Under the Fair Debt collection Practices Act ( FDCPA ), I have the right to request validation of the debt you say I owe you. I am requesting proof that I am indeed the party you are asking to pay this debt, and there is some contractual obligation proving my obligations to perform or comply, that is binding on me to pay this debt. The parties should be of like kind, being either artificial Legal Entity and artificial Legal Entity, or living Man/Woman and living Man/Woman, allowing more than two parties but never a mixture of these kinds. 2. Free and genuine consent The consent of the parties to the agreement must be free and genuine. The consent of the parties should not be obtained by misrepresentation, fraud, undue influence, coercion or mistake. If the consent is obtained by any of these means, then the contract is not valid or lawfully enforceable. 3. Full disclosure When negotiating a contract, full disclosure is the act of providing all material information, or telling the whole truth, about any matter which may influence the decision-making of the other party or parties before they decide to enter into a contract. 4. Signatures or autographs Written contracts between Legal Entity actors must carry the wet ink signatures of the parties, each wet ink signature being anaccommodation from a Man/Woman. Written contracts between living Men/Women must carry the wet ink autographs of the parties, and/or living identification such as a thumbprint. Living standing is recognised by a thumbprint, or more often by an unambiguous declaration with the autograph, such as authorised agent written below. 8. Privity of contract A contract exists only between the parties. ARS national services is guilty of information breach, they are using my personal information without my consent, and i will be contacting a lawyer to seek counsel, this is against the law what they are attempting to get away with, A breach occurs when a customers personal information was, or is reasonably believed to have been, accessed by an unauthorized person. N.J.S. A. 56:8-163 ( a ). Upon discovering the breach, the first step is to notify the Division of State Police, in the Department of Law and Public Safety, for investigation or handling. 56:8-163 Disclosure of breach of security to customers.

12. a. Any business that conducts business in New Jersey, or any public entity that compiles or maintains computerized records that include personal information, shall disclose any breach of security of those computerized records following discovery or notification of the breach to any customer who is a resident of New Jersey whose personal information was, or is reasonably believed to have been, accessed by an unauthorized person. The disclosure to a customer shall be made in the most expedient time possible and without unreasonable delay, consistent with the legitimate needs of law enforcement, as provided in subsection c. of this section, or any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system. Disclosure of a breach of security to a customer shall not be required under this section if the business or public entity establishes that misuse of the information is not reasonably possible. Any determination shall be documented in writing and retained for five years.

b.Any business or public entity that compiles or maintains computerized records that include personal information on behalf of another business or public entity shall notify that business or public entity, who shall notify its New Jersey customers, as provided in subsection a. of this section, of any breach of security of the computerized records immediately following discovery, if the personal information was, or is reasonably believed to have been, accessed by an unauthorized person.

c. ( 1 ) Any business or public entity required under this section to disclose a breach of security of a customer 's personal information shall, in advance of the disclosure to the customer, report the breach of security and any information pertaining to the breach to the Division of State Police in the Department of Law and Public Safety for investigation or handling, which may include dissemination or referral to other appropriate law enforcement entities.

( 2 ) The notification required by this section shall be delayed if a law enforcement agency determines that the notification will impede a criminal or civil investigation and that agency has made a request that the notification be delayed. The notification required by this section shall be made after the law enforcement agency determines that its disclos ure will not compromise the investigation and notifies that business or public entity.

d.For purposes of this section, notice may be provided by one of the following methods : ( 1 ) Written notice ; ( 2 ) Electronic notice, if the notice provided is consistent with the provisions regarding electronic records and signatures set forth in section 101 of the federal " Electronic Signatures in Global and National Commerce Act '' ( 15 U.S.C. s.7001 ) ; or ( 3 ) Substitute notice, if the business or public entity demonstrates that the cost of providing notice would exceed {$250000.00}, or that the affected class of subject persons to be notified exceeds 500,000, or the business or public entity does not have sufficient contact information. Substitute notice shall consist of all of the following : ( a ) E-mail notice when the business or public entity has an e-mail address ; ( b ) Conspicuous posting of the notice on the Internet web site page of the business or public entity, if the business or public entity maintains one ; and ( c ) Notification to major Statewide media.

e.Notwithstanding subsection d. of this section, a business or public entity that maintains its own notification procedures as part of an information security policy for the treatment of personal information, and is otherwise consistent with the requirements of this section, shall be deemed to be in compliance with the notification requirements of this section if the business or public entity notifies subject customers in accordance with its policies in the event of a breach of security of the system.

f .In addition to any other disclosure or notification required under this section, in the event that a business or public entity discovers circumstances requiring notification pursuant to this section of more than 1,000 persons at one time, the business or public entity shall also notify, without unreasonable delay, all consumer reporting agencies that compile or maintain files on consumers on a nationwide basis, as defined by subsection ( p ) of section 603 of the federal " Fair Credit Reporting Act '' ( 15 U.S.C. s.1681a ), of the timing, distribution and content of the notices.

