This company Atlantic Recovery services called my cell phone out of no where twice in the past two days, stating I need to call them as they have my social and legal document yet, I never received anything in writing from them. Additionally, they had called someone I knew and began with threats with my credit. I do not owe any debt, never signed any agreement and want them to cease and desist all communication as I have no idea who they are. Additionally, not only did they threaten my credit with someone who wouldn't be involved in the situation but also they are calling to speak with XXXX XXXX, and a XXXX XXXX XXXX left a voicemail statement to call XXXX because they have sensitive documents with my name ( My name is XXXX XXXX ) and that they will be contacting my work to verify my assets and my property which is none of their business especially since I have no idea who they are. To be threatened in such a manner is infringing upon my rights and is actually breaking Fair Debt Practices Act and I will seek legal council. They have broken the following laws : 804. Acquisition of location information ( 3 ) not communicate with any such person more than once unless requested to do so by such person or unless the debt collector reasonably believes that the earlier response of such person is erroneous or incomplete and that such person now has correct or complete location information ; 805. Communication in connection with debt collection ( b ) Communication with third parties Except as provided in section 1692b of this title, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector. 806. Harassment or abuse A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section : ( 1 ) The use or threat of use of violence or other criminal means to harm the physical person, reputation, or property of any person. ( 2 ) The use of obscene or profane language or language the natural consequence of which is to abuse the hearer or reader. ( 3 ) The publication of a list of consumers who allegedly refuse to pay debts, except to a consumer reporting agency or to persons meeting the requirements of section 1681a ( f ) or 1681b ( 3 ) 1 of this title. ( 4 ) The advertisement for sale of any debt to coerce payment of the debt. ( 5 ) Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number. ( 6 ) Except as provided in section 1692b of this title, the placement of telephone calls without meaningful disclosure of the caller 's identity. 15 USC 1692e 808. Unfair practices A debt collector may not use unfair or unconscionable means to collect or attempt to collect any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section : ( 1 ) The collection of any amount ( including any interest, fee, charge, or expense incidental to the principal obligation ) unless such amount is expressly authorized by the agreement creating the debt or permitted by law. ( 2 ) The acceptance by a debt collector from any person of a check or other payment instrument postdated by more than five days unless such person is notified in writing of the debt collector 's intent to deposit such check or instrument not more than ten nor less than three business days prior to such deposit. ( 3 ) The solicitation by a debt collector of any postdated check or other postdated payment instrument for the purpose of threatening or instituting criminal prosecution. ( 4 ) Depositing or threatening to deposit any postdated check or other postdated payment instrument prior to the date on such check or instrument. ( 5 ) Causing charges to be made to any person for communications by concealment of the true purpose of the communication. Such charges include, but are not limited to, collect telephone calls and telegram fees. ( 6 ) Taking or threatening to take any nonjudicial action to effect dispossession or disablement of property if -- ( A ) there is no present right to possession of the property claimed as collateral through an enforceable security interest ; ( B ) there is no present intention to take possession of the property ; or ( C ) the property is exempt by law from such dispossession or disablement. ( 7 ) Communicating with a consumer regarding a debt by post card. ( 8 ) Using any language or symbol, other than the debt collector 's address, on any envelope when communicating with a consumer by use of the mails or by telegram, except that a debt collector may use his business name if such name does not indicate that he is in the debt collection business. 15 USC 1692g 809. Validation of debts ( a ) Notice of debt ; contents Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing -- ( 1 ) the amount of the debt ; ( 2 ) the name of the creditor to whom the debt is owed ; ( 3 ) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector ; ( 4 ) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector ; and ( 5 ) a statement that, upon the consumer 's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor. ( b ) Disputed debts If the consumer notifies the debt collector in writing within the thirty-day period described in subsection ( a ) of this section that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or a copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. Collection activities and communications that do not otherwise violate this subchapter may continue during the 30-day period referred to in subsection ( a ) unless the consumer has notified the debt collector in writing that the debt, or any portion of the debt, is disputed or that the consumer requests the name and address of the original creditor. Any collection activities and communication during the 30-day period may not overshadow or be inconsistent with the disclosure of the consumers right to dispute the debt or request the name and address of the original creditor. ( c ) Admission of liability The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer. ( d ) Legal pleadings A communication in the form of a formal pleading in a civil action shall not be treated as an initial communication for purposes of subsection ( a ). ( e ) Notice provisions The sending or delivery of any form or notice which does not relate to the collection of a debt and is expressly required by title 26, title V of Gramm-Leach-Bliley Act [ 15 U.S.C. 6801 et seq. ], or any provision of Federal or State law relating to notice of data security breach or privacy, or any regulation prescribed under any such provision of law, shall not be treated as an initial communication in connection with debt collection for purposes of this section. 15 USC 1692h

