My position is legal based upon sections of the Fair Credit Reporting Act as well as the Fair Debt Collection Practices Act. These laws are to make sure that a level and fair playing field exist to protect American consumers from abusive reporting procedures on credit reports, as well as illegal and deceptive collection practices. I stipulate at this time that are no condition am U making an identity theft claim or accusation, so I demand that policy be adhered to by all creditors and respective credit reporting agencies. Amended consumer rights Fair Credit Reporting Act Public Law 15 U.S.C. 1681 : https : //www.consumer.ftc.gov/articles/pdf-0111-fair-credit-reporting-act.pdf Fair Debt Collection Practices Act : https : //www.ftc.gov/enforcement/rules/rulemaking-regulatory-reform-proceedings/fair-debt-collection-practices-act-text On these subscribers that are reporting the affixed information, I am requesting full validation such as, original transfer rights to collect, confirmation of legal timeline to report on credit and/or collection procedures, validation of licensing requirements, posted bonding requirements, oversight on monthly payment histories, proper subscriber agreement compliance with credit reporting agencies, and overall compliance with all Fair Credit Reporting Act and Fair Debt Collection Practices Act bylaws as mandated by federal laws. If all of these requirements are not in order, then I have the legal right to request the deletion of this tradeline accordingly. I especially desire compliance under the 84-month timeline for deletion of negative information, with the deletion of the account details altogether. My dispute is quite specific in the exception area posted below : 605. This complaint is in response to the recent reply of case # XXXX submitted on XX/XX/XXXX with a response on XX/XX/XXXX which I have attached for reference. First of all, this company stated that they sent me mail on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX with no response about a collection placed with them on XX/XX/XXXX. This company stated that they sent letters to an address that does not belong to me nor have I ever lived at the address they stated they sent the letters to. I have attached my driver 's license to show what my address would have been at the time they claimed to have sent the letters and you will clearly see that if they did indeed send such letters then they went to the wrong address. So not only would I have never received said letters which is a problem in itself, the bigger issue is that since they sent these letters to the wrong address then my medical information has been exposed because who knows who was on the receiving end of those letters. This is a violation of my HIPPA rights. No one should have access to my medical records other than the providers who treated me. This company also stated that they called me multiple times with no answer. So they basically admitted to harassing me about this alleged debt since I did not give them permission to call me pursuant to 15 USC 1692c ( a ). This company states that they received my request for validation on XX/XX/XXXX and that they requested an itemized statement from their alleged client. They then state that said statement was mailed out on XX/XX/XXXX to the same incorrect address that the other 4 letters ( previously mentioned at the top ) were mailed to. So instead of sending said statements to the address listed on my initial complaint or the address listed on the certified mail return receipt, they sent it to an incorrect address again, which exposed my medical information again. So at this point my HIPPA rights and right to privacy has been violated 5 times. They state the itemized letter was allegedly returned to them and that they have now sent said letter certified mail to the address they should have sent it to the first time if they really wanted me to have the documents validating this alleged debt. So as you can see I never got the request for validation of this alleged debt so that is a violation of 15 USC 1692g for furnishing an unvalidated debt. This company also harassed me as they said in their own words by calling me multiple times without my permission pursuant to 15 USC 1692c ( a ). This company also took a private matter and made it public by reporting it to consumer reporting agencies, so they are advertising this alleged debt to coerce payment which is in violation of 15 USC 1692d ( 4 ). Pursuant to 15 USC 1692c. ( c ) ( 2 ) I am invoking my specified remedy as a consumer, and the original creditor I am demanding that this account be zeroed out immediately and that this account be immediately deleted from all consumer reports.

