On XX/XX/XXXX I requested to open a merchant bank account from : XXXX XXXX XXXX/XXXX XXXX Agent XXXX office XXXX fax XXXX customer support XXXX XXXX I completed the required XXXX XXXX application for : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, PA XXXX ( XXXX ) XXXX I was subsequently issued a XXXX XXXX XXXX XXXX portal for processing credit card transactions. The merchant bank account was subsequently attached to my business checking account for automatic deposits and withdrawals. For unknown reasons XXXX/XXXX XXXX was unable to withdraw their monthly fee from my business account for statement month XX/XX/XXXX which I was not aware of until I received a letter of collection from them stating such in mid XX/XX/XXXX ( no pro-rating fees even though my account was only active since the XX/XX/XXXX ). I immediately contacted customer service at the phone number provided and was able to pay this billing cycle fee over the phone. I requested the account be checked into and verified with XXXX/XXXX XXXX and I was informed everything checked out on their end. I then had things looked at through my bank in order to make certain it was not anything on my end that wasn't allowing the withdrawals to take place and also to make certain I could receive credit card deposits. My bank stated everything looked good for my business checking account with no blocks or holds of any sort. I did not contact XXXX XXXX at this time. I received another letter of collection for the subsequent statement month of XX/XX/XXXX and immediately called the number again. This time I was able to have this billing cycle fee waived. I then put an online support ticket into XXXX asking how I was able to pay my service online instead of having to wait for a letter of collection to come in the mail. I wanted to be proactive and pay when I received my monthly statement. I was informed everything was automatic withdrawal from my business checking account. I then called XXXX XXXX and explained the situation to him and asked him to check into things. XXXX asked me to be patient while he checked and that he would call me back. While I waited I phoned my bank again to see if everything with my business checking account was fine and it was. XXXX called me back and stated that everything looked good on their end and provided no explanation of why XXXX/XXXX XXXX was unable to collect their monthly fee from my bank account. He also informed me he would do some more searching with the company to check on things and hopefully not have the problem reoccur for XX/XX/XXXX. I told XXXX I could not have this happen again that I have good credit and this was completely unacceptable, that I was not the one at fault and was doing everything I could to keep things in good standing with XXXX/XXXX XXXX. I told him I should not have to be calling every month in answer to collection letters and trying to get fees waived or to give XXXX/XXXX XXXX my money. If it happened again I would have to close the account he told me he understood, that if it came to that he would help me to get my early cancellation fee waived. I said that was fine and I would wait through one more statement cycle. The same thing happened again for the statement month of XX/XX/XXXX. I immediately called the collections phone number and was able to have this fee waived again and this time I put an online support ticket into XXXX directly to close my account. I then immediately called XXXX and left a voicemail which thereafter I sent him an email stating I was closing the account. XXXX sent me an email back requesting I contact him so we could discuss the early termination fees. I called him and gave him an earful upon which he said he would do what he could to cancel anything I owed, but I would have to contact the online customer support immediately and request the account not be closed on their end. XXXX stated he would not be able to have the early cancellation fee waived if they did it on their end and that he had to do it. So I did as XXXX told me and submitted another online support ticket requesting my account NOT be closed on their end right there while XXXX was on the phone with me. XXXX assured me he would take care of things and would contact me once it was handled so we ended our conversation at that time. I never heard back from XXXX again. Even though XXXX stated to me he would contact me once things were resolved on his end and the merchant account was closed with the early cancellation fees being waived I never heard from him again. I did however receive an email XX/XX/XXXX showing my XX/XX/XXXX statement as having the account cancelled and showing the early cancellation fees waived. Out of the blue on Tuesday XX/XX/XXXX I receive a phone call from : American recovery Services Incorporated XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, CA XXXX I spoke with an XXXX XXXX who asked me for my personal information and stating she needed to verify who I was. I told her that I wanted her information and was not going to give her my personal information. She informed me she was from a collection agency ARSI and calling for their client XXXX XXXX XXXX whom I have never heard of before and that my business entity owed them {$590.00} and they had turned my account over to her company for collection. I was in shock and yelled at her stating I did not owe anyone anything for any reason and then asked for her contact information so I could get back in touch with her. I received her email address - XXXX - and phone number XXXX ext. XXXX - to contact her directly after I did some searching through my records, knowing that the only account my business had ever opened up was the merchant account with XXXX/XXXX XXXX I knew I had never done business with a XXXX XXXX XXXX. I dug through my emails and correspondence and verified my merchant account through XXXX/XXXX XXXX had in fact been cancelled, closed and the early cancellation fee waived according to my records. After thinking about things I thought this collection activity might be a fraud attempt so my wife and I researched fraudulent collections that night upon which we determined this was probably a scam. Since I gave no personal information over the phone I didn't think much about it any further until I receive a collection notice in the mail yesterday dated XX/XX/XXXX, 5 days before the phone call. All of the information XXXX said to me is contained within the letter pertaining to XXXX XXXX XXXX and the amount of {$590.00} owed along with a reference number and their account number for me. In looking through my records I am able to determine the reference number ARSI has for the XXXX XXXX XXXX account is the exact last 5 digits of my previous merchant number for XXXX/XXXX XXXX and the name they have for me/my business is identical to my account name I had with XXXX/XXXX XXXX. UPDATE : XX/XX/XXXX : I have contacted XXXX/XXXX XXXX multiple times as of now and every representative tells me that they can not help me and that I need to speak with collections. Upon being transferred over to XXXX/XXXX XXXX collections I am informed that I need to speak with ARSI collections company as everything is out of their hands. XXXX/XXXX XXXX XXXX is rude and not helpful at all. After speaking with XXXX/XXXX XXXX XXXX I was finally able to reach XXXX XXXX today by marathon calling his phone number where he then informed me not to worry that this would just go away by itself, but also that he had no recollection of asking for the fees to be waived at all or in fact of who I was or any of our previous conversations. XXXX obviously does not care at all what happens or about any of this. I should have never corresponded with XXXX over the phone and should have only corresponded with him via email so that there was a written record. Shame on me. When I contacted ARSI today they were actually the nicest company to speak with and were surprisingly pleasant to me. I was not able to reach XXXX whom called me originally and spoke with another lady whom I did not catch her name. After speaking with them they said they had submitted a complaint to XXXX/XXXX XXXX on my behalf after the initial phone conversation I had with XXXX. I attached my XXXX/XXXX XXXX statements to an email I sent to XXXX at the email address she provided to me to show them the account had been paid. The other lady I spoke with said she would follow up with her and that it might take just a little bit to hear back from them so please be patient, but I would hear back as soon as they were able to provide me with any updates.