I originally spoke with Atlantic Recovery Solutions back in XXXX regarding my account with XXXX XXXX ( account number XXXX ). The agent name was XXXX and he advised if I did n't get payment set up on my account I was going to get sued. I advised I would set up payment and would call in XX/XX/XXXX to make my payment. When I spoke with an agent on XX/XX/XXXX he stated that my payment did n't go through and he needed to know what happened with it. I stated I was set up to call in each month to make my payment. He stated that it would be unacceptable to do that due to their client requires that I set up auto payments. I advised I was uncomfortable with auto payments and he stated he would n't accept my payment then and would mark me up as a refusal to pay. I advised I was n't refusing to pay and need to make payment due to I was being threatened with having a lawsuit filed against me. He transferred me to a manager who advised that I had to have my payment info set up on file per their client and would need auto payments. I asked if I could call my payment in every month and he stated no but they would be able to reach out to me to make sure it was ok to run my payment first. I was comfortable with this. On XX/XX/XXXX, while I was checking my phone I noticed that Atlantic Recovery Solutions had n't gave me a call so I was about to call them but decided to check my back account first and noticed they ran my payment for {$50.00} but did n't reach out to me as they stated they would first. I gave them a call to see why I did n't receive the call as the supervisor stated and the supervisor I spoke with told me that is not their policy and my payments would automatically run. I advised her that I would prefer my payment information to be deleted and I would call in my payments monthly. She then advised me that she would mark my account up as a refusal to pay and send it back to their client. I advised I 'm not refusing to pay and I will give them a call in XXXX to make my payment. She told me they will not have my account as I 'm refusing to pay in which I then asked to speak with her manager. I called Atlantic Recovery Solutions and spoke with a rep named XXXX. I explained my situation to him that I was n't refusing to pay but did n't want the auto pay on file and I asked will they still have my account in XXXX when I call to make my payment. He stated he did n't know, then I was transferred to a manager named XXXX XXXX. XXXX XXXX advised me that since my account has been open since XXXX their group of attorney 's from Ocmac were waiting to file a lawsuit against me and once it was filed the bill will be over {$7000.00} and they could take my car, garnish my wages, and other assets and if I did n't have these assets available then I will be in big trouble cause I 'm breaking a court order. I asked what court did they file the lawsuit in but he did n't answer. He then proceeded to tell me that I needed to grow up and act like an adult that is over 18 years of age and they were not going call me and that payment {$50.00} a month on a {$2000.00} balance was ridiculous. I tried to tell him to please not talk down to me but he continued to talk over me. He told me that if I did n't have the auto pay that collections will continue on my account and they will call me everyday until I have the auto pay set up. I stated to him hold up my payment is not due until next month so do not call me until then. He stated they could call everyday if they wanted to since I was refusing to have the payments automatically so I stated to not call me and I would call them. He stated he would notify the client of my refusal to pay and wished me luck. I said I 'm not refusing to pay and I guess I should contact the Indiana Attorney General. He then hung up on me. I ended up calling back and telling them to take the payment for {$50.00} on the XXXX of each month that way it will give me time to call if I needed to pay with a different account if the money is not there. What I 'm scared of is if I do not have these auto payments set up this company will tell their creditor that it 's ok to sue me. All of my calls with Atlantic Recovery Solutions have been very abusive and they are extremely rude. I do n't think it 's right that they are allowed to threaten me like this and I 'm afraid that if I do n't do the auto payments they will try to take my car or come after my bank account. They state the bill I owe is for a student loan but it 's not, it 's actually money that is owed to the school due to apparently when I was there I was supposed to be on a payment plan to cover the costs of my tuition since my financial aid did n't cover the full cost of the school. It 's a bill that was an over site on my end which I agree I owe but I should n't be threatened to make a certain type of payment plan. Hopefully you can help me with this. Thank you so much.

This complaint is about Atlantic Recovery Solutions , LLC ( https : //www.atlanticrecoverysolutions.com ). They are harassing me, my husband, and other family members over a supposed " debt '' we do not owe/does not exist. They call me at all hours, on weekends, and have begun texting me despite me making it clear we do not owe this debt and asking them to stop. We requested proof of the debt and they sent a contract for a company that no longer exists with no indication that we owe the amount they are claiming. To make a long story short, we installed an XXXX alarm system in a rented home in XXXX using a company called XXXX. We paid for all installed equipment in full at the time of installation. When we moved out of the home, we cancelled the contract and were under no further obligation to XXXX as per our contract. We have received zero communication from anyone regarding this account for many years. Suddenly a few weeks ago, Atlantic Recovery Solutions ( ARS ) began calling me incessantly claiming I owed {$1300.00} or so for " the XXXX alarm system ''. I was baffled and completely confused, as we do not owe any money for this years-old system. The man who I first spoke with at ARS, XXXX XXXX, was extremely rude and threatening with his choice of language when speaking with me. He called me " ridiculous '' and threatened legal action within two weeks if I didn't pay the ~ {$1300.00} on the spot. I said I was confused, did not believe we owed any money and asked for proof of the debt. He immediately and very rudely stated because I asked for proof that he would " tell his client I was being uncooperative '' and hung up on me. I was in no way being uncooperative ; ARS calling me and demanding thousands of dollars without proof is insane ; me asking for proof of a contract or any debt is completely reasonable and cooperative. We have no intention of not paying a legitimate debt that we owe if we indeed owe it. Since that first point of contact, ARS has not provided any proof of the debt. They have called and texted on a near-daily basis both me, my husband, and members of my extended family whose numbers were provided as part of our emergency contact list when we installed the XXXX system XXXX Thisis predatory, abusive, and illegal behavior. My husband called ARS on XX/XX/XXXX to demand they cease calling me. XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Their repeated and incessant cloaked/spoofed calls from different numbers were causing me a high amount of stress. My husband demanded they send proof of the debt and to stop calling me due to my condition. ARS sent him an email containing 1 ) a demand for payment letter from them, which they referred to as a " contract '' ( it isn't ), 2 ) our installation agreement with XXXX for our XXXX system, which shows no debt owed, and that we actually paid for the equipment in full at the time of the installation. What they sent from XXXX is more like a receipt and is attached. You can clearly see there is nothing about owing the amount ARS is claiming, nor any contract length that would accrue such a number over time. It makes no sense. Further, 1 ) XXXX is a company that no longer exists. We attempted to contact them to resolve this and discuss it yesterday ( XX/XX/XXXX ) and they are out of business. We do not and have never had any agreement with ARS. 2 ) ARS has continued to call me on a daily basis from spoofed numbers including after-hours and on the weekend, despite repeated demands that they stop doing this. They threaten legal action and other similar things. If you would like a list of calls, numbers, and times of calls/texts from them, I am happy to provide it via our phone provider.

