My mother passed away 10 months ago. At the time of her death she has two credit cards with balances of about {$10.00} and {$50.00} respectively. XXXX XXXX. is the creditor for both accounts. I informed both accounts of her passing just a few weeks later and was told that AscensionPoint Recovery Services would contact me as the representative of her estate in order to collect the amount owed at the time of her passing. I was also told that this could take several weeks, but that no late payment fees or interest would be added to the balances. When we continued receiving statements for those accounts showing that late fees and interest were being added to the balances I called again. This time I was told that we could ignore the statements and that AscensionPoint would only request the account balance at the time of death. Over 8 months after my mothers passing AscensionPoint finally reached out to me about one of these accounts and then the other, attempting to collect debts from her estate of about {$160.00} and {$360.00} respectively, balances that DID include all the late fees and interest accrued over the months after my mothers passing. Because so much time had passed and it wasnt a very large sum I initially paid the first account without questioning it. Later I happend to notice my error. When I contacted AscensionPoint about this they were quite gracious in refunding the full amount to me with apologies. At the time, it seemed like an isolated incident and I didnt think much of it. A few weeks later when AscencionPoint contacted me about the second account, once again requesting an amount that was much higher than the account balance at the time of death, I started to get suspicious. I am still in the process of getting the amount they are trying to collect from my mothers estate reduced to the {$50.00} that it should be. It takes time, effort and patience. My experience so far, also from what I can gather from the AscensionPoint representatives Ive spoken to is that its very common for small credit card debts belonging to the recently deceased to be handled in this way. Its not unthinkable that XXXX and possibly other creditors intentionally delay the process of forwarding debt to collectors like AscensionPoint, letting the accounts rack up extra late fees and interest. Bereaved persons like myself, who have taken on the extra burden of handling an estates finances often dont have the time to double check every little thing or the energy to dispute the debts theyre presented with. Im therefore sure many people will pay smaller amounts like this without question. The fact that this happens to me not once but twice is disturbing to me. The question must be asked : Is XXXX intentionally or unintentionally taking advantage of the recently bereaved by charging unwarranted late fees to the accounts of deceased persons?

On XX/XX/XXXX, my father passed away. I am the official appointed personal representative for the estate. On about XX/XX/XXXX, I received a letter from the following collection company attempting to collect a debt : AscensionPoint Recovery Services LLC XXXX XXXX XXXX XXXX. XXXX XXXX XXXX XXXX, MN XXXX XXXX I then called the company and spoke with a representative named XXXX XXXX ext. XXXX to find out what this debt was for. I told her that I was the court appointed personal representative. She asked if I was working with a lawyer- I told her that we were, however that as the personal representative she could work with me as our attorney charges {$350.00} per hour and I did not want and did not have to use his services for this particular issue. She then promptly informed me that the debt was for a medical credit card called " XXXX XXXX '' and told me the balance they were seeking. I asked her to mail me an invoice showing a detailed break-down of the charges, which I have yet to receive ( it has been about 2 weeks ) Upon preparing my deceased father 's XX/XX/XXXX tax return today XX/XX/XXXX, I discovered I needed to find out how much he spent on medical expenses for year XX/XX/XXXX. I knew from the balance on his " XXXX XXXX '' card that he must have put some medical expenses on there that I need to discover in order to complete his tax return. As I have not yet received the statement I requested, I called back to AscensionPoint at approximately XXXX XXXX. The representative refused to provide me information saying that " because the estate has an attorney, LEGALLY he can't speak with me and has to have all of my attorney 's information to speak with him '' which I know is absolutely not true and will accrue unnecessary expenses to the estate. As a court appointed Personal Representative they are required by law to provide information directly to me, they are under no " legal restrictions '' as the collections agent falsely stated to " only work with my {$350.00} per hour attorney ''. Despite being compelled by law to work with me on this issue, they decided to attempt to bully me into adding additional unnecessary legal costs to my father 's estate to aid themselves in strong-arming me for a collection of debt. ( Which I can't stress enough, is absolutely not called for ) I take issue with their morally reprehensible, illegal, and unnecessary bully tactics to attempt to collect a debt.

