Me and my wife closed on our home XX/XX/XXXX with AmeriFirst Financial Corporation XXXX AmeriFirst Home Mortgage " XXXX '' going forward,. In XXXX of XXXX, before I was ever late, I called XXXX letting them know about my current living and financial situation and how it had changed, I asked if there was any way that my loan could be remodified to accommodate my changes. And I was told by the agent over the phone for XXXX that there was nothing they could do until I was months behind. So I called again in XX/XX/XXXX and was again told there was nothing XXXX could do to help me until I was months behind. I then said there is nothing you can do to help me even though I've paid my payment on time and even payed overage to principle. They said no. I then said that I received a letter from Fannie Mae on XX/XX/XXXX stating that XXXX sold the loan to them on XX/XX/XXXX. Then I told them that by law I was entitled to all of Fannie Mae assistance programs. Then in my second call for help, XXXX finally agreed that I was entitled by law to all help, assistance, and programs Fannie Mae offers. They agreed to mail the borrower assistance form after that. The letter and borrower assistance form XXXX sent was dated XX/XX/XXXX however, I did not receive it until XX/XX/XXXX. I filled the form out and emailed it to them along with all documents required on XX/XX/XXXX. Yet they requested more info. On XX/XX/XXXX I sent in more info. Yet they requested more info again. On XX/XX/XXXX I sent in more info. Then finally XXXX XXXX at XXXX said she was going to give everything to the analyst to double check they had everything and send me a letter verifying they did. Instead, on XX/XX/XXXX I received a letter from XXXX demanding all late payments in full in order to stop foreclosure. We then emailed XXXX XXXX at XXXX. She replied the application was completed on XX/XX/XXXX and she would mail the letter out that day and said they had XXXX days to make a decision. After much confusion on XXXX part in XX/XX/XXXX I finally received a flex modification/loan modification offer from XXXX XXXX ; senior Loss Mitigation Analyst at XXXX. The terms for the modification offer stated XXXX XXXX XXXX XXXX trail period payments had to be made before a modification could be given. The payments of {$790.00} had to be paid the XXXX of XXXX, XXXX, XXXX, XXXX. On XX/XX/XXXX XXXX XXXX ; Compliance and QC Manager - Originations at XXXX mailed a certified letter to me stating : During the course of origination of my home loan, XXXX errored providing me with incorrect information regarding the agency in South Carolina designated to receive mortgage complaints requirements of SC XXXX. XXXX gave me no address, no phone number, and incorrect email regarding the agency in South Carolina to receive mortgage complaints. On XX/XX/XXXX XXXX XXXX ; Compliance and QC Manager - Originations sent a check in the amount of {$750.00} and a letter stating : XXXX would like to inform me of their error that took place at the origination of the loan application the Attorney/Insurance Preference Form, was never given to me in accordance with South Carolina 's STRICT regulatory requirements of SC XXXX ( a ). On XX/XX/XXXX I wrote XXXX and made them aware of my grievance and complaint and their violations to South Carolina XXXX XXXX - Consumer Protection Code Chapter XXXX, Statute XXXX, and Article XXXX : XXXX and Breach of Contract by XXXX pursuance to the same statues. I requested to XXXX that my only wish NOW THAT the contract is invalid and canceled due to XXXX error ( s ) is to have all leans/leases placed by XXXX ( file a release of mortgage ) taken off of my deed of title and recorded in the same office where deed is recorded in South Carolina, the return of all money received By XXXX from or on my behalf in connection to the now VOIDED loan returned to me either by money order, personal or casher check made out and sent certified mailed to me for the total SUM of {$19000.00}. Then for XXXX to send me certified