We got the loan in XX/XX/XXXX. Immediately after, I was rushed into emergency XXXX and suffered multiple complications post-op. I reached out to the company, and spoke with XXXX XXXX, who I asked for payment arrangements due to my XXXX-related medical situation and time off work. I again reached out in XXXX, relaying I needed payment arrangements/accomodations due to my medical situation and was offered the option to pay in XXXX separate payments -- but they stated they could not offer any kind of extension or deferment. On XX/XX/XXXX, I was admitted for a 30 day inpatient hospital stay -- at which point, my husband took over handling the account. On XX/XX/XXXX, he made another payment, and noticed an alert in my email on XX/XX/XXXX regarding a scheduled automatic payment. He called Aqua Finance at that point to dispute the upcoming transaction, as he'd already made a payment. On XX/XX/XXXX, Aqua Finance reported us as 30 days late to all 3 major credit bureaus. Since I was in the hospital, I did not know this or start disputing it until after XX/XX/XXXX. In the summer of XXXX, Aqua Finance passed our information onto XXXX XXXX of XXXX ( a recovery service or debt collection agency ), and XXXX XXXX began harassing us and multiple family members -- from as early as XXXX XXXX to as late as XXXX XXXX -- daily -- multiple times daily. She also called our family members and told them of our current account status as being delinquent. On XX/XX/XXXX, after multiple attempts, we voluntarily surrendered the property. Nonetheless, I continued speaking to various supervisors and account reps at Aqua Finance in an effort to resolve our account status situation. One of the last supervisors I spoke to, XXXX, was completely oblivious and unaware of the CARES ACT -- it's purposes, limitations and uses -- and stated he didn't care if I had had medical emergencies related to COVID that caused me to lose my job -- I still should have been paying the account as I'd agreed to in the beginning. I also spoke with XXXX XXXX. I filed a complaint with the CFPB related to Aqua Finance 's blatant misuse of credit reporting platforms, their inability to follow laws related to the CARES ACT, the failure to provide payment arrangements and/or accomodations, and their continued inaccurate reporting. After nearly 8 weeks, they responded that they reviewed the recordings and that I never mentioned medical situations, nor did their 3rd party collection agency harass me and break CFPB, CFRA, or CFDPA regulations and statutes. On XX/XX/XXXX, I emailed XXXX XXXX and asked for information related to my account including a statement of account history, accounting, all credits and fees added to the account, the entire process of how they report to the credit bureaus, etc... all in response to her email stating they'd received a copy of my complaint and she wanted to make sure I understood how credit works. Nonetheless, no response was ever returned to my email or my usps request for the information. The company refuses to be upright, honest and transparent in their dealings with the account credits, transactional history, and reporting. On the contrary, the company continues to maliciously report false information pertaining to our account. Not only is this information false, but it. is wholly inaccurate and overall inconsistent in the way they are reporting. They have reported as open to XXXX, with a balance due of {$14000.00} -- with an involuntary REPO in XXXX for both me and my husband. They have reported a balance of {$14000.00} with a closed account to XXXX for both my husband and I ; and closed, involuntary repo in XXXX, 60 days late in XXXX, 90 days late in XXXX, 120 days late in XXXX, with a balance of {$14000.00} for me, but a {$0.00} balance due for my husband. A company that is this CONSISTENTLY inconsistent and scattered with their reporting can not possibly accurately keep track of an account -- much less perform data review of ALL recordings and interactions. Not to mention the fact that I have requested copies of all account transactions, recordings, reporting, and the company has refused on numerous occasions to provide any or all of the information. Additionally, when I've asked for a detailed transaction report listing each credit and debit on the account, they have failed to provide such -- namely, when did the property sell at auction, and when did they credit the account with the service warranty contract refund.

On XX/XX/2018 I applied, signed and was approved for a loan with Aqua Finance Inc. The amount that I was approved for was {$13000.00}, This is the amount that should have been relinquished to myself and is also reporting on my credit report. This amount ( {$13000.00} ) was supposed to have gone directly to a plumbing company that was remodeling my bathroom. After really going through all the fine print of my contract/loan documents, there are no stipulations for any hidden fees. Basically {$13000.00} no additional fees hidden charges ( on my signed contract ). On my contract with the plumbing company who did the remodel for my bathroom, it states ; total cost {$13000.00} with a deposit of {$1300.00} and the balance of {$11000.00} paid from my loan with aqua finance. Very basic black and white. The problem however is, {$13000.00} the amount that was finance to me went directly to the plumbing company. This company was to have received the $ XXXX that i was approved for. So now they got the {$13000.00} in addition to my deposit of {$1300.00}. {$1300.00} should have been returned to me from the deposit however none of the companies involved is willing to get me back my {$1300.00} or rectify this blatant breach of contract and failure to disclose hidden fees which constitutes as fraud from my perspective. When i reached out to the plumbing company their explanation was that they only received {$11000.00} from Aqua Finance and with my {$1300.00} deposit totals the {$13000.00} which was owed to them for services rendered. When i reached out to aqua several of times, they said that i would have to get my deposit back for the plumbing company and that there is nothing they can do. My realtor was kind enough to help me with mediating a resolution to which the aqua finance representative disclosed the following information. I, XXXX XXXX was approved for the {$13000.00} that is what i was financed. They disclosed that they only released {$11000.00} to the plumbing company. The representative also stated that the plumbing company was charged a {$1300.00} promotion fee by aqua finance. The rep stated that the charge was an agreement that was between the finance and plumbing company and nothing to do with me and should not have affected me and for that reason the plumbing company should not be charging me the {$1300.00} to make up for the promotion fee. I even tried to email the ceo and no one has gotten back to me. Aqua finance said that they would call the plumbing company to clarify their agreement so that the {$1300.00} would be returned to me. NO one ever called back, i even called to follow up and they said that they are still waiting on a return call. the last time i spoke to them they argued with me that there is nothing they can do, will do and that i need to take it up with the plumbing company. From the information that i have gathered, Aqua finance inc failed to disclosed finance charges or additional fees such as the {$1300.00}. Also, if my finance amount was {$13000.00} then {$13000.00} should have gone directly to the plumbing company. Any outstanding bills or charges that were due to Aqua by the plumbing company should have been paid by the plumbing company, not my loan. By Aqua finance only releasing {$11000.00} and fraudulently retaining {$1300.00} for their personal ventures without my knowledge or consent should be subject to investigation for corruption, theft and integrity and fraud. There should be severe consequences and penalties for their poor business practices. I also feel that i should be compensated for all the distress that has been brought onto me from this in addition to my {$1300.00}. Please help me. thank you for your consideration.

I'm a XXXX XXXX XXXX on XXXX. I had XXXX on my left XXXX in XX/XX/2018. I was home alone and had fallen three times and had a XX/XX/XXXX on. I hired a guy from XX/XX/XXXX XX/XX/XXXX to put handicap bars in my bathroom tubs. He came and as he was leaving the pain was unbearable so I took a pain pill. The guy left and a man walked up and I asked him if I could help him he said he was here to sell me a walk in tub. He claimed to be an employee of XXXX XXXX XX/XX/XXXX of XXXX XXXX, SC. I asked him how much he said {$20000.00}. He came in and gave his speech and I figured he would figure that I had no money and just leave. I was wrong. He placed a phone call to the finance company and he said no interest for six months and a payment of {$240.00}. He asked if I could afford it and wrote a contract. I was again in a cast and told him about falling and that I was on pain medication. The tub which I couldn't use was installed unprofessional. It was leaking from the valve on the outside. They finally got it fixed. I couldn't use the whirlpool part until my cast was removed months later. I had a short pain medication supply and The paperwork I kept reading but couldn't barely read it and the paper credit card was typed out as the XXXX XXXX XX/XX/XXXX XX/XX/XXXX. I found a number and called XXXX XXXX who financed the {$20000.00}. The lady I spoke with during the no interest period said there was no lien but she could get one if need be but no interest. I asked about payment and she had a big pause I said {$240.00}? She said yes. Still nothing in writing. I took the paperwork later to my bankruptsy attorney and he looked at the terms. There was no way on XXXX and debt to income ratio that I shouldn't have been approved. I had no choice but to file Chapter XXXX. I had a credit score around 730 before the account. I did file with the SC US court Chapter XXXX. My payment on mainly expenses and attorney fees that I wasn't aware of on the back end was XXXX per month. It has been a terrible year and mainly in nsf and overdraft and having to get food from resources. The main issue is XXXX never filed a claim with the court and the trustee said they were notified as was XXXX XXXX XXXX and it was to late to file. When I pulled my credit report 3 annual free it listed XXXX and the others but it did not list XXXX in chapter XXXX. I have called XXXX XXXX and XXXX but heard from no one but one lady from XXXX who said another department was handling the bankruptcy part. I have filed disputes with each creditor and my attorneys office paralegal said don't pay attention until it is over and then pull credit reports due to inaccurate reports. I have also filed a dispute with the BBB on both XXXX and XXXX whom has numerous complaints for the same deceptive practices. I still think they knew about the XXXX and pain medication. Also XXXX never got a permit and a protective device when you have electricity and water wasn't installed nor was the breaker changed. No electric inspection and a worker went under the house connected the pipes and electrical to some unknown means. I know I have forwarded information that you probably can't use and if I need to just finish the Ch. XXXX and see if they try to get a lien or something since my account shows pays as agreed. One more note I received a bill which I am trying to re find it was for XXXX the first and only one was over {$600.00}.

