RE : Attentively review my formal writ composed declaration of not proven complaint misinformation that is all or in part : deficieant of the adequate current status in the fullness of TRUTH, ACCURACY, COMPLETENESS, TIMELINESS, documented OWNERSHIP, certifiable RESPONSIBILITY, or otherwise irrefutable, complaint obligatory, and regulatory requisite reporting thereby mandating your immediate actions to rectify and remedy and any infractions behavior ( s ) by retaining or returning to demonstrate TRUE, CORRECT, COMPLETE, and COMPLAINT XXXX XXXX data field formatted reporting!!! I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX XXXX XXXX XXXX and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within XXXX days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with XXXX XXXX XXXX XXXXXXXX Consumer Financial Protection Bureau, and XXXX XXXX stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C . 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. 1. ASCENDIUM & {$0.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted. The first letter was mailed on XX/XX/XXXX and a second letter was mailed on XX/XX/XXXX. This letter is in response to a phone call I received from ASCENDIUM ED XXXX asking them to provide me validation of this debt in accordance with the FDCPA 809 ( a ). On XX/XX/2019, my employer send me A emailing stating that my wages will be garnish starting XX/XX/2019. So I contacted the loan company to informed them about I never received any information and at that moment they updated my information ( address in the system as they stated ). Spoke with a representative who took my call and stated that they will still garish my wages even though I never receive any information first by mail but only from my employer who receive it on XX/XX/XXXX and 15 % will be taken out. I was informed by the representative that I can get on income base program after I make 5 consecutive payment, plus the {$5.00} a month for 6 months. I cant afford that and I just started this job back in XXXX and just moved here, but she stated in order to do that I will have too. On XX/XX/XXXX, I contacted the company about I never receive the information about the garnishment at all and was informed by representative that it was send out on XXXX XXXX to an address I never lived at, which I told them and the federal law ( Public Law 102-164 ; 20 U. S. C. 1095 ( a ) et seq ) stated that Your creditor must give you a 30-day notice, the representative placed me on hold because she did not know what I was talking about and I ask to speak with a supervisor. When the supervisor finally got on the phone and informed him about I never received a letter and thats not my address. I was highly upset because my social security number is on the paperwork my employer emailed me. The supervisor stated that it was my job to keep my address updated and I informed him that on the site that I access it is updated to a address that I receive my mail too. The supervisor was very rude and while he was talking I listen. So when he finished I explained to him again Sir I never received a letter and never stayed at that address and while I was talking he was raising his voice and over talking me. So when I ask him a question he didnt answer at all for and it was a very long dead air on the phone. I said hello like five times and no answer and when finally got on the phone again, I ask him did he here anything I said and his answer was yes and I said well I ask a question and you didnt say anything at all. So he stated again, its my job to update my information, I ask for his Boss and stated she is not in and that she is a very busy woman. So I ask for her name and number which he provided the name and said her number is the same as if I was calling in. I ask him do he know when she will be in and he stated I do not know, she is a very busy woman. I informed him that I will be filing a complaint because of his unprofessional towards me. On the following day I contacted XXXX about the situation and was informed to speak with the collector, I informed them that I have and they are unprofessional and rude. Representative informed me that I can do voluntary payment with them instead of the wage garnishment but it will be up to them. I said okay, I will give that a try. So I ask to speak with there consolidate representatives and I spoke with a a representative and she walked me through the steps and was informed that it will take up to 90 days but to contact the collector to informed them that I will be doing that and see can they place it on hold since it doesnt start until next month. So I contacted XXXX XXXX again and as I was speaking with a representative who placed me on hold 3 times after I was speaking with her about the consolidation she placed me on hold again and but her supervisor on the phone who I spoke with before who was very rude and unprofessional and he explained to me that, thats not a good idea because I wont be able to apply to the IBR program if I do the consolidation and it will be more interest and I said well Sir I am going to do the consolidation and he stated the wage garnishment will still take place, so I ask him about the voluntary payment I can do and he decline. So I told him that I would like to do a hearing and can they send me a validation of my information from them. He stated that they will. I ask them how long will it take for them to send it out because the paperwork that was send out to my employer stated XX/XX/2019 and she received it on XX/XX/XXXX. He stated we will send it out on today. He also stated if you do the hearing that they will have to remove me from the IBR program and I said okay. Thank you.

