XX/XX/XXXX Dear Consumer Financial Protection Bureau, I XXXX XXXX XXXX am applying to your office for help with resolving a billing dispute with my student loan servicer American Student Assistance ( XXXX ) and their agent XXXX XXXX XXXX ( XXXX ). My Dispute involves two issues ; 1. Overpayment to XXXX XXXX XXXX, 2. American Student Assistances mishandling of my account from its inception. In the spring of XXXX while still attending XXXX XXXX I was erroneously sent notice to start payments on my federal student loans. I appealed this action to the US Dept. of Education ( USDE ) and for two years we went back and forth trading documents. In the fall of XXXX while waiting on a decision from the USDE I received a notice from XXXX that they were about to attach my pay check for being in default of my student loans even though I was in the process of resolving my USDE dispute. I received no notice from the USDE regarding any default of my student loans. Once youre in the default status the USDE doesnt want to acknowledge you anymore and refers you back to XXXX whos only interested in charging you fees. So from XX/XX/XXXX through XX/XX/XXXX I ended up making 101 continuous on time {$300.00} a month payments to XXXX. ( See XXXX XXXX ) In the spring of XXXX I was let go by XXXX XXXX IT division and replaced by three contract employees in a cost saving move by the new owners at XXXX XXXX. Unfortunately approximately XXXX other IT Professionals in the XXXX area were also let go by a large IT outsource company at the same as a precursor to the coming Great Recession. With no IT jobs available and numerous competitions for what might be available I went to XXXX XXXX for a XXXX XXXX. While applying for a new USDE student loans I was surprised to find out that after making101 continuous on time educational loan rehabilitation payments of {$300.00} a month to XXXX I was still in default. Well of course I notified XXXX immediately explaining my predicament of being in default while also supposedly having rehabbed my original USDE loan. I talked and corresponded to XXXX agent XXXX XXXX to explain how I was wrongly put into default in the first place and all the payments I made to XXXX. Not surprisingly XXXX XXXX said there was nothing she could do about the original default issue but she did apologize for the default status and curiously she awarded me a {$6000.00} waiver in existing collection costs/fees ( see XXXX XXXX ) towards my remaining balance of {$12000.00} after she talked to her supervisor. So to summarize I was in a USDE loan default for a loan that was started prematurely and I was still in default after making 101 rehabbed payments but I was still awarded {$6000.00} for being in default, interesting. XXXX XXXX removed my default status after 8 years of continuous payments and placed my account with their agent XXXX with my new payments to begin when I completed my full time XXXX degree at XXXX XXXX. According to my conversations with XXXX XXXX my balance on XX/XX/XXXX was {$12000.00} minus the award of {$6000.00} for a final balance of {$6700.00}. Dispute 1. Overpayment to XXXX XXXX Services. Of course XXXX tried to start repayments as soon as possible such as XX/XX/XXXX while I was starting at XXXX XXXX. It took months of phone calls and correspondences from myself and XXXX XXXX to explain to XXXX that I was supposed to have a deferment while attending XXXX XXXX and they finally recognized my status after approx. 6 months. From XX/XX/XXXX through XX/XX/XXXX I contacted XXXX numerous ( XXXX ) times to get a starting balance of my rehabbed USDE loan so as to confirm what XXXX XXXX had stated. I would call XXXX and talk to folks with a foreign accent which was fine because I understood them clearly and they knew what I said and the information I needed. Unfortunately I never received the information I requested even though I would review my contact information every time. Before I even graduated in XX/XX/XXXX I received a payment coupon book from XXXX ( see XXXX XXXX XXXX ) starting in XXXX of XXXX in the amount of {$160.00} a month. Because I like round figures and I wanted to pay this loan off faster I increased my payments to {$200.00} a month. Again I contacted XXXX about my account balance status and I seemed to talk to the same folks every time with the same result which was almost no result. After over 3 years of calling I finally received some paper work from XXXX ( see XXXX XXXX XXXX, XXXX, XXXX and XXXX ) with a promised 36 month account history that shows only 4 payments. From XX/XX/XXXX until XX/XX/XXXX for a total of 50 months I called XXXX on a monthly basis and I never received a monthly or yearly statement and not even a XXXX tax statement except for the one statement with 4 vague pages from XX/XX/XXXX XXXX see XXXX XXXX XXXX, XXXX, XXXX and XXXX ). When I contacted XXXX about this serious issue I was told to contact XXXX directly because it wasnt their concern. I guess they forgot about the assistance part of their name. Getting anything from XXXX wasnt exactly my priority during the years XXXX through XXXX, getting a job was the priority. Nobody was hiring in the medical field, the IT field and even XXXX XXXX wasnt hiring. Id send resumes and even drop them off in person and youd swear you could hear them being deleted or dropped in the circular file as you walked out the door. Nobody seems to want to hire the older worker and