CFPB # : XXXX ; XXXX ; XXXX ; XXXX ; XXXX ; In response to XXXX XXXX , Default Litigation Specialist response to the Consumer Financial Protection Bureau ( C.F.P.B ) complaint regarding the above property you will find the following discrepancy and altered document. While the loan was undergoing modification it was referred to their attorney 's office of XXXX XXXX XXXX XXXX XXXX ; XXXX XXXX XXXX XXXX XXXX ; XXXX , NJ XXXX ; XXXX + In her response in the letter dated XX/XX/XXXX CFPB # XXXX , she claimed that Atlantic Pacific Mortgage is the current servicer of the above loan. She further stated that the Servicer name should never be removed from the mortgage clause of the insurance policy. The information she presented was not the total truth. The letter dated XX/XX/XXXX written by XXXX XXXX XXXX , Escrow Insurance Services from the former Servicer for Atlantic Pacific Mortgage Corp ; NJ License # XXXX , XXXX XXXX XXXX XXXX ; XXXX XXXX XXXX XXXX ; XXXX XXXX XXXX ; XXXX PA XXXX ; XXXX ; Loan # XXXX sent to my insurance agent, XXXX XXXX XXXX clearly stated that Re : Mortgagee Clause Change Endorsement Request claimed that the above mentioned loan was transferred to XXXX XXXX XXXX on XX/XX/XXXX . While the loan was in litigation and foreclosure XXXX XXXX XXXX was the Mortgagee ( see attachment ). All my attempts to get the matter settled was ignored by Atlantic Pacific Mortgage and XXXX XXXX intentionally in retaliation for me not accepting the Loan Modification after it was approved after the trial period. Since Atlantic Pacific Mortgage had sold the loan and transferred it to XXXX XXXX XXXX , Atlantic Pacific Mortgage felt that they were going to do whatever they could to get the property instead of curing the default. Payments totaling {$13000.00} ( 4 payments for $ XXXX = {$2500.00} XX/XX/XXXX ; XX/XX/XXXX ; XX/XX/XXXX & XX/XX/XXXX and two payments for $ XXXX = {$1400.00} and 1 payment for $ XXXX = XX/XX/XXXX . The foreclosure was filed on XX/XX/XXXX @ XXXX in the Superior Court in XXXX by attorney XXXX XXXX for the firm In the response dated XX/XX/XXXX , page 2 # c ; d e & f is false. Note the IRS XXXX as well as the reinstatement quote which shows the total periodic payments went back to XX/XX/XXXX . Therefore, c ; e & f is still missing and was never applied to the account., Atlantic Pacific claimed that the check for {$9600.00} was refunded on XX/XX/XXXX check # XXXX but was unable to provide proof. Check was sent after the attorney kept pressuring them in XX/XX/XXXX made solely to Estate of : XXXX . This shows the blatant intention to produce false and altered documents to the CFPB, the IRS and the NJ Department of Insuance Regarding the total reinstatement dated XX/XX/XXXX of {$18000.00} for total periodic payment of {$14000.00} ; Late Charges of {$310.00} ; Property Inspection for {$190.00} ; Attorney Fees : {$3300.00} and Suspense account {$500.00} The mortgage payment is {$700.00} which XXXX XXXX incorrectly stated as {$700.00}. Note that the late fees were charged in the total payment of {$710.00} eleven ( 11x ) times. It appears that someone intentionally overcharge me {$77.00}. My total charges for periodic payment should have been {$14000.00}. is no explanation for the {$7.00} surcharge. Regarding the attorney fees and recoverable expenses she failed to elaborate. I lived in the property. I maintained the property. I fenced the property with white picked aluminum fencing ; I put solar panels on the roof and cut the grass. Therefore, her statements regarding property maintenance is incorrect. My XX/XX/XXXX Statement to IRS Form XXXX showed that the attorney was reimburse from the money that was sent to pay the mortgage ( See attachment ). Had Atlantic Pacific Mortgage and XXXX XXXX XXXX responded to my request to cure the default then I would not be charged these outrageous attorney fees. Complaints were filed with your office regarding the run-around from both companies who violated my consumer 's right by refusing to cure the default then present fraudulent documents to both IRS and C.F.P.B. Regardless of many letters ( XX/XX/XXXX ; XX/XX/XXXX ; XX/XX/XXXX ; XX/XX/XXXX ; XX/XX/XXXX & XX/XX/XXXX ) sent to XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX IL XXXX and Atlantic Pacific Mortgage XXXX XXXX XXXX XXXX XXXX XXXX XXXX NJ XXXX emails and letters to their attorneys XXXX XXXX XXXX ; XXXX XXXX , XXXX and XXXX XXXX , XXXX , In an attempt to frustrate me and increase their attorney fee to {$10000.00} hoping that I would not be able to cure the default. Atlantic Pacific Mortgage sold the mortgage to XXXX XXXX before I signed the Loan Modification. When I /did n't sign because of the terms, I was foreclosed upon. On XX/XX/XXXX I paid, with a cashier 's check {$31000.00} ( {$21000.00} ( Total of 30 payments ) ; Overcharge of {$77.00} ; Late Charges- {$310.00} ; Property Inspection $ {$330.00} & Attorney Fee 's {$10.00}, 349.59 ) to XXXX XXXX of XXXX XXXX XXXX XXXX XXXX XXXX , XXXX XXXX XXXX XXXX XXXX ; XXXX , NJ XXXX ; XXXX ; XXXX . The check was cashed on XX/XX/XXXX . The attorney fee is outrageous It is not reasonable attorney fees. There was no need for the property inspection since I lived in and maintained the property. No one ever came to inspect the property. This is just an overcharge Upon going to the office it took 1 hr before XXXX XXXX XXXX took the check. My attorney and paralegal was on the phone. as well as I lost time from work just trying to give them the check on XX/XX/XXXX I finally got a letter dated XX/XX/XXXX stating that the mortgage was reinstated only to keep getting the run-a-round from all the customer service representatives : XXXX ; XXXX , XXXX , XXXX , XXXX and a supervisor who would n't come on the phone. I was informed that the account is still in active foreclosure with Atlantic Pacific Mortgage even though my account is current. On XX/XX/XXXX , I was told that I still owe XX/XX/XXXX 's payment. I paid the {$700.00}. Again I paid XX/XX/XXXX 's payment on XX/XX/XXXX for {$700.00}. I received a letter dated XX/XX/XXXX . that my payments would increase to {$950.00} Atlantic Pacific Mortgage and their servicer XXXX XXXX XXXX has caused me XXXX XXXX died XX/XX/XXXX . The estate was dissolved. I presented Atlantic Pacific Mortgage and XXXX XXXX XXXX the documentation to remove him from the account and they refuse to do so. I received a statement dated XXXX/XXXX/XXXX from their research Department from a customer service representative with the initial MGY. My account was accessed surcharge fees of {$200.00} which they created an escrow. In addition, Atlantic Pacific Mortgage charged me 9 Late Fees for {$35.00} for a total of {$310.00} which must be refunded since the late charges were charged in error. 15 days after the due date is the XXXX of the month since the payments were due on the 1st of the month. These charges were done on XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX. Violation of the Note dated XXXX/XXXX/XXXX ; Loan # XXXX page 2 of 3 under # 6 BORROWER 'S FAILURE TO PAY AS REQUIRED A. Late Charge for Overdue Payments If the Note Holder has not received full amount of any monthly payment by the end of the XXXX calendar days after the date it is due, I will pay a large charge to the Note Holder, The amount of the charge will be 6.000 % of my overdue payment, I will pay this late charge promptly but only on each late payment Atlantic Pacific failed to credit my account in a timely manner. XXXX XXXX Bank statement shows that Atlantic Pacific cashed the checks sent via Bill Pay on XXXX/XXXX/XXXX ; In addition Atlantic Pacific Mortgage knew I was living in the house. I made several attempts thru writing to XXXX XXXX XXXX, NJ XXXX XXXX Banking and several other entities to cure the loan which Atlantic Pacific Mortgage and their subsidiary XXXX XXXX XXXX made impossible for me to cure the loan. I was charged a total of {$330.00} for property Inspection I was charged eleven ( 11 ) charges of {$10.00} for property inspection ( XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ) and Sixteen ( 16 ) charges for {$14.00} for property inspection ( XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX ; XXXX/XXXX/XXXX & XXXX/XXXX/XXXX Atlantic Pacific Mortgage charged me {$7.00} extra on my payments for a total of {$210.00} additional