On XX/XX/XXXX, I went to the Emergency Room at XXXX Hospital in XXXX, PA. XXXX Hospital later sent me a bill for {$250.00}. For approximately a year and a half I have contacted XXXX Hospital billing about the error as the services were paid in full by my primary and secondary insurance companies up to the contracted allowed amount with no patient responsibility. I had sent them the Explanation of Benefits ( EOBs ) and had my secondary insurance company contact them via phone and provider education letter. A representative from my secondary insurance company advised XXXX Hospital that it was a contract violation to bill me, the member. Every time I thought that the situation was resolved, a few months later I would again receive a bill in the mail, starting the process all over. Note that I was advised by a billing representative from XXXX Hospital that in XX/XX/XXXX a new billing company took over since there were so many errors from the previous company. I was also advised that any debts sent to collections were being recalled due to the errors. However, shortly after, my account was indeed sent to collections by XXXX Hospital. Note that the secondary EOB shows that the contracted allowance for the services is {$660.00}, The primary insurance issued payment in the amount of {$400.00}, and the secondary issued payment in the amount of {$250.00} with no patient responsibility. Also note that there is a remark that states that this amount represents the copayment required for emergency room services for which the secondary insurance paid. This statement is incorrectly being interpreted by Arcadia representative XXXX XXXX to mean patient responsibility. Because the insurance is secondary, it pays the co-payment leaving a {$0.00} patient balance. Also note in one of the bills from XXXX Hospital that I attached, they acknowledge total payments of {$660.00}, the contracted allowance. Below is a timeline of my contacts and attempts to resolve this matter after it had been sent to collections. XX/XX/XXXX Date of correspondence from Arcadia Recovery Bureau , LLC informing me that creditor XXXX Hospital, XXXX sent my account to collections for the amount of {$250.00}, reference number xxxxxxxxx [ omitted per direction ]. XX/XX/XXXX I called Arcadia and explained that this was an error with XXXX Hospital and secondary insurance paid that balance. Representative requested that I email the EOB to them at XXXX. XX/XX/XXXX I emailed EOB as PDF to Arcadia. XX/XX/XXXX I called Arcadia and spoke with XXXX who confirmed receiving email. XXXX stated that they will reach out after coordinating with XXXX Hospital. XX/XX/XXXX A representative called from Arcadia stating that there was no attachment in my email and to resend. I confirmed that email was indeed sent with attachment. I forwarded original email stating such and also included EOB as JPEG format. XX/XX/XXXX I contacted Arcadia. A representative confirmed receiving EOB but said that it states co-pay so this is patient responsibility and that XXXX Hospital is stating that payment was not received from secondary. I explained that the EOB is being misinterpreted and that insurance did pay. I was advised to have insurance call Arcadia. I contacted insurance. A representative assured me it was paid on XX/XX/XXXX and there was no member responsibility. Insurance called with me on 3-way and was transferred to XXXX XXXX who was not at desk. Later in day I called insurance company to try again. Representative XXXX spoke with XXXX XXXX who requested for the insurance to submit the EOB. When XXXX relayed this information to me, I explained that Arcadia has EOB. XXXX called back with me on 3-way but it went to XXXX voicemail ( VM ). XXXX left a message advising XXXX that they do indeed have EOB. I then called XXXX Hospital billing and spoke with XXXX, extension XXXX. She was sending the case to a supervisor who would call me back but never did. XX/XX/XXXX I called XXXX Hospital billing and spoke with XXXX. Call was disconnected while on hold for supervisor. I called back again later in the day. I was indeed connected with a manager who informed me that I must go through Arcadia since the file has been sent to them and they no longer have access to the records. However, she did tell me that there was a note from XX/XX/XXXX from Arcadia that they were waiting for the EOB. XX/XX/XXXX I called Arcadia and spoke with XXXX XXXX. She stated that they need the remit from the insurance company showing proof of payment and to fax to XXXX at XXXX. I called insurance company and spoke with XXXX who informed me that the EOB serves as proof of payment and that this was the first time she had heard of a collection agency requiring additional proof of payment. She called XXXX XXXX with me on 3-way again. XXXX stated that they did not have EOB. I told her where it was emailed to and she retrieved it. She reiterated that she needed proof of payment. I advised that insurance will not provide that, that she is misinterpreting the EOB, and that this should be reported to the Federal Trade Commission. XXXX at some point disconnected the phone call when at no time did myself or the insurance representative speak inappropriately. I have spent many hours trying to resolve this matter first with XXXX Hospital and now with Arcadia without success. I want to make a formal complaint regarding how this was handled by both entities. I received a call from " Arcadia Recovery Bureau '' on XXXX XXXX, 2016. This is not the first time they have called me ( and they have called me in the past, too ). The caller did not identify herself, which violates the Fair Debt Collection Practices Act, 15 U.S.C. 1692-1692p ( FDCPA ), and she also claimed it was a " business matter, '' another violation, since she has to disclose that it is an attempt to collect a debt. The woman proceeded to tell me that she needed to verify my information, to determine if I was the " correct XXXX XXXX. '' My name is not that common due to the spelling. I am not even sure how she got my cell phone number ; the bill IS NOT in my name. She repeated my address to me, and she asked for my birthday. First of all, since she claimed it was a " business matter, '' I was not going to disclose