copies of doing so. If removing any reports on my credit by XXXX is not possible, change the states to paid in full and on time. Also removing any negative remarks as well. And that if my request wasn't honored by XX/XX/XXXX or no later than XXXX business days from the date they received my letter then I would be requesting the legal amount allotted by South Carolina XXXX XXXX from XXXX for their violations for Status mentioned above. On XX/XX/XXXX I received a letter from XXXX XXXX ; Associate Counsel for XXXX stating : This letter is in response to your recent correspondence disputing the validity of a mortgage. After analysis, we are confident the mortgage is valid. On XX/XX/XXXX I replied to XXXX saying I received a written communication from XXXX XXXX Associate Counsel for AMERIFIRST HOME MORTGAGE to myself dated XX/XX/XXXX wherein XXXX made reference to a loan that is valid and very well maybe so, but loan ( XXXXXXXXXX ) isnt my loan. The loan I actually wrote to you about on XX/XX/XXXX is ( XXXXXXXXXX ) and according to South Carolina laws is invalid due to AMERFIRST HOME MORTGAGE absence of full disclosure at origination of the loan unless given absolute proof of rebuttal is presented. If you have chosen XXXX XXXX as your legal representative, I have NOT given consent to communicate with him/her. And if XXXX has chosen him/her to represent you, please send the correct documents stating so. Also enclosed with the response to the written communication dated XX/XX/XXXX was a RESPA QUALIFIED WRITTEN REQUEST, COMPLAINT, DISPUTE OF DEPT AND VALIDATION OF DEBT LETTER, TILA REQUEST. THE REPONSE TO THIS RISPA, TILA REQUEST IS TO BE PERFORMED IN THE LEGAL TIME ALLOWED. This is another attempt to settle this matter between us peacefully. On XX/XX/XXXX I received a letter from XXXX XXXX from XXXX stating that in response to your most recent correspondence disputing the validity of a mortgage. we have corrected the loan number, which we mistyped in our first letter to you. Attached for your convenience is a copy of your recorded mortgage. After review of your letter, we remain confident the mortgage is valid. Moreover, pursuant to XXXX XXXX ( f ), we object to the requests in your most recent letter because they are duplicative, irrelevant, overly broad, and overly burdensome. On XX/XX/XXXX XXXX XXXX builder of Texas ran my credit without my written authorization and Denied my VA Loan because of my XXXX XXXX and Retired status.XXXX XXXX VA Loan Department of Florida didn't conducted a application, only pulled credit as stated that underwriter didn't approved loan and my XXXX credit score was XXXX in which my credit score was over 600. On the same month of XX/XX/XXXX XXXX XXXX refer me to their business partner XXXX XXXX of Florida in which I filled and completed a VA Loan application and gave written consent to pull my credit as AmeriFirst and XXXX XXXX Reps stated that another credit pull has to be implemented on another VA Loan as XXXX XXXX implemented a decline VA Loan # XXXX on XX/XX/XXXX and on XX/XX/XXXX-XX/XX/XXXX Amerifirst pulled my credit. On Home purchase my Florida Real Estate Agent conducted the deal with XXXX XXXX in providing all full closing cost paid, with Washer & Dryer, Stainless Steel Refrigerator and all blinds throughout the house and only money coming out my pockets was {$1000.00} earnest deposit. XXXX XXXX put a price tag of XXXX on new inventory construction home that wasn't ADA mandated and I wasn't accommondated on my of my XXXX XXXX. Home appraisers of XXXX County email me appraisal of around {$200000.00} from the Office of XXXX XXXX, XXXX, XXXX XXXX County Property Appraisers of XX/XX/XXXX. Amerifirst was charging me around {$500.00} for home appraisal and many other VA Loan and lender fees. AmeriFirst Mortgage provide it a Pre-Approval and a Earnest Deposit of {$1000.00} was electronically sent from my XXXX XXXX XXXX to XXXX XXXX Builder XXXX XXXX, to start escrow proceedings for XXXX XXXX builder New Inventory Construction