I have disputed this creditor Ascendium Education on numerous occassions and baffled as to why this company has not deleted this inaccurate information. Ascendium is reporting incorrect data to XXXX and XXXX. Ascendium is reporting as if the accounts are new accounts. I have been disputing this for several months now because this company is reaging to keep on my credit reports. I had to research the company, as I was clueless to who this organization is. They are reporting numerous Ascendium Education accounts on my XXXX and XXXX credit reports as if they are recent accounts. I received an alert and it showed these accounts reporting opening dates as XX/XX/XXXX. I had my loans with several lenders, not Ascendium, which at this point the accounts are all obsolete. I never had any loans opened in XX/XX/XXXX which is what Ascendium is reporting. When I attended school, it was in 2001 or 2002 and I finished in 2009. So, I have been out of school exceeding 10 years. Then, when I completed school, I assisted in taking care of my father and my only sibling who both unfortunately loss their battle to XXXX, so I was not working or paying my loans. Then I became XXXX and still am, so I am not employed and have not been since completing school. Ascendium knows reaging is against the law. Re-Aging a delinquent account is a serious violation of the FCRA. Once the original creditor reports the FCRA Compliance Date to the credit reporting agencies, it is set in stone. This date can not be changed or updated under any circumstance. The time clock on the date the account FIRST went delinquent can not change no matter how many times a charged-off debt is purchased, transferred or sold to collection agency. Basically, the purge from date NEVER changes. The charged-off account can bounce from collection agency to collection agency but according to the FCRA, the debt can only be reported for 7.5 years from the date of first delinquency ( DOFD ). I am asking Ascendium to research their records because the original crediors date is not the one in which Ascendium is reporting, nor are they are reporting correct payment history as it it will show no payment history for the original creditor. All of these factors will support that the creditor Ascendium should not be reporting any accounts that are obsolete as well as reaged on my credit reports. I have attached a copy of my XXXX credit report. I have attached XXXX XXXX report. I have attached a complaint and response from the BBB in regards to Ascedium and this was their response to a complaint by XXXX XXXX XXXX XXXX, Thank you for sharing your concerns regarding Ascendium Education Groups ( Ascendium ) credit reporting. Although we are unable to disclose account-specific information in the XXXX XXXX XXXX public forum, we appreciate the opportunity to respond to your Customer Review. Ascendium assumed ownership of your loans from XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, and is now the furnisher of data to the Consumer Credit Reporting Agencies using the Ascendium trade line. It is important to note that the same information previously reported under the XXXX trade line ( i.e : open and delinquency dates ) is the information being reported, just under the Ascendium trade line. I purposely defaulted my student loans to get a in-person hearing our over the phone hearing because XXXX and its previous names ( XXXX XXXX and XXXX XXXX ) would not work with me. The only options these student loan providers ever want to offer is forbearance, deferment, our the greatest scam of them all, the income based programs. Its very unfortunate this is my only option left to fight the amount XXXX claims I owe them. For almost 16 years I have lived with non-stop harrashment from XXXX XXXX, XXXX XXXX and now XXXX. This past month ( XX/XX/ ) I requested all records of my student loans and payments ever made to XXXX, formally known as XXXX XXXX and XXXX XXXX. I requested these documents to support a over the phone hearing our a in person hearing that I have not officially requested to dispute the amount of money XXXX claims I owe them. 1. I HAVE NOT OFFICIALLY REQUESTED A OVER THE PHONE HEARING OUR IN PERSON HEARING AND XXXX HAS ALREADY DENIED MY RIGHT FOR A FAIR HEARING. XXXX STATES You requested an in-house or telephone hearing to stop the possible seizure of your federal tax refund or other federal payment ( s ) due you as allowed by the Treasury Offset Program ( TOP ). Your request has been denied. etc I NEVER REQUESTED A OVER THE PHONE HEARING OUR IN PERSON HEARING! I REQUESTED ALL MY STUDENT LOAN HISTORY AND PAYMENT HISTORY EVER MADE TO SUPPORT A POSSIBLE HEARING. IF XXXX OUR ASCENDIUM HAS THE REQUEST FOR REVIEW PAPER WORK THAT WAS SENT TO ME TO OFFICIALLY REQUEST A REVIEW AND THE PAPERWORK IS FILLED OUT, ALL THE INFORATION ON THE PAPERWORK HAS BEEN FORGED! Please allow me to explain what I mean by OFFICALLY REQUESTED. Ascendium, the deceiving collection agency supported by XXXX, sent paperwork to me that included the REQUEST FOR REVIEW. This paperwork gives me the opportunity for a over the phone hearing our in person hearing to dispute what XXXX claims I owe them. I have NOT SIGNED any of this paperwork titled REQUEST FOR REVIEW our sent it to anyone. To my knowledge, this paperwork is the only way to request a over the phone our in person hearing. XXXX denying my right for a REQUEST FOR REVIEW without giving me a chance to present any paperwork for a over the phone hearing our in person hearing should be against the law! There is a good reason why XXXX is currently being sued by many people for deceptive practices. 2. XXXX did not send me all the records of my student loans and payment history that I requested. I was only sent payment records back to XX/XX/XXXX. My first loan was taken in XX/XX/XXXX, I know there are more records and I want those records. Im very curious as to why XXXX is not disclosing this information. 3. My online account with XXXX has been locked for over a year. I have tried multiple times to access this account without any luck. I have sent numerous emails only to be told XXXX can not help me through email and for me to call random 1800 numbers. I have not called and will not. Once this deceptive organization gets a persons number the harassment never stops. I have even offered to meet with a representative from XXXX in person but they have denied those requests, imagine that. I have kept several email transactions with XXXX that I would really enjoy presenting to a court. 4. In XXXX I signed a 6 year enlistment with the XXXX XXXX that included tuition reimbursement. Payments on my student loans were made and more payment could have been made. I fought with XXXX XXXX, XXXX XXXX, and now XXXX about this matter for years and they all could care less. I have a contract from the XXXX XXXX showing I was enrolled in the tuition reimbursement program. I want to see my complete student loan record and payment history as stated before. All I am asking is to have a fair chance to have my voice heard and receive a fair hearing.