any personal information due to incessant identity theft in today 's world. Second, there should be no reason for this if she is attempting to collect a debt. If I say I am the person she is seeking, that is all she needs -- confirmation I am that person. When I refused to provide my birthday, she said that she would not tell me anything else, would not provide any other information. I said that I was sorry, but I would not provide my birthday. She immediately switched over to a harassing tone and nature, " informing '' me that she would " continue to call until I gave her my personal information. '' This is definitely harassment and not anything valid. This person 's actions are clearly in violation of the FDCPA 806 ( 5 ) and 807. Additionally, I will be attaching screenshots of the calls I received from this number, XXXX, since it was not blocked and the calls were placed to my cell phone. These simply demonstrate the recent calls to my phone, as they are what appear in my " recent calls list '' : XXXX XXXX - XXXX XXXX XXXX seconds XXXX XXXX - XXXX XXXX - XXXX minutes, XXXX seconds ( I was on the other line at the time, and I think the call just ran on my voicemail ). XXXX XXXX - XXXX XXXX - XXXX seconds XXXX XXXX - XXXX XXXX - XXXX minute, XXXX seconds Aside from XXXX XXXX, 2016, the other calls were hang-ups with a little " blip '' noise. This is also in violation of the FDCPA. However, since the initial contact in my call log is XXXX XXXX, 2016, and the caller chose to hang up before repeatedly calling me, Arcadia violated the FDCPA 809 by not notifying me within five ( 5 ) days of the initial communication on XXXX XXXX. Five days would have been XXXX XXXX, 2016, when is when I received the second call. I have also been receiving a barrage of calls, both at home and on my cell phone, that are usually no one on the other line with the same " blip '' noise. I Never GOT Validation letter in 2019 I was homeless and sick This letter is being sent to you in response to notices sent to me from your company and more importantly, due to your erroneous reporting to the Credit Bureaus, the highly negative impact on my personal credit report. Please be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 ( b ) that your claim is disputed and validation is requested. This is NOT a request for verification or proof of my mailing address, but a request for VALIDATION made pursuant to the above-named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you regarding the following account numbers : # XXXX Please provide me with : 1. What the money you say I owe is for. 2. A detailed explanation of how you calculated what you say I owe. 3. Copies of any and all papers that prove I agreed to pay what you say I owe. 4. Has Deliberately and Maliciously caused harm to my financial stability, by adding a un-validated debt to my consumer credit report XXXX, XXXX, XXXX. Upon first initial communications on a unsubstantiated debt a Consumer ( Myself ) have 30days upon first communication to dispute this debt and all collection attempts must cease! Notice I say ''ALL COLLECTION ATTEMPTS '', and NOT just a cease and decist in communication. This is a Clear violation of FDCPA 809 ( b )!!! It has n't even been 30days since 1st receipt of letter and yet they already trying to collect in a unfair and deceptive matter. In XX/XX/2019, I visited the emergency room at XXXX XXXX XXXX XXXX in XXXX, Texas. Upon entering, I informed the receptionist, nurse, and doctor that I wanted to be told clearly up front what charges would be assessed, so I could approve or reject the service. I specifically said that I did not want any surprise bills after the fact. They all -- three separate persons -- agreed that they would do so, and that I would not receive surprise bills. And on that basis -- and only on that basis -- I entered the facility. I was told at the time that I would receive a bill for $ XXXX. I agreed to that, and later on I received and promptly paid that bill. But I was NOT told that I would receive an additional bill of {$690.00}. So when that improper and unauthorized bill came, I refused to pay it. Sending that bill was plainly and simply a breach of contract. I did not -- and do not -- consider it appropriate for a hospital or any other service provider to make up whatever dollar mount feels right to them and then demand that it be paid after the fact, without giving advance notice to the customer and without getting the customer 's agreement -- particular after making a promise to do so and agreeing not to send bills without first doing so. XXXX XXXX called several times to collect this payment, and I plainly stated my position. They then referred the matter to Arcadia Recovery Bureau, and again I plainly stated my position. I do believe that a service provider, or debt collector, acting in good faith would have agreed that sending a bill in violation of a promise constitutes a breach of contract and would have accordingly voided the bill. Therefore, I was dismayed to learn recently that Arcadia Recovery Bureau reported the non-payment to all three credit bureaus. I then subsequently lodged disputes at all three credit bureaus, but I have been disappointed to learn that XXXX and XXXX have since affirmed the adverse account. This disappointment stems from two foundations : First, as a substantive matter, as stated above, I think the charges are legally unenforceable, plain and simple, and should not be levied against me. But second, and more troubling, neither XXXX nor XXXX apparently even considered the substance of my dispute. Instead, the entirety of their process included asking Arcadia whether they agreed with my position. Predictably, then did not -- and apparently in the face of such a self-serving statement, backed by no evidence and without any assessment of credibility, XXXX and XXXX determined that the creditor ought to be believed over the consumer. What happened here was wrong. It simply can not be the case that a service provider can make up an unauthorized bill -- breaching its own contract to do so -- and then harm the consumer 's credit when the consumer refuses to pay it. Therefore, the adverse account should be removed from my credit report.

