On XX/XX/2022, I received an email notification of a new inquiry on my credit report. The inquiry had been completed the same day by " XXXX XXXX ''. I called XXXX XXXX and they advised that the inquiry came from Angel Oak Mortgage Solutions. I attempted locate a phone number to reach out to Angel Oak for more information but they have limited contact information. At this time, I confirmed with my spouse that their credit had been ran as well. We then reached out to our mortgage broker about the inquiry and he advised he would reach out to Angel Oak to see what the problem was. On XX/XX/2022, we received two emails from Angel Oak. One advising that we have been pre-qualified for and subsequent email from a sales representative, XXXX XXXX. I called XXXX XXXX and asked how they obtained our information since we are not interested in a mortgage at this time. He advised that he is provided a list of interested loan applicants. I again advised that we are not interested in a mortgage and requested to speak with his supervisor. He refused to provide a phone number for his direct supervisor and when he was pushed to provide a phone number so that I could speak with someone directly, the phone number provided ( XXXX ) that allegedly belonged to a " XXXX '' who was a sales manager, would not work unless an extension was provided. I then followed up with our mortgage broker and advised of the exchange on the XXXX and he advised that when he reached out to his contact who is on the " wholesale side '', the contact advised that their side did not run the report but that it came from the " retail side ''. Our mortgage broker indicated during this conversation that he would attempt to obtain more information. We reached back out to our broker on the XXXX for an update and he was looking into it. As we strongly believe our broker has nothing to do with this situation, I emailed Angel Oak Solutions on XX/XX/2022 requesting to speak with someone directly. Our email exchange was not exactly the type of response we were looking to receive by their Chief Marketing Officer, XXXX XXXX. My contact information was passed on to XXXX XXXX, XXXX of the Consumer Direct division. I received a call from XXXX XXXX who immediately advised that they did not run our credit and thought it was a better idea to try and explain to me how their sales representative obtained our information. XXXX XXXX was only interested in explaining how their process works once they receive notification that someone is interested in a loan and that the first email I received from them confirmed that they ran our credit, which is in compliance with government regulation. This was not a pleasant conversation and I felt as though XXXX XXXX was only looking to make excuses as to how this could not have possibly come from their company. I advised that all we wanted was for them to look into who ran the credit inquiry but he advised that I would essentially need to do all of the leg work. This is unacceptable. I called Credit Plus again on XX/XX/2022 and confirmed that the credit inquiry came from Angel Oak Mortgage Solutions. The representative could not advise who specifically requested the inquiry and could only provide a phone number of XXXX. This number goes to a system generated message advising the mailbox belongs to XXXX XXXX ( unconfirmed spelling ). I did not leave a message as the mailbox did not identify as belonging to anyone at Angel Oak Solutions.

We started the refinance process in XXXX of 2020. We were also purchasing a home at the same time. We closed on our new home in THREE weeks, that was quadrupple the price and value of our rental property. This company was selected by our broker because they offered the best interest rates. We signed the contract and the intesrest rate was 3.625 %. After countless back and forth, requesting documents that we had submitted multiple times, we were set to close in XXXX. We received closing information on XX/XX/XXXX, to close on XX/XX/XXXX. The interest rate was 4.625 %. We never received a loan disclosure indicating that the interest rate changed. There was not formal paperwork disclosing the change in rate or the reason why. We have been dealing with the lack of professionalism for thre months. It does not take three months to complete a refinance on the home. There were no issues with credit, or any of the normal things that can delay the process, so the three month time frame was excessive and daunting. Mortgage lenders are required to notify you of changes in rates in writing, along with and explanation. The only way we found out was when the title company sent over the documents to review. I have every email and corresondance and they never sent a loan disclosure or settlement documents. Our mortgage broker contacted them immediately and the only thing they said, was that the appraisal came in low, so they had to increase the interest rate. My issue is that no one from this mortgage company contacted us in writing and failed to provide the proper documentation.