I received a letter dated XXXX XXXX, 2021, stating that my Federal loan debt ( approximately 130k ) was taken over by another company after the initial company, XXXX/Ascendium in conjunction with XXXX XXXX XXXX XXXX, conducted a financial review/administrative hearing to determine if and what I could pay on the past loans. I never received any resolution from XXXX but the next time I heard anything about my loans was when I was contacted with a letter from the new company, XXXX, or XXXX XXXX XXXX. Again, I did not receive a determination letter or a conclusion to this initial review but rather, was contacted by a new collector named, XXXX XXXX XXXX ( XXXX ). I contacted ( via phone call XXXX XXXX ) XXXX and was routed to a XXXX XXXX XXXX XXXX XXXX ). According to the letter his department sent me and XXXX XXXX admissions on the first phone call, I had three options one of which was the ability to rehabilitate my loans with XXXX ( a federal loan servicer ). I was happy to hear that I could indeed start this option! XXXX XXXX initial conversation had to be cut short because I called him during my lunch break on XXXX/XXXX/21 but asked him if I could indeed call him back the following morning at XXXX XXXX est. he agreed. As planned, I called XXXX XXXX back on XXXX/XXXX/21 and the conversation went well, at first. I asked him based on the options his company sent in the letter and which he stated the prior day, could he please send me the proper paperwork for me to begin the loan rehabilitation program he refused! He demanded I give him, then and there, round-about financial numbers and personal documents, e.g., tax returns, IRS documentation, etc. I kindly stated I did not feel comfortable doing this approximation of what my true financial situation was as this would be especially important in determining my future payments I am a XXXX who does not make much, so this was especially important to me. The manager, XXXX XXXX then lied and stated, I spoke to XXXX and a staff member told me that you have had wage garnishment in your past based on the owed loans this was an outright falsehood, and had never heard of this before and assumed was his attempt to intimidate me into giving him what he wanted. I concluded after this conversation that the letter and XXXX XXXX claim of the option of rehabilitating my loan was a falsehood and a bait and switch tactic. I did become upset with him and accused him of being unethical and unprofessional ( and a few choice words ). Finally, I was willing to rehabilitate my loan ( s ) only to be misled and lied to by a person supposedly representing XXXX XXXX XXXX in good faith XXXX XXXX was not working in good faith and lied to get what he wanted, collection fees on his and his companys behalf. XXXX XXXX threatened to garnish my wages at the end of the conversation without giving me the opportunity ( as claimed by his letter and initial phone conversation which were recorded ) to provide sound financial information on my behalf to rehabilitate my past loans. Please help me resolve this situation and disallow this rogue representative of XXXX to treat people in the unethical and unprofessional way he treated me and to disallow him from proceeding with the wage garnishment of my XXXX salary. Finally, I will be going to the local newspaper to volunteer my current experience/situation with XXXX as an opinion piece to hopefully expose collections companies like this who prey on hard-working XXXX especially during the trying times. XXXX, XXXX, XXXX and XXXX are assumed to be credit Bureaus and there is only on Bureau and that is the Consumer Financial Protection Bureau. XXXX, XXXX, XXXX and XXXX continue to report debt in the public that isnt mine. On XX/XX/1933, Congress enacted HJR-192 section 73-10 to suspend the gold standard and to abrogate the gold clause. When I called the XXXX XXXX XXXX they were Spreading False Statements that I had not paid on My School Loan since ( XX/XX/XXXX ). Of Course not long after that, I received a letter from the ( Federal Offset Unit, Dept. of Treasury ) ( See attached ). But this letter from the Federal OffSet Unit WANTS to [ Withhold Funds from my Soc. Security Payments because of that False Statement -REALLY! ]. It does not take a genius to figure out what XXXX XXXX is doing. And the ( U. S. I am totally confused regarding who and who is handling my student loan activities. I took out a loan for graduate school between XX/XX/XXXX - XX/XX/XXXX with XXXX XXXX, then XXXX XXXX contracted my loan to a XXXX and now to Ascendium. My loan amount then was about {$47.00}, XXXX. Have been paying on my loan since graduation except for XX/XX/XXXX due to XX/XX/XXXX crashed when I lost my job at XXXX/XXXX and I requested forbearance until I had another job in XX/XX/XXXX. Ascendium sent my loan for collection to XXXX XXXX XXXX XXXX , XXXX, XXXX, GA XXXX with a hefty collection fees of {$17000.00}. ( see attachment # 1 ). I was having difficulty paying my loan then a {$17.00}, XXXX burden was added bringing the total of over {$64000.00} with interest added ( I do not know how much ). This has been my nightmare. I started paying on my loan by wage garnishment from my Social Security benefits and from the State of Maryland. I last file a complaint with your Office with regards to how my payments are distributed. I never got an answer from Ascendium. I went on their website to only find payment from Social Security Administration and nothing from the State of Maryland accounted towards my account ( see attachment # 2 ). Further after examining the loan I downloaded it states a loan date of XX/XX/XXXX and disbursement date of XXXX. I graduated from XXXX University in XXXX. I did not take out any loan in XX/XX/XXXX. I was not in any school whatsoever. So, I need to know where this came from. Because of Covid-19 the Former President Donald Trump suspended payment & interest on student loans. And suddenly after he left office my name was sent to XXXX XXXX XXXX who is making threats about a law suit. I can not get through to anyone at Ascendium. Their machine will tell you for default loans call the Debt Collector. I do not want to deal with a debt collector, because they are not my loan servicer. All Ascendium has to do is to resubmit request for wage garnish to the Department of Treasury and The State of Maryland ( DHS ) as it was done before and I just have to acknowledge and signature. But they prefer sending my name to one of their cronies. Since it's had to get someone at Ascendium, I went on-line to check my payment history and I am surprise there is NO PAYMENT HISTORY whatsoever. See attachment # 3. I would like to know whether this loan dated XX/XX/XXXX is mine or not because I did not request any loan for school in XX/XX/XXXX. If it is the old loan from XX/XX/XXXX-XX/XX/XXXX, I