received a call from XXXX -- it only came up on caller id as XXXX Fl, and I was getting ready to leave the house I almost did not answer. However, the message started out saying this message was for ... ... ( my name ) and they currently had an urgent matter with my name and social security number attached to it so at this point it sounded important so I picked up the phone ... ... ... ..the VERY nasty woman told me she was from ARS - and I was like yes, so who are you? She again said ARS - I told her I had no idea what she was talking about and had never heard of ARS - then she proceeded to inform me that she was from a collection agency. At this point I intercepted to advise her that I have been on XXXX since XXXX of XXXX and that the last time I personally was even able to make any payment on any credit card was in XXXX and it really did not matter what card what she was calling me about as the statute of limitations in the state of Florida was 4 yrs and even if they had a signed application then it was 5 yrs so either way, time barred. She continued to argue with me that how would I know anything about statutes. I informed her that prior to my becoming XXXX I was a collector and not with sub prime third party bottom feeder but with XXXX XXXX XXXX and I knew the laws inside and out. She then yelled at me enuf so that I had to move my phone away from my ear " so you think because you are XXXX you do n't have to pay a bill? '' I replied back to her ... ... ... .that would be correct because 1 ) the statute of limitations for collecting was over ... ... ... 2 ) up until I answered the phone, I never even received any communication from ARS and had not a clue who they were and 3 ) she could not touch my social security XXXX income, I own nothing else except for the clothes on my back - only thing my name is on at all is our Florida homestead and given our ages, I feel confident XXXX will actually still " own '' it by the time we die ... ... ... so yes ... ... ..I did not have to pay the bill - thru out all of this, the rep from ARS still DID not tell me who she was even collecting for - this is a violation of the FDCPA as was her threatening tone of voice ... ... ..if I had used that tone and was being monitored, I would have been terminated immediately from XXXX. This was not the first time the number called, but previously no messages had been left ... ... ... .also her message was certainly misleading and indicated that this was some type of possible social security matter, government matter, etc as she referred to a file on her desk with my name and social security attached to it, it sounded as though she was from law enforcement.

ARS has been harassing me for months. Prior to the harassing phone calls they never mailed me any information regarding any alleged debt that they are trying to collect. I am confident that by them not sending me an initial letter communication for me to dispute any alleged debt that the debt they are trying to collect is not valid. In my letter to XXXX, I requested ARS to send me any documentation ( validation ) that they have that I owe a debt, documentation that the alleged debt is to ARS, & a copy of a contract I have with ARS signed by me that I have an alleged debt for any unpaid services that they provided for me. As of todays date ARS never complied with my request. I first received a phone call from ARS on XX/XX/XXXX at XXXX XXXX and another phone call from ARS on XX/XX/XXXX at XXXX XXXX. ARS masked their phone number by using the number XXXX. On or about XX/XX/XXXX I sent ARS a letter advising them & demanding them to cease and desist from any attempt of future contact with me. Unfortunately, I continued to get phone calls from ARS ON XX/XX/XXXX XXXX XXXX, XX/XX/XXXX XXXX XXXX, XX/XX/XXXX XXXX XXXX, XXXX XX/XX/XXXX XXXX XXXX, & XX/XX/XXXX at XXXX XXXX. again masking their # by using XXXX. The Fair Debt Collection Practices Act, or FDCPA, was passed in XXXX to protect consumers from being harassed by debt collectors. ARS is knowingly and willingly violating my rights granted to me by the FDCPA. ARS has called me at inconvenient times, such as before XXXX XXXX and after XXXX XXXX in my time zone, ignoring me when i asked them to cease & desist after they didn't provide me with my requested information ( mentioned in the 1st paragraph ). Furthermore, ARS is knowingly & willingly violating my rights granted to me by the " Truthin Caller ID act ''. FCC rules prohibit anyone from transmitting misleading or inaccurate caller ID information with the intent to defraud or obtain anything of value. ARS has and continues to display false representation & communication tactics. Based on ARS website they are located is located at XXXX XXXX XXXX # XXXX, XXXX, NY XXXX. The reason they mask their phone number and show a XXXX area code is because XXXX is the XXXX area code and my cell number is XXXX to try and deceive me in answering the phone. ARS is not located in XXXX! XXXX XXXX, Settlement Director with Atlantic Recovery Solutions, LLC contacted my father via his cell phone and told him that ARS was trying to collect on a debt that I have. XXXX XXXX proceeded to email my father a document to his personal email stating that they are trying to collect a debt on behalf of XXXX. Per the FDCPA, it is illegal for a debt collector to share any information regarding a debt with a XXXX party other than the conusmer, their spouse or an attorney. My father called me and forwarded me the document that XXXX XXXX had emailed him. I immediately checked my credit report and there is no reporting of this debt with any of the XXXX credit bureau agencies. I attempted to contact XXXX XXXX to obtain more information at XXXX x XXXX and spoke with XXXX XXXX, XXXX of the account representatives, she then transferred me to XXXX XXXX at XXXX who states that she is their compliance officer. I gave XXXX XXXX my name and she asked for me to confirm my father 's phone number and his social security number. I told her that I would not give her that information. She confirmed the last XXXX digits of my SS # and proceeded to tell me that XXXX has been trying to collect a debt for unpaid overdraft fees on an account that has been inactive for XXXX years. She indicated that XXXX, the original creditor, another collection agency by the name of XXXX XXXX XXXX and finally Atlantic Recovery Solutions have been trying to contact me for XXXX years to recover this debt. I asked how they had tried to contact me and she told me they had tried to call and had sent numerous letters. I asked for the numbers that they tried to reach me-they had a list of XXXX phone numbers that they had attempted to use to contact me-only XXXX of them belonged to me, the rest were for friends and family members. She indicated that there had been numerous letters sent to me trying to collect the debt. I have not received any letters from XXXX, XXXX XXXX XXXX or Atlantic Recovery Solutions even though they have my address on record. I told her that her organization was in violation of the FDCPA by sharing my information not only over the phone with a third party but also electronically. I also requested that a letter of validation regarding the debt be sent to me.