The sales agreement was signed on XX/XX/XXXX, for the new build house at XXXX XXXX XXXX, XXXX XXXX TX. 2. The loan estimate was issued, agreed and signed on XX/XX/XXXX, with rate lock until XX/XX/XXXX at XXXX EDT, interest rate of 3.375 % for a loan amount of {$150000.00}. This is a legal binding document that XXXX XXXX and Angel Oak Mortgage solution need to adhere to for the interest rate lock. ( page 1 of the attachment-loan re-disclosure documents- signed-XXXX ) 3. Final closing date was issued for XX/XX/XXXX 4. Email came XX/XX/XXXX, at XXXX, asking me to choose the interest rate option, offered at 6.25 %, see email attached, an 85 % increase from the rate locked at 3.375 on XX/XX/XXXX ( attachment XXXX XXXX XXXX email regarding interest rate ) 5. I sent a demand email to the respective loan officers and XXXXXXXX XXXX XXXX consultant with the options : proceed to close at 3.375 % as locked rate, or if I am forced to go to another lender, the {$10000.00} seller credits is being retained. Attached are the following documents : Loan Estimate ( XX/XX/23 ) Broker confirmed locked from Angel Oak ( XX/XX/23 ) Closing Disclosure signed XX/XX/23 Final Closing Statement from XXXX XXXX demonstrating the overcharge. I want an immediate refund of the overcharge in the amount of {$8400.00} which is the difference between the stated and agreed points of 1.5 % ( {$16000.00} ) and the points charged at closing of 2.25 % ( {$25000.00} ). At the time of closing, I was under the financial distress caused by the enormous amount of time it took to get the transaction done. I had many obligations to pay from the proceeds of the refinance, couldn't wait any longer and was surprised at the overcharge of 2.25 % points at the last second, as all of Angel Oak 's attachments confirm the rate of 8.875 % with a cost of 1.5 % points. The lock agreement confirms the locked rate and cost, which I advised XXXX at the time of closing needed to be adjusted. Angel Oak has been so advised and has not responded. I want payment in full for this unfair and deceptive act.

Applied for a mortgage loan on XX/XX/2021. I received and signed a loan estimate and my rate was later locked at 5.625 % with a 2 year prepayment penalty period. Nothing changed with my qualifications before settlement. I was told the loan was approved and settlement was scheduled. I received no disclosures prior to settlement. At settlement on Friday, XX/XX/XXXX at XXXX XXXX The loan package arrived at the settlement office and was radically different from anything I had agreed to. The mortgage rate was 6.125 % and the loan prepayment penalty was extended to 3 years at a penalty of {$6200.00}. Additionally, the bank doubled the posted tax rate on the property for the tax escrow. When the settlement company questioned this, Angel Oak Mortgage Solutions refused to reduce the escrow to the actual tax rate. As I had a {$50000.00} deposit and {$490000.00} in exchange funds at risk, I had no choice but to sign the loan documents. My feeling is that predatory lending laws were broken.

I have a loan estimate and my rate lock expires on XX/XX/2020. I qualify for the loan and have been approved by the lender. There were two conditions, both of which have been satisfied and documented with the lender. I have incurred {$700.00} in costs related to applying for this loan ( appraisal and follow up appraisal ). The lender even went so far as to make itself the beneficiary of my homeowner 's policy. The lender is now refusing to set a closing date and says they will not fund this loan, because of the Coronavirus. I want to know if the loan estimate is binding, provided that I still qualify based on the same criteria upon which I qualified when I originally applied. Furthermore, I want a refund of my fees if the lender is now refusing to fund the loan. Yes, the appraisals were done, but of course I would not pay for an appraisal unless I had already been approved by the lender and it was a requirement for closing the loan. Are they responsible for those costs?

I arranged a mortgage loan funded thru Angel Oak Mortgage Solutions LLC., which closed XX/XX/2018. A flood insurance policy was required to close. I obtained an agent for that and Angel Oak 'Net funded ' the loan so that they were to pay the premium due of {$550.00}. Angel Aok did NOT fund the policy ; quickly sold or transfered the loan and the subsequent company made me pay for the insurance a second time. The borker who aranged the loan ( XXXX XXXX ) at XXXX XXXX XXXX tried to help me to get them to fix this but after talking to numerous people, some of whose names are on the forms being uploaded, i have still not received back the XXXX. Angel Aok apparently kept my money. Simple as that. Now they won't give it back after numerous poilte efforts to obtain that. I am attaching a sheet showing the Net Funding ; the Closing Disclosure and a letter demanding the payment from the company Angel Oak tranfsered/sold the loan to.

Earlier this year ( XXXX to XX/XX/2018 ), I had attempted to refinance a townhome I own in XXXX XXXX, UT. I was working with XXXX XXXX of XXXX XXXX XXXX, who in turn was " shopping the loans '' with different companies/banks/investors. One of those companies was Angel Oak Investors out of XXXX XXXX, Georgia. The deal fell through as my income has changed, and they were understandably not comfortable assuming the risk. However, they have continued to pull my credit via hard inquiries. I called and emailed XXXX twice regarding this matter who said he will look into with Angel Oak. I have emailed and called Angel Oak and copied my attorney on the emails and have received no response, only continued inquiries into my credit which is needless to say, quite frustrating. We bought a house on XXXX 2015. During the process of getting the loan we found many difficulties dealing with the lenders. Just because we could not prove that we paid the rent we previously had, the interest rate that was given to us is 7.25 %, when the rate at the time was around 4 %. Thus, our payment for the mortgage is well above what we expected. We have a letter from the landlord that states that we paid in the rent, they said that was not enough.

Angel Oak Mortgage continues to pull hard inquiries on my XXXX report every 30-60 days even after filing a complaint, reporting it, and they responding they were not engaging in pulling my report.