need a complete up-to-date payment history. I tried so many times to get this information from Ascendium but to no avail. ( see attachment # 3-1 ). You are the second person I am asking for help After a long career in the XXXX XXXX my daughter was seriously ill and had a chronic illness I resigned from my job and went back to school. I am a member of the armed forces that received XXXX XXXX order to a combat zone. XXXX was notified in writing and via phone along with my other two student loan companies of my XXXX and I requested a forbearance until my deferment became active due to financial difficulty ( exact dates and times can be released upon request along with all documentation ). The exact month that I left for combat I have a letter from XXXX stating I was eligible for the SCRA and additional benefits if I were in a war zone, which I was, as long as I sent my orders to them which I did. That same month XXXX sold my loan to ascendium education. Ascendium education has these loans in a defaulted status currently and did so at that time within two months of my XXXX. I was able to do research when I got back and I contacted them with no solution. I am in good standing with my other two student loans and have been who did place my loans on hold. I have researched and found out that part of one of the loans in good standing is owned by ascendium too. How can ascendium state that they didn't know anything? You can look in the national data base and see all of my loans and all of my information. You can also look into the military side of things. This is not hard. So they dropped the ball somewhere but want me, the service member to pay the outrageous interest rate prices that have accrued because they messed up. They violated the Servicemembers Civil Relief Act ( SCRA ) and did not defer some of my loans. They would not listen to me when I tried to explain even though it is in black and white when you look at my account in the department of education national data base. The collections department is constantly calling from different numbers. They call my cell phone, my work and then they are hanging up, threatening, threatening to garnish my wages. I believe this is not only harassment, a violation of ones rights and fraud, it is also a federal crime to a service members right to be protected from such actions. I have written proof. I have proof they were notified. I have proof that they own both of my student loans one in which was placed in deferment appropriately and is still in good standing. They have dropped the ball. All I have wanted was them to take all that outstanding interest off, consolidate and fix those loans, take off all those fraudulent reports on my credit so I can try to begin a more normal life again. XXXX XXXX XXXX XXXX XXXX, has not honored my cease and desist telephone communications requests. Several times in XX/XX/2019 specifically, XX/XX/XXXX, and XX/XX/XXXX, I had rather intimidating and belittling phone calls with a representative ( Id # XXXX ), who used demeaning and aggressive language towards me. On one of the calls, she instructed me to get a prepaid card ( on which I would accrue monthly fees ) in order to make a payment and when I asked her if there were any other options available to me, she reiterated that if I did not make a payment within 30 days of receiving the notice of wage withholding, my wages would be garnished through an administrative garnishment. Under the threat of an administrative garnishment, not having the money, feeling belittled by XXXX, and based on the threatening and condescending manner with which they spoke to me, I purchased a prepaid card in order to make the payment and enter into an arrangement for subsequent monthly deductions from the card. XXXX collected money from me in order to execute the agreement. However, on the same day that I made the payment, prior to providing XXXX with my card information, I requested that they provide me proof that I owe the debt because I could not find documentation it based on a review of my personal records. Today, XX/XX/2019 I again received several calls from a number that XXXX called from onXX/XX/2019. On the XX/XX/2019 call, I told the representative that I requested that they stop calling me a few months ago and that I only wanted letter communications. Also, todayXX/XX/2019, XXXX sent me an email about the debt. It has become unbearable. Also, I spoke with XXXX, the federal student loan servicer, to ask if XXXX was collecting on their behalf and the XXXX representative said " no, '' which increased my suspicion of XXXX XXXX began each call with me by stating that " they've been hired by XXXX '' to collect, which caused me a lot of stress. I ask that all the calls connected to the account on which XXXX is attempting to collect be reviewed. In those calls, you'll find evidence that : - I requested that XXXX not call me ; - My communications with XXXX reps were abusive ; - XXXX reps deceptively represented to me that they were hired by XXXX to collect the debt ; - XXXX used the threat of garnishment to take a payment from me before providing me proof that I owned the loan ; and - XXXX may have committed other violations of consumer protection laws and infringed on any rights granted to me under those laws.

I entered into a rehabilitation agreement with Ascendium/XXXX ( made payments to XXXX XXXX XXXX- see below from their website ) in XXXX and paid six on-time payments. Based on the Federal Moratorium Law instituted by the US Federal Government ( " If you have a defaulted federal student loan and enter a new rehabilitation agreement during this pause period any date since XX/XX/XXXX the suspended payments that would have been made from the beginning of your agreement through XXXX XXXX, XXXX, will count '' - studentaid.gov ). I did not make my last three payments. Based on this new student loan Covid Relief law I should of received rehabilitation credit for the last three payments even though I did not actually submit these payments. Consequently, I was under the assumption that my rehab program was successfully completed on XX/XX/XXXX. I initially called XXXX ( collections agency and the agency that sent my all of my rehab documents ) and spoke to XXXX ( XXXX XXXX ) to check the status of my rehab program. She advised me that I indeed completed the rehab program with their company and sent the information to Ascendium/XXXX. She also advised me to ask a representative at Ascendium/XXXX about my post-claim status. I called Ascendium/XXXX on XX/XX/XXXX and spoke to XXXX. She advised me ( after getting guidance from her supervisor ) that I would have to pay the last three remaining rehab payments to XXXX or I would have to " wait in the back of the line '' behind all of those who made the nine required rehab