Our mortgage company is Astoria Federal Savings. In XX/XX/XXXX my husband and I came to our hometown in XXXX to help establish a XXXX in an impoverished community. We have done XXXX XXXX and XXXX XXXX XXXX for our entire adult lives. We already owned property in XXXX and would be spending time in XXXX and in XXXX on a part time basis. We did not move our furnishings and our XXXX adult children and XXXX XXXX continued to live in our home in XXXX while we are fulfilling our XXXX XXXX here in XXXX. Our plan is to return to our home permanently in XXXX when our XXXX XXXX is complete here because we want to be with our children and grandchildren. When we are in XXXX we stay in our home there along with our children. I started a part-time temporary job in XXXX with the XXXX XXXX. My husband is retired XXXX XXXX. I started the XXXX XXXX to help continue our mortgage in XXXX. In XX/XX/XXXX that job ended and also we received a letter from our mortgage company saying that our ARM mortgage was ending after 10 years and the letter showed our new payment which would double our payment. We knew it would change in 10 years but we did not know that our payment would double. This was shocking and created a very stressful hardship with paying our mortgage. I contacted the mortgage company to see what could be done. We thought surely they will work with us and help us by adjusting our payment agreement and allowing us to work out an affordable option. This was just the beginning of this nightmare. As instructed by the representative I requested a loss mitigation package from my mortgage company and filled it out including all details and documents requested. After many additional requests for the same documents over and over and over again, we were turned down for a modification or forbearance because they stated that we did not have enough income. We appealed and resubmitted the loss mitigation package about 4 or 5 times over the course of time from XX/XX/XXXX up until present day. My husband and I have submitted documents continually throughout this course of time including, letters, bank statements, tax returns, pay stubs, leases, rental agreements, explanation letters of spending, deposits, withdrawals, expenses ; We have made countless phone calls, received countless letters and threats of foreclosure, legal documents and such without successfully receiving a modification. We have sent countless emails and scanned countless documents continually. I saved every document. I have a large shopping bag full of them. I have every email that I have sent to them with documents attached since XX/XX/XXXX. Every hoop they asked us to jump through we have done it to try to save our home. I wrote a letter to the president and officials at Astoria hoping to appeal to them and that by chance one of them would at least talk with me but my letter was passed on to others and I received only more papers detailing everything that I already knew which was, we are not going to help you. I obtained a full time job in XX/XX/XXXX and my husband obtained part time work in addition to his retirement pay, We do this in addition to our XXXX XXXX because we want to keep our home. We submitted again with all of our new income and information. Our income also includes rental income and our daughter covers the utilities at our home in XXXX. Our income also includes a monthly housing allowance that we receive monthly from our XXXX which offsets our living expenses. Everything they requested and asked for we sent it. With such a significant change in income we were sure we would receive help. Once again we received a letter on Thursday XX/XX/XXXX saying once again that we do n't have sufficient income and no offer of modification. We are beyond disappointed stressed and fearful that our beloved family home will be lost and our daughter and grandson will be uprooted without an affordable place to live. I am totally frustrated and I feel that this company has bullied us, dismissed us, toyed with us, and has totally disregarded our claims. After paying faithfully for 10 years I feel that they have decided to snatch our home away without giving us a chance to start over and begin payments again. I believe we deserve this opportunity. I believe everyone who experienced the housing crash should be given a chance to keep their homes. We like many families did not have full understanding of what could happen with our payments nor did we understand that a housing crash would take place. Astoria no longer offers the loan product that we received in XXXX and its unfair to us as consumers not to be given another chance. Astoria should take responsibility for their part in this too for offering a product which later would cause many families to lose their homes. Our home is severely underwater. We owe XXXX but the house in only work XXXX however we are willing to still pay the loan if they modify our principal, interest rate, or anything to give us a chance. I have asked what income was counted in the decision and I have not received any detailed answers. I also asked what does our income have to be to quality but they have not provided that answer either. After over a year and a half of the threat of foreclosure hanging over our heads I believe we have been severely wronged and stressed beyond measure. No family should have to be tortured in this manner. We worked ourselves to the bone to achieve home ownership and we feel that this company has not considered or regarded our situation. Our lives are deeply affected by the thought that we will not have a home to return to. We want to keep our home and we believe there is no benefit to refusing to give us a chance. Snatching our home from us, selling it at a huge loss will not change the life of Astoria Federal but it will devastate our family. We are just asking for a chance. I understand that certain lenders were not mandated or ordered to help their clients because of the housing crash and loan products which are no longer offered. I believe that it is just plain wrong and evil to refuse to help those of us caught in this type of dilemma. I am also disappointed that my husband who served his country for almost 25 years and used his XXXX XXXX income to obtain our home is not being considered for a loan modification. This home was purchased for us to retire and grow old in. This home is part of our security as we age. We would appreciate any effort or gesture from Astoria Federal to give us an opportunity to keep our home. We would appreciate an opportunity to sit down face to face and discuss this with those at Astoria who can make a decision to help us. In good faith we are willing to pay our debt.