every year is another year older and the law doesnt protect you. So after more than 4 years and 50 payments I put pen to paper to figure out that I overpaid XXXX. My USDE loan Balance in XX/XX/XXXX was {$12000.00} minus my XX/XX/XXXX award of {$6000.00} brings my starting XXXX balance to {$6700.00}. I made 50 payments to XXXX for the amount of {$9900.00} which to me means I overpaid ( see XXXX XXXX XXXX ) XXXX by approx. {$3100.00}. Since I couldnt get XXXX or even XXXX to respond to me inquiries for even just basic account information and since my simple math demonstrated that I surely overpaid XXXX I did the only reasonable thing I could think of to get their attention. I stopped making payments. What a response from XXXX, they sold my account ( see XXXX XXXX XXXX and XXXX ) to XXXX XXXX XXXX XXXX ( XXXX ). So I called XXXX to explain my situation and they didnt know I stopped paying XXXX, They had a different balance than I had, {$5600.00}, they had no payment paperwork or for that matter any paperwork on my account from XXXX and they didnt really seem concerned. So I sat on my hands and waited for them to call for a payment. It took 6 months for both XXXX and XXXX to call. In XXXX of XXXX I contacted XXXX XXXX ( no last names given ) to discuss my account status and the fact that I overpaid XXXX. XXXX stated that XXXX had no information regarding any of my payments to XXXX and didnt know why XXXX sold my account to XXXX. ( According to news reports XXXX was banned from any USDE contracts because of highly questionable practices. ) While I was on the phone with him XXXX contacted XXXX supervisory accountant XXXX who after more than hour ( 90 minutes ) of searching XXXX files couldnt find any of my payment information or even information about the transfer of my account to XXXX. Mind you they had my account since XXXX, over 7 years. So XXXX and I moved on to XXXX and talked to XXXX in purchases and accounts. XXXX had my account since the beginning of XXXX so they surely knew what my balance was, how much I paid to XXXX since XXXX and what my future payments were. XXXX couldnt even tell us what was on the paperwork they had sent me to make payments to them. Remember XXXX represented XXXX the guarantor of the loan who supposedly had to approve the transfer of my account from XXXX to XXXX. XXXX had a right to this information even if they didnt want to give me the information. To say that XXXX was as frustrated as I was an understatement. He was mad and was going to get to bottom of this and would get back to me in a few days. Finally, someone who understood my situation and would get some straight answers for me on my account. So I thought. I dont remember hearing back from XXXX but I did make multiple calls back to XXXX talking to different representatives and having to continuously repeat my account scenario. After repeated XXXX request during these same months in XXXX I called XXXX again and explained my situation to XXXX representative XXXX. She reviewed my account information and stated that I was probably owed more than the approximately {$3100.00} by XXXX and really didnt have a high opinion of ACS. She gave me a deferment for XXXX so as I wouldnt keep getting bills On XX/XX/XXXX I talked to a XXXX XXXX at XXXX who took my information again and requested I forward any pertinent documents to him and he stated that he had more authority to look into my situation. Not hearing from them for more than six months I called back and XXXX XXXX said he never received my mailed documents but interestingly XXXX XXXX did receive the docs I sent her by mail in XXXX. So here I go again sending documentation that for the most part they already have or should be able to access but this time I sent it electronically through their email response system acknowledged by some XXXX XXXX who states that XXXX will contact me in 24 hours but they never did. I received a response from XXXX on XX/XX/XXXX denying my request ( see XXXX XXXX XXXX and XXXX ) by XXXX representative XXXX XXXX. I responded to XXXX XXXX on XX/XX/XXXX by reapplying my dispute with additional information and pointing out that XXXX never answered many of my queries including XXXX balances. XXXX according to their rules is supposed to get back to me within 24 hours with an acknowledgment but they never did and I havent had a call from them since. After not hearing from XXXX since XX/XX/XXXX I received a notice from the US Dept of the Treasury that they would be deducting 15 % of my monthly Social Security pymt ( See XXXX XXXX XXXX ). In summary in XX/XX/XXXX I was placed with XXXX by XXXX after miraculously coming out of an 8 year USDE default even though I made 101 regular on-time payments for which ASA waived {$6000.00} from my account. My balance in XX/XX/XXXX was XXXX minus {$6000.00} waived by XXXX for a new balance of {$6700.00}. XXXX tried to start my payments immediately in XX/XX/XXXX while I was in deferment but this was quickly corrected by XXXX XXXX of XXXX. I never received any documentation at the start of my relationship with XXXX reflecting my account balance or any other documentation you might expect when starting a loan repayment plan. The only items I received from XXXX were payment coupon books. My coupon payment was for {$160.00} but I paid {$200.00} a month to pay off my balance sooner. I made 50 regular on-time payments and every time I made a payment I would call XXXX