We purchased an RV with a loan thru AQUA FINANCE in XX/XX/XXXX. Shortly after, I had an emergency XXXX, but I still made my ( XXXX ) XXXX payment. In XXXX, I knew I was about to have to go for a 30 day XXXX XXXX stay -- I reached out to XXXX, requesting payment accommodations, as my medical problems were the direct result of a COVID illness. XXXX refused to make any accommodations, deferments or alternate payment arrangements. I made my XXXX payment -- and XXXX was not due until XX/XX/XXXX. Upon my release from the XXXXl on XX/XX/XXXX, I noticed my XXXX payment had been marked 30 days late w/ credit reporting. I reached out to XXXX, and still, no options were available and they communicated they would not correct the status with the credit bureaus. I eventually lost my job, resorted to pleading with XXXX, and they continued to report my payments as late -- each month being late while still refusing to correct XXXX 's reporting. By XXXX, they had hired XXXX to collect on the debt from us -- who contacted us multiple times daily, beginning at XXXX XXXX and not ending until XXXX XXXX most days. I communicated with XXXX reps we wanted to voluntarily surrender. Company reps refused to reply to messages and hung up on numerous phone calls. XXXX cont. to harass and threaten us, eventually calling family members not listed on the loan ( mother, father, son, siblings ) -- communicating our debt obligations/status. Again, we communicated that we wanted to voluntarily surrender. AQUA FINANCE finally took possession of the vehicle on XX/XX/XXXX. Although the account is supposed to be closed and they have taken possession of the property, they are STILL reporting the loan as LATE... They are still tacking on interest charges and late penalties. Telling us that they will continue to report the debt as LATE until we pay it in full. They took the property and have refused to tell us where it is located or what ( if any ) repairs are being made and by whom. They have not given us the opportunity to repair the property before hand, nor are they communicating with us regarding the status of the auction/repairs. Reps I have made contact with transfer me to a different department each time I call if they don't just outright hang up on me once they realize I'm not going to make a payment and instead, I'm requesting a correction to the account. The company is in violation of the most basic consumer protection rights. How can we still continue to be reported as LATE when the company has taken possession of the property? Furthermore, how/why did the company fail to request a refund for the remaining Warranty Service Contract fees ( should have been close to {$3700.00} refund ). XX/XX/XXXX, I would NEVER recommend anyone doing business with this company. They do not care about consumers. They are not educated in any of the CARES ACT or consumer protection statues and regulations. They will not hesitate to call family members and your place of employment if you default and they refuse to make any sort of accommodations or account corrections when asked.

On XX/XX/2016 we bought XXXX XXXX XXXX to purify our household water and our drinking water. With the notion, that the system will take out all impurities out of our water. After 3-4 months from the date of installation we started noticing a yellow, orange, red, and greenish color substance in our showers, toilets, and sinks. So we called the sales person over 50 times and he did not answer. Finally, we got in touch with the main office and the manager called us back. He came to the house, we showed him the problems. He took samples, and they were inconclusive. Then we called again, spoke to another manager, he came out same thing. Then they sent a tech out, the tech informed me that the reading should be under 10 because it is a new water system, when he did the test, there was no difference between the city water coming into the house and the water coming out of the system, which I saw with my own two eyes because he was showing me the reading. After he saw the readings he tried to change his story so we called the main office and spoke to the main guy in California. After a heated debate we left off on that he was going to figure out an alternative option something like switching out the machine for another one and we hung up. Working 7 days a week, months and months went by but nothing was done. We didnt receive not one call or come to any solution. I got sick, my XXXX XXXX was as big as my XXXX XXXX. My doctor asked what I was drinking and eating because it could be a XXXX XXXX. So after doing a XXXX & XXXX they still couldnt figure out what was wrong. So I stopped drinking the water and cut off the payment that was being directly withdrawn from my bank account for almost two years. Ironically, my health got better yet my level of stress with this company got higher. Thats when they started calling us. We explained the situation they told us they would get back to us within 48 hours and nobody called us back. They sold our account to a collector who demanded payment. We explained to them the situation they said they would call us in 24-72 hours and no one called us back. A few months ago they called us again. We explained to them the situation again this time they even confirmed the notes on the account & said they never received one single payment. Which is a lie because we have bank statements to prove it. We even told them to come get their machine and they said that it would be a good idea to come get it and yet again NOTHING was done. Forcing me to pay for something that doesnt work is not right. They also stated every time that we were on a recorded line so they should be able to confirm the same thing I am stating. They even said they have a lot of notes on the account and even said they had everything documented yet nobody did ANYTHING to help fix the problem. We are still waiting for their phone call. I went to buy something the other day and noticed they are hurting our credit and I dont know if to get legal counsel and file a law suit therefore I am here begging you for your HELP.

XX/XX/XXXX I purchased what was supposed to be an XXXX Solar AC System. Within two months I found out that I had been scammed. I also found out that the company was not licenced to do solar ac systems. I then found out that there " in house '' notary had signed my name to several documents and has been found quilty by the FL Gov. Office for doing so. I then found out that a loan had been taken out in my name by someone. The loan was for the price of the " solar '' ac system XXXX with a company named Aqua Fin. I have told Aqua everything and provided documents to them in regards to the fraud and scam. when I received my first statement from Aqua Fin. I called and asked them to send me documents that I had signed due to the fact that I 've never applied for a load with them. They never sent me anything. I 've never paid on this loan and Aqua has placed it on my credit record and now I sold my home in XXXX XXXX and they had placed a lien for a " water treatment system ''. when the title company told me about the lien for a " water treatment system '' I told them I 've never had one in my home. So when the title company calls Aqua Fin. to find out what its about they told them it was for a " water treatment system ''. After the title company talked with me and i told them that I know of a company named Aqua fin. but I never had a water treatment system. I told the title company about the scam and fraud. The title company told Aqua Fin. about the " Solar AC System '' and by XXXX the next day Aqua Fin. had place another lien for the " XXXX XXXX AC system ''. I 've never had a XXXX Solar AC system in my home. The equipment that was installed I found out was just a regular XXXX AC system. And the " Solar '' panel they installed is not approved by the state of FL and that it had been found dang. I need help in getting my XXXX back that the title company is holding and get my credit back. This has made me very sick over the past two yrs. in trying to deal with this. I 've been in the hosp. over 15 times in XX/XX/XXXX due to XXXX. I have the Attorney Gen. Office of FL working on this scamm, along with working with the XXXX XXXX. PD in placing charges against several people that have been involved. It 's not right that Aqua Fin. took up business with XXXX XXXX and they got ripped off. I do belive that Aqua Fin. knew about the scam and got in on it to make money. it 's not fair to that I have to pay for a loan that I did n't take out. I have no papers showing that I did so. Please help me .... i do n't have the money to hire an attorney to help me .... attorneys want XXXX just to start to work on the case. I do n't have it and the XXXX is all the money I have and ca n't lose any of it. Please help me if you can. If you look online you can see just what kind of company Aqua Fin. is. Also if you look at my payment history on any of " my loans '' you will see that I pay them. My credit has dropped into XXXX when it was at XXXX.

We were scammed by a contracting company in XX/XX/XXXX for services not received and unsafe/poor workmanship ( XXXX XXXX ). They financed through their lending partner, Aqua Finance. We were never provided a contract stating terms, APR, loan term. We signed nothing with them. They claim the contractors contract with us was also a binding loan contract with them yet nothing is mentioned in that contract regarding a loan or terms of any sort and this was not stated to us by XXXX XXXX which we would not have accepted. Also, only I signed the contractors contract, not my husband. Aqua Finance also placed a lien on our home which we found out on our own and the only reason we continue making payments. We purchased this home XX/XX/XXXX. We were conned by XXXX XXXX for the incomplete work and our loan was for {$34000.00}. We have made 25 payments to Aqua Finance, and to date, our bill is still {$34000.00}. Monthly payments are {$380.00}. Out of over {$9600.00} we've paid Aqua Finance, only {$270.00} has been applied to our loan. We've learned this is a 9 year loan@ XXXX XXXX daily compounded interest which was told to us verbally by Aqua Finance... again, nothing in writing. In XXXX of this year, my husband and I both contracted XXXX placing me in the hospital with a XXXX XXXX and him out of work for 4 months with no income other than social security. We paid for the month of XXXX and XXXX and explained to Aqua Finance we are working to catch up on ALL bills once my husband returns to work on XX/XX/XXXX. I've explained this twice to Aqua Finance and they rudely stated they have no record of my calls and now want proof of hardship and have threatened to foreclose on our home. I've tried reaching XXXX XXXX, the account manager, since mid XXXX and shes yet to return my calls or respond to emails. I want to make a settlement agreement as I believe we have paid well beyond the incompetent project supplied by XXXX XXXX ( the contractor ) and that XXXX XXXX should return the remaining amount of this loan to Aqua Finance. I also do not believe this to be a binding contract as we've signed nothing with loan terms and nothing with Aqua Finance. The contract with XXXX XXXX is also invalid as we both did not sign nor did they live up to their contractual agreement. We would also like to know where all of the 25 payments @ {$380.00} have gone since only {$270.00} has been applied to this loan. We are seeking your assistance in removing the remaining balance of this loan to Aqua Finance as we do not see how this can be a valid loan, and also, they are reaping our payments unlawfully, threatening to take our home, harassing us during a time of hardship and illnesses, and just plain scamming us for money we should not owe them. Complaint XXXX XXXX to me 55 minutes agoDetailsXX/XX/XXXXXXXX XXXX XXXX We purchased the XXXX water refiner and reverse osmosis system for our home onXX/XX/XXXX, from XXXX XXXX XXXX. We started having problems with the pipe connections outside where the system was installed, causing water leakage that was going under our home. We contacted XXXX, who sold is the unit, in XXXX of XXXX. They told us the problem might be our main drain was blocked but they would send someone out to check it. That never happened. We called three more times over the next month, leaving messages, but heard nothing back. We wanted to have a professional plumber fix the issue but our contract with XXXX stated that only their personnel could perform service in on the item and its components or our warranty would be voided. After months of dealing with this situation we began to notice the quality of our water declining. Evidence of hard water residue was in our bathtubs and sinks. We called againXX/XX/XXXX to request a service appointment and heard nothing back. Months later, XXXX sent a text with a service check reminder and we called them right away. Our appointment was confirmed for XX/XX/XXXX. When they called me days before the appointment I was informed that they would service our unit, for a charge of {$250.00}. I explained that according to our warranty, that the first year of service was free. They informed me that the year had past but I explained that we never received the service as requested during the first year. It took a bit of back and forth but after checking their records they saw I was correct and that they would come out at no charge. The appointment never happened. The day before our appointment I was contacted by XXXX who said their service guy got into an accident and could n't make it. I completely understood and we rescheduled for the next week. The day before that appointment I was called by a different employee of XXXX with the same story that their service guy just got into an accident. I clearly realized that they were lying and had no plans to service my unit. I began researching the company because the whole thing seemed suspicious to me. During my investigation I found that the water treatment specialist, XXXX XXXX, who sold us our unit was using a contractor 's license number ( CA # XXXX ) that was not registered to him. I found no evidence that he is actually licensed. That was the first count of fraud. The second was our contract of credit for XXXX XXXX was never signed by us. We only signed the contract for the water system, not for the revolving credit, which was opened without our consent. The third item is that our purchase contract is also invalid because it was never signed by management personnel at the XXXX home office as mandated. As of this date, we have paid over {$1500.00} to a company that has defrauded us on all accounts.