I received a XXXX XXXX letter from ARS in California in XX/XX/XXXX. The letter stated XXXX XXXX had turned over my account for collection in the amount of {$14000.00} which I owed to XXXX XXXX. I contacted ARS and asked why they had my account I had been paying my account.I was told they received the account from XXXX XXXX to collect. I was shocked it had been turned over for collection. I requested to have 1 payment moved on the account. I was in the process of getting a equity line on my home to pay off the account to XXXX XXXX. I was not told it was going to collection. I thought my payment would be moved and it was handled. I was told by XXXX XXXX I needed to pay ARS they no longer had the account. I verified the amount and told them the closing attorney was sending a check from the trust account to pay off the loan. I confirmed the amount and requested them to send me a receipt showing the account was paid and closed. I asked to pay XXXX XXXX direct and I was told to pay ARS and they would send the funds. I confirmed all these details XX/XX/XXXX and they agreed to furnish me a payoff letter and the amount. I contacted ARS on XX/XX/ and spoke with XXXX and confirmed the amount ( XXXX ) according to their letter and confirmed this would clear the account with XXXX XXXX and I would get my letter, she agreed and confirmed the details. I was told it would take 5-6 days for the funds to clear and post to my account.I should call back. I called back XX/XX/XXXXand was told it had been paid and XXXX XXXX would forward my letter and show the account paid. I called XXXX XXXX back in mid XX/XX/XXXX and they said " yes '' it's paid and they were working on updating my account and they would mail my payoff letter. I called again onXX/XX/XXXX @ XXXX and spoke to XXXX XXXX He was very nice and said he saw it was paid and would need a supervisor to help. I was on hold for a very long time, over XXXX minutes. He keep coming back and apologized for the wait and said he needed a supervisor to adjust the account. Finally, he came back and stated that it was paid off. Then he informed me I owed another {$500.00} because of additional interest. I was very upset at this point! I explained the whole process and that I had follow their instructions to the letter, according to ARS and XXXX XXXX. I stated that I tried my best to work with them and they did not meet the agreement we had. I explained you can't accept my payoff and after the fact, decide you want to continue charging interest on a closed account. He put me on hold again. Then he lost the call. They didn't reach out to me again or call. If this wasn't enough, they reported my account 30 days late after we had spoken and worked out the payoff! I had my account for XXXX years with them and was never late. They sent it to collections without notice, accepted my payoff, refused to clear my account, added XXXX and showed a 30 day late ... ..This is not how you do business. I told them I would not pay the additional XXXX they wanted to charge. The account has been paid off. I want no further dealings with either company. All I want is my letter showing paid and the 30 day late removed. It should have never been entered. I hope this can be resolved with your agency. I decided to contact you instead of posting reviews of how poorly these two companies handled this situation. Thank you.

On the morning of XX/XX/XXXX I received a debt collection call from an unknown VoIP number. I returned the call and was informed I was a contact for somebody they were attempting to collect from. I requested the agent identify the company he was calling from, but they could only tell me it was regarding a financial matter and asked me if I could relay their message to the target party. When I declined because I wasn't sure who I was talking to, they insisted I still relay their message anyways. I called them back from a separate number to protect my own identity from further abuse. I was connected with the same agent, who then attempted to verify me using the last four digits of the other parties social. I do not know the person they were trying to contact, despite this, they believed I was them because I " vaguely identified myself. '' Instead of asking me to verify myself and my identity, the agent released PII to me in the form of the last four of the target parties social in an attempt to verify my identity. After telling them that was not a lawful disclosure, they forwarded me to their supervisor, who skillfully avoided liability on his or their agents behalf. This is where they went wrong : instead of asking me to tell them my social, they disclosed somebody else 's social security number instead. This is a willful disclosure of PII and they apparently have no intention to report this accidental disclosure. In fact, upon contacting them via their webchat about this, they would still not accept any kind of liability and dodged my questions, talking over me or ignoring specific details. They instead told me they are not related to ARS debt collection at all upon realizing my intention, and I would have believed them about not being related, until I was told to " Try XXXX. '' so without leaving the chat, I searched XXXX for ARS national, their supposed business. The first result is ARS National, a debt recovery operation. A flat out lie on that agents part before. I informed them of my discovery on XXXX, and at that point they were ready to cooperate in helping me with repayment by asking me for my name. I declined. At the very least, they should be held accountable for willful and negligent disclosure of their clients PII. This is dangerous because that information could be used to further identity theft and fraud. They appear to be trained to immediately deny any liability or involvement when this happens. When I spoke to a supervisor at ARS and told them what happened, instead of listening and acknowledging that one of their agents is improperly identifying people by handing out their social security number instead of requesting it in a secure manner in accordance with the law, they still insisted I forward their message to somebody I have never met. I won't let this go until I know ARS national is held responsible for years of unlawful practices. I am fed up with these types of operations believing they are above the law. I owe nothing to them, why should my morning be spent dealing with a shady organization? Why should anybody deal with these, for lack of a better description, mafiosos?