payments per Federal law. I explained to her about the Federal rehab payment moratorium and that I should have received credit for the last three remaining payments based on this law. She said she could only tell me what her supervisor stated I must do to finally have my loans rehabilitated. I was highly upset because I am finally trying to pay my loans back. Ascendium never contacted me at my current address which I have had over 10 years. I was informed by the Attorney General to submit the complaint. Ascendium Education is reporting 16 debts from previous creditors from student loans. I attached their response which confirms that they are falsifying dates to keep on my credit reports. All of my loans exceed 7-10 years, however they are reporting the opening dates of the the obsolete accounts as XX/XX/2016. Then they are reporting the payment history as the payment history starting in XXXX, 2016. It is against the law for a collection agency not to report the same opening and payment history of the original creditor. Even if the credit collection company reports the opening date in which they receive the defaulted account to the credit bureaus, it is against the law for them to report a payment history that is not the same as the original creditor. Ascendium should know that negative re-aging debt on credit reports is changing the delinquency status of an account to fool the credit bureaus into thinking its more recent than it really is. Negative re-aging is illegal and, if it occurs, you are in violation of the Fair Credit Reporting Act. Some collectors do this intentionally. Collection accounts may be reported for seven years from the date that the party first fell behind with the original creditor. Thats true regardless of whether the account is paid, unpaid or settled in the meantime. If a collection agency re-ages the original date of delinquency, it is likely breaking the law, and the consumer should contact the Consumer Financial Protection Bureau and/or a consumer law attorney. I have attached my credit report so that you can see that Ascendium has changed the original date of the loans as well as they have changed the payment history. I also attached a copy of the letter from Ascendium and it supports that Ascedium is reporting false information to keep on my credit reports. If they do not remove this false data immediately, I will be forced to sue the organization. Please take note of the dates in which Ascendium is stating, the dates of the obsolete student loans, the dates reflect that I have had all of the loans exceeding 7-10 years which support they are outdated and should not be reporting as recent student loans as Ascendium is falsely reporting. We have repeatedly been harassed by collection agencies for debts that DO NOT BELONG TO US. Their was an employee error in verifying my husband, but that is NO EXCUSE the Collection Agency should be verifying whom they are owed money from BEFORE contacting someone's employer! As part of my loan repayment plan, I entered into a contract with XXXX. XXXX was working on behalf of Ascendium Education to service the loan. The loan repayment plan was set to automatically debit from my checking account on a specific day each month. No payments were missed. During XXXX, the Covid-19 pandemic occurred. When the CARES Act was passed by the U.S. Government, XXXX sent out a brief notification that payments would be temporarily suspended. There was no request sent in by me for this suspension. In XXXX of XXXX, I received a notification from XXXX XXXX XXXX XXXX, a collection agency who claimed they were working to collect a debt for XXXX ( latest collection letter attached ). I called XXXX on XX/XX/XXXX and spoke with agent XXXX XXXX. He told me that XXXX had ceased their suspension of payments in XXXX when the original CARES act expired. After 60 days, the account was sent to XXXX for collection. He advised me to contact XXXX to get a full explanation. I called XXXX on XX/XX/XXXX and spoke with XXXX, operation # XXXX. XXXX was very combative and argumentative. At several points in the conversation, she actually denied working for XXXX, instead claiming to work directly for Ascendium. Her fallback phrase, " your account is no longer in good standing '' was uttered in response to most of my questions. I asked why XXXX had not resumed their contractually obligated payments when their observance of the original CARES act ended. She refused to answer. When I asked why the account was sent to collections, she uttered her fallback phrase. When I asked why XXXX did not reach out to resume payments they had voluntarily suspended, she refused to answer. Eventually, I gave up on the conversation. As of now, XXXX wants me to enter into another contract with them, using XXXX as a servicer for a Consolidation. I feel this would be a very bad decision but feel pressured to try and get my account back into good standing. What are my options? XXXX has already added {$5000.00} in fees and interest in 2 months and Mr. XXXX says the interest is accruing daily. This debt is growing out of control and right now I see no hope.

Ascendium, the loan guarantor ( and XXXX, the loan servicer ) are both threatening collection action, call the loan and damage my credit history for an amount they claim is overdue, but I am actually paid ahead. On XXXX, I received a call from XXXX that I was behind over {$2500.00}. Since then, I have made XXXX calls to XXXX and XXXX calls to Ascendium to get clarification and resolve this issue since ( i ) not once in my online account 's dashboard did it ever say I was behind anytime in XXXX ; ( ii ) not a single monthly statement in XXXX showed I had a past amount due ; ( iii ) an account truly behind 9 months would have been reported already to a credit reporting agency and would have been transferred over to the guarantor ; ( iv ) and adding all of my payments in XXXX actually showed I was overpaid ( and still am ) since all of XXXX ; ( v ) no late fees have ever been assessed. I have offered to share my evidence of payments, but no one has been willing to sit down with me ( in person or virtually ) or receive the evidence via email, mail, etc. On XXXX, I spoke to XXXX, Account Manager ( payroll / # XXXX ), XXXX, who discovered that someone, instead of updating my account to paid ahead to XXXX, actually typed XXXX. Everything unraveled from that point. However, she said it would be corrected within 24 hours by the accounting department ( or 48 if she had to take it to another department ). On XXXX, when I called XXXX, I received contradictory information in that the matter would take 8 business days to get a response. On XXXX, I received a letter dated XXXX that XXXX was calling the loan and threatening credit harm if the " overdue '' amount is not paid by XX/XX/XXXX.

