If I could give them no stars I would. Athas claimed they could loan for people in my situation. I provide them 24 months in bank statements and I was perfectly qualified according to their guidelines. I do fix and flips and driving on the side for extra income. Instead, they made a smooth and simple process highly difficult. I never have less than three incomes going at once. They declined two because the account it was going in had too many NSF charges ( which they didn't say so in the first place ). So they just decided to only count my LLC income. ( I dissolved a partnership last year to go solo. ) Except my sole proprietor, that I do business on now, was 50 % ownership of the partnership which was how it was structured. I show them proof of that. Then they tried to claim that they can't tell what is income and what is not from my fix and flips. Payoff statements from title and escrow could simply debunk all of that, but they didn't care to ask for those did they? Overall, they were just simply denying my incomes for one XXXX ( and easily provable ) reason or another. Then they said that I could go to a CPA for an income analysis and they would accept it. Once they realized I was going to do it, they " accepted '' my proof of business income and submitted it to the underwriter. Finally! All of that took a whole month! Two days later, XXXX XXXX on a Friday, I got a denial email stating that 8 out of 24 months that they asked for were missing so they decided to do an income analysis based on the 16 months available and the income/debt ratio was way off. Ummm ... .first, there weren't 8 months missing. And second, even if there were, they never said nor claimed it was missing. I sent emails to a XXXX XXXX ( floor manager ) and a XXXX XXXX ( account manager ) saying there was a mistake. XXXX responded saying he and XXXX will investigate Monday morning to get to the bottom of it all. And I trusted that they would. I mean ... .would n't they WANT to close this account? Nope ... .I call in Monday afternoon and spoke to a XXXX ( compliance dept ) and he said I should be receiving a call later on that day. No calls. No emails. No communication. I email XXXX on Wednesday to ask if there's an update. His response, " I'll call you this evening. End of the month rush. '' Wait ... shouldn't mine be included in the rush? I mean, I qualify according to your guidelines. But that email told me something ... ..they were never comfortable approving me in the first place. Instead of being straight up about it ( like other companies ), they dragged it out, questioned it, made me prove stuff they didn't care to have proven. They were just pulling me leg the whole time and took a month to do it. They were going to make me pay {$1500.00} ( minimum ) for an income analysis from a CPA they had no intention of using. When all of that failed, XXXX made sure ( either that or the underwriter ) that 8 months of bank statements were conveniently missing so that I wouldn't get approved. I know for a fact they did because he sent a fake concern for the situation only to not do it because other loans were more important. They say my income was too inconsistent for them to feel comfortable approving me ... .which is highly unfair and unjust to say considering they decided to remove my consistent income due to NSF charges. Overall, terrible company ... and not because they didn't approve me. I know my situation is unorthodox and complex and I've been denied before. But other companies didn't play these games.

During loan origination, lender XXXX XXXX asked me to fill out an XXXX authorization form while leaving the max authorized amount blank, which I was not willing to do. The loan very nearly didnt happen over this issue. First they told me the payment amount would be {$480.00}. Then it was updated to be {$990.00} which was to include PITI + HOA dues amount. I was certain I would be paying HOA dues on my own and not the servicer, but under threat of loan cancellation if I did not comply, I provided an accourate ACH authorization form to Athas Capital on XX/XX/2021 which I was told would be used to make scheduled payments. I further provided a voided check and recent account statement to corroborate the information I provided on that form. At loan signing the notary gave me a ACH form to complete. I did not have my banking information with me at the time and said I had already provided one to Athas Capital. It also contained the incorrect, lower amount of {$480.00} as a monthly payment amount. I called my loan officer, he apologized profusely and said they would take care of the form on their end. Notary still requested that I sign the document anyway, even though it was not filled out. Youll notice that someone filled out the ACH information from signing. Not me. Loan officer said someone from Athas Capital would fill it out using the information previously provided. However, it was an incorrect transcription that transposed some of the account numbers. Date was added and a different authorization amount was added electronically after the fact. Are not these actions illegal? XX/XX/2021 an email from Athas said that your payment is set up on ACH to come out automatically from your bank account. No need to do anything else on your end. Out of nowhere, on XX/XX/2021 I received an email from servicer " XXXX XXXX XXXX XXXX XXXX '' saying my payment was rejected. I was charged a late fee and NSF fee. XX/XX/2021 I called XXXX and explained the situation to the rep, who understood and sympathized over the situation. He said he was authorized to waive the NSF fee if I made payment by phone ( which I did, excluding the unjust {$48.00} late fee ), but that I would need to resolve the late fee with Athas Capital. XX/XX/2021 I emailed everyone I knew of at Athas Capital, and the rep at XXXX and XXXX explaining the above. To this date no response has been received from any party. XXXX XXXX I receive a Notice of Servicing Transfer from XXXX dated XX/XX/2021. XX/XX/2021 I set up my online account with XXXX. The rep attempts to assure me -- as did Athas Capital in the XX/XX/2021 email -- that they already have my correct bank account number and that I dont need to worry about anything. However I can see it too, is the incorrect bank account number provided by the notary to XXXX, then from XXXX to XXXX. I spend nearly 30 minutes on the call with her in an attempt to resolve. She says I can always call back in about a week or two when they will have more information. Please note emails and their corresponding attachments that I am also including, for full documentation of this issue, and screenshots shown below showing the XXXX online portal does not allow me to correct this error.

