My car was repossessed on XX/XX/2023 due to non payment stemming from returned payments in XXXX. I contacted the company to make them aware prior that I was experiencing financial hardship and including loss of income and shelter for my family. I was told that I did not qualify for any deferments and was encouraged to pay the balance immediately. I was able to accumulate XXXX of the near XXXX redemption fee which was quoted to me originally by XXXX the XXXX in redemption. However, when the day came for me to redeem my car ( XX/XX/XXXX ) XXXX was the one who helped process my redemption, He told me that according to the policy that the company had I could redeem my vehicle for the lesser amount that I had. I paid it and was able to redeem my vehicle on the premise that the repo fee of XXXX dollars was going to be sent to the back of my loan and the storage fees would be negotiated uppon my monthly payment by means of an additional fee. My XXXX was supposed to have went to cover my missing payments but the company applied the monthly payments I was making to the storage fees. I was made aware of this by XXXX who contacted me after reviewing my account and noticed that his coworker had redeemed the vehicle to me for less that he had quoted originally which led him to go back and make adjustments to all the payments that I had made since I redeemed. Also these payments were not showing up in my account on the portal nor the report which they provided. So the premise is being created that I have not made any payments and at XXXX point XXXX asked for proof that I was paying. I am not able to pay with my checking account and only able to pay cash or in person. This situation has caused me to be back in default status due to how they erroneously applied my payments..and they are now harassing me with phone calls and threatening to recover my vehicle again. I was quite upset with him for doing this to my account so I did previously attempt to contact him and find out how this could be resolved. I felt he was being insensitive to my situation as he was trying to say that I should be happy he even put the fees to the back of my loan and that my car was still behind due to the storage fees incurred. He insisted that he has done all he can to help but instead he has caused us immense distress in this situation. Also not only did we encounter a financial issue but once the van was finally returned to me I noticed that the car was leaking and overheating from damage to the underbed of the car. As I look further there I notice the hood latch was broken and only made to look like it was fully closed. The latch has been broken. There are also many missing parts, and new hoses that have been taken out and replaced with similar older parts from a similar vehicle including a battery that I recently bought and still had a warranty on. They rewired some parts of my starter and engine to a small battery connected to a main battery which is causing a lot of electrical issues and indicators to spawn. I can not replace my battery without the core battery so I tried to reach out to XXXX again providing him with pictures and video of the issues the car returned with. I then asked for the information they had on my car from the repairs done on my vehicle as he was reading them to me. He would go on to say that I needed to go through my insurance for repairs because neither the auction vendor nor the towing company took responsibility for any damage and claimed that they could not prove that those damages were/ were not already there. I told him I will be pursuing this matter in small claims if I have to and that this treatment is wrong, I disconnected our call and since then they have been calling me and hanging up. When I do try and answer someone I explained to them that my situation has been exacerbated by so much financial pressure I am doing the best I can to pay and they keep letting me know the spill about calls will continue until I make arrangments on the account. I then received another call recently during a meeting I have for an active case and the employee made very dismissive remarks saying that his call was more importatnt and that if my case was so important I would have not answered. He also said that I was the one who is hanging up and not calling back when I am supposed to, I found this odd. Usually, the callers are not rude if I do get a person who isnt hanging up.. he rose his voice sternly and demanded I submit a payment within a certain time. I disconnected the call during his disrespectful comments. I have since been disturbed that I will awake to them trying to take my car again even though I have been actively communicated with them up to this point. I barely sleep at night. I am submitting a claim so that my situation may be reviewed on a higher a level and that an investigation take place into the situation so that my car my be repaired and that my payments be applied to my account as we had discussed on the day of my redemption. I believe they are taking advantage of thier customers situations and being unreasonable.