Im filing a complaint against Ascendium/XXXX XXXX XXXX/ Department of Education . I started going to XXXX, now XXXX ( XXXX College ) in XX/XX/XXXX and finished in XX/XX/XXXX. I was promised that I would be making more money with a degree and if not, they would provide me with a position making more money. When I finished my total was around {$18000.00} and I started paying monthly. In XXXX, I consolidated my loans, which means it should only be one loan amount and not two as they are reporting it. Sometime in XXXX/XXXX, it was determined by the government that XXXX Colleges was found to be fraudulent ; therefore, the loans were fraudulent and should have been discharged. At the time the total they said I owed was {$11000.00} and on another loan {$14.00}, XXXX. If you will notice, Ascendium wasnt on my credit report until XXXX, ( the year XXXX was breached ) and they reported these loans as if I had attended school in XXXX. In XX/XX/XXXX, Ascendium seized my federal taxes of {$5100.00}, claiming I owed them. I was contacted in XXXX by XXXX XXXX XXXX and told they were in the process of garnishing my paycheck and to stop it, I had to sign a contract to pay or my paycheck would be theirs ; I had to sign and agree to pay, and I have the contract to which I signed. They have been debiting every month since XXXX {$78.00} until the end of this year and afterwards I will have to start paying more. The way the contract is written is as if I just applied for a loan to attend school. I reviewed my credit report and on my XXXX report, it shows over {$20000.00} in student loans owed, but on my XXXX, it doesnt show any student loans owed ; they all are discharged, as they should be. In a nutshell, XXXX in-house collections agency committed fraud by lying to the Federal Government in order to procure my federal tax refund. In XXXX of XXXX, after I became unemployed, I called XXXX to set up a payment arrangement for my defaulted student loans. Being unemployed, I could only set up a minimum payment of {$5.00} at the time. I was told by the supervisor ( who refused to give his name ) that amount was unacceptable. I told him I could not afford anything more, to which he replied that they would just submit a wage garnishment to recoup payment. I then informed him that I was unemployed so a wage garnishment would be a moot point. This upset him. I also asked to only be contacted via USPS, because I was tired of their repeated calls daily ( upwards of 5-6 calls daily ), which angered him further. I again offered the $ XXXX/month payment, he again refused it and said there were other ways to get me to pay and ended the call. Fast forward to XXXX of XXXX, and Im due my federal tax refund. On the day it was to post, it was offset by XXXX, in the amount of {$3000.00}. I called to inquire about the offset, and was told by the representative ( XXXX ) that the offset was entered at the end of XXXX due to failure to make payment arrangements with the collections agency. This is where they committed fraud! I did try and make payment arrangements, the collections agency refused the amount. They then told me that I had to contact the collections agency again to set up a payment arrangement. So I did, and was placed on their rehabilitation program where I am required to make ... wait for it ... a payment of $ XXXX month! The EXACT SAME payment I tried to make in XXXX. The collections agency LIED in order to procure my federal refund, which Im pretty sure is illegal, hence my use of the term fraud.

I pulled all 3 of my credit reports to find out what was showing on them, as I hadn't done it in a long time. I was shocked to see accounts that I do not recognize, including companies I've never done business with. One of these was : XXXX XXXX XXXX XXXX XXXX XXXX XXXX The address listed on the credit report is : XXXX XXXX XXXX XXXX XXXX XXXX, PA XXXX The account numbers that they are reporting is " XXXX '' and " XXXX '' I was advised to send a " Validation '' Letter to them to validate the debt under the FDCPA and FCRA. I have attached the letter with my complaint. I mailed it " Certified Mail '' so that I would be able to verify that they received it. XXXX tracking shows that it was delivered on XX/XX/XXXX at XXXX XXXX. I have also attached a copy of the " Certified Mail Receipt '' so that you can see the tracking of this letter. Under the law, they had 30 days after receiving the validation letter to respond to my letter and validate the debt that they're reporting to the credit bureaus. It has been 52 days ( Today is XX/XX/XXXX ) and they have not sent me anything at all. I have given well over the 30 day window for them to correct this and validate this debt they're reporting, but they have not done so. Please note that before sending the validation letter to this company, I also sent a dispute letter to all 3 credit bureaus ( XXXX, XXXX, and XXXX ) and XXXX XXXX XXXX XXXX have NOT removed this account from my credit reports, or have sent me any kind of validation. I request for this company to remove this account from my credit reports immediately, as they have not followed the law, including FDCPA Section 809 ( b ), which carries a {$1000.00} fine for not validating the debt and still continuing to report it on my credit reports. I attended XXXX from XXXX. I withdrew because I was lied to about transferring my credits. In XXXX I applied for XXXX XXXX for XXXX and was denied. When I go on the federal student aid website it states that navient has my loans. So after contacting all these companies I found out that ascendium does have my loans even though the federal student aid website states that navient has my loans. I contacted ascendium about getting a refund and they sent me an email from the XXXX stating I would have to contact the XXXX XXXX XXXX for a refund. Then about XXXX weeks ago I received a check in the mail from the Department of Education for {$1000.00}. I called the federal student aid customer service to find out what that check was from and nobody knows. I contacted the sending him XXXX again and they stated that they can't give me a refund once again and I would have to contact the XXXX XXXX XXXX XXXX. Upon review of my credit report in XX/XX/XXXX it was brought to my attention there was several accounts that reported negatively that needed my attention. I have formally requested a hearing for the current Wage Garnishment that is being enforced on my salary from XXXX XXXX out of XXXX, NY. Refuses to provide me the original creditor 's information, which supports that Ascendium Education has reaged the account to keep on credit reports. The time clock on the date the account FIRST went delinquent can not change no matter how many times a charged-off debt is purchased, transferred or sold to collection agency. Basically, the purge from date NEVER changes. The charged-off account can bounce from collection agency to collection agency but according to the FCRA, the debt can only be reported for 7 years from the date of first delinquency ( DOFD ). I am requesting the original creditor 's information again which I am entitled. It will validate when the accounts were opened and the payment history. I have never paid anything on the accounts because I have been XXXX over 10 years. The accounts are obsolete and if Ascendium does not delete the obsolete accounts that they have reaged, I will be forced to retain legal representation against Ascendium. XXXX and XXXX are not requesting the original creditor 's info which supports the accounts are obsolete. On Monday XX/XX/XXXX, I received in the mail a notice that my entire state and federal return had been taken by Ascendium Education Group to a total of {$9800.00}. When I called the number listed for this loan agency, I was transferred to another loan agency XXXX. It was at this moment that I found out that my loan is now in the hands of XXXX. I wrote an email on XX/XX/XXXX stating my questions and due to the circumstances, hoping they will be empathetic and release my return either partial or full. I received a canned email with a attachment for an economic hardship application, not at all addressing one of my questions. I was not aware of my default status, either was my loan consignor. I had been on automatic withdrawal from my checking account for over a year to Ascendium Education Group and it appears due to an inputting error with my debit card, the past 3 months of automatic withdrawals were not going through. Does 3 months of a mistake really warrant a {$9800.00} seize of my funds? I have been an XXXX XXXX member for 13 years plus and when I applied for a student loan with the Dept of Education in 2008 I was approved for the XXXX this loan was given to me via Ascendium and the US Dept Of Ed. I have had the loan in forbearance several times with intention of using my education awards to pay this loan in time, I recently was informed that tis loan was in default and I owed a sum of {$9500.00} for a loan of only {$3700.00}!!! I as an XXXX XXXX XXXX XXXX member find this excessive interest rates XXXX and unacceptable at the time of the loan I had no understanding of the 6.8 percent interest on this student loan coming form the department of education!!! I have never heard of such a rip off of the student loan process!!! One of my loan servicers is XXXX. They report to credit bureaus if a borrower is 90 days past due. I always keep a careful watch on when I may become delinquent. I was especially careful this year because I was going to consolidate my loans under the PSLF loan changes. A company, called Ascendium calls on behalf of my loan servicers to tell me about my options. They are not my servicer and they do not ask for payment. They have all of my personal information and say they trying to collect a debt. On XX/XX/XXXX I received a called from someone with Ascendium letting me know I needed to take action on my XXXX and XXXX student loans. They told me they would make everything current with my account, though the calls from my servicers might continue. I also received a form about income-based repayment. I even have an account number with Ascendium : XXXX. I complete the consolidation form and submit my PSLF to XXXX. Yesterday, XXXX reports that I am more than 120 days delinquent on several student loans. I told them about Ascendium and that I should be current. My credit score dipped XXXX points because of this. I want this off my credit score. I trusted Ascendium at their word and thought I would be brought current on my loans.

