX/XX/16. *I already explained my intentions. Several collection calls have been made since then. Then I got this email on XX/XX/16 Please reach out to me to discuss options for your account. If there is no communication, collection efforts will continue to escalate. The sooner we know what the issue is and what your intentions are, the sooner we can help. Contact me today to discuss options and deadlines. * I had already spoke with previous representative about my intentions so why am I being threatened with escalated collection efforts? I have never had missed payments on this loan. Yet I am being treated as if I am skipping out on my debt. My response was this. I have already explained to the first representative. The car is being paid off. There has yet to be a late fee on my account yet I'm being threatened with futher collection actions? The payoff will be paid within the next 30 days. Please make a note on my account so I do not continue to get threatening emails. I understand your " policy '' however this is the plan. * & this is what I received in return. I will notate this on your file, however, there will be a late fee assessed at end of business today. Until the payoff is received, you are still responsible for payments to be made on time. Accurate reporting and collection efforts will continue. *if I am in communication with the company about my intentions I do no feel it is right for escalated collections. We purchased a new Vehicle in XX/XX/XXXX and made our first Payment XX/XX/XXXX. We have a high interest rate so planned to pay extra to the principal as we could. The website for Avid acceptance states that to pay extra to the principal we just need to pay extra on the car payment and it will be applied to our principal balance. As the year has progressed I have kept track of my payments and the information posted on my statements. My base payment is {$320.00} monthly. XX/XX/XXXX I paid {$320.00} and from XXXX XXXX I paid {$350.00}, XXXX XXXX-XXXX XXXX I paid {$400.00} each month. When I was reviewing my loan information in the hopes of refinancing for a lower interest rate my Principal balance did not seem to reflect any additional payments made. as I did the math to check if I was wrong, I found there is close to {$60.00} a month unaccounted for on any of my statements. When I called and spoke to a customer service representative at Avid Acceptance today he stated that my statement was generated on the XXXX or XXXX of the month and my payment was processed on the XXXX of the month, so, all those days between the statement and the payment I accrued interest which was taken out of the additional money I paid that was meant for principal. This money is not reflected anywhere on any of my statements and Directly opposes the policy listed on their website on how extra is to be paid to principal. When I asked why that 12-13 days of interest every month was not accounted for on my statements the customer service representative I spoke with only explained the same thing to me again. this cycle happened 4 times before I finally gave up trying to get a strait answer. Financially, I should be able to track every cent that I pay to this company with the statements they provide me, and It is clear that this is not occurring. Additionally, I have not had a statement generated in either XX/XX/XXXX or XX/XX/XXXX, according to the Customer Service representative that I spoke with this is because I am ahead of my payments?

This complaint is from a prior complaint from XX/XX/XXXX on the same company. Later that afternoon I received an email from XXXX XXXX the account manager sending me a delinquent account notice That my account was past due and the payment was due on XX/XX/XXXX. Now if I am not mistaken, when I made my {$200.00} payment at the end of XX/XX/XXXX, that payment cleared on XX/XX/XXXX, that bought me to current according to customer service. I told them I would call in the make my next payment which would have been after XX/XX/XXXX. That is the payment they took out of my account without notice and after I stated do not take any more money out of my account, I had to contact them to make them put that money back because I already had that money in budget for someone else and I would make my payment by XX/XX/XXXX. They ended up giving my money back on XX/XX/XXXX. During my conversation on XX/XX/XXXX, I told them I do not want the auto pay and I will call in my payment. I called on XX/XX/XXXX to make my payment of {$190.00} and stated I will make another payment by the end of the month. Again on XX/XX/XXXX, they went into my account against my wishes creating over drafts that I am responsible for. That money was budgeted to put my car in the shop and I did not know what was going to be charged. My car note $ XXXX monthly and they got their money on XX/XX/XXXX and XX/XX/XXXX. Then that is when I get another email from XXXX XXXX XXXX saying " Just reminding you that your car payment was due on XX/XX/XXXX. You can pay online, or feel free to call into the office at XXXX with your payment information and we would be happy to get it submitted for you. I was advised in the past that they do not keep your payment information in the system once the payment has been rejected then they have to put the information in the system again and basically verify. I use to get notifications that the payments were coming out but now I do not get anything up until now.