My wife and I moved to this area in XXXX of XXXX. She was diagnosed with XXXX XXXX, and we moved here because her surgeon was close by this area. On XX/XX/XXXX, we went to the retailer and purchased living room and dining room furniture. The retailer was offering XXXX percent interest for five years on the furniture. We both gave them our drivers license and all pertinent credit data and we told them we both wanted to be on the account because no one survives XXXX XXXX. Some may just live a little longer than others. We were approved, bought the furniture, and it was delivered on XX/XX/XXXX. We were happy with the creditor as we had paid off two large purchases with XXXX percent interest with them in the past. We made all of our payments on time. My wife passed away on XX/XX/XXXX. On XXXX I went to the same retailer to buy a new bed. I gave them my info and said I wanted to buy it XXXX interest financing for 2 years. A few months go buy and all the payments are made on time. But I didnt like the way they applied the payments to principal. I called customer service to see if there was another way they could apply the principal. They asked who I was, I gave them all of the pertinent info on my wife, and myself. The creditor said, You are not on the account, can I speak to your wife. I said no, she died of XXXX XXXX 4 months ago. They said they could no longer talk to me, transferred the call to the deceased division. The deceased division told me the account had to be closed immediately. I said Why, I am on the account. They said No, you are not. I said Really? How can that be? On XX/XX/XXXX I purchased a bed, my wife had been dead for 3 months, and my name is on the invoice. They told me to send in her death certificate, will, and marriage license and told me they would get back to me. On XX/XX/XXXX of this year, I get a letter from a collection agency contracted by the creditor requesting payment in full out of her estate. I called the collection agency once a week for the last month trying to resolve the situation. Each time the call was escalated to the next level. Then I would get a voice mail. EVERY time I left my contact info. I have not heard from them at all. Whats my solution? They reinstate the debt with NO PENALTIES, and I pay the debt off as I have for all of my debts.

XX/XX/XXXX : On XX/XX/XXXX, my husband XXXX XXXX died. I am his wife/widow and was appointed as his Personal Representative. I quickly notified XXXX of his death and subsequently provided it with the documents issued by the XXXX. XXXX assigned it to Ascension Point Recovery Services ( ARS ). ARS advised in several phone calls that once the account was assigned to it, that ALL late charges and interest fees were frozen and that the amount owed was the amount due on the date of Mr. XXXX ' death. I asked and their representative could not tell about repayment deadlines. ARS 's letter dated XX/XX/XXXX shows the amount owed on that date as {$4500.00}. I made payments to XXXX : XX/XX/XXXX : {$180.00}, XX/XX/XXXX : {$750.00}, XX/XX/XXXX : {$350.00}, XX/XX/XXXX : {$500.00}, XX/XX/XXXX : {$350.00} TOTALING : {$2100.00}. On XX/XX/XXXX I called Ascension & asked for a balance. Their Representative said the account was returned to XXXX in XX/XX/XXXX & gave me a phone number to XXXX XXXX XXXX. On XX/XX/XXXX I received a 1099-C issued to XXXX which shows a date of XX/XX/XXXX for {$4300.00}. I called XXXX & spoke to Representative # XXXX and asked how XXXX got the amount in the 1099-C because the amount didn't reflect the payments I made and NO ONE told me that it was going to be " Cancelled '' or that a 1099-C would be issued. She told me she didn't have any information & to talk to my tax advisor. I told her that suggestion was ridiculous and that my tax advisor would have NO information. I asked for a Supervisor or Manager. She said none was available. I asked for the name of someone somewhere that I could ask my questions & was referred to the Presidential Dept of XXXX in XXXX XXXX, SD which she said had NO phone number, NO fax number and NO email address. I sent a letter to the address on XX/XX/XXXX. Today I received a letter from XXXX dated XX/XX/XXXX which said the debt in the 1099-C was accurate and gave me NO other options to address my concerns.