A XXXX XXXX XXXX was purcahsed from XXXX XXXX, in XXXX Ohio. I took it home to Pennsylvania and took it to XXXX XXXX XXXX XXXX in order to register it and get a license plate. After this was completed I thought everything was good and needed no further action. A couple months later, I was pulled over by an officer who informed me that the registration for the vehicle was suspended and they needed to tow the vehicle. After contacting the Pennsylvania DOT, I was informed that XXXX XXXX gave a bad check to pay for the registration and vehicle taxes. With that happening, I immediately contacted them, only to find out that they have been shut down for doing this to hundred of people. I found the owners of XXXX and spoke with him telling him what happened and letting him know that the registration in my name was revoked due to the taxes and registration checks bouncing and that he would need to return the funds I paid and take the vehicle back. He assured me he would call and take care of it but never did. I then informed him where the vehicle was being held, and that he needed to go retrieve it and refund me and he once again said he would take care of it. I was told by the tow company that the dealership did indeed recover it. so even though I didn't receive any money back I still was hoping nothing would show on my credit about it. I have spoken with the attorney general and was advised to contact Automotive Credit Corp and let them know that the dealership went to court and was forced to pay everyone back for not sending titles, not sending payment for state taxes, as well as not sending proper forms to complete the sale of the vehicle and that this in no way should be a debt of mine, rather it should be transferred directly to the owner of XXXX on the law suit that the Lender has or had ongoing with the dealership. Below I will list the link to the 100+ other victims attorney general complaints as well as my own. This has completely ruined not only my credit, but there have been so many years worth of denials due to this debt that it has impacted what should have been the best years of my young adult life. Having this fraud impact me to the degree it has with no one listening when I say this debt is not mine, has caused me to not be able to get funding for my business, be forced to take horrible auto financing due to it looking like I don't pay my debt. Meanwhile. this is the only collection on my record that is significant enough to tarnish my entire credit file. Complaints were all made through XXXX XXXX XXXX XXXX XXXX is the dealership who defrauded me and caused the entire mess and was found guilty in the case, having to pay back everyone who he didn't send titles to, but people like me where left in the dust because even though he sent bad checks for state taxes, and never sent a good one to make it right, he sent the first one so there is nothing the AG will do to make it right. Automotive Credit Corp is the lender I am asking to please check the Attorney Genereal complaint and see the hundreds of people like myself who have a collection from them in which the vehicle was returned to them only for them to sell it again like in my case. XXXX XXXX XXXX of XXXX XXXX, XXXX XXXX. XXXX XXXX XXXX, XXXX XXXX XXXX XXXX who Defrauded myself and hundreds of others ) XXXX XXXX sold used motor vehicles to consumers and failed to transfer titles to the purchasers as required by Ohio law . Consumers filed complaints with the attorney general seeking relief from the Title Defect Recision ( TDR ) Fund. The complaints resulted in payments being made from the TDR Fund to reimburse the injured consumers. The Attorney Generals Office sued the business and its owner on XXXX XXXX, XXXX, for violations of the Consumer Sales Practices Act and the TDR Law. The litigation concluded on XX/XX/XXXX, with a Consent Judgment and Agreed Final Entry and Order. The settlement included a declaratory judgment ; a permanent injunction ; {$42000.00} for reimbursement to the TDR Fund ; and a {$50000.00} civil penalty, with {$25000.00} suspended on the condition of full compliance with the terms of the settlement.

I purchased a vehicle financed by AUTOMOTIVE Credit Corp on XX/XX/XXXX ; My payment was {$5000.00} down and {$900.00} per month ; payments was due the XXXX of the month. My truck was totaled on XX/XX/XXXX by a driver that ran stop sign ; I filed claim with at fault driver same day but later found out that her insurance lapsed which caused me to file with my insurance company on XXXX XXXX ; I paid XXXX and XXXX payment and have proof ; I received auto statement from XXXX stating XXXX was due on XXXX XXXX so I assumed it was because insurance paid vehicle balance of XXXX but found out a payment of XXXX was made XX/XX/XXXX ; I never received a XXXX Statement so I logged on to the website to pay balance on XX/XX/XXXX but message stated account was suspended but balance of XXXX due XX/XX/XXXX ( I have proof ) so I called to see why and was as told I would receive a letter in the mail ; No statement came for XXXX nor did the letter come but XX/XX/XXXX I received a phone call from XXXX XXXX company stating remaining balance for the auto loan with XXXX was due and I made an over the phone payment of XXXX that posted to my account XX/XX/XXXX ( I have statement proof ). XX/XX/XXXX I received a credit notification that a charge off was reported to my credit and dropped my XXXX score XXXX points. I called that same day to XXXX to find out why tis account was reported as a charge off and that it was paid in full but reporting a balance of {$4500.00} ; was instructed to call XXXX XXXX their collection company ; Called XXXX XXXX and was told balance was XXXX but they do not report to bureaus and to call XXXX back ; I called back same day and was told I had to speak to a supervisor and transferred me to a voicemail but call wasn't returned ; called back 48 hours later to XXXX and balance was confirmed XXXX but stated I had to dispute charge that was the only way to correct and they will respond and correct then ; filed a dispute on XX/XX/XXXX only for response to come back as updated, the balance still shows {$4500.00} and this still shows a charge off ... .report states last reported was XX/XX/XXXX but been paid since XX/XX/XXXX First mistake, the account was reported to my credit as opened XX/XX/XXXX when I can prove that was inaccurate, I still have messages from salesman showing me the truck XX/XX/XXXX asking if I was interested and more proof it was opened end of XXXX next, XXXX reporting balance of {$4500.00} still til this day when I have proof and so do they according to my last call that balance was XXXX and after sending disputes twice they still didn't update it ; XXXX was original creditor, never reported terms, monthly payment amount, and other accurate account information, it just shows {$4500.00} due, incorrect open date and a charge off status XXXX sold debt to XXXX XXXX but XXXX XXXX never was reported to my credit, so 2 parties was trying to collect on the same debt Still til today, I can still log onto account at XXXX that's shows next payment due XX/XX/XXXX for XXXX and that I paid XXXX and XXXX payments ;

