I applied for a rehab loan at 0 % which the City of XXXX, as Lender, said was under the Federal H.O.M.E. program. The commitment letter was for {$67000.00} in funding, and I found numerous mistakes in calculations, which were corrected by hand notation of both parties. They told me that I had to repay all of the money ( {$67000.00} ), {$35000.00} of it deferred until I move or sell. This is despite the fact that forgiveness was granted to nearly all people of color who participated in the plan - one of whom actually became one of their approved contractors shortly after getting his free repairs. The Note and Mortgage which they authored refer to the funds as a " Loan '', not as a line of credit. This means they are obligated to lend me the full amount, for the full scope of approved work. The lender required that I execute the construction contract they wrote, without modifications, even after pointing out several conflicting passages. They also limited the contractors I might hire via an onerous process for approval. As a result, I used one of the contractors they recommended, and with whom they do business on an ongoing basis. They also designated a " rehab specialist '' to periodically inspect the work, and keep financial records. Problems arose with the process right from the beginning, but we are all human and can make errors. First, the lender attempted to deny me funds by not " factoring up '' my social security income before calculation ratios - and that is a Federal requirement. They also required that I refinance my existing mortgage before closing, which cost me thousands in closing costs and additional interest beyond the MIP I eliminated. They refused to allow corrections to the contract, or even to make loan document templates available to me before signing so I could have an attorney review them. Despite their own contract stating that I had only 30 days to both execute a construction contract and for the construction to begin. They created exposure to liability by demanding I execute a contract before closing, contrary to the documents they authored and provided. After the construction started, several problems arose which violated provisions of both the loan agreement and the contractor agreement. When a resolution was not achieved, I contacted the FHA 's department over the H.O.M.E. program. The response from the City was that they didn't use Federal monies for my loan, which is contrary to brochures, letters, e-mails and the construction contract. The first draw payment to the contractor was made as approved, despite it including partial payments and structured contrary to the bid on file. The construction proceeded and became more and more out of schedule : I requested a revised schedule in order to plan for the work. I asked that they do not release funds until I have both a new schedule and correction of the defective and incomplete work. Neither happened, instead, two City employees showed up on a day when I already told them I was sick in bed, demanding discussion of matters already discussed, and it became a homeowner-bashing session between them, the Rehab Specialist and the Contractor. I told them that " if you aren't doing work, you need to leave ''. They refused. I had to get the police to tell them to leave. The contractor and his staff remained and continued working. Then one day later, the contractor and his workers left ( leaving tools, waste, and materials behind ) and never returned. I received no explanation until two months later, which indicated that the City had pulled him off the project. ( His allegation that I did so is disproven by near-daily e-mails to the contrary, which were asking when work would resume. ) My home was left with a non-functioning kitchen, a faulty electric system ( I had three fires as a result ), damaged flooring, defective window installation resulting in water causing mold, concrete work which is spalling after only 2 years, loose and detached stairs and railings at all my entrances, no deck, no gutters and downspouts due to warping/lifting fascia, and other problems. This was after the Contractor filed a Lien. The City, as Lender, without my permission and without even notification, paid off the amount. They claim they are justified in doing so because of the " Rehab Specialist '' making a determination as Arbitrator. He did not. My appointment with him to discuss the matter was cancelled, without explanation even after multiple requests. He did not conduct any semblance of arbitration : that would require him to consider both sides, which he not only refused to do, but also included monies for defective and incomplete work, which is contrary to the contract. The contract provides for additional and alternate contractors completing the scope of the work when the initial contractor can not. They also refuse me this option. And correction of the problems is an additional cost. The City, as lender, now expects me to pay back they money I did not authorize, which violates both the contract and lending practices, and which creates an untenable financial burden on me since I have had to spend all my money plus {$12000.00} IN CREDIT CARD DEBT to make my house safe, correct the defects, and complete some of the work. I filed a claim with the Contractor 's insurance company only to be told he did not have the requisite Contractual Liability coverage, which was to be confirmed by the City as Lender. His coverage only covers consequential damages, but that alone was offered to settle for roughly {$9000.00}. The actual costs to repair/replace/correct and complete is roughly {$20000.00} While the City as Lender has chosen to reduce the amount to reflect only the two draw payments they made ( despite the 2nd payment being clearly objected to ), they have not reduced the Note amount. So it claims nearly {$20000.00} OF EQUITY in my property to which they are not entitled by their own admission. THAT MEANS I CAN'T REFINANCE OR GET A LOAN BELOW THE CREDIT CARD RATE. The first {$35000.00} of the loan is deferred, at zero interest. They are demanding that I make payments on an additional {$18000.00} CREATED BY THEIR UNAUTHORIZED PAYMENT TO THE CONTRACTOR. As a result of their unwillingness to correct the situation to any significant degree, after several months trying to rectify, I have stopped making this payment. As a result, my credit score is now horribly low from the late payment and carrying {$12000.00} of credit card debt - it was excellent before this : in the 800 's. Attorneys want {$5000.00} TO GET STARTED, which is money I do not have. I have spent thousands of dollars which were unnecessary, and living on social security income, can not afford. I now have no savings, only debt. And one year after this horrific experience, they revised the program to forgive up to {$90000.00} IN DEBT for homeowners, regardless of location within the City. Regardless of age, and I'm 2 years over the XXXX year old minimum to qualify. But they still refused to do anything. They have made no gesture of good faith in any of this, and I have to wonder how many other people they have victimized under the guise of a Federal program.