In XXXX of XXXX I was contacted by Atlantic Recovery Solutions to settle a XXXX XXXX credit card account. I was advised I could make a pay agreement and when the account is paid in full it would be removed from all credit reporting agencies. The account was paid and settled in XX/XX/XXXX. It is still reporting on my credit report. I have disputed this many times as paid and it keeps coming back verified and never paid. I connected Atlantic Recovery solutions in XX/XX/XXXX ( XXXX ) advised would follow up with all 3 reporting agencies to have this removed. Then I was emailed another letter confirming debt was paid for my records. The following month in early XXXX still reporting on my credit report. I called all 3 reporting agencies filed another dispute gave them contact information ( name and phone number of direct person to contact ) sent them the PAID letter. On XX/XX/XXXX another letter from reporting agencies stating this is verified as accurate and it has not been paid. Another call ( XX/XX/XXXX ) to Atlantic Recovery Solutions ( XXXX ) spoke with " supervisor XXXX '' advised he is not sure as to why its reporting not being paid all his records show account is paid and it has correct account number listed. " XXXX '' then gave me the number to his " client to call and see if they have been contacted regarding any disputes. And they will contact reporting agencies to have it removed. Number given to me by " XXXX '' XXXX XXXX XXXX XXXX. Called XXXX XXXX XXXX and was not able to speak with anyone using the website on their voice-mail obtained number XXXX. Same message on previous line they are busy and call another day or go to website www.diversefunfing.com and someone will get back with me. Did not see were I am able to leave message to dispute a problem on website. This has been reporting incorrect on my credit for 2yrs. Contact anyone and having paid letter is getting me nowhere. I am moving in XX/XX/XXXX and I want this removed to assist in boosting my credit for a home purchase. XXXX

This morning I received a message at my place of employment ( XXXX ) XXXX from XXXX XXXX supervisor from Atlantic Recovery Solutions letting me know that I havent made a payment since XX/XX/2019. And he wanted me to call him back to make a payment arrangement before XX/XX/2019 or else he was giving back the account to his client so that they file suit against me. Scared to death, which for the record this is the THIRD notification to this company advising them that I am NOT allowed to receive personal phone calls at work. I called XXXX back and let him know please dont call my job that he needs to call my personal cell number and I asked for my account number so that I can make a payment online he said no he wasnt giving it to me that I needed to pay off the balance of {$500.00} I told him no that I dont have that and that I will make a payment online he kept telling no about account number when I asked for it and that he was making a note that I refused to make a payment, and threatened me that the next step was wage garnishment. I let him know that I am not refusing I am asking for my account number and he wont give it to me. I also let him know he cant do that as along as I make a payment. He told me I dont know this work " honey '' and I told yes I do he hung up on me. I called him back asking for my account number he wouldnt give to me that I have to make a payment over the phone I let him know I dont give my credit card information over the phone but that I will do it online he said no because back in XX/XX/2019 I suppose to make a payment online and I didnt I let him know that I honestly got side track do to me being at work but that I have everything ready to go on my computer screen I just need my account number he once again said no that I have to pay the full amount of XXXX right now over the phone. I told I dont have that but I will make a payment online and he said no and hung up. I have never felt more threatened, disrespected, and intimidated in my entire life.