To : CFPB RE : Disputing Fraudulent charges I am writing this letter to make a formal complaint and dispute to XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, NY XXXX for making about 10 unauthorized charges to my checking account affecting me because I received overdraft charges of {$35.00} each. By XX/XX/XXXX I tried to use a new merchant company I contacted XXXX XXXX XXXX within 3 business days I didn't like their services and I decided to cancel it ; to proceed with cancel service I have to return the merchant device and closed the account I did returned the equipment but also they advise me that I had to get in contacted with XXXX XXXX XXXX XXXX that was the main merchant company for XXXX XXXX. Immediately I contacted them by phone to cancel my services, after while I stared getting charges under the name of XXXX and I contacted my personal bank they gave me a phone number I called them but they sounds to be a different company and no idea about me? and they couldn't help me, in the mean time those charges was made to my account, then by XX/XX/XXXX I received a collection letter from XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX California XXXX Phone : XXXX for the amount of {$530.00} Ref # XXXX under the name of XXXX XXXX XXXX XXXX I contacted them and this was in connection with XXXX XXXX XXXX XXXX I spoke with XXXX Ref # XXXX she explained me that they are trying to collect a debt on my name XXXX XXXX XXXX XXXX XXXX ) I advised her that I have not relationship with XXXX XXXX XXXX XXXX for long time, and inclusive I returned equipment ( device to charge credit cards ) that I have no records of services with them, she personality verified what I was saying, and she tried to do conference call with XXXX XXXX XXXX XXXX to clarify this annoying and incorrect procedure from XXXX XXXX XXXX XXXX AGAIN! @ XXXX but it was unsuccessful to get a person over the phone and left few messages to them explaining why I need them to stop charging for a service that It doesn't exist, until today nobody has contact me and I really concern because I can lost my checking account getting overdraft fees. Please I really appreciate your attention on this matter. I really want to proceed with formal complaints to these companies, and clarify those fraudulent charges and avoid that this collection company record any negative records in my credit report.