My whole ordeal began XXXX XXXX, XXXX, I called my mortgage company to make a payment that was big enough to cover two partial months and one full month. The grand total of the payment was {$1000.00}. For XX/XX/XXXX. ( {$470.00} ) I had made a payment {$200.00} which left a balance of {$270.00} pulse a {$20.00} late charge. My next step was to have a check drawn off my account on XX/XX/XXXX. for the amount of {$500.00}, which would be sent straight from my bank account to them via snail mail. Well needless to say the money sat in my account until XX/XX/XXXX. that 's when I called my back to see what was going on. The bank then notified me that my check had not been cashed yet, so out of fear that maybe I had submitted the wrong info to the bank I had them stop payment and reverse the funds back to me. I did not believe that it would take that long to get to them and be processed. The funds were returned to me on XX/XX/XXXX. At this time I processed to contact the via phone to make the payment of {$500.00} and an additional {$500.00}. This would have been enough to cover all of XX/XX/XXXX mortgage ( {$400.00} ) and a portion of XX/XX/XXXX. There was a change in my mortgage amount due to taxes decreasing. The young lady and I went back and forth for a moment figuring out what exactly how much I was giving towards each month that 's how we came to the conclusion of {$1000.00}. At that time it seemed we had it all together, and processed to use the date as a check number. This all took place on XXXX XXXX over the course of the weekend I checked my account and seen that my money was not reflect in the manner in which we had spoke about. So I called on XX/XX/XXXX to inquiry what was going on, because I noticed what should have been in my unapplied account for partial payment of XX/XX/XXXX was applied to principle. I was assured that day that everything would placed where it need to be once she contacted that department. I also asked about the fact that a late charge was still reflecting on my account and told me that that was a mistake and it would also be handle. Some days go by and I receive a latter in the mail indicating that I still owed for XX/XX/XXXX. and that I was be assessed a return check fee of {$15.00} because the check had not gone through. Now the check they had was the check that was issued from my bank that I had stopped payment on. Mind you by this time it is now around XX/XX/XXXX, and I did n't understand why they where even trying to cash it. I had already called and made a payment twice that amount and that should 've been noted on my account. Just looking at the dates of everything you could figure that out. So I contacted them and had a discussion with them again because my account had not been up date as promise and because now they were trying to say I had paid at all. I also contacted XXXX XXXX XXXX which is co-owner of my house to see if they could get some resolution from them, they hold a XXXX mortgage on my home.. They contacted Amerinational also and was told pretty much the same thing as far me canceling a check and what not. XXXX could n't figure out exactly what was going on because they were trying to look at the ledgers on line and could n't see where a payment of {$1000.00} had been made because Amerinational hand chopped it all up and had it posted as to separate payments. Needless to say they tired but really could n't help too much even with me giving them print outs and going to the main office and explaining it to them. Eventually about a month ( XX/XX/XXXX ) later they finally got it together and I made the remanding payment for XX/XX/XXXX which they told me they would waive the late fee and check by phone fee due to the fact it took them so long to get together. That payment was in the amount of {$100.00}. Now here it is XX/XX/XXXX and I am back at square one fight to get payments posted in a timely manne rand fees accounted for.

