XX/XX/2015This statement concerns my dealings with XXXX. They are located at XXXX XXXX XXXX. in XXXX, Texas. My first contact with them was prior to XXXX XXXX, 2015. I base this on an email that I received from one of their Mortgage Counselors asking me for copies of my current mortgage statements. The email was sent to me by a XXXX XXXX XXXX on XXXX XXXX. When I first met with XXXX XXXX I was left with the feeling that he really had no idea what he was doing which made me rather uncomfortable. I stressed to him the importance of having this refinance done and completed before XXXX XXXX, 2015. He assured me that it would be done without any problem. As you will see, if they had gone with a VA loan that I inquired about at a later point. Meeting this deadline would not have been a problem. Over the next several weeks, I became acutely aware of the fact that XXXX XXXX did not have the experience or knowledge to be able to handle my application. At one point he ended up asking for help from a Senior Consultant, a XXXX XXXX XXXX. Unfortunately, all this did was make me even more uncomfortable than I already was. I ended up wishing that I had immediately bailed out and taken my business with me. I would eventually realize that doing any business what so ever with XXXX was a huge mistake in judgment on my part. I could never get either one of them to give me a straight answer about anything. I told XXXX XXXX numerous times that the Refi. needed to be done before XXXX XXXX, and why it was so important. I have text messages from XXXX XXXX as far back as XXXX XXXX assuring me that he was well aware of the urgency, and that it should not be a problem. On XXXX XXXX, I got an email from XXXX XXXX where I could electronically sign some documents and send them back to him, which I immediately did. On XXXX XXXX, I sent him a text that I had just received the GFE ( Good Faith Estimate ). XX/XX/XXXX I hand delivered a document that their processing dept. had requested. This ( The GFE ) turned out to be the very last thing that I would receive from him in the way of documentation that a loan was being processed. While I was in the office, XXXX XXXX came out to meet me. We started talking about the appraisal, and he said something that caught me off guard. He said, " XXXX, I am not supposed to tell the appraiser how much we need for the appraisal to be so that you will have a 20 % equity in the house. But that does not mean that you can not tell him because technically he works for you since you are the one paying for it. '' It may not be illegal for him to tell me this but it sure seems like it is unethical. I ended up paying {$500.00} for an appraisal that I was never able to make use of. As you will see, I never even got a copy of it. Over the next month and a half, all I got from him was excuse after excuse after excuse as to why no progress was being made. At one point, the loan amounts had to be changed, ( Because of the appraisal ) so within three days I started asking for the new GFE. I must have asked at least a dozen times. I NEVER got one. I have a text dated XXXX XXXX asking when I could expect a new and updated GFE. The loan amounts may have changed but his excuses did not. At XXXX point, I was told by someone in the processing department that customers like my wife and I were the kind of customers that everyone looks for. Both of our credit scores were above XXXX. We had absolutely no credit card debt whatsoever. Our debt to income ratio was less than 30 %. We both had long employment histories with the same companies. My wife alone had a yearly income above $ XXXX per year. Get the picture? So I was having a difficult time trying to understand why things were not moving any faster. The only thing I ever heard XXXX XXXX say to me was " I 'm just trying to get you the best deal I can. ''