Aqua finance, XXXX XXXX XXXX and there investment banks are still harassing us. We sent numerous complaints to your office through the U.S. Mail and also online. Just recently we started receiving responses from Aqua but for what ever reason we could n't see what Aqua had wrote and we used different computer devices but nothing would show. We started writing your department because our complaint would n't go through when we hit submit at the end our when Aqua replied, the system for whatever reason would n't allow us to dispute. This is another tactic by Aqua using there influence to manipulate the situation. Why would we submit a complaint of harassment as many times as we have and not follow up on them makes no sense! Aqua is getting caught in all types of lies. Aqua stated that financial systems XXXX are no longer working on our account, they just admitted to another lie. If your department pulls out all the information that we sent you, there is a correspondence print out that displays conversations between Aqua, the XXXX and ourselves. Aqua clearly stated on the correspondent that they Do n't Have Anyone Working On Our Account so with there on words they are caught in a XXXX and yes we have copies plural of that correspondence print out and we can always send your department another copy! Aqua wo n't even address the conversation involving the print out, they only address the pictures thinking they can explain there work vehicles constantly being around us XXXX following us XXXX. Aqua in there arrogance has forgotten that they told the XXXX that they do n't have any representatives in our region, once again another lie! If your department reviews our complaints and the evidence that we have sent you, this a clear case of felony harassment. Aqua also told the XXXX that they do n't deal in real eastate or mortgages and that they never have and they never will. Well I guess I can see the future, because if your department checks there web sit you will see that Aqua is in real estate, mortgages, car loans, business loans and even personal loans. In my opinion this makes them a much stronger company to harass people because they a lot of influence. We can send your department another print out of there conversation with the XXXX that proves that they are liars and are very crooked companies. Ever since we have been sending your office complaints, it has yeilded significant results, we have also sent the Texas ago at least XXXX written complaints over the last 4yrs. I bought my home in XX/XX/XXXX, shortly after I received a notice in the mail that I had a package. So I was thinking that maybe a package was trying to be delivered that I missed. So I called the number and found out that it was regarding a water softener. The sales man came out like the end of XXXX beginning of XXXX, went over his sales pitch and showed me how bad my water was and how if I get their water softener all the benefits that come with it. He then start asking me how much we pay for drinking water, dishwashing liquid, hand soap, filters for the refrigerator, and laundry detergent. It came out to like {$110.00} a month. He then said we can cut that in half {$54.00} and give you free dishwashing liquid, shampoo. hand soap, and laundry detergent. He ended it with you'l pay {$54.00} a month for 5 years, and I had 3 months to start paying, in which my first payment, would be due XX/XX/XXXX. He just needed to do a credit check and send an installer out. Awesome right, wrong! The installer came out, he had to drill holes in the wall, unbeknownst to me a that was never mentioned. Then the water was soft the first 3 months, now it's feeling hard again even after we bought bags of salt from XXXX. With our ice maker on the refrigerator he pointed out you see all this white residue was the chlorine that's in the water prior to the installation of the water softener, however after the water softener it's still a white residue, so pretty much nothing changed. Here 's what brings me to my complaint today.I feel like I was GOT, this was a gimmick. I look at my credit report often since I'm a victim to identity theft. I noticed that Aqua finance is on my credit report, reporting the product at {$46000.00} and the balance that's due today is {$4400.00}. If you take the {$54.00} I was told that was due each month and multiply that by 5 months that's come up to {$270.00}, right, wrong. For every payment I make for {$54.00} {$37.00} goes to interest, in which that was never discussed. So out of my {$54.00} only {$16.00} is going to the premium. Since it was a loan, I figured it was like you going to The XXXX XXXX or XXXX, where you get a piece of furniture and all the finance charges are included in that monthly fee. Well I called the customer service number on Thursday and basically the rep was like yes the interest is like {$1.00} a day. Now come on do you think I would've got myself in debt like this, I'm very smart when it comes to my money, I just don't spend it carelessly. Now the sales man lied to me and keep in mind I didn't receive my first bill until XXXX by that time it's too late to return the waters softener because you only had like 3 days to do that after installation. In XX/XX/2019 I had a water purification system demonstration performed at my house by a awesome rep named XXXX. I was convinced after all the testing to get a system installed. I was so convinced I wanted to get one for my mom who is a XXXX XXXX military vet. I was told by someone at XXXX who called to verify my information, that in order to get both water systems that we ( myself and XXXX ) need to tell the finance company ( Aqua Finance ) that the way my house was designed, I needed two systems. When Aqua called they didnt bring up the issue of 2 systems. I had my system installed and scheduled the demonstration for my mom. She had to reschedule the demonstration due to doctors appointments. She was notified during this time that she had to have XXXX immediately. After further thought, my mom decided not to have they system installed because extra funds were going to be needed for her care. I contacted XXXX to advise them that we were not going to get the 2nd system installed at my moms. I was told that my 3 days had passed and there was nothing that could be done because the finance company wasnt going to make any adjustments. I contacted Aqua Finance who stated they couldnt resend the contract but XXXX can call them and make an adjustment to my account. XXXX refused. They actually became very nasty. I was told that they could drop the system off and I could try to sell it to get my {$8000.00} back. They said that IF they made any adjustments I would have to pay the fees associated. I said ok, how much are the fees, she said at least {$4000.00}. I laughed and asked why would I have to pay {$4000.00}? She said because commissions were already paid and fees were already paid to the finance company. I said it would be like any other company that makes returns/adjustments to commission checks and financing companies and I refused to accept that offer. We argued for weeks over this. When I said I was going to contact Aqua Finance and dispute the amount with them, I was told that I would be jeopardizing my financing and that Aqua could void the entire contract then the {$15000.00} would become due immediately and they ( XXXX ) would be calling me for a check or credit card for the full balance! What makes this situation even worse is the scare tactics they tried to use. I have made my payments to keep the account current until this issue is resolved. I was also told that I received extra discounts on my system because I was getting 2. I advised that the extra discounts went to the second system because they gave my mom a senior discount and military discount. My system had its own discounts. I will also be making a CFPB complaint, FTC complaint, AG complaint. They have also violated the FDCPA!

This is actually a dispute complaint to respond to Aqua finance 's response to our latest complaint against them and there colleagues. Aqua finance in there response stated that they are glad I sent pictures, they did n't expound on which pictures and if they are referring to there work trucks you can clearly see there trucks have tx plates. This company and there colleagues have been felony harassing my family for over 4yrs. Aqua illegally sued us without our knowledge and have been trying to force us out of our home for the last 4yrs. We even tried to pay these crooks 3yrs ago and finicial systems of greenbay told us they do n't do written contracts. Finicial systems of greenbay told us they only do verbal contracts and we knew that was n't right. They had 1 of there XXXX ( agents ) damage our sons car so I called the police and I told the officer what has been going on. The officer told me not to pay them because without a contract we have no proof that we have been paying them. I also came to the realization that there ca n't be a contract because the case is supposed to be closed! Once again these companies are caught using illegal practices. I had to make a late payment, so I called and asked if I could make a double payment for {$290.00} after I got my check on XX/XX/XXXX or XXXX. I told him I get paid on the XXXX but sometimes it doesn't clear until the next day so I would pay by Saturday the XXXX at the latest. He said something at the end of the call that made me say, Sir I do not want an automatic payment t set up. XXXX XXXX is funny, and because sometimes my check clears later that night or the next day if you take that payment out in the morning or before my check clears they will charge me an overdraft fee. I EXPLICITLY said I do not want an automatic payment set up and told him why. He said this isn't an automatic payment you can just go online and pay it like you usually do. So they did an automatic payment on the XXXX anyway before the end of the business day. My check had not cleared yet, so my bank emailed me about the transaction. I called them, they said they could not stop the payment, but that if I showed them the transaction and negative balance, and showed them the overdraft fee they could reimburse me the overdraft fee. That was fine. Then XXXX called back and said that a supervisor had reviewed the call and that the payment was agreed upon. That is a bold face lie. I EXPLICITLY said in exact words that I DO NOT WANT AN AUTOMATIC PAYMENT SET UP and told him why, and he definitely replied with, It isn't an automatic payment ... .etc. so I asked XXXX to let me speak to someone who would review the call on the phone with me and then tell me I agreed to it. She put me on hold, came back and said she couldn't get a supervisor because she works from home and the people that review the calls work in the office. Then at the end of the call she said, " Yes ma'am, I'll do that tomorrow as soon as I come into the office. '' So she lied to. I want Then to review that call with someone in the FTC and then explain why they are doing what their customers EXPLICITLY ask them not to do, taking payment without and consent after they were expressly told they DID NOT have my permission to do so. Then they can explain why they lied and said I did agree to it so they didn't have to give me back the {$35.00} extra they cost me by doing what I told them they did not have my permission to do. I could have stopped the payment through my bank but it would have e cost me {$31.00} to do that and the overdraft fee was about the same, I had to make the payment anyway so I did not do that. But what they did, and lying about that and other things is unethical and fraudulent.