I recently learned that the City of XXXX demolished my great grandmother 's property located at XXXX XXXX XXXX XXXX, Ohio XXXX. City officials approved a predatory open-end mortgage product to her in XX/XX/XXXX through the XXXX XXXX XXXX XXXX in XX/XX/XXXX. My grandmother, XXXX XXXX XXXX was Power of Attorney for her mother XXXX XXXX XXXX who owned the property. The loan was originally executed by XXXX XXXX XXXX. However, the City of XXXX and its agents The XXXX XXXX XXXX XXXX XXXX , XXXX, and Amerinational Community Services , Inc., illegally assigned the debt to " XXXX XXXX '' in XX/XX/XXXX when the mortgage was assigned to the City of XXXX. XXXX XXXX 's credit reports show a debt of {$33000.00} to Amerinational Community Services of XXXX XXXX XXXX XXXX XXXX California XXXX and have been reported since XX/XX/XXXX ; the same year the mortgage was assigned to the City of XXXX! Further, the City suggested that it exhausted all avenues attempting to reach next of kin but clearly the City and its agent Amerinational Community Services , Inc. assigned the debt to XXXX XXXX XXXX. XXXX XXXX never received any notices. ( See attachment ) On XX/XX/XXXX XXXX, XXXX the City 's agent Amerinational Community Services , Inc. emailed me an Account Payoff Quotation of {$43000.00} for " XXXX XXXX. '' However on XX/XX/XXXX XXXX, XXXX XXXX XXXX XXXX, Assistant to the City Manager emailed me a Write Off Recommendation for a balance owed in the amount of {$43000.00} for XXXX XXXX XXXX. The payment history from XXXX shows that payments were made but only {$37.00} was applied to the principal balance and the majority of payments were applied to interest! According to the City the balance owed grossly exceeds the amount borrowed in XX/XX/XXXX. The City received thousands in interestpayments. The City has not offered to remedy this situation other than to write off the loan. A write off will not repair the damages to XXXX XXXX 's credit rating or the loss of property. These are clear and blatant civil rights violations based on age, sex, race and location. It should also be noted the Borrower was XXXX years old at the time the loan was executed. ( See attachments ) The City of XXXX used their public nuisance ordinance and municipal authority to demolish the property and subvert the terms of the mortgage agreement in violation of the Fifth and Fourteenth Amendment rights to the U.S. Constitution and state law. Mayor XXXX has ignored all of my requests to meet with his staff. My staff and I have identified XXXX other homeowners both alive and deceased who are also victims of the City 's predatory lending practices and the numbers continues to grow. The City of XXXX has a history of displacing XXXX Americans and creating systematic racism and discriminatory practices when it comes to their mortgage lending practices. The City may have used federal money to give these loans to homeowners that were in areas they designated for future development projects.. ThanksXXXX XXXX

I Have New Information To Add. This is a NEW COMPLAINT. I received a response to my complaint from the servicer Amerinational Community Services. In the response Amerinational indicates that they have no problem participating in Keep Your Home California. Amerinational indicates that they inquired with XXXX XXXX XXXX XXXX - XXXX about me applying for Keep Your Home California, and the XXXX XXXX XXXX says that they have no recollection of ever trying to assist me with the program. So I have at least 3 emails that contradict this. The first email is on XX/XX/2015 I initiate the email by giving them the phone number of Keep Your Home California, by my language you can tell that this was a request that I am responding to, and I cc myself and XXXX other people. The second email was the same day XX/XX/2015 about 2 hours later from a XXXX XXXX XXXX representative to the Director and I. In his response he indicates that he has received the email, has begun inquiring about the process, and will follow up. This is the third email from XXXX XXXX XXXX Representative XXXX ; { XXXX XXXX, After many phone calls, conferences and emails I have bad news. While XXXX is ready to develop a relationship with Keep Your Home California, our new payment servicer ( AmeriNational ) is not interested in getting approved to work with KYHC. As it turns out, it is them ( not XXXX ) that has to be on the approved list and we can not force them to get approved. There are other Habitats that work with KYHC but they manage their own payments ( as we used to ) and so have gone through the long approval process. What this means, of course, is that XXXX is not going to be able to pay your two months of past due payments. We are truly sorry it did n't work out. XXXX } The actual email is attached. So now we are here. I am facing foreclose even though I tried to get help almost a year ago. I was told by my lien holder ( XXXX XXXX XXXX ) that the new servicer ( Amerinational ) was not " interested '' in being part of Keep Your Home California. In addition my lien holder ( XXXX XXXX XXXX ) denies having any knowledge of, or assisting me in any way with applying to Keep Your Home California. I have a servicer ( Amerinational ) who rejects the part they are said to have played in this drama. I have XXXX applications with Keep Your Home California that cant be processed because everyone is passing the blame around. I am a single mother of XXXX, including a mentally ill adult child who needs almost constant supervision. I help to take care of my XXXX mother who has health issues. I am one of many clear pictures of whom these programs were designed to help. I should not be facing foreclosure. I should not have been lied to. I should not have to fight against programs that are supposed to help. I believe that I am a victim of unfair, and unethical practices. I believe that my rights have been violated. I believe that because of being purposefully mislead, that I have been prevented from helping myself. I have been kept from applying to a program that would have helped me almost a year ago. I believe that the organizations, and individuals that give their time and money to these programs, would be very interested in this situation.