We refinanced in XXXX with a FHA XXXX. Everything went well, or so we thought. In XXXX, Aspire Financial hit our credit again with a hard inquiry. I contacted my Loan Officer on XXXX, she had no clue why. I got a phone call shortly after from a manager with Aspire telling me that they had messed up the XXXX, and the only option was to do another refinance. He informed me we could not do another streamline and would have to do a full refinance, which would include more processes. He assured me that we would not be paying any of the closing costs for the second refinance, as it was their mistake, and they would drop our interest rate .5 % to match the payment amount as close as they could to the refinance amount. He sent the GFE reflecting this. I gathered documents and got them what they requested. They requested more, I got them what they needed. After several rounds of this, they ordered the appraisal. I contacted XXXX on XXXX to make sure they had made my insurance payment which was due on XXXX. She said she had my insurance. The appraiser came out on XXXX. I was told that was the last item needed, everything was being sent to underwriting for clear to close. On XXXX, XXXX emailed me to ask if I 'd made the XXXX payment to them. I informed her I made it on XXXX and asked if I was to make a XXXX payment. She told me no. On XXXX, I asked for an update. I was told they are having to transfer something internally that has to do with FHA and waiting on title company from previous transaction to give us the " ok to proceed '' and I should hear something the next day. On XXXX, I asked for an update. XXXX told me she was going to follow up with FHA and would be in touch. She then told me we would close this month. Later on XXXX, my insurance agent contacted me letting me know my payment had not been made and my policy expired on XXXX. I contacted XXXX again, she told me she did have the insurance. On XXXX, I asked if I would be getting an answer about insurance. XXXX I emailed again asking XXXX if it had been paid, and that her emails were unclear and I needed an answer. XXXX she said she talked to servicing about insurance and was unable to answer my question. On XXXX, she said servicing would be contacting me about insurance and believed it had been fixed or was being fixed that day. XXXX XXXX also said he was checking on the escrow and would let me know ASAP. I never heard from XXXX again. XXXX got involved and got the insurance paid. I contacted my insurance agent on XXXX and was told they had received payment for insurance and the check date was XXXX. XXXX called on XXXX. We spoke about the whole situation. I asked about the XXXX payment. She said Oh, yes, we need it. So on XXXX, I made my XXXX payment to XXXX. XXXX, we were set up to close on XXXX at XXXX. XXXX I received disclosures with a higher interest rate than our initial GFE. XXXX could not find it anywhere in our file, so I sent a copy to her. She said they would fix it. Then said they could n't. I told her just go with it, if we were to close on XXXX, we just want it over. We never received a XXXX until around XXXX on XXXX at XXXX XXXX. The loan amount was the same as the paperwork showed in XXXX. I contacted XXXX, but she could n't give a reason. We did not sign. We 've received XXXX sets of disclosures since and a final HUD statement, all with different numbers, and still incorrect interest rate. I was also told my payment, which is {$77.00} higher than we were told. I 've been told they are putting numbers in so the bottom line is zero, but I feel like they are moving numbers around and we are paying some of the fees without knowing. Settlement fees have gone from {$11000.00} to {$6400.00} in 3 days. I need help. I do not feel comfortable signing anything with this company.

After reaching out to XXXX XXXX in XXXX XXXX we disclosed our circumstances that prior to being married my wife had a deed in lieu of foreclosure in XXXX XXXX . We also gave our credit information so that hey had a full credit history. He told us that we can still be eligible for an FHA loan. We found a home that would be completed in XXXX or XXXX XXXX so we contacted XXXX XXXX of Texas Lending. He then sent us a preapproval for a loan on XXXX . we watched out home be built for the next 3 months. In XXXX XXXX we notified Texas Lending that our closing date would be XXXX XXXX XXXX . Once the loan was sent to processing the processing agent XXXX XXXX contacted us and asked for supporting documentation. We sent all of the information asked for. After I complained about the disorganization and inability for XXXX XXXX to contact us in a timely manner we were left at the week before closing with no closing disclosure for the original closing date of XXXX XXXX . We were then sent a closing disclosure on XXXX XXXX XXXX for a closing date of XXXX XXXX XXXX . On XXXX XXXX ( the day before closing ) at XXXX XXXX we were suddenly asked for a letter of explanation for the deed in lieu of foreclosure and supporting documents. We were never asked for these documents in the numerous correspondences we have had with Texas Lending representatives neither XXXX XXXX nor XXXX XXXX . We submitted the letter that same night with supporting documents. We also submitt ed one more supporting document on the morning of XXXX XXXX XXXX at XXXX XXXX . So once again closing could not happen. We waited patiently to hear back from someone on XXXX XXXX XXXX no one called or emailed to say the documents were received, sufficient, or submitted. While receiving calls and emails from the builder and insurance agents wondering what is going on because no one from Texas Lending has returned their calls in an effort to stay on top of things for closing. On XXXX XXXX XXXX I continuously tried to call XXXX and XXXX and was not able to reach neither one. I f inally got in touch with XXXX at around XXXX . She told me that she submitted the information we sent on XXXX XXXX and XXXX to underwriting that morning XXXX XXXX . She also told me that she will reach out to underwriting at XXXX and will get back to me. I received no call back so I called numerous times and was not able to reach anyone. I then called Texas Lending and asked to speak to a supervisor. I was given a supervisor by the name of XXXX he told me that he will look into the loan application and will call me back. About XXXX mins later I missed a call from XXXX XXXX . I listened to the voicemail which he stated that the loan was not approved and there is nothing he can do. This was very upsetting to me because nothing was an issue until after I complained about the handling of the loan. The company preapproved us knowing that there was a deed in lieu of foreclosure and knew that my wife had extenuating circumstance s ( medical issue that reduced her yearly salary by 20 % ) that would allow us to apply 6 months earlier then the 3 year waiting period for the FHA. They also had full access to our credit reports and knew my wife was reestablishing her credit and raising her credit score .

