On XX/XX/XXXX, there was a judgement filed against me by Atlantic Credit and Finance supposedly on behalf of XXXX XXXX XXXX. Prior to being subpoenaed to court, I had never received any correspondence in the mail pertaining to this company. There was a default judgement that was entered due to the fact I did not appear in court because I was healing from a major XXXX XXXX and was not able to get around on my own nor drive. In XXXX or XXXX of XXXX I was subpoenaed back to court on the same matter. The attorney from XXXX, XXXX, XXXX & XXXX representing Atlantic Credit and Finance requested to speak some of the plaintiffs, including myself after court on individual matters when our names were called during court. When it came time for me to speak to the attorney, I informed him I needed to see documentation, which included account number and how they came to the amount that I supposedly owed because my information did not match what they had. The attorney told me that they probably could not provide me with that information and just to send them what I had ''. Fast forward to XXXX I was subpoenaed back to court on the same judgment that I refused to pay and provide any financial information because the Attorneys office nor their client Atlantic Credit and Finance could not provide me with any documentation, however the judged threatened me and I was bullied into paying them. When I called Atlantic Credit and Finance they finally provided me with account # XXXX********** I informed them I had never seen this account number before and they me told it was the credit card number from my account Red Flag!!! I never had a credit card with XXXX XXXX XXXX. The representative of Atlantic Credit and Finance abruptly ended the call and advised me to contact the attorney representing them. XXXX of XXXX, I received a paid in full letter from XXXX XXXX XXXX on an account, which I had been paying through the court to XXXX XXXX XXXX through another attorneys office. Not only did I receive a paid in full letter, I received two checks for over-payment. When I contacted the law office of XXXX, XXXX, XXXX & XXXX I spoke with XXXX who requested that I send the information to them. She suggested that if the account numbers did not match I would still have to pay. I informed her the account numbers were not going to match because their information was not accurate. I sent the letter in XXXX of XXXX and I did not hear from the Attorneys office again until I receive a voicemail from XXXX on XX/XX/XXXX. XXXX called and claimed they never received anything so I re-faxed the letter on XX/XX/XXXX and made sure to call them back to make sure they received it. Upon speaking with XXXX again, she told me what I already knew, that the account numbers did not match. She then went on to state that the account number was the credit card number from XXXX MAJOR RED FLAG!!!! I HAVE NEVER HAD A CREDIT CARD WITH XXXX and I HAVE NEVER DONE ANY TYPE OF BUSINESS WITH XXXX. She then stated that XXXX was bought by XXXX XXXX, yet again Ive never done business with XXXX and never had a credit card with them. On XX/XX/XXXX, I contacted XXXX XXXX XXXX litigation department and spoke with XXXX. I informed her of the entire situation I had been having with Atlantic Credit and Finance and their attorney. First, she stated she had never heard of Atlantic Credit and Finance. Secondly, XXXX stated their attorneys that work on behalf of XXXX XXXX XXXX are always able to provide loan origination documentation when requested. I gave her the account number which was provided by Atlantic Credit and Finance and their attorney, she then stated that they had a similar account number but it was NOT the same. She also stated the only accounts I had with them were loan accounts. I told her I had previously made payments through the court totaling around $ XXXX {$700.00} to the attorney, XXXX , XXXX , XXXX & XXXX . XXXX stated that they had not receive any payments from this company. She also stated, which I already knew, the only accounts I had with XXXX XXXX XXXX were loan accounts. After a 30-minute phone call and further investigation, XXXX stated they, XXXX XXXX XXXX, had not sold any account I had with XXXX XXXX XXXX to Atlantic Credit and Finance and they did not have this company on any paperwork. She advised me to call the attorneys office and have them to conference call their contact at XXXX XXXX XXXX and if that doesnt work I may need to contact an attorney to represent me on the matter because it sounds like possible fraud going on with this company Atlantic Credit and Finance.

I first received a phone call from " XXXX '' at Atlantic Credit and Finance , Inc. '' at my business, which I own, where the gentleman asked for me by first name only. The XXXX phone call attempt from AC & F I was not available to come to the phone, XXXX told my employee that he would wait on the phone until I became available, when my employee refused his offer he said there was no message. XXXX called back a few hours later, at this time I answered the phone. Our conversation began with XXXX telling me that I owed money for a past debt in the amount of over {$3000.00} from the company " XXXX ''. I responded quickly telling him I have never owned or been billed for a " XXXX '' credit card and therefore he had to have had the wrong person. That is when he began asking me personal financial information about myself just to " check '' if he had the right person. He asked me what my address was, what my social security number was, banking information, etc. I refused to answer these questions and told him that if he is trying to collect a past debt from me HE SHOULD HAVE THAT INFORMATION in front of him. He assured me that he did indeed have all of my personal information in front of him and that he was just asking so that he could verify this information. I than asked him to please read to me the, address, social security number, and name of the banking institution he had on file for me, he only gave a false S.S. number before I stopped him and told him once again that HE HAD THE WRONG PERSON. After about a half hour of XXXX trying to " trick '' information out of me I finally got him to agree that he had the wrong person, he apologized for the inconvenience and we hung up the phone. The next day my company received another phone call from XXXX again. He began the conversation this time the exact way he began it the day before as if we had'nt even spoken with each other before. When I reminded him that he had called me yesterday and I thought that we have resolved the issue, he just ignored me and kept going on with his interrogation for my personal information. This time I told him to please verify where I applied for this " XXXX '' card, where I made the so called purchases, what address and name was " XXXX '' sending statements to, in regards to this account. He tried avoiding the questions and it seemed to me that he would pause, as if he was being fed information to repeat back to me. I told him to send me as much information as he had on this account so that I could look into it myself. He told me he could not send any of the information. I told XXXX that I needed to look into this issue more and asked him for his phone number so that I could call him back once I found out more about this issue. Once I got off the phone with Atlantic Credit and Finance , Inc. I researched the company online and was able to find out that I was not the first person that has an experience like this with them. I called my Attoroney General 's Office and told them a little bit about the phone call. I gave the Attoroney General 's Office Atlantic Credit and Finance 's company name, address, and phone number and they told me that the company has be dissolved for over four years.