I am a XXXX XXXX XXXX homeowner whose loan was sold to Amerinational Community Services sometime during the XXXX. At the time the loan was sold, my balance was behind. I had asked XXXX to move that balance to the end of my loan. They neither responded or acted on this request. In XXXX XXXX, I wrote to Amerinational asking how they 'd calculated my balance. I also asked for a copy of the transfer info. I never received it. A few months ago, Amerinational sent me a letter asking me to pay them $ XXXX for XXXX to XXXX XXXX. My mortgage payment is {$920.00} per month. I responded by sending in my payment receipts for those months and noting the error. From there, I was deluged with random letters that expressed no purpose. At one point, I spoke to a rep who neither acknowledged or offered to straighten out this mess. He was concerned with confirming my cell number. I sent back an account of this in writing. He offered to send me a loan modification app and said it was their goal to help me keep my home. I completed it and sent it back. For close to a month, I went back and forth with a woman who kept asking for tax returns after I informed her that I did not file XXXX taxes. To offset this, I sent all salary and wage information as a required attachment to the application but she could not understand this. I received four letters in 10 business days. Not one letter had a real purpose. They did nothing about the loan modification they promised to help me obtain. It never evolved into anything .... Last week, after a month of quiet, I received a voice msg on my cell from a woman telling me they 're attempting to collect a debt. To date, all monthly mortgage payments have been applied as appropriate but it has been several months since I began asking them ( via letter ) to move any unpaid balance to the end of my loan. They 've consistently ignored this request. Back in XXXX, I informed Habitat via email that I 'd made this request. They thanked me for the info but offered no assistance in making it happen. At this point, I need to speak to what is happening to me. I am being bullied and harassed by Americnational. From their activities, it is apparant that they have the opinion that I am a " cash cow '' and by submitting threats, I will somehow respond with a sum of money. I want them to stop harassing me. This company is trying to scam me trough scare tactics when the resolve has been put before them on multiple occasions. I believe can be described as illegal. It is not unusual for a lienholder to move back payments to the end of a mortgage loan. Since they did not honor their word to provide modification they should move the payments. I pay them each month. I have no reason to believe that I am going into foreclosure unless they push me into it and then I question the legality of that. I just want to pay my mortgage to an upstanding company and live in peace.