The following statement consists of the information on the matter of the XXXX XXXX account that we have gathered so far. After the statement there will be a few items we would like you to address. The XXXX XXXX statements that were emailed to us lists our address as a p.o. box address in XXXX XXXX S.D. However, we have never lived or even visited XXXX XXXX S.D. When we looked further into that p.o. box online we discovered an additional p.o. box in XXXX V.A. we were also unaware of. When we researched the new p.o. box we discovered an unknown owner that shared the p.o. box in XXXX and owned another p.o. box that shared a close proximity to the XXXX XXXX p.o. box. We have never received any statements prior to those you sent, upon request, thus we had no prior knowledge of the account until your company called. According to XXXX XXXX, payments were made from XXXX, XXXX through XXXX, XXXX, with payments ending on XXXX, which corresponds with the information you provided. However, our bank has no record of either themselves or us, the account holders, stopping the automatic payments. Additionally XXXX XXXX shows payments being made on XXXX and XXXX of XXXX but there is no record of payment for those two months in our bank records. Finally, XXXX XXXX states that the payments should have been XXXX XXXX dollars but the XXXX XXXX statements you emailed to us only show XXXX XXXX dollars as payment due. In conclusion we have several requests for you to look into. And they are as follows. 1 ) We request a list of all purchases made since the opening of the account in XXXX till the last purchase made in XXXX of XXXX. 2 ) Find out why the account was closed and who authorized the closure. 3 ) What is the location where the account was activated in XXXX.

XXXX XXXX after review those financial XXXX XXXX re -submit the account in 24 hour and re- open the account.. just because at the time the CPA have not prepare the Tax retune for the year XXXX. the representatives for XXXX XXXX stated that the reason for close the account and for the request for the statement was because my husband 97 % of the charge on the card. he is my husband and he run the company he make the money. I ask XXXX XXXX why they cancelled all of my account. with my income being XXXX and retire income is XXXX per year and we have more XXXX a total of home hold XXXX with over XXXX XXXX in asset.. and they already have this information on file. they could never give a good reason but your husband charge 97 % of charge. but they just took XXXX membership fee from us on the statement the first of the year .and then turn one of my account over to a collection agency a company by the name of American recovery service inc , why? for a XXXX bill that they cause not to be paid check the record never late never missed all paid my membership fee ever year. this is wrong on so many level. this harassment and discrimination, I believe this is a violation of one age just because I turn XXXX year old but I still work XXXX hour a week just pay my bill.

I am a small business owner who had a merchant account with XXXX XXXX XXXX XXXX, whos headquarters in XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, GA XXXX. They closed my account in XXXX of XXXX and sent me a statement in the amount of {$120.00}. When I contacted them, they told me that the actual amount is {$21.00}, but they added the {$100.00}, which is a collection fee. That was the very first time that they have sent me a letter and requesting the amount of {$21.00}, and I dont even know why they added that {$100.00} collection fee ( they are not even a collection agency ). Later on, on XX/XX/XXXX I received a letter form ARSI ( American Recovery Service Incorporated XXXX which is a collection agency, demanding me to pay {$110.00}. When I contacted them, they told me that this is a collection that was referred to them by XXXX XXXX XXXX XXXX. I have never been contacted, received bills or demand letters by XXXX XXXX XXXX XXXX XXXX XXXX ) about this amount, yet they directly transferred this amount to ARSI for collection. When I tried getting some answers from XXXX, they told me that they can not provide me any information about this debt, including what it is for, why wasnt I contacted and received any statements. I told them this is my right to know what this payment is for, but they refused to give me any explanation. I feel like XXXX and ARSI are they just extorting people without giving them any reason or explanation. I dont even know why I owe them money? They can not do this to people and not be accountable for. I wouldnt be surprised if ARSI and XXXX have common interest in the final collection amount, or they might even be affiliated companies.