I am in the process of filing chapter XXXX bankruptcy. I have been contacting all of my creditors in order to fill out a packet given to me by an attorney 's office. I have not retained this attorney yet because the information needs to be filled out completely before I file. In attempting to gather information needed, such as balance due, account #, and mailing address for correspondence, I ran into an issue when I contacted Atlantic Credit & Finance, Incorporated. On the evening of XX/XX/18 at XXXX, I called to gather this needed information on several accounts that were placed with their agency. Initially, I spoke with XXXX who handles my accounts. I explained that I was filing bankruptcy and needed balances due, account numbers and mailing address for correspondence. Instead of her cooperating, she began asking me, in a very sarcastic tone, unnecessary personal questions, such as, " How did I get into such big debt? '' and " How does it make me feel? '' I started to oblige her questions, but told her it does not change my decision to file bankruptcy and asked her to please provide me with the information that I needed. She then transferred the call to her supervisor named XXXX ( spelling? ). She then started asking me the same questions in a sarcastic tone just as the previous collector did. Then she accused me of lying about the debts that I owed. For example, I am behind 3 months on my auto loan and she argued with me that it wasn't true, insinuating that I had money lying around somewhere. Again, I asked her nicely to please just provide me with the information so that I can turn in my paperwork to file. She then began to ask me personal questions like the previous girl in a very demeaning and sarcastic manner, asking me " How does it make me feel to be in so much debt? '' I had enough of the psychological interrogation by this point. I asked again to please just provide me with the information that I need to file and she REFUSED to help me. Instead, she kept asking me over and over and over and over and over again, the same question and I began to cry, had an XXXX XXXX and told her I had XXXX XXXX because she was harassing me. I was being oppressed. She intentionally caused me to have XXXX and I begged her to stop. I stayed professional throughout this while grueling experience. Her exact words were, " I'll give you the information you need once you answer my questions. '' I eventually told her that I was disconnecting the call and did so. I then sent an email to the corporate office that same evening and copied the compliance officer. I requested a call back and received no call. The following week, I sent a formal complaint to their office from their website. I still have not received a phone call back. Their email address is XXXX and the compliance officer is XXXX. I do know some about the FDCPA and know that a collector should not intentionally cause harm and anxiety to a debtor. This was intentional. Asking the same inappropriate question over and over again- many times-and continuing to do so even after they were told they were causing me unneeded stress.

I could not find the exact " describe the issue '' choice, but Atlantic Finance threatened me that unless I made my payments via a monthly electronic payment system, they would sell my debt to a company that would add more interest until the debt was paid off, therefore dramatically increasing the amount of my debt when I agreed to payments but only wanted to pay by USPS money order. Said my credit would get a negative report if I did n't pay electronically. XXXX XXXX and his " supervisor XXXX '' Harassed me and used threats of credit harm if I did n't open up some kind of electronic XXXX card payment system to make my monthly payments. So, at much hardship and more expense I did open a pre-paid credit card and made my first payment. The very next day I received hard copy correspondence from Atlantic Credit and Finance that included a payment form for paying with a money order or check??? OR electronic CC payment IF I CHOSE. I am a XXXX year old totally and permanently XXXX Veteran, my total monthly income is from my VA XXXX pension which is less than {$1100.00} ANY extra expense is a extreme hardship on my financial abilities, and I explained this to Atlantic Finance when I stated that I only wanted to pay via money order or check to avoid any electronic fees or give any of my private financial information to a collection agency because of all the reported harms done by collection agencies to others when they provided personal financial info unrelated to the debt. I agreed to make the payments to protect what little credit I have, even though I felt in principle that the original debtor XXXX XXXX, had broken a agreement with me for payments when I was ill and could't keep up with the full payments but offered " good faith '' payments until my health would allow me to catch up. I fulfilled my part of the agreement with XXXX XXXX, but the reneged just before XXXX causing me to not be able to purchase the gifts for my grandchildren I wanted to. I admit I was so angry and upset XXXX, that I just did n't care and told XXXX XXXX this. But after contact by Atlantic, I did agree to pay off the debt if they would n't harm my credit as long as I was current. They said they could n't but convinced me that as long as I was paying that 's all that would show, that I was paying a monthly obligation. But they insisted that they could only accept a electronic payment, otherwise they would sell my debt to another company that would continue to add interest charges and that I would incur much more debt! I was harassed, demeaned for my original debt to XXXX XXXX, coerced and outright threatened with more debt added, unless I agreed to make electronic payments and incur the added expenses.