My refinance was handled very poorly. It took over 90 days and I did not have any of the potential delays listed on their website ( picture included for review ). On their website, it claims 27 average days to closing ( picture included for review ). The first problem that caused a delay was when they said there was a lien on our house for my husband owing child support. There was no lien on our house and the lien they were referring to was because my husband is the one owed child support from his son 's mother it's not even attached to our house. I have attached the lien for your review. I informed my loan officer XXXX XXXX of this immediately. This alone set us back 30 days as our loan went into a dormant status. I could not seem to get a response as to what was taking so long. At one point an email was sent to the higher-up management from my loan officer and she commented that my loan, " XXXX says 29-day status. '' I was even asked to get several documents I feel the loan processor should have obtained including a payoff on my solar panels. My closing fees went from {$5300.00} to XXXX XXXX hours before closing. I asked XXXX why there was such an increase and her response was, " Refinances are expensive. '' On XX/XX/2021 I informed XXXX that I needed a satisfactory reason why my loan fees increased drastically in the amount of XXXX 24 hours prior to closing. She told me that it was the title company and she would find out the reason for the increase. She never got back to me. Unfortunately, this is not surprising considering the poor service I received from Texas Lending. My loan did not close the day it was supposed to because they did not have all of the documents in order. I was en route to my closing at XXXX XXXX on XX/XX/2021 when I got the call it would not go through. That is when I got the 2nd closing disclosure with the increased fees. We had to go again the next night. My refinance was handled extremely poorly and I was not given an explanation for the final fee increases even though I specifically asked my loan officer XXXX XXXX who works for Aspire Financial dba Texas Lending.

Around the first of XXXX, I contacted XXXX to apply for a cash-out refinance. I explained that I had medical bills from a XXXX XXXX earlier in the year, and I was approaching a critical point with my bills and I needed the cash-out refi to hopefully lower my interest rate, but most importantly to pay off some outstanding debt. The refi process went along relatively smoothly, albeit very slow. Every communication with XXXX XXXX XXXX, XXXX XXXX XXXX was via email, so anytime they needed something, I found out about it after I got home from work, too late for " same day response '' - if they had called, it would likely have cut the process time by a third. At any rate, they process completed and I closed on the loan Friday, XXXX XXXX, 2016. At the closing they stated that the loan would fund on XXXX XXXX. On the afternoon of the XXXX of XXXX ( XXXX ), I received a phone call from Texas Lending stating that we had a problem - XXXX business days after this process started. XXXX XXXX XXXX with Texas Lending stated that they had run another credit check on me, and my rating had dropped below their allowable limit and they would not be funding the loan - this was on the day it was supposed to fund. In the beginning I explained that I was approaching dire straits and they were aware that this is what I was getting the loan for. Their slogan, or motto, or misleading tag line - is that they target closing the loan in 21 days. Due to their operational method, they took double that time to close my refi. Even after all papers were signed and the loan was closed - signed and sealed, on Friday XXXX/XXXX/16 - they waited till the following Wednesday ( XXXX/XXXX/16 ), on the loan funding date, to check credit and decide not to fund the loan, because I had gotten a little behind on the very credit cards they were paying off with this refi. There has to be something illegal about the way XXXX\Aspire Financial conducts business.