payment on my mortgage payment from XXXX/XXXX/XXXX until XXXX/XXXX/XXXX. Atlantic Pacific Mortgage charged me a extra ( 1 ) cent on my mortgage payment from XXXX/XXXX/XXXX until XXXX for a total of {$170.00} After paying the reinstatement amount of {$31000.00} on XXXX/XXXX/XXXX which was posted to my account on XXXX/XXXX/XXXX, I received a call from my attorney claiming that he received a letter from Atlantic Pacific claiming I owe them XXXX XXXX rent even though I paid them on XXXX/XXXX/XXXX. I called Atlantic Pacific. I was told that if I made the payment on the phone I would not be charged any late fees. I made the payment on the phone with the representative. I requested a statement. A statement dated XXXX/XXXX/XXXX, showed that the late charge was removed. After that I have not received any more monthly statements. I requested another statement and received one on XXXX/XXXX/XXXX from the research department with representative MGY where the representative added the charges as well as did a Notice of Error for XXXX/XXXX/XXXX charging me late charges of showing these charges. I called on Monday XXXX/XXXX/XXXX and spoke with a female claiming to be XXXX who was unable to answer my questions. As stated in the letter, I requested proof of how they arrived at the charges. I took out a mortgage with Atlantic Pacific on XXXX/XXXX/XXXX. The mortgage was sold to XXXX XXXX without my knowledge, on XXXX/XXXX/XXXX. I paid Atlantic Pacific Mortgage Dept, via XXXX Bank, a total of {$13000.00} ( XXXX {$620.00} ; XXXX {$620.00} ; XXXX {$620.00} ; XXXX {$9600.00} ; XXXX {$620.00} ; XXXX {$700.00} & XXXX {$700.00} ) which the company refused to apply these payments to my account. XXXX Mortgage reported to IRS that they added 2 payments to the account ( shown on XXXX IRS XXXX Form ) These two payments were later reversed as payments ( See Customer Activity Statement dated XXXX/XXXX/XXXX for the last 2 years. After much complaint and writing of letters to consumer Finance ( CFPB ) and to Atlantic Pacific Mortgage via XXXX XXXX XXXX after Atlantic Pacific Mortgage said that they sent the money back on XXXX/XXXX/XXXX check # XXXX. After much letter writing and a letter from XXXX claiming that the check was cashed and never return to the account XXXX XXXX XXXX Disbursement Clearing Account, XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, IL XXXX, a check was made out to the estate of XXXX XXXX for {$9600.00} on XXXX/XXXX/XXXX. The statement showed that payments totaling {$3900.00} were applied to attorney fees, escrow fees, suspense fees and others. After writing several letters, This statement was altered from the previous statement. The statement dated XXXX/XXXX/XXXX and XXXX/XXXX/XXXX show no record of the check for {$31000.00} which was paid for restoration which include the attorney fee for {$10000.00}. Whenever you call Atlantic Pacific Mortgage, you wait for 10-15 minutes before transferring to other departments. According to XXXX in the Foreclosure Dept/Collection, the loan is correct but it takes up to 2 months to be corrected in the system. I personally went to XXXX, XXXX XXXX XXXX, XXXX in XXXX, NJ, attorney for Atlantic Pacific Mortgage on XXXX/XXXX/XXXX, and I got the same run-a-round. No one wanted to take the cashier check even though the reinstatement letter said to mail it to her office. After waiting for 1 hour, XXXX XXXX, the attorney who went and got the default even though I sent her documents and proof regarding my payments finally came out and took the cashier 's check and signed it. Atlantic Pacific Mortgage cashed the check on XXXX/XXXX/XXXX and issued an order on XXXX/XXXX/XXXX after I called to get the loan reinstated. This is ridiculous that even though it is reinstated with the courts that the loan is still in foreclosure and I am constantly being stressed and harassed and still getting the run-a-round and mistreatment. The problem is that there is a lack of communication between the customer service, the research department and the loss mitigation departments. No one seems to know what is going on. A representative from XXXX XXXX called my mortgage pretending to be