On XX/XX/ I entered into a consumer credit transaction with ACC. ACC produced an illegitimate contract as they have violated the TILA. As defined under the TILA 15 USC 1605 ( a ), the finance charge is determined as the sum of all charges, payable directly or indirectly by the person to whom the credit is extended and does not include charges of a type payable in a cash transaction. ACC states on its contract that the finance charge is The dollar amount the credit will cost you, which is false, misleading, and a violation to my consumer rights. ACC included a down payment of {$5000.00} which is also a violation. As stated under the TILA, Charges which are included in the finance charge, but were not, are as follows : ( 1 ) Interest, time price differential, and any amount payable under a point, discount, or other system or additional charges. ACC did not include the interest in the finance charge which is a violation. Section ( c ) also states charges or premiums for insurance shall be included in the finance charge unless a clear and specific statement in writing is furnished by the creditor to the person to whom the credit is extended, setting forth the cost of the insurance if obtained from or through the creditor, and stating that the person to whom the credit is extended may choose the person through which the insurance is to be obtained. ACC did not include my insurance in the finance charge and did not disclose the option to obtain the insurance of my choice through them which is a violation. Per 15 USC 1631 ( a ) a creditor or lessor shall disclose to the person who is obligated on a consumer lease or a consumer credit transaction the information required under this subchapter. Per 15 USC 1635 ( a ) In the case of any consumer credit transaction the obligor has the right to rescind the transaction until midnight of the third business day following the consummation of the transaction. XXXX stated there is no Cool Off Period and I can not cancel this consumer credit transaction. ACC did not disclose my right of rescission which is a violation. These are just a few violations under the TILA backed up with evidence that was provided to ACC. Per 15 USC 1611, Whoever willfully and knowingly ( 1 ) gives false or inaccurate information or ( 3 ) fails to comply with any requirement imposed under this subchapter, shall be fined or imprisoned, or both. I have tried to settle with ACC, sending them an Affidavit of Truth stating a few of the violations under the TILA and an invoice for violations. They disregarded my request and stated they did not breach their contract. Due to violations ACCs contract is null and void and they have been collecting on this alleged debt after receiving a request for validation. On XX/XX/ ACC received my second attempt to settle before taking legal action.

1 Payment that was made was not credited correctly. {$180.00} int. {$130.00} principle 2 Deceptive practices ( I tried to elaborate on what the contract says about waiving up to {$500.00} and the deductible of the primary insurance and I was told that was only if there were a {$1000.00} deductible. I pointed out to them that my contract stipulates my deductible can not go higher than {$500.00}. So I was told that the clause didn't pertain to me only people with a {$1000.00} deductible. I was first told by XXXX XXXX and then I insisted on speaking with a supervisor. Thats when it was confirmed to me my XXXX XXXX. I purchased my truck on XX/XX/2019. My first payment was due XX/XX/2019. I made my payment on XX/XX/2019. I got into a accident and totaled my truck, on XX/XX/2019. I was fully insured and I had GAP. XX/XX/2019 {$9800.00} {$10000.00} bal {$310.00} payment principle {$130.00} interest {$180.00} {$9900.00} bal {$9800.00} paid by insurance {$91.00} bal GAP should've covered this. I tried on numerous occasions to resolve the matter. I was told that they would let me settle it at {$300.00}. When I would ask a question I was talk to like i was some XXXX. I asked why gap wouldn't cover the balance and they told me because I was behind in payments. A hard inquiry was added to my credit report by AUTOMOTIVE CREDIT CORP on XX/XX/2019 XXXXWHY WOULD THEY RUN MY CREDIT AGAIN? XXXX I bought my XXXX XXXX XXXX on XX/XX/2019. I paid {$590.00} for GAP. The 48 month term that I signed started XX/XX/2019. My vehicle was totaled in a accident. Someone slammed into the back of me that didn't have insurance. The accident date was XX/XX/2019. According to the gap contract it will cover the balance of the loan. My insurance company paid it off in XXXX. Automotive Credit Corp told me that gap wouldn't cover it because I was behind in payments. I went through 3 different people and no one would listen. Finally the supervisor of the insurance part tried to convince me of just a bunch of XXXX. In the waiver it states " ( A ) If the vehicle is protected by insurance, lender will waive the GAP amount and the waiver shall include the primary insurance deductible up to {$500.00}. I tried discussing this with them and I was told that it was for people that had a {$1000.00} deductible. I asked where is this disclosed? And then emphasized that in my contract it states that I can only have a {$500.00} deductible. Then my credit was ran by them. This happened for no reason and I didn't authorize it. They also did the interest and principle wrong. it should've been {$180.00} interest. They have reported that I was 120 days late. Then because of disputing they had to remove it and changed it to 119 days.