Astoria Bank steals from a XXXX Identity fraud victim while she was in the hospital. Identity Fraud, It is a scary situation, even more difficult when you find yourself moving back and forth from a XXXX to a XXXX assistance program. But what do you do when your bank also seizes the opportunity to steal from you and from the taxpayers, stating " it is not our fault you are a victim of Identity Fraud. This bank did n't make the error '' XXXX XXXX came to New York XXXX years ago with her husband for medically related issues. XXXX based on her medical situation, no private insurance would pay for a XXXX. Since only XXXX XXXX in the country were qualified to perform this XXXX, they found themselves in New York. Her situation was very dark. After losing their home, cars, and business to a medical bankruptcy, they made their way with a very slim hope of surviving. While others were fighting " The Great Recession '', XXXX and her husband had to face XXXX, XXXX, XXXX, XXXX, Social Security, XXXX XXXX XXXX, XXXX ... on and on and on, all while significant budget cuts were being made. " I felt like I was a criminal, constantly begging and pleading for help to survive '' Top it off with a hospital bed every XXXX weeks based on an XXXX. In all XXXX XXXX totaling over XXXX days, XXXX XXXX and XXXX XXXX, XXXX XXXX, XXXX of doctors ' appointments, XXXX, XXXX, and XXXX all while trying to survive on a net XXXX income of {$770.00} after the government copays and premiums. Since they were only granted up to XXXX hours a day in XXXX, XXXX had to take care of his wife the remaining time, thus limiting any chance of employment. They also had to wrestle the fact that they were not allowed to make any additional income because they would have lost all the medical coverage and benefits they needed to survive. Their only option, to do the best they could to survive in New York on less than {$800.00} per month. XXXX and XXXX never lived a life of always taking and never giving back. Though they were stuck in this situation, they feared become a drain on society without doing their part to give back, no matter how small that was. They also felt alone since they were just a number or a case to many government agencies, Hospitals, etc ... To compensate, and to show appreciation for what little they were given from the government and the taxpayers, XXXX ( and XXXX when possible ) would donate their time to their church, dialysis centers, and many other non-profits like WOOinc - an inner city youth development program in XXXX. During one of XXXX 's XXXX, XX/XX/XXXX, XXXX and XXXX fell victim to Identity fraud summing up over {$1000.00} of charges through XXXX. Like most Americans, accounts were linked, in this case XXXX was linked to her bank account and this started a chain event of bank fees and charges. Most conspirers of identity fraud now use different websites and smaller dollar amounts, instead of one lump sum, causing an even more difficult time proving/getting the charges reversed.. Like all of us who have fallen victim to Identity fraud, XXXX did what they had to do while his wife was at home with the nurse aide. They filed the police report, who also directed them to the FBI since it also included a web based sites. XXXX, contacted XXXX and Astoria and filled out all the necessary reports/documents. XXXX