and changed from insured paying to XXXX. I called XXXX XXXX and found that a representative from XXXX XXXX called as well as sent over false documents claiming to be me that I requested the change so that XXXX XXXX would send them the payments instead of me. This is outright FRAUD. This is the reason why XXXX XXXX had to use the name Atlantic Pacific Mortgage to file for the foreclosure since the mortgage was already sold to XXXX XXXX XXXX on XXXX/XXXX/XXXX. Previous letters will show that Atlantic Pacific Mortgage XXXX XXXX XXXX XXXX XXXX Mt. XXXX, NJ XXXX claim that there was no Escrow account when I filed a Notice of Error back in XXXX.

The company keep saying that the money was refunded, which it was NEVER REFUNDED. It took several letters and the attorney threatening to sue to get the {$9600.00} which the company claimed was sent back 2 years ago because someone had listed it on my records as paid which was fraudulent. Even after several letters asking for the money, the company claimed that it was returned without checking their bank account to see that the check which they claimed was mailed was never cashed. The modification payments were never applied to my account. My IRS XXXX showed they were applied but the company record showed that they were reversed. The other payments were never applied to my account even though they were collected from my bank and never applied to my account. The company never made any attempt to correct the record even though they were presented with proof regarding the Error which is a violation of my right. The company, XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, IL. purchase the mortgage from Atlantic Pacific Mortgage without my knowledge or signature.on XX/XX/XXXX and added {$7700.00} to my mortgage and created an escrow account. The company claimed that they would remove the escrow account after I send the declaration page for the insurance. I did and they continue to charge me an additional. The mortgage has a fixed rate of 6 % and payments of {$700.00} as agreed upon XX/XX/XXXX, but the company interest rate varies when the mortgage is n't a variable mortgage. The balance in the escrow that the company claimed I owed is {$1500.00}. In XX/XX/XXXX, I received my annual escrow analysis from Atlantic Pacific Mortgage XXXX. Upon review of the escrow analysis, I discovered that my mortgage payment had increased by {$640.00} per month. I figured there had to be some sort of error, and I was correct. It seems their escrow department failed to collect and pay my Private Mortgage Insurance since the inception of the loan. I was a little irritated that I did not receive a phone call or letter explaining the mistake. With that increase in my monthly payment not being feasible, I called the customer service number found on the escrow analysis to try and arrange a repayment plan that would be acceptable to XXXX parties. I did not think that this would be a difficult problem to rectify. On XX/XX/XXXX, I spoke with XXXX in customer service who repeatedly told me that she was sorry, but there was nothing they could do. I was shocked. I considered this an easy fix. After all, I did not make the mistake, Atlantic Pacific made the error. I was now forced to examine my options. I was not going to take money I pay to other bills to pay my mortgage. I did not have problems with my other creditors. I made the very difficult decision to not pay my mortgage. For the XXXX time in 30 years, I was not going to pay a bill. My credit score of XXXX would most likely take a significant hit. However, I still held out hope that a competent person would eventually surface to fix this. I soon found out there are no such people their. I could n't understand why they did not want to resolve this, and continually pushed for loss mitigation and loan modification. I relented and applied for loan modification. I soon found out why they pushed for loan modification when they revealed the terms of what my new loan would be. The Simple math would result in me paying an extra {$220000.00} more for my house than the original note. It appears the error they made would be a financial windfall