Hello, On XX/XX/XXXX, I received 2 phone calls and 2 texts. The 2 texts stated that " documentation has been received including my name and SSN ''. The same day XXXX received a voicemail at XXXX XXXX from a guy by the name of XXXX ( pronounced Read-in ), phone number XXXX, stating that he was an Identity Monitoring Specialist from some so-called " Benefits Service Center '' and he had information that needed verification and to return his call. I did not return this call due to it sounding like a scam. On XX/XX/XXXX, XXXX XXXX from " ARS '' at XXXX XXXX called from XXXX. She claims to have my credit report in front of her stating that I owe money to an account already paid. I have looked at my XXXX, XXXX, and XXXX to prove that the account mentioned was not on the reports. When I asked for a letter VIA mail ( rather it be USPS, XXXX, or XXXX ) she responded that letters have been sent and I had 30 days to pay and it would be a waste of time to send a letter. She told me to provide proof that it was paid off. To my understanding, I believed that the debt collector was obligated to provide and/ or have all required information regarding the said account. She failed to respect my request so in return I respectfully told XXXX that I paid the account and I am not paying something twice. Not to mention she was very rude towards the end of the call telling me " is it really that hard to get proof from 13 months ago ''? She told me goodbye and hung the phone up before I could complete my portion of the conversation. Another company told me the account was closed back in XXXX meanwhile this company is stating its been closed for 13 months. I will not be another victim of a scam and will ignore all other communications with this company. The company they state I owe will not allow new lines of credit if one owes a debt. I've made future purchases with this particular company and would only be possible if past debts have been settle/ paid.

I have got many calls from Atlantic Recovery Solutions ( ARS ) staff IRA XXXX regarding a fake debt. I have communicated with both XXXX and XXXX. No such claimed " {$1200.00} transaction '' to another party ever occurred at XXXX, neither was XXXX rejected by XXXX. ( this was also claimed by Mr. XXXX that my banked notified me the return of ACH by XXXX in XXXX of XXXX ) I went to the bank in person and I got the transaction statements for the month of XXXX to XXXX. None of them have shown any rejected ACH. See attached XXXX statement not showing such transaction in the history and no ACH rejection in XXXX. See attached statement from XXXX for the month XXXX, XXXX, XXXX and XXXX. MR. XXXX claimed that my XXXX account was suspended due to the non-payment. I logged on without a problem. My XXXX account history shows no transactions since XXXX. When I called XXXX to report ARS, I found out that ARS is faking to be XXXX member using a fake certification # on their website. XXXX XXXX XXXX has confirmed in the email that they can not take actions towards their fraud debt collection due to the fact that ARS is not a member. Please see attached email communication. When I called ARS to question their validation of debt process. The staff said they " bought '' debt from XXXX XXXX XXXX which is another made up company with fake phone #. See attached XXXX search of the company as well as their fake phone #. I have statements from both XXXX and XXXX to prove that they have fabricated this " debt '' And they illegally bought my SS #, DOB, old and new accurate address. I had to freeze my credit through XXXX XXXX. The staff, IRA XXXX, threaten to ruin my credit if I didnt pay at least {$800.00} by the end of day on XXXX. I have been getting obsessive phone calls and texts via a company called ARS. I previously thought it was ARS XXXX, which is why I created my last report- but turns out it was for the incorrect " ARS. '' I called back this ARS who was contacting me and asked for them to give me more data about their company. This was on XX/XX/XXXX. I was told that this " ARS '' is in New York ( which didn't match the address I had for ARS XXXX - hence the incorrect report for them ). This company has been calling and texting me from numbers associated with Oregon and New York. I finally discovered they are Atlantic Recovery Solutions " ARS. '' On XX/XX/XXXX I was emailed by XXXX XXXX a one page copy of what was a collection attempt. I emailed back a document asking for further verification of this debt. This is debt is not on any of my credit reports. I did not get an email saying the email bounced back, so for all intents and purposes, they received it. I still got multiple texts and calls from them. One call about a week later ( toward the end of XXXX ), I picked up the phone and told the woman on the phone that I sent a debt validation letter via email to XXXX XXXX and she quickly got off the phone with me once I stated their attempts at contacting me go against my rights with the CFPB. I thought that was the end of it because I haven't heard anything since from them. Until today. My mother called me to let me know a company had called her looking for me on XX/XX/XXXX and XX/XX/XXXX from the numbers I had listed with Atlantic Recovery Solutions. She said they had been calling her repeatedly for the last couple of months. This contact has happened before and after I asked the company for a debt validation. On XX/XX/2019 a voicemail had been left on my phone by a Mr. XXXX telling me he was with ARS I was sent documentation 3 weeks ago, and either I, or my attorney, needed to call him immediately. I had never received any information from ARS or anyone like them. Within a few minutes, I received a message from my dad that he was contacted by the same person. Then my brother. Then my wife. Then my grandpa. Mr. XXXX called and left voicemails for me and 4 family members within, literally, 5 minutes. This is without any notice provided or even giving me a chance to respond to them. After trying to reach out and figure out what this was about, I finally heard back from Mr. XXXX on XX/XX/2019. He gave a very brief, quick rundown of the debt he was trying to collect and said that if this was not taken care of immediately, litigation would proceed. I let him know that I had still not seen any documentation about the claim. Mr. XXXX said the debt was around {$500.00}, but I could pay 65 % of that today, or break it into 3 payments of {$160.00}. I told Mr. XXXX that I would not decide until I see documentation about this debt. Mr. XXXX hung up on me. A few hours later, Mr. XXXX called back and said it was emailed. I never received an email. Mr. XXXX said, What do you want to do? I informed Mr. XXXX that I would not discuss this debt until I see documentation and verification about it. Again, Mr. XXXX hung up on me. For a company/person that was so enthusiastic to call anybody that shared my last name, Mr. XXXX and ARS ( Atlantic Recovery Solutions ) did not have everything in order, and completed what was equivalent to a smear campaign against me with my family.