Within this past couple of weeks, I have received several calls from someone saying that if I did not pay a collection that everything attached to my social security number would be seized. The individual who called me was XXXX XXXX, she called on Monday, XX/XX/2019, at XXXX XXXX She advised that she works for a Law Firm and is reaching out to the XXXX XXXX XXXX to have them garnish my wages. I called her later that day and then she advised she worked for a collection agency who was attempting to collect a debt from CashNetUSA. I received an email from CashNetUSA at the end of XXXX stayed that they sold my debt to a collection agency. I received a call today from a Delaware number and when I answered the lady asked for me, I said hello, and was getting to ask her where she was calling from, and before I could speak she rudely spoke over me, so I disconnected the call. She called back and left a voicemail advising that me hanging up was not a good option and that they will garnish my wages and my school checks. This lady called Monday, XX/XX/XXXX at XXXX XXXX I called the number she left on my voicemail on XX/XX/2019, at XXXX XXXX. and someone else answered the phone, but they already knew who I was because they asked they stated my name. I asked them the name of the company because I keep getting harassed and the guy told me the name of the company as XXXX. He then transferred me to the person who was handling my case. On the following day, XX/XX/XXXX, I called again and spoke with XXXX XXXX XXXX who identified herself as being from XXXX XXXX in North Carolina. XXXX XXXX XXXX stated that they have offices in many places. ) She stated that I had an outstanding balance with XXXX of {$7100.00} and she was prepared to offer me pandemic relief for half the amount {$3500.00} as a settlement of this debt. I explained that I did not owe this debt and had in fact settled this {$7100.00} XXXX debt via another agency, ARS National Services, in XXXX. She advised me to send documentation of payment to XXXX, which I forwarded on XXXX XXXX on XX/XX/XXXX. ( I initially sent this to the wrong email address : XXXX. When I received a notice from my email carrier stating this was not deliverable, I forwarded the email to the correct address. ) I spoke with XXXX XXXX of XXXX XXXX at XXXX again today XX/XX/XXXX at XXXX XXXX in response to her voicemail message at XXXX XXXX. ( She initially provided a different number XXXX. ) She stated that the documents from ARS did not state paid in full, and that the account to which XXXX alleges is in question is XXXX for {$7100.00}. This is the EXACT AMOUNT referenced under ARS account number XXXX. Firstly, I notified XXXX XXXX that I did not receive notification of this alleged issue in writing of and she replied, things are different these days. Further, I requested a validation letter substantiating this alleged debt. XXXX XXXX indicated that this this would have to come from another unspecified entity ( To to me, meant that they were not the party responsible for this and I believe that this is incorrect ). XXXX XXXX stated that she will mark the file as disputed and stated that I should take my documents to court. As I had only ONE XXXX XXXX, I believe that XXXX XXXX is attempting to collect a debt that was resolved in XXXX by another agency, ARS National Services. In response to these two correspondences I spoke to agents on the phone and ultimately responded to their claim in the mail multiple times. One such correspondence is uploaded for your examination. I have received no response from ARS NATIONAL SERVICES INC in order to validate their claim other than the letters dated XX/XX/XXXX and XX/XX/XXXX that are uploaded to this complaint. The date of this complaint is XX/XX/XXXX. We are approaching two years since ARS NATIONAL SERVICES INC initially sent out their correspondences and they have yet to validate the debt they are attempting to collect on. My XX/XX/XXXX correspondence is a conditional acceptance to honor the debt that ARS claims to have but they have failed to provide any of the conditions set forth in that XX/XX/XXXX letter. ARS NATIONAL SERVICES INC is currently engaging in unfair and/or deceptive acts or practices. I have no contract absent their purchase of a consumer debt. I required debt validation from them via phone and/or correspondence to make available the documentation that proves that XXXX XXXX. is the assignor of the debt that they hold. They are unable to supply this documentation and they continue to cause the estate of XXXX XXXX XXXX harm by negatively impacting its credit profile. I previously settled a similar situation with another company like ARS NATIONAL SERVICES INC. This company removed the account they were holding from all credit reporting agencies yet ARS NATIONAL SERVICES INC refuses to follow suit. The case that was withdrawn by the plaintiff in XXXX COUNTY DISTRICT COURT also references this account and the fact that not only is the debt satisfied but that a company like ARS NATIONAL SERVICES INC can not legally and/or lawfully collect on it. ARS NATIONAL SERVICES INC 's initial correspondence dates back to XXXX of XXXX yet they have not filed any action with XXXX COUNTY DISTRICT COURT to collect on the debt they say is owed to them. The reason they have not is because they realize legal action is not possible given their position. Consumer debt sales are regulated by federal/state agencies and protected under laws enacted for commerce. The Federal Trade Commission ( FTC ) is one of these agencies and they protect the public fromunfair or deceptive acts or practices. This applies to all products and services not just offered by banks, but to every stage and activity, from product development to the creation and rollout of marketing campaigns, and to servicing includingcollections. The act/practice of debt sales has been shown to be unfair, and directly violates the FTC 's section 5, by causing or likely to cause substantial injury to consumers. Opened an account with XXXX XXXX while making a purchase in the store in order to receive a discount. Total amount came to {$150.00}. This total amount was paid via electronic issuance from my bank XXXX XXXX XXXX XX/XX/XXXX. No other purchases were made on this account. Received a statement from XXXX showing a balance the next month. My thought was that the payment had not been received at the time of the statement generation. Received another statement the next month that included a late fee on the statement. I contacted XXXX and indicated that they made a mistake and that payment had been made to them. They requested proof of payment which I provided. There was an issue with the account number however, they assured me that they would be able to locate the payment by name/ dollar/ amount and trace information provided by the bank. They indicated that was probably the issue with the delay of application to my account. They removed the fees and a few months later it happened again ... I repeated the same thing and then they removed the fees and made a notation and submitted the account for research. I provided information again and also hosted a 3-way call with my bank. The bank confirmed the payment. I also provided a copy of my statement showing the money being taken out of my account. About 6 more months went by and I started getting collection calls. To each one I told the representative the same thing and provided the same information. Finally I wrote a letter to the CEO complaining and received a call back from customer service. They took the issue under advisement and promised they would resolve it. The collection calls continued and I tried desperately to get it resolved. By this time it had been over a year and XXXX XXXX XXXX was negatively impacting my credit as well another account that I had with XXXX XXXX for my XXXX XXXX account was directly negatively impacted. I received letters from XXXX XXXX informing me that they were lowering my credit limit from the current {$1200.00} to {$800.00} then it went to {$600.00} and now to {$300.00}. This happened each time I paid down my balance. I went back and forth between my bank and XXXX XXXX both holding their positions. XXXX maintaining that the payment was made and accepted by XXXX and XXXX maintaining that they never received my payment and it was still owed. In XX/XX/XXXX/ XX/XX/XXXX I started received collection calls from ARS National Services indicating that they had ownership of this account and I had a balance of {$430.00}. I explained everything to them and provided the same documentation. They said they would note the account and open an investigation. At the end of XX/XX/XXXX I received a letter from ARS stating they received a debt validation request for the account with copies of the XXXX statements and indication that the debt is still owed. At this point I am not sure who is at fault, XXXX or XXXX however, what I am sure of is this money came out of my account and was sent and this has been paid and is not owed.