home built in XX/XX/XXXX at XXXX XXXX XXXX, XXXX, Florida.XXXXXXXX XXXX XXXX On XX/XX/XXXX I get a email letter that my VA Loan was denied because of credit scores of XXXX, not enough funds to close and other Derogatory Remarks on Declined VA Loan. VA Lender XXXX XXXX investors underwriters denied my loan also because of the Bankruptcy Chapter XXXX of XX/XX/XXXX in which it was Discharged by XXXX, Texas Federal Judge on XX/XX/XXXX. A Bankruptcy Chapter XXXX had to be implemented to discharge me from any collections debts of XXXX XXXX XXXX XXXX, XXXX, XXXX.XXXX in which on XX/XX/XXXX a fraud, corruptions and scandal was implemented on VA Loan , purchase process with Texas home Builder and VA Lenders XXXX XXXX and XXXX XXXX XXXX XXXX XXXX , XXXX XXXX XXXX XXXX XXXXXXXX , XXXX XXXX and XXXX XXXX XXXX XXXX XXXXXXXX XXXX . A VA Loan Modifications was in process because of the issues of unlawful appraisal of XXXX XXXX XXXX of XX/XX/XXXX in which XXXX XXXX XXXX XXXX initiated the appraisal through a Texas appraiser to accommondated a higher inflated appraisal so XXXX XXXX XXXX can make a profit of {$80000.00} to {$100000.00}. Many Federal Government complaints was filed from XX/XX/XXXX till XX/XX/XXXX. As XXXX XXXX and XXXX XXXX XXXX had a business partnerships, just like XXXX XXXX and XXXX XXXX of Florida. As far of XXXX XXXX and XXXX XXXX it appears that they just put me on VA Loan and purchase process to denied me and that's what they did as they knew that I had creditor of XXXX auto loan that had a derogatory remarks of 30-60-90 days that needed to be deleted and it was going to take over 30 days to deleted the derogatory remarks. There is other Retaliating and Discriminating factors against me that was it was written by email by XXXX XXXX VA Loan rep by Mr.XXXX XXXX and it was sent to me as I didn't like him saying to me, that I was frustrated on VA Loan process and I wasn't 'frustrated as I don't crumble under pressure. I am a US XXXX XXXX, Military Veteran and I was educated in the Military to never crumble under pressure and always respect your other and oppositions. On around XX/XX/XXXX XXXX XXXX Senior Vice President Ms.XXXX XXXX and VA Loan Rep Mr.XXXX XXXX sends me a email stating that my VA Loan was denied because of the underwriters investors decisions as they didn't want to approve my VA Loan because of Bankruptcy Chapter XXXX, and my XXXX XXXX and my National Origin as a XXXX XXXX American. My XXXX XXXX income is at {$4600.00} a month with 2-3 percent Cost of Living increase every year on XX/XX/XXXX.and my debt ratio was under 40 percent as I don't have many debts and my credit scores is over XXXX. On XX/XX/XXXX I email Ms.XXXX XXXX XXXX of XXXX XXXX XXXX that I was denied on VA Loan and I like to receive my {$1000.00} refund back to my XXXX XXXX XXXX checking account ending # XXXX, she stated that I have to sign a document to receive my refund. On XX/XX/XXXX I signed the document by electronically email and I haven't receive my {$1000.00} as of XX/XX/XXXX to my XXXX XXXX XXXX account, just like I wired the {$1000.00} to XXXX XXXX XXXX XXXX Bank on XX/XX/XXXX. Ms.XXXX XXXX stated that a check of {$1000.00} will be mailed by US Postal Mail two or three weeks. I respectfully requested for my {$1000.00} electronically wire to my XXXX XXXX XXXX or US XXXX XXXX and I got declined just like my VA Loan and home purchase. XXXX XXXX XXXX and Amerifirst has violated my ADA Disability Civil Rights Act under Department of Justice and I have been Retaliated and Discriminated. Why have me go through the purchase process and VA Loan Pre-approval and take my {$1000.00} deposit and than Discriminate and Retaliate against me and denied me a opportunity on VA Loan and home purchase in Florida? I am sure that both XXXX XXXX XXXX and Amerifirst Reps and Law Firms will deny any unlawful acts of violations against me and VA Loan and home purchase. Did VA administration in Florida Pre-approved my loan and denied alongside Amerifirst and XXXX XXXX XXXX?

