In XXXX 2014, I purchased my XXXX home using XXXX ( XXXX ). In XXXX 2015, American Portfolio Mortgage ( APM ) became the servicer. I paid my mortgage on time but APM is threatening foreclosure and late fees. Here is what happened:XX/XX/XXXX : I mailed my XX/XX/XXXX mortgage payment to XXXX. It cleared XX/XX/XXXX. ( Attachment # 1 ) XX/XX/XXXX : XXXX sent Notice of Servicing Transfer to send my XX/XX/XXXX payment to APM, stating, " Under Federal law, during the 60-day period following the effective date of the transfer of the loan servicing, a loan payment received by your old servicer on or before its due date may not be treated by the new servicer as late, and a late fee XXXX not be imposed on you. '' ( Attachment # 2 ) XX/XX/XXXX : XXXX sent letter saying it would stop accepting payments XX/XX/XXXX, and APM would start accepting payments XX/XX/XXXX. ( Attachment # 3 ). XX/XX/XXXX : I mailed XX/XX/XXXX payment to APM. It was Received XX/XX/XXXX and cleared XX/XX/XXXX. ( Attachment # 4 ) XX/XX/XXXX : APM sent notice to send payments due after XX/XX/XXXX to APM and advising " in order to receive the rights and protections afforded to you by RESPA for Notices of Error and Requests for Information, as outlined in this letter, you must send your written correspondence only to the following address ''. ( Attachments # 5 & # 6 ) My name was misspelled. XX/XX/XXXX : APM sent statement warning, " You are late on your mortgage payments. Failure to bring your loan current may result in fees and foreclosure - the loss of your home. As of XX/XX/XXXX, you are 57 days delinquent on your mortgage loan. '' It showed an amount due of {$2900.00} [ 3 payments ] and stated, " If payment is received after XX/XX/XXXX, a {$29.00} late fee will be charged. '' ( Attachment # 7 ) XX/XX/XXXX : I wrote APM that my name was misspelled and my account was NOT delinquent, enclosing copies of my XX/XX/XXXX and XX/XX/XXXX checks and my XX/XX/XXXX payment. ( Attachments # 8 & # 9 ) I sent letter return receipt requested with copy to XXXX. XX/XX/XXXX : APM sent notice my " inquiry '' had been sent for review. ( Attachment # 10 ) XX/XX/XXXX : APM sent statement correcting my name but claiming I owed {$1900.00} [ 2 months ] for XX/XX/XXXX, and showing XXXX items for " Reversal for Returned Check '' - {$990.00} and {$1100.00}. ( Attachment # 11 ) I do n't know what these are. {$990.00} is my regular payment. {$1100.00} is shown on XX/XX/XXXX statement as " escrow payment ''. The statement warned, " If payment is received after XXXX/XXXX/15, a {$29.00} late fee will be charged. " XX/XX/XXXX : APM sent a letter stating my XX/XX/XXXX payment was not applied until XX/XX/XXXX, my XX/XX/XXXX payment was not applied until XX/XX/XXXX, and my XX/XX/XXXX payment was applied on XX/XX/XXXX. It said, " your XXXX 2015 payment was reversed from your account on XXXX XXXX, 2015 due to a stop payment placed on this check .... funds in the amount of {$990.00}, were reapplied as your XXXX 2015 payment. Thus, as of the date of this letter your account is due for your XX/XX/XXXX payment '' ( Attachment # 12 ) I could n't have stopped payment on XX/XX/XXXX, because the check cleared my bank XX/XX/XXXX. I made my XX/XX/XXXX and XX/XX/XXXX payments to APM on time and have the cancelled checks to prove it. I have been harassed by phone calls from APM. On XX/XX/XXXX I got a call but was advised on XX/XX/XXXX it was in error. On XX/XX/XXXX I got a call about a late payment. I stated I did not owe any payments and had already notified them in writing. I was told my account was still in research. On XX/XX/XXXX APM called my work, even though I had requested all communications be in writing. When I returned the call on XX/XX/XXXX, Collections told me there was a stop payment on a check. I told her I had been with APM only 2 months, had cancelled checks for both months, and the check was not mine. I do not understand what is happening. I have always paid my mortgage on time but am worried about late fees, foreclosure, and a bad credit rating, all through no fault of my own. I hope the CFPB can help me resolve this problem