XXXX XXXX - Lost and Stolen Fraud refuses to cooper ate, to provide documentation requested, and to properly trace down scammers. This failure also resulted in a violation of 12 CFR Part 30, App endix D, " OCC Guidelines Establishing Heightened Standards for Certain Large Insured National B anks, Insured Federal Savings Associations, and Insured Federal Branches. '' The agency also issu ed a cease and desist order requiring the bank to take broad and comprehensive corrective actions to improve risk management, data governance, and internal controls. The bank senior management and the bank 's board has not made timely, sufficient progress in complying with the order. As a res ult of the unsound baking practices overseeing fraud and scams, the bank has turned to collect fro m consumers for their massive failures of effective risk management and internal controls. I was making regular payments to ARS National Service for a debt collection on a XXXX XXXX Credit Card. ARS lost the account and XXXX XXXX hired a new collection agency, XXXX XXXX XXXX per their letter dated XX/XX/XXXX. The balance due according to XXXX was short by {$200.00} for the last two payments made to ARS National Service for the XXXX XXXX account on check # XXXX dated XX/XX/XXXX and check # XXXX dated XX/XX/XXXX. Both checks cleared my account, which should have brought my balance down to {$5400.00}. I wrote a letter to XXXX on XX/XX/XXXX, informing them of this error. They never responded. I wrote a second letter XX/XX/XXXX and copied XXXX XXXX. I included copies of my canceled checks XXXX and XXXX. On XX/XX/XXXX XXXX XXXX sent a letter requesting that I call them. On XX/XX/XXXX they only acknowledged payment up to XX/XX/XXXX, but make no mention of the two subsequent payments on check # XXXX and # XXXX paid to ARS National Service. On XX/XX/XXXX, XXXX XXXX sent a letter requesting that I contact them via phone. They called me on XX/XX/XXXX per the attached copy of my cell phone detail for the incoming call. During the course of the conversation, XXXX XXXX acknowledged that ARS had received and cashed checks # XXXX and # XXXX in XXXX and XXXX respectively. They told me that ARS had refunded me but I informed them that I HAD NEVER RECEIVED A REFUND FROM ARS. XXXX XXXX then proceeded to tell me that I had to " DISPROVE '' that I received a refund by submitting a copy of my bank statements for the two months in questions. HIPAA laws not withstanding, I refused and asked that XXXX XXXX or ARS provide proof of refund via copies of THEIR canceled checks just like I did to prove payment ( which of course they can't provide because I NEVER received a refund. ) XXXX XXXX recorded this conversation for " quality control purposes '' and if two party consent is needed, I hereby give my consent via this claim for CFBP to retrieve an audio copy of the conversation. I can also provided a notarized affidavit attesting to what was said during this call bertween XXXX XXXX and me. XXXX XXXX followed up with a letter the same day, XX/XX/XXXX, reiterating that my balance was for {$200.00} more than my payments reflect. I don't know if there is a sweetheart deal or going away present that XXXX XXXX gave to ARS via my XXXX and XX/XX/XXXX payments. All I know is that ARS needs to forward the two payments to XXXX XXXX or issue a refund for {$200.00} to me. Last year in XXXX I was notified of a XXXX $ debt owed to XXXX. It was my fault. I thought the bill was on auto pay and never looked at my statements. ( The account is services by XXXX card holder services ). ARS debt collection agency was servicing the debt Their address is XXXX XXXX XXXX XXXX, XXXX, CA XXXX. The representative I spoke with asked for an initial payment of XXXX {$200.00} dollars. They also set up a monthly payment that would automatically be debited from my checking account each month for {$71.00} until the total debt was payed off. In XXXX of this year, the final debit for the remaining balance of {$33.00} was taken from the account. These transfers were automatic, and initiated from ARS, not me. 2 months later, I received a new bill from XXXX showing I owed {$140.00} + {$86.00} in late charges - all from the original debt. When speaking to representatives from ARS, they explained that the details of the repayment agreement were no longer available on my account, and they could only see that I was sending them payments for XXXX $ a month. The representative said if I paid the {$140.00}, they could waive the {$86.00} late fees. I paid the XXXX $ on the phone with them ( XX/XX/2020 ). I was then billed for the remaining XXXX XXXX which was supposed to be waived ( as they explained to me ). After speaking with two representatives today ( XXXX XXXX and XXXX XXXX ), they said there is no record of the XXXX $ being waived, and the company does not even have the authority to do that. All Ive been trying to do for the past year is pay off this debt! On XX/XX/2022, I received a letter from ARS National Services , Inc. about a debt they were trying to collect. I did not recognize this debt, so I sent them a debt verification letter, requesting information including, but not limited to : -Name and address of the creditor to whom the debt is currently owed -Copy of the signed agreement that created my original requirement to pay -A copy of the last billing statement -When the creditor claims this debt became due and when it became delinquent -Information about the firm 's authority to collect this debt. In this letter, I also requested that no telephone or email contact be made by their office to my home, my place of employment, or my mobile phone. On XX/XX/2022, I received a packet from ARS National Services. This packet was just a bunch of printouts of statements from XXXX that I do not recognize. They failed to provide any copy of an entered agreement to pay, as requested in my letter, as well as information on when the debt became due, delinquent, etc. In the past month, I have also received numerous emails and phone calls from ARS National Services as an attempt to collect this debt. Based on all of the information I have, it seems to me that ARS National Services are engaging in predatory debt collection practices. I am not sure if they are a scam debt collector, but it would not surprise me with these tactics. I drafted a letter to send to them to notify that I will be informing the CFPB of these practices, but am afraid to send it to them presently with the current frequency of their calls and emails. We opened an XXXX XXXX credit card through XXXX XXXX in order to purchase a couch for {$1000.00} as the promotion at that time would save us roughly {$200.00} for taking the card. We bought the couch, paid the amount in full with one payment, and immediately canceled the card. The account number ends in XXXX and you can verify there will be no further history of purchases. Last year I received a letter from XXXX XXXX XXXX stating I owed some money but the letterhead did not appear to match the company logos correctly, nor did the phone number on the letter match any information I had for XXXX XXXX credit. I called my numbers for XXXX XXXX credit, they said I had nothing open with them, and that the letter was spam. I called my phone number for XXXX for their credit department just to be sure, they told me that I had no open account with an outstanding balance in the letter was spam. Yesterday in the mail I received a letter stating I have been sent to collections. The amount being collected was {$350.00}. I will attach a photo of this letter. Because it says XXXX XXXX I called my local branch manager XXXX, told her that on the letter there was an account number ending in XXXX, she looked that up and confirmed an amount for {$350.00} being owed. She later explained these charges to be a {$35.00} a month fee for owning the credit card, plus late fees, and plus interest. She says there is no evidence of our request to cancel the card which we made immediately after sending the one time for payment to cover the couch. In XX/XX/XXXX, I entered into a repayment agreement with ARS National Services Inc. to repay XXXX XXXX XXXX Bank XXXX XXXX the amount of {$25.00} a month. ARS sent me a monthly reminder that the payment would be processed on a certain date. I received these monthly reminders from XX/XX/XXXX through XX/XX/XXXX. ARS stopped sending the reminders on this account and will not tell me the status of the XXXX 's account. I have asked ARS for an accounting. ARS representatives are unable to locate the account under their specific reference number, the last four digits of the XXXX 's account number, or any of my personally identifiable information, including my social security number. ARS representatives indicated that XXXX is the holder of XXXX 's accounts and advised me to contact XXXX. Representatives at XXXX could not find the XXXX 's account number referenced on the ARS monthly reminders for which I have paid {$25.00} monthly for over 4 years. I have another XXXX 's account that I am paying monthly to ARS, which began in XX/XX/XXXX. ARS is still sending monthly reminders on this account. ARS representatives indicated that their system changed and their reference numbers have changed. The change in the reference numbers is evidenced in the monthly reminders for this particular XXXX 's account. ARS representatives indicated that this is the only account they have serviced. XXXX representatives verified this account is under my name. Monthly reminders on both XXXX 's accounts are attached to this complaint as evidence that ARS was withdrawing funds for both accounts.