I had a credit card through commenity bank. XXXXXXXX XXXX was in the process of selling the accounts to XXXX XXXX. In that process I got behind on payments but never received anything in the mail from XXXX XXXX about this account. To my knowledge, once the account was with XXXX XXXX I did not receive any calls about my account. Around the beginning of XX/XX/XXXX, Atlantic Credit and Finance contacted my husband, who is not an authorized user on this account and is not listed on the account at all. He spoke with a woman named XXXX who worked at Atlantic Credit and Finance. She made him aware that my account was past due and they were attempting to collect a debt. My husband is a XXXX XXXX and due to the many scams going on would never give personal information or bank information without knowing the company and call is legitimate. They attempted to ask my husband for my date of birth, social security number, and other personal information. He, of course, would not give them this information. He asked them if this was legitimate then they should have the information. XXXX then proceeded to give him my social security number, date of birth, current address and other personal information. He did set up a payment plan to pay my debt. I never received notice of the payment plan. He received through the mail statements letting him know the amount was deducted. Nothing ever came in my name. He told me about this information, and at the time I was going through some health and emotional issues and did not have the time or energy to deal with it. Not only that, since it was now in his name, I did not know who to contact to deal with the issue. The end of XXXX, XXXX, my husband 's debit card expired, which was their form of payment. They sent a letter to my husband through USPS stating the payment would not go through. So, I called them to set up a new payment. While I was on the phone with a woman named XXXX who works for Atlantic Credit and Finance, I told her of the incident of XXXX from Atlantic Credit and Finance giving my social security number over the phone to my husband, and how I did not think that was legal. She repeatedly told me it was legal. I asked several times for her to provide documentation showing it is legal. She said she could not do that because she does not have that documentation. I did set up a payment plan to pay my debt, but I do want this company in some way reprimanded for this action. They could have been giving my information to any person. I originally filed a complaint with the Federal Trade Commission on XX/XX/XXXX and when I called to get an update on the status of the complaint was told to contact the Consumer Financial Protection Bureau.

On XX/XX/XXXX I was contacted by XXXX, last name unknown. She started by saying this call is being recorded. She told me that I owed a debt to XXXX XXXX. I told her, yes I do. I told her that I was at work and could she call me after XXXX. She would not get off the phone. Finally she said for me to call her when I get a break. I called her around XXXX, the call went to voice mail. I left a message. On XX/XX/XXXX I receive a call from XXXX, who started the call by saying she is recording this. She preceded ask me what happened, why did I fall behind. I explained to her that the payments we to high for me to handle and I fall behind. She proceeded to say, well I need to know what happened, I know that you are a proud person, and I really need to know what happened. I explained to her that I had XXXX on my XXXX and that my insurance didn't cover {$5000.00} of it. They payments were to high for me to handle and that I was falling behind with all my bills. I told her that I contacted a debt consolidator to help me with my credit. I told her what he wanted me to pay {$450.00} every 2 weeks, and that I couldn't afford that. So I contact my creditors on my own and was making arrangement to pay them off 1 by 1. She said well you never called XXXX XXXX. I told her I was going to call them because I know I owe them. I told her I would like to make arrangements to pay this debt back. She started asking me, questions like what happened, I see you paid so much and you stopped in XX/XX/XXXX. I told had fall behind because the payments were to high but I am willing to work something out to pay this. She said that she needed to know why I let it go. She said that I was to proud to tell her what really happened. I said to her what do you mean. You can tell me what is really going on. She says so you had XXXX XXXX and the payments were to high. Yes. I said that is what I said. Really XXXX you can tell me what really happened. I said to her, I am sorry, what do you want me to say. I know you are a proud person, just tell me the truth. I said to her are you trying to collect a debt or are you a councilor. She says just tell me the truth. I told her that the call was now ended and I hung up on her. She gave me know account number. She was very rude and to me she wanted me to get angry. She kept saying I know you are frustrated. No. I said to her. I am trying to work something out with you. But she didn't want to hear that nor did she seem to want to work anything out.

I'm filing a formal complaint the creditor Atlantic Credit & Finance Incorporated for continuously sending me a wrong receipts even after there has already been a settlement agreement and a payment schedule arranged. My ACF Account # XXXX. On XX/XX/XXXX my XXXX XXXX ( XXXX ) Account was settled for the amount of {$3700.00} instead of {$7400.00}. The first payment was made on XX/XX/XXXX for the amount of {$5.00}, after this payment the total amount due went down to {$3700.00}. On XX/XX/XXXX a payment of {$180.00} was initiated that went the total amount due down to {$3500.00}. On a recorded line on XX/XX/XXXX, a settlement conversation agreement with XXXX XXXX, the total amount of {$3500.00} was agreed & settled to be paid every XXXX of the month by automatic debit on my account for {$170.00} starting XX/XX/XXXX until XX/XX/XXXX totaling to 20 payments. This settlement agreement was clearly confirm when XXXX XXXX send formal letter with payment schedule. The letter was dated XX/XX/XXXX. However, on XX/XX/XXXX a receipt was created and mailed to me stating that Atlantic Credit & Finance received my payment of {$170.00} and that my new balance is {$7100.00}. I immediately bring this error to the attention of Atlantic credit & finance Account representative. I called and discuss the issue to them and on a recorded line, the representative apologizes for the error and told me that my new balance after XX/XX/XXXX {$170.00} payment is {$3300.00}. But the same error occurred again on XX/XX/XXXX when my payment of {$170.00} for this month cleared, Atlantic Credit & Finance has sent me a wrong receipt again, it states that after they received my XX/XX/XXXX payment my new balance is {$6900.00}. It is clear that Atlantic Credit & finance did not correct or worst did not acknowledge the settlement agreement which is very frustrating & unprofessional. I strongly insist that Atlantic Credit & Finance have to honor the settlement & correct the monthly receipts they are sending me. I have determined that the new balance after my XX/XX/XXXX payment is {$3200.00}. I already called Atlantic Credit & Finance so that they can correct the error but it seems that their finance department did not anything about this. Atlantic & credit & Finance have to correct the correct balance as soon as possible.