In XXXX 2015 we obtained a mortgage with ATHAS Capital Group, Loan No. XXXX The loan documents XXXX attached XXXX states that payments should be made to XXXX XXXX XXXX XXXX located in XXXX, CA. We have sent payments to this address successfully using the loan number above, until XXXX, 2015. After sending check XXXX. XXXX on XXXX XXXX, 2015, we were informed on or about XXXX XXXX, 2015 that payment was not received. In following up on this notification with XXXX Customer Service on XXXX XXXX, 2015, we found that the Loan NoXXXX did not exist in XXXX XXXX system - we used the property address to look up the account. We were told that ; 1 XXXX the account number was not XXXX but XXXX ; 2 XXXX that the XXXX 2015 and XXXX 2015 payments had not been received and ; 3 XXXX our statements were being sent to an unfamiliar XXXX XXXX XXXX XXXX Washington XXXX The XXXX 2015 check has not been returned and the amount was not withdrawn from the account, also at that time the XXXX 2015 check had not posted either. Further we found that no action had been taken on an XXXX 2015 request XXXX email record attached XXXX to shift the payment date from the XXXX to the XXXX of each month. And that the entire mortgage would need to be rewritten if the lender, ATHAS Capital Group agreed to the payment due date each month. In addition, XXXX XXXX XXXX had been in direct contact with ATHAS by phone and received no resolution or decision regarding this matter. On XXXX XXXX, 2015, after talking with XXXX Customer Service, the following actions were taken ; 1. stop payment on check numbers XXXX for XXXX 2015 and XXXX for XXXX 2015, at {$35.00} for each stop payment, totaling {$70.00}. 2. requested billing statements and communication be sent to an address that belongs to us so that payment coupons can be available for mortgage payment on the XXXX of each month. 3. authorized correction of the erroneous billing address and that all related correspondence or issues regarding the mortgage be directed to the proper person for payment and resolution of issues. 4. XXXX emailed a statement for past due mortgage payments for XXXX and XXXX 2015 showing non-receipt of both payments and late fees/penalties ( attached ) On XXXX XXXX, 2015 we received a default letter from a company called XXXX, we were told by XXXX that this company XXXX is a sister company with ATHASOn XXXX XXXX, 2015 - added a second signature and sent the authorization to XXXX then resent the correspondence a second time to verify his signature. On XXXX XXXX, 2015 we informed XXXX that ; 1 XXXX XXXX checks had stop payment on them ; 2 XXXX the payments would be mailed again with the new account number ; 3 ) we expected any fees to be reversed and default collections to be stopped and ; 4 ) that a complaint would be issued to the Consumer Financial Protection Bureau so that all parties will be on the same page regarding the account.