I am writing in the hope that you can assist me in my over yearlong effort to have XXXX XXXX unitsCoordinate to assist me. I thank you in advance for reading my letter. I have a mortgage from XXXX for my condominium in Florida, purchased in XX/XX/XXXX. Thiswas and remains my property and the one that I hope to retire in with my family. The loan was and remainsan interest only loan for {$460000.00} at a rate currently of 3.750 % Like so many other Floridians in the past few years, I faced financial difficulties which put me behind in mypayments for a number of months. Two years ago, I was able to resolve all issues with XXXX and fulfilledtheir conditions that allowed me to a ) avoid foreclosure and b ) achieve a good standing in Astoria 's eyes. Atthat time, they asked me to ensure continued timely payments, secured at 3.50 % rate until XX/XX/XXXX recently received the notice that the rate will increase onfrom {$1900.00} to {$2000.00}, with the rate increasing to 3.75 % and for interest only. My problem, and the reason I am writing to XXXX and now to you, is that for over a year, I have beenspeaking with their loss mitigation department and provided documentation to every document andquestion they asked. Please understand my frustration since after all this time, they tell me that do nothandle refinances - precisely what I have been asking for. As I have presented in the documentation, I havebeen able to better my financial standing significantly, both my reducing my debts while increasing myincome substantially. In XX/XX/XXXX I contacted the refinance department and spoke with XXXX XXXX XXXX, who was veryenthusiastic when taking my information and providing me information on your refinance programs, specifically of interest because as an Astoria customer I could avoid some or all closing cost. On XX/XX/XXXX, at XXXXXXXX, XXXX & lt ; XXXXXXXXXXXX & gt ; wrote : Hi, I need you to replyto the other email that I sent that has a subject line of " Rate lock '' XXXX XXXX XXXX NMLS # XXXX. XXXX Italics added XXXX. I did so and spoke with her the next day. She said she would call me back rightaway and after not hearing from her for a week, I called only to have her tell me that because I was workingwith the Loss Mitigation department, I would not be eligible to refinance with Astoria. When I spoke again with the Loss Mitigation department, they explained that they only handledmodifications on the current loan but that would not include any long term agreements, i.e., any refinancingof the loan. They also stated that they recognized my point and that their departments do not speak toeach other and that this " was something Astoria was working on ''. Astoria 's Loan Mitigation department has all the information they have requested, and since I have had toupdate their request on multiple occasions, I can easily and quickly provide the most updated within 24hours of the request. I would be extremely grateful for the Bureaus assistance in getting Astoria to respond to my request tomove from an interest only loan to a fixed rate. Thank you.

To whom it may concern : I was reading on your site about " dual tracking in foreclosure '' and how there are laws prohibiting such an act. I would like to make a complaint against Astoria XXXX and the XXXX XXXX XXXX XXXX and XXXX & XXXX XXXX for violating this law. I would like to reference my previous case number XXXX as supplemental documentation for my complaint against XXXX ( Astoria XXXX ). In XXXX XXXX we were forced to file bankruptcy due to my spouse 's lack of finding gainful employment and after draining our bank account of all our savings when the mortgage company denied the short sale. Since our discharge in XXXX XXXX, we have received numerous calls and letters ( sample attached ) that say " This document is an attempt to collect a debt, and any information obtained will be used for that purpose. If you are in bankruptcy or, have been discharged in bankruptcy. This letter is for informational purposes only and does not constitute a demand for payment in violation of the automatic stay or the discharge injunction or an attempt to recover all or any portion of the debt from you '', the entire statement is contradictory to bankruptcy laws when the mortgage company and lawyers state the same thing but they are trying to collect a debt. Since XXXX we have had discussions with the mortgage company and have decided to try to loss mitigation route again to keep our home. We received our package in early XXXX and sent it back as soon as we could. The receipt is attached. While going through this process, the company intentionally foregoes the time to evaluate packages and plays games with the paperwork to make sure the time passes with no assistance. I have attached proof of how the original package request and document checklist is different from another package which came after the original. At this point, if they wanted to foreclose on the property why call and offer a loss mitigation package. Previously in XXXX and XXXX, I have submitted all the same documentation to no avail. Now, no less than a week after they receive the package, we receive a notice of a foreclosure sale XXXX XXXX, XXXX, from XXXX and XXXX who represent Astoria XXXX. There has to be some accountability for this sort of harassment even after we filed bankruptcy. We have kept this house in good shape while were here and maintained the utilities and upkeep hoping the mortgage company would stop playing games and refinance the home to something affordable, but once again you will see by the attached email it is no use. I am supplying all the documentation I provided to Astoria, and the redacted information is the same information I sent to them which was removed because it has our social security numbers and we have been victims before of identity theft. As you will see redacting our social security numbers and bank account numbers will be another reason for denial. Please have someone look into this, I have spoken to an attorney on the matter, but I am hoping to resolve this without having to take that route.

