In accordance with the Trial Period Payment Agreement signed XX/XX/2021, XXXX XXXX XXXX XXXX is in violation of this agreement. This is formal notice of violation of said agreement. Refer to page 2, bullet point one.
" Any pending foreclosure action or proceeding that has been suspended during the trial period may be resumed if you are notified in writing that you failed to comply with the terms of the trial period plan or do not qualify for a permanent modification. You will receive notice at your normal mailing address for receiving notices from us. '' Resumption of the foreclosure action was to take place if proper notice was given, yet XXXX XXXX resumed such action without sending proper notice.