I applied for pre-approval of a mortgage loan through AmeriFirst on XX/XX/2021. I began interactions with XXXX XXXX of AmeriFirst Home Mortgage on XX/XX/2021 as AmeriFirst would need more information to begin looking into the home mortgage process for me. We began our interactions on the phone, but I prefer to communicate through email. Ms. XXXX emailed me information about starting the home loan process, with links with more information and the email was titled " We're here for you. '' I followed the links in emails from AmeriFirst, read the information, and had some questions. I emailed Ms. XXXX my questions. I never heard back from her, but her assistant, XXXX XXXX, emailed me a list of " Needed Items '' to get started on the mortgage process. I responded to Ms. XXXX that I was awaiting a response from Ms. XXXX, and included the same questions I had emailed Ms. XXXX, just in case Ms. XXXX could answer them. Ms. XXXX responded in a confusing way, so I rephrased my questions for clarity. Again, Ms. XXXX did not answer my questions, so I tried calling Ms. XXXX. There was no answer, and Ms. XXXX was getting more confusing every time she responded. So, I found a number for AmeriFirst and called for help. The number I found seems to have just been a generic number for the company, as when I called, it seemed like an automated greeting. Once I got ahold of a person, I told them I was hoping to talk to someone who could answer some questions for me, because it seemed like Ms. XXXX was instructing me to do the opposite of what Ms. XXXX had said in the only email Ms. XXXX had sent. As I was having a hard time getting through to Ms. XXXX or Ms. XXXX, and they seemed to skirt around my questions, I requested a new loan officer. The person I spoke with said they were adding notes to my file and would transfer me to leave a message about what I had been experiencing, and I would hear back from a new person. Instead, I received an angry call from XXXX XXXX on XX/XX/2021, with her saying " Why'd you make a complaint about me?! '' I explained everything as I have written, she insisted she never received my email. In fact, she insisted I resend her the email right then over and over while saying she wasn't getting it. I gave up, explained her attitude was specifically why everything up until now was in writing in emails, and she could refer to those for why I was going to another loan officer. I requested she transfer me to another person, told her I did not appreciate her yelling at me when she was the one who failed to respond to communications, and she just kept insisting it didn't matter anyways, she couldn't process a mortgage for me. She said none of my income would qualify for even " {$30000.00} and you can't buy a house for that. '' I told her I know, I was hoping for {$80000.00}, and she said there was no way. She even gave me 2 numbers of Rural Development to call, saying there was no loan I could apply for that I would be approved for through AmeriFirst. We ended the call after 25 minutes, and she told me to let her know how it works out with Rural Development. I never completed my application for a mortgage with her, because she insisted she could do nothing for me. On XX/XX/2021 I received a Statement of Credit Denial, Termination or Change stating that my requested credit of {$40000.00} had been denied, dated XX/XX/2021. So after our call, I suspect in retaliation for the complaint she thinks she got, Ms. XXXX applied for a {$40000.00} mortgage with the information I had sent her and got me a denial. Knowing we had ended our business, knowing it would be denied, knowing I was going to try through a different loan company, she pushed a mortgage application through with my information and without my approval. I would never apply for a {$40000.00} mortgage as a different company already discussed offering me {$50000.00} before I spent a year significantly improving my credit score. According to the Mortgage Loan Options resources from AmeriFirst, the actions of Ms. XXXX would harm my ability to be approved through a different mortgage company because of recent failed mortgage applications.

