I owed {$4500.00} in XXXX bills. I was told by their legal representative ( XXXX ) that I needed to pay it in full. I did not have that much money and a garnishment would put a huge financial strain on my family, because we would not be able to pay current living expenses.
XXXX told me that I could enroll in a payment plan. The only thing with that is that they would have to take legal action and so I would owe more fees. The total would be {$6900.00}, but I would not have to pay it all at that time. So my choice was to pay {$4500.00} today or {$6900.00} over a longer period. Why did she need to take legal action in order to accept payments from me? I did n't want to question her because I was scared that she would pull the deal and I would be expected to pay {$4500.00} immediately, which I did n't have.
I have been making payments on time, in fact I have made XXXX consecutive payments. By my calculations I have paid {$3300.00} on this bill. If it was only {$4500.00} like it had been, it would almost be paid off. However since they embellished the amount to {$6900.00}, I still owe almost half of the debt.
In XXXX my debit card number was compromised and someone made some fraudulent charges with it. I called the bank and they cancelled the card. However I had forgotten that this debt collector was attached to the card. Since they always deduct the funds automatically, I never think about it. But when I balance my checkbook at the end of the month, I compare all of my online charges. So when I was looking at my budget for XXXX, I saw the charge that was supposed to have gone to this debt collector and I noticed that it was never deducted from the bank. I immediately called them and spoke to XXXX. She said that they had tried to reach me by phone during the month. They never left any voice mails and my call log on my phone does n't have any missed calls from them. But XXXX said that the bill is due in full. I told her that I could n't do it, and I explained to her what happened in XXXX and I told her that I was calling them on my own to give them my new debit card number because I just discovered the mistake. She did n't care about anything that I had to say. She would n't take payment or my new card number.
She said that I should have alerted them the moment that my car number changed, and although I agree with that, I would have if I remembered that they were using my debit card. Some bills just deduct from my checking account so I do n't need to give them my debit card.
Since she is demanding full payment, I would like to know if adding on those extra fees in the beginning were legal. When we were talking about a payment plan, the bill was nearly {$2400.00} smaller. She did n't have to take legal action as part of our payment arrangement. She could have allowed me to begin making payments on the current bill with the appropriate interest. I did n't have all the money so she knew that they could get more over the long run.
XXXX told me this week that they offered the payment plan as a courtesy. But since I paid nearly {$2400.00} for it, I do n't think that it was a courtesy.
Since XXXX would not allow me to make a payment on my bill, I went online and did it there to show good faith that I want to get it paid off.

Mortgage refinance - Title company found judgement against XXXX XXXX form XXXX XXXX. Although the address and date of birth did not match they would not clear title because somehow, Asset Recovery Group had my SS #. XXXX attorney 's I talked to said they frequently pull that information from data bases without verification. After several conversations with the title company ( WFG ) they ( Asset Recovery ) convinced them beyond a doubt that this was my debt. This is fraud. We were three days from signing ... I had no choice but to pay someone else 's debt or loose my interest rate. {$2700.00}. I want my money back.
XXXX XXXX living in XXXX WA made numerous trips to the XXXX over several years around XXXX. She ended up owing XXXX which she defaulted on. XXXX reported this debt to the credit agencies on XXXX XXXX 's SS and then sold it to Asset Recovery who pulled my SS number from a data base, probably due to the similar date of birth. XXXX XXXX, however, was served at her home -in XXXX!!
All XXXX had to do was look at my credit reports to clearly see I have never lived XXXX and never been to the XXXX. My credit reports are spotless with a score of XXXX XXXX to be found. My children have know me for some time and never once visited me in XXXX.
The date of birth was wrong and in XXXX I had dark red hair - I only stopped dying my hair two years ago but you would not know that, no one ever called me ...
Asset Recovery has stopped giving me information as they are realizing they have made an egregious error, but admitting that opens them up to a law suit. Collection agencies pull SS from data bases and errors are not uncommon. At our last communication they said " we are not sure you are this person. '' They will not provide me the date of birth so I can order the medical records from the XXXX, because as the last XXXX attorneys I have spoken with have indicated ... the XXXX will have the correct SS #. Gee, if I was really this person I should have no trouble getting my own medical records ... thing is I 'm not this person. I do n't know her real SS or her real date of birth.