My account with Top Finance Co. was closed on XX/XX/17 and charged off. Top Finance Co continues to show this account as open. Top Finance Co. has subsequently increased the balance of this CLOSED ACCOUNT by {$100.00} every month for almost three years since this account was closed and charged off. As a result of Top Finance Co. fraudulently increasing the balance of this closed account, I have 32 late payments reported on my credit report for an account that was closed and charged off three years prior. This has occurred from XX/XX/XXXX-XX/XX/XXXX. Because Top Finance Co. has committed this fraud, this closed and charged off account currently reflects that it is delinquent or in collections ; having a SIGNIFIGANT impact on my credit report with all three credit bureaus. Top Finance Co. has also fraudulently reported 5 random payments on the account after the account was closed in XX/XX/XXXX and charged off, in which no such payments were ever made on the account. The term of the original loan before the charge off was 42 months, however Top Finance Co. has reported 70 months of payment history for this account because majority of the payment history was derived from their intentional fraudulent misrepresentation. All the foregoing is a violation of the Fair Credit Reporting Act ( FCRA ). I have attempted to resolve this matter with Top Auto Finance , Inc. multiple times, however Top Finance Co. continues to violate federal credit reporting laws. I want ALL fraudulent information reported on my credit report after XX/XX/XXXX, when this account was closed and charged off to be removed with ALL THREE MAJOR CREDIT BUREAUS ; to include late payments, increased balances, delinquency, and collections. There should be no activity reported afterXX/XX/XXXX on the account with Top Finance Co. as the account was closed and charged off. The ONLY status that should reflect on my credit report for this account with Top Finance Co. is CLOSED/CHARGED off from XX/XX/XXXX. In addition to the above mentioned facts, Top Finance Co. has started to report the same negative erroneous information previously mentioned under a company name of Top Auto Finance , Inc. with certain credit bureaus. I did not realize this until I looked at my credit reports with greater scrutiny and noticed the slight variation in name. I have NEVER had an account nor signed a contract with a company called Top Auto Finance , Inc. Please reference CFPB complaint number XXXX. Please advise if I need to amend my previous complaint as I never had an account with Top Auto Finance , Inc., only TOP FINANCE CO.

I got behind on my car payments due to my job losing money. I was 30 days for a few months until I eventually was able to get my finances in order. I contacted XXXX to let them know I wanted to get my account up to date. I spoke with a rep named XXXX. We agreed that I would make 3 payments in the month of XXXX ( the payments were made on XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX ) to get my account current and that they would in turn let me skip a payment in XXXX and that my next payment would be in XXXX. I was also informed that they had no evidence that the car had insurance and they were charging my account and that I need to pay for the year they didn't have proof of insurance or provide proof that I did have insurance. I sent documentation that I did have insurance on my car. Mid XXXX, I once again started to receive calls from XXXX. I contacted them to asked what was going on and I was told that my account was past due for XXXX and the amount owed for insurance. I mentioned that I had an agreement in place to skip a payment in XXXX. The rep said that she didn't have that in the system but that they would look into reviewing my account to see if I was eligible for a deferral. This is not the agreement I had with them originally. She offered to have me speak with a XXXX but I said I wanted to speak with the rep that I had originally made the deal with. I followed up by sending additional documentation for proof of insurance which I am continuing to be charged for. Eventually, I decided to contact the XXXX in an attempt to get XXXX to honor the agreement we made back in XXXX. XXXX responded by stating some of the facts above but that I still owed other fees for insurance. I replied that I had sent two different emails to show proof of insurance but that I still wanted them to honor the original agreement. I asked them to bring up the recording of the conversation since they record calls. They have not done so to this date. As of this week, they are reporting my account late, and that I owe them even more than the original amount. They said I had not made a payment in the last 30 days but I have evidence by looking on their website that I have made the payment. Then followed up by reporting to XXXX that I am delinquent and owe them {$11000.00} when their website says my total amount for the loan, which I have for another 2-3 years, is {$10000.00}. I believe they are acting in bad faith and causing me hardship by reporting incorrect information on my credit report which has affected my credit rating. The XXXX account number is XXXX.