to get a balance and/or an update to my account. During the more than four years and 50 payments I made to XXXX I never received a monthly or yearly statement or even a 1098 tax document that the IRS requires to show interest payments. The only paperwork I received From XXXX was from XXXX that showed 5 payments that didnt look correct and showed no overall account balance. I paid XXXX 50 payments in the amount of {$9900.00} on an original balance of {$6700.00} resulting in an over payment of {$3100.00}. I have been trying to recoup this overpayment since XXXX of XXXX to no avail. Im seeking your assistance with recovering my overpayment and in dealing with the non-compliance of my request for my account documentation. Dispute 2 American Student Assistances ( XXXX ) mishandling of my account from its inception. After 101 continuous payments to XXXX nothing ever happened to my account except to garner increased fees and penalties that benefited XXXX. In the 9 years of making payments to XXXX I never received one notice regarding their rehab policy. In the 9 years of making payments I never received one monthly or yearly statement regarding my loan balances. In the 9 years of making payments to XXXX I never received one notice regarding interest payments to report to the IRS. . Background : On XX/XX/XXXX I filed a complaint with you ( CFPB # XXXX-XXXX ) regarding American Student Assistance ( ASA ) & XXXX XXXX XXXX XXXX involving what I suspected to be unfair and deceptive practices involving a FFELP Consolidation loan. Rather than respond to your inquiry as is customary, ASA responded to my complaint in a letter which they mailed via U.S. Mail dated XX/XX/XXXX and which included ( for the first time ever ) partial copies of the initial Federal Stafford Loan documents which I had believed were consolidated, the consolidation loan which I believed to have consolidated those loans, and then a subsequent rehabilitation loan document for the same consolidated loan which I had defaulted on due to significant hardship at that time. Also enclosed was a Loan History page printed from the Federal Student Aid website which is subtitled " Grants '' and " Loan History '', then " Aggregate Loan Information '', and " Loan Summary '' In a separate response through your website I received a response from XXXX who was the alleged servicer to whom XXXX had transferred servicing to and attached to their response were two spreadsheets from XXXX beginning in XX/XX/XXXX, and another from XXXX which began in XXXX through XXXX. Separately I also received a response from XXXX ( XXXX ) through your website which attached the same consolidation loan document that ASA had attached to their letter dated XX/XX/XXXX. Later I received a check from XXXX for {$.00} cents of " overpayment ''. I tried to respond to this via U.S. Mail but my letter was returned to sender, no known addressee. Importantly, the two initial federal student loans ( Stafford ) documents that they sent me show that a. ) I had signed BLANK loan applications as I was directed by the financial aid department ( s ) at XXXX XXXX XXXX College in XXXX, Massachusetts ( XX/XX/XXXX ) for {$1200.00}. which I had written in and is typed into the box titled " Certified Loan Amount '' ; and at XXXX XXXX College in XXXX, Massachusetts which was for {$10000.00}. which I signed and dated XX/XX/XXXX ; and b. ) NEITHER LOAN WAS EVER APPROVED BY THE LENDER. In fact the copy that ASA sent me shows the loan application I signed on XX/XX/XXXX is still blank. Equally important is the custom/policy the schools had of not providing me with a copy of either loan document at the time and I have never seen any proof that any amount was actually paid to the schools for my tuition and fees. I was never asked to endorse any loans for the school. Also these " Application and Promissory Note for Federal Stafford Loans '' are copies of the original note - Lender Copy A and contain the logo of American Student Assistance ( ASA ) on the form, which leads me to conclude that ASA was the lender and not the guarantor, which was materially omitted from all communications. All of these facts contributed to the reason I falsely believed that the consolidation loan represented my student loans, because the consolidated loan was also originated by XXXX XXXX College as was a separate Perkins Loan in XXXX so I reasonably relied upon their expertise since they had all the records, or so I believed. Notabably, the XXXX loan is signed by XXXX XXXX on XX/XX/XXXX and whose title was " State Association ''. Finally, the copies of these loans include ONLY THE FRONT PAGE. There is no back page and no borrowers disclosures. Prior to my graduating in XX/XX/XXXX, I applied for sales position with XXXX XXXX and was hired in XX/XX/XXXX with a start date of XX/XX/XXXX. The consolidated loan document that I signed was sent by XXXX XXXX College via US Mail in XX/XX/XXXX which I signed and returned to them. I didn't have a photocopier then and I presumed they'd send me a copy of the loan document if it was approved. However the next thing I received was a loan repayment booklet from XXXX XXXX XXXX. I defaulted in XXXX due to excessive legal expenses related to my attempted divorce. ASA began collection attempts, then XXXX XXXX XXXX OBO ASA or at least that was what I was led to believe. My new understanding based on the past two years of research, communications and