I have a XXXX XXXX XXXX hom e in XXXX , CA and XXXX contracted with sub-servicer AmeriNational to handle my monthly payments. Due to job loss in XX/XX/XXXX , I e nded up behind in payments. Back on track in XX/XX/XXXX , I re started making regular monthly payments - accepted without incident- until XX/XX/XXXX / XX/XX/XXXX when I received a letter from AmeriNational seeking a total of $ 23+K as an outstanding balance for one month in XX/XX/XXXX . I rep lied. We went back and forth. I asked for a loan modification. They sent an application. I completed it then returned it. They responded that they needed by XX/XX/XXXX tax returns but a t that time I had not filed. In lieu, I sent in all the employment info/paystubs I had and when I did file XX/XX/XXXX , I sent in copies. From there, everything went dormant for a couple months and no one from AmeriNational would tell me what they did with my app and why it was never processed. I filed a consumer complaint. The company 's rep responded online and said that they 'd resend another app " but it did n't mean I 'd get it ''. Never received it. I continued making monthly payments. They were received without incident. In XX/XX/XXXX , they sent that month 's payment back. Said they only wanted my defaulted payments. We went back and forth and I still sent in monthly payments. In XX/XX/XXXX , they retur ned XX/XX/XXXX , XX/XX/XXXX and XX/XX/XXXX but not XX/XX/XXXX . Do n't know what happened to it. In the letter attached to those payments, they asked me to stop making payments all together. Shortly before this happened, they 'd referred me to HUD. I do n't have a HUD loan ... .. H UD 's site says " if your servicer asks you to stop payments that that 's illegal ''. I 've asked AmeriNat several times -in writing- if they partnered with any agency who can help me. I wrote to HUD. In their response, they indicated that my mortgage is n't FHA so I 'm not sure how AmeriNat categorizes it. I wrote them and asked what they did with all the other payments I 'd made. They wo n't say. They sent me a copy of a USPS receipt for mail they sent but my signature is n't on the form b/c I did n't receive anything. I told them this. No response. Along with that copy was a printout that I could n't even digest. They also wo n't say why they just wo n't move this defaulted amount to the end of my loan. I 've received letters from at least 4 different people in this company. At one point during XX/XX/XXXX , they emailed that they 're no longer AmeriNational, they 're AmeriNat. This was after I wrote that I intended to report their activities to their executive Board ( thos e identified on the AmeriNational website ) XX/XX/XXXX says they do n't get involved. Just want to keep my home.

I am contacting you in reference to my loan # XXXX with AmeriNat and the questionable customer service which Ive received. On Friday, XX/XX/XXXX, I signed into your website ( https : //www.amerinatls.com/ ) in order to look into my existing loan with your institution. At which time I discovered that in spite of my making nearly 2 years of payments, my principal balance had only decreased by a little over {$2000.00}. As I have a median interest rate and loan amount, I found this dismal pay-down to be strange, so I called in to your customer service group with questions about my : loan, balance, interest rate and per diem. The first young lady whom I spoke to seemed to not know what a per diem was, as each time I asked her to calculate my current per diem, she replied with AGAIN giving me my interest rate. I ended this phone call due to frustration and instead utilized your website to explore my payment history myself. After going to XXXX and finding a basic formula for calculating daily interest and doing the math, I called into your customer service once more. The gentleman whom I spoke to was at least familiar with the term per diem and knew how to calculate it. After doing his own math, he agreed that the way my payments were applied seemed odd. At this point, I assumed that Id get a ticket or reference number for a review of my account and payment history, but no such luck! I was told that this young man would put my request in his pile and later review it with his manager before calling me back by XXXX. Unfortunately, I did not receive a callback or any other type of follow up for my concerns. Im disappointed that your institution seemingly doesnt have any escalation department or process to assist borrowers with this type of inquiry, so I am sending my complaint in writing and including the OCC and FTC in the thread. I have attached a spreadsheet of my loan history, and would like an investigation into my payment history & a breakdown of how my payments were applied going back to this loans inception. Here are just a few of my concerns with how my payments have been applied : I made 2 payments in XXXX on 2019 in the amount of $ XXXX/each. How is it that my principal and interest breakdown are the exact same for both payments? Please explain your math in calculating {$210.00} worth of interest when my records show that accrued interest should have been under {$160.00} I started routinely overpaying my loan by $ XXXX/month in XX/XX/2019. These overpayments do not appear to have been applied to principal, where are they?