To Whom It May Concern : This letter is an explanation of why we are requesting a short sale of our current home to Astoria Bank. My spouse was laid off due to a reduction-in-force from her job in XX/XX/XXXX. When this occurred I requested a deferment of payments for a few months and a loan modification to be applied to the end of my mortgage loan. The request was denied even though I had given Astoria all the necessary information requested ( hardship letter, pay stubs, bank statements, taxes, budgets, bills, and letters of explanation ). To further increase the severity of our financial situation at the time we had a rate adjustment on our current loan, which increased the mortgage by additional {$1500.00} dollars. Since then my spouse has been unable to find steady work and has been taking temp jobs to try and assist with helping to make ends meet. We did not think that it would be this difficult for her to find employment which would sustain our household, but it has. We have drained our bank accounts checking and savings to almost non-existence and have only been able to make payments up until this point by borrowing from friends and family to help us make our mortgage payments and to make ends meet. Early XX/XX/XXXX we pursued the short sale avenue, received an offer on our home and have submitted a short sale package again to our mortgage company Astoria Bank, which is trying to use deceptive practices to deny this transaction, by requesting the same paperwork over and over again. They are coming up with reasons to deny the short sale, which we will have no course but to continue down the foreclosure route. We have provided ( hardship letter, paystubs, bank statements, taxes, budgets, bills, letters of explanation, and two years ' worth of data ) and they still request more and say the package will be denied. We can no longer support the payment with XXXX steady salary in our household. This has been great financial burden on our family and very stressful time in our lives. Our household incomes as I have mentioned before has been reduced of 46 % of take home salary and an increase of 80 % on our mortgage loan, with another pending adjustment coming. We are customers in good standing currently with this bank, and have never missed a payment, but this has now come to where we have drained every dime. We tried to get the process completed before our bank account became empty, and a year later Astoria is being very difficult ; The bank drawing this process out seems as if they want to force our offeror to withdraw and force foreclosure which makes no sense to us. Our realtor says they have never seen anything like this ever, and believe Astoria is being deceptive in their practices. Please let us know if there is any action we can take as consumers against such practices.

I had a mortgage on a Coop apartment with Astoria Bank and as a result Astoria Bank was holding the Proprietary Lease and Stock Certificate. Upon selling the Coop apartment, Astoria Bank informed us that they had lost the Proprietary Lease and Stock Certificate and sent us an " Affadavit of Lost Assignment Assumption and Consent to Transfer of Proprietary Lease. '' As a result of Astoria Bank losing the Proprietary Lease and Stock Certificate, I had to obtain a new Proprietary Lease and Stock Certificate which cost us {$800.00}. As explained to us by Astoria Bank 's representative at the closing and in Astoria Bank 's own affidavit Astoria Bank is obligated to reimburse us the {$800.00}, which it still has n't done despite my best efforts through constant letters, faxes, emails, and telephone calls. In Astoria Bank 's own affidavit they state " the Bank was the last holder '' and " the Bank shall indemnify and hold harmless XXXX. '' This issue has been outstanding since XXXX of XXXX and today is XXXX XXXX, XXXX, so this simple matter has been unresolved by Astoria Bank for over 10 months. Astoria Bank has been unresponsive to my frequent contact over the past 10 months and they have n't been able to put me in contact with anyone who can help resolve the matter. I 've requested to be put in contact with Astoria Bank 's research department that is researching the matter, their Compliance department and their Ethics hotline but my calls never make it past Customer Service and they tell me that I ca n't reach any of those departments directly to resolve the matter. From my perspective the issue is easy and straight-forward. Astoria Bank was holding documents that they were responsible for and lost them and now they should reimburse for the replacement of those documents. This is all spelled out in Astoria Bank 's own " Affadavit of Lost Assignment Assumption and Consent to Transfer of Proprietary Lease, '' which was issued and signed by Astoria Bank. In addition to sending Astoria Bank their own affidavit stating the facts, I also sent Astoria Bank the paid invoice that I received for the new documents, as well as a copy of the check used for payment. I do not understand why Astoria Bank has continued to drag its feet in resolving the simple matter for so long and why Astoria Bank makes it so challenging to get help on the matter. I suspect that they 're hoping that I grow weary and give up on the matter so that they avoid the reimbursement and steal my {$800.00}. This is not right and it is unethical and Astoria Bank should be reviewed and punished for how it handles this and similar complaints.