On or about XX/XX/2019, I submitted a boat application to XXXX XXXX XXXX XXXX for a " XXXX XXXX XXXX XXXX XXXX XXXX '' XXXX XXXX XXXX ( Standard Package ) for one primary applicant. On XX/XX/2019, I received a call from XXXX of XXXX XXXX stating that my application had been approved by Aqua Finance for about {$27000.00}. The advertised base price of the boat I wanted was {$25000.00}. However, after visiting several XXXX XXXX/XXXX XXXX XXXX, the same boat listed was for significantly more than my approved loan amount. I, subsequently contacted XXXX of XXXX XXXX and asked for a reconsideration of my loan for {$34000.00} because I couldn't find a boat for the original amount of {$27000.00}. I was told in order to qualify for a higher amount that my wife had to be included to my application with her income being verified. I declined to add my wife to the application. And that I like to retain my initial loan approval. I never submitted a separate loan application with my wife included. The next day I was told by XXXX ( XXXX XXXX ) that Aqua Finance had rescinded my initial loan approval because I had not provided proof of income. How can this be? I had already provided all requested information initially and I WAS ALREADY APPROVED! On XX/XX/2019, I contacted Aqua Finance to find out the reason for my initial loan approval had been rescinded. I spoke with XXXX and was later transferred to speak with XXXX. The only information they would provide was that my applications had been denied for lack of income verification. I then asked what was the income thresholds for a {$27000.00} loan? They didn't known the answer or they refused to tell me. How could you rescind a loan that has already been approved and in effect for about a month and then later claim that income was not sufficient or had not been provided? What changed since the initial approval until now? The only change was when I refused to apply for a joint account with my wife for a higher loan amount. Regulation B, the implementing regulation for the Equal Credit Opportunity Act. Section 202.7 ( d ) External Link of Regulation B generally provides that a creditor shall not require the signature of an applicant 's spouse who is not a joint applicant on any credit instrument if the applicant qualifies on his or her own. I believe that I have been discriminated against based on the above citation ( marital status ), because I refused to reapply for an already approved loan with my wife. Thereby changing my initial one person application to a joint application.

I was told by XXXX, that they would run a credit application to get us financial approval to install a new roof on our home. XXXX called back a few weeks later and said we were approved to get the work done! I asked them how much was the approval amount! They stated XXXX! I also asked them, what would be the monthly payment, they stated XXXX dollars! The contractor stated that they would send a crew out to start the job in a few weeks! We did n't know about that option until after the 3 day period had already expired! We did n't think we had a option to decline, especially since the work was now completed! Then we made the first payment of XXXX dollars to Aqua finance company, instead of the pay off amount going to a lesser amount the pay off amount went up in price to XXXX dollars! Then we received a bill statement outlining the details of the loan! The XXXX dollarso only went toward the interest rate, instead of the pay off balance! In order for the payment to go toward the interest and the pay off balance, we must pay the minimal payment of XXXX dollars instead of the XXXX dollars! We are also being charged XXXX dollars late fees for payments not received within 10 days and our APR may increase to the penalty APR of XXXX percent! I blame XXXX for setting me up with this predatory lender Aqua finance! My credit score was XXXX during the time the roofing work was approved! I also got approved to buy a XXXX dollar vehicle during the same period! I really beuylieve, I should have got a better financing option than what I was offered! This is not a vehicle it is a commercial trailer loan with a company called Aqua Finance, which i do already have a existing open loan since XXXX XXXX. Yesterday XXXX/XXXX/XXXX I applied for a additional loan through the funding company Rock Solid Funding that goes through Aqua Finance ( which again I have a open loan already with them on a trailer I purchased XXXX ) I got a email from the XXXX XXXX XXXX that Aqua Finance denied me. I called Aqua finance today XXXX/XXXX/XXXX at XXXX ( eastern time ) I was on the phone for 41 minutes and got no where.I spoke to the lady who answered to find out why I was denied she said my account is past due, I explained to her it is not according to all the invoices/receipts she spoke to a supervisor and came back on the line and said due to that they denied me, I asked to speak to a supervisor ( XXXX ) I explained I am current according to all my bills since XXXX she transferred me over to billing, I spoke to XXXX she said she has a 3rd party billing and they always mess up and explained I had a payment due today which I was aware of and was to pay today ( which I did ) I asked XXXX so I am not past due she said No. I asked to be transferred back to ( XXXX ) the supervisor she then said the same things I said I need to talk to your Supervisor she got me on the phone with XXXX I explained the whole situation that I should not be denied for past due balance cause I am not, I told her that I have all emails, receipts, their invoices showing no past due etc.. She then stated we are not financing you due to late payments, I then got upset mentioned to her that I will contact FTC and who ever I need to since I feel this is a " false statement about the ability to offer a loan '' since I do not have a deliquent/past due. XXXX then changed why i got denied and said we are not approving you due to having to pay off exsisting loan which I then got angry with her and said oh now XXXX you are changing why I got denied after you and everyone else stated before I was denied for past/late charges which is incorrect!! She then had nothing further I told her I will forward all this proof over that I am not late/past due she then didnt want to speak to me further. Me and my husband filed for Chapter XXXX Bankruptcy in XXXX. It was discharged on XXXX XXXX, XXXX. The creditor Aqua Finance was included in the bankruptcy and was discharged with the other creditors. We sold our home and were closing on XXXX XXXX, XXXX. XXXX XXXX XXXX is handling our closing. On XXXX XXXX, XXXX, XXXX XXXX was provided a final XXXX settlement statement from XXXX XXXX XXXX XXXX that was given to us. To our disbelief this statement has a second mortgage listed for {$6000.00} from XXXX XXXX XXXX, XXXX. We were confused. We don't have a second mortgage and since we have a VA guaranteed loan, we can not have a second mortgage on our property. I searched for XXXX XXXX XXXX, XXXX and contacted them about this fraudulent 2nd mortgage. I spoke with XXXX a customer service representative at XXXX. She informed me that they represented Aqua Finance. I told her the debt that we had with Aqua Finance was discharged in the Chapter XXXX. She stated that they had no record of this. She provided me with a claims email address and I emailed a copy of the listed creditors in the bankruptcy and the discharge order from the court, to show that Aqua finance was listed. I called back to make sure they received the email and spoke with XXXX another representative. She stated that Aqua Finance had a judgement of exemption from the bankruptcy discharge and this was a valid way for them to collect the debt. I asked her to provide me with a copy of this since I have a copy of the bankruptcy closure of estate order. It shows that no creditor was given an exemption to the bankruptcy discharge to collect on an exempt debt. I asked if she would provide me with a copy of this exemption order they had for XXXX XXXX XXXX, XXXX to collect this debt. She stated they didn't have to provide me a copy of this ordre. I informed her that I would file a complaint with the CFPB. She told me to go ahead, that was fine. The actions of XXXX XXXX XXXX, XXXX on behave of Aqua Finance, is a clear abuse and infringement of my consumer rights and protections provided to me and my husband under the US Bankruptcy code. It is also holding up the sell of our home. This is a blatant strong arm tactic by big corporations to collect a debt and they are breaking the law.

This is a add on to a complaint I already put in on XXXX XXXX,2017 complaint XXXX about AQUA FINANCE, INC.. I had put in this prior complaint and was surprised and thought great customer service since I received a call the next day on XX/XX/XXXX from a " XXXX '' who was in management ( called from a unknown number ) and she apologized over and over how Aqua Finance was wrong in this whole process with me, all representatives/Managers I spoke to all stated I was late/past due and that was incorrect regarding my account, which I am very upset about if I did not know my laws and or rights then that would of been it. XXXX explained how all of this was " bad training and they will look into this '' and how she wanted to move forward with the process of loan I agreed she stated she will make notes and forward all my info to the head guy in financing and I will get a return phone call. Well go figure .... it is now 8 days later and no returned phone call or any emails etc..I have no idea if I was approved, denied, nothing! I am so frustrated with this process especially how I feel I was told I was denied original on the prior claim which is NOT correct and in my eyes a " False Statement '' from the Finance Company this is very unprofessional and agian I am highly frustrated due to now allowing them to move forward and fix the problem they have made the situation worse and once again misleading information by having someone contact me back ( after pulling my credit ) and NO ONE can communicate with me in regards to the loan process, I have no call back number for this XXXX and I do not want to even call customer service do to the prior complaint and I was mislead/lied to by all the managers ... .this is the MOST horrible experience I have been through when applying for a loan, especially frustrating that I have a existing loan which is in good standing so I have a relationship with this company already.I need to know what I can do about this i feel like I have false denial statements ( original complaint ) and now this company has pulled my credit and no phone calls back to me ... .I am ANGRY!!!!!