I noticed the company Automotive Credit reporting an inaccurate and fraudulent debt on my credit report. I initiated a dispute and requesting to validate and and investigate the debt since that seems to always be the 1st step to credit solutions. The company failed to respond AT ALL to that initial request. I also called them and had to argue with a representative in order to talk to someone in Compliance regarding their failure to respond to the validation letter. I spoke to " XXXX '' in compliance because XXXX the director was out according to her. She asked for time to investigate and that she would later get back to me. She never did. Two entire weeks passed and then I called her again to find out what the next step was. She said there was nothing to do because they have phone calls and that the " account info '' that they have on file is deemed as accurate. I asked her how? And if that's what the company has concluded I am legally entitled to see this " proof '' of what I have been telling them is FRAUD. She then goes on to tell me that they ONLY way she will send me proof that the company DID respond to my validation letter is IF I SEND A CERTIFIED MAIL RECEIPT -- - that is illegal and A LIE. I don't need to send any letters Certified Mail that is NOT a requirement for them to do their job. I then tell her that she is lying to my face about that being a " rule '' and that she is wasting my time. She then asked me if i sent over a police report. I told her NO, i did not send one over because YOUR COMPANY never told me what procedure to take or what direction to go in. To INITIATE A DISPUTE THAT IS NOT LISTED under the FCRA to submit a Police Report along with the initial investigation letter, so how am I supposed to assume that's the case? That's when I told her she should educated herself and the company on the TERM " LIABILITY '' since she has no clue of what she is talking about -- and since she is purposely wasting my time I will have no choice but to contact a Lawyer, which by the failed response and their claim of recorded calls -- I am confident I have a case that will grant me monies along with their compliance to the full extent of the law upon contacting a lawyer. But I also want a paper trail of their failure to follow the LAW on multiple occasions with me. I can only imagine with how many others this happened with!

I received a phone call from a man by the name of XXXX, which to be honest I do n't remember if he said his name when he called. I was more interested in what company it was calling me from a weird XXXX number as it appeared on my caller ID. This man calls me to advise me that my car pay is {$58.00} short, my payment is actually XXXX and change. Most of the time I do n't bother thinking in cents but in whole dollars so either I pay a few cents less or a whole dollar more, no big deal. I tell him if that is an issue, he states that it is because my total payment should have been the XXXX and change, I then tell him that this entire phone call is a bit ridiculous because up until now I have paid my payments in full minus the lousy cents and this month I paid XXXX instead of the XXXX and change since they want to get " technical ''. I then ask him for a copy of my contract loan with them just so I am aware if I am out of bounds, I understand that the full payment is due but i paid XXXX % of it and for them to call me about {$58.00} is annoying frankly. Especially since I am at work! This is not the first attempt to contact me at my place of employment either, they have previously left messages with co workers during the first two months because of being a few days late, only because of my due and payment cycle however it was UNDER 10 days late. This is not my first car loan, but this is the first time being approached as harshly FROM THE BEGINNING. If I could turn the car in without hurting my credit I would have a long time ago, but we all know that 's not the smart thing to do and I do n't think I can handle 4 more years of this kind of attitude because if it 's not this month it will be next month, kind of annoying if I am paying my bill in full or up to XXXX % and within its pay period I do n't see why I need a babysitter. Something has to change because along with the XXXX attitude, XXXX did not give me the FDCPA or mini miranda or any other kind of awareness before continuing with the slap in the face.

In XX/XX/XXXX my ex husband and car salesmen told me to sign a document so my name can be on the title of his new car purchase in case I get pulled over. I told them I was n't co-signing and they assured me I could n't because I did n't have good credit and it was only so my name would be on the title. I signed a piece of paper and fast forward XXXX years now the debt is mine. The creditor has taken my state taxes. I 'm remarried and they have gone into our joint account and taken over {$600.00} ( which was our rent for that month ) and I was n't working so it was my new husband income but according to the bank married couples take on each others debt. Now they are taking my child support from my personal account I 've had for years with no incident until they merged with another credit union. Although I have not worked since XX/XX/XXXX they continue to harass me and recently took {$7.00} well because that is all I had left in that account. I made a {$300.00} deposit to rent a car but took it out the same day once I could n't get the rental. My point is there are no deposits for this account other than child support from a income standpoint. I called my credit union once before on the same issue and they told me they could n't do anything because it was a garnishment. I informed them it is illegal to take child support as payment for a debt. They informed me that any deposits made to my account is fair game. So, I 'm at a loss and will have to file for bankruptcy I 'm guessing. However, I wanted to put this on the record that I have contacted the Attorney Generals office and they sent back the creditors response which included the form I signed plus another XXXX I did n't sign that miraculously had a signature that was n't mine on it. These creditors take illegal measures with consumers that ca n't afford to fight back because no one holds them accountable. So for all the consumers out there, DO N'T SIGN ANYTHING WITHOUT READING IT.