I have contacted XXXX XXXX numerous times to dispute an account that is not mine and may be a possible case of identity theft. I have no memory of this account.I have asked that thisaccount be removed after exercising my right under Section 609 ( a ) ( 1 ) ( A ), the requirementof creditors and credit reporting agencies to verify accounts through physical documentation, verification of the original signed consumer contract and/or identification used to open the account. Otherwise, anyone paying for their reporting services could fax, mail or email in a fraudulent account. I have requested such documentation from XXXX XXXX and it has not been provided. I also requested physical verification from XXXX XXXX, XXXX, and XXXX, all of which have not provided any sort. Somehow, these credit bureaus keep verifying data without furnishing any proof of a proper investigation or obtaining the physical proof required by section 609 ( a ) ( 1 ) ( A ) of the FCRA. When asked about this, XXXX, XXXX, and XXXX XXXX personnel replied that they use the E Oscar system to verify debts. This is not acceptable. These credit bureaus keep verifying information that is incorrect by basically matching numbers already in their data base, thus making it next to impossible to remove an account that isn't mine to begin with. This is not a reasonable investigation and their willful noncompliance is a violation of my rights as a consumer. Collection agency contacts my phone multiple times daily from different spoofed numbers. Today, an agent called my phone, left a voicemail, then proceeded to call my wife 's phone. On that call, the agent disclosed private information before verifying they were, in fact, speaking to a right party. As a debt collector myself, I know it is a violation of the Fair Debt Collection Practices Act to disclose information to ANY party before first verifying that they are speaking to the right party by confirming one private information ( such as date of birth or last four of social security number ) and/or a second piece of private or one piece of public information ( i.e. address or phone number ). They are then required to inform that it is an attempt to collect a debt by a debt collector and any information obtained will be used for that purpose. Also, in the state of NY, they are also required to inform spouses that, although a spouse can discuss their spouses debt, the spouse is not personally liable for said debt. None of these actions were taken on the call to my wife on XX/XX/21. The person asked if they were speaking to my wife by first name only, then proceeded to state that they were looking for me and that they wanted me to call them about a debt to discuss a settlement option before they took legal action. The same company then called my phone minutes later leaving their standard voicemail. The woman then called my parents phone looking for me. Four calls within an hour is definitely harassment according to the FDCPA.