I have regular appointments with the Hospital XXXX. I 've been a regular patient for 9 years for a XXXX XXXX that required the XXXX in XXXX XXXX. In XXXX XXXX, XXXX XXXX and XXXX XXXX, I had follow up appointments to check the status of the XXXX. Apparently, my insurance company denied the XXXX claim on each of these appointments. I was n't aware that these bills were not settled because I never received a bill from the hospital. Recently I was contacted by a debt collector for the balance on these XXXX claims. When I called the hospital, the claim they have mailed bills to my address to which I never responded ; however, they verified that for some reason each of those bills was returned undelivered by the post office. Immediately upon finding out about these unpaid debts, I contacted my insurance company which is in the process of resubmitting the claims in order to settle the debt. In the mean time, I 've had this debt collection company calling and sending me invoices in the mail for a bill that will be covered by my health insurance. I 've told them multiple times that my insurance company is handling the debt, but they still insist on contacting me. My wife and I have exemplary credit. In fact, I pride myself on how good my credit is and I 'm in the process of refinancing my mortgage and now I 'm afraid that I 'll have this debt collector listed on my credit report for the next 7.5 years for a debt that should have never even hit collections if the hospital had figured out how to get a bill to my house so I could contact my insurance company. They did n't even attempt to call or email me. They just sent it right to collections. Funny how the the debt collectors bill arrived in my mail box but nothing from the hospital. When I contacted to hospital, they told me they have to correct address on file so I should contact the USPS. I 've lived at this address for 5 years and all my mail comes to this address. I want for this debt collection company to stop contacting me and I 'd like for any negative entry of this debt to be removed from my credit report. I 've attached documentation showing the bill I 've been receiving from the debt collector. I 've also attached documentation for the reprocessing of XXXX of the XXXX claims showing that XXXX of the debts has been settled. I 'm still waiting for the explanation of benefits for the other XXXX once the claims are reprocessed.

Received a call on my answering machine announcing that I needed to call back a number about a debt issue. XXXX day later I received a collection notice for {$78.00} for date of service XXXX/XXXX/2015 from Arcadia Recovery Bureau for a doctor charge from XXXX of 2015. Checked my EOB/Medical file to find that I never received a bill from the provider. I contacted the provider University XXXX XXXX XXXX XXXX. They told me that they had sent a bill on XXXX/XXXX/2015 that was returned from the PO stating " temporary out of town and can not deliver ''. At that point they told me their policy was to flag the account for that invoice and future invoices for collection. 1. I do not understand how that policy can be legal. The creditor must do due diligence to make an attempt to collect the debt before turning it over to a collection agency. Automatically flagging an account does not constitute due diligence. 2. XXXX further told me that they have so many patients that is the only way they can handle the billing process. Just because they do not have the proper man power does not mean they have the right to put a persons credit record in jeopardy. They have my home number, my cell phone number, my email address and a messaging system from XXXX XXXX XXXX in place to contact me. 3. Flagging an account because of a temporary mail delivery issue is not the patient 's fault. On the hospital side I still receive bills and process them for payment. They have access to all those records and should be able to determine if the mailing address is correct. 4. The message left by the collection agency disclosed debt collection information and my name on an answering machine that is available to other individuals. That can not be legal. 5. I believe XXXX 's billing system is flawed, prejudicial and illegal and I need help to shut it down.