COMPLAINT BASIS : I am having SEVERE issues with Collection Companies that have been attempting to collect on debt I am NOT LEGALLY RESPONSIBLE to pay for myself. The debt may have even already been PAID by the ACTUAL Responsible Parties involved. MY NAME/ RECORDS should NOT be involved in this debt, regardless. The Collection Companies involved have been repeatedly notified via multiple Credit Reporting Disputes & other CFPB Complaints of this situation & REFUSE to correct it. Even worse, now, on at least one of my Credit Reports they have actually RETALIATED against me for filing a Fraud Dispute with Credit Reporters & the CFPB against them, by literally DUPLICATING the SAME Collection Account, originally posted under a DIFFERENT Collection Company name ( which they themselves may even own ), IMMEDIATELY AFTER it was CLOSED under the original Collection Company Name pursuant to a CFPB Complaint, by using literally the SAME Account Number, Amounts, Original Creditor, etc. but strategically & intentionally ALTERING just the filing date numerals to DEFEAT the Credit Reporting Companys computers from identifying the clearly intentional duplication. The Credit Reporting Company involved even identified this. This Account is one of these RETALIATORY DUPLICATIONS. These Companies clearly believe they can VIOLATE US Federal and/or State Regulations at will, & also attempt to RETALIATE AGAINST/ INTIMIDATE CONSUMERS who try to get these Collection Companies to comply with US Federal Statutes XXXX Therefore, I am filing a Federal Complaint against the Companies involved, to make the US Federal CFPB & Other Federal Agencies, such as the US Department of Justice, aware of these Collection Companies improper, unlawful, threatening tactics, in order for ALL appropriate Federal Corrective Actions to be ENFORCED against them, so ALL Consumers are protected from these Collection Companies. I reserve ALL my Rights to also file Legal Action/s with the State Attorney Generals Office & personal Civil Law Actions ( ie. Lawsuits ) as well. BACKGROUND : I suffered a severe fall with permanently disabling injuries ( including an XXXX ) THROUGH NO FAULT OF MY OWN at a Restaurant due to a defective stairstep, No Warning Signs, & Lights being turned off. The Restaurant involved & their Liability Insurance Company are LEGALLY RESPONSIBLE for paying ALL my Medical Bills from the Incident as part of the Settlement to Avoid Lawsuit against them. All the Bills were Submitted to these proper Responsible Parties by my Attorney, including the Bill/s in question. Bills were clearly paid by the Insurer as a result. Why this Bill was not credited paid is due to ERRORS at the Original Creditor involved, who sold the Account. NOT me. Whom It May Concern : I hope this email reaches you in good health and spirits.

Back on Friday, XXXX XXXX XXXX, I received a FICO monitoring alert via XXXX XXXXXXXX monitoring subscription that a collection account had been reported to 2 of my credit reports. After investigating this unknown account further and gathering documentation and details, I was able to submit this information to XXXX XXXX XXXX County ( the original creditor ) who apologized for this mishap and withdrew the account from Security Collection Agency ( SCA ) .Once the account was withdrawn, I reached out directly to SCA to ensure this information was deleted from my credit reports. XXXX XXXX was deleted w/o issue ; however, XXXX to date, still has not removed this account. I disputed this account 3 times ( XXXX, XXXX, & XXXX ) with XXXX in which they came back stating that the information reporting is accurate. Again, I reached out to SCA who indicated that they received the dispute from XXXX ( electronically ) and replied instructing them to delete the account each time. However, XXXX continues to report the investigation results of the information reporting is verified and accurate. So it appears that SCA is blaming XXXX and XXXX is blaming SCA. So I submitted another dispute to XXXX, this time including the documentation stating that the account was withdrawn. I even sent the email correspondence between myself and the Deputy Director of Administration which clearly states that they have instructed that this be removed. For whatever reason, XXXX continues to report this account as being valid. I have attached all of the same documentation that I submitted to XXXX.

I feel that XXXX is again, engaging in illegal and unethical practices. As a financially responsible consumer with a spotless credit history, this is mistake is costing me. I am set to apply for a mortgage in the next few weeks, and this is detrimental to this process and will cause extreme delay. I have done everything right, and yet, I am the only one being impacted. No matter how many times I talk to XXXX, they send me to inviduals in another country that reads from scripts. I asked them if they even read the documentation, they stated they dont have access to look at that information. I then asked to be transferred to a US based rep whom also told me the same thing. They also stated that they had not received any delete requests which I find odd in that I had no issues with XXXX. The US based representative indicated that I need to talk to their business office and provided me with the number. However, when I called, they stated they do not talk to consumers or handle consumer personal credit files. I am truly at a lost here and am not sure what I need to do. As a result, I am reaching out to your organization for assistance.