activity leads me to conclude that ASA sold the debt to XXXX and created a completely new lien which also rolled in almost {$4000.00} of collection costs and fees and which XXXX originated ( unbeknownst to me ). Thus ASA 's definition of " Rehabilitation Loan '' is not the same as the U.S. Department of Education 's definition of Rehabilitation Loan. It seems that ASA is in the business of issuing securities rather than administering the U.S. Federal Student Aid Loan Program. In fact, the letter that ASA wrote me dated XX/XX/XXXX explicitly admits that the initial consolidation loan was theirs and they were holding it. Not only that but the document they sent me shows that the consolidation loan exceeded the alleged amount owed, which actually aren't even the two loans I signed, they are two completely separate loans that I have no record of and did not apply nor consent to. The other potential place the XXXX loan originated in XX/XX/XXXX came from was also without my knowledge or consent, the training program with XXXX XXXX which I was unaware was not a sales job but was evidently a " vocational education program '' which I had no idea. XXXX XXXX had a mandatory boiler plate Employment Agreement for employment at will that they required I sign before I started and it requires that I acknowledged that I pay them back if I voluntarily left the firm in my first three years of employment. I worked at XXXX XXXX until XX/XX/XXXX ( 17+ years ) so I would have never attributed that amount to them until I ( a ) Discovered in XXXX that " XXXX XXXX Human Resources Benefits Department '' was really XXXX XXXX which is owned by XXXX/XXXX ; ( b ) in reviewing the student loan documents noticed forbearance documented I received ( but did not request ) dated XX/XX/XXXX, that equaled the amount I would have owed had I voluntarily left XXXX XXXX in XX/XX/XXXX, and found evidence of false loan documents originated by XXXX which were sent to me over the years which I never signed or returned, aligned with the timeframes in the spreadsheet sent by XXXX where the student loan appears to have been " reconsolidated '' without my knowledge or consent. It seems that they were under some kind of obligation to keep the loan principal at 95 % of original issue - because apparently someone was using it as collateral - my federal student loan appears to have been used as a CDO. Interestingly, my tax records for XXXX contain a 1098E from XXXX XXXX XXXX XXXX XXXX ( XXXX ) which is the agency name for ASA which is a DBA ; for the interest they earned on my loan at the time that the loan was allegedly in " rehabilitation '' and they capitalized almost 4k in collection costs, I looked up the EIN and it turns out that it is the Deferred Compensation Plan of the ASA Employee Welfare Plan ( 401a ) which is a conflict of interest. Not only that but at that time the U.S. Dept. of Ed didn't charge collection costs for rehabilitation loans yet. When I mentioned this to ASA in a letter, they wrote back that they would ask " The Department of Education ''. I responded that they clarify if they were speaking of the U.S. Department of Education or the Massachusetts Department of Education. I never heard back but then I received notice that XXXX was servicing the loan. XXXX simultaneously discontinued collection efforts, probably to make it appear as though the loan is one and the same. Eventually ASA sent it to XXXX XXXX XXXX XXXX for collections. I disputed the debt and asked for verification but received none. I also informed them that in addition to all of the above, I was never eligible for the student loan in the first place because I had never graduated from high school. They sent me an expired U.S. Department of Education form to complete. I responded letting them know that their form was expired and they sent me another collection notice. Finally on XX/XX/XXXX I mailed XXXX. XXXX XXXX XXXX an affidavit signed under the pains and penalties of perjury with exhibits attached. I didn't hear from them and so on XX/XX/XXXX I emailed them and asked what the status was since I hadn't heard from them and also asked if/how the CFBPB 's consent order with XXXX would affect their collection activity. I have not heard back. Instead, I received a letter a few days later from XXXX XXXX XXXX attempting to collect the debt for American Student Assistance ( ASA ). I have no idea if ASA issued ANOTHER security and this is in addition to the one XXXX XXXX XXXX XXXX is attempting to collect or not. I haven't received anything back from XXXX XXXX XXXX XXXX indicating that they have ceased collection. I don't know if they refused to collect after receiving my affidavit, or if they transferred it directly to XXXX XXXX XXXX. As I researched further, I discovered that the US Dept of Education doesn't even allow for consolidation of " CONS '' ( Consolidated ) Loans. No disclosure, no signature, no notice, nothing. They are just printing money basically. Apparently Massachusetts Securities Law must conflict with Federal Security Law because I can not think of any other valid reason who this would be allowed to happen. As you can imagine, this is incredibly frustrating as it has completely damaged my credit. I can't look for a job because no one would hire me with a bad credit report and I can't collect unemployment because I'm not 'available ' for work until I can get someone to correct my credit report.