FIRST AND FOREMOST THE DEBT IN QUESTION IS REGARDING MEDICAL DEBT! As a Medical Debt it falls under the provisions of HIPPA Laws and FDCPA. I never in my sober and contious state of mind ever gave my permission for my medical records to be disclosed as i know under HIPPA laws .... Can only be accessed via a court order by a judge or I myself give written authorization to realease my medical history or any documents related to medical treatments!!! Required by the XXXXealth Insurance Portability and Accountability Act, 45 C.F.R. Parts 160 and 164. XXXX XXXX XXXX XXXX .Has willfully and maliciously broken FDCPA LAWS AND HIPPA LAWS. LET THAT BE CLEAR!!!! how you ask? easily- fdcpa 808 ( 1 ) under unfair practices of collection of debt clearly states : The collection of any amount ( including any interest, fee, charge, or expense incidental to the principal obligation ) unless such amount is expressly authorized by the agreement creating the debt or permitted by law. A CONTRACT IN OTHERWORDS ... AS STATED IN THE BEGINNING I NEVER GAVE THESE CROOKS ACCESS TO MY MEDICAL INFORMATION, OR UNLESS THEY GOT A COURT ORDER I DONT KNOW ABOUT!??? how then are they adding interest to an alleged debt, WITHOUT HAVING THE INSTRUMENT/CONTRACT, MEDICAL FORMS THAT CAUSED THE DEBT? ILLEGAL, UNLAWFUL, AND DECEPTIVE MEANS HAVE BEEN USED AND I FULLY INTEND TO SUE FOR TWO COUNTS OF DAMAGES MADE UNTO ME! I requested written validation of my debt. I received a validation letter dated XX/XX/2023 from Arcadia Recovery Bureau , LLC that failed to include the following information : 1. Information you can use to reply to the debt collector, such as if you believe the debt is not yours or if the amount is wrong 2. An end date for a 30-day period when you can dispute the debt The debt collector did provide an itemized statement from the creditor, XXXX XXXX XXXX XXXX XXXX XXXX but the amounts differ from the validation letter. Professional Charges : Total Charges : XXXX Professional Payments and Adjustments : XXXX XXXX XXXX Total Insurance Payments and Adjustments : XXXX It is not clear how the debt owed came to amount to {$140.00} as indicated in the validation letter from Arcadia. Doing the math as listed in the itemization I come to a total of XXXX. XXXX XXXX XXXX = XXXX I received multiple bills from the creditor, XXXX XXXX, with differing amounts ; on XX/XX/2023 total payment due {$140.00} and XX/XX/2023 total payment due {$210.00}. Also, the itemization of the current amount of the debt does not reflect payments or credits within the validation letter, which differs from the creditors itemization of the above-mentioned payments and adjustments. I am submitting this complaint because I was not given proper information regarding this debt collection, nor an ability to dispute, nor an end date to dispute by, or a reasonable explanation of the amount of debt owed including any adjustments, or credits applicable. The debt collector and creditor appear to be using disingenuous accounting to misrepresent owed amounts which needs to be investigated further.

Hello, I recently logged onto XXXX XXXX to pay find any debt I may have. I have been on XXXX for a few months now and recently received an income, which is the reason Id like to pay off debts owed. I went XXXX XXXX last year XXXX XXXX. I had suffered in XXXX to my XXXX XXXX, XXXX, up to XXXX XXXX. I had taken the XXXX at XXXX in a clients XXXX. I was forced to work the rest of the day without being able to XXXX XXXX or get medical treatment until a couple of days later. After being XXXX for my right XXXX I had reported feeling XXXX. I had mentioned this XXXX to my work place but they said it had no revelance to the XXXX. Till this day my case is still open and today I paid out of my pocket for something I feel that my work place should have provided treatment for as well. Thank you first and foremost for representing people like myself whom feel absolutely violated by these criminals. I received medical services last year, and received a bill from XXXX XXXX ( XXXX ) indicating that I owed more money than my explanation of benefits letter indicated I should pay. XXXX indicated I owed over them over {$400.00}, whereas my EOB indicated I owed ~ {$160.00}. This claim was ultimately handed from XXXX to Arcadia collection agency as there was still a discrepancy in the amount to be paid, with me refusing to pay more than my EOB. At this time I contacted XXXX, my claim representative, and they had a cease a desist letter filed to Arcadia to halt any further harassment to myself. XXXX also advised me to pay the EOB amount only ( ~ {$160.00} ) to Acadia to prevent all further interactions with them and also advised to hand write a letter to Arcadia indicating they were no longer to harass me, which I did. Unfortunately, despite the hand written letter and the cease and desist letter filed, these thieves have attempted yet again to send me a physical letter demanding me to pay the remains amount of the {$400.00}, Without any proof of indicated payment due and even going so far as to suggest I outright pay them and then ask the insurance company to pay me back ... .... I am outraged. They may retort that the case is closed and that I have a XXXX balance. This however, is not at all what concerns me. On XX/XX/2018, I received a bill from XXXX XXXX ( Hospital of the University of XXXX ) for {$1100.00} for routine maternity laboratory tests, which should have been covered by my insurance