XXXX XXXX uses criminal thuggish tactics in an attempt to collect payments because I fell behind in my car payments. Their tactics have caused me and my mother unreasonable harm. For example, last week on Monday XXXX XXXX, 2015, at XXXX XXXX, an agent of XXXX XXXX, XXXX, XXXX XXXX XXXX XXXX, XXXX Texas XXXX, repeatedly called my mother 's home. In Particular, one person who called, identified herself as XXXX XXXX, she pretended to be a law enforcement officer by stating that " she was with the investigation unit. '' She also disclosed that she was trying to reach me because they wanted me to turn in the car implying that it was a criminal violation to owe money on a car loan. That is bad, because it appears to be a violation of my consumer protection rights and a UDAAP. It is certainly an unfair practice that puts the bank and its depositors at risk because of possibility of claims and damage to their reputation - especially if XXXX XXXX takes interest. As I said, that was bad, but it was not as bad as it gets. Later that night or rather in the middle of the night at XXXX XXXX the next morning, another agent of XXXX XXXX, XXXX XXXX XXXX of XXXX PA, actually came to my mother 's house. He pounded on her door and woke her up in the middle of the night! Imagine this : she looks out the window and sees someone with a flashlight in her side yard and backyard - and then actually pounding on the door in the middle of the night. She opened the door to a man in a uniform with stripes on his pants who identified himself as from the " PA Investigative unit! '' saying he was looking for XXXX XXXX. She said " for what? '' he repeated the question and then said he was looking for XXXX 's Dodge Dart. My mother told him she was calling the local police. She then came back to the front door with her phone in her hand and asked for his name and rank, He handed her a paper and said " You are served!!! '' She was scared to death, he appeared to be armed, but as she said she was calling the police he quickly left. He tore down the street out of town and went back to XXXX, Pa where we believe that operation is located. My mother was confused and did not call the police. She then looked at the paper he gave her and then she read that It only said " Sorry I missed you. '' I have the paper for you to review. But their tactics made her believe it was a legal process. Again, what government agency allows people to pretend to be law enforcement and knock on peoples ' doors in the middle of the night? Finally, I tried to catch up on arrears because of this intimidation and then they told me that they would not take the back payments that I had to pay the balance in full plus additional charges for their thugs. Ive had a charge off with XXXX Bank credit card thats been on my credit report since XXXX. Problem is, not only do I not know how this account got on my report, but neither does Applied! Yet it remains there. Finally, today, fed up with the negative mark on my credit reports, I decided to give it another shot and call them. Ive already disputed this with the credit bureaus several times, but each time this company validated that the information they reported was correct. I asked today l, XX/XX/XXXX how much it would cost to just pay them to get rid of this, even though I truly believe its fraud. They were actually super nice and friendly, but after talking to the higher ups in the company, they said they couldnt accept a dime from me because they have NO record of me ever having an account with them. Thered be no way to apply it to my account because there is none! I asked them so if it actually were my debt and I wanted to pay it, how would I? They stated that I couldnt have. That thered be no way for them to accept money from someone theyve got no record of owing them. I then asked the woman, XXXX, ok, well then what is it youve been using to verify my account when you reply to the disputes XXXX keeps sending you? She stated that it wouldnt be possible for them to verify something that doesnt exist in their system. I then asked is it possible this mystery debt was sold to a collection agency? She stated that they only do in house collections, and that even if it were sent to an outside collector, they never get rid of that information. So naturally, my last question was well can you remove it from my credit file? She stated that shed love to since clearly this is affecting me XXXX and my ability to purchase a house as the lender requires it to me removed, even if I must pay a debt that isnt mine. ) she stated unfortunately, shes not able to reach out to the bureaus and ask them to remove something she cant locate, and that my only course of action would be to dispute it again. Ive done this. At least 3-4 times with no success. I then called Experian, the XXXX reporting these bogus charges. They said the same thing, the only way to remove is to dispute it. I can not have any open disputes while purchasing my home. Its my first home and Ive got a family of XXXX to care for. Im now stuck with a horrible mark on my credit that no amount of money could even help, because I do not exist in this companies system, yet they continue to report it, and XXXX continues to allow it. Yet my family gets to suffer the consequences of this clear case of fraud. All possible reports pertaining to this have been filed. I await a swift response so I can proceed with my home purchase.