Atlantic Recovery Services have been attempting to contact me since XX/XX/XXXX. On XX/XX/2022 at XXXX XXXX my local time ( an FDCPA violation in of itself ). After calling them back at a reasonable hour I told them to cease telephone communication and to use recorded, written correspondence if they had any need to contact me further and requested a debt validation letter at that time. Since then I have received multiple calls from them, using different phone numbers with area codes from my local area to try and trick me into answering the phone. I have since called and left messages, as well as used their online website to request they cease and desist telephone communication. Today I finally was able to speak to someone, and told them again to stop calling me. I was treated rudely, yelled at, hung up on, and transferred into XXXX several times before finally speaking to a supervisor who claimed the company had only received my request for cease and desist today, and that I had not requested a validation letter, and the address I had on file that they verified to send me the letter to was an address that I have never lived at ( despite them having recorded conversations with me telling them to mail me the letter and giving them the proper address ). At this point I do not believe the debt is actually mine, and that this company is either incompetent or maliciously attempting to illegally collect debt. It is only a matter of time before citizens who do not know their rights as well as I do are preyed upon and have debts that are not theirs illegally collected.

On XX/XX/XXXX I got a voice message from something called ARS ( only a acronym, nothing else ) by a man named XXXX asking for me to call because of a " Time sensitive matter '' with no other information on what it was about or who they were, same with my parents and my sister. Being I get scam calls sometimes I didn't call because I naturally assumed it was a scam. In the month of XXXX I got 2 text messages in a week to " Confirm my location '' from ARS ( again just the acronym ) Finally on Wednesday XX/XX/XXXX I got two messages while at work from A XXXX XXXX from two different numbers within 10 minutes of each other from what I now know to be Atlantic Recovery Solutions involving supposed debt from XXXX, A institution I haven't been involved with in at least 8 years, asking to verify personal information about myself making it seem like they tried to reach me multiple times instead of that one time in XXXX. My mother and step father as far as I know were also called in that time too. I was advised not to respond. I have never received anything in the mail or in writing about anything involving any supposed debt. Just a call with at the time vague acronym ( ARS ). I have even checked all 3 credit reports and have found nothing on them indicated in the last 7 years that most credit reports go back. If their is any supposed debt why attempt to collect after it's more than likely legally passed the Statue of Limitations to take any legal action in most states, Including the current SoT of 3 years in my state or the original one of 6 years.

I keep getting on a daily bases sometimes a few times a day calls from a number XXXX saying I need to call XXXX. I had time to call back to to figure out why am i getting so many calls daily. i called XXXX a man picked up asked me if I was XXXX XXXX and verify SSN. I told the man I would not be giving any info can he give me the name of the company so i may know if the collect was a fraud or not. He said I need to verify information. Atlantic Recovery Solutions has been contacting me under their alias " ARS '' since at least XX/XX/2020 via calls and texts. They never properly identified themselves or the reason for their call so I did not first make contact with them until XX/XX/2020 at XXXX ( via telephone ). The representative was accusatory and unprofessional. However, I proceeded to request debt validation be sent via mail only and requested not to be contacted by phone again. The agent became upset and stated they " would not stop calling '' and disconnected the line without notice. On XX/XX/2020 I received a text from my mother stating that a company named ARS has been contacting her regarding me. On XXXX my sister reached out to me stating ARS has been contacting her as well. On XX/XX/2020 at XXXX I spoke with a representative at ARS again and requested the full company name, address and debt validation in writing. I was transferred multiple times and when I complained to the " Senior XXXX XXXX '' I was told I signed up for my family members to be contacted. I did not give this company permission to contact my family member 's. They knew how to reach me and were unwilling to put the request in writing as requested. ARS has called and texted me from multiple numbers referencing a " legally required notice, paperwork and a case ''. However, they never identified themselves as a debt collector or gave notice this was an attempt to collect a so-called debt. In XXXX, I opened a credit card through a bank in order to transfer a balance from an existing credit card account because with this bank she got 0 % for 12 months. I paid off the balance before the 12 months was up and never used the card again. A few months ago, in XX/XX/XXXX, I started getting contacted from a company who claimed to be a collection agency, referencing unpaid delinquent account that was transferred to them. I researched the collections company, and they seem legit, but they havent sent her an email or anything in the mail, just tried to call her. They even called me. We tried calling the bank, they said they transferred the account to another company. We called that company, and they gave us more information on the charges. We found out there were charges from websites like XXXX ( a XXXX website ) and XXXX ( XXXX clothing website ), both websites we would never, ever use. Apparently this company then transferred this account to another company, and now it may be in collections. My credit was just hit with a delinquency and my score dropped a ton. We have called and called around to these companies and they even said they were opening a fraud investigation, but when we call back, no one has record of anything. I never received any notice by mail, statements showing these chargers from the original bank I had the credit card with, nor was I contacted by any of these companies who owned the account. This is credit card fraud and I can't seem to get anywhere on the phone with anyone.