On XX/XX/XXXX I spoke with a loan rep named XXXX from ACC that finalized the loan. During this conversation XXXX advised me that I will be receiving loan and payment information via mail with-in a week from our phone conversation. Since our conversation I havent received the loan or payment information which was supposed to be sent to me. But what I have received is several calls from your employees that tell me my loan is in default, but no one to date have sent me loan information to make a payment. I am requesting my loan and payment information sent to me via US mail. ( 2 ) I, XXXX XXXX have received your correspondence, dated XX/XX/XXXX that states YOUR ACCOUNT REMAINS PAST DUE. YOU MUST IMMEDIAETLY REMIT {$320.00} IN ORDER TO BRING YOUR ACOUNT CURRENT. As I previously advised this company, XXXX a loan representative told me I would receive car loan information via US mail. But I wasnt provided any information in regards to my car loan via US mail. And still to date the only response to my request to get car loan information dated XX/XX/XXXX is a letter demanding a payment more than quoted to me by XXXX XXXX a representative from your company. According XXXX who only provided me with payment information via phone quoted my loan payments to be {$300.00}. Those are two of the letters I sent ( 1 ) XX/XX/XXXX and ( 2 ) XX/XX/XXXX to acquire information regarding my auto loan # XXXX to ACC. Since then the only response from them have been threatening letters. Also I have made a complaint against XXXX XXXX XXXX XXXX with multiple reporting agencies for forgery. XXXX XXXX XXXX XXXX responded to the Better Business Bureau on XX/XX/XXXX was that I was on repossession status and I should rescind the loan. I bought a XXXX XXXX XXXX about four months ago at a dealership called XXXX XXXX in XXXX. I got financed by a company called XXXX XXXX XXXX XXXX. The day I purchase the car the manager at the dealership didn't let me test drive the vehicle before purchasing it. The the car had problems with the transmission or the engine I'm not sure what the problem was. I told the dealership to fix my car and they denied to fix it. I contacted the finance company and they told me the loan went through without me giving authorization that the car was in good running conditions. I told the finance company to tell the dealership to fix my car. The finance company told the manager at the dealership about my situation and I got a call back from the manager. He was angry at me telling me that the finance company was going to back off from the loan if I didn't tell them that the car was running good. They told me they would fix the car if I told the finance company that the car was in good running conditions. But they never ever tried to fix my car. The finance company knew about this problem from the start ever since I got the loan. Now my car got repossessed because I haven't given the first payment. I don't think it's fair that I didn't even get to enjoy or drive my car in the time that I had it. Now I don't know what to do since the loan went through and it's already on my credit and my car is repossessed. This looks like the finance company and the dealership worked together to sell me a lemon car that I didn't even get to drive. And now I owe them {$8000.00} because the loan went through without me approving of it. I need help getting rid of the situation I have XXXX kids and they're the reason I bought the car in the first place. I bought a car from the XXXX XXXX in XXXX Indiana on XX/XX/XXXX. I was financed through the Automotive credit Corporation. the total amout financed was {$6100.00}. I paid {$800.00} cash down to the XXXX XXXX. the owner of the company is XXXX XXXX. THe finance company paid the car lot in full so i then made my payments to them through their web site. I had a family emergency that required my finaces but i i had made arrangements with the finance company. I paid them {$200.00} of the {$260.00} payment and i agreed to catch the the remaing up. On the XX/XX/XXXX the XXXX XXXX sent a tow truck and took my car. I do not make i payments to them i have a letter from the finance company telling me to deal directly with XXXX about my account. The next day i called to see how i get my car car back and what i need to pay. XXXX then informs me that they do not have my car, nor did they authorize the reposessioin. they advise me to contact the police to see if a repo was reported to them. The dispatch officers informs me that no repo report was made so i then procced to file a stolen vehicle report. I also called the XXXX XXXX and XXXX XXXX said they didnt have the car. when the police filed the report XXXX XXXX then informed the officer that he repossed it. I have the call recorded with the finance company at that point saying that they do not know why he has the car or or what he wants to accomplish by taking it. The finance company sold my car back to XXXX XXXX who is now going to sell it at an auction. So my contract was cancled with XXXX and wont tell me why. i recived a letter on the XX/XX/XXXX stating any questions need to be directed to the XXXX XXXX I dont belive either company has a license to finance so i was decived and robbed of my money. also they voided my signed contract. over XXXX bucks.