My husband and I recently refinanced our home with XXXX and was overcharged in our closing documents. We paid for our XXXX certification that is required by the VA administration, which is also suppose to be not an expense to the borrower. We were then charged again in the closing documents. We also gave XXXX a copy of my divorce decree showing that I was awarded my home in my divorce. XXXX did not supply a copy of this decree to the title company at closing and the title company requested a copy from the courthouse and charged me in my closing documents. During the XXXX month, ordeal of getting our home refinanced, we experienced bad customer service, lost numerous documents that was submitted to XXXX numerous times. The XXXX managers was unprofessional in all aspects of this refinance process. I even at XXXX time tried to reach out and talk to the XXXX of the company just to receive a call from XXXX of the managers stating that, " the XXXX does n't talk to customers. '' If this is true then the commercial 's that is aired on TV is false advertising, and the customers that he is showing as a true customer is fake. At closing with the title company, our closing documents had numerous forms that were still incorrect even after we submitted them to XXXX numerous times. I even contacted XXXX of the managers to state that they over charged us for the XXXX certification by {$320.00} to only be hollered at by this manager. I even had my cell phone on speaker phone and the title company closing officer was in shock to hear the tone and what this manager said to us.

I applied for a reverse mortgage to refinance an existing reverse mortgage and draw more money out of the equity in the house, due to increased market value. The company, XXXX XXXX, ordered an appraisal through a company that does their appraisals. I was pleased with the appraised value of {$250000.00}. Then I find out, that when it went to underwriting, the underwriters rejected the appraisal, saying it was incomplete and had too few comps. I was told I would have to pay for an additional appraisal of {$560.00}, because they could n't use the one they had. At that point I cancelled the contract. Now they want me to pay for an appraisal they ordered from their company that has no value to them or me. I am refusing to pay at this point. Thank you,

I checked my credit before applying for a cash out re-fi. All 3 reports show in the high 700 's and was told I could get a rate of 2.375 %. I gave permission for Texas Lending to pull my credit. They said I have a XXXX score and couldn't give me a reason and tried to give me a higher rate. I called and requested an explanation and offered to share screen shots of all 3 agencies showing my credit score. I was told a mortgage score is different and that I needed to repair my credit. On XX/XX/19, I sent an online inquiry to TexasLending.com to check the rates for a cash out refinance of my home mortgage. After speaking with an agent, I was told they would only do a " soft pull '' and it would not affect my credit. After going over the rates the agent helping me and I agreed that they could not give me a rate and loan better than what I currently had. Then a few days later I received loan docs from them and got a phone call to remind me to complete the docs in a timely manner. I told them I was not getting a loan through them and that they needed to contact the credit reporting bureau to remove the inquiry from my Credit. They agreed and as of XX/XX/19 they have not done this.

I contacted Texas Lending via their website to request their advertised Mortgage Pre-Qualification that they advertised as a soft credit pull that would not affect your score. The next day I got a credit alert that a hard credit pull had occurred, and it reduced my credit score. I investigated and found out that Texas Lending had done a hard credit pull without my consent. I tried several times to contact the agent who pulled my score, and she failed to respond. I finally was able to get a hold of her today, and she said that there was nothing she could do about it. I applied with TexasLending for a hone equity loan. Speaking with their rep I questioned the high appraisal costs and was told I could select an appraiser which I did. I was told the loan was approved and in process. Today I was informed that the loan was denied because I had the appraisal done and not them. This has cost me the appraisal cost, time, and possibly damaged my credit due to being turned down for a loan. As a senior citizen ( or any citizen ) I think this is unfair practice to say the least. i think if TexasLending needs their appraiser to do the appraisal they should pay for it and proceed with the loan I qualified for.

Company ASPIRE FINANCIAL , INCXXXX DBA TEXASLENDING.COM. After approval for a cash out refinance I was presented with 2 final disclosures with conflicting information. 1 was the original terms agreed to with a closing cost of {$10000.00} and the second was a lower cash out among with a XXXX increase in costs in the amount of {$13000.00}. The explanation given was credit score changed but no credit information was was reported or changed between application pull and final pull. I feel I have been bait and switched. I have 1 borrower signature on the original forms given before aspire archived the document.