This is the second complaint that I have filed against Amerinational mortgage company. I have contacted them twice via phone to get my late charges for my mortgage handle. As of right now when I go on there website it currently reflects that I owe XXXX in late charges. I made a payment on XXXX XXXX,2017 of {$440.00}, which was my mortgage payment plus the late fee that they were saying that I owed. As of today I have made another payment towards my mortgage of {$420.00} to cover XXXX 's mortgage payment and late fee. The first call I made was around the XXXX XXXX, 2017 and spoke to a young lady that told me she would have the changes made and my should reflect a XXXX balance for the late fees, that did n't happen. So on XXXX XXXX, 2017 and spoke to a young man named XXXX about XXXX XXXX central time. At that time explained to him the problem I was having and we went back and forth with the numbers for a little while before he just came to the conclusion that he did n't understanding why the system was still reflecting a late balance and at that time a new late charge that was n't they 're standard late charge of {$20.00} was showing also. The system at that time was saying that I now owed an additional {$11.00}. Which I told him was impossible because if they give a grace period of 10 days from the XXXX of the month at the time of us speaking I still was n't late. At that point he said he would put in a request to have the matter handle. He told me it would take about a week to fix it has been a week and nothing has been done. I also have contacted XXXX XXXX XXXX Of Wisconsin ( XXXX ) which is named on the mortgage also to help resolve this issue. They are the organization that I abstained my home through. I have attached the payment ledger to this complaint so you can see exactly what is going on with my account. I have made lump some payments at time that did not get posted right. They decide to break the payments up and then they applied them how they wanted to. They will put the money towards unapplied funds or escrow payments instead of late fees or the next months mortgage payment.

I am writing to file a formal complaint against AMERINAT- Loan Servicing company for and XXXX XXXX regarding their treatment of me as a borrower. I believe that AMERINAT and XXXX has engaged in several practices that are unfair, deceptive, or otherwise illegal. I'm a XXXX XXXX XXXX XXXX XXXX and my medallion loan was transferred by my original lender to XXXX and Amerinat - Loan servicing company. Firstly, when the COVID-19 pandemic hit, the lender contacted me over the phone /email and offered a modified payment plan that allowed me to make reduced payments for a period of time. However, on XX/XX/2023, statement, I discovered that the modified payment plan has caused my loan to mature earlier than originally scheduled. The lender did not adequately inform me of the impact that the modified payment plan would have on the maturity date of my loan and did mail the XXXX bill on time. As a result of the short notice, I had to borrow money from private individuals at a high interest rate in order to pay off the loan and the closing costs. This has put me in a difficult financial position. Secondly, AMERINAT overcharged me for closing costs associated with my loan. I believe that these fees are excessive and do not accurately reflect the actual costs associated with the loan. I have attempted to resolve this issue. but have not receive a satisfactory explanation for the closing cost. I received. a statement that the lender had reallocated my principal and interest. payments for prior years in a manner that is not in line with the terms of the loan agreement. Specifically, a greater percentage of my payments was. reallocated towards interest than principal. This reallocation of payments is a violation of my rights as a borrower. I would also appreciate any assistance that the department can provide in resolving these issues with the lender. As a borrower, I expect to be treated fairly and with transparency, and I do not believe that Amerinat has lived up to these expectations. Thank you for your attention to this matter. I have a home mortgage loan through Amerinat nationwide loan services. I have always paid on time and early an have never been late and have always paid the full amount, if not extra. Nevertheless, I received a credit monitoring alert this morning that stated that my credit had dropped 60 points. Upon investigating what caused the credit to drop, it was reported that Amerinat had reported that I was a victim of a natural disaster/declared disaster. So, I called to see what this was all about and the lady on the phone stated that because they did not report to the credit agencies for the month of XXXX that they went ahead and put on everyone 's account that they were affected by a natural/declared disaster. I told her that was illegal because I paid on time and early for he month of XXXX and since I have had the loan. I told her I wanted to speak to a manager, who was not available. So, she proceeded to tell me that I needed to go through collections to settle the dispute, since their collections department was the one who reported it. They advised that I needed to dispute it, which I told her was ridiculous because the fraudulently reported that I was affected by a natural/declared disaster. I have never once asked them to defer a payment, so the fact that they reported to a collection agency that I was affected was illegal. She said there was nothing that she could do and that I would have to write an e-mail stating what happened, which I did. Moreover, I am reporting this because it is illegal, because it was fraudulently reported to the credit agencies. When I purchased my home in XXXX, I used a loan program for XXXX XXXX that was administered by the State of Maryland. The loan servicer was XXXX and I had no issues. In XXXX or XXXX the loan was sold to Amerinat. The problems began shortly after. They created several payment issues with their mismanagement of payments and paperwork. Their customer service line has 60 minute+ wait times making impossible to speak to anyone. On XX/XX/XXXX @ XXXX XXXX, I submitted a payment with extra principle that would pay down my loan. Nearly 2 weeks later on XX/XX/XXXX, the amount had not shown up as a credit to my account. I also noticed an additional automatic payment was debited for a loan that should have a XXXX balance. I emailed Amerinat to get an explanation. They claimed my funds were being held in an " unapplied account '' and wasn't credited to my loan because their company policy was that I had to ask for a payoff amount in writing prior to making a payment. They continued to charge me interest despite holding my payoff in a random account I didn't authorize. They also made no attempt to notify me of any payment issue. In fact, the email I got after submitting the payment would lead any reasonable person to believe the money was accepted and applied to the account. Amerinat makes every effort to make the payment of loans as difficult as possible. They recently added {$120.00} in fees to payoff the loan without explaining what the fees were for and how they are legally allowed to charge them. They also will only accept a final payment in a certified cashiers check or money order via US Mail. They have not explained why they can't debit my bank account directly like they have in every other payment.

