I had an account with AUTOMOBILE ACCEPTANCE CORP account # XXXX and the account was paid off. Since the account has been paid off, I continue to look at my credit reports from XXXX, XXXX AND XXXX XXXX and continue to note this account continues to be re-aged by the credit bureaus adjusting the charge off date/ status of the account. As a result, I have disputed this item directly with the credit bureaus XXXX, XXXX AND XXXX XXXX and each time the credit bureaus report the account is verified as ACCURATE via AUTOMOBILE ACCEPTANCE CORP. As a result, I have disputed this account directly with AUTOMOBILE ACCEPTANCE CORP via letter and via phone calls and each time, AUTOMOBILE ACCEPTANCE CORP states they are note responsible for the reporting of the account and I must dispute directly with the credit bureaus - in which I have SEVERAL times and AUTOMOBILE ACCEPTANCE CORP continues to ignore my requests. Even when I send evidence with my disputes, the credit bureaus state the account is verified as accurate via AUTOMOBILE ACCEPTANCE CORP. With the continued evidence and detailed disputes, AUTOMOBILE ACCEPTANCE CORP and XXXX , XXXX XXXX continue to verify the account as accurate. I have included the letters I have sent AUTOMOBILE ACCEPTANCE CORP with copies of the inaccurate credit reporting. I need help to ensure my rights under the FCRA is protected. According to the FCRA to avoid the illegal re-aging of this account by the credit bureaus ( inaccurately changing the date of first delinquency on a consumers account to a later date ). According to the laws of the FCRA If the consumer provides additional relevant information during the 30day period, the CRA has 15 more days to resolve the dispute. The CRA must give you all the relevant information it gets within five business days of receipt, and must promptly give you additional relevant information provided by the consumer. If you dont investigate and respond to the notification of the dispute within the specified times, the CRA must delete the disputed information from its files. In addition AUTOBILE ACCEPTANCE CORP violated my rights when it failed to action. According to the FCRA when information to a CRA on a regular basis and determine that any information you provided is inaccurate or incomplete, you must promptly notify the CRA and provide corrections or additions. This didnt happen and I demand this account be removed for FCRA violations. Even my letter to the CEO has gone unanswered. PLEASE ASSIST Me

The American Automobile Acceptance Corporation ( AAAC ) is currently reporting my consumer account between 30 and more than 120 days past due for four months to all three ( XXXX, XXXX, and XXXX ) credit reporting agencies. The resource ( a XXXX XXXX XXXX XXXX XXXX for this account has been associated with a civil litigation matter since XX/XX/XXXX. My commercial encountered a breakdown in XXXX XXXX, Arkansas and my Emergency Roadside Service dispatch a towing and wrecker service versus a certified repair mechanic who caused additional damage to my commercial vehicle. The towing and wrecker company was negligent in the mechanics repairs and performed deceptive maintenance practices in their explicit charges for the repairs ; they attempted to charge me more than {$8000.00} for two tows and a single-axle ( right rear ) repair. As a result, I was required to stay in a hotel for more than 2 1/2 month as I attempted to rectify this matter through local agencies ; but, caused me a severe financial hardship and the inability to make payments ( over {$800.00} ) on this account for four ( 4 ) months. To prevent the account from going into foreclosure and eventually repossession, I have been able to make payments on the account for the previous seven ( 7 ) months through my personal financial account. Fortunately, the Representatives of the American Automobile Acceptance Corporation have worked with me and allowed me to make payments at the end-of-the month versus on the XX/XX/XXXXof the month. However, they haven't been willing to remove the negative reporting for the four-month negative reporting ; even as I have informed them of my circumstances. In addition, the AAAC is holding a check ( more than {$3000.00} ) which still requires my signature ; and are only willing to post the check to the principle of the outstanding loan since the check was issue for repairs. In reverse, the truck is still not repaired and I would not trust any additional maintenance by the towing and wrecker company as theyre mechanics are not certified diesel mechanics ; nor is the business a certified repair facility. Yet, the truck is still not repaired I will have to transport it to a true repair facility upon completion of the litigation process. Also, AAACs four-month negative reporting is causing my inability to obtain credit which is much needed for financial support for additional attorney fees and other legal expenses.