To whom it may concern, on multiple occasions I have been contacted by both Atlantic Credit & Finance Special Finance Unit, LLC ( ACFSF ) as well as their counter partners XXXX XXXX XXXX, XXXX. ( XXXX ), in regards to a phantom debt which is alleged to have been originated between myself and a company called XXXX XXXX ( XXXX ). When I was first contacted by ACFSF, I explained to the collection agent that I had never heard of XXXX nor did I have any accounts with a company by that name. I asked for the details of the account and later pulled my credit reports in an attempt to authenticate what the agent from ACFSF, had shared with me. Upon reviewing my credit reports I realized that I in fact had never had a creditor by the name of XXXX, within my entire credit history. Shortly thereafter I received another call from an agent working for ACFSF asking for payment on this unknown XXXX account, I reiterated to the agent that I was unaware of any such account with a company called XXXX. I advised the collection agent that I would like to be sent a copy of any promissory note or written agreement, which would bare my signature for of terms that I allegedly agreed to repay on a loan from XXXX. I never received any such proof of validity of this debt which is in violation to the Fair Debt Collection Practices Act ( FDCPA ). These communications with ACFSF transpire within the first two weeks of being contacted by their office. To this date I have not received any information that would provide any details of the debts origination date, nor in what form that I am alleged to have utilized these funds. To add insult to injury this debt is still not reporting to my credit reports and I have been pursued for a judgment by ACFSF, along with their counter partners XXXX, in XXXX county circuit court of Illinois. On XX/XX/2014, a judgment was entered in favor of ACFSF. The judgment has now provided both ACFSF and XXXX, the ability to garnish my pay checks as a result this phantom debt created by ACFSF and enforced with XXXX. Im seeking assistance from the CFPB, to place an inquiry into both ACFSF and XXXX actions against me the matter of illegal debt collection tactics, fraud, and additional violations to the FDCPA. I implore your office to take immediate action in this matter!

Hello, I would like to complain about the debt collection from the agency XXXX XXXX XXXX. I was a cosigner for a former friend, who had a XXXX. She opened up an account to make payments on a credit on XXXX, XXXX with the company, XXXX XXXX, but needed a cosigner just in case the payments were not met. She made it seem like she was responsible enough to make them, so I said yes.I was not aware of the documents and the requirements to be one, and she knew of this and took advantage of the situation and filled out my information. I was not aware she was supposed to hand me documents and she forged my signature. Saying yes to be a cosigner were just words, but it being signed and dated by the actual person or to have it in writing by my permission of course are two different things. What if I had changed my mind? I was young and was only saying it to be a good friend. I was not aware she topped making payments until the debt collection company, Atlantic Credit & Finance Incorporated contacted me in XXXX, XXXX after she stopped making payments.The debt collectors turned to me and my information and started asking me for payments on XXXX of XXXX for about {$9800.00}. I have called and spoken to people from XXXX XXXX and Atlantic Credit. I told them I did not sign any documents pertaining to the documents needed to sign for a cosigner and even disputed the account in XXXX, XXXX, but it seems like they can not do anything to remove my name and my information from being a cosigner. I reached out to Credit people from XXXX in XXXX, XXXX, to explain the situation and they refused to give me any information on the account, even though I am the supposed cosigner, but because I am not the primary account holder, which would be my former friend in debt. They have been sending my letters in the mail with her name on it, asking for {$7500.00} and have called me on several occasions. Also, I do not know the company 's location where she got her XXXX, because they have refused to give me that information as well. Thank you for your time

On XX/XX/XXXX, we went to court as the company who purchased my debt ( Atlantic Credit ) obtained legal respresentation ( XXXX XXXX XXXX ). I, did not have an attorney representing me. The attorney for XXXX XXXX XXXX had me sign the judgement form ( outside the courtroom in the hallway ) stating it was proof I showed up for court. I advised him that I did not want to and that I wanted to see if I could obtain an attorney ( as I was completely unfamiliar with the situation ), I also wanted to discuss my options with the judge. The XXXX XXXX XXXX attorney stated the the debt was valid because I signed for the credit card. In XXXX, I made two written requests that included payments ( {$200.00} and {$20.00} ) via money order to them and requested they send me in detail a list of the alleged charges and fees. However, they failed to respond and provide anything I requested. In XX/XX/XXXX, my wages began to be garnished without me ever being formally served or notified. I have only attended one court hearing and were not notified of any other proceedings. My wage garnishment were 25 % for the total {$1900.00}. On XX/XX/XXXX, it was reported to be my final wage garnishment, however, when I called XXXX XXXX XXXX they advised that it was not my final payment ( although the judgement stated so for the final amount paid ) and that it was still accumulating interest. I advised them that the order was already set and payment was sent for the balance. The advised that I still owed interest as it was accumulating although my wages were being garnished. I requested the debt collector information who hired them so that I may contact them directly and they stated they had no such information. When questioned how they could not have this information they were not able to formulate an answer. I then asked for the attorney who was handling my file and they reported there was no attorney handling my file. Furthermore, I was not informed of the garnishment until I received my paycheck in which the initial deduction was made.