Initially on XX/XX/20 I received a threatening phone call from a XXXX XXXX stating she was going to file legal action with XXXX XXXX XXXX unless I called them back at XXXX, and that my case number was XXXX She also called my XXXX year old grandmother and parents, threatening legal action and to come to her place of residence. Which when I called they said that it was regarding a personal loan that I hadnt paid with loan me totaling {$7300.00}. They stated they are a proceedings office called National they would not give me an address. They said I must pay in full or they would proceed with legal action and I would be responsible for all legal fees for a total of {$15000.00}. They forced me to set up payments which I couldnt possibly afford bi-weekly otherwise they said I would have to pay the {$15000.00}. After I did research and spoke to a legal representative they told me not to pay them anything until they gave me a written validation notice. I XXXX XXXX do not agree with a collection process initiated against me. There was only a letter from ARS National Services , Inc., stating that they have been hired by XXXX XXXX XXXX XXXX, without proof of transfer. The Federal Trade Commission made it clear in a decision against a national debt collection agency in 2009 ( FTC v. XXXX XXXX XXXX XXXX that a collection must show proof, i.e. a written transfer of information and the right to collect on a debt. My rights have been violated under the Fair Debt Collection Practices Act. ARS has posted a collection on my credit bureaus without first submitting proof that they had the right to collect on a debt. I am not disputing that there was an obligation owed to XXXX XXXX XXXX XXXX, what I am disputing is the egregious act of destroying my credit without going through a legitimate process. I have already been a victim to an FDCPA violation and a violation of the FTC mandate to validate a collection, as well as showing proof that the collection is well within state guidelines where I reside. Since I am a XXXX XXXX member of the United States XXXX XXXX, I take my rights serious, as much as I take my loyalty to the United States. I had my identity stolen and a bunch of credit cards opened in my name without my knowledge or approval. I have gotten all of them taken off except XXXX with XXXX account # XXXX which also turned into a collection account with a company called ARS National Services. I keep getting phone calls from ARS National Services trying to collect over {$2000.00} from me which is not my debt. Each time I give them my social security number they tell me that 's not correct, when I tell them this was from identity theft they do n't believe me. ARS keeps calling me. I spoke with a representative on XX/XX/XXXX, and advised HIM not to call. I received another phone call, they left a voicemail on XX/XX/XXXX. They texted me on XX/XX/XXXX and called me 1 time after I texted not to call, I spoke with a woman and advised her not to call. The woman also gave information to my sister, the person that answered the phone and called me a XXXX and a little girl. She did say the phone call was recorded, so management can go back and listen to the call, however AFTER this incident 2 more calls came in from the company. I am not sure why they are harassing me. Unbeknownst to them I was in the office of a State official at the time, who also heard the call. XXXXSince I the last time I told them not XX/XX/XXXX to call and communicate through mail, I have received 13 calls the last one being received today from a XXXX, who stated that " they don't have to stop call until the debt is paid. I advised this is harrasment and was told, what are you gon na do put me in jail. '' This has to be illegal at this point and I will be filing a police report for harrassment and seeking damages via court. XX/XX/XXXX of XXXX I've contacted XXXX regarding an old account that I had no knowledge of it and now showing on my credit report and drop my credit score by 68 points during the process of getting a mortgage loan. Since there is an urgency I just wanted to pay it off/ settled, so they directed me to ARS National Services Inc who was handling the account for XXXX . The Balance was {$2300.00} and they agreed on accepting {$1500.00} as settlement in full if paid on that day XX/XX/2020. Attached is the settlement letter they emailed me and how to make the payment and that once paid they will let XXXX know so that they can report to all credit bureau as paid. I made the payment of {$1500.00} the same day ( Confirmation screenshot attached ) as agreed. On XX/XX/XXXX I received a letter from ARS National Services Inc ( Attached letter ) thanking for accepting the settlement of {$1500.00} in full however it was still showing a balance of {$830.00} which was the difference from the total balance. This should had said {$0.00}. On XX/XX/2020 XXXX reported the balance to XXXX as {$830.00} instead of paid in full. This is NOT what was agreed upon and have all the proof. As a result our mortgage approval is on hold until this gets cleared up as paid on all 3 credit bureaus.