On XX/XX/2019, we had a small fire in our home. The damage was enough that we are now living in temporary housing (that the insurance company is paying for). 1 month later, the insurance company issued an RCV check, which has both our names and our mortgage company on it, AmeriFirst. We signed the check, and sent it to the mortgage company, along with paperwork the mortgage company indicated it needed. AmeriFirst delayed for a month and had no contact with us. I phoned to inquire about the delay and spoke to an employee named XXXX. She informed my that our filing was mising an Adjustor's Affidavit. I consulted with my contractor, who had assisted in assembling the initial paperwork, and we discovered that there was nothing missing. We informed XXXX of this via email. She agreed that nothing was missing, and said that the check would be issued soon. In a phone call, I asked XXXX to send the payment via 2-day mail, with tracking information, to which she assented. Two weeks passed with no check arriving, no tracking information provided. On XXXX XXXX I called to inquire, they informed me that the check had been mailed via standard US post and should arrive soon. It arrived 4 days later on XXXX XXXX, postmarked the day after I most recently called. During the call, I expressed my frustration to XXXX, and I made a post on social media about it. Shortly after, a man named XXXX XXXX with AmeriFirst called to "make sure I was heard." During this phone call, he verbally informed me that our loan was slated to be sold to another bank at the end of July. It is my understanding that law requires a 60 day notice for such transfers, Mr. XXXX claims that a letter was mailed. However, we had been monitoring our mail closely, since we were getting claim forms from the insurance, checks, etc. No notice was received. On XXXX XXXX, I instructed my contractor to request inspection to try and get a second draw from the claim money before the loan is transferred, so our project wouldn't be completely stopped in want of funds. She was able to get an inspection set up with a third-party inspector, who submitted his findings to AmeriFirst. AmeriFirst issued the second draft, which was received XXXX XXXX. On XXXX XXXX, 2019 I phoned and verbally requested Mr. XXXX release the remainder of our insurance funds prior to the sale of my mortgage, to eliminate the delay that will be caused by re-establishing a claim with the new bank. He flatly refused to do so stating that it was not possible. However, during our previous phone call on or around XXXX XXXX, Mr. XXXX offered to release our second draw without the inspection that AmeriFirst said was required, so it is reasonable to believe that the third check could feasibly be similarly released, but they will not do so with no justification offered. Between the delay before receiving the first check and the delay that will be introduced by the sale of my loan to a third party, AmeriFirst has caused significant, unneccesary delay in the process of getting my family back in our home. It is affecting my family emotionally and financially to be displaced; AmeriFirst has significantly increased the duration of that displacement for no good cause. Furthermore, the property suffers deterioration from being unoccupied for longer than necessary, necesitating repair once we finally regain our home. The purpose of the mortgage company's involvement in the claim is to ensure the claim money is put into the repair of the asset, at this stage it is clear we are committed to repairing our home, have a contract obligating us to do so with a builder, and are actively engaged in the process of doing so. There is no reasonable explanation for the numerous delays AmeriFirst has already introduced, and they have further thrown the process into disorder and delay by transferring my claim money to a third party with whom I have no business relationship.

XX/XX/XXXX : Amerifirst has stated in an email there was a hiccup in closing documents. Informed they did not factor the cost of monthly mortgage payments into closing papers. Amerifirst Renovation & Construction Draw Processing office is informing we will need to allow a corporate advance of {$5400.00} and the bank is to also keep the 10 % contingency of {$4800.00} ( we were to receive for reimbursements ) to cover final draw to contractor. Renovation & Construction Draw Processing office will not respond to emails requesting updates. They have called twice and emailed once requesting a call back to answer any questions. As of XX/XX/XXXX an email was sent requesting all correspondence be sent via email. XX/XX/XXXX Contacted Corporate Director/assistant director of XXXX renovations ( draw office ). Return call on XX/XX/XXXX received, they requested we accept a corporate advance '', we declined and asked why it was not deferred as stated previously. On a return call XX/XX/XXXX, were informed the situation was escalated on our behalf and we would here from them the following Monday ( XX/XX/XXXX ). No call was ever received. Left a message requesting an update XX/XX/XXXX and not heard from anyone as of XX/XX/XXXX. According to FHA/HUD website explained that monthly payments were deferred until renovations are completed. HUD consultant informed during initial consult this was how the payments were covered. We were never notified at anytime during the 5 months of renovations that there was a problem. When we received emails stating payments were made on our behalf, we considered it was a deferment they were referring to. No explanation or details of what a corporate advance is or how it works, etc. has been provided. Corporate advance to my understanding is for persons who are in bankruptcy to prevent foreclosure. This is not the case, thus why we declined. Price of home was {$120000.00} with {$48000.00} in renovations. Total at closing was approx. {$190000.00}. Anything over this amount will exceed loan to value of the property. We do not see a reason why the payments were not deferred as we were told numerous time it would be covered or taken care of. All funds are being withheld at this time until we agree to the corporate advance. Payments were to be deferred until completion of renovations as the house was could not be occupied. We asked of this many times during the waiting period from XXXX XX/XX/XXXX until closing XX/XX/XXXX. Many delays in closing occurred due to poor communications, our documents changing hands numerous times. The loan officers kept switching us to different loans each time increasing the interest rate instead of locking in the rate. Mistakes were caught time and again with closing totals, estimates, list of work being done, documents requiring signatures, type of loan being financed, etc. All of which caused a 3 month delay in closing and an increase in the interest rate. Some situations occurring during that time were done so with out our knowledge or approval. We have not been provided with any documentation within our closing documents stating the bank has the right to withhold funds.