My name is XXXX XXXX XXXX, I recently purchased a home at XXXX XXXX XXXX in XXXX XXXX, FL on XX/XX/2021. On XX/XX/2021 I agreed to purchase a water softener system for my home from XXXX XXXX XXXX and the loan would be financed for XXXX through Aqua Finance. According to my contract, my payments were supposed to be deferred to 3 months from the date of the contract ( XX/XX/2021 ). However, I received a call from Aqua finance and they stated that my first payment was due XX/XX/2021 and that I had incurred a XXXX dollar late fee. I called them back ( XXXX ) this afternoon and Spoke with XXXX. I explained to XXXX that I would not be paying the XXXX dollar fee and he agreed to waive it as a " one time courtesy '' but refused to change my payment date to the agreed upon date according to the contract. I asked XXXX to speak with his manager. I was then connected with XXXX the manager who explained to me once again they can waive the late fee this one time as a courtesy but, the latest they could make my due date is the XXXX not the XXXX. I explained that is not what the contract says and he said we are two separate companies and his system will not allow him to change it to anything past the XXXX. I live on a budget and I have budgeted to make this payment on the XXXX of every month like it was agreed upon in the contract. I have attached the contract as well as the statement they sent me in the mail saying I owed them XXXX dollars by XX/XX/XXXX. XXXX also explained to me he can not change my due date until I pay my already " overdue '' XXXX balance and he still will not change the date to the XXXX but, just the XXXX. I personally feel like I was swindled by this company and do not recommend anyone do business with them. I have never missed a payment on anything on my credit and now even though the company says they will not report the missed payment. How can I trust them when they can not even honor a contract. I was in the market to renovate my bathroom, and believed that I made the right choice at the time when selecting XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX ; XXXX, NJ XXXX Ph : XXXX or XXXX a/k/a Aqua Finance to help me. It was done in XX/XX/XXXX. The problems are as follows : 1 ) I asked about the high interest rate of the loan ( $ XXXX ) ; and why did it look like my balance was not going down. This is all new to me, and I never knew they could short-change consumers with not telling the entire story ( predatory lender ). I called several times, and they alwas blew me off. UPDATE : when searching for XXXX XXXX on XXXX, it is now out of business. 2 ) Aqua Finance is the same-they also have same loan and refuses to discuss why/how the amount never seems to change although payments were being made. Again, emails sent ( on their site and they refuse to answer forthright to my concerns ). Then to my horror, in XXXX XXXX, we had to get our kitchen ceiling attended to because it looked like it was about to fall any minute. I noticed it slightly, but never knew why. The contractor who has nothing to gain in lying to me, asked me to come downstairs and he pulled out ALL of the cement/debris the contractors stashed in my ceiling! So, not only did I have to pay to repair the ceiling, but also to properly have debris properly disposed of-which was supposed to have been taken away. It was paid for in this loan. Now, to date, they refuse to address why they feel no need to care about the out-of-pocket expenses that I have to deal with through no fault of my own. They were rude and abrupt saying " we have nothing to do with it and there is nothing we can do. '' The last time I spoke with them was prior to Covid-19 pandemic, and have not made any further payments because I feel was wronged, and have no need to make this up. Solution : My relief should come by way of cutting the loan in half, including interest rate for the fraudulent/shady practices that adversely affect me to this day.

We obtained financing for a bathtub. Began making payments. My husband lost his job. We became delinquent in repaying our outstanding debts. We began trying to dig ourselves out of a hole but were negligent in getting back on track with this loan. We were later in the process of trying to refinance our mortgage to lower our interest rate when we discovered that the creditor had placed a XXXX lien on our home so we were not able to refinance. Since then we have attempted to come to an agreement with the creditor. They continually refer us to a third party credit collection agency. However the collection agency is not empowered to negotiate the amount, a repayment schedule or a payoff amount. They have refused to submit our offers to the original creditor unless they fit into a very narrow definition basically a full payment of the loan in one or several installments. The creditor has been charging us 21 % interest on the loan. We are unable to payoff the whole amount at this time and would not be able to cover the interest payments with a monthly payment plan. The creditor will not allow us to come to an agreement with them if we were to arrange to sell the house and would like to make arrangements for a settlement with them. I finally made contact with them but we were told that someone would return our call and contact us to discuss arrangements. No one called back. Instead they escalated the severity of our delinquency on our credit report, changed the status of the loan to in collections and have damaged our credit even more at this point. We are no longer able to obtain financing to purchase a new home. We feel like we are between a rock and a hard place. We actually need to purchase a new home that will accommodate our XXXX. But we can not do so without making arrangements to payoff this debt and improving our credit score. However, negotiations are essentially being refused. We have no leverage and they apparently have no motivation to talk wit us.

I recently requested my statement from Aqua Finance Inc. When reviewing my statement I discovered that the first six payments that I made to the company for my monthly pool payment of {$750.00} had been taken strictly towards interest. Not a single XXXX of that initial {$4500.00} went towards the principal! As I continued to review the statement I noticed that even though I have a fixed interest rate of 10.9 % the amount of interest that I was required to pay monthly varied significantly. Even though I was consistently making my payments, the amount of interest that was being collected would actually go up which doesn't make any sense because if I have a fixed interest rate and I'm making my payments monthly even if the principal is decreasing by a small amount, the amount of interest collected should always decrease and never increase. I'm not talking about small amounts either, this company takes whatever amount that they want from your payment and will keep it as interest. The math is simple, if I am paying monthly on my account that has a set interest rate my principal and amount of interest ( dollar amount ) should decrease and unless should never increase unless the interest rate changes or there is a late fee. One month the amount of interest collected was {$270.00}, the following month they took {$390.00}, the following month they took {$580.00}, and the month after that they took {$680.00}. Payments were all made on time in the amount of {$750.00} and Aqua finance Inc just arbitrarily choose to keep whatever they wanted and just disregarded the terms of the contract. Business should not be allowed to take advantage of consumers like this and it is a disgusting practice. I have emailed the company twice and I have gotten no response and I spoke with a representative and he couldn't provide answers as to why this was occuring ( although there was also a language barrier between him and I ).

Aqua Finance open an account in my name without my consent using false information. I never authorized Aqua Finance to pull my credit nor did I sign a contract. The information listed on the contract is not correct. They listed my military rank and salary wrong on the application and I never signed the contract. I have reached out to them on several occasions to have this information remove off my credit report. I contact a XXXX XXXX on XX/XX/XXXX about my credit been pulled and she couldn't locate my account but told me to call XXXX Ext XXXX. I was told if I filed a police report this would remove the account off my report. I filed a police report Case # XXXX and sent this information over and the report is still showing on my credit causing my score to decrease. The electronic signature was not done by me and I never spoke with a representative or the person listed XXXX XXXX, about pulling my credit or trying to establish credit for me. I have been working on my credit and I wouldn't allow someone to pull just my credit. On the contract XXXX XXXX listed my military rank as an XXXX XXXX and I'm an XXXX XXXX He listed my gross salary at {$5000.00} which is also incorrect. I would never claim to be of rank that I haven't earned in the military that's a frown on my Integrity. Also, I joined the military XX/XX/XXXX and XXXX XXXX show on this contract that I've served for 18 years. XXXX XXXX listed my husband as Retired military and gross salary XXXX. My husband has never served in the military. He's received SSI monthly. On the contract he listed him as XXXX XXXX XXXX and my husband doesn't have a middle initial. All this Information is incorrect and XXXX XXXX never spoke with me about my military career, salary or if he was authorized to pull my credit. The signature on the contract wasn't signed by me and I had no knowledge of this account until I received an alert that my credit was pulled.

A sales person by the name of XXXX came in to our business to offer us a water filtration system called XXXX. He tested our water and said that it had XXXX causing chemicals and that we were at high risk of getting sick from it. After discussing the product for a while we decided to get it installed. He said that the total was XXXX and that the monthly payment was going to be {$90.00} a month for 6 years. He showed us a peace of paper where I had to provide my social security number to see if we qualified for additional savings. To which he then said we qualified for three free months. What we didnt know is that what he was doing was opening a credit card with Aqua Finance in the amount of XXXX. We have been paying our $ XXXX monthly bill amount for a little over a year now and just found out that we are actually paying a financing company who charges interest every month for the unpaid monthly balance. Our balance is XXXX as of XXXX which means that in this whole year we have been paying mainly interest and only about {$270.00} has gone towards the water system. The only reason we found out in because my daughter opened a bill from them and reviewed it and let us know about this issue. We were absolutely never advised that a credit card loan would be opened and that there were interest fees on top of the XXXX. My daughter checked their XXXX reviews and XXXX reviews which are filled with people complaining about being scammed by them too. They are a fraud. They lie and take advantage of the XXXX community that doesnt speak much XXXX. I called the company Aqua Finance and they told me to call the sales people at XXXX XXXX. I financed my pool with a company called XXXX XXXX. They used Aqua Financial for the funding in XX/XX/XXXX. Original amount was {$80000.00}, monthly payment of {$1000.00} for 20 years. I have been making {$1000.00} payments every month and not a XXXX has come off my principal. I am only able to go back to XXXX of XXXX since Aqua is now using a new online payment portal and they do not offer you all of you loan info. My daily interest accrual is {$30.00}. So every 31 day I accrue {$930.00}. I pay {$1000.00} on the XXXX of every month and they are not taking a XXXX off of my principal. I made an additional {$200.00} payment on XX/XX/XXXX since my monthly payment had been removed so that the {$200.00} would go towards the principal. I looked online and it said I still owed {$180.00} in interest even after my monthly payment. I called and they said my {$200.00} will first go to pay off the {$180.00} and the remaining will go to principal. So, I cancelled the payment. Also starting in XXXX they started lowering my monthly payment by {$1.00}. Started as {$1000.00} in XXXX, then {$1000.00} in XXXX, {$1000.00} in XXXX, {$1000.00} in XXXX, {$990.00} in XXXX, {$990.00} in XXXX and XXXX is the same at {$990.00}. So why would you lower my monthly due when supposedly I am not even paying enough now to cover interest. Their statements do not show principal balance. I currently show owing {$78000.00}. By the time my next bill is due I will owe {$79000.00} with interest. So in over 2 years {$1100.00} has come off of my principal. {$1000.00} of that is because they posted a payment to my principal by mistake. So technically only {$110.00} has actually came off my principal. That is less than {$4.00} a month being taken off my principal. This is not right and probably illegal.