Received calls from this ARS National Services from multiple phone numbers on XX/XX/XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, and XXXX ( 2021 ). Phone numbers include XXXX and XXXX. They never leave a voicemail. When I called the missed number, each time the rep says " thank you for calling ARS National Services, '' says the call is being recorded, gives their name, and asks for reference number. I have never received mail from a debt collector or any reference number. When I asked why they keep calling, they asked me who I was. When I didnt tell them they stated they were a company that deals with personal information and could not share why they were calling. The rep gave no information at any point when I requested validation and verification for who, what, and why they were calling my number. The rep is also on recording lying twice that they did not even have my phone number in their records and could not explain how come I had multiple missed calls from them then. I stated I believe they have the wrong contact info and to remove the number from their call list. He stated he would ask his supervisor about removing the number from their records ( which he had already claimed they didnt have on record ). The calls have persisted.

On or around XX/XX/2019, I received a debt collection letter from ARS NATIONAL SERVICES INC to collect a debt on behalf of XXXX XXXX XXXX XXXX. The account with XXXX XXXX XXXX XXXX was opened online, in my name, fraudulently. I never received any card in the mail from XXXX XXXX XXXX XXXX. I never received any billing statements, online or by mail. My email address and phone number is not associated with the account. I never received phone calls in regards to the application or the account. I never received any contact prior to the fraudulent account being approved and opened in my name, to verify my identity, in order to prevent this exact gigantic issue from happening! This is a debt I did not personally apply for or obtain. This account was reported as fraud immediately upon discovery of the fraudulent account in my name. I reported the account as fraud, placed fraud alerts and credit freeze, filed an identity theft report with the FTC, opened disputes with credit report bureaus, andfiled a police report with my local police department. This account is fraudulent and was opened in my name FRAUDULENTLY. I'm doing everything I can to clear my name and to clear this fraudulent activity from my credit reports!