We had a home fire XXXX 2013. We settled with XXXX XXXX insurance ) for $ XXXX to rebuild our home. XXXX sent the insurance funds payable to us & AmeriFirst Home Mortgage - as we have a mortgage. AmeriFirst would hold the funds in escrow & pay out the funds in intervals as the home is rebuilt. At several points AmeriFirst would work with our builder to defraud us or coerce us to make payments we disagreed with. In the end, AmeriFirst helped our builder ( who quit before the house was done ) steal a great deal of money from us. AmeriFirst refused to give us the funds they were holding to repay invoices we 'd paid to rebuild the home. Then we received the final insurance disbursement, which AmeriFirst demanded they get the check ASAP - that was almost 2 months ago. Since that time they have made excuses, delayed & stalled reimbursing us for invoices we incurred. They absolutely refuse to repay us a single penny. They 've stated that they 'd release the funds once an appraisal was done to show the value of the home was over $ XXXXk XXXX our original mortgage ). They 've stalled & changed an appraisal to a BPO, FHA inspection, inspection & back to an appraisal. We ordered our own & showed that our home was $ XXXX, which is obviously more than $ XXXXk. Two weeks pass, we hire an attorney & AmeriFirst has objected to our motion to compel the release of funds since we met their requirement of $ XXXX in value. Now they 're objecting to the appraisal stating that they believe the value of the new construction XXXX sq ft home is well under $ XXXXk XXXX after spending $ XXXX ). This is simply another stall tactic to hold our funds. AmeriFirst believes the funds are theirs & that they should keep the funds in order to mitigate their loss of value on our home, which is crazy! This is the end of the story - but there 's so much more they 've done wrong - such as releasing $ XXXX to the builder after we clearly told them we no longer wanted any more funds to go thru the builder. They forced us to sign over the 2nd disbursement rather than pay bills thru AmeriFirst. Then after the builder quit & they were notified they 'd quit - AmeriFirst still worked with the builder to steal funds from us. AmeriFirst released inspection reports after the builder quit. AmeriFirst released information about how much additional money they were holding to assure the builder they could steal our funds & bills would still get paid. AmeriFirst has worked against us every step of the way & in very illegal & unethical ways - much like them continuing to hold funds for months when they clearly know from prior inspections & a current appraisal as well as FMV of new construction that their objection is frivolous & a delay tactic.