On XXXX XXXX, 2017, I received a phone call from ( XXXX ) XXXX on my cell phone. The man calling asked for someone whose name I did not recognize, so I told him he had the wrong number and hung up. This was the second call I 'd received like this, so I called back and asked him to please take me off their calling list. Instead of agreeing to take me off their list, he asked me how I knew the person they were calling about, if they were my husband or relative, etc. I told him to stop calling me, but he continued to ask me questions about the person they are trying to find. He then accused me of lying about not knowing the person they are trying to find. When I told him I would report him to the FTC, he became rude and abusive and continued to call me a liar. I asked for his name and the name of the company he was calling from. He said his name is XXXX XXXX and he was calling from ARS, XXXX XXXX XXXX XXXX XXXX, NY XXXX. I asked him repeatedly for the full name of the company or what ARS stood for and he refused to answer, insisting that it was just ARS. This person was extremely rude, aggressive, and refused to comply with my request to take me off their calling list. Instead of agreeing to stop calling me, he started asking me personal questions as if I 'm obliged to help him find whoever he was looking for. He even asked me why my office line was ringing while I was on the phone with him. This person is extremely aggressive, unprofessional, and showed no respect for my rights as a consumer.

Atlantic Recovery Solutions contacted me by phone on XX/XX/XXXX regarding a debt that they say I owe to XXXX XXXX XXXX in an amount totaling {$3900.00}. I asked representative XXXX XXXX to send me information by mail regarding the amount in question. He stated that they are not able to send me anything by mail, but " assured '' me it was a valid debt. He sent me a generic email with only the amount of the debt, their account number for me, and their phone number, with no disclosure that I have 30 days to dispute the debt. He also gave me the phone number to XXXX XXXX to call if I want to verify the debt, which only led me to an answering machine. I sent Atlantic Recovery a debt validation request letter on XX/XX/XXXX, which I have documentation that they received on XX/XX/XXXX at XXXX. I have received no response and they have continued to call me every day. I called today XX/XX/XXXX, to state that they need to stop calling me, and spoke to XXXX XXXX again. He claimed that they mailed the information I requested on XX/XX/XXXX, which I have not received. He also claimed he has record of speaking to me on XX/XX/XXXX, which is untrue. I told him that they violated the law by not sending the requested documents after the first call on XX/XX/XXXX, that they still have not sent me anything, and that by law I have 30 days to dispute the charges once I receive the documents. Two acquaintances received phone calls, one of the calls received went to voicemail and the transcribed voice message was forwarded to me. I have attached a screenshot of the transcribed voicemail. I also received a voicemail from ARS ( Atlantic Recovery Solutions ) from a XXXX regarding a debt I do not owe. I have attached a screenshot of that transcribed voicemail as well. I have not received any documentation from this company whatsoever. I checked my credit reports from all three credit bureaus and this company is not listed on any of them. They have sent nothing by mail I can respond to in order to verify this is a legitimate debt. Because the message was sent to an acquaintances phone and not my own I further cant verify who they are. The only way I was able to find the company behind this call was because the person sent a screenshot of the phone number it was received from and it matched the message Id received. This is not legitimate. The outcome I desire is no further contact from this company in any form whatsoever. They will not harass acquaintances or attempt to contact me through other parties or any of their affiliates. Whatever records they believe they have regarding me will be removed from their systems and will not be passed on to further parties in another attempt to receive monies from me. Please investigate this business on my behalf. I believe they are attempting to press an illegitimate claim to receive money for a debt I do not owe.

On XX/XX/2021, I received a robocall from XXXX ( voicemail saved ) stating that the company calling has " important document with your name and social security number attached ''. The call back number XXXX, when searched on the internet, gave no credible business information. Additional calls from the number happened throughout XXXX, XXXX, and XXXX. On XX/XX/2021, the caller identified themselves as ARS. A letter was sent to ARS XXXX XXXX XXXX XXXX, XXXX, CA XXXX. ARS responded that it was not them calling. A certified letter was sent to Atlantic Recovery Solutions ( XXXX signed return receipt ). No response was received from Atlantic Recovery Solutions. On XX/XX/2021, Atlantic Recovery Solutions, called ( voicemail saved ) via robocall stating " This message is intended for XXXX. I am calling with the offices of ARS regarding a legal required notice that needs your immediate attention. Please call XXXX or press one to speak to a live representative. The company is not identifying themselves as a collection agency ; the company is using robocalling technology ; the company has repeatedly failed to correctly identify themselves and failed to respond to legally required requests.

XXXX XXXX balance in full XXXX Settlement Amount I called in this afternoon to discuss a debt that I was paying each month because I recently had the debt card we were using to make auto pays compromised. I spoke with three reps XXXX XXXX, XXXX XXXX, XXXX XXXX. I wanted to just move the XXXX pmt to XX/XX/XXXX since I was unable to pay the full amount. XXXX XXXX told me I couldnt change the payment plan because they need a payment for XXXX. I ended that call and received a call back from the other rep XXXX XXXX who said she was returning a call that dropped and after I told her what I needed to do with the acct she told me that I can not dictate my own debt and they will see me in court and hung up. I called back and spoke with a compliance supervisor by the name of XXXX XXXX. XXXX did take the time to listen to my situation and helped me get to a resolution that both of us found reasonable. She said the rep would be reprimanded for threatening me with legal actions. I Felt threatened when I was told I would be sued over trying to make payments on an account Ive been paying since it got moved to their company. XXXX did help me feel more at ease but I still dont like the practices that company is training to their employees, because who knows how many people they tell that on a daily bases and actually get to pay with the deceiving collection tactics.