Ascension Point Recovery ( APR ) is a group of individuals who seemingly browse through obituaries and attempt to contact the next of kin for the recently deceased. My Mother passed away weeks ago and we received a phone call from Ascension Point Recovery business attempting to get MY MOM 'S personal information by calling and asking questions about her. We received a phone call from XXXX XXXX XXXX XXXX who was looking for the person in charge of executing my Mom 's will. I called my family to ask about the situation and quickly realized it was a fraudulent call and the person was out for personal information. When we called APR back, we were greeted by a very generic and low quality answering service, and eventually, a woman answered the phone. She informed us that XXXX XXXX was not available but ANY of the associates could help because " they ALL were aware of what was going on ''. After a few questions, the woman ACTUALLY STARTED ASKING US QUESTIONS ABOUT MY MOM 'S DEATH. They asked when it happened and how and who was executing the will. Obviously we didn't disclose any of this information, but ultimately she asked if we were aware that there was a possible debt remaining that had to be paid. These people are targeting elderly men and women and attempting to convince them to give the company money to " resolve past debts ''. There are countless stories on XXXX that suggest this company has been terrorizing people for years. On their official website, Ascension Point Recovery only provides one option under the " CONTACT '' tab and that is a " RESOLVE A COMPLAINT '' form. That in itself lends to the illegitimate nature of the company. Not only is this one of the sickest and saddest forms of underhanded exploitation, but it is compounded by the fact that the people being contacted have just lost a loved one.

However, the Dodd-Frank Wall Street Reform and the Consumer Protection Act of 2010 transferred most responsibility to the CFPB. My Auntie passed away XX/XX/XXXX. Several fraudulent purchases where made while she was on her death bed and other purchases where made after she died .My Aunt XXXX never abused or maxed out her credit cards. XXXX never gave consent for anyone to use her credit cards. She never authorized any authorized signers on any of her accounts. I want all these fraudulent credit card purchases to be carefully reviewed, and i want all charges cancelled due to fraud. My aunts spending patterns where simple. She always paid in full, never left a balance and hardly never used her credit cards. Why weren't these unusual spending patterns noticed? In the early afternoon of XX/XX/2018, a company by the name of Ascension Point Recovery Services called my brother. During said phone conversation, the representative from Ascension Point ( XXXX XXXX ) told my brother I was dead and that I had named him as the executor in my will. She tried multiple times to get my brother to " confirm '' my date of birth and the last four of my social security number so she could help him " settle my estate ''. Despite her persistence, he would not give her any information. My brother began asking her questions ; he asked about her business with me, questioned when I supposedly " died '', what he " supposed '' to pay and how much, ALL of which she refused to answer. Fearing that this company was phishing for information, he informed her that I was not dead, but very much alive and lived 8 miles down the road and he would be calling me immediately after their conversation was finished. She, XXXX, left her name, company, phone number and extension so he could call her back to " settle the estate ''. After he called and told me about the conversation, I put the company name into XXXX. I found out that this company offers debt collection services as well as estate settlements. There is so much ethically wrong with this. I am not dead, I have not named my brother as executor on anything, and I certainly do not have an " estate to settle ''. To call family members and suggest their family member has passed away is crossing that ethical line. Had they called my XXXX year old mother, this could be a whole different situation. THIS COMPANY NEEDS TO BE STOPPED!

My husband XXXX XXXX XXXX passed away on XX/XX/2016. We were separated at the time for XXXX years and he resided at XXXX XXXX XXXX, XXXX XXXX Maryland at the time of his death. I received his letter from the Collection Agency in care of XXXX XXXX XXXX, The XXXX XXXX stating they wanted to make a settlement of his debt. Since we had been married for XXXX years, separated for XXXX years, all of our debt had been in each of our own names, other than our home, which we did a deed in lieu of foreclosure. I did not know which debts my husband had, never signed my name on any of them, and have never been responsible for paying any of them. The same goes for me. I have my own debt, including my own XXXX XXXX card. Now, these people want me to pay for his debt. This is totally unfair on several accounts, I never signed my name on any of his bills, never used any of his credit, didn't know what credit he even had. My credit has always been important to me, and now while trying to keep my own credit cleaned, his bills are now coming in for me to pay, and are being placed on my credit report and they are using my address. I have sent letters to 3 of them, informed all of the banks, and now after 2 years, they are trying to collect from me. XXXX was the primary bread owner while we married, even then, we were responsible for our own debt. In addition, my deceased husband, never lived with me at my current address, nor I at his current address.