My husband and I purchased a XXXX in XXXX right after filling bankruptcy. The financial institution that financed the auto loan was Avid Acceptance out of Utah. We made every months payment on the vehicle for almost a year. My only brother was murdered in XXXX and I had to pay for his funeral costs etc. So the vehicle was repossessed and sold at auction for an undisclosed amount. I never received any documentation with the auction amount Avid Acceptance received for the vehicle. Avid Acceptance is currently on all XXXX credit bureaus for my husband and I. Avid Acceptance has applied numerous fees to the balance since XXXX. One charge that's applied every month since the vehicle was repossessed in XXXX includes {$540.00} dollars which was the vehicle payment. The vehicle was repossessed and sold at auction and even after they sold the vehicle, they continue to add a monthly charge of {$540.00} for non payment of auto loan. How can we still owe a monthly payment on a vehicle that was sold at auction in XXXX. The balance is almost {$30000.00} dollars because of these charges and fees. They have and continue to update every month to all XXXX major credit bureaus for my husband and I for the past 6 years. I have requested numerous times for documentation. I have disputed this item with each credit bureau each month, and without fail the item doesn't get removed and the balance continues to increase. Im not sure what to do at this point. I know by law the financial institution has to provide us with a letter of the amount the vehicle was sold for at auction and they didn't do that either. I hope someone can help us. The company in question is AVID Acceptance out of Utah/ We are not struggling per say but we pay a few days late, not 30 days late as of yet and for the last three years we have this loan. The loan itself is and has been a predatory loan on which we were charged excesive fees from the dealer but more importasntly we are, we were and we will be charged over 18 % interest rate. The balance does not go down at all. At the time we needed the vehicle and we agreed to the terms. It is still predatory because our credit history was small. Everything was paid on time but there was not a lor of trade lines. To the day these insipid people call us everyday and sometimes twice a day. My wife get interrupted at work and it's simply harrasment that I am going to stop at any cost. Last week we hit the bottom when they offered a " deal '' to my wife to postpone the payment for XXXX until the end of the loan so we could have a breather for this month in the midst of a pandemic and with XXXX upon us. After the disgusting loan clerk/collector got the document signed by my wife, they said we neded to still pay XXXX yesterday. That did not make sense other thatn this company continue to steal our money in fees and scams/ Bait and switch kind of procedure. We cancelled the " deal '' and paid XXXX. At this point if possible I want to report this company for harrasment, deceptive practises, predatory lending and whatever else applies. They are a firm that I will never recommend to anybody else and would like to take them to court. Please notify me of any action I can take in your behalf.

I currently have an auto loan with Avid Acceptance. I made two payments in the month of XX/XX/2023 ; I paid {$500.00} on XX/XX/XXXX over the phone with XXXX XXXX, and I made another payment on XX/XX/XXXX in the amount of {$350.00} ( not including the {$7.00} processing fee ). These payments are not reflected on my online account. It's showing that the last payment was made in XX/XX/2023, which is incorrect. I have reached out to several representatives via email ( which I have attached ) and I have not received a resolution to this matter. Yes, my payment history has been sporadic lately but as I explained to them I am currently homeless, and I paid {$850.00} last month and agreed to come up with over {$700.00} this month to get this account caught up. I receive daily emails regarding my account. The last email I received from XXXX XXXX was today, XX/XX/2023, and all she did was apologize for it not showing accurately on my end, but stated that it is showing correctly on their end. She offered to send me a print out of my account history, but I'm not accepting that because I have no idea if this with be something randomly typed up by Avid Acceptance. They are more concerned about obtaining more money from me as opposed to ensuring that the balance online is correct. So right now I have inaccurate data as far as my loan balance, pay off amount, etc., and I do not feel comfortable paying them any more money until this issue is resolved and will not do so. I reached out to Avid well during the COVID months when the governor and federal orders were in effect to inquire about options with a job loss. I was treated very rude and ignored, no options. I was later told about an email that was sent months later, that went to junk mail so I didn't have an option to respond. After several months of Avid reporting late to the bureau despite the Covid relief order, I reached out regularly nearly begging them to correct as it was ruining my credit! In fact, they reached out to me regularly for payments and I asked about the status of updating my credit report. Each time, I was told they don't have time to update, it was a big project etc. Finally I filed a better business bureau complaint. That got the attention of administration XXXX XXXX that reached out immediately indicating he would rectify the problem. Despite his efforts to rectify the problem and update my credit history, somehow, I got a notification from the credit bureau that the account was deleted even more so damaging my credit as I had a lengthy credit history with Avid. I received an updated credit report saying updated, however, the late payments are still reflected on my credit report.