Received a letter on XXXX2018, regarding a debt with XXXX XXXX XXXX XXXX, Contacted Atlantic Credit and Finance Incorporated, XXXX. XXXX XXXX XXXX, VA XXXX. XXXX AFC : XXXX Account Number : XXXX Called : XXXX XXXX XXXX Current Servicer : Atlantic Credit and Finance Inc. When calling, I was transferred to several people with in the Credit and Finance group to settle a debt, the employee stated this was an attempt to collect a debt, then I was placed on a brief hold and transferred to a representive. I was ask a brief couple of questions regarding the debt and answered the questions in regards to the letter sent to my home by Atlantic Credit and Finance Inc./ : XXXX XXXX XXXX . Why did it take so long to pay your bill? What did you do with your income and monthly income? o What bills are a priority in your household? Why did you neglect your XXXX XXXX card statement? Did you have an issues at your home where you needed to replace items or a fire or natural causes of a disaster? Do you have health issues? Employment hours reduced beyond your control? I answered the question several times, repeating the answers and then asked to settle the credit card debt, as instructed in the written letter sent by this said firm. I was then transferred to a manager and the same process was repeated. Why did it take so long to pay your bill? What did you do with your income and monthly income? What bills are a priority in your household? Why did you neglect your XXXX XXXX card statement? Did you have an issues at your home where you needed to replace items or a fire or natural causes of a disaster? Do you have health issues? Employment hours reduced beyond your control? I then became upset and requested a settlement of which I was denied, and I hung up the phone and called our family lawyer the firm is not willing to settle a debt.

I have a XXXX 's XXXX credit account which is delinquent and was recently sold to a third party collection agency - Atlantic Credit. I received a letter in the mail regarding the outstanding balance but I have received no less than 5 calls per day since the beginning of XX/XX/XXXX. Not only do they call from their toll free number, I have received calls from a XXXX number in XXXX, VA as well as from a Restricted line. They do not leave messages from any of these numbers. On XX/XX/XXXX, I accepted a call from the restricted line to inquire who was actually calling. Atlantic Credit informed me they were trying to contact me before they had a local attorney take over the account.Upon speaking with XXXX XXXX and her supervisor, XXXX, I informed them both of my reason for the delinquency as well as expressed an intent to work out a payment arrangement. I also informed them both that I was at work and would not be able to accept calls during business hours and would have to call them from home during non business hours. On the morning of XX/XX/XXXX at XXXX, I received another call from the Restricted number but again they did not leave a message. I am interested in discussing a payment arrangement but I am not interested in receiving multiple calls from multiple numbers nor am I interested in feeling as if I 'm being harassed with threats of legal action or sarcastic comments regarding my intent to pay.

XXXX was my original creditor. Due to financial distress, I could not make payments as agreed, and the account was sold to XXXX XXXX XXXX XXXX XXXX on XX/XX/XXXX. I spoke with a representative about my account XX/XX/XXXX, and we had agreed to cut the balance in half ( original {$3600.00} down to {$1800.00} ) and to set up a biweekly payment plan of {$35.00} to be settled in full by XX/XX/XXXX. I see that every 2 weeks, payments are still being deducted. When I call they claim an amendment never existed, and do not see a record of the call. I was told the balance owed is still {$2100.00}, and not the {$350.00} I had assumed I had agreed to. I spoke with XXXX ( ext XXXX ) on XX/XX/XXXX, who was really kind, and said she'd review recorded calls for the dates I specified ( XX/XX/XXXX to XX/XX/XXXX ). She said I should hear back within an hour, but I do not understand why a record of my call and the contents do not exist. I am asking that ACF mark the account as settled in full, as agreed, and cease and desist taking any additional payments via ACH or EFT or otherwise debiting my account. I have also not been receiving any printed or emailed statements regarding my account, which I believe is a violation of FDCPA. I had sent a letter in XX/XX/XXXX about my change of address, but I never heard back. I am upset because I agreed to pay and feel hoodwinked that they never notated my account.

I started receiving calls on XX/XX/XXXX from a restricted number or XXXX. From XX/XX/XXXX they have called me XXXX times from the same numbers. Sometimes multiple times in XXXX day. They have also been contacting my husband on his cell as well. This debt has no ties to him and on XX/XX/XXXX when they called for thr XXXX time i told them they are not to try to contact me on his number. I did talk to them on XX/XX/XXXX and agreed to male arrangements with them but kindly asked them to call me back because i was driving and trying to drop my XXXX off at XXXX. They proceeded to keep me on the phone for XXXX minutes trying to " console '' me with XXXX XXXX and XXXX psychology. I asked them to send me a statement so i could send them monthly payments. I got irritated and hung up on them. On XX/XX/XXXX they called again and I answerd to let them know I received the statement and that I would be sending monthly payments. The XXXX girl " XXXX '' stated that was only if i was paying the entire balance. I repeated to her what my intentions were then she handed the phone to " XXXX '' where he started with his XXXX XXXX and XXXX psychology again. I explained that I did not feel comfortable giving my account info and that I would be sending checks. This conversation went on for XXXX minutes. They were very condescending and refuse to hang up after I told them I was going to send monthly checks.

There 's an old, unsecured line of credit I took out with XXXX XXXX XXXX / XXXX back in 2005. The original amount was {$7500.00} and I made payments periodically - but not always on time due to difficult financial circumstances. In total, I probably made {$2000.00} in payments over time. But, I 've been un / underemployed for most of the last 13 years and have struggled to simply make ends meet - much less make progress towards old debts. I have never filed for bankruptcy, nor do I intend to.

That debt was written off by XXXX / XXXX and the right to collect the debt was purchased for pennies on the dollar by Atlantic Credit & Finance. Atlantic Credit & Finance is somehow partnered up with a law firm called XXXX XXXX out of XXXX, FL.

They sought a legal judgment against me without properly without giving me proper notice and secured said judgment and had a lien imposed on my personal checking account. Now, any money that goes into that account will be garnished. I never had a hearing or opportunity to tell my side of the story to a judge or magistrate - although I am in the process of filing for such a hearing.

The judgment and the lien are for over {$9000.00} - although I know they bought the debt for only a fraction of the original {$7500.00} debt. This is wrong!! The interest / charges are criminal given the fact they bought the debt for pennies on the dollar.