Automotive Credit Corp has about placing CPI insurance force place insurance on my account illegally. I have sent them several information messages and asked them to please update their system letting them know that I do have insurance for the vehicle purchased I purchased a vehicle in XXXX Ive had insurance on that vehicle from XXXX until the date that I paid it off which would have been XX/XX/XXXX XXXX this company continue to charge fourth place insurance CPI insurance on the vehicle even though Ive sent them several emails several proof that insurance was in place this of course caused me to be late or have missed payments due to them charging me for this insurance that was not needed please see all the proof here which shows that insurance was with this vehicle ever since XXXX Over the past two weeks I've spoken with five to six different people at automotive credit Corp then they told me to contact someone at XXXXXXXX XXXXXXXX XXXX I have verified all the information I've had my insurance agent sent over insurance documentation shown we have proof of insurance from the date they requested please see all attached this company has been giving me the runaround this company has refused to remove the force placed insurance which is causing me extreme damage financially. I finished paying my car noteLast year XXXX ( 2022 ), however sometime before that, in XXXX ( 2022 ), about a month before i made my finalpayment, Automotive credit corporation ( acc ) reported that I was 30 days late on my payment. I called several time and exchanged emails etc. XXXX ( rep from ACC ), respondedwith justifications as to why that late report is on my report etc. ( see thread ) Eventually, your team sent me my title but the late payment report had already been done. I recall talking to ACC team several times in XX/XX/2022 about why my creditreport is showing more balance than it should. A team member informed me that automotive is changing its systems and for that reason, balances showing on each credit bureau is different. I gave their team grace to correct this balance inaccuracy. AroundXXXX XXXXXXXX, there still was no correction yet. ( I assumed automotive was still changing database systems ) Again, I emphasized to the representative that if i were late for my payment, Automotive will charge me a late fee and also report to the credit agencies. I stated that if that correction is not fixed, i will not make payment on time for my next month. ( All of this, i have on recording and i believe your team has on recording as well ). Indeed if i was late on payment, automotive quickly reported that late payment to the bureau. Fast forward to today, this isscrewing me up big time because I can not purchase real estate whatsoever. At this point, all I am asking is a resolution regardless of who is to be blamed. On XX/XX/XXXX, I purchased - or I thought I purchased - a XXXX XXXX from XXXX XXXX. I was given a temporary tag even though I had a valid tag from a previous vehicle. After 30 days, I was given another temporary tag. I attempted to have someone in XXXX transfer my valid tag to no avail ; the vehicle was registered to someone in Indiana. I went back to the dealership and ... ... .surprise! They were shut down for fraud. I continued to pay the monthly payments to AUTOMOTIVE CREDIT CORP. XXXX is theis headquarters number in Michigan. As of XXXX of XXXX, they still were not sure of the ownership at which time they sent me a verification of VIN paperwork, which I provided to the Florida XXXX University police dept ( I believe ) i subsequently forwarded to ACC. Along with the vehicle giving me issues and the confusion regarding lien holder or title, I requested they come and get the vehicle, I'm not sure of the date possibly a month or so after. On time payments were reported until XXXX of XXXX. I was informed by ACC that I did not give them enough time to research and they've decided not only to butcher my credit but also to sue me. XXXX XXXX XXXX XXXX XXXX at XXXX. Apparently there is a judgment? I no longer live in the state of Florida. It's been extremely frustrating, why would I be responsible for a loan that was tied into this dealership? This financing was set up by the dealership, not me. I believe they should go after the dealership as another 100 customers did.

I had purchased a vehicle in XX/XX/2023. My first payment was due in XXXX. Ive paid on time every month sometimes early. In XXXX, I got new insurance through XXXX, and Automotive Credit. They ended up canceling my insurance for unbeknownst reason. ACC spoke to them and changed the policy. I got canceled and I never even knew about it. I corrected the situation when I found out about it. I went with another insurance company, because I couldnt get any answers on why they canceled me. ACC charged me {$450.00} for 15 days XXXX policy, unbeknownst to me. I paid early and apparently they applied my regular payment to the insurance charges and showing Im 15 days late. Ive advised that Im not paying that amount for XXXX weeks in lapse of insurance. They refuse to work with me. I asked for them to take off the charge, XXXX XXXX refused. She did take off a late charge and told me to pay the payment a day late so it wont be applied to the insurance. I would like that amount. To be taken off and my payment to be applied correctly. They call me every day for collection and want me to pay. XXXX stated that nobody can apply the payment correctly, if she could she would. I asked to speak to someone higher and she stated XXXX and XXXX will not talk to customers. I get that I was supposed to keep insurance but I was unaware, especially since XXXX took out a payment for XXXX and then they canceled it, no reason given. Before opening a new account with my new refinanced account XXXX .Automotive Credit Corp.is reporting my account as a 120 days past due in XX/XX/XXXX .W hen I made a payment in XX/XX/XXXX as instructed by Automotive Credit Corp.which t ook my balance down.Upon opening the new account XXXX that decrease is reflected on the new account.In the CRA manual in which the curr ent st atus is clearly defined as a snapshot of the account status as of their last reporting.Which was n't reported correctly or timely to the Credi t Bureaus.Automotive Credit Corp has a statutory requirement ( FCRA 623 ( a ) ( 2 ) ) to update any prior reporting so as to maintain its accuracy. On XX/XX/2020 I received 2 phone calls from XXXX at my work number ( XXXX ) XXXX and 2 calls from ( XXXX from Automotive Credit Corp ) on my cell ( XXXX ). These all occur first thing in the morning when I am working. I returned the call around XXXX on my lunch and left a VM to let them know that they are not to call my work phone number ( XXXX ) as my boss got the message and was not happy. I was given a verbal warning. On XX/XX/2020 I again received 2 calls from XXXX ( XXXX from Automotive Credit Corp ) at my work number and also 2 calls from them on my cell. I then sent them an email which I got from their website and which I asked them again not to contact me at the work number. About an hour later a friend of mine who I listed on the loan papers as a reference received a call from XXXX ( XXXX ) who told XXXX I was behind in payment and that she needed a number to reach me at. XXXX then called me and asked that I remove her information from the file. I also requested that. Now on XX/XX/2020 I again receive 2 calls on my cell phone and one at my work number which my boss was lucky enough to get. He then gave me a final written warning and explained no more personal business calls at work. I have not included the emails sent to them or the write up as it may need to be used in court and I do not wish to provide them anything until after I speak to an Attorney.

