Notice to Cease and Desist This is in reference to the Consumer Report sent by XXXX. While checking my credit report, it came to my notice that XXXX has furnished an account XXXX on my Consumer Reports. According to 15 USC 1692a ( 2 ), the term Communication means the conveying of information regarding a debt directly or indirectly to any person through any medium. As per the literal interpretation Any medium includes any oral, written, electronic, or other medium, which includes nonaffiliated third parties the XXXX major CRAs XXXX, XXXX, and XXXX. Therefore, furnishing of the Consumer Report by APEX ASSET MANAGEMENT LLC will amount to Communication. I demand you Cease and Desist from disclosing my nonpublic personal information to all nonaffiliated third parties, which includes XXXX, XXXX, and XXXX. The provisions of 15 USC 6801 ( a ) state It is the policy of the XXXX that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. Please be advised that I have not given your company consent to share my nonpublic personal information and if theres a nondisclosure clause in your contract/agreement giving you that option to share my nonpublic personal information. I ask that you show me in the same contract/agreement where I can opt out of your sharing of my nonpublic personal information. XXXX5 USC 6802 ( B ) clearing states that A financial institution may not disclose nonpublic personal information to a nonaffiliated third party. 15 USC 6802 ( B ) 1b the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party 15 USC 6802 ( B ) 1c the consumer is given an explanation of how the consumer can exercise that nondisclosure option. The Privacy Act of 1974 ( 5 U.S.C. 552a ) protects personal information held by the federal government by preventing unauthorized disclosures of such information. Individuals also have the right to review such information, request corrections, and be informed of any disclosures. The Fair Credit Reporting Act ( 15 U.S.C. 1681 et seq. ) protects personal financial information collected by consumer reporting agencies. The Act limits those who can access such information, and subsequent amendments have simplified the process by which consumers can obtain and correct the information collected about themselves. The XXXX also actively enforces prohibitions on fraudulently obtaining personal financial information, a crime known as " pretexting. By Definition ; The XXXX Clearly says a Cancelled or Charge Off is income. The reporting of this as debt is inaccurate. 15 USC 1681 s-2 Says you APEX ASSET MANAGEMENT LLC are a furnisher of information to a consumer reporting agency. You ARE PROHIBITED BY LAW to furnish inaccurate information. I demand you to Cease and Desist the reporting of incorrect/inaccurate information immediately! 15 USC 1681 s-2 ( a ) ( 1 ) ( A ) A person shall not furnish any information relating to a consumer to any consumer reporting agency. If the person knows or has reasonable cause to believe that the information is inaccurate. You are hereby put on NOTICE that you are furnishing incorrect/inaccurate information. The lender must file FORM 1099-C and send you a copy if the amount of debt cancelled is {$600.00} or more and the lender is a financial institution, credit union , federal government agency, or other applicable entity as discussed earlier in chapter XXXX. I have gotten a notice from APEX collection agency for medical bills paid long ago. Attached to this complaint are the following : 1 ) XXXX XXXX ' XXXX XXXX billing statement ; 2 ) XXXX XXXX ' Receipt for payment for APEX bill ; 3 ) APEX collection agency 's statement ; 4 ) Health insurer 's ( XXXX 's ) statement showing payments Please note that the receipt XXXX XXXX mailed to me is undated and I ask the CFPB to find out why XXXX XXXX provides undated receipts as a matter of routine practice and policy. My experience of several years is that XXXX XXXX ' billing department is an unmitigated mess. In past years, I called my doctor 's office numerous times to give it the correct billing address for XXXX in this area. Many medical providers here have not heard of XXXX but more have heard of XXXX which seems to be the name that XXXX operates under in this region. After providing XXXX telephone numbers and claims address to my doctor 's office repeatedly, over the phone and in person, I heard nothing for some time. When I later continued to get statements from an out of state billing operation for XXXX XXXX, I also talked to it numerous times. In short, it resisted taking the information I tried to give it for XXXX and it was clear that it had been sending its bills to the wrong address for XXXX. When it continued to bill me for the same bills which had been paid, I gave up and insisted that it contact my doctor 's office which assured me that it had the correct address and billing procedure for Multiplan/GEHA. At this point, the XXXX XXXX XXXX department refused to call my doctor 's office, the very same office that the billing department was sending out bills for. When I asked the administrative person in my doctor 's office about this and asked her to try to contact XXXX ' billing center, she insisted that they were separate operations and I got the impression that the doctor 's office also would not contact the XXXX XXXX billing office. It left me with the impression that even the doctor 's office of the doctor I saw wanted nothing to do with XXXX XXXX ' billing operations. It appears that XXXX XXXX ' billing operations are wildly incompetent and for a long time have simply pushed paper through their offices with little care to their accuracy or truth, so that they can get phony statements to collection agencies as soon as possible. It appears that someone has calculated that there is no " cost-benefit '' to running a legitimate billing operation at XXXX XXXX under the supervision of professional medical auditors and that even