I sent a CERTIFIED letter of dispute to Automobile Acceptance Corp. on XXXX/XXXX/2015 and demanded a validation of debt. I was asking for the proof regarding the debt that I owe and verifying it. I have a signed Receipt from Automobile Acceptance stating that they received the letter on XXXX/XXXX/2015. On XXXX XXXX, 2015 I sent another CERTIFIED letter stating I do not believe I owe what they say I owe and in accordance with the FAIR DEBT COLLECTION PRACTICES ACT, 15 USC 1692g SECTION809 ( B ) Validating Debts, that this matter is closed since they failed to respond, I assume that they were unable to validate the debt. I contacted ( XXXX ) XXXX ext XXXX or XXXX ) the collections department on XXXX/XXXX/2015 and spoke with XXXX ( front desk ) @ XXXX ; XXXX whom transferred me to XXXX and I got the voice mail, I called right back spoke with a XXXX ( front desk ) on XXXX/XXXX/2015 @ XXXX who transfer me to XXXX XXXX in collections on XXXX/XXXX/2015 @ XXXX. I explained that I needed to speak with someone in compliance regarding a debt validation that needed to be deleted from my credit report. she advise me that she did not have that authority to do so and asked me to fax over my documentations so that she could forward them to her manager whom was in a meeting a the time. I tried to fax the XXXX and the fax failed so I hand delivered them into the office located at XXXX XXXX XXXX XXXX Ga XXXX at the payment center and they were signed and received by XXXX XXXX on XXXX/XXXX/15 @ XXXX. I received a phone call from XXXX XXXX XXXX XXXX Collections manager on XXXX/XXXX/2015 XXXX that lasted 14mins and 40 secs. I advised him that the Account with his collection was not validated with in the 30 day period and I wanted this matter resolved by having it deleted ASAP. He replied by telling me that he had just sent out a letter to me yesterday in reference to my letter dated XXXX XXXX, 2015. I also advised him of the FAIR DEBT COLLECTION PRACTICE ACT, 15 USC 1692g SECTION809 ( B ). AND TOLD HIM THAT IF HE DIDNT COMPLY THAT I WAS GOING TO REPORT VIOLATIONS OF THE LAW TO MY STATE ATTORNEY GENERAL, THE FEDERAL TRADE COMMISSION AND THE XXXX. His reply was go ahead. He later said he would get back with me on Monday XXXX/XXXX/2015 after he spoke with someone to see if I was right.

I have XXXX car loans through Automobile Acceptance.I am still paying for the Azera. But the loan for the Town and Country was almost paid in full when I needed the repairs done.I had paid the car loan down to approx {$600.00} and the car would be completely paid for.I had repairs done on my car in XX/XX/XXXX-XX/XX/XXXX. The cost was approx {$800.00}. I had the work done at XXXX. The vehicle loan is through Automobile Acceptance and XXXX works with them. You make your car payments, car repair bill, etc to them. I was told by AutoTune that I am to pay {$140.00} per month and there was no mention of interest on the repair bill. It should also be noted that this is the second time I have my car repaired and paid to Automobile Acceptance and there was n't any interest charged. The gentleman at XXXX never said anything about interest charged on the repair bill. Like I said this is the second time I have had my car repaired this way. After steadily getting all the calls regarding the repair bill I told them that my repair bill should be paid for by now. When I looked at the bill I saw that interest was being charged to the repair bill. When I went to them they combined the repair bill with the rest of the balance owed on the car. That 's when I discovered that I was being charged interest on the repair bill. I am submitting the payment history and a copy of the contract. Please help. I am on XXXX and my husband is the sole bread winner as I ca n't work. So our money is limited and we count every dime. It 's not fair that I am being charged interest on a repair bill. I am getting phone call after phone call regarding my payment for the repairs. I get calls XXXX-XXXX times per day. I informed the company that my bill is to be paid once per month. When I started paying I would pay every other Friday, to get the loan down, and I figured it was a good way to pay since I had to pay for the Azera and the Town and Country. I called Automobile Acceptance bec ause I am trying to fix my previous mistakes from 5 years ago. I am in the process of getting a financial license that requires me to explain past financial mistakes. It requires me to show proof that a debt has been paid, proof that a payment plan has been established and t hat 3 current pay ments have been made, or prove the debt is not mine and dispute with creditor and credit agency. I called Automobile Acceptance aft er 5 years of not dealing with them. The account shows as a repossession, which it was, and I have not received a call or a piece of mail since the repossession. I have had the same phone number the entire time, since XXXX . I called them to discuss a payment arrangement and was offered an arrangement of 60 % of the balance for {$120.00} a month, or 50 % of balance for {$150.00} a month. I asked if there was anyway to do a weekly arrangement of {$40.00} a week so I can show that I have m ade 3 payme nts to the GA Dept of Banking and Finance so I can proceed with my life and future employment endeavors. I was the n accused of wanting to pay jus t 3 payments an d then not pay them again. I never once said that. They said that they could not offer weekly arrangements. I was then sent to a supervisor ... XXXX , the Legal Manager. After much back and forth, she put me on hold and said I could pay {$50.00} a week, but it would be on the entire balance of {$4600.00}. They have not attempted to contact me for 5 years. I contacted them to try to take care of the deficiency balance. I never even received a letter stating the remaining balance after the sale of the vehicle. I want to work something out with this company, but it just reminded me as to why I regretted buying the vehicle in the first place. They prey on people in need and over price their cars and then charge you a ridiculous interest rate on top of the overpriced car. Its my fault that I did it, but I am trying to take care of it.