We have applied for a rehab purchase loan FHA XXXX FHA CASE # XXXX is the name, AmeriFirst Bank XXXX # XXXX and my loan officer is XXXX XXXX XXXX XXXX # XXXX and his assistant XXXX XXXX XXXX XXXX # XXXX, the loan that we are doing with them has become a night mare the contractor that XXXX and XXXX provided his work does not pass the City of XXXX XXXX XXXX in Illinois the inspector name is XXXX XXXX XXXX, CBO Assistant Director, City of XXXX XXXX. The inspection has not passed 3 times there are safety issue so the work can not continue, the contractor already was paid the 1st time and on the second draw we decided not to allow payment as the work is not completed by code. We have spoken with XXXX and XXXX and they keep stating that the contractor is fine and FHA Consultant so we have called the FHA consultant XXXX XXXX contact # XXXX that is our inspector and XXXX XXXX XXXX another inspector to please check the work that was being completed and both agree it is wrong and needs to be corrected. So when we asked for the bank to have the contractor correct the work he declines and states it is done correct and he went and placed a lien on the title of the home. So know we are asking for the bank to allow us to seek a new contractor and they are giving us a hard time. While this has been going on back and fourth for about 8 months and we are know where closer resolving this matter. I was then referred to a loan officer that was nice enough to explain and direct us to the CFPB to place a complaint and open an investigation as to why you can not obtain another contractor and why the back wants me to only work with this contractor that will not do right by the work he is to be paid to complete. In XXXX I applied for and received a XXXX XXXX XXXX for my property at XXXX XXXX XXXX. In XX/XX/XXXX, I applied for a refinance of my construction loan with Amerifirst Home Mortgage. My underwriting file was forwarded to XXXX Underwriting Department on XX/XX/XXXX as documented by an e-mail from XXXX XXXX, Renovation Sales Manager. I was denied approval of my loan on XX/XX/XXXX. I requested this denial due to being negatively impacted by Covid-19. I have written Amerifirst regarding their failure to provide a timely loan decision. I have enclosed their response asserting full compliance with XXXX. From XX/XX/XXXX to XX/XX/XXXX, Amerifirst did not request any additional information from me. Prior to XX/XX/XXXX I provided my tax returns, compensation statements, bank statements and retirement account statements. From XX/XX/XXXX to XX/XX/XXXX, my credit report was run, an appraiser was appointed and a survey was conducted. I was even promised a closing date in XXXX. Amerifirst 's failure to provide a timely credit decision and taking actions that would indicate loan approval ( survey, appraisal, title company etc. ) resulted in significant financial harm to me and my family. If I was given a timely denial of credit I could have possibly secured an alternate source of refinancing. In addition, the appraisal ( s ) used in my refinancing contained factual errors as well as failure to follow well established appraisal methodologies for excess land. I have filed complaints with the State of Florida regarding the two appraisers. The key issue here is that the loan to value ratio should be below 80 % and PMI should be avoided. With the flawed appraisal reports, my loan continues to require PMI and the associated premium. I have provided you with the relevant letters that I wrote and Amerifirst 's response. I have provided a timeline of this transaction.

My wife and I are in the process of buying our first house. We realized the house we were interested in needed some work, so we started looking at 203k loans. We were preapproved through XXXX XXXX and had a locked in interest rate of 3.5 % prior to looking for 203K loans. Ultimately, we started working with AmeriFirst Financial Corp dba AmeriFirst Home Mortgage onXX/XX/19. We were preapproved that day for {$320000.00} and began looking for contractors to perform the renovations. On XX/XX/19 we met with the loan agent in person to complete the loan application. During our meeting, a estimated cash to close worksheet was provided stating that we would owe {$21000.00} at close. We reluctantly signed due to the house we wanted to purchase being a relocation and the seller was getting nervous we could not secure funding for the 203k loan. On XX/XX/19, while I reviewed the AmeriFirst form, I noticed a line item for Loan Discount Points in the value of {$8700.00}. Upon researching the topic, I learned they are not a necessary item, and informed out loan agent that we did not wish to utilize them. Of note, the interest rate placed on the 203k loan sheet was 6.125 %. We were assured that upon completion of the renovations to our home, we could transition to a traditional loan and use the equity built into the house as our downpayment. When confronted about the loan points, we were told they were necessary due to our credit scores and they could not be removed. Yet in 3 months when the renovations were completed, we were supposed to transition to traditional loan and the loan points we purchased would be void. It is clear that this company is pressuring first time home buyers to spend more money than necessary and do not care about helping rebuild credit, as the company touts.