I have been harassed via phone by XXXX XXXX with Avid Acceptance about a previous loan I had with his company. XXXX XXXX I fell victim to a flood and my car that was financed through this company was deemed a total loss. My apartment and all of my family 's contents were destroyed. My insurance company did not pay the full value of the car nor did I have Gap insurance as I was told I had. I never thought to check the information but found out the hard way after my car was totaled out. Insurance then pushed me to get a new vehicle or be without a car or get a rental at my own expense. I spoke with the Avid Acceptance whom told me they would not finance me until my current loan was paid off. I had to go through another company to get a car for my family, clothes, place to live etc. XXXX has been calling my boss stating that I gave her as a personal reference apparently she gets so many calls she begged me to call him, and tell him to stop calling her. I was not made aware that I could make this complaint or even if something will be done about it. I just need him to stop calling my boss. I have tried to negotiate to get this debt taken care of but what I can afford and what they want me to pay are two different things. I filed a CFPB complaint against Avid Acceptance back in XXXX for the same communication issues. This company is harassing me AGAIN and making fraudulent statements. I respond to all communications, and yet they continue to say I do not respond to anything or communicate with them. They say they call me, yet I have received XXXX phone calls from them. I have received XXXX email communications 3 days in a row, to which I have responded to all of them. My XXXX payment is due ( due XX/XX/XXXX ) I am aware. At the time the account was 11 days past due, I advised her I was unable to make a payment at that time. She transferred the call to a male name XXXX, he never disclosed his title he simply advised me I had to make a payment with him because they were closing the books, he stated I was a bad paying customer, I advised I would be able to make a payment the following week on XX/XX/XXXX. First of all, I owe more than what the vehicle is valued a difference of over {$12000.00}. I was initially told that the fact I missed a payment in XXXX I was never caught up, which I have never been over 30 days late. I also did not miss a payment, I overpaid and the customer service representative stated that I did not have anything due till XXXX . They also tend to make threatening phone calls, stating they will repo your vehicle even if you are 1 or 2 days late and after they repo the vehicle they will also garnish your paycheck. They charge daily interest fees which was not included in the contract and they are also not willing to work with you on your payments, no matter what the situ ation may be. Unabl e to trade in the vehicle due to the value and loan amount still owed on the vehicle, which is literally the same amount of a new vehicle. With the extreme interest rates and finance charges and fees, one would never be able to pay off a vehicle with this company, you will literally be stuck. I do n't understand how this company is even in business or able to conduct business. Please READ the contract before signing, especially if it 's AVID ACCEPTANCE! I have tried several times for the life of this loan to gain access to a billing statement with AVID ACCEPTANCT. I never receive one. Anytime I have asked an employee to fix it so that I get a copy of a bill sent to me monthly, they recap my address and do nothing else. Even after several failed attempts at asking for help in gain access to my account information via a billing statement, I still never received one. I have not received a billing statement for the past 1.5 years. I can never seem to gain access to my account via their web address. Even if I change the password it still doesn't work. I always have to pay my bill by bypassing gaining access to my account and entering an account number and the amount due in hopes that its posted to my account. I can not see if it has been posted to my account because I don't have access to their website and I NEVER receive a bill. As a consumer I should be able to have access to : 1. How much my payment is for 2. How much of my payment is paid in interest 3. How much of my payment is paid to principle 4. How much is left on my loan to pay it off. I have already placed this company on a cease and desist for repeated call to my job, and they still called after. Now the most recent on going issues is the collection tactics. The threatening of repossession when my account is less than a half payment due and not even 30 days late. Sending me strict compliance letters and Im not even 30 days past due and again we are talking less than a half a payment. Im in constant communication and always pay when stated yet calls and e-mails continue along with the threats of repo. Again for a half a payment that isnt even 30 days late. When I first purchased the vehicle, I was told by the dealership that the loan would be due in 45 days. When I spoke with the lending company, they told me that wasn't true - the paperwork was submitted for 30 days. I explained that I could not make a payment at the beginning of the month, that I would need to have my payments due after the XXXX of each month. I was told there was nothing they could do to change the payment date. I've since gotten behind, and can not keep up with the late fees. Unfortunantly I am not in the best health and I have to have XXXX due to a XXXX XXXX in a few days, so I called avid acceptance to see if I could get a deferred payment for this month. The first guy I spoke to said : yes we do deferred payments and I will have your loan manager give you a call. waited a day and I still didn't get any call, so I called this morning and I was told that people are on a waiting list for deferred payments and they could put me on the list for a deferred payment. So basically they are only given allotted deferments and since I was not on the list I could get a deferment. I had this loan for about 2 almost 3 years my income changed around XX/XX/XXXX and had issues keep up with the payments. that's when the calling and emailing started they would contact me every hour by email and phone about my account I told them over the phone and by email they they no longer have my permission to contact me by my cell phone or email. I requested the company correct their reporting on my credit report and they responded with a threat to garnish my wages and withdraw the signed payment agreement we currently have that has not been broken by myself in any way. They are now threatening to void the signed contract and force me into other options I can not do. My finance company does not report correct information to the credit bureau. I started my loan with this company XX/XX/2020. Since then I have made my payments on time. Ok so the vehicle in question was in a recall for emissions fraud XXXX XXXX XXXX buyback. They Settled for a fix amount for a fixed time period. And a fixed mileage. This company knowing this was trying to get me to pay during the time for the time it took for payout of the vehicle. The company continues to call and email after a payment has already been arranged. There is no valid reason for the call other than to harass or to get my wife and I to overcommit ( commit to making ANOTHER payment despite arrangements already having been made. ) This is very clearly bad faith. Multiple issues : 1. Avid prevents customers from knowing how much interest and fees they charge in total by failing to provide any method to see these totals. They deliberately only provide monthly statements while preventing access to the total amounts. 2. Avid charges interest rates even when paying early.