Athas Capital Group Inc. is advertising Business Purpose - DSCR loans on its Website to the public. My family would like to purchase a condotel in XXXX XXXX, SC ( note, a condotel is the same as a condo accept condotel units offer Hotel style short-term rentals ). Athas Cap advertises the type of business loan I need. This is why I chose Athas Cap. My complaint is twofold concerning two properties. My 1st complaint is for XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, SC XXXX. I went under escrow after I received Conditional Approval from Athas Cap. This property has since fallen out of escrow because Athas Cap failed to secure my loan. All that was left was to receive Clear to Close from Athas ' Underwriter ( s ) and upon receiving XXXX my Athas Cap Account Executive, XXXX XXXX, would notify my Title Company, XXXX XXXX, of the Clear to Close so then XXXX XXXX could schedule a Closing Date. The continuous promises by XXXX XXXX and Athas Cap went on for days, which turned into weeks, which has turned into months. The Seller provided extension after extension. It became well known amongst XXXX XXXX XXXX that XXXX XXXX was failing to provide loans as advertised. My understanding from an XXXX I know well is that, of his 12 loans, Athas Cap has only funded 1 out of 12. All others fell out of escrow, including his own, for failure to acquire the necessary funding. Each of these consumers, including my family, have lost our properties because Athas Cap falsely advertises a product to the public which they fail to provide. My 2nd complaint is for XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, SC XXXX. This complaint is similar to above accept that I am still under escrow for the property. I fear losing this property because of Athas Cap. I request that Athas Cap either provide DSCR - Business Loans like they advertise or they are audited to find out why. If Athas Cap is found to be out of compliance then shut them down. Athas Cap does not serve the public 's best interest, erodes consumer confidence, and has negatively affected many homebuyers in the worst way possible -- not providing what it advertises it will do -- to the point where families lose their property.

Failure of in document preparation. Statements mailed to the wrong address and never received since XXXX 2015. The fact that the borrower has dealt the XXXX different entities and XXXX different employees in an attempt to resolve payment, billing and mailing issues is troubling. The fact that payments were returned on XXXX XXXX, 2015 as " unable to process '', stating " the property is now in foreclosure '' is alarming. The borrower has been bounced around between representatives of XXXX, Athas, XXXX and now XXXX XXXX XXXX. The borrower has attempted to resolve servicing issues with the following employees from XXXX, XXXX, XXXX and XXXX XXXX XXXX : XXXX - XXXX XXXX - AthasXXXX XXXX - AthasXXXX - XXXX XXXX - XXXX XXXX - XXXX XXXX XXXX XXXX - XXXX - XXXX XXXX was finalized in XXXX 2015 based on the XXXX XXXX, 2015 loan application, Initial_Disclosure_XXXX ( attached ). The final loan document was prepared with an incorrect mailing address then passed to XXXX XXXX XXXX for servicing. In a XXXX page letter dated XXXX XXXX, 2015 ( attached jpg files ), XXXX people were referenced for more information and resolution to the foreclosure. XXXX XXXX of XXXX XXXX XXXX and XXXX XXXX of XXXX Foreclosure Department, I learned yesterday, ( XXXX/XXXX/2015 ) that neither woman had knowledge of the letter, XXXX XXXX was emailed a copy of the letter yesterday ( XXXX/XXXX/2015 ) and has promised to get back to me with more information. The borrower first contacted XXXX XXXX six days ago ( XXXX/XXXX/2015 ), I learned yesterday that XXXX XXXX actually works for XXXX XXXX at XXXX, not XXXX XXXX XXXX as stated in the letter. Further, the correspondence was mailed to the wrong city and took XXXX days to arrive ( XXXX/XXXX/2015 ) at the correct address. Just as the statements were mailed to the wrong city and never arrived. This is no way to do business.

I applied and got a mortgage from ATHAS CAPITAL located in XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, CA XXXX on XX/XX/2018 and was given a 6-month bridge loan on my primary residence. 1st complaint is ATHAS CAPITAL during the loan process did not give me a set of disclosure outlining the terms of the loan for me to compare to loan documents. The loan had a balloon rider, but also had a 10 % penalty of the total loan amount which equates to {$55000.00} for the being late refinancing. That took away 10 % equity of my home along with a default interest rate of 18 %. This was never disclosed to me or I would have never signed the loan. I also asked for a copy of this from them and told me they did not know what I was talking about. They made me sign disclosures via docusign in which they did not allow me to have a copy as they left out my email. This is criminal. I want a copy of the disclosures I signed for lawsuit purposes and I want to see if they can corroborate the same loan terms in loan docs than in disclosures. 2nd complaint is after default I was asked to figure out how to refi or apply for loan modification. I immediately filled out loan modification paperwork and 1 month later after the XX/XX/2018 default I was denied the modification due to the fact they do not offer loan modifications and used the time to file NOD. This was deceptive business practice and I want an investigation of this company ATHAS CAPITAL and XXXX XXXX for steering and loan products that produce the stealing of homes of senior citizens. I am a XXXX XXXX XXXX man.