This complaint is for XXXX XXXX Bank and their collections services ARS National Services Inc. The account I had with XXXX was for a credit card that needed to be paid. The account was then passed to ARS National Services for collection. I called ARS National Services on XX/XX/XXXX and identified the debt with XXXX XXXX Bank with account representative XXXX XXXX XXXX. On the same day, the debt was settled for {$2700.00} and paid through a check from my XXXX XXXX account deposited on XX/XX/XXXX. I received a letter sent from XXXX XXXX on XX/XX/XXXX stating that ARS accepted the settlement for the referenced account. It was stated on the phone that the settled debt would be reported to XXXX XXXX XXXX, then updated and removed from my credit report. However, I received mail notification sent XX/XX/XXXX that XXXX XXXX and ARS National Services are now trying to collect a new and different debt in the amount of {$1800.00}, which was reflected on my credit report. On XX/XX/XXXX I received a threatening phone call from someone claiming they were a collection for a personal loan that I had with XXXX. They called me, and several relatives and threatened legal action and a call to my supervisor at work if I did not respond that day. I called them back at XXXX and asked the name of their company to which they claim to be National based out of XXXX Georgia, they would not give me an address. They forced me to make a payment that day and to enter into an agreement to pay them bi-weekly in the amount of {$480.00}, if I did not agree they would proceed with legal proceedings and I would be responsible for {$15000.00} instead of {$7300.00}. My late husband ran up huge debts, some in his name, some in my name. He XXXX XXXX in XX/XX/2015. My was XXXX XXXX, according to Texas law. I am being threatened by ARS, a company in California, for a XXXX card. I did not use, and was not even aware of that card. Apparently, XXXX XXXX XXXX " dumped '' an overdue card of his own, probably an XXXX XXXX card, onto a card in my name. I wrote a letter explaining this to XXXX, when I discovered the debt on my credit report. Now, almost three years later, I received a letter from ARS, threatening me, if I do not pay them, for outstanding debt of that card. I have sent a letter to them, as well, with a more lengthy explanation, and other supporting documentation. I will attempt to attach a copy here, without the other attachments, but will supply those, as well, if necessary. The most important this is : THIS IS NOT MY DEBT. If I am sued, I will fight this. On XX/XX/2020 ( I sent via uspo mail ), several 'Debt Validation letters to debt collection agency XXXX XXXX XXXX , XXXX XXXX XXXX , XXXX XXXX XXXX XXXX. requesting certain documents to validate a debt said agency states I owe, and that the collection agency Remove the collection accounts from my credit reports, if they're unable to validate the accounts. Received the same message today. the XXXX left me a voice message claiming they needed to come to my home between XXXX on XX/XX/XXXX to give me some documents and I needed to provide to pieces of ID. and referenced a case # with the last 4 of my SS #. Also said to reschedule the appt ( which I never made one ), then to contact XXXX. Which I contact this number and asked who they were, the guy said ARS. I asked what is ARS and he said they were mediators for a client. I asked who the client was and he would not tell me. I didn't even get this person 's name and on the voice message there was no name or company name mentioned either. I told him, that no one is coming to my home or business and talking with people to get information about me. He told me to " just shut up '' and hung up. The store and the credit card are separate. was not known at the time. I took my first payment into the store the day it was due. A man called looking for my Father, regarding my father 's personal small business. I asked him to clarify and he cursed and hung up on me. I called him back and another person answered the phone, she said the company that contacted me was " ARS national services ''. This information took asking for at least 5 minutes what the company was. What alarms me is that both persons who answered the phone insisted that the first call was for my Mother, not my father and that it was to discuss her small business. Both of which are lies, my parents do not own small businesses, and in fact my father works within the federal government. This supposed debt collection company is calling the children of alleged debtors under the false pretense of small business. I was ultimately transferred to a supervisor who tried to deflect and ultimately used subversive tactics to end the line of inquiry to the original phone call. ARS National Services Inc. contacted me on XX/XX/2019 at XXXX pst in the attempt to collect a debt. I filed a petition for chapter XXXX bankruptcy on XX/XX/2019 and all of my creditors were notified of this filing. It was also listed on my credit report at of XX/XX/2019. I reached out to ARS National following their attempt to contact me despite the Automatic Stay being in place. I told them via online messenger that I had filed bankruptcy and asked them for their address so I could send them the filed petition. They refused to give me the information and said I had to call them and talk to someone. Later that day, I went to XXXX to view my most recent credit report. I noticed that ARS National Services had run an inquiry using my social security number and DOB that same day. They ask to speak to a " XXXX XXXX XXXX '', a name similar to mine. I have told them on at least three ( 3 ) occasions that they have the wrong number and the wrong person, and I have asked them to stop calling me. They still persist in calling. I received a letter on XX/XX/XXXX form ARS National Services Inc they are collecting a debt on behalf XXXX XXXX. The letter is in Spanish but is a settlement offer to resolve a my debt with XXXX. The offer is good until XX/XX/2020. I contacted all my family members to get all the money together and pay the offer. Today XX/XX/XXXX I called to this collection agency to take the offer -remember the offer is good until XX/XX/2020- but I was informed that the account was recalled from XXXX. This is a unfair communication tactic from the Bank and form the collector since they made an offer and later decline it. My issue is with a XXXX XXXX credit card. I fell behind on payments and then made a payment to pay all pass due amounts. Soon after that they suspended me from making direct payments on the XXXX XXXX website and would not accept payments over the telephone. I was contacted by ARS national Services and given the option to pay XXXX in full to clear the account. I paid the XXXX in XXXX of 2015 and thought all was well until I received a call from ARS in XXXX of 2015 stating I now owe XXXX. Each time I spoke with the company they insisted I owed the money. I requested explanation of the balance in writing but to date have not received a detailed explanation in writing. They only tell me it is because of interest. On XXXX, XXXX, after I pulled my credit report, I found out multiple accounts that did not belong to me, right after doing my own research, months later, to be exact on XXXX, XXXX, I submitted my first dispute to the credit bureaus, after about three weeks a received replies from them requesting me to file a Identity Theft Police Report, so I did. On XX/XX/XXXX, I filed my Police Report, with the report in my hands, on XX/XX/XXXX, I started my dispute journey but this time I included my Police report. I did not send my disputes to the credit bureaus very often, since I am always busy, but so far since that time to date, I have submitted my package of Identity Theft at least four times. This submission is NOT from a third party. I received a letter with my maiden name on it as a new account. Saying I owe {$820.00} when I called them to inquire and explain that I have not used that last name in 25 years. I had the letter and I read to them the account identification information on the letter. Despite providing the info on the letter they tried to gather my SS # and my date of birth. I then advised that as a debt collector you added what must be given to get information on this account yet you are asking for information you don't have to collect a debt. On XX/XX/2021 and XX/XX/2021 Ars Natl Svc called me and did not leave a voicemail. After XXXX this company, I found out that they were debt collectors. I reached out to an online rep to get an address so that I could mail this company a letter stating that the debt is disputed and to provide validation. I never received any written notice or a letter stating that I had the right to dispute, so I sent a dispute letter anyway so that I was within my time limits of the FCRA when responding to debt collectors. On XX/XX/2021 I sent the dispute letter to this company via certified mail to the address that a rep gave me. I have requested debt validation of two accounts being collected by ARS NATIONAL SERVICES INC. After sending a certified letter requesting this debt collector to validate the debt, they did not respond with sufficient documentation or information to satisfy my request, as is my right under the Fair Credit Reporting Act ( FCRA ) and the California Rosenthal Fair Debt Collection Practices Act. Instead, I received a generic " Cardmember Agreement '' without my name, signature, or any other identifying information. This is not my debt. This is the debt of a family member. I owed XXXX {$1600.00}. The account went into collections and was serviced by ARS. I began paying them and they then offered a settlement agreement. ARS National Services somehow obtained my boyfriends name and private cell phone number in an attempt to contact me. I was not with my boyfriend at the time of holding the account ( XXXX ), nor was he ever at any point in time listed on the account. Clearly they used deceptive and unethical means to obtain this information.