According to asset systems ( the debt collector ) I had gone to XXXX XXXX hospital back in XXXX. I honestly dont recall going bit apperently I was served papers in XXXX of XXXX for a garnishment suit. They explained that I was served at XXXX by a 3rd party carrier though no signature from myself was required. I attested that I never received anything from them. The debt amount in question is XXXX.
A few days ago I received a letter in the mail stating that I was being garnished starting on XX/XX/XXXX. I checked my credit report and have never seen a bill on there for said amount. When I called them to find out about the debt I was told that I had given numerous excuses why I couldn't pay my debt. One such excuse was that I couldn't talk because I was driving. I am visually impaired and can not obtain a valid driver 's license. It felt like falsified information. After the agent was no help, I asked for the supervisor. I was told that my deadline to dispute the debt ended in XXXX. If I had actually heard from them in the past decade, I would have tried to fix any problems that arose, since I did not hear from them, I had no idea I even had a debt. It's clear that they spoke with someone, but it wasnt me. Up until a few days ago I had no idea the company even existed. I was also told that they would garnish me for 90 days BEFORE they would allow me to make payment arrangements. I had asked for the managers desk phone and the supervisor said that she would not be in until Thursday of this week. ( Yesterday ( I left a voicemail requesting the original bill and have not received any correspondence from the manager.
I just want to get to the bottom of this, if it's a fair debt I will pay it, but too many things dont add up.

in XXXX a judgment was filed against me in XXXX XXXX Case # XXXX for {$12000.00}. Asset Systems has contracted with no less than XXXX attorney agencies to collect on this judgment. In XXXX I had no less than XXXX agencies garnishing my wages. Sometime during XXXX XXXX to date, Asset Systems was paid a total of {$7800.00} of the original debt filed against me in XXXX. Per a statement from XXXX XXXX w/Asset Systems on XXXX/XXXX/XXXX, they dropped the collection on this debt because they could n't not get their garnishment attempt in place because of the other creditors waiting with their Writs. The newest letter I received from XXXX XXXX XXXX, on behalf of Asset Systems has filed a claim that I owe a total of {$11000.00} on the original debt filed, again, back in XXXX under the garnishment case listed above. I have filed a complaint w/the AG 's office for Oregon. I will be filing a dispute w/XXXX on this demand for payment stating that Asset Systems, through previous garnishments have been more than paid for the debt they claimed on me since XXXX. Unfair collection practices is happening and I request that a full investigation be made on this case. I will be requesting from my current and previous employers, copies of all garnishment payments made to agencies under this case number. Once I have this information I will provide this to any agency proving payments made on this case since the date it was first filed.

The choice I chose above best describes what happened, but there is so much more. They threatened to take us to court and sue, threatened to damage our ( both my wife and I 's ) credit score as much as possible and garnish both My wife and I 's employment checks until debt was settled. We also can not confirm this, but we think there have been attempts by XXXX to contact us through our employers. We want to work with them and pay it off as we did n't even know that this medical bill existed until he called. That is nobody 's fault except ours, and we know this. We will fix it, but he is being very forceful and very abusive in his calls. The agent 's name was XXXX with Asset Systems.
After this conversation with XXXX, my wife called me crying. So, I called him to ask for the name of the company he was with, He immediately went to " Do you want to speak to my supervisor? '' I said no, I just need the name and address of your Company please, which he provided. I wanted to report them for this abusive call and their tactics of trying to collect a {$600.00} debt. We my wife called them back during her lunch break today and to settle on a payment plan, but now I feel I need to take action against them for this type of behavior.

We agreed on a monthly payment plan of {$400.00} a month for my outstanding medical bills from a hospital visit. After three monthly payments that were all made as agreed and on time I was able to get payment from my health insurance company and paid off over {$4900.00} in one month. They then attempted to collect the remaining {$260.00} the next month and said that I was late paying. I said does n't the {$4900.00} payment mean I 'm months ahead of schedule and she was rude and said it does n't work like that. This is not the original agreement at all, I 've paid well over {$400.00} a month and am close to paying off the entire amount a year early! I do not like being threatened to go to court or have my wages docked after making a payment of almost {$5000.00}! These people should be struck off. To add insult to injury NONE of this was my fault but the fault of my health insurer messing up with the billing. They gladly admitted this and cut a cheque as soon as it was pointed out.

I have repeatedly requested they send me a validation notice. I still have not received anything to verify thier claim of money owed. There is nothing to access online. I am told they are unable to email it, paperwork would be mailed. I have yet to receive any mail correspondence. Per FTC guidelines I should have received that documentation within 5 days of initial contact.
They have left voicemails on my shared cellular phone number stating that they are a debt collector attempting to collect a debt. The caller leaves the ARG phone number but the caller doesn't disclose their name or the company name in the message. I had to do a web search on the phone number to find out who it was that called. This is another violation as the FDCPA does not permit debt collectors to disclose personal information to any third party.
I have never signed a HIPPA release form for the alleged creditor ARG to have access to any of my medical information.

I 've attempted to set up several payment plans, I never get written communication verifying that payment plan and then when I call back they said it does n't exist or that I never paid and wont set up another one. They are very rude, they threaten, the make judgmental statements about you. I 'm willing to make monthly payments but they wont make the amount something that fits within my budget and they are now saying they will garnish my paycheck without letting me make payments. They are the worst company! I do n't even know why a hospital would ever use them!

I was notified about a debt through a lawsuit. There is no information provided about the debt owed. After a review of medical bills and health insurance records, I find no debt owed to the XXXX. Now, this debt collector is threatening me with legals fees and seeking a settlement. The alleged debt owed is {$570.00} and a lawsuit is a very heavy-handed approach. I'm not an attorney and it's costly to hire one for the amount in question.