My husband, XXXX-years-old needed XXXX replaced, since previous XXXX were XXXX at hospital he was in prior to XXXX visit. He did not have insurance coverage for XXXX work, so he applied for XXXX and received {$800.00} credit toward dental work. On XX/XX/XXXX an appt. was made with XXXX, XXXX, XXXX. We handed them the approval for the {$800.00} credit approval toward dental work to be done. The manager at that time, stated that they can have XXXX increase the amount to cover more of the work to be done. She called and it was denied. The cost would be {$2000.00} - {$800.00} = {$1200.00} which we used our personal credit cards to pay out of pocket {$500.00} from each credit card. This was the XXXX visit and only XXXX was taken to send to XXXX. On XX/XX/XXXX my husband was admitted to XXXX from XXXX since XX/XX/XXXX, and could not make the next scheduled appt. on XX/XX/XXXX. I am receiving billings from XXXX XXXX, and AscensionPoint Recovery Services, LLC regarding the balance of {$800.00} for XXXX. The card arrived, but was never activated by my now XXXX husband. According to when I informed XXXX XXXX nd AscensionPoint of my husband 's death, they informed me that this is not the family responsibility but yet they are still sending me statements and letters and it has been placed with collection agency which is AscensionPoint, XXXX XXXX, XXXX in which now they are sending bill in my name.

On XX/XX/2022, I received a phone call from AscensionPoint Recovery, LLC at XXXX. I missed the call and returned it at XXXX on XX/XX/2022. When I spoke to someone, they asked if I was the " executor '' of my step-father 's estate, XXXX XXXX XXXX I am NOT, but told them that I was his step daughter. I confirmed his date of death, and they stated they were attempting a probate collection for his XXXX 's XXXX XXXX. This card is being paid as agreed, by my mother, XXXX XXXX, XXXX XXXX 's wife. AscensionPoint called me as a " relative '' and tried to get me to pay the {$900.00} remaining balance by threatening a lien on my mother 's home ( which I do not live at ), and threatening to put this debt on MY CREDIT REPORT. How they received my information is a mystery, and why they are attempting to collect on a debt that is already being taken care of, is against Florida Statute. They are also in violation of Fla. Stat. Ann. 559.52. Pursuant to Florida Law, I am asking for a {$1000.00} resolution to their violation to be paid immediately, or I will file a formal lawsuit against the company, where legal remedy will be much higher!

This complaint is in regard to a collection letter mailed by AscensionPoint Recovery Services , LLC to collect a debt owed by my deceased mother, XXXX XXXX XXXX. XXXX of my mother 's creditors used AscensionPoint Recovery Services , LLC to collect outstanding account balances. As the XXXX of the estate, I wrote letters to the creditors to the best of my ability to inform them of the XXXX. I provided a XXXX certificate for documentation purposes. Before I was able to settle the outstanding balances, AscensionPoint Recovery Services , LLC sent a letter to the Estate of XXXX XXXX. Sheets to an address that is not related to any of her accounts in any way. The letter was requesting information regarding the XXXX of the estate. I am filing this complaint because I do not understand why AscensionPoint Recovery Services , LLC felt that it was necessary to send a collections advice to a random address. I believe that this predatory collection agency searched for the same last name in the same city, state, zip code as a XXXX expedition. This is very offensive to my mother 's XXXX.

My father XXXX XXXX on XX/XX/XXXX. I am the court appointed executor of his estate. I received a bill dated XX/XX/XXXX ( received on XX/XX/XXXX ). As the original creditor is not listed on this correspondence, I called to ensure this debt is not being collected under the original creditor name and a collection company. After requesting a manager, I was transferred to XXXX who advised me it is " Against the Law '' for him to tell me the creditor on this debt. When I asked what law it was against, he openly admitted he did not know and did not even know if there was a law prohibiting it. He transferred me to his supervisor XXXX and she also refused to identify the initial creditor. Ascension Point is practicing deceptive collection practices through both the failure to identify the original creditor which is required by law and through the use of intimidation by making false statements such as " Against the Law ''

I received a phone message from XXXX XXXX XXXX XXXX. They called me about debt related to a deceased family member, XXXX XXXX. I am not responsible for any debt he may owe. This phone message ( left on my machine ) sounded like a typical phone scam aimed at older consumers. The return phone number left in the message is XXXX. Internet research showed this phone message to be a scam aimed at older consumers. Mr. XXXX was my sister-in-law 's father ( XXXX XXXX XXXX ). He passed away in late XX/XX/2018. I am only related to him through marriage and not responsible for any debt he left. When I contacted my brother to report the phone message, he said that it was a scam. When I contacted the company to have my number removed from their call list, I was told that the consumer service representative had to " obtain permission '' to remove me form their call list. When I called again, I was told the same lie.