I am writing to dispute the Account or File Number being charged as BAD DEBT/CHARGE OFF AND OR COLLECTIONS that appears on all 3 of my Credit Reports. I have circled the information as it appears on my credit report for a visual that this account is being reported inaccurately. I previously was told by a representative at Automobile Acceptance that the accounts would be updated with the Credit Bureaus to reflect accurate information. That information has not been updated on my credit report correctly it has been reported as BAD DEBT/CHARGE OFF AND OR COLLECTIONS which is not TRUE/ACCURATE reporting of this account to the Credit Bureaus. Im having a hard time comprehending why this account is still being reported to the Credit Bureaus when the account was Paid in Full on XX/XX/XXXX. Per the Fair Credit Reporting Act I have the right to dispute all inaccurate information contained in my file. Therefore I will need documentation on a Company Letter Head that the account will be deleted from my report or further action will be taken. Enclosed are copies of my credit report from XXXX, XXXX & XXXX. I have circled the information that is INACCURATE. I have also enclosed letters from Automobile Acceptance that states that the account should be 1 ) Paid or Closed Account/XXXX Balance 2 ) Payment Rating of Current. To resolve the problem, I am requesting that the account be removed from my credit report because this is causing major harm to my credit. This can be done and will be done because this matter should have been resolved when I received the letter from the Employee XXXX XXXX dated XX/XX/XXXX stating that the account was Paid in Full ; as well as a letter from Employee XXXX XXXX dated XX/XX/XXXXstating that the account would be updated with the Credit Bureaus. On XX/XX/XXXX, I called and spoke with A rep from Auto Acceptance trying to get clearance on a supposedly debt I have and a repo on my credit report that has me as a joint co owner. My ex husband XXXX XXXX had that loan and I did not authorize no one to list me as the co signer just because we were married at the time. I was only to be a reference. on XX/XX/2020 I spoke with a young lady name XXXX from auto acceptance that stated she couldnt find me in her system and then I told her it has me as cosignor and i gave her my husband name XXXX XXXX and she found it under his name. I believe they are trying to hold me responsible for his debt since i called them to clear my name and they couldnt prove to me that I owe this debt, then she said it must be in an old system that she cant access when I asked for paperwork again, so then she said to call XXXX and I asked who are they and she said to just put in my ss # and it will direct me to the person that supposedly has that information. I was told to call XXXX press option 1, well I did that and I was transferred to mrs XXXX and for 2 days straight I got no answer and I left 8 messages between co workers and voicemail and i even put in 2 request for call backs. I called back and asked if I can speak with someone else and they said no. I asked does this person still work there and they said yes and they will send her an email to call me and still nothing as of today. I spoke with XXXX and they refuse to help immediately because the account is still under dispute until XX/XX/2020 .I spoke with XXXX XXXX XXXX XX/XX/2020 from XXXX i explained i couldnt verify this with the company and its affecting me getting a mortgage. He still refused to acknowledge FCRA, FDCPA & CFPB guide lines. I believe this is a scam or extortion on my credit report because no one can provide me any information on this matter or show my signature and drivers license with the original contract.