Originated a student loan with XXXX XXXX XX/XX/XXXX for {$28000.00}. Made monthly payments until I became unemployed. My loan was sold to United Student Aid Funds & went into forbearance XX/XX/XXXX. Was informed I needed to make rehabilitation payments to XXXX XXXX XXXX starting XX/XX/XXXX to XX/XX/XXXX for total {$700.00} in order to become rehabilitated & then my loan was sold to XXXX. My complaint is that I was never informed by United Student Aid Funds , Inc. or XXXX XXXX XXXX that I would be charged a {$7900.00} fee to rehabilitate my loan. This amount was added to my student loan principle & interest. I have now been paying at minimum {$500.00} a month to date to repay my loan & I am just now getting close to my original loan amount of {$28000.00}. I received a statement from the school outlining aid received. On the statement one of the loans indicated an lgl ( loan guaranteed loan ) The other a guaranteed student loan. Also XXXX XXXX XXXX and Federal Pell grant. Noticed on the Federal student aid Pell grants are not showing for this school. Did some research USA funds were a short term lender ( last resort ) the school issued XXXX normally. That would explain why family members and next door neighbors were getting calls from USA funds to help guarantee a loan. Don't know how an lgl can result in a Federal stafford loan. USA funds put in my financial aid record that the loans were not going to be subsidized. Eventually they got some third party person as to what was disclosed to me to guarantee the loans. This too must failed and the loans became XXXX XXXX subsidize loans however no one could locate a subsidy. When I contacted federal student aid they said if I were 8issued a Pell it would show up. I am attempting to contact my loan servicer but keep getting the run around. The last servicer I knew about was XXXX, so I called XXXX today and was told that my loans were paid off. After further investigation I was told that my loans were actually just transferred to XXXX XXXX. So I called XXXX XXXX and they told me they did not have an account for me so the representative told me to go to XXXX to find out who my loan servicer was. XXXX told me my loan servicer was XXXX. I called XXXX and put in my personal information ( SSN and DOB ) and was transferred to a phone number for XXXX. Unfortunately for me, no one answered and there is an automated message saying to call back during normal business hours but does not say what those hours are. I was not even able to leave a message. It was only XXXX PST so I can't imagine an office being closed at this time. I tried contacting these same people like 2 months ago and have not been able to reach anyone. I received a debt collection letter dated XX/XX/2022 from Ascendium stating that I was delinquent on my XXXX student loan. I checked all my loans on studentaid.gov and I am not delinquent on any of the loans. I called ascendium to ask for verification of the debt. The letter itself includes a debt collection notice that states in part " if you tell us you dispute some or all of your balance within 30 days of receiving this letter, we will send you information verifying a portion you dispute. '' However, the agent I spoke to claimed that ascendium can not verify this debt, and that despite receiving a debt collection letter from ascendium I have to verify my debt with XXXX. However, I have not received a letter from XXXX and only have an ascendium reference number. Instead of agreeing to send me verification of the debt as the letter states they would, the agent also tried to shuffle me towards programs to get caught up on my loan, which is not my issue here. I felt pressured to enter a repayment program for a debt that I can not verify, even after I explicitly asked the agent to send verification of the debt.