doctors in the XXXX XXXX practice know this and want to distance themselves from the billing operations. I venture to say that if XXXX, XXXX, XXXX, military and other federal government health insurance programs investigated the billing practices of XXXX XXXX XXXX XXXX, it might find that it has been swindled out of a considerable amount of money, through falsified billing codes and other activities of routinely falsified financial statements. ( See more about this below. ) Some recent encounters with XXXX XXXX billing operations raises more doubts. Last year when I saw XXXX XXXX again after some time, a clerical assistant in her office wanted to see my driver 's license. I refused to give it to her. She claimed that she wanted to see a photo ID but then when I offered my passport, she did not want it but wanted the driver 's license. Next I offered a photo ID of a university which, although it was expired, had a large photo of me on it. She declined this as well. She ended up not using any of the photo or other IDs I showed her but she kept asking for a driver 's license. I did not provide one to her for several reasons. The notice states that your claim is disputed and validation of the account is required. This notice is not a request for verification of the account or proof of my mailing address, but a request for validation made pursuant to the FDCPA laws. I humbly request that your agency/office sends me valid proof that I am legally obligated to pay you. Please provide me with the below mentioned things : * The amount you claim I owe you * Explain and show me how you have computed the amount * Send me the copies of any documents that prove I agreed to pay the alleged amount * Identify the original creditor * Confirm that the account has not crossed the SOL period * Prove that you're a licensed debt collector * Show me your license numbers and registered agent. I would like to further inform you that if any action is taken ( during the validation period ) which could be regarded as detrimental to any of my credit reports, then I will seek advice from my attorney for lawsuit. I recently received a copy of my credit report after XXXX. I noticed accounts which I am uncertain of and began filing disputes especially for dates I was XXXX. Apex is a debt which I do not believe I owe and when looking for validation nothing was provided but paperwork, nothing included my signature our anything just documents they prepare. So now I am sending the following letter enclosed. XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Apex Asset Management XXXX XXXX XXXX XXXX, XXXX XXXX XX/XX/2017 Dear Apex, After viewing a copy of my credit report, I noticed a collection account placed on my credit from Apex in the amount of XXXX. I am requesting that you allow me to validate the alleged debt. I am unaware of any outstanding medical bills that I possess, and I am seeking the name and hospital/medical provider to which I owe the debt and a detailed break down of the fees that I owe. Additionally, I am allowed under the Health Insurance Portability and Accountability Act ( HIPAA ) to protect my privacy and medical records from third parties. I did not give permission to any of my current or prior medical providers to release any of my medical information to a third party. I am aware that the HIPAA does allows the release of limited information about me but anything more is to only be revealed with the patient 's authorization. Therefore, my request is twofold -- validation of debt and HIPAA authorization. Please provide breakdown of fees including any collection costs and medical charges. Provide a copy of my signature with the provider of service to release my medical information to you. Cease any credit bureau reporting until the debt has been validated by me. Please send this information to my address listed above and accept this letter, sent certified mail, as my formal debt validation request, which I am allowed under the FDCPA. Please note that withholding the information you received from any medical provider in an attempt to be HIPAA compliant can be a violation of the FDCPA because you will be deceiving me after my written request. YOUR COMPLAINT Today on XX/XX/XXXX I received a letter in the mail from Apex Management for services rendered on XX/XX/XXXX from XXXX XXXX and XXXX in the amount of {$130.00}. Stating that they have received my {$30.00} payment. The {$30.00} that was sent to them was for a bill that I had received on XX/XX/XXXX regarding XXXX XXXX of XXXX XXXX, with acct # XXXX However the {$30.00} was applied to XXXX XXXX and and XXXX Acct # XXXX and should have been applied to XXXX. I also wrote the acct # of the bill sent by Apex on the check. I Called the office the office to try and explain, I was hung up on twice. After being hung up I tried again and asked to see if there was corporate office or a supervisor to help resolve this issue, I was told no and again hung up on. on XX/XX/XXXX I now received a new bill from Apex applied my XXXX to another bill that I don't even have proof that is even my bill. I have never received any bills from XXXX XXXX and XXXX # XXXX. I asked in writing for documents of proof for this bill with my signature via mail.I believe that XXXX applied my money to another account that does not belong to me and if it is truly my bill it is out of the statue of limitations and they applied it to the other account to try and show a date after the statue of limitation has run out. On XX/XX/XXXX I was again billed for XXXX the bill that I've already paid on XX/XX/XXXX under acct # XXXX this time they sent the bill same client reference # XXXX same amount but with a different acct # this acct number isXXXX. I believe that I am a victim of unfair practice by Apex Management .I am also Diaputing the debt for XXXX XXXX and XXXX. This is eight year debt and I have no proof that this is my debt.