We have had our mortgage with Astoria Federal Mortgage Corp, recently changed to Astoria Bank, since XX/XX/XXXX. We have had an adjustable rate with this lending institution from day one and have been trying for 10 years to modify our loan to a fixed rate so it does n't continue to adjust yearly. In XX/XX/XXXX we tried for a modification, but we were denied because of lack of income and the collateral was not sufficient. But we continued to pay our mortgage for the last 10 years and have never missed a payment until XX/XX/XXXX. On XX/XX/XXXX our family encountered a true and devastating hardship. With a 2 day notice and no severance pay my husband lost his job of 15 years unexpectedly and through no fault of his own. We reached out to Astoria on XX/XX/XXXX and spoke with XXXX and she reassured us that this happens and our payments would more than likely be reduced our rolled into the end of our loan. We were hopeful. We immediately filed paperwork with the Loss Mitigation Department at Astoria. We contacted the Hope hotline and talked with a counselor, XXXX, who told us we were clearly eligible for certain programs put in place by the government to help families like our own. We also reached out to our local HUD agency and worked with a counselor, XXXX XXXX. Well after all that we received a phone call from XXXX XXXX from Astoria on XX/XX/XXXX ( but just received something in writing through an email today XXXX/XXXX/XXXX which put us past the 14 day appeal window ) that the committee would again deny us any modification because of lack of income ( no kidding ) and that they do not participate with HAMP. Lack of income is the reason we are in this situation in the first place. So at that point we were 2 months behind on our mortgage and incurred 2 late payments of {$160.00}. Our credit score dropped XXXX points in 3 weeks from excellent to fair. We are responsible people and have always paid our bills on time. We are still just trying to provide for our XXXX beautiful children on what little savings we have. We did come up with the past due mortgage amount and are now current on our loan. My husband is back working and we are trying to get back on our feet. We just want a modification so our rate does n't continue to change yearly. Sad when we have continued to pay our mortgage when they said we could n't, but with no help ever in the past 10 years, Astoria just continues to adjust our rate yearly. Predatory lending at its best ...

I had a foreclosure date schedule. I called the bank and I requested for a short sale being that my daughter was in hospital at that moment having XXXX. It was so stressful I did n't know what to do so they suggested that I can do a short sale. They send me the short sale documents and told me to complete the paper work and send it to them. Knowing that a foreclosure date was schedule for X/XX/2017 it was never cancelled and when they received the documents they told me that it was foreclosed already and it did n't matter. My daughter is very sick and I can not move at the moment.

XXXX XXXX is an Asset Management which is an investor and have absolutely no consideration for my daughter illness and our situation.

I had a five year interest only loan and I try to modify three times and first they said my income was insufficient the second time my income was to high Astoria bank never tried to help with the modification and knowing that I was going through so much stress lost my job during that process because my daughter illness they just fine the right time to foreclose without my knowledge and the last was they will consider a short sale.