Purchased a walk in tub in XX/XX/XXXX. In XXXX, XXXX, the heated back and hydrotherapy functions stopped working. I called for service. Between that date and XX/XX/XXXX, I called for three service calls. The final time was XX/XX/XXXX. I got no response and I sent a letter to XXXX XXXX notifying them that under the terms of the credit agreement I signed I would make no further payments until the tub was either fixed or replaced, preferably replaced. On XX/XX/XXXX, a repairman came out for another service call. On XX/XX/XXXX, someone from XXXX called demanding I set up payments by phone to cover a missed payment from a year ago as well as my XXXX payment. He proceeded to tell me that I could not withhold payments due to dissatisfaction with my tub because this was not a credit card purchase ( unlike I had been told by several other people in discussions on the phone ) and that if I didn't make this payment and a half on XX/XX/XXXX it would go against my credit and go into collections. If I refused to make payments at all because I was " unhappy with my purchase '' and it went to 120 days out, XXXX and XXXX XXXX XXXX would sue me. I had signed a secured consumer contract and was responsible ( with my husband, who I am now divorced from ) for payment. He then went in and pulled a credit report and started reading off to me all my accounts and telling me that I was paid up on all of my other accounts, and he didn't see why- if I was current on everything else- I wasn't able to catch up and pay my XXXX bill current. He even went so far as to ask 1 ) If I couldn't ask my auto loan company to wait a month so I could use the money from that to pay XXXX and 2 ) Knowing that I am now divorced

Shortly before the Covid lockdown I traded a XXXX XXXX XXXX XXXX XXXX XXXX for a XXXX XXXX. The salesmen stated that the amount billed would XXXX out before the grace period on the account was up around XXXX I believe. I called aqua finance to confirm there was no interest accruing in the grace period so I would not be left with a balance. 4 months later I received an offer to open a credit union account with XXXX and a notice that I had an amount due. Upon research it appears that XXXX is a front for Aqua finance. I wrote to dispute and Aqua finance/ XXXX became Bay Finance, none of whom have a true debt for me. When I disputed with XXXX after erroneous posts the dispute was closed as a mistake on a closed account but they reported the same misinformation on my credit reports 3 times that same month after the bad debt was removed. Because they call me 5-10 times a day I have sent letters demanding they stop the abusive behavior to no avail and an email to them came back undeliverable to the address on their website ( Bay Finance ) .. Im at my wits end, the last item I received was a notice that they would continue to destroy my credit, and garnish my wages, take my assets etc over the account they admitted was not delinquent or open. As they have done severe damage to my good credit and harmed my reputation I believe they intend to continue this blackmail to whatever lengths they can get away with. There is no contract in my name, there is no debt to sell amongst these related companies and their deceptive reporting and aggressive calls make it clear they know they are in the wrong and are attempting to evade financial reporting laws.

This loan was originally obtained when I was married. During my divorce was an account that " fell through the cracks '' and wasn't paid. This account was later disputed through a company i hired after my divorce to help fix my credit. The debt had been removed and then re-reported under a collection agency which purchased the account. While trying to refinance my home, it came to my attention ( only until then ) that a lien had been placed on my home by Aqua Finance. I never received notification of such action and per Aqua Finance a notification had been mailed through regular mail. Mail where I live doesn't always get to me and I manage that by keeping track of bills and other items electronically through email notifications. When I spoke with Aqua Finance at this time they claimed they didnt have to send anything certified or verify that i received a notification for the lien which i feel is very deceiving. A few days passed and they re-reported the debt from a XXXX balance collection account to a full balance ( {$3900.00} ) placed for collection account. I feel this is a violation of the Dodd Frank Act as it is an unfair practice of Aqua finance placing a lien on my home without properly advising me, and then taking it further re-reporting a debt to my credit days after I called them. In them re-reporting the debt with a balance as an open collection, it caused my credit to go down 86 points, which seemed to be done on purpose to aide them in collecting the debt by affecting my credit when I was trying to refinance XXXX which they knew was how I found out of the lien on a XXXX balance collection account days before )

We applied for a loan to build a pool . Aqua Finance provided us with {$40000.00} and the balance of our backyard project was paid i n Cash. Payments for the loan were set up as an automatic payment from our bank account on the XXXX of each month starting 30 days after the completion of our project. The first payment was XX/XX/XXXX . Since XXXX I have been trying to set up an online account so that I can increase our payments and pay this loan off by the end of XXXX . I was told that I would receive a bill in the mail with a code which I could use to set up my online account. Once I have this information I will be able to increase my payments and there would be no pre-payment penalty for paying off the loan early. I called in XXXX , XXXX , XXXX , XXXX and XXXX . Today I was told I will never get a statement because I pay the bill automatically. I find this unethical, as a consumer I should receive a statement no matter how my payments are made. I have no way of knowing that the payments I am making are being applied to my account and what they are applying to principle or interest. This is unacceptable. On my phone call today they offered to increase my payments. I do not want to give who ever I was talking to any more control over my payments without a bill. Apparently the billing is done by a 3rd party. They will request that I receive a bill. They do not know if I will receive a bill at the end of XXXX or maybe it will be XXXX . In XX/XX/XXXX opened a loan of {$10000.00} w/an interest rate of 12.99 % that originated with XXXX XXXX for a home improvement project. In 1 year and 7months I had paid this loan down with XXXX XXXX to {$9500.00}. That's 19 months at {$130.00} a month a total payment of {$2400.00}. XXXX XXXX then sold my loan to aqua finance in XX/XX/XXXX. From XX/XX/XXXX I have paid Aqua Finance {$130.00} for 33 months that's a total payment of {$4200.00}. My loan has gone from {$9500.00} to {$8900.00} that is a difference of {$660.00} in almost 3 years. With XXXX XXXX the interest fluctuated from $ XXXX {$100.00}. Aqua Finances interest fluctuates from $ XXXX {$130.00}. Why the big swings in interest? Why am I paying an average of {$210.00} a year towards the principle? At this rate I will never get this loan paid off. It is my belief that this company is improperly billing and manipulating numbers and this needs to be looked into. I sent this to XXXX XXXX, Examiner State of Wisconsin-DFI and Aqua Finance responded but there are discrepancies in their documentation. They claim that due to a revolving credit loan I pay a monthly payment factor of 1.25 % making my payment {$130.00} a month that is inaccurate, that was never agreed to and this was the first time I had ever heard that. They also included months of XXXX XXXX payments to increase their principle payment amount in their letter of response to the examiner. There are reviews of this happening to other customers online I am not the only one complaining about the billing practices of this company.

I have called 4 times to request to have my due date changed from the 5th to the 18th. It is auto debited from my bank account each month. The first time I called, the gentleman said it would be changed and it would take 2 billing cycles to complete. When I received my statement for XXXX, it said the payment would be debited on XX/XX/XXXX. The payment was taken from my account on XX/XX/XXXX. I called and was assured it would be correct for XXXX. I received my XXXX statement and showed a due date of XX/XX/XXXX but the payment was taken from my account on XX/XX/XXXX. I called in XXXX XXXX and was assured by XXXX XXXX that it would be corrected and that when the payment was changed the first time, they only changed the due date but not my debit date for the payment. She said she corrected it and it wouldn't happen again. She also sent me a letter confirming the proper debit date. I received my statement for XXXX and it showed a due date of XX/XX/XXXX. XXXX 's payment was actually taken as agreed. I assumed everything was fine until today! My statement came showing a due date of XX/XX/XXXX and AGAIN they debited my account XXXX XX/XX/XXXX. Now, my account is overdrawn by more than {$500.00} and have been charged {$30.00} in overdraft fees. I am FURIOUS! This is the 3rd complaint I have registered with the CFPB about this HORRIBLE company. I can not understand why I am penalized for keeping my commitment to make my payments but they don't have to keep their commitment to take the payment as they agreed and NOT cause me to overdraft my account.

So for the past XXXX years I have been paying on an auto loan ( for the purchase of my camper ) to XXXX XXXX. At the beginning, I was paying more than what was required on the bill. After some time my bill started showing {$0.00} due but I was still paying. Now XXXX years later, they say I am almost {$2500.00} behind. Come to find out that all those times I was paying extra they were applying directly to interest instead of both interest and principal. With the loan range and interest rate after XXXX years the interest is basically paid for but on my credit report they have reported I have not paid anything in over a year which is hurting my credit. I have all the records to show from them as well as on my side that I have been paying the set amount or more each month but they are not reporting that this has been paid. They are reporting I am only paying interest. My loan agreement does not say anything about any penalty or interest payment if you make more than the regular payment. Based on calculations they are incorrect on it all and I should be ahead by several months. This needs to be fixed immediately. I have spoken to them about fixing this issue as they keep calling wanting payment, when I have been paying. It clearly shows on the report they sent that I have been paying but they keep saying I haven't. You can not take someone's payment and put directly to interest and never pay down the principal. I need this fixed along with my credit immediately.

I purchased a XXXX from XXXX & XXXX XXXX on XXXX/XXXX/XXXX. The financier was a company by the nae of Carmel Financial who approved a revolving open ended charge account. On XXXX XXXX, XXXX, I received a letter from Carmel Financial notifying me that Carmel Financial Corporation Inc has sold my account to Aqua Finance and that the account has changed to a close ended, simple interest account. Shortly after that notice, I received a second notice from Aqua Finance notifying me that my account would be sold AGAIN to a third company - where the terms and conditions of the original contractual agreement would be changed again if I did not respond within 30 days of the notification. I called the number provided and stated that I did not agree to the second sale. During this same time I began receiving collection calls from Aqua Finance about an annual {$30.00} fee? Aqua Finance has been unable to reproduce a copy of the verbiage where I agreed to pay the annual fee. Now I am receiving late fee charges on statements for not paying the fee. I have never missed a payment at this point in time. As a consumer and a banking professional - Aqua Finance has conducted their business in an unethical manner at my expense. Transferring the original debt from company to company, all while changing the terms and conditions of the original contractual agreement to benefit their bottom line at the expense of customers. I recently paid off this account, so as far as I know, I do not owe anything. When I logged into the website, it still shows that my next payment is XX/XX/XXXX. My records show I am owed {$92.00} in overages. I asked how to retrieve that additional cash, but that too was ignored? I asked them if I can have that extra mailed back to me? It is disturbing that my account could be paid off, and they still take money from my account. Furthermore, there is no way to stop the autopay on the website. Customers are directed to reach out to them, which I diid, but was subsequently ignored. They are now impacting my ability to pay my mortgage on time by taking money no longer owed to them. On XX/XX/2017 I purchased an XXXX water treatment system at a cost of {$6600.00} from an XXXX salesperson. I paid {$3300.00} from my credit card and the remaining {$3300.00} was financed through Aqua Finance Inc. The loan was offered at 0 % interest rate if paid in full within 12 months of the initiation of the loan. On XX/XX/2017, I created an autopay schedule at a rate of {$270.00} per month so that the loan gets paid in full within12 months. The electronic system of the Aqua Finance Inc. did not accept or confirm this autopay for $ XXXXmonth. But I assumed this was accepted by the system as it was shown on the screen after submission. Unfortunately, I have lost the screenshot of that page. Afterwards, Aqua Finance has been charging the minimum amount due, {$83.00}, each month which I did not have noticed due to my assumption that it was getting paid in full within 12 months. As a result, I have been charged 15.78 % on the initial amount of {$3300.00} for 2 years. The total interest that Aqua Finance is claiming is {$1000.00}. Had my autopay been accepted by their system, I would not have to pay any interest at all. I think their system is designed to reject payments that are scheduled to avoid interest charges. I hope the CFPB will involve an expert IT auditor to investigate their system so that customers like myself are not victimized in future.