This is in response to an unfamiliar listing on my credit report. Apex Asset Management LLC sent me a collection letter dated after my account was fully paid and closed. I had paid directly to the hospital rather than to Apex, but called Apex after to notify them that the debt had been fully paid, and they confirmed over the phone that my account was closed on XX/XX/2023. On XX/XX/2023 I received a letter dated XX/XX/2023, attempting to collect the already paid debt. The amount of {$94.00} was paid in full on XX/XX/2023, and Apex was informed of this and said they closed the account the same day. The letter sent to me was dated for XX/XX/2023, and the wording of the letter was alarming. The very first line of communication under the letter head was, " Why are you avoiding these debts? '' written in all capitalized letters. Printed beneath this statement was the following : " Your failure to pay these accounts in full may show that you do not intend to pay them voluntarily. Are there circumstances of which we are not aware? We need to discuss your resolutions options. We have several options available to assist you in paying your debt. If there are mitigating circumstances, please list them below : '' Beneath this paragraph was a blank line to fill in, with further blank lines indicating to fill in information regarding my workplace location and phone number, and home phone number. The implication that I was unwilling to pay and avoiding this debt was mortifying and concerning, and the attached pay slip at the bottom of the letter was a new addition to communications I had received from them until now. I am positive that my debt has been taken care of with the hospital, but the wording of this letter left me feeling shamed and afraid of what they would further do to collect this debt, which I no longer owe.

On XX/XX/XXXX I had a preventative care visit at one of my physicians under XXXX which is fully covered by my insurance provider. In XX/XX/XXXX I was notified that I owed {$50.00} to my physician 's office for the visit. In XXXX XXXX resubmitted the claim to my insurance carrier and advised that everything was resolved. On XX/XX/XXXX I received a collection notice for the same issue now for {$110.00}. I contacted XXXX and was advised XXXX denied the claim due to it being 180 days after the visit and sent a notice to XXXX that they must send an letter of explanation in order for the claim to be paid. I have reached out to XXXX, who advised I don't have a balance or an account in Collections and has asked I forward the collection notice. XXXX provided a fax number which did not work. I have been calling on a weekly basis since XX/XX/XXXX and can not reach anyone, have left several messages and do not receive a call back. Please tell me who I can contact to pursue XXXX XXXX health group legally. I have been going to this office for years and I have always had my wellness visit covered at XXXX XXXX. My last visit I did not see my normal doctor I saw his nurse practitioner who instead of billing my wellness visit as such she decided to bill it as excessive bleeding which I did not have excessive bleeding at all. Some of my medical bills from XXXX XXXX XXXX from XXXX were sent to a debt collection agency - Apex Asset Management. I never received the bills because XXXX XXXX sent them to a non-existent address. I only recently became aware that there was debt outstanding. I have paid all outstanding debt to Apex, but they are still billing me for paid debt. On XX/XX/XXXX, I received a summary of unpaid charges from Apex Asset Management in the amount of {$340.00}. There were three charges : Reference Number XXXX {$300.00} Reference Number XXXX {$19.00} Reference Number XXXX {$20.00} The {$300.00} was previously paid. I sent the company a check for {$40.00} to cover payment for two of the items and I sent them proof of payment for the {$300.00}, including a confirmation number for the payment. I called them on XX/XX/XXXX and was informed that the {$40.00} was applied to the XXXX and that I still had an outstanding balance of {$260.00}. I resent proof of payment for the {$300.00}. Today ( XX/XX/XXXX ), I received a new bill from Apex indicating that I still owed {$40.00}. That is incorrect. They are fraudulently billing me for items that were already paid. These bills were turned over to APEX ASSET MANAGEMENT XXXX. APEX calls repeatedly and hangs up. This deceptive practice is so that you will call them back and they can demand personal information from you to " verify the account. '' They are extremely abusive when you call back and half the time they hang up on you again. Two employees XXXX and XXXX were overtly abusive and rude and informed me that if I did n't verify my personal information with them then the debt would be " referred to legal. '' I attempted to explain the issue with the health insurance and that the claims are being resubmitted by the company for payment of the medical bills. The continued to act in an aggressive and abusive manner and continued to inform me the matters would be " referred to legal '' unless I provided my address, date of birth and social security number. Despite being told to stop calling, instituting a 10 day bar per the Debt Collection Practices Act, they continue to call multiple times a day and hang up hoping to call back. We had an appointment for my daughter to visit XXXX XXXX on XX/XX/18 to get the XXXX vaccine, and to check on an XXXX XXXX ( because you cant get the vaccine if the XXXX is still there ). My wife called the office the day before the appointment to see if they had the vaccine in stock. She was told that they did not, so she went ahead and requested to cancel the appointment. ( I a lso did not receive a notice of right to dispute. ) Apex called my cell phone asking for me. They wished for me to verify certain personal information before talking to me, which I declined to give since they did not tell me their name or company information. They said this was about " an account '' I opened ( without any details, no company, no amount ), and did I open said account? I asked what account, and they said they could not tell me until I gave them my information. I declined again, saying I was not going to give personal information to someone over the phone not knowing who they were. They said they were Apex. I said that I have no idea who that is, and declined again to give out information. They said " Then I ca n't help you '', and hung up on me. I had no idea this was a legitimate business until something showed up on my credit report. I never received anything in the mail from them. They also recently called my parents ' home where I no longer live. In this day and age, personal information needs to be protected. It is absurd that Apex calls asking for information without even stating who their company is, the caller 's name, or even what account they are referencing. Any shady person can do these things, why would a legitimate company?