for them. Needless to say, I declined the loan modification when it was presented to me in the XXXX week of XX/XX/XXXX Before the loan modification, I had sent a letter on XX/XX/XXXX to various departments stating my dissatisfaction with their mortgage company, and explaining, in detail, what had transpired up to that point. I received a return letter dated XX/XX/XXXX, stating that they would review my inquiry. I received another letter dated XX/XX/XXXX, stating that they still needed additional time to respond because they had not completed their investigation of the error, but they will respond no later than XX/XX/XXXX. The next letter I received was dated XX/XX/XXXX This letter again stated that they needed more time, and that they would respond no later than XX/XX/XXXX. This letter was received after I rejected the loan modification. On XX/XX/XXXX, I received a call from an individual in the research department. He left a message stating that he was given my case to resolve, and if I could please give him a call back. This was the XXXX time someone called and gave me their direct number to call them back. It was 6 months to the day from my initial call to them. He was pleasant, apologetic, and resolved the escrow with a 48 month spread. The numbers worked, and he said he would get the paperwork together. I have n't heard from him since, however, I still have the email he sent me. I received a letter dated XX/XX/XXXX, with the findings from the inquiry. In this letter it also states the 48 month escrow spread, however, they now have added another {$3000.00} unexplained increase to my escrow account. I am now facing foreclosure. I thought these companies and tactics were eliminated after the last mortgage fiasco. The emotional stress in addition to my ruined credit have taken there toll, especially with XXXX children.

My fianc and I are purchasing a home. With the assistance of a trusted broker, we were provided conditional approval from Atlantic Pacific Mortgage for a USDA Rural loan. All of our information was disclosed immediately regarding my business that I operate from home. XXXX None of this was kept from them. My business was established because I felt I should be held accountable for the monies earned and to be responsible for paying taxes just like everyone else. On our original application it was stated that my company, [ XXXX ] XXXX XXXX, is my source of income. They awarded conditional approval from this. ThAfter conditional approval had been awarded the appraisal was requested and paid for on my credit card. The appraisal was scheduled and fee charged to my credit card prior to the appraisal taking place. The appraiser did not contact to schedule and had to be basically tracked down in order to schedule. The appraiser was supposed to contact the seller of the property as he has the key. The appraiser was not heard from so myself and the broker made every effort to get things scheduled. The appraiser dropped the ball and had to be followed up with by the APM manager/owner. Appraiser was scheduled to meet with the seller at XXXX. The appraiser showed up around XXXX. Luckily the seller had come to the area early as he lives XXXX hours away to take care of some other business and saw that someone was there at the home. The appraiser was less than polite and had incorrect information. The appraisal was complete and submitted, at some point, to Atlantic Pacific Mortgage. Eventually we received our copy. Now, Atlantic Pacific Mortgage decided after conditional approval, submission and completion of a nearly {$500.00} appraisal, that they do not lend on FARMS. I am a person. The property we are purchasing is acreage covered in hardwoods. It states on the appraisal it is NOT FARMED LAND nor is it income producing in any way. They brought up AFTER doing all of the hoop jumping, follow up questions, and CHARGING MY CARD FOR THE APPRAISAL, that they do not lend on FARMS which it is in no way, shape or form. After extensive research it is clear that they have absolutely no ethical business practices occurring within the company and it is possible that their ultimate goal is to basically