To whom it may concern, I have applied for a primary home loan with the aforementioned mortgage lender on XX/XX/2019. I supplied lender with all documents as requested by them in a timely manner and was issued a conditional loan approval with XXXX, which expired XX/XX/2019. All of my outstanding conditions were submitted to lender no later than XX/XX/2019. I was told by the loan originator that I will be closing no later than XX/XX/2019. The lender has not provided any updates to me in regards to the status of this loan since XX/XX/2019 other than a few emails from the Sr account manager stating that " he is working on it ''. My loan originator, title company, and myself have been trying to reach them multiple times daily with no luck. I have been a XXXX for many years and have never been so appalled at how unprofessional this company has been. Because it was stated that I was able to close no later than the XXXX of XXXX I am now in default of the contract and will loose my earnest money deposit along with the other monies spent during my dealings with this company. The biggest issue I see is the fact I was never provided a loan estimate after my initial application. I have requested this because when they sent me my conditional approval it was for a higher amount down, which is not what I originally applied for. Thank you for your time and consideration.

I used Athas Capital located in XXXX, CA to refinance my property. There was a lot of issues before we even closed which should have been an indicator not to proceed. They sent out a paralegal to my home to do the closing. I was not provided the HUD statement prior to the closing and when I saw the HUD statement along with what my monthly payment would be I contested it due to the escrow being so high, but the paralegal told me I could just sign the papers and question it as documentation wouldn't be submitted for a few days. I sent numerous emails about the escrow and then was told it was too late we closed. This was in mid XX/XX/2019. I have been trying since then to get the escrow figured out. I owed back taxes and money was taken out at the time of closing to pay the back taxes which were never paid. Escrow was taken out of my loan at that time also based on the back taxes for future tax payments and my monthly escrow payment is also based on those back taxes that should have been paid. I have been asking for an escrow analysis since XXXX. I have asked them to contact the assessor to get the updated information. I just keep getting the run around. Now they are telling me I have to make my first payment. If it's not one thing it's another.

I had a mortgage with XXXX XXXX XXXX. XXXX XXXX XXXX transferred the title of the house to XXXX XXXX XXXX and I bought the house free and clear from XXXX XXXX. I used a hard money lender named Athas Capital and I borrowed {$130000.00} and purchased the home. Somewhere along the lines fraud came into play. XXXX XXXX XXXX says they never transferred the title to XXXX XXXX and that they still own the house. Meanwhile, I closed on the house with XXXX XXXX XXXX and Athas Capital and they say they own the house. Meanwhile, I have two banks saying they own the house and if I don't pay them, they are going to foreclose on the house. Now I am stuck paying 2 mortgages over $ 3000+ for a {$130000.00} house and I can't afford it. I have been asking both mortgage companies to figure out who owns the house but they both won't. I have been paying 2 mortgages now for almost a year and its really crushing me financially. Both of these mortgage companies have title insurance and one of them needs to exercise it and recoup their loss.I need your help to make them settle this.

An appraisal was conducted and a copy of the original appraisal report was not properly turned over to us. We received a copy of the appraisal with black and white photos, when the appraiser submitted the report with color photos. Upon requesting the original copy ( with color photos ), upper management advised that color copies are for internal use only and would not provide any other reason for not providing the original copy with color photos, nor would elaborate on why they could not provide a copy with color photos. It was pointed out that an appraisal with color copies was provided in XX/XX/XXXX, so why couldn't a report with color photos be provided in XX/XX/XXXX ( these are two seperate appraisals ). Upper management refused to answer the question. If the law specifies that a copy must be provided to the home owner, shouldn't it be an exact copy of what the lender has, and in this case that is a copy with color photos.

When I applied to cash out my recently acquired investment properties at Athas Capital Group, XXXX XXXX told me that they would approve the cash out loan based on the actual market value at appraisal, not the purchase price because we acquired the properties at very low prices. However, after Athas Capital Group checked my credit score, they told me that they could only approve the loan based on the purchase price. XXXX XXXX cheated me to submit my application and business checked the credit score, now this business must remove this credit check from my profile as soon as possible. If XXXX XXXX did not promise to approve the cash out loan based on the actual market value, I would not submit the application.

On XX/XX/19 - I closed on a refinance with Athas Capital Group XXXX Inc., XXXX. As of today, XX/XX/19 - the loan has not disbursed funds yet. It should have disbursed on XX/XX/19 and did not. The lender ordered inspections AFTER the disbursement period was over and did not follow up, to insure it was within the disbursement period. I feel they are in violation as the rescission period is for the borrower 's benefit and not to be used to delay funding by the lender. There was no disaster at my location, nor named a disaster as Hurricane Dorian did not hit my area. XXXX XXXX XXXX.