Dear Consumer Financial Protection Bureau, I am writing to dispute the debt collection efforts by Applied Business Services , Inc. for an alleged debt that I do not owe. Furthermore, I have learned that this collection agency is not licensed to operate in the state of Florida, which raises serious concerns about their compliance with state and federal laws. Despite my repeated requests for information and validation of the alleged debt, Applied Business Services , Inc. has failed to provide me with any evidence or documentation to support their claims. Furthermore, I have recently discovered that this collection agency does not hold a license to operate in the state of Florida, which is a violation of state law. I have also been contacted by XXXX XXXX XXXX XXXX, who claims that I owe a debt for services rendered. However, XXXX XXXX XXXX XXXX has been unable to provide me with any documentation or evidence to support this claim, other than a digital copy of my signature. I do not recall signing any agreement or contract with XXXX XXXX XXXX XXXX, nor do I have any record of receiving the services for which they claim I owe a debt. Furthermore, I believe that it is highly irregular and questionable that Applied Business Services , Inc. is attempting to collect a debt on behalf of XXXX XXXX XXXX XXXX, who can not provide any documentation or evidence of the debt other than a digital copy of my signature. This company keeps trying to say my identity was stolen. My identity was not stolen. There are many XXXX XXXX. I am just one of many. The address on file for this debt does not match my address and has never matched any of my addresses. I have never lived at this address. I sent proof to this company that I never lived at that address. Yet they are still trying to claim that my identity was stolen. My identity was not stolen. They have the wrong XXXX XXXX. There is a charge on my credit report that is not mine. It is an EMS charge with XXXX XXXX XXXX XXXX XXXX XXXX. I contacted the EMS company and told them it was not mine. The EMS agency confirmed the address was not the one they had on file and removed the charge from my credit report. However, the charge has now reappeared. This time I contacted the Collection Agency ( Applied Business Services , Inc. Security Collection Agency ) and told them it was not my account, and I provided them with a copy of my XX/XX/XXXXand XX/XX/XXXX XXXX showing my address, showing that since XX/XX/XXXX I have never lived at the address that the EMS company had on file - it is in another town! I asked them to remove this from my credit report because it is not my account. The credit agency did not do that. They simply sent my current address to the EMS agency. I closed my Applied Credit Card account with XXXX balance on it and the next month, they ( XXXX XXXX ) sent {$16.00} to pay. I refused to pay them the money and then the next month, they added as they so called a late fee of {$35.00} even though the account was closed. I called them, but I did not really remember in which month, but it may be in XX/XX/XXXX. I discussed the issues with one of their workers. She told me to pay the {$16.00} and the late fees of {$35.00}. I had to pay that amount. The next month, they sent me another late fee of {$35.00} even though the account had been closed. Again, I refused to pay the so called late fee because I did not use the card to purchase any goods. In XX/XX/XXXX, they called me to pay their money and I said no, but the lady convinced me to pay the money and I paid {$77.00} out XXXX. She told me that if I paid the {$77.00}, they will close my account. This was the reason that made me paid the {$77.00} so that they will close my account. I'm a victim of identity theft. I've been attempting to recover the damage and resolve the issues on my credit report by calling, faxing, and uploading the required documentations to the bureaus as requested by their agents. But the issue is that the website never completely lets me finish the account setup with usual errors ( ie " failed security check '' or " site error, try again '' ) on multiple occasions. Contacting IT department of the bureaus lead to nothing as the agent would " open a ticket '' and no resolution was reached. When the site actually does let me make an account, I can't submit any disputes due to further glitches and contacting IT again leads to nowhere. Last option remains to call their representatives and proceed to dispute through that but when I do call, the reps are too lazy to even properly initiate any disputes. FTC and police report numbers are not taken over the phone and are asked to mail instead. Even after mailing the said documentations over and over again via certified mail and having proofs that the bureau received it, the agents keep denying the receipt and keep hindering my attempts to fix any and all attempts to resolve this drastic information leaks on the bureaus end.

I hav disputed this exact collection with other bureaus and with the company, and XXXX and XXXX both did not receive sufficient enough information to verify. Although, XXXX is still reporting this, and I have requested disputes on this account. It appears to be a Ambulance and/or medical bill. I can not verify the authenticity of this as they have not and legally can not provide that information. So through XXXX, I requested that they receive documentation regarding this dispute, and it has just been completed. So, for one, the only way the representative stated he would verify the account is social and date of birth, although I feel like a victim in the sense of I can not even receive verification, nor have I ever received a bill for this account in question. Also, why would 2 bureas remove the collection while 1 can not? And on top of that, if they did provide patient information ( to include name, date of birth, and social ) and/or documentation, that is a clear violation of HIPAA laws, due to medical information.

There is a charge on my credit report that is not mine. It is an EMS charge with XXXX XXXX XXXX XXXX XXXX XXXX. I contacted the EMS company and told them it was not mine.