To date Amerinat refuses to send monthly mortgage statements. The last statement I received was XX/XX/XXXX. A door knocker was left on my door when I reached out to Amerinat on XX/XX/XXXX I was not provided information about my loan balance. Every prior statement there was a major past due increase added the amount to reinstate my loan making my loan balance increase more. They send letters from their attorney but never approve a resolution as I was denied a loan modification. Never was given the opportunity to find out why I was denied but no help from this company at all. I get no answers to my questions about my loan. My loan balance has increased not decreased since purchasing my home in XXXX. I am in active bankruptcy and I inquired about the post partition payments made to my account. Again nothing was shared. And then I was hung up on. This is my third complaint as I have received no resolutions. It is totally unfair for a customer to be ignored and mistreated with no clarity or answers. So if there are no answers why is my loan always threaten with foreclosure. This company truly want to take my property. Something definitely need to be done to hold Amerinat accountable. Fell behind in mortgage payments and filed XXXX bankruptcy XX/XX/2018. In additional to monthly payments made to Amerinat, trustee payments were made and I received help through the HAF program. I obtained a housing counseling program and applied for help. It seemed as if the post petition payments sent to Amerinat were not applied to my delinquency. My account balance became higher and higher as if Amerinat wanted to foreclose in my home deliberately. I applied for loan modifications that were denied. I paid lump sum payments to their lawyers and the company but never received statements showing the amounts were received or applied. Only thing I received were foreclosure packets. I do not see where the post petition payments made by myself or the trustee have been applied. When I applied for HAF Assistance I was approved and Amerinat received {$13000.00} and additional XXXX. I dont understand how I was behind to receive over XXXX of help from HAF. The trustee paid from XXXX a total of XXXX to Amerinat and I paid over {$16000.00} in post petition payments. My tax assessor sent an incorrect tax bill to my mortgage company in 2016. The mortgage company, AmeriNat, then paid the incorrect amount. When I called to explain the issue, the mortgage company insisted that it was my responsibility to get the accurate bill which I did. The tax collector told me that a refund was issued to my mortgage company on XXXX/XXXX/16. My mortgage company then increased my mortgage payment to compensate for the mistake payment despite the fact that I provided them with the accurate bill. They then told me that it was my responsibility, not the tax collector 's responsibility, to make sure that the refund was received. I was even able to give them a check number and the date the check was sent to the third party vendor that accepts their payments but they refused to acknowledge it because they said they never received the payment. So basically I 'm stuck with a mortgage payment that is {$1600.00} more than it should be because Amerinat refuses to investigate the situation and take the appropriate action. Amerinational Community Services Inc., XXXX XXXX XXXX, XXXX CA XXXX is not only a fraudulent company but also the loan servicer for the City of XXXX XXXX, CA who is the second lien holder on my mortgage which was refinanced on XX/XX/XXXX. I have been paying my mortgage through a bankruptcy trustee. All the payments have been sent. I noticed in XXXX the balance was larger than it should be I contacted the company and was told once all the payments were made from the trustee the account would be paid in full. I call or email every month after that intial conversation because even though im being told the account is being fixed it never is and i continue to receive incorrect statements. I had enrolled in autopay twice with this company, unfortunately it did not go through. When I was aware of the problem I fixed the problem. The company however has not. I have been told that the reporting are to old and can not be removed. This is stopping me from moving forward with a refinance of my property. The amount is {$15.00} per month.