First, I do not know what education program I am purported to have completed. I thought I had passed the XXXX in XXXX but learned in XXXX that I could not have because XXXX XXXX XXXX XXXX ( XXXX ) in XXXX, Massachusetts only administered four of the five mandatory sections of the exam to me and told me I passed based on my cumulative score of the four sections exceeded the total score needed to pass. This was a false statement. In XX/XX/XXXX XXXX sent me a copy of my official transcript through the U.S. Mail which falsely reports that I completed a one year technical writing certificate program in XX/XX/XXXX. In XXXX I applied to XXXX XXXXXXXX XXXX ' Degree program in Business Administration and XXXX represented to me that I had been admitted. I justifiably relied upon XXXX 's representations and attended full-time from XX/XX/XXXX to XX/XX/XXXX. I attended part-time evenings from XX/XX/XXXX to XX/XX/XXXX and dropped the two classes I had planned to take in XXXX because I was pregnant with my XXXX child who was due to be born and was born in XX/XX/XXXX. I did not return to XXXX until XX/XX/XXXX where I attended part-time evenings through XX/XX/XXXX. In XX/XX/XXXX I was laid off from my job and because XXXX represented to me that my only outstanding requirements to complete the XXXX ' degree was 13 classes which I could complete within one year, I paid for and completed 13 classes during the year XXXX and XXXX mailed me an " Official Academic Record '' through the U.S. Mail on XX/XX/XXXX which states that I completed a degree in XX/XX/XXXX, XXXX of Science in Business Administration. On XX/XX/XXXX I visited the federal student aid website www.nslds.ed.gov for the first time and discovered XXXX reported me to have been 'WITHDRAWN '' effective XX/XX/XXXX. I contacted XXXX by mail in XX/XX/XXXX to request they correct the FSA record. XXXX relayed to me that they do not consider the FSA record to be incorrect. I also saw federal student loans and grants that were reported in my name that I did not knowingly apply for or consent to. In XX/XX/XXXX, XXXX contacted me about beginning repayment of my student loans which were purported to have been federal student loans. XXXX offered to consolidate the federal student loans and sent me a document through the U.S. Mail which has the logo XXXX at the top which stands for XXXX XXXX XXXX XXXX. They had completed the document for me and provided me with a self-addressed stamped envelope to return it to XXXX. I signed and returned it to XXXX. Because XXXX used their discretion in selecting which purported federal student loan they offered me, and never provided me with an original nor copy of any document until I complained to the CFPB on XX/XX/XXXX, I had no way of knowing that the loans purportedly being consolidated were not the same loans XXXX ( and XXXX ) had me sign for previously ( {$1200.00} in XX/XX/XXXX, {$10000.00} in XX/XX/XXXX and {$1500.00} in XX/XX/XXXX ). They essentially had me agree to consolidate loans I never received, one of which is a directed Federal Loan I did not need and another appears to be a private student loan with XXXX ( now XXXX ), neither of which I needed nor received. Evidently I am a victim of a bait and switch in education and in education funding. It also appears that the fictitious student loans have something to do with XXXXXXXX XXXX XXXXXXXX according to certain tax documents I received. It also appears that I was a victim of a false employment scam which was advertised to be an inside sales position in the " financial services industry '' by XXXX XXXX on XXXX in XX/XX/XXXX which I mistakenly applied for because they claimed there was no prior work experience needed and no minimum education requirements were disclosed. In fact they claimed to provide all necessary training on the job. XXXX XXXX did not disclose that it was a registered investment adviser with the SEC, did not disclose it was a voluntary association nor did it disclose it was a business trust. I mistakenly provided my social security number and authorized a background check under the false pretenses of employment. At no time did XXXX XXXX disclose they were providing a proprietary education program. It appears from the records that there was some collusion between XXXX and XXXX XXXX because XXXX falsely reports on the academic record that I was retroactively transferred to " days '' during the fall semester to be effective XX/XX/XXXX, however I had no knowledge of this and did not consent to it. Finally, the fact that XXXX refuses to provide me with any record of my admissions which I requested multiple times between XXXX and XXXX tends to show there was no admission whatsoever because I was not eligible because I did not complete the XXXX which they knew or should have known. Finally, this fraudulent scheme has left me without any valid higher education and without the ability to earn any wages or income because their actions prevent me from being able to complete a valid resume or apply for employment since they terminated me from this fictitious employment in XXXX under false pretenses which I could not have known at that time. As a result of their actions, I was evicted from my home, my car was repossessed, my reputation has been harmed and I have no way of supporting myself financially. This is the condensed version of harm. Also the purported federal consolidation loan ( XXXX ) shows they checked boxes for blank spaces which leads me to think they added even more fictitious loans to the form after I stupidly signed it and returned to XXXX through the US Mail. I trusted XXXX because they are in fact the Commonwealth of Massachusetts and I never thought the state would intentionally defraud me.