This company called me today and threatening to take me to court if I did not set up some kind of arrangement with them today. They said the papers where laying on there desk and ready to be sent. I told them that I was not able to work because of health problems and that I have applied for XXXX. I have no money. My wife is the only one working and she is trying to keep us a float. They would not listen to me and ask what bank we used and called the bank and put us on three way and set it up to where money would come out of our savings on Monday. How can money come out of something when you do n't have money in there. I keep on telling them that we needed to wait on my wife because I just have a card to show at the bank when I did work to get my check cashed. I do not have a bank card or anything like that my wife has it all and it is all in her name. He even said that me and my wife can have the argument or fight but it was going to be settled today. I was on the phone with these people for about two hours and they say it was being recorded so lets hear if everything they said to me is on the recording. When I got off the phone with these people my chest was so tight. I do not handle to many of the bills my wife does. I keep on telling these people that I could not hear them good to just wait till my wife got home from work but they would not hear of it.

I received a phone call at my place of employment on XXXX/XXXX/2016 at XXXX ( CST ) from XXXX Credit from phone number XXXX. The representative did not verify the identity of the person she wished to speak to nor did she provide the statement with regard to the attempt to collect a debt. She proceeded to tell me that I owed {$6000.00} and if they did not secure an arrangement it would be forwarded to an attorney. I informed her that I am absolutely not aware of the debt she is referring to and that if she though the debt is valid, they must provide a letter in writing to me advising me of the debt and that I have 30 days to dispute or confirm the validity of the debt. As the conversation proceeded, it turns out that she is looking for someone else that has the same first and last name as I do ; however, the middle name is different. Additionally, she provided the other person 's name, address and last XXXX digits of their SSN. Even after I told her that she has the wrong person, she asked to be transferred to my HR manager/department which I refused. This is unacceptable that that they would be contacting someone 's place of employment and also contacting the incorrect person and harrassing me at my job. This collector refuses to provide any written verification of debt or any requested information for that matter. At the judgement hearing, the attorney stated that he would send me the agreement to file a motion to set aside if I were to pay the judgement in full by the end of the following month. Nine days left of the month and I finally contacted them to request this information and they claim to have no knowledge of it, yet inform me that I now owe over {$200.00} more than the judgement due to statutory interest. They request that I call back the following day to see if they had a chance to speak with the lawyer. I was n't able to call back until 6 days later, only to find that instead of sending me the requested information, they filed a garnishment instead. I feel like they use the courts to prey on people who are n't able to protect themselves and do so using tactics like demanding you allow them to garnish real property if signing a payment agreement. I was not taken seriously during the entire court process by either the court or the collection agency and they need to be stopped from abusing their power. They still have not issued the garnishment or sent me anything in writing concerning the amount of interest they are now attempting to collect on as well.

I was contacted by Atlantic Credit & Finance on today XX/XX/XXXX. The call was humiliating and harassing because the person I spoke with forced/coerced me to tell why I couldn't make the payment. He consistently asked about my personal life regarding why I couldn't make payments. I told him that I did not want to continue the conversation about my personal issues. I wanted to talk about rectifying the payment. He said he couldn't help me until I tell him the reason why I stop paying on the card. This went on for about 30 minutes. He put me on hold and then his manager got on the phone and said the exact same thing to me. I practically begged both of them to end the conversation because I was in tears. Both of them continue with no concern. I stayed on the phone with them for almost an hour and still no payment arrangement was made when the call ended. I felt ashamed that I had to disclose this information. The amount of the debt balance is {$1800.00}. I received communication via XXXX XXXX as well. The letter disclosed that I could mail payments. The rep told me that I could not mail the payment in unless I send them {$900.00}. The letter also states that I could make biweekly payments as low as {$25.00}. I was not offered this amount as an arrangement.

I received a overnight XXXX letter from company Atlantic credit finance XXXX XXXX XXXX VA XXXX XXXX we received a letter stating this was in Pre-legal notification to contact them to make arrangements with a payment plan of XXXX bi weekly by XX/XX/2019 or they will forward this to an attorney for litigation. Please keep in mind we have never received a ( 1st notice ) Letter ) this was the 1st letter that was ever received. I contacted this agency and wanted to honor what they had in writing for a payment arrangement, I spoke to two representatives by the name of XXXX and XXXX both advised me they could not honor what was in writing without a down payment of a percentage down? I advised them both this was not was was in writing and all we would like to to due to our financial status that I could afford. Both refused to honor what was received in writing. I have kept this correspondence along they both advised me that the call was being monitored and both did not give me the full mini Miranda. I received a copy of a judement from my escrow company that I didn't know about it was dated back in XXXX. Talked to a XXXX XXXX on XX/XX/XXXX regarding this judgment an my willingness to pay so I can move forward and have this cleared. He stated once they received payment he would issue a document of Statement and Release and have this recorded with your court system. I asked for a recordable document so my escrow company could have it recorded. Ref. # XXXX Judgement doc # XXXX. Amt of judgement is for {$1600.00}. A payment in the amt of {$1600.00} check # XXXX was paid to Atlantic Credit and Finance on XX/XX/XXXX. They received it on Monday XX/XX/XXXX as I had it certified and return receipt. Atlantic Credit and Finance Inc. called and spoke with me on Thursday, XX/XX/2018 regarding a debt I have. I did not deny having the debt but requested the amount of insterest and late fees that accumulated in order to help bring the debt down so I could pay it off. The four representatives I spoke with all refused to look up the interest and late fees and continuously ridiculed and belittled me over the phone. XXXX, XXXX, XXXX, and XXXX are the representatives i spoke with and hung up feeling embarrassed and frustrated that they were unwilling to help me as I was calling to get this account back on track. They also threatened to sue me multiple times over the phone. When I hung up I called the original card company and asked for my last statement with all of the interest and late fees. My balance ( with no interest and late fees ) was {$940.00}. The interest and late fees totaled around {$820.00}! This company is trying to collect for {$1700.00}. Which is why I repeatedly asked for the amount of interest and late fees to help drop the balance and allow me to pay off the debt faster. I also tried to negotiate the debt to have it paid off faster by the end of XXXX and they refused to negotiate or work with me.