This company refuses to let us into a hardship program, all while violating our rights. Because of XXXX and the microchip shortage, I was forced to leave my position as it was costing me money to work. Throw in my grandmother is in hospice care. Which me and my wife do provide her money to pay for rent, and other services related to her needs as POA for her, its been a huge financial burden. How is that going to help our situation? It will make exponentially worse in the long run, we asked for a Financial hardship, they said after reviewing our current income that we cant be helped. How can that be the case? Were struggling to pay for a WATER SOFTENER when my grandmothers meds are way more important then some scummy Finance company getting its money. They keep asking for detailed records of our Finances and other things that are well without the scope of normal. I am set up with Auto Pay using the 3rd party service I was given by the creditor at the time of opening my account. Last year the auto pay was set up but didn't get paid due to the setting of the 3rd party system. I called once I noticed it was never paid and made the full payment and the person from the 3rd party company rectified their Auto Pay system but at this time it was now showing as a 30 day late. The 3rd party company said I must speak with the creditor to correct the reporting but the creditor didn't help due to it being paid late. This year my wallet was stolen along with my debit card so I created a new bank account on the Auto Pay prior to the payment being taken out for the month. According to the creditor someone on the 3rd party servicing system ( Bay Finance Company LLC ) cancelled my payment for the Auto Pay. I can not get anyone to tell me who cancelled this payment. They never notified me that it didnt go through on the new bank account I set up and when I tried to speak to someone for details my voicemails were not returned. I think it is horrible that a {$75.00} per month account that has been on Auto Pay for years is putting 30 day lates on my credit report when I have never avoided paying this creditor. I contacted them after about 5 or 6 months, and they some kind of excuse then started sending them. Then they stopped sending my statements once again, so I contacted them again and they started sending them again. Now they have stopped sending my statements once again, so I contacted them today, The woman on the phone told me that because I am on auto pay, that I do not get a monthly statement. This is just plain wrong, because everybody should get a monthly statement for their loan, and this should be the law. I am hoping that it is the law. I want this this lame finance company to do the right thing, and provide me a monthly statement for my loan each and every month like they should. Letter to XXXX XXXX I submitted a letter to the credit card company XXXX XXXX on XX/XX/2021 requesting a refund of the monies paid for a product ( security doors from XXXX XXXX , XXXX located in XXXX, MD ). I submitted a letter to XXXX XXXX on XX/XX/2021 and made several phone calls to the company regarding the dissatisfaction of the product and lack/no response for service from XXXX. A formal investigation was requested with no results of follow up from either company. I have disputed directly with the creditor ( Aqua Finance ) REGARDING AN ERRONEOUS Account they have been reporting on my credit report for over 1 year. I opened 1 account with this company and after disputing it with them directly. They claimed to have done an investigation and verified that all information is correct with the credit bureaus, when it is not. They also fraudulently opened a " new account '' claiming to have " re-booked '' an older account but with new terms and conditions which I DID NOT agree to. They fraudulently opened a second account nd began reporting it to the credit bureaus. You can see in the second letter attached dated on XX/XX/XXXX, THEY ADMITTED TO THIS FRAUDULENT activity. The account reporting for both are in violation for the FCRA and as consumer they have prevented me from getting a mortgage I believe because the CRITICAL Metro2 fields are non-compliant. I obtained this loan to construct a pool at my home. We only had this loan for a couple months before the home was sold and the loan was paid off. The title company who performed the closing contacted Aqua Finance and obtained the ten day payoff. The payoff was mailed, overnight mail within the ten days. When they received the payoff, they stated it was {$160.00} short and began harassing us for the difference. This account was paid off more than 9 years in advance and now they are reporting I was more than 90 days late on my payment. We paid them the additional money even though we did not agree with it and when I contact them and ask them to remove the late payments from my credit report, they are extremely rude and always tell me that I cost them money because I paid the loan off early. I believe that I am being punished both by the additional money I had to pay and the derogatory mark on my credit report because we paid them off early. Before we paid the additional money, I was getting almost constant calls and emails harassing me for the money. They were even calling my childrens ' phones. According to my review search of them, this is a common practice of Aqua Finance. We had no choice but to pay them the additional amount owed to stop the constant harassment.

If at any time I was notified by Aqua finance that a lien would be placed, they used misleading verbiage. XXXX XXXX XXXX claims Aqua deemed it necessary to lien because the loan amount was over {$25000.00}. I was never informed or notified of intention to lien. Aqua refused my request to review the phone call of myself and Aqua authorizing the transaction and what was recorded. I specifically asked and clarified no lien on the call. On XX/XX/2018, I acquired through a company called Aqua Finance , Inc 3 items for my house, a water filter, a water shower and an air filter ; I signed a contract with them that said I have 3 days to return the items. My bank information was given to them and I authorized them to proceed with automatic debits for the payment of these items. The problem is that within the 3 days of the contract, I didn't have any problems, but about a week later, the water that came out of the filter, had a bad tasting and smelling water. I called the company and they said I have to change the filter. I told them the filter is supposed to be brand new, I shouldn't have to change the filter yet. They told me to contact the manager but he was not present at the moment. With that experience, I didn't want to open the box that contained the second item, the air filter. I got a distrust feeling regarding this Company. I emailed the company, explaining to them my problem with the water filter and offering to return the items because I didn't want to keep paying a big amount of money for low quality items. I financed my water softener through Aqua Finance Inc XXXX XXXX XXXX XXXX ( hereafter referred to as Aqua Finance ). For this, a credit account was opened. I received an invoice on the mail and decided to send them a check for the total balance listed on the invoice. The check I sent in was received by Aqua Finance before the listed due date, and even before the next invoice was generated. The following month, I received another invoice for interest that had accrued. After calling Aqua Finance to understand what happened, they explained that the amount due is only valid as of the day the invoice was printed, meaning that the listed balance is not correct even the following day. This seems to be an unfair and deceptive practice. I was told that the only way to pay off the account was to call in and get a payoff quote. When I asked what would happen if I never called, but continued to pay via invoices, I was told i would be paying interest indefinitely. To require someone to call to get a true and accurate payoff is unfair and deceptive, as well as potentially discriminatory to individuals with XXXX. When asked if they would waive this unfairly accrued interest, they refused. I have not gotten any resolution with Aqua Finance.

Aqua Finance marked my account as 30 days late in XX/XX/2023. From XXXX XXXX XXXX Aqua Finance was a Line of credit which I signed a contract as and I was make more than the minimum payment often times covering more than one months payment. Then in XXXX of XXXX they closed that account and opened a new account as a revolving credit without my approval. I was still making more than the minimum payment. I have documentation that shows on XX/XX/2023 I paid {$150.00} which was XXXX months payment and XXXX payment. Then on XX/XX/2023 I paid {$300.00} which was XXXX monthly payment and XXXX monthly payment. So as you can see I was never late. When I spoke to the costumer service rep on the phone today, XX/XX/2023, the rep did not listen to what I was saying and talked over me. When I asked to speak to a manager he put me on hold for 20 minutes and came back and told me that no manager was available to talk to me. He did not listen to what I was saying as I tried to explain this. If I was late I should have received emails with my statement saying late since I am paperless, I never received anything stating that. The company Aqua Finance is committing fraud. I had an account with this company over 8 years ago. They installed a water softener in a residence that I lived at. payments to this company were made for three years. due to an extreme hardship loss of work I lost this residence to the bank to include items in the residence. Aqua finance was listed in the court documents given a time limit and was notified to pick up there property. I am currently trying to clean up my credit and found out that Aqua Finance is deliberately and intentionally committing fraud. what they are doing exactly is manipulating the credit reporting system by claiming my account has changed or shown activity when it has not for over seven years. For example I was recently informed by XXXX that my account with aqua finance changed from a collection status to 120 days late which is fraud. no type of payment arraignments or status has ever changed on this account since 2005.This happens every month which will not allow the account to ever show inactive. what this does is never allow the debt to age properly allowing the consumer to remove the debt., all three bureaus will have proof of this fraud am sure I am not the only one this is happening too.

