The history show strong possibility of broken chain of titlle and no just standing by two previous institutions. Dear My name is XXXX XXXX. I am writing to you because I am looking for help. I have been told that my house is being foreclosed on by a collection company in the middle of a pandemic. I am a hard working American XXXX XXXX XXXX impacted by COVID. I have worked in XXXX all of my life, I have built many American dreams with my hands and now someone is taking my house. What hurts the most, is not just the fact that I am impacted by COVID, but this came completely out of the blue. The company that is foreclosing on my home, I have never heard of. I have never signed anything to them,. It is not my first mortgage. My first mortgage is with XXXX XXXX. I called them to put me in deferral and they helped. The company that is foreclosing on me is Aspen Property Group LLC. The mortgage they are foreclosing on is from XXXX XXXX. They initiated foreclosure in XXXX. in XXXX they voluntarily dismissed the foreclosure because at that time there was no VALUE in the house. They CHARGED OFF the mortgage. This was the same time that when we tried to do a modification because we were impacted by the great recession. I was in construction then as well. We have paid for the first mortgage since then, for 9 years we have had no problems. We never heard anything from XXXX XXXX since the chargeoff and the voluntary dismissal. We never received any calls on this. We get emails telling us that the mortgage was sold to another company, We get letters saying that this financial company in bold letters say we only have 1 option. Pay in full. They do not offer modification or payment plan. I ask you to help me. I can not understand : 1. why did this mortgage get charged off and now a 4th company is foreclosing on my house without giving me the ability to make a payment plan 2. I never got served the foreclosure 3. is there no statute of limitations. The mortgage was charged off in XXXX. 4. Illegally charging late fees. Original principal is XXXX. Interest at 11 % XXXX. late fees XXXX. They have charged me for late fees since XXXX. Many legal fees. 5. how much money did this company pay for my mortgage 6. This collection agency is acting like a mortgage ( foreclose ) but they do not offer any payment plan, and foreclose in the middle of the pandemic. They are assuming the rights of a lien that was charged off 9 years ago 7. my first mortgage does not know and was not included 8. they are bypassing all foreclosure moratoriums. 9. I have not been notified of the sale date. I got a flyer from a company asking me to pay it. 10. me and my husband never got served. PLease look at XXXX county public. All happened on 1 day. Good morning! My father and I was took out a mortgage loan together as borrower and co-borrower and used our home as collateral. Last year my father passed away due to covid complications. I as co-borrower called mortgage servicer to inform them on the passing of my father and to see what I can do to take over mortgage since I lived on the property. The person I spoke to informed me that the loan had just been transferred to their facility and they did not have all documents on file yet. It was then that this individual provided me with the lenders number so that I could talk to lender on what was needed on my behalf. I contacted this lender individual and asked if he could send me copies of documents they had on file such as deed/title & promissory note. He informed me he would work with me to find a solution so that I could modify loan and take over mortgage. I sent all information he needed such as my fathers death certificate, I filled out paper work he had emailed me & sent out my income information, etc. Then out of no where he indicated My sister & step moms lawyer contacted him indicating they were owners and they would be paying off mortgage loan and basically dropped me. He informed me I was co-signer and for me to get a lawyer. He informed me he would keep me in the loop on what they ( sister/step mom ) were planing on doing. I informed him I was partial owner on mortgage loan making me co-borrower not co-signer. I called him once again and he never answered. I sent email and did not get a reply to that email. I then contacted mortgage servicer to see what I can do since I had already made several payments on mortgage loan. They informed me to call lender and work it out with them. I was recently evicted from the property my father and I owned by my step XXXX & XXXX and was informed I had no legal rights. I have called so many places in which I could get some help I even hired an attorney but he basically misrepresented me and I lost out on a significant amount of money in which I could have used toward the loan my father and I obtained jointly. The homeowner has been trying to get a loan modification since XXXX / XXXX / XXXX . Recently I was served a Notice of Default on XXXX XXXX , XXXX . The servicer XXXX XXXX served the XXXX Notice. A trustee of Sale is : XXXX XXXX XXXX XXXX , XXXX XXXX XXXX XXXX , XXXX XXXX , XXXX , Nevada, XXXX . I have a change of circumstances and am formally filing an appeal via the CFP B Consumer Finance Protection Bureau. I am requesting a basis of denial report, as appears that errors in the income and property value were used to base the denial for request for a loan modification. I was denied a loan modification : without an explanation for the denial. On XXXX / XXXX / XXXX A notice of Default was file d. There is no date of sale set at this time. On XXXX XXXX I received a notice of mortgagee 's sale of real estate from Aspen Properties Group , LLC via the law firm XXXX XXXX XXXX. The mortgagee 's notice of foreclosure sale is for my property at XXXX XXXX XXXX XXXX, XXXX MA XXXX. The loan was a home equity line of credit that was cancelled by the original bank in XXXX. The HELOC had a maximum draw of {$170000.00} and I never withdraw that amount nevertheless Aspen Properties Group is foreclosing on my property for the entire amount of {$170000.00}. I have reached out to Aspen to prove the correct amount that was withdrawn from the HELOC but to no avail. Aspen has schedule XXXX XXXX as the sales date. This is also a time-barred account per XXXX XXXXXXXX XXXX. Per their payment statement the loan is 4101 days delinquent.

Aspen Properties LLC has file foreclosure proceedings ( sales date XX/XX/XXXX ) on my home located at XXXX XXXX XXXX XXXX XXXX XXXX MA XXXX using incorrect financial information. In XXXX I took out a home equity line of credit with XXXX XXXX XXXX. The credit line was for roughly {$190000.00} XXXX XXXX closed down the credit line in/or around XXXX. Aspen Properties has acquired the loan and incorrectly claim that I owe {$190000.00}. I have repeatedly asked Aspen to sent me documentation of all the withdrawal AMOUNTS from the HELOC as well as the DATES of those withdrawal but to no avail. The amount Aspen allege that I owe is incorrect and I hereby respectfully request a correct accounting of all transactions including amount withdrawn and dates from that HELOC.

On XX/XX/2022 Aspen Properties Group LLC notified me that they will modify my mortgage. Aspen however conducted a foreclosure sale of my home on XX/XX/2022. I was under the belief that Dual Tracking was illegal. I worked diligently with Aspen to get a loan modification and supplied all the required information that Aspen requested but was blindsided when my home was sold. I am still in possession of my home but was notified that there is a new owner of my home.

Aspen Properties Group LLC offered me a loan modification on XX/XX/2022. Aspen failed to send me the loan modification documents via certified mail as is required by law. Aspen then went on to conduct a foreclosure sale of my home on XX/XX/2022. Aspen is required to send the loan modification documents via certified mail and allow me 30 days to review the proposal. I never received the loan modification documentation from Aspen.

Aspen Properties Group has filed preliminary paperwork to foreclose on my home. Aspen claim they purchased a debt that I had incurred. I have asked them to validate the debt but to no avail. Aspen has gone as far as to do a corporate assignment of mortgage on my property.