I have an account with XXXX XXXX ( Automobile Acceptance Corp. ). I got the loan in XX/XX/XXXX and have been paying on time until i became sick in XX/XX/XXXX until XX/XX/XXXX where I filed a insurance claim to pay for those months because I was out of work. I then made a payment n XX/XX/XXXX of about {$300.00} and something to bring my account to a current status. Beginning XX/XX/XXXX i have received almost 3 calls per week not including the calls that were made to my job for payment after I sated to them that I wanted to pay off my account at the end of this month. I requested a payoff online on Sunday XX/XX/XXXX. I spoke to a representative on Monday when I received another call for payment verbally and was not given one but a date to pay before collections which was XX/XX/XXXX I stated to them once again that i needed a payoff and that i didn't get paid until the XX/XX/XXXX, no help, no progress. after hanging up with them I received a corresponding email to my pay off request that stated that I have until XX/XX/XXXX to pay the amount in full. On today XX/XX/XXXX i received a call once again asking for payment. I then stated to " XXXX '' that i did receive a payoff payment date and that I had to the XXXX to pay it off and that I was gon na pay it by tomorrow XX/XX/XXXX because that when I would have the funds and that there is nothing i can do but wait until my check clears what more does she want me to do?! She then tried to tell me that that is not what that means and she stated i need to make a payment, I didn't like the tone of her voice so i told her she would get it tomorrow, have a good day and hung up. This is my 2nd loan with them and i just don't understand how they could harass a person that's doing what they are supposed to do i'm not months behind the month isn't even over and they are hounding me.

Under what authority, statute, or law does Automobile Acceptance have to share and or furnish my non public, private, personal, identifiable financial information? Automobile Acceptance has been put on notice about sharing my private, personal, non-public identifying financial information, and transactions and experiences to third parties, which include but may not be limited all consumer reporting agencies. I was never received full disclosure regarding my option to opt of of my non public personal information being shared and that was my right. Automobile Acceptance assumed they had my consent and they did NOT! I have revoked, canceled, and rescinded all presumed consent retroactively to date. Automobile Acceptance referred to 15 U.S. Code 6802 section d, that states limitations of sharing the account number for marketing purposes. However, being that I was never given the option to opt out initially prior to my information being shared, that code does not even apply. Pursuant to 15 U.S. Code 6802b I was never given the opportunity to opt out of having my non public personal information shared with third party affiliates, or explained how I could exercise my right to the non-disclosure of my information being shared. I have a right to privacy and full disclosure, and I was not provided either with Automobile Acceptance. Automobile Acceptance also stated they have the right to report consumers account information, which is their non public personal information, but under whose AUTHORITY? Federal law states the rights of privacy I have as a consumer and federal law supersedes any policies Automobile Acceptance may have. This information that is being furnished to the consumer reporting agencies is harming and injuring me.

On XX/XX/XXXX , I purchased a vehicle a XXXX XXXX XXXX from XXXX of Georgia. On XX/XX/XXXX , I found out the vehicle was no good meaning the motor and catalytic conve rter was gone out. I took the car back o n XX/XX/XXXX less than 24 hours later after purchase also being told at the time I sign the contract that I had 72 hours to return the car if I decide I did not want it. When you bring the vehicle history up on this vehicle connected to VIN XXXX may have been recalled. Check full report for more information vin # XXXX ... this comes up. I was told by XXXX who is now working for XXXX XXXX XXXX in XXXX XXXX , GA the vehicle was sold and they had already receive a check for the vehicle. I ask who was my finance company and she replied Automobile Acceptance. On XX/XX/XXXX , I went to the finance company in XXXX , GA and told them that I no longer wanted the car and that I have 72 hours to bring it back and I was well within the 3 days and the credit manager replied they had already electronically sent XXXX check and conveniently XXXX closed down everywhere. The credit manager said it would be a repossession if I return the car so she convince me to keep the car. It became very hard to maintain the car and the payments so I voluntarily gave the car back. The car has been charged off on my credit and now Automobile Acceptance are suing me for almost $ 15k with 12 % interest. I was initially tried to be served in XXXX county XXXX XXXX , Ga but when I went to XXXX , GA Magistrate court and was the served with this civil suit, in which ; I find illegal and unethical. I will upload s upporting documents that will show the vehicle loan was charged off.