The servicing company is a Mortgage company by the of XXXX XXXX XXXX in XXXX XXXX, Illinois. That is the company that did not accept the short Sale waited for the date letting me know that it will postpone and foreclosed. The servicing Company XXXX XXXX told me it was to late the own the property and purchase it for {$100.00}. Last package was sent to XXXXXXXXXXXX Phone # XXXX Fax # XXXX toll free # XXXX Right now XXXX XXXX XXXX XXXX XXXX requested for my phone number in an aggressive way and my daughter with the home attendant did n't know what to do. Unfortunately I fell behind on my payments to Astoria Federal Savings overdraft line of credit in XX/XX/XXXX. Astoria Federal reported this account as charged off in XX/XX/XXXX and XX/XX/XXXX. I paid the principal and interest on this account in full in XX/XX/XXXX. The account was closed and no further advances were ever made. FCRA 623 ( a ) ( 2 ) requires any party who has furnished information to a CRA to promptly update that reporting as necessary to maintain its current accuracy. Astoria Federal was thus required to update their credit reporting to keep it current and accurate. Astoria Federal failed to update the account status from " Charge-off '' to " Paid charge-off '', and omitted my payments from the reported account history. THIS CONSTITUTES A CLEAR VIOLATION OF THE FAIR CREDIT REPORTING ACT. ( Astoria Federal did update the balance to zero at the time the account was paid. However this is not equivalent to reporting the account as paid as there are many reasons a charged off account could report a zero balance, such as the debt being sold to a collection agency. And besides the balance, Astoria Federal persisted in reporting the account status and account history inaccurately. ) I attempted to obtain relief innumerable times by disputing this matter via the credit bureaus ; and while this should be an open-and-shut case Astoria has never corrected its reporting. ASTORIA 'S FAILURE TO CONDUCT A REASONABLE INVESTIGATION TO CORRECT THIS ERROR CONSTITUTES A SECOND VIOLATION OF THE FCRA. Furthermore, Astoria 's reaction to the disputes has been to falsely report the account history to show that a default occurred at the time of the dispute, i.e., approximately FOUR YEARS after the account was paid and closed, in XX/XX/XXXX and XX/XX/XXXX ( see the attached credit report info ). THESE FALSE DATA CONSTITUTE A FURTHER, EGREGIOUS VIOLATION OF THE FCRA. Possibly, Astoria Federal 's erratic credit reporting is due to technical incompetency rather than actual malice.

In XX/XX/XXXX, my XXXX Aunt went into her Astoria Federal local branch in XXXX. She had XXXX CD 's that were maturing in XXXX. I do not know how they convinced her, but she was guided to the " investment desk '' and met with XXXX who convinced her to take XXXX CD for approximately {$12000.00} and an IRA CD worth about {$14000.00} and put them into tax deferred annuities with 7 year surrender charges! There is no justification for this " transfer '' since the annuties are not paying more than the CD 's were, and now she ca n't get at her money without a huge Surrender charge which is currently 6 %. Not only that, but they did not even wait the 1 month until the CD 's matured and it cost her roughly {$60.00} in " penalties '' for breaking the CD. On the Regulation 60 paperwork, they put down that the reason for the transfer was " need for income '', their reason that the XXXX contract could not satisfy the need was " this is a fixed annuity ''. Well a fixed annuity can be annuitized to satisfy the income need, and since it was an older contract, likely would pay out at a higher rate. Again, they did this for commissions. They did not have the best interest of the client in mind. Also in the suitability section of the application they put her investment time horizon as " more than 10 years ''. What XXXX has that investment time horizon? This is a horrible example of banks taking advantage of senior citizens.