destroy people who are trying to get ahead in this world. They sent us the denial letters which were received via USPS. My broker agency proceeded to reach out to another lender, XXXX XXXX. They agreed to accept the original appraisal as it is still within the 90 days and valid. All the required documentation was submitted to terminate with Atlantic Pacific Mortgage and to transfer MY APPRAISAL to XXXX. The paperwork was signed and submitted to Atlantic Pacific Mortgage!!! They REFUSE to acknowledge receipt of the paperwork and REFUSE to forward MY APPRAISAL to QuickenLoans. My loan has been approved! XXXX is now waiting ONLY ON MY APPRAISAL from Atlantic Pacific Mortgage to be transferred. They are holding my appraisal hostage and screwing us over! They processed everything, hit our credit, and now are trying to destroy us. They have knocked our credit score with a vengeance and are now holding us over a barrel because, why? The appraisal just needs to be sent to XXXX XXXX. Atlantic Pacific Mortgage needs to be trained in ethical business practices and should immediately have their lending abilities revoked! On XX/XX/XXXX, I received a reinstatement quote from Atlantic Pacific Mortgage thru XXXX for {$18000.00}. This included {$14000.00} for total periodic payments as of the date of that letter Late Charges of {$310.00} Property Inspections : {$190.00} Attorney 's Fees and Costs of {$3300.00} Suspense Amount Available {$500.00} In a letter on XX/XX/XXXX, XXXX told Consumer Financial Protection Bureau XXXX XXXX XXXX File # XXXX that I was approved for a Loan Modification after completing the Trial plan. It was sent on XX/XX/XXXX the XXXX was sent for approval with an expiration date of XX/XX/XXXX which I did n't sign because I did not agree with the terms and condition. XXXX mortgage sold the mortgage to XXXX Mortgage during the trial period. In their claim, XXXX Mortgage opened the escrow account. The check for the {$9600.00} was sent to XXXX Mortgage as instructed. In addition, I was told to remove XXXX XXXX Mortgage from the insurance and add XXXX Mortgage XXXX see attachment ). This needs to be investigated. I have given you the facts with supporting evidence. This has been going on too long and no one is really looking into it. According to XXXX XXXX Mortgage, they had open an escrow account on XX/XX/XXXX. Atlantic Pacific Mortgage claimed that I have a XXXX loan since the investor required XXXX. Since I did n't accept the investor terms then the money put in the escrow account should be returned. In previous letters responding to complaints, they claimed that I did not have an escrow account and I was making false claim. If you look at the mortgage statement it showed that I was charged an additional {$6.00} for tax and insurance which I paid for According to Atlantic Pacific Mortgage the total of {$2500.00} collected was applied to the delinquent loan. If it was applied to the delinquent loan, then why are they asking for {$14000.00} to reinstate? The information was given and they still have not responded. In addition, Atlantic Pacific Mortgage is requesting attorney 's fee and cost for {$3300.00} without giving a breakdown as well as Suspense amount which is not explained. The mortgage payment is {$700.00} and any late fee is {$35.00} per month. If I had not made any payments to Atlantic Pacific Mortgage from XX/XX/XXXX until XX/XX/XXXX the total due would be {$19000.00}. Late Fees would be {$990.00}. Since my payments were refused I should only owe Atlantic Pacific Mortgage {$70.00} in Late Fees. On XX/XX/XXXX, I paid {$9.00}, XXXX which Atlantic Pacific Mortgage failed to apply to my loan. Instead, Atlantic Pacific Mortgage opened a foreclosure case in XXXX and started harassing me. As of today, I am currently out of {$9600.00} plus {$2500.00} which is a total of {$12000.00}. Therefore, my outstanding balance should be {$7600.00} plus {$70.00} in Late Fees for a total of {$7600.00} in order to reinstate my loan which I do n't have problem with. I filed a complaint against Atlantic Pacific Mortgage Corp who sold the mortgage to XXXX Mortgage when I tried to get a loan modification.