I obtained a non-secured loan from XXXX in XXXX after being forced shaped out of the XXXX XXXX. I was unemployed for 9 months and had to relocate XXXX but was paying $ XXXX/month on the debt. The loan was sent to Atlantic Credit and Financial where I continued to pay $ XXXX/month due to extended unemployment. In XXXX XXXX, while checking my credit report, I noticed that the debt was now a judgement. I had never been notified of potential legal action. I NEVER received any type of notification from Atlantic Credit ( or the law office ) informing me of the judgment. I NEVER received any type of documents from the XXXX XXXX XXXX allowing me the opportunity to respond to the claim. I DO NOT deny the debt. The debt is my debt ; however, I dispute the fact that it was placed as a judgment especially since I was paying as agreed. I am a Veteran of the XXXX XXXX XXXX and have endured many obstacles in the last few years and was just starting to recover until the judgement was placed on my credit report. Again, I am responsible for the debt ; however, I do not agree with the debt being placed as a judgement and I believe that I did not receive my consumer rights to respond prior to the debt being placed in judgement.

I had recieved a call from a debt collector in regards to a piece of furniture I co- SIgned on for my roommate and I at the time. We had parted ways 3 months after purchasing it and the other party kept the couch. In XXXX, I reviewed my credit score and saw the account on the couch was closed and {$XXXX} balance. Now a debt collector called, did not say what company he is working for and said if I did not pay right now I would be sent to an attorney and sued. Out of the blue a month or two ago I started receiving several phone calls per day including calling my place of employment from them. It was non stop calling every day. I called them back and would always end up leaving a message. A couple of time I would be on hold for over 10 mins until I was able to speak with someone. I did speak with XXXX. Soon as I was on the phone with her she immediately said that there was going to be a lawsuit against me for a unpaid debt/sending it to an attorney in my state. Then as we went further into the conversation she asked alot of personal questions as to why I had the debt. It was to the point where I felt very uncomfortable with talking to her. I felt like she wanted my life history and it was just to personal for her to know that information. I had a Line of Credit for {$20000.00} with XXXX of Florida and 5 years ago I stopped the monthly payments because I was renegotiating with them a Mortgage for my House. A few months ago I started to received at least five calls a day on my cell phone from this number and a number from Missouri. I never answered the phone because alot of it was during work hours. Then they started calling my work office number, repeatedly harrassing my coworkers if I did not come to the phone. I talked to one person and asked that they stop calling my business and they said they would. They told me I had an outstanding debt that I thought was legitimate, but has never sent me any information regarding it in writing. They have continued to call me at least once or twice every day on my cell phone since then, and today on XXXX called my office twice again today. When my coworker picked up the line she talked to someone named XXXX and she put him on hold. When I picked up, no one was there and it hung up. The phone immediately rang again and she picked up again, and he gave her his number which is the XXXX. I do not know if this is a legitimate debt collector over any of my debts. And if so, I do not want to do business with them and their practices. They are harrassing me night and day.

On XX/XX/2018 at XXXX XXXX EDT, I received a phone call from XXXX with Atlantic Credit & Finance. When I picked up the phone she said " XXXX? '' and I said " yes? '' At this point she proceeds to say she is with Atlantic Credit & Finance and that they have purchased my XXXX Credit Card account and gives me the balance due. She does not verify my DOB, last four of my SSN, or even say my last name. At this point I explained to her that she has violated the FDCPA by failing to confirm my identity and could've just committed a third-party disclosure. She said that she didn't do that and she doesn't have to confirm my identity. At this time I told her I have an attorney and she should know that because XXXX was aware of it prior to selling the debt to Atlantic and that it's probably in their file. She wanted the attorney 's information to continue collection efforts. I was contacted b y Atlantic Credit and Finance i n 2015 regarding a credit card debt I owed to XXXX XXXX Company. We resolved the debt and I paid a settlement in good faith in the amount of {$10000.00} on X/XX/15 . I took this money out of my 401K. My complaint is that I was not told this would be considered income by the IRS and the State of Oregon. As a result, this created an additional tax burden for me and I had no way to arrange for additional withholding since I did not know the amount of debt " forgiven '' would be counted as additional income. IF I would have known the complete impact of the arrangement I agreed to, I may have preferred to make other arrangements. I was led to believe there would be no further consequences to my finances once I paid the agreed upon amount. This omission by Atlantic and their representative constitutes bad faith and misrepresentation. I am still dealing with the IRS and State of Oregon on this issue and it continues to cause financial hardship. I would appreciate you investigate this action by Atlantic.