The Ascendium loans and the XXXX loans on my account are fraud. All of my student loans were paid-in-full by a second mortgage HUD 1-A with disbursements directly to XXXX in XX/XX/XXXX ( please see attached evidence ). I graduated from the University XXXX XXXX in XXXX. I never had any other student loan debt and all of mine was paid in XXXX by the aforementioned second mortgage. The XXXX and Ascendium loans are fraud and must be removed from my account. XXXX was helpful, and removed the debt from my credit report. XXXX was non-responsive and continues to post numerous repeats of the fraudulent debt regardless. The fraud representative, XXXX, with XXXX was not helpful. We spoke with XXXX in the fraud department with XXXX, formerly XXXX, who confirmed my loans were paid-in-full in XXXX. XXXX did not want me to ask questions or to speak, other than just providing my personally identifiable information and updated contact information to the creditors. I get an email daily stating what is coming in the mail. I received a letter with not post date on it. Inside the envelope there was a letter threatening garnishment of my wages. The envelope was also not certified. The letter was dated XX/XX/2021 but it arrived at my door on XX/XX/2021, two weeks after the date of the letter. They were wanting me to fill out extremely personal information but the letter looks suspicious. I didn't want to fill it out any information because i didn't feel comfortable by how I received the letter. This account is not listed on my credit report either. It stated it had been charged off. I don't want this to reflect on my chances of trying to purchase a home. I have been working hard on my federal loan to pull it out of default. I went to school from XX/XX/XXXX-XX/XX/XXXX, was injured at work and had to drop out. I was off work for a XXXX and went back to work in XX/XX/XXXX. They started garnishing my wages and took all of my refund money. I now have a descent paying job and they keep selling my loans to other companies and charging me 25 %. I requested information regarding the new " XXXX XXXX XXXX' program, from Ascendium, one month ago via a phone call and email. They requested that I contact XXXX for more information on the program. Today, I received a letter stating my loans are being transferred to XXXX per MY request to begin the " XXXX XXXX '' program ( see attachment ) - I never made such a request. This would bring my XXXX loans out of rehab status. Ive had severe issues with the student loan process for at least 10 years. An on going fraudulence has occurred on my student loans which I believe started with identity theft. Im unable to get resolution and require legal assistance. Ive contact every department related to my claims & accounts for the past 3 years. Ascendium Education Group took over my student loans some time ago. I was not aware, but they have been accepting payments from me since XXXX and not reporting that information to the credit bureau. To make matters worse, I consolidated my loans with another servicer and they are now in good standing with that servicer but Ascendium has flat out refused to remove the negative information from my credit bureau report and it is costing me. They are reporting two loans in collections and charged off. Neither is true. They are actually falsifying information on my credit report. I want these two accounts removed from my credit report. I want the collection and charge off status removed because those are false statements. This has now become a housing crisis for me. On XX/XX/XXXX I received a Wage Withholding Administrative Hearing Final Decision from XXXX XXXX XXXX XXXX with copies issued to myself & XXXX XXXX XXXX. The Decision states " Ascendium or Borrower may request reconsideration of this decision anything after 6 months from the date of this decision. '' I received a new letter from Ascendium dated XX/XX/XXXX stating they are starting attempts to collect from me already. I called them on XX/XX/XXXX to ask them why, based on the above decision they were contacting me already and they said my Final Decision had nothign to do with them and the amount was due and that they were going to start procedures on me. They were not trying to listen to the fact that my Final Decision said I have 6 months before they could reconsider. I hung up the call. XXXX and XXXX removed the above mentioned item once an FTC Report and documents to verify my identity were sent. XXXX did not. I am making this complaint against Ascendium Education Solutions because on XX/XX/2023 my student loans were discharged due to the Borrower Defense Case concerning the Sweet v. Cardona ( " Sweet '' ) lawsuit Ascendium Education who is contracted under the Florida Department of Education refuses to give me back a refund because payments were to the loan through offsets and wage garnishments even though the letter clearly says in the borrowers defense letter the following " The benefits do not apply to private loans '' there is no written policy on ffelp loans that states that you can not be refunded or receive a refund! Thr XXXX suggested I file a complaint here against my student loan " servicer '', Ascendium who took my student loans in 2019. They offset my taxes of {$5700.00} & told me they gave it to a company, new mexico but it's not on any statement. Now they direct me to XXXX or XXXX XXXX to resolve any issues since my loans are in default. According to fafsa, national system data site- my servicer is ascendium & NOT these other companies. Ive paid off the loan as of XXXX XXXX. I paid this loan on a settlement price of $ XXXXto XXXX XXXX XXXX. Upon payment they informed me that XXXX/ascedium wasnt taking incoming calls at the time to resolve the issue in my credit report. XXXX XXXX XXXX deleted my account with them as soon as I paid the settlement amount and the payment cleared. Im calling them to receive an XXXX balance report they told me they couldnt because they deleted my account. I set up auto payments with XXXX/ Ascendium but once i gave them my info they sent garnishment to my employer ( not a problem ). They have since sold my account to XXXX but they are still garnishing me. XXXX advised that they now have my account for repayment but i advised that I'm still being garnished by previous company. They advised to call them to see why garnishment is still in place since they sold my account. I'm being bounced around, nothing is being reolved. I feel as if I don't know who i should be paying. HI, All Federal Student loans were discharged due to permanent and total XXXX. All of this was completed thru XXXX and the loans were discharged thru documentation provided by the VA. XXXX is the loan servicer and they sent me information showing the loans as in fact discharged. The problem is 5 FFELP loans guaranteed thru Ascendium are showing still active. I have recently inquired that there has been an offset on my IRS tax return from the US Department of Education and lender XXXX XXXX. The offset was in the amount of XXXX and was taken over a decade ago back on XX/XX/XXXX I have confirmed the dates and amount with IRS, The Bureau of Fiscal Services, and the Treasury Offset Program. Ascendium send notice. I do not know who they are. XXXX did not notify me of change. I have written XXXX over and over on deferment forms and they never responded to my letter or notes. I gave up. I do not have phone to call. They failed to correct payments that I did make. They did not accept emails either. According to Trump has deferred interest and payment until end of year. Unsubsidized FFEL Consolidation Loans I have been paying income-driven payments by an automatic deduction for years. At some point, the XXXX decided to change the way they do things unbeknownst to me and stopped my auto payment, thus defaulting me. When I figured I had to be close to payoff, I inquired so I could pay off any remaining balance cash I learned about the change and that there are no added fees. Ascendium seems to have purchased my loans from XXXX. However, they have to been able to provide me with the promissory notes. I believe that the loan was already paid in full in 2014.