My husband and I have mortgage with Astoria Savings. In XXXX, we received a notice from Astoria stating that our mortgage would be increasing due to our 10 ARM. This doubled our mortgage form {$2500.00} to about {$4800.00}. Needless to say, we are unable to make our payments, so we asked for assistance. We were instructed to complete a loan modification application, and submit all of the appropriate documents ( hardship letter, financial information, paystubs, checking and saving acct statements, XXXX statements, etc ). The initial case was being handled by one person, and then we started dealing with another lady ( who requested the same information ). Meanwhile collections is calling us because they want to know when will be making a payment -- oh, did i forget to tell you that because we are now more than 120 days behind, they have accelerated our mortgage, which means they want at least XXXX payments ( that 's about $ XXXX ). It is now XXXX 2016, and they are still requesting information and at no point in time has our file been reviewed to see if and what kind of assistance we would be eligible for. We have reached out to HUD, but they said all they will do is provide the documents ( that Astoria already has ) to the mortgage servicer. We are concerned because we do n't have family that will be able to give us money, and if Astoria does n't grant our loan modification, we will have to file bankruptcy because they will want at least $ XXXX to stop foreclosure proceedings. I think their business practices are deceptive and that they do this to every customer that seeks assistance with no intention of ever helping out the customer. We have been processing a short sale wit h Astoria and their servicer XXXX since XXXX of XXXX . I will spare you all the details of how they lost our documents several times and re-requested items they already had. This is why it has taken a year to process the short sale. The most egregious issue is on XXXX XXXX , XXXX , a counter offer was issued and the buyers accepted the counter offer. All of the requested documentation was submitted to Astoria on XXXX XXXX , XXXX . On XXXX XXXX , XXXX , XXXX indicated they will issue a decision by XXXX XXXX , XXXX . I contacted them several times to follow-up and finally on XXXX XXXX , XXXX , the day after the Federal taxes are due they requested a copy of them to continue the review. It should have been out of review by XXXX XXXX , according to their timeline. We provided the taxes on XXXX XXXX . They indicated this file was not sent to the committee for final decision until XXXX XXXX , XXXX and they will take 30 days to review the offer. It 's ludicrous to require another review, since this is the counter offer THEY issued us, and we agreed to it. What is their to review? Today, I received a call from the second lender indicating if Astoria does n't approve it by XXXX XXXX , the 30 days they set out as their review period, they will rescind their short sale approval and we will have to start over with the entire negotiations. It is completely unconscionable to request a counter offer and when it 's agreed to, indicate you will take 30 days to re-review it. Why would the counter offer be made if it was not approved by Astoria already? It 's not negotiating in good faith or a good way to do business.