XXXX and XXXX attorney office had contacted my siblings and my mom regarding my credit card collection prior to contacted me. They have disclosed my confidential financial information to my siblings and my mom. They used scare tactics to my siblings and my mom that they will use legal action against me if I do n't pay back the small amount of credit card debt. I called the XXXX and XXXX office to work on the payment reduction and payment plan. But the guy named XXXX only gave me very short time frame XXXX months and each payment is over {$1300.00}! That is a such high monthly payment in addition to my other family expenses! Despite the current bad economy, they do n't give you a chance to catch up and they said it will be a legal action if missing the payment. There is no room for negotiation nor longer time frame such as XXXX months or XXXX months like XXXX XXXX gave me. These are XXXX are taking advantage of us during the bad economy. Was contacted numerous times last week sometimes back to back from unknown number. When i ask who they were was advise they got my number from my previous supervisor XXXX XXXX they continued to call so i decided to answer. Spoke with a rep name XXXX we entered a payment arrangement even though i told her i was unable to make payments because i am in the active foreclosure process for my home. She was persistent and i wanted to stop the calls so i agreed to the terms but i spoke with my housing counselor and was advise until i reach a agreement with a loan modification i could not add any extra bills so i called today on XX/XX/18 to cancel my agreement with Atlantic credit and finance incorporated where i was verbally abused and she hung up on me because i asked to cancel my payment arrangement i ask for a supervisor and he was not much help either restating that they can not help me in the future i explained over and over i would have to cross that bridge once i am able to pay and they still threatened me.

I received a threatening letter from Atlantic Credit and finance incorporated threatening to sue for debt if I do not contact or pay. For one, this company has never sent correspondence to me until now, two, I informed the person that called I am XXXX and have no way to pay as I am waiting on social security and have absolutely no income. This same alleged company has called my household multiple times with blocked caller or unknown caller on caller ID and immediately ask for social security number. I do not give this information over the phone to random callers. This letter was received via XXXX today XX/XX/XXXX and demands payment or contacting a number they give but never answer by XX/XX/XXXX or they will hire an attorney to sue. As I said, I have informed them in the past I am XXXX, I can not work and I have absolutely XXXX income until my social security XXXX is approved.

A company named Atlantic Credit and Finance Called me from an unknown number today X/XX/2017 at XXXX Pacific time. The call lasted about 16 minutes. After asking the repeatedly at least 10 times during that call if I could have their address so I can send my via Money they continued to harrass me after I told that financial hardship is the reason my account went into collections. They wanted to know how, why, when, where and what exactly happened. After repeatedly telling them that I was n't giving them my life and if I could the address and kept asking me what was having their address gon na do for me. Atlantic Credit and Finance has called repeatedly from a blocked number ( No Caller ID ) without leaving messages. They have called and spoken with my family members multiple times, though it is illegal to call more than once. They are harassing myself and my family members and to date I have received nothing in the mail alerting me to this debt collection. They call multiple times a day, mostly during the work day when calls can not be answered, with No Caller ID and leave no message with contact information to return the call. I only know it is them because my brother was able to answer the call from No Caller ID and they immediately told him who they were with ( eluding to the my owing of the alleged debt ). The first time they called, he asked them not to call again, but they did. To date, I am not even sure what the original debt is.

On XX/XX/2019 I received a response from The XXXX regarding my issue with Atlantic Credit and Finance and they acknowledged receiving my payment and that such debt was satisfied. They said debt was being handled by XXXX XXXX and they have been directed to start the satisfaction of judgment process and they attached a copy of a release letter from Atlantic statingthe account in question is settled and the consumer has no further obligation to the account. Atlantic Credit and Finance calls my personal phone multiple times per day. They started calling my husband, now calling my job. I have asked them to no longer contact my job and family. They also leave messages on the voicemail claiming they are a debt collector trying to collect a debt from me. Atlantic Credit & Finance has be en calling my employer in an attempt to collect a debt. When I spoke with them and informed them that this was not an appropriate number to call. I asked what company they were calling from and a phone number so I can call them back on a private line. They refused to answer and give me any information. After about 5-10 minutes of the man aggressively talking over me, interrupting me and threatening legal action, he told me the company name, Atlantic Credit & Finance, but the man on the phone would not give me his name or a phone number. I recently had to cancel my phone plan due to lack of finances from being on XXXX. I was forwarded a letter sent to a resident and state I do not live in on the XXXX of XX/XX/2019. Debt collectors have n't called outside of proper hours, however I am having an issue with debt collection companies not providing me with a receipt for my monthly payments. I 've spoken with multiple representatives and supervisors who always claim they 're going to resend it but they never do. A common practice for these companies is to only allow you to speak with XXXX person who is authorized to handle your account. The issue with this is very rarely is that specific person available to take my call and when I leave a voice message my calls are never returned. It is ridiculous that I have to make demands for something as simple as a payment receipt. These companies need to improve their customer service now!

I just found out they are utilizing a third party XXXX, XXXX, XXXX who has refiled this judgment as a State Tax XXXX with the Plaintiff as State of New Jersey not as Atlantic Credit. The specific nature of the problem refers to the terrible customer service of Atlantic Credit and Finance. Over two months ago I 've sent a payment via postal mail and I still have n't received a payment receipt. Every time I try to call I 'm transferred to someone that never answers the phone and whenever I do leave voice messages no one ever returns my call. This is a horrible way to treat customers who are trying to rectify their accounts. Unfortunately this has happened before ever since they 've had my account over the past two years. The company is Atlantic Finance and Credit based out of XXXX, Virginia. I try to call and pay what I owe and they are clearly dodging my phone calls. I was finally answered by someone and transferred to a voice mail after hours of calling. They will not call me back and continue to charge my bank account {$22.00}. I am unable to give the amount owed, which is why I am contacting you. Atlantic Credit Financial does not have a website or method of keeping the consumer informed about the balance of the remaining debt. They are difficult to contact or at least I have been unable to contact them on this day XX/XX/2019. I have never received any notice from any court with regard to any account. I requested from plaintiff proof of my signature on their application, but they have not provided me with any information, instead they are asking me for my personal information, i.e social security number, etc. Atlantic Credit and Finance , Inc. alleges that court took judgement on their behalf on X/XX/2010 , for which I was never requested to attend.