The bill for the emergency room doctor was {$400.00}. Apex asset management llc of XXXX PA has been calling me and telling me, in writing, that I owe this bill. I explained multiple times of my two insurances and that both insurances would have covered the bill IN FULL. They continued to bill me. I have since learned that Apex asset management submitted the bill to the primary insurance using an INCORRECTLY spelled last name. I called the insurance company and they stated to me they never, ever received a bill for the doctor or a bill from Apex ; yet Apex told me they submitted the bill several times. This bill should have been paid when first submitted to insurances, but the last name has been spelled incorrectly ; although the last name on my patient chart is CORRECT. Apex told me on XX/XX/XXXX they were submitting the bill, AGAIN. I have never heard back from this debt company and need to have them be accountable and clear this matter up. On or about early XXXX, Apex contacted me with regard to a debt alleged to have been owed. Exercising my rights under FDCPA I requested VALIDATION in a letter issued to them on or about XX/XX/2022. In that letter I also explicitly told them to cease any and all contact with me other than via mail. On or about early XXXX, they responded with information that a ) did not satisfy validation demand, and b ) made clear that personal medical records had been transferred to their possession a violation of HIPAA. Company is a debt collection agency. They sent a request for repayment of XXXX bills, XXXX invoices originally received from health care facility, in XXXX separate request, presumably because I have to dispute each one separately. The online form to dispute debt provides no confirmation of submitting disputes. Debt was paid in full-confirmed with original creditor debt was paid in full. Was told by original creditor they had contact Apex. Provided proof to company that debt was paid in full, but got no confirmation of receipt. They refused to remove or resolve debt until they received communications from company, but when I asked them to contact the company ( since I had already spoke to the company on this issue and was informed they would call Apex ) they refused to do so. I requested that Apex Asset management LLC provide me with proof that I requested service from XXXX XXXX the debtor they are collecting for. XX/XX/2016 I requested " A signature '' " A contract '' something so I may see my handwriting or proof of some sort that this belongs to me. The first reply I got from them was nothing more than a print out with my name, the amount owed and pretty much the info that 's on my credit report. Company Apex Asset Management continuously sends mail to my address stating that I went to the hospital on XX/XX/20. I did not go to the hospital on that day. I did not receive anything from a hospital or place stating I went there. It must be identity theft and fraudulent activity against my name. This Apex collection report showed up on my report magically without any warning this year. I need this false report removed immediately! I have been sending in a report every week and will continue to do so because I feel this is criminal activity and they should be fined at the very least or do jail time. Hello, I have noticed that I keep getting debt XXXX on my case about hospital bills, however I signed up last year to a thing called XXXX through XXXX and it was supposed to pay for anything that my insurance did n't cover/pay for. They even told me I was approved for the charity care and still continued to send me bills. I had a XXXX in XXXX XXXX and was transported to the hospital by ambulance. I had medical insurance at the time but I did not have my insurance card at the time. Later, I called and provided my insurance information but the amount on the bill never changed. I called again but they insisted that I still owed the same amount regardless of insurance. I believe I am a victim of identity theft. Due to the Pandemic, we have been facing a lot of problems in terms of financial, emotional, and physical aspects. Also, I have been hearing a lot of recent news that the Bureaus are having data and system issues. I disputed the fraudulent information from my credit report. I have no idea how the theft took place. I also have no knowledge of any suspects. I did not receive any money, goods, or services as a result of identity theft. I have done many attempts to reach out to the Bureaus but they failed to give me any results or feedbacks about this concern. Please investigate and remove it from my personal credit file. Thank you.