I was behind LAST YEAR on a personal loan for home improvements ( new windows ). I caught it up by making over {$3000.00} in payments on the account. I noticed I had not received a new statement in a while, so I reached out and inquired ... as I was trying to see what the actual balance was. I should also mention that I have made the monthly payments AND THEN SOME since this time. After I made the large payments on the account, they apparently sent it to collections... which I NEVER received any communication about. I reported this to you. They then retaliated by reporting that the account was not up to date on credit reporting ... even though the account IS up to date... they are just not reflecting that and are refusing to do so. This is clear retaliation for me reporting their illegal practices- and you closed the complaint at their repsonse! I'm shocked by this- but they are now digging in and retaliating by trying to make my credit suffer even though I have made MORE than the required payments since late XXXX. I purchased kitchen cabinet remodeling services through XXXX XXXX with the contractor being doing the work as " XXXX XXXX XXXX XXXX '', as a revolving credit account which was assigned for financing to Aqua Finance , Inc . I recently applied to refinance my home and was informed that Aqua Finance , Inc. is showing up on my records as a mortgage with a home improvement lien against my property. My loan payments are due the XXXX of every month and for convenience I chose automatic payments. I finally read XXXX of my statements and realized the balance wasn't going down. Around XX/XX/XXXX I spoke to XXXX from Aqua Finance resolution department to discuss interest fees 13.99 %. I found out that out of the {$650.00} I pay every month only {$100.00} is being applied to the principal balance of {$47000.00}. I've had the loan since we started building our pool in XXXX. I spoke to XXXX about refinancing the loan and she said that it wasn't an option and that interest had accrued since before the pool build was completed. So it seems like I'm just paying back interest and the loan will never be paid back if only {$100.00} is being applied each month to the balance. I asked her if I could pay half {$320.00} twice a month and she sent me the link for Pay Near Me so I am able to do that. However, my husband began getting calls that we were behind on payments and they started charging a {$10.00} late fee. I called today XX/XX/XXXX and was told the customer statements are just estimates or averages of next months billing charges. The person I spoke to emailed there internal statements which shows all or at least a majority of all my over the minimum payments they apply towards interest. On XX/XX/XXXX a minimum payment of {$90.00} was paid on time and they charged me {$7.00} interest, on XX/XX/XXXX I made a {$100.00} payment on time and paid as extra {$10.00} above my minimum required payment of {$90.00} and I was charged {$11.00} in interest? All amounts over the minimum required payment are legally supposed to go to the principle, and the statements have to be correct, they cant be a estimation or a guess, none of the amounts on any of these statements makes any sense. I feel like there is something shady going on, and if its being done to me than its being done to everyone, and according to other customers in XXXX this company is doing alot of illegal things. Also the customers statements say one name for the company and the internal documents say a different company name. Paying for the system was to be financed through a 12 months same as cash promotion. The finance company is Aqua Finance XXXX XXXX in XXXX, WI. On XX/XX/XXXX, I had n't received any information from Aqua Finance and I was curious when my first payment would be due. I called the finance company, spoke to a woman named XXXX, and was told that my first payment of {$530.00} was due XX/XX/XXXX. Today I discovered, after intense inspection of the contract, that the contract states that the 12 months begins on the day the contract was signed. This makes the term 10 months, not 12 months. If I continued making payments as instructed by the person I spoke to I would have been libel for over {$1100.00} in interest payments come the termination of the contract. Both Aqua Finance and XXXX is guilty of deceitful and unethical practices in misleading people in believing they have more time to pay then they actually do. My husband is in the military and we were told we qualified for a special offer because of our credit and his status. We went through a copy called XXXX XXXX XXXX for a pool loan. The total cost of the project was {$50000.00}. We did not have all of the funds and only needed a loan for {$15000.00}. When we started the process we were told it was unsecured and nothing will be attached to the property. XXXX sold the loan to Aqua Finance which is who I signed all of the loan papers with. I read the loan documents before I signed and nowhere did it say it they would file anything against my property via a lien or a XXXX filing. I am refinancing my home and was told they filed a XXXX on my whole property. I was concerned and called Aqua to see what was going on. I was told that 's what they do and have been doing that for ever. I asked them where in the contract I signed, it stated that they were filing a UCC on my property. They referred me to a section of the contract under Additional Provisions ( B. ) Security Interest. I read it and know where under that section did it say they were filing anything against the property. Hello, In XX/XX/XXXX I entered in to an agreement with Aqua Finance to finance my bathroom remodeling through a 3rd party contractor. All is well, overall with one exception. They refuse to remove my method of payment on file citing they only process payments between 2-5 PM each business day. Thus the need to keep the entire card on file. They say it is to protect in case of something not processing correctly but does not offer any option for one time payments online for its customers to enter. I do not want my credit card information saved on file but their limitations in payment processing nor offering any options for customers to process as they choose online, force my info to be available. Im seeking resolution here. It does not stop 10 phone calls per day at all hours from happening when a payment is late even a day. Let me also add that if paid a day late the next months charges are already added the total amount due forcing you to pay the next months bill early or having to call or answer one of their 10 calls a day to process. In addition to being denied credit, this company filed a deed notice against my property. I have not been able to refinance my home without this credit/debt showing against my property. They have used predatory lending practices to effectively lock me into this debt. I tried to contact them to settle the debt and they refuse to offer a fair settlement. We were offered a free in home water test and told we needed a filtrations system to clean our water. The systems were very expensive so the company offered financing. We were lied to about the products and what they would do. We were lied to about the warranty and it's transferability. We were told that we would get all our paperwork after the product was installed. Once the product was installed and financing went through we found out they lied to us about everything so we had the water tested again and found out the water from the filtration system is dirtier than the water from the mail line. We requested a refund. The company wants to charge us again for having the product picked up and will not refund the credit the finance company. It is so complicated that I can't even accurately restate it but they refuse to issue a whole refund even though we were clearly lied to to get the equipment and then knowing the equipment is not even working as promised. In XX/XX/2019 XXXX by XXXX convinced us to get new windows throughout our entire home. They said they would help find a company we could finance this through. I was nervous about getting a loan I wanted to make sure we didn't get taken advantage of but the guy told us it was a good deal. We ended up with Aqua Fiance. I've tried calling them before and asking if we could re-fiance or anything and they said no. I was scared of hurting me credit. Aqua Finance is taking auto payments from my bank account for an account. They auto debit $ XXXX. Some promo ended which increased the payment to {$36.00}. They did not send an email to let me know of the change. They say i was sent a statement via mail, and that may be the case however all previous statements are to remind me that an auto debit is about to occur. I would have no reason to believe this would be any different. In the past, they have called and emailed me when my auto debit failed. This time, Aqua Finance reported me late to all credit bureaus, even though they are receiving auto debits on time for the original {$24.00} amount they set up as recently as XXXX of this year. Aqua Finance has placed a lien on my property for a XXXX XXXX. This has been reported to CFPB before and was removed from my Credit report after filing a police report. We have a loan financed by Aqua Finance. I received one letter from them prior to our first payment being auto drafted from our bank account. That letter said we would receive a statement so we knew what our loan balance and such was, along with account information so I could register for online access. To this day, I have not received anything more. I have never gotten a statement yet they have taken 2 payments out of my bank account. I have tried 10 times to call their 800 # on the letter and get disconnected or it rings endlessly with no answer. I can not get online access without the information they say they would send and whats more important- I should receive a monthly statement and havent gotten a single one. I researched extra ways to reach them online and all I see are pages and pages of XXXX complaints about similar things. It seems they are not upholding their obligations as a lending institution. This issue is with Aqua Finance , Inc. at aquafinance.com. Customer Service # XXXX. They are a creditor of mine for new windows in my home. I'm not getting paper statements and I can not access my account online for most of 2021. I spoke to XXXX on XXXX/XXXX/21 who assured me that I would start getting paper statements again and that she would NOT be able to fix the online access problem. I got a consumer loan for new windows through Aqua Finance. I got behind on payments last summer and made up for late payments in XXXX. In fact, I made over {$3000.00} in payments in XXXX alone. Aqua Finance determined that I didn't have enough equity in my home to qualify for a home equity line of credit for the project so the offered an unsecured revolving line of credit. Aqua Finance still continues to report the debt as an unsecured debt to the 3 major credit bureaus despite securing the debt with real estate. They told me that they will setup up the security system and all I need a copy of my check and they will be able to setup up my services. I had a consumer installment loan from Aqua Finance, LLC which required that I make payments online through a website they established. Without any advance notice or warning sometime between the time I made my XXXX payment and my attempt to make my XXXX payment, the company suspended the website and I was unable to access my account. I explained to them i did not have the money due to financial hardship. I had a company contacting my mother called Aqua Finance in regards to a payment. When they asked for her, I informed them that she unfortunately passed. This account was opened by another individual while this company established an account fraudulently in my name because the address is the same. The lending institution then sold the account to another institution and closed the account, showing paid in full only to report the debt on my credit as late after 36 months of being closed. We bought a water softener in XXXX of 2015. The loan was for {$6400.00} for 6 years. We made minimum payments. The first year we paid $ XXXX/month with a 5.9 % interest rate. The following years until the present day we have paid $ XXXX/month with a 13.99 % interest rate. Year-to-date, we have paid {$4100.00} and only {$1400.00} of that has gone to the principal amount. {$2600.00} has gone to interest. There was one month where only {$1.00} went to the principal. Their customer service has accepted blame and acknowledged that they messed up and still have not removed or adjusted the reports. My husband and i had a water softener installed, we were both working at the time and have paid monthly payments on time for 2 years so when my husband lost his job for medical problems and my job cut everyone to part-time we fell back on payments and asked the company ( XXXX Finance ) to pick-up and take away the softener as we were not going to be able to keep up the payments. They said that was not possible and have frequently calling and harassing me and him on our phones and now my workplace. i have been embarrassed at my workplace and reprimanded by my supervisor. The account is paid in full NOT a charge off. Aqua finance sent a Paid In Full letter reflecting the {$6600.00}. But has yet to update the credit reporting by removing tje charge off. Because of their inaccurate reporting my credit score dropped 57 points. The amount they claim is paid on my credit report of {$5100.00} is also inaccurate. According to the Servicemembers civil relief act Your lender cant add the amount of interest above 6 percent back into the loan later on after you leave XXXX XXXX. My lender supposedly changed my interest to 6 % but it shows on my bill that its 9.9.