I contacted Automotive Credit Corporation in regards to a credit inquiry I did not authorize. I was transferred to XXXX XXXX XXXX XXXX whom Collections representatives are extremely rude. They pulled my XXXX report on XX/XX/XXXX without my authorization. When I asked them why they said I signed a contract back in XX/XX/XXXX which authorized them to pull my credit report whenever they feel like it and the contract has no expiration date per XXXX whom was rude. My concern since I have no contract with XXXX XXXX XXXX XXXX they pulled my credit report fraudulently. I did not give them permission on XX/XX/XXXX to pull my report. Automotive Credit Corporation is also reporting to XXXX incorrect information on a collection account. They are continuously reporting I have a XXXX balance and I have received documents that my current balance owed to them on court documents is XXXX. My employer certified a final statement on garnishment to them with the court ordered amounts. I tried to resolve the issue with them and I am getting no where. Their representatives are rude and do not seem to know what they are talking about. I would like the hard inquiry on my credit report investigated and removed. I will also like them to update my XXXX report with the current amount owed per my court documents or to settle for the said amount in my court documents which is XXXX.

Top finance has caused much confusion and I personally feel have violated my rights. An old auto loan which they have failed to provide, a certified letter to me within 5 days that I could by back after repossession, a notice within 10 days that the vehicle was sold, and also the letter of how much the car was sold for and fees acquired were never sent to me within 30 days of the repossession. Since then the account was charged off and sent to collections but it was never fully sent to anyone so no one had this debt. I was advised by top finance to Contact XXXX XXXX XXXX XXXX, and ACC, which has now aquired Top Financed. When I did I was advised I had no account. Now, I am being advised again by Top finance management and ACCXXXX XXXX XXXX XXXX that I owe a debt that no one could verify and they did not have my account. This all has caused unnecessary stress and negatively affects my credit file. I have filed a complaint with the BBB requesting the proof that TOP financed notified me of the repossession and sale of the vehicle within my signature of the intent to buy back notice acknowledging I was aware of this sale. I have not received a response. This was a breach of peace. in regards to the debt owed I never received a letter stating my debt I moved from my old apartment. the only way I found out about this debt is because I was contacted by my grandmother who lives in XXXX Ohio and she said that I was being sued I drove to XXXX to take care of it however im not sure how they even obtained her address but I live in Indiana the entire time even when the loan was originated but they're suing me in Ohio for a unverified amount of money that I was not even aware that I had the right to dispute. Automotive Credit corp is showing an inaccurate balance owed of {$4000.00}. I disputed this inaccuracies with XXXX, XXXX and XXXX. Automotive credit corp has verified and certified the furnished information is accurate. I then did my own investigation and determined that Automotive does not own this account anymore. They sold this account to XXXX and charged it off. As a result of that sale Automotive credit lawfully has to update my consumer report to {$0.00} balance. I owe no money to Automotive credit since they no longer have ownership of the account. The FCRA requires furnishers to furnish accurate infomation. The FCRA also requires Automotive credit to investigate disputes. I tried calling the listed number on my consumer report and they refuse to help me because they said they no longer hold the account. This inaccurate reporting is a violation of 15 USC 1681 also since they failed to complete their duty to update the consumer reporting agencies this is another violation and noncompliance with the FCRA. Also when i filed my dispute with the consumer reporting agencies and the dispute was forwarded to Automotive Credit they verified the inaccurate information instead of doing a reasonable investigation which is another violation of the FCRA.

Automotive Credit on account numbers # XXXX, XXXX and XXXX have responded in sync with XXXX stating that they investigated my last CFPB complaint and found all reporting to be accurate. The findings were false and clearly not even accurately looked into. It seems to be that both companies simply just stated all was correct to advoid actually looking into and addressing the incorrect reporting. A simple example of this is attached here to with the photo of my Credit report showing the automotive credit tradeline. Automotive Credit Corporation the original lender who I got the auto loan from and their lawyers/debt XXXX XXXX, XXXX & XXXX XXXX XXXX On my credit report they have on their records the wrong amount owed which is double or almost triple according to my credit report. I previously submitted disputes ask you asking for investigations into automotive credit company account # XXXX, XXXX and XXXX. Reason being I hope three accounts with them but they have reported negative payments on falsely and secondly have not reported any sort of data or update on the accounts with any of the three bureaus since XXXX. Previous complaint # XXXX response from Top Finance was ignored by whomever provided the response from their company. I requested the following documents from Top Finance : Proof a certified letter was sent to me that i signed the intent to buy by the vehicle 5 days after the vehicle was reprocessed, the notice that the vehicle was sold, and a letter of how much the vehicle was sold for including any fees.