In XX/XX/2018 I began working with a loan officer to help repair my credit and prepare me to buy my house from my ex husband after our divorce. The loan officer gave me very specific instruction on how to obtain a loan with a gift of equity from my ex husband, had me borrow money from family members to pay off certain debts and instructed me to not make application for the loan until after the divorce went through. I followed his instructions to the letter and when I returned to apply, I was not able to use the loan we planned out because me ex husband could not give me a gift of equity. Not only that, but the loan officer then explained he could not help me at all because he didnt originally understand the rules around that product despite giving me financial and life advice to obtain it. I was forced to sell the home with my ex husband and split the profit, which has left me homeless and struggling to prepare for another loan while I take care of my children and work. If a loan officer is unprepared to instruct a client on loan products, then they have no business doing that job. Initially, I was unable to continue paying my mortgage due to unemployment. Although my job was eliminated back in XXXX of XXXX, I was able to continue paying my mortgage until XX/XX/XXXX. My mortgage company granted me forbearance while I continued seeking employment. In XX/XX/XXXX, I did begin working again, but not making sufficient income to begin paying my mortgage and I sought further assistance from my mortgage company, staring in XXXX of XXXX. In XXXX of XXXX, my mortgage company informed me that my request for further assistance could not be granted due to the 'default status ' of my student loan ( federal student loan ). I did contact the student loan company and they informed me that my only option was to pay my student loan in full ( ~ {$180000.00} ) before the status of my student loan could be changed. At this time the mortgage company requires that I pay {$11000.00} up front before I can resume paying my mortgage. * Company failed to provide notice of transfer per 1024.33 ( b ) ( 3 ) * Company sent mailing asking for payment of mortgage after loan was transferred to another servicer and marked as closed with credit reporting agencies * Company has caused significant delay in insurance claim process by failing to transfer relevant paperwork to the new loan servicer. After our loss ( due to fire ), we filed the requisite paperwork with AmeriFirst to initiate the loss draft process. After over a month of delay with no word, I called to inquire as to the cause of the delay. On XX/XX/XXXX I was contacted by an employee named XXXX XXXX, who verbally informed me that my loan was being sold to a third party. His verbal notice was not within the timeframe described by law, nor did it contain the disclosures required by law. On XX/XX/2019 I received a bill from AmeriFirst asking for payment on the loan, due XX/XX/2019. This mailing was sent after the effective date of transfer, and references a billing month after the date of transfer. This notice is confusing, and could have resulted in errant payment being sent to the wrong financial institution.

Sorry, I didn't see any drop down selection for a complaint related to PMI waiver under the HPA. I called my mortgage servicer, Amerifirst Home Mortgage, on XX/XX/21 to ask them to commence a PMI waiver. They asked me to provide a list of improvements made since I purchased that property a year ago. I asked them to confirm if they needed receipts or other documentation. They said no. A few days later on XX/XX/21 I received a canned email saying they got my list of improvements and that I should call them again to pay for the BPO / Appraisal. When I called on XXXX they said they would not order the BPO / Appraisal until I submitted itemized receipts for the improvements. Per discussion with the manager, they said this was a requirement from XXXX / XXXX. Per the provisions of the HPA I don't see any reference to these additional requirements to obtain the BPO / Appraisal.

We opened our first mortgage on a house with the loan servicing company Amerifirst. The loan amount was approx. {$170000.00} and we closed on the house XX/XX/2019. XX/XX/XXXX, we received a letter from XXXX XXXX notifying us that our mortgage loan had been sold to XXXX. At no point had we been notified by Amerifirst prior to the projected sale, and we have yet to date been contacted by Amerifirst to notify us of the completed sale. We confirmed the sale by calling Amerifirst directly and having them report to the status of the loan. We understand this is a standard process in loan servicing, but I was under the impression that a loan servicing company is required to notify the home owner of a mortgage loan sale no less than 15 days before the sale. We did not receive such a notification.

Our mortgage was sold from Amerifirst Home Mortgage to another bank without any attempt of notifying us before this took place. This created a 25 point drop on both my husband and my credit score. I spoke to Amerifirst several times in the last 2 weeks prior to this transfer about potentially looking and refinancing our mortgage, however nothing was mentioned about our mortgage being sold in these conversations either. I was not notified of the foreclosure. Also, two lots are being taken from me when only one was financed.