I have lost my job and do not make any meaningful money to pay the exorbitant mortgage. I have contacted Astoria Federal many times for assistance and modification but they always refuse to modify my mortgage. I was once given a reason that Astoria Federal do not conform to Federal Regulation and are not obliged to help me in any way. In XX/XX/XXXX, I received a bill from my dentist for {$270.00}. I have him set up on the AstoriaBank bill pay service with the correct payee and correct address. AstoriaBank apparently works through XXXX and I believe it is XXXX bank in XXXX, WI to transmit payments. I paid the dentist through the Bill pay link and later was informed that the payment " cleared '' on or about XX/XX/2016. Despite this my dentist continued to seek payment from me and initially when I looked to secure proof of payment, I received only the front portion XXXX my bank does not provide both sides of paper checks written out through its bill pay service ) of the negotiated check. Eventually, in XX/XX/2016, I received both sides of the check which is annexed. Any review of the check will reveal that wile it is made out to a dentist it was cashed by an auto parts place. It was never properly payable to a car parts place. Astoria has known of this since at least XX/XX/2016, and refuses to restore the money improperly debited from my account until they secure the money from some place else. While they call every so often to provide a status, the simple fact is that they or their agent wrongfully paid out on a check despite the endorsement very clearly reflecting that it was not properly payable to the entity to which they furnished my funds. I am disgusted with how Astoria has handled my loan for months. First my loan was denied because i did not qualify for an affordable mortgage payment due to not enough income. Astoria had me re-apply and has and was promised a fair review, however this did not happened. I have provided enough proof to Astoria that my home is severely underwater. This is really stressful because i am tired off all the excuses Astoria has given in order to deny my loan modification. Recently, i was told to participate in any government modification. I opened a new checking account with Astoria Bank on XX/XX/2016 with an ongoing promotion. Even though I applied online I was asked to come to branch to finish account opening. Once in the branch I pretty much had to disclose all the information I already gave online again, I asked them to confirm {$250.00} bonus promotion for having direct deposit for XXXX consecutive months or XXXX bill pays/month for 3 months and they confirmed I am enrolled. They also mentioned I would receive a {$50.00} direct deposit bonus once I receive my first direct deposit. Surely I received my {$50.00} direct deposit bonus on XX/XX/2016. I kept paying bills using this account and also kept my direct deposits. For the pa st 7-8 years ( maybe more ) our association has provided a fax to confirm the flood insurance is in place. During this time Astoria continuously discards the policy ( some black hole ) and then proceeds to harass for weeks on end about obtain ing proof of insurance. My wife and I take it upon ourselves, each year, to fa x ( to a generic fax ) the policy over. This too becomes lost at times and they wont provide email addresses for us to scan so we can confirm receipt. I contacted my bank and they quickly put the money back into my account. On XXXX XXXX, XXXX the same thing happened again. The same customer presented a XXXX dollar check for cash.with the signature overlapping that same digit to make it look like an eight.This time I was given an overdraft fee of {$35.00} plus the {$20.00} check amount debited from my account. The bank again said this was an error and quickly took the overdraft fee off and promised to put the {$20.00} back into my account within 24 hours. The first time this happened, I would say it was a mistake of the teller. It would almost be impossible for this to happen again with the signature covering that same digit to appear as another digit. Astoria Federal Savings, held the mortgage and reports the mortgage as being in XXXX XXXX " closed and paid '' along with another paragraph which states, " account paid for less than full balance. '' This statement makes the impression that I sold for less than the balance of the mortgage or via a short sale. This is anything but the truth ... I paid them every penny and have the IRS tax records which easily shows the record. The only negative on the credit report was the XXXX 30 day late payment posted to the account in XXXX XXXX. I 've called them, I 've written them, I 've emailed them and I 've even faxed them ... .and not once have they replied. My home insurance policy covers XXXX years for one-time only fee. My mortgage bank ( Astoria Bank ) is supposed to accrue the insurance premium over the XXXX years. Since I am selling my house, I requested the payoff letter to the lender ( Astoria Bank ) several times. Short sale request was denied for a bogus reason. I received a short sale denial letter yesterday that makes no sense and Astoria i s not responding to me. The denial letter states that the short sale was denied due to excessive fees and the offer was too low. The fees on the seller side are NOT excessive - the 6 % realtor fee and 2 % transfer tax for Pennsylvania are traditional and customary - NOT excessive. The sale price of this home is $ XXXX , which is the fair market value for this home. At this sales price, with all sellers closing costs deducted ( again - traditional and customary costs ) - with NET Astoria {$350000.00} - which is BELOW the payoff fo r Astoria. Why woul d n't Astoria resp ond with a counter offer if this was the case - a rejection is just yet another way to delay this file.

5 years ago i did a refinance of my loan with Astoria Federal. At the time the loan was supposed to go from a jumbo to a conforming. Now I am finding out that this did not happen, I was lied to. My current loan with them is still considered a jumbo, even though it is {$220000.00}. I am now trying to refinance into a 15 year fixed. The rate on their page https : //www.astoriabank.comXXXX for a 15 year conforming is 2.75 %. They will not allow me to access this rate unless I pay them {$1500.00}. For their program that costs {$250.00}, they are offering me a higher rate, not the one advertised on their page. This bait and switch of rates is due to their error from last time I refinanced, when they promised me a conforming loan but did not deliver.

I am refinancing my coop mortgage. With a coop the collateral is the stock. My current lender, Astoria Federal, possess the stock. My new lender, XXXX XXXX, has requested the stock from Astoria on XXXX XXXX, 2015. It typically only takes about a week to transfer the stock but as of today ( almost four weeks later ) XXXX has not confirmed if/when they will transfer the stock. I am trying to obtain a short sale approval from Astoria Bank - they ( Astoria ) demanded that they have short sale approval from all junior liens BEFORE they would even consider a short sale. Hi, I sold my house on XXXX / XXXX / 17 and the title company overnighted the certified check for the payoff amount to the lender and the lender received it on XXXX . However, the lender returned the check due to their system error. After the title company received the returned check, the title company had to wait a few days to clear the check. on XXXX before XXXX XXXX ( eastern ), the title company wired the payoff amount again. 3rd request ... Astoria Federal Savings bank is still reporting that the mortgage that was paid off in XX/XX/2014 was " Settled for less than Balance '' with XXXX.