Please note that anything I say here, I will say under oath in court. This is 100 % truth and we swear on the lives of our children that we are being honest and sincere. In XX/XX/XXXX, our student loan was under forbearance through XX/XX/XXXX. I remember getting the confirmation in the mail in the summer and double-checking that it was for this loan. I remember vividly the relief I felt when getting the forbearance, as we are struggling with unemployment in our family. The approved forbearance communication was confirmed by the XX/XX/XXXX correspondence from XXXX XXXX from XXXX ( formerly XXXX ). The servicer acknowledges that ( 1 ) they received our forbearance request and ( 2 ) initially approved our forbearance request - which confirms my point that we did receive the forbearance approval in the mail. We did not receive a follow-up letter about a missing signature and I challenge the servicer to provide proof that this ever got to us in either the mail or the email that is on file. I can also confirm that we did not receive ( 1 ) mail stating our account was past due after XX/XX/XXXX, nor the typical barrage of phone calls that lead to this type of delinquency. No certified mail or notifications reached us - nor did we expect it because we were, to our knowledge, in forbearance. Additionally, circumstantial evidence shows that we were engaged consumers in this, and we wouldn't ignore a notice like this if received. In XX/XX/XXXX, I submitted another forbearance form for XXXX as our struggles continued. In XXXX, we received a default notice from XXXX, a collector for XXXX. Again, please remember that Id say this same thing ( and may have to, if this continues to escalate ) under oath. This is not one of the common excuses that Im sure you may hear routinely. Ill swear my life on it. While we can continue to dig through the details, the bottom line is this : - We were eligible for a forbearance in XX/XX/XXXX. - We submitted a forbearance in XX/XX/XXXX. - Our forbearance was ( initially ) approved in XX/XX/XXXX ) If we are to ignore everything else in this situation, the bottom line is that our lives were essentially ruined because of an unknown missing signature. - There is no proof that XXXX sent the subsequent forbearance denial or made any follow-up contact with us. We never received phone calls or mail from them after the forbearance approval. The burden of proof is on the servicer. Mountains of circumstantial evidence shows that we would NOT ignore this if we received this communication. I suspect it had something to do with us being approved for a forbearance in XX/XX/XXXX and then reversed so quickly due to a signature. It may have stopped other communication in their system. - XXXX was sued in a XX/XX/XXXX class action suit because of this type of issue, so Im not alone. Upon reviewing others experiences, their experience is almost IDENTICAL to ours. This is not an administrative error that we can live with, as it has a devastating effect on the financial future of not only the two of us, but our kids and extended family. If this escalates, we will be forced to seek damages due to the significant damage this administrative error has done to our family. While the knee-jerk response is that we're only allowed one " rehab '', this is not a " rehab '' situation - this was an administrative error by XXXX. This is not a typical situation, so we need atypical attention and resolutions. We hope that we can resolve this through the CFPB 's process, without having to hire a student loan attorney, which is the last resort for all party 's involved. We don't want this to be an adversarial situation at with American Student Assistance at all! This was a servicer administrative error ( admitted by them ) that ultimately went haywire. We can both acknowledge where the disconnect was, even if we disagree on who is primarily responsible for the administrative error.

I have had long standing problems with my student loan servicers going back years. I do not have any documents from the origination of these loans and in fact do n't recall ever receiving any. I recently learned that all the loans are listed on XXXX XXXX XXXX website www.nlds.ed.gov. so I looked them up and started researching. One of the loans is a XXXX XXXX XXXX oan for {$1500.00}. disbursed on XXXX . Evidently it 's for " Financially Needy '' persons ( See generally 34 CFR 674.1 Purpose and identification of common provisions ). " ( a ) The XXXX XXXX XXXX XXXX provides low-interest loans to financially needy students attending institutions of higher education to help them pay their educational costs. '' I do not believe this is or ever was my loan for the following reasons : 1. ) I was not " financially needy '' at the time. My husband and I were in the process of purchasing our first home at that time and we completed the purchase in XXXX XXXX 2. ) We were both employed and earning above average income combined ; and 3. ) It 's unlikely I was enrolled for classes that semester because I was pregnant with my third child ( born XX/XX/XXXX ), my other children were age XXXX and XXXX , all while working and buying a house. The FSA reports that I defaulted on XX/XX/XXXX and paid it in full on XXXX . I have no recollection or record of this and in fact it looks like this amount was rolled into the consolidation loan I obtained and which is the subject of dispute with the servicers. Also, I was surprised to find that my status on Federal Student Aid says " Withdrawn '' and has not been updated to " Graduated '' ( my graduation was on XXXX XXXX XXXX ). Very odd. Stranger still, as I look through the files the documents report my school name as " unknown '' ; and there are multiple account number references. It appears that there is actually more than one " consolidation loan ''. Communications I have received from American Student Assistance Corp. references at least XXXX different " XXXX ID # 's. The first is XXXX , and it lists the servicer as " XXXX XXXX XXXX XXXX '' whom I have never had any loan with and have never been contacted by. The second is XXXX , the servicer is ACS who I had many problems with, and the third is XXXX , also lists XXXX as the servicer. The original problem with the servicers started when I had a financial hardship and requested assistance. They never responded for months until after they notified me of " default '' and then I was 'approved ' for a " rehabilitated loan '' by XXXX XXXX however the documents they sent were " consolidation loan '' documents. I have the original unsigned documents in my file still. I also found a document dated XXXX XXXX rom XXXX that reports a consolidated loan was in forbearance for 73 months. I 'm pretty sure this exceeds the maximum allowed by the DOE regulations and it was my understanding that I was not in forbearance. Finally and importantly, many of the documents they send do not contain ANY account numbers so I have no way of knowing what account ( s ) they are alleging I owe $ $ on. I suspect they are fabricating new loans and possibly using these loans to collect from the guarantor while never disclosing this to me. Essentially, its ' identify theft.