My Father, XXXX XXXX XXXX, died XX/XX/XXXX. In XX/XX/XXXX my underage son was called five times by Ascension Point debt collection service regarding his estate. Five messages were left then they talked to my clearly minor child and coerced him into giving them my cell phone number. My son is clearly underage and this tactic is abhorrent. Furthermore, I am not the personal representative for my father 's will nor am I a beneficiary ( nor is my son ). I called Ascension point on Friday, XX/XX/XXXX, to ask them to cease and desist in calling me or any of my family members. After this call they contacted my sister 's father-in-law. My sister is also not the representative nor a beneficiary of out father 's estate. These aggressive tactics for possible fraudulent debt that we are not legally responsible for is unacceptable.

My mother died XXXX/XXXX/2014 and left an unpaid credit card. I went into the store to pay it and learned that they had written it off. ( excused the debt ) When I got home my wife said a collection company called and wanted payment for that same debt. She did n't know it had been written off by the original company and she agreed to pay it. She gave them a check by phone to be cashed a few days later. I stopped payment on the check as soon as I learned what she did. The collection company is AscensionPoint Services. They have continued to call me and my wife on our personal phones and her work phone. They say we are n't responsible for the debt but they keep calling. I researched AscensionPoint and found numerous pages of complaints on them being a scam and not to pay them anything.

Ascension Point Collection is attempting to collect a decedent debt they say they have obtained from XXXX XXXX associated with XXXX credit. My father passed away XXXX XXXX, 2016. They are stating that {$300.00} is owed on a credit card associated with XXXX and this bank. XXXX and XXXX XXXX have been contacted and there is no money owed. They released all financial obligation upon his death. Further, they have never heard of this company and only associate with XXXX. No paperwork has been given via the bank to ANY collection agency nor will there be. Despite several calls, the company is saying payment is owed. This is a scam. No one from the bank has even heard of this company. They are insisting on payment and have sent paperwork and made numerous calls.

my father died in XXXX of last year. had debt with XXXX credit card. i did a estate for father and after funeral paid and such only was {$88.00} and some change left so i sent to only creditor which wanted their debt paid, which was dcm services.check was returned saying wassnt full amount. now they sent to another agency and now they are harrassing me. my name not on debt at all. i advised dcm to stop harrassing me, but still continues and now another. last that was mailed was in my name, now i am afraid they are trying to aapply this to my credit for non pay. need to get stopped and my credit file checked they havent applied this as my debt. i spoke with a cfpb spokesperson and she advised me to file complaint to get stopped. she was very helpfull

On XXXX AscensionPoint Recovery Services, LLC. sent me a letter stating : Dear estate of ( my name ). The letter did not give me my mini-miranda rights nor did their letter state they they were a debt collector. I disputed the debt in a letter dated XXXX and requested that they conduct an investigation and to send me the results. On XXXX I received another collection letter from them with out receiving results of the investigation of my dispute on the alleged debt. The collection letter attempted to collect {$12000.00} and then it also stated to me : " You personally are not required to pay any of the debts from the estate. '' What estate if I am still alive and the the letter was sent addressed to me! XXXX the FDCPA and the Texas XXXX XXXX.

The debt owed was from my brother who passed away XX/XX/2018 and I told ascension point that there was no estate. Received a call from XXXX, claiming to Ascension Point, a debt collecting service. They claimed there were debts owed from my deceased husband 's estate ( my husband died 2 years ago ). But they would not say what for or how much. There were absolutely no debts owed at the time of my husband 's death or since then. They asked for personal information, which I would not give. When I commented that this was a scam & I would report it to the authorities, they said they would transfer me. Then the line went dead. I am concerned about identity theft by this company. Scam debt collection call regarding my recently deceased mother.