They never notified me of placing me into collections by phone call, email, or letter. I found out I was placed in collections after I made a phone call to them to verify my line of credit for a purchase. Now, on XX/XX/ I received an email notifying me that this debt of {$820.00} was sold to another collection agency : Atlantic Recovery Solutions as a sneaky way to avoid my requests. Collectors can not report a debt to a credit bureau before they contact me. Rather than XXXX verifying the information of this debt they sold this to another company as a passive collection tactic! Regulation F prohibits this, collectors have to contact me before they place an account on my credit report. I made payments up to the time when I placed a call to this company. I demand a letter that verifies the date this account was opened, the payments made, the day I was placed in collections, and why. Otherwise, please remove the account from my credit report as a violation of Regulation F. The information collectors must supply to debtors can only come from the original creditor.

Hello, Someone named XXXX XXXX & XXXX XXXX, from a company called Atlantic Recovery Solutions has been calling me, my husband, my sons, and they even called my XXXX mother 's house and asked for her trying to collect a debt that I know nothing about. XX/XX/2019 I got a call and a voicemail from Atlantic Recovery Solutions, specifically a woman who identified herself as XXXX XXXX. Before I was able to call her back, she had called my wife, my mother-in-law, my sister-in-law, and my father. My wife called me and told me that XXXX XXXX had asked her to verify my information to give information about the reason for her call. I called XXXX XXXX back at the number provided to my wife. On XX/XX/19 at XXXX I received an automated call from XXXX stating " we have been attempting to reach you in regards to a legally required notice placed in our office for you. '' When I called back the person did not identify herself but the company name is Atlantic Recovery Services and stated that they were attempting to collect on a debt from XXXX on behalf of XXXX. This company has been harassing me for months by placing numerous robocalls to my phone number, consisting of approximately 10 calls in a row in the morning at XXXX, leaving 10 voicemails asking me to call back, then places an additional set of calls in the afternoon, and an additional set of calls at night. When I have spoke with them, they use misleading info to intimidate and scare me into providing credit card information over the phone, without any documentation of terms or evidence that I owe on a debt. Over the past several days, a company has called myself, members of my family, and has threatened to call my employer MULTIPLE TIMES. I have no idea who this company is and what the matter is. The last voicemail I received was from XXXX who did not state she was with any particular company, and only gave me her telephone number of ( XXXX ) XXXX and a file number XXXX. I googled the telephone number and it matched with Atlantic Recovery Solutions. I called and the first person who answered was silent and then hung up the phone. Good Afternoon, I have gotten 2 phone calls XXXX claming to be a legal matter not discussing what the "Legal Matter was" on my voice mail. Atlantic recovery solutions contacted me via phone on XX/XX/XXXX indicating they needed to speak to me or my legal counsel. I called them back same day and the man I spoke to was condescending, rude and was of no help. I then received a text from them on XXXX asking me to call a different phone number and provided a case # to reference. Again I called, the man didnt provide his name, took him 3 times to tell me the debt amount and then after several minutes of back and forth I agreed to a $ XXXX/month payment to stop the harassment and threat of legal action with the promise that they would email me all of the documentation that evening. I received no such email. After multiple emails and another phone call I finally receive an email with an attachment that has someone elses name and information on it! On XX/XX/2020 the company contacted my boyfriends father my boyfriend and my mother all looking to speak to me over a debt. They asked my mother for my date of birth and address she gave it to them and then they gave her further information on my debt. Atlantic Recovery Solutions called me on my cell phone at XXXX XXXX on XX/XX/18. They left me a vague message saying they were following up on a previous conversation we had. Literally 11 minutes later, they called me on my employer 's phone line from a different number and I answered. The employee, XXXX at first refused to say where she was calling from. I recieved a call on XXXX from a debt collector saying that a XXXX account with a balance of over {$5000.00} was in default and that they were debt collectors looking to settle and that if I did not, I would end up in court and sued. When I heard this, I made no promise of payment or agreed to any form of contract payment and then they said I had 3 days to call them back to with my decision or else they would go to court. After this, I felt something was wrong and realized that the account they were referring to was not one that I had opened myself and that I had flagged prior back in XXXX as a possible fraudulent account. After looking into it more I realized that the account in question was opened as a factoring company type account, something which I have never done before. Therefore, I decided to take steps to report my identity as being stolen most likely along with the fraudulent activity.

This debt collector emailed me, then 2 mins later repeatedly called my phone non stop. They are trying to collect on a debt that was written off by the original company. I kept getting the same repeated phone calls and voicemails multiple times per day. It sounded like a scam so I didnt respond since they never told me who they were on voicemails. I was left a voicemail about a credit card debt and around the same time was called by a process server. They had a very outdated email address so I gave an updated email address for them to send information about the debt to.