My school closed. It was owned by XXXX College. I first attended when it was XXXX College and then it became XXXX XXXXXXXX University. I attended from XX/XX/XXXX through XX/XX/XXXX, graduating with an XXXX XXXX in XXXX XXXX and XXXX. I started a family and took time off. I returned from XX/XX/XXXX through XX/XX/XXXX. I accumulated approximately {$35000.00} in Federal student loans. Prior to my last quarter to receive my XXXX XXXX, I began contacting other colleges in the XXXX XXXX area such as the University XXXX XXXX Florida so that I could receive my XXXX XXXX from a better known university. I was shocked by what I learned and so discontinued attending XXXX and did not complete my XXXX program. The reason was that while XXXX had told me again and again that my credits would transfer to any other college that I would want to attend, I learned that not only would I have to retake not only my entire XXXX program but some of my XXXX program as well. I was also told XXXX had employment programs for graduates but as it turns out those programs never existed. I was also never counselled on how my student loans could ever be repaid after graduation. I was furious and sought legal help but no one would help me so I just turned my back and walked away. Once I walked away from XXXX that was that as far as I knew. Until not long ago. A few months ago, I was in need of an official college transcript for a job offer. In my attempt to contact Florida XXXX University, I found that the school had closed, became XXXX College, closed again and is now XXXX XXXX XXXX. I contacted XXXX XXXX XXXX and I was able to receive an unofficial transcript but this is not what was needed. After several weeks of contacting XXXX again and again, I was told that while there is a record of my attending XXXX, there is no record of my XXXX and so I could not obtain an official transcript. Needless to say, I did not get the job. My degree is worthless! Since then, I found that XXXX College had been sued in a class action suit, which failed, and also by the CFPB. I just learned that the CFPB had sued and won a settlement against XXXX College in XX/XX/XXXX but XXXX had filed bankruptcy and so CFPB has never collected. I do not feel that I am able to legitimately able to continue using this college information on my rsum as I can not prove that I XXXX yet I have student loans to repay, which are almost double what they were when I XXXX. I do not feel that I should be responsible for these student loans because I feel that I was defrauded. I have nowhere else to turn. I have twice submitted complaints to the U. S. Department of Education, ( XX/XX/XXXX and XX/XX/XXXX ), but have received no response and do not expect to. I also reached out to my lender but was told it could not help me because the school closed after I had XXXX. Is there anything that CFPB can do to help me?

American Student Assistance ( ASA ) and the U.S. Department of Education have been attempting to collect on an alleged federal student loan in the amount of {$5500.00} ( XXXX ) with no valid promissory note. The law explicitly requires that any electronically signed notes are not acceptable unless there is proof that an electronic signature was affirmatively authorized. I have been attempting to obtain a valid note for years with no resolution. I have now written more than 20 letters since XXXX regarding the alleged loan requesting a copy of an actual signed promissory note or proof that I affirmatively authorized an electronic signature, but they have not been able to produce either. All they can provide is a note with the typed words Electronic Signature on File. No note - no debt. They are ignoring my repeated requests and have filed a garnishment with the Social Security office and funds are being deducted from my monthly Social Security check. They attempted to garnish an income tax refund, but it was denied. The alleged debt is invalid with no promissory note or proof that I affirmatively authorized an electronic signature. Also, the alleged debt has now grown considerably with interest over the years as ASA and the U.S. Department of Education are stalling and can not produce a valid note. Another rather suspicious problem is that the loan holders and loan numbers have continuously changed over the years making it very difficult to follow any accounting of the alleged loan. There is also an alleged loan with the Florida Department of Education for which they can not produce a valid note either. It would seem likely that this issue may have potential as a class-action lawsuit. I am probably not the only person dealing with invalid promissory notes from ASA and the U.S. Department of Education.