On XX/XX/XXXX I mailed a notice of collection dispute to XXXX and XXXX reporting agencies regarding fraudelent information reported to them by Automobile Acceptance. XXXX did not return the Return Reciept I mailed to them, as required by the US Postal Service- a paid service. However, they noted on my credit report the following note " Between XX/XX/XXXX and XX/XX/XXXX the following remark was removed from this account : Consumer disputes - revinstigation in progress. '' At the same time they also added a note that the account I disputed has been updated to " Charged off acccount, fixed rate ''. XXXX. ) XXXX failed to contact me with information indicating the false account has been successfully proven by the creditor. XXXX. ) As I shared with XXXX, the creditor Automobile Acceptance has been submitting late payment information for the past three years. All the while knowing the vehicle has not been in my possession since XX/XX/XXXX. There is a note on the report that indicates the last last payment was XX/XX/XXXX - this is false- the vehicle was not in possession. Further, why is XXXX reporting late payments as of XX/XX/XXXX while noting the last late payment was XX/XX/XXXX? XXXX. ) Further, the creditor is claiming a loan amount of {$9700.00} due to them. This is also false as the loan amount was not for that amount. I DO NOT owe this Automobile Acceptance {$9700.00}. XXXX. ) Due to this false reporting on the part of the creditor, I requested the account be completely removed from my credit report. XXXX has closed the investigation, per notes on my report without completing the investigation nor removing the fraudalent account.

I recently learned that consumers have privacy rights secured to them under the Gramm Leach Bliley Act 15 USC 6802 and the Fair Credit Reporting Act 15 USC 1681a ( d ) ( 2 ) ( A ), that requires any financial institution desiring to disclose/share and or furnish private, nonpublic, personal identifiable financial account information, transactions and experiences about any customer and or consumer, must first provide proper disclosure regarding its intent to do so, as well as give the consumer an opportunity to opt opt. AUTOMOBILE ACCEPTANCE are hereby notified of the following : ANY and ALL consent assumed or obtained by AUTOMOBILE ACCEPTANCE from the consumer, ( XXXX XXXX ) that granted it permission to disclose, share, or furnish the private, personal, nonpublic, identifiable financial information. transactions and experiences, whether it was expressed or implied is now REVOKED, TERMINATED, CANCELED, and RESCINDED retroactively to the date that such consent was presumed to be obtained, to-date. I have made numerous attempts to clear this up directly with the credit reporting agency ( XXXX specifically ) and they keep saying that an AGENT at Automobile Acceptance XXXX XXXX XXXX XXXX, Georgia XXXX has verified the said account. I have been a victim of identity theft and have supplied all the proper documents. AUTOMOBILE ACCEPTANCE ACCOUNT # XXXX {$5800.00} does not belong to me ( I do not owe automobile acceptance the said amount, and I have asked in order to validate the debt, I would like a copy of the original contract containing my wet ink signature, the name of the agent who verified the debt and who has first hand knowledge of the said debt. In Regards to : UNFINISHED BUSINESS XXXX XXXX XXXX non-adverse, non-belligerent, non-combatant party, secure creditor with power of attorney general, and Executrix on behalf of the XXXX XXXX XXXX ESTATE, is in possession of your recent voluntary submission of evidentiary documents also known as a credit report. Furthermore, in order for XXXX XXXX XXXX to validate the debt, please provide verification through audit certification of debt entry in accordance with XXXX, XXXX, in accordance with XXXX XXXX accord and XXXX conventions. I am currently making payments to Automobile Acceptance Corporation. After falling 31 days behind on my payments the unit was placed out for repo. Prior to this occurring their represents called my phone 3 times a day even after I told them when I would be able to make my payment. They even sent emails to a family member regarding my loan They called after I made arrangements. They also contacted my relatives everyday. After the vehicle was place out for repo, a representative contacted my cousin and refused to identify himself. He made threatening statements which included that Automobile Acceptance Corporation is seeking a warrant for my arrest.