provider, XXXX. I appealed this bill with XXXX and informed XXXX XXXX that I was appealing this bill with my insurance provider since it should have been covered under routine maternity care ( XXXX was provided a letter attesting to this by my XXXX doctor ). Even though I informed XXXX internal collections department that the charges were under an appeal process and provided them with a reference number for the appeal, XXXX XXXX sent the bill to collections. XXXX Hospital ( XXXX XXXX ) was set up with XXXX to collect debts owed to the hospital. We had charges from previous medical issues that were not covered by insurance and we need to set up a monthly payment plan, which we did and were paying every month via and automated deduction from our checking account. The accounts were never reported to the credit bureaus because were were not delinquent. At some point at the end of XXXX, XXXX was dropped and XXXX XXXX was given our account. Then out of the blue we started receiving phone call regarding the debt owed. There was never any written notice that XXXX was no longer servicing the account and that we would need to work with Arcadia, so we were questioning what these debts were and from when. At one point the person calling gave us incorrect dates of service as well as incorrect parties they were collecting for. I've been disputing fraud accounts on my credit report since XX/XX/2021. I sent letters to the bureaus and the creditor via certified mail with tracking and each letter shows signed and delivered and yet the bureaus are still not taking any actions. The accounts are not showing in dispute nor are they removed from my report. The accounts always show up with different name variations and different account number variations and yet the bureaus seem to ignore the trend and let these fraud accounts affect my credit score. I have requested the investigation to be initiated and also verifiable proof to be submitted should the account claim to be mine. Not only have I not received any mail showing the verifiable proofs needed to justify the accounts to be on my report, I haven't even received any letters at all stating the investigations have begun. Per the FCRA and federal law, the process is supposed to be 30 days. Its been well over 40 days and no results are showing. To clarify the answers to the questions on the prior page : - while the amount owed is being disputed as well, the nature of the misrepresentation in this particular complaint is that the collection agency provided falsified financial records that obscure the actual activity relevant to the disputed debt, which was done far more blatantly and maliciously than any misrepresentation of the balance itself - I have communicated with the company already, but not specifically about the misrepresentations. Given the situation, it felt like it made more sense to file the complaint with a third party. In response to my disputing a debt, Arcadia Recovery Bureau , LLC mailed me a letter dated XX/XX/2023 containing financial records that had clearly been falsified and furthermore obscured important information about the adjustment activity on the account. A debt from XXXX that had been reported by XXXX XXXX collection agency for 7 years was sold to the Arcadia collection agency who now reports it as a new collection account from XXXX to the credit repositories XXXX and XXXX. Arcadia confirmed it was from XXXX verbally, but state the start date is now XXXX when they bought it. This is a re-aging of the account and not in compliance with the Fair Credit Reporting Act. I provided XXXX a copy of an old credit report that showed the same account from XXXX and they refuse to remove it without consent from their paying client Arcadia who plans to report a collection account for 15 years from the date of the collection and 8 years past the 7 year statute of limitation for collection accounts to be reported on a credit report. The debt was from when I was young and I understand they may be allowed to try to collect it, but they are not allowed to at this point break the law by re-aging the account and report the account as new again after it had already been reported on my credit already for over the 7 year limit.

I received a phone message from Arcadia Recovery Bureau saying that they were looking to speak with me about owed debt. I called the number back, and they had my name, address, phone number, and date of birth. They then said that they were calling about {$3200.00} that I owed to XXXX XXXX. I finished my treatment with XXXX XXXX in XXXX of 2015 and paid in full throughout my treatment. Dear CFPB, I am a hospital resident in training at New York XXXX Hospital in XXXX. I am not aware of owing any debts ( I just had a loan officer confirm this ), but this is beside the point. " Arcadia XXXX XXXX XXXX '' has been calling me on a non-private hospital line that is supposed to connect doctors to the resident work space. It is a line shared by all the residents and a very busy one for communicating vital healthcare information. How Arcadia got this number I am not sure, but I have told them to stop the first time. I sent Arcadia an Accord and Satisfaction letter in XXXX and also in XXXX along with a {$150.00} money order to settle the debt being showing on my credit report. When I asked the name of the company and of the person contacting me and what is the name of the company I owe money to they did not provide any of these informations.