Im not sure who to take this to anymore, but Ive disputed this account several times with both the original creditor and the credit reporting agencies accordingly and Ive attached everything to support my dispute. However, I continue to received a pre-template letter sent to me that its been verified and it REMAINS. How is it possible that this was verified if you continue to report incomplete, inconsistent, inaccurate, and unverifiable information on this account and a thorough and in-dept investigation. Ive disputed and I havent received anything as such, but it continues to be reported in violation of the consumer laws. Continues to report wrong balance, incorrect date of first delinquency, wrong date of last active, inconsistent payment status, high balance and actual balance is questionable, etc. I believe that section 609 of FCRA also allows me to ask for detail information about the account and how you indeed investigated and your detail process. Im extremely upset and shocked about the way this charge-off account is reporting on my credit report which continues to report with incomplete, inconsistent and unverifiable Info. How can you honestly say that you verified as it being accurate? This was NOT verified! I am requesting this investigation under the authorization of the Fair Credit Reporting Act Section 623. ( a ) ( 8 ) ability of consumer to dispute information directly with the furnisher. What I am disputing : The account you have reported to the three credit bureaus. In 1987 I took out a loan and it was about {$14000.00}. I let it go into default due to some personal circumstances. I recieved a letter stating that it was in default and I owed {$17000.00}. When I took that loan out, it stated if it went into default, it would be up to 25 % penalties and interest. It did not say, 25 % penalties and interest plus 20 % interest until it was rehabbed and then they would add more and more to it. Now ASA ( American Student Assistance ) have recently hired Performant to collect a separate debt I have not taken out or agreed to pay. The only paper work they have been able to provide is a fuzzy print document with pages missing. ASA claim I agreed to this loan but this is not true, nor have I ever seen the document before. If I had agreed to such a large loan there would be a copy of a loan agreement with my personal signature on it. I need them to stop garnishing my wages for this immediately. They have tried to get me to actually agree to pay this loan I know nothing about and I absolutely did NOT agree to it at any point in my life. This is not reasonable that someone can just " show up '' and say I owe them {$160000.00}! it is illegal and extortionate. I did NOT " electronically sign '' nor did I agree to consolidate or any such nonsense. Now ASA has been garnishing my wages through XXXX for the past year. If they won't provide an actual document to me proving the debt is legitimate, why are they allowed to garnish my wage? I had defaulted on a FFEL Consolidated loan in XX/XX/XXXX. The loan was then turned over to a collection agency. I have been on a payment plan with this collection agency for 21 years, and I have not missed an agreed upon amount payment, but my loan is still showing to be in default status. XX/XX/XXXX I rolled my husband 's and my student loans in to a consolidation with promises of a 3 % intrest rate with American Student Assistance, that never happened. They made prmises they did not keep. On or about XX/XX/XXXX, I requested a forbearance or delay in paying my student loans due to unemplyment and homelessness. I had a XXXX XXXX so I would get my mail. I thought everything was ok and that I got my forbearance. I began working in XX/XX/XXXX, my second paycheck was garnished with no warning. Found out it was American Student Assistance and they started taking a quarter of my wages. Saying my loans were in default. Called them to find out why ... they said the forbearance was denied because I had no phone number I explained I was unemployed and homeless. They said my loans were in default and wages would continue to be garnished. I tried to resolve the issue a couple times stating my wage amounts and what I could afford and did not know what else to do. I believe that the loans were never in default. Also in the last ten years I have never once received a bill or any statements for amounts they received or took other than my wage stubs and tax lien notification from IRS. They have never sent interest paid amounts for tax purposes. I know they have had my address because I received privacy notices.

American Student Assistance purchased this debt from XXXX and decided to temper with the original dates. I contacted XXXX to inquire about the date of delinquency in this account which was the first day after I missed a payment XXXX XXXX 2009 and should have been reported within 90 days .this account should be in default After I did n't make a scheduled payment for a period of 270 Days from last payment according to federal Regulation. I included documentation for payments schedule and proof that XXXX got no payment past the date stated above and admitting to the last payment date ... American Student Assistance provided fraudulent information to the credit agencies to default the loan at a later date so the status of limitations can be changed giving them a longer time to try to collect. Negative account information should not be reported after 7 years from the delinquency date which was XXXX XXXX 2009. Yet till this day American Student Assistance is posting negative information and their customer service is unaware of federal regulations and ignore my submitted documents that I provided. American Student Assistance should remove all negative information from all credit bureaus since the delinquency date was more than 7 years and no payment have been made since. Legal action will follow for this fraud.

In XX/XX/XXXX, I had a student loan debt consolidation with XXXX XXXX that included XXXX and American Student Assistance loans. My XXXX loans were sold to American Student Assistance in XX/XX/XXXX or XX/XX/XXXX. I sent these creditors debt validation letter 30 days ago asking for your company to provide me with proof that I own this debt, and these companies has failed to respond.