This complaint is a follow on from a previous complaint # XXXX. That complaint detailed an illegitimate debt collection from a collection agency on a card that was issued by XXXX XXXX. That agency apparently is no longer involved. Recently I was contacted by another collection agency American Recovery Services Incorporated, XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, CA XXXX to whom collection of that debt was recently transferred. After receiving a notification letter of an attempt to collect a debt I immediately contacted them XXXX and notified them that I was not responsible for any unpaid balance on an XXXX XXXX card. The card account in question ending in XXXX was issued to XXXX XXXX XXXX XXXX XXXX. I was a XXXX of this business which is a corporation. The business suffered financial collapse in 2017 and has subsequently been dissolved. I have never personally been issued an XXXX XXXX card, however XXXX is now attempting to collect this unpaid balance ( on behalf of XXXX XXXX. This is illegitimate collection effort. A corporation serves to provide a barrier between actions of the corporation and the owners. Debts owed by the corporation are not transferable to the individual owners. I notified XXXX about the circumstances of this debt and demanded that they provide some form of documentation demonstrating that I was responsible for this debt, otherwise they should immediately cease all collection efforts. No documentation was ever provided. I again contacted XXXX to request cessation of their efforts but they failed to respond. Their collection efforts continue to occur.

XXXX / XXXX XXXX is misreporting a balance on a settled charge-off account. They apparently have also either sold the account or have hired an outside collection agency to collect on their behalf a balance which should have been forgiven per the settlement agreement. On XX/XX/XXXX, I sent XXXX a letter requesting a settlement along with a check. They cashed the settlement check, and payment was posted from my account on XX/XX/XXXX. On or about XX/XX/XXXX I received a response letter from XXXX stating that they were unable to identify my account, and were requesting information so they could apply the payment correctly. On XX/XX/XXXX I faxed over all of the requested information to them. After nearly a month with no response, I attempted to call them several times and could never get in touch with someone to discuss the situation. I left several messages and got no response. On XX/XX/XXXX I sent via certified mail the entirety of the information they requested that I had faxed on XX/XX/XXXX. I have yet to hear a response. On XX/XX/XXXX I received a letter from ARSI, a collection agency, stating that the account had been listed with them for recovery. The balance stated on the collection was not the original charge-off balance, but rather the original balance minus the settlement amount that was agreed upon. XXXX has not held up their end of the settlement agreement, and is attempting to collect on a balance that was forgiven per settlement agreement.

In fact, recently, i : did an investigation and found out that my identity has been stolen. I, XXXX XXXX entered into a consumer credit transaction with XXXX XXXX. A consumer credit transaction is a transaction in which a finance charge is involved. Pursuant to 15 use 1605 a finance charge is the sum of all charges in a consumer credit transaction. Because I know the finance charge is the sum of all charges I was not expecting a bill.XXXX XXXX sent me a bill which is a violation of 15 USC 1692b. XXXX XXXX also sold my account over to AMERICAN RECOVERY SERVICE INCORPERATED which they are now attempting to collect this allege debt. Which is now reporting to my credit reports which are in violation of 15 USC 1692 ( d ) 1 and 15 USC 1681a ( 2 ) b, hurting my reputation by not excluding this from my my credit report. AMERICAN RECOVERY SERVICE INCORPERATED is also in violation of 15 USC 1692j for furnishing certain deceptive forms trying to collect debt not owed to them ( See attachment Exhibit! ). AMERICAN RECOVERY SERVICE INCORPERATED Is also in violation of15 USC 1692b ( 5 ) for putting their logo on the document ( Exhibit A ). I kept receiving emails from ARSI ( American Recovery Services Inc. ), about a debt I have never heard of. The email says I need to pick a payment option. I tried to unsubscribe from the emails, thinking it was a scam, but I kept receiving emails. On XX/XX/2023, I went to their website and disputed the debt, stating that it is not my debt. I have not gotten any response to my dispute, but I keep receiving the same emails. I called the number in the email and left a voicemail explaining the situation, but still got no response to my dispute, and the emails kept coming. I called the number again today, XX/XX/2023, and spoke to someone who would not give me information unless I verified I am the person on the account, by giving her personal information. The research I did on incorrect collections, said not to give them that information because they can use it to create false records of the debt, making it harder to disprove, so I did not give her any information that was not in the email they sent me. I have no information about the debt they are claiming, and they have yet to send me any information.

I was a victim of identity theft and my consumer rights are being violated. XXXX XXXX and American Recovery Services Inc ( ARSI ), are attempting to collect an alleged debt that I do not owe. I have provided XXXX XXXX with the FTC Identity Theft report and have sent them more than enough proof to relieve me of this alleged fraudulent debt. I have attached the documents. It is unlawful that these organizations are colluding together to take advantage of me and attempt to collect this alleged debt which I have informed them multiple times that I do not owe them any money. They are also ruining my general reputation by reporting these fraudulent accounts that are not mine to the credit reporting agencies. The are committing deflation of character against me. I need support and I am going to be forced to take legal action if I do not get help. These big companies are harassing me and abusing their power! I will not back down, please help me. My consumer rights are being violated according to the FCRA and FDCPA

I found out that there was loan under my name from company called XXXX XXXX. Couple months after, my credit point dropped over 100 points, and I started calling credit companies, XXXX, XXXX, XXXX to dispute for this amount. I have never requested personal loan from XXXX XXXX, nor received money. I tried call this loan company, but it is unreachable by phone. I sent an email and they sent me a letter which didnt explain anything about my concern. Therefore, I filed a complaint about this fraud on police department in XXXX, TX. I am guessing someone stole my identity. I have received a letter from a collection company called American Recovery Service Inc. which amount of {$13000.00} on XXXX, XXXX, 2020. Debt collector sends me a letter asking for a debt that I do not owe and is not mine. Gives me 30 days to respond. I sent a letter telling debt collector that I do not owe but do not understand why collector keep badgering me and I feel harassed. Collectors have even called my wife! I ever owned a XXXX XXXX. I have gotten calls for years about this type of amount. I do not know why the collector or XXXX think I owe them money. I wonder how many other people are being badgered? Some action needs to be taken to stop this bad behavior. I did work for a company that had COMPANY credit cards and was an accountant who processed transactions FOR THE COMPANY. When I was an accountant, there were no past due amounts for any credit cards.

On XXXX separate occasions in XX/XX/2021, American Recovery Service made hard inquiries on my XXXX credit file. According to federal law ( Fair Credit Reporting Act 15 USC 1681b ), it is unlawful for an entity to view a consumer 's credit report with a permissible purpose. On XX/XX/2021, I mailed written correspondence asking for that purpose, but never received a direct response. I did not apply for employment, nor did I apply for credit with American Recovery Service. These unauthorized hard credit inquiries constitute XXXX FCRA violations of willful noncompliance, and XXXX FCRA violations of negligent noncompliance.

I am seeking a letter containing the lump sum, how to pay any lump sum, including the ARSI account number, and where to send any payment, with a cashiers check sent certified mail. I do not get through to anyone who can provide this information, so far, in 2 weeks of trying. I mailed a priority mail ( tracked ) letter two weeks ago, seeking information in writing. I am still waiting for it. XXXX wont take money and cant or wont provide an account number to even access the ARSI website to allow payment, despite XXXX not selling the debt ( based on calls to XXXX ). I received a letter form ARSI Collection agency, they are collecting an account on behalf XXXX XXXX, the letter is an opportunity to resolve my account for less than the balance owned, the offer is good until XX/XX/2020. I called the collection agency and they informed me XXXX recalled the account from their office.