Originally, my loan was being serviced by XXXX. I received a letter from XXXX dated XXXX XXXX, 2019 stating as of XX/XX/2019 our loan would transfer to XXXX. XXXX XXXX XXXX and I would receive information directly from them about the processing of my mortgage payments. As of XX/XX/2019 I had not heard from XXXX. XXXX. I began calling their offices, citing the letter from XXXX. On or about XX/XX/2019 I was escalated to a supervisor who informed my that my loan was sold again ( before any processing at XXXX. XXXX ) to American Portfolio Mortgage and I would receive additional information from them. On or about XX/XX/ 2019 I began calling American Portfolio Mortgage to locate my mortgage loan. I was advised repeatedly they would send a letter. I called about 2-3 times a week, seeking information on where to. I was told they did not have the loan and not to worry, there would be no late fees or issues once they did have the loan. On or about XX/XX/2019 I received a letter from American Portfolio Mortgage acknowledging my mortgage and providing an old loan number as well as a new loan number. The letter stated American Portfolio Mortgage would begin subservice on our mortgage under contractual agreement on XX/XX/2019. I called them and was advised it would take 10 business days for the loan to be entered. They provided a website I could check and that would allow me to set up my online account. I have called 9 times since that phone call, spoken to three supervisors ( two of which escalated and someone was suppose to call me back in 24 hours ). I have checked the website at least 3 times a week. My last call was today to a supervisor who advised she couldnt understand what was going on. To date ( despite paying into the escrow to cover these charges ) I have had to pay my house insurance premium and my property taxes out of pocket. My mortgage has now not been paid in 4 months because the account can not be locate.

My VA loan was transferred to American Portfolio management on XX/XX/XXXX. The loan was in COVID forbearance which was due to end XX/XX/XXXX. I requested a VA disaster relief modification toward the end of XXXX by phone. I sent an email on the servicer website on XX/XX/XXXX to ask about the status of the modification. The automated response was " Dear XXXX XXXX XXXX and XXXXXXXX XXXX XXXX : We received your message dated XX/XX/XXXX, regarding your modification. We are sending this response via email as our messaging portal is temporarily unavailable. We apologize for any confusion or inconvenience this may cause. Your account was service transferred on XX/XX/XXXX, this also transferred your pandemic forbearance effective XX/XX/XXXX, through XX/XX/XXXX. Your account was approved for a forbearance with a XXXX-payment requirement with our Loss Mitigation Department XXXX As of the date of this message, you are still working with our Loss Mitigation Department. If you have questions about your forbearance or any additional payment assistance, please contact our Loss Mitigation Department at XXXX. If you have any further questions or concerns, please feel free to contact our Customer Service Department at XXXX, or you may respond directly to this message. Sincerely, Research Department '' I found out today that the call and the request for the modification were not documented properly and the modification request was not submitted by the loss mitigation representative.The person on loss mitigation I spoke with today told me she would submitthe modification request and that it would take 60-90 days to process. This should have already happened from my first request. I am livid, what is my recourse? Do I now have to wait an additional 3 months for this company to do what I was told would happen back in XXXX? I am stuck with this company until I make six consecutive payments and can refinance ( 3 more months ).

XX/XX/XXXX, American Portfolio Mortgage Corporation ( APM ) began servicing my mortgage account. This is the second time I have had to contact CFPB about APM 's mismanagement of my account within the past 3 months. I attempted to contact APM by phone to resolve this matter but was unsuccessful. XX/XX/XXXX, APM used funds in my escrow account to purchase flood insurance on my home ( See Attachment # XXXX ). At the time APM purchased this policy, I already had flood insurance, paid through XX/XX/XXXX. ( See Attachment # XXXX ) After APM purchased this unnecessary insurance for {$1100.00}, I was notified that I have a " Escrow Shortage Amount '' of {$1000.00}. APM advised me that the shortage " may result in an increase in [ my ] payment ''. ( See # XXXX ) APM 's " Escrow Account Projection For The Coming Year '' shows flood insurance in the amount of {$980.00} due in XX/XX/XXXX. ( See # XXXX ). This is further evidence that the flood insurance APM purchased XX/XX/XXXX was not warranted. The XX/XX/XXXX projected payments FROM my escrow account total {$3900.00} ( See # XXXX ). The XX/XX/XXXX projected payments TO my escrow account total {$4700.00}. This difference amounts to a {$790.00} surplus in my escrow account. ( See # XXXX ). The alleged escrow shortage projected by APM is a direct result of the flood insurance wrongfully purchased by APM XX/XX/XXXX. There is NO shortage in my escrow account, nor any basis for increasing my mortgage payments.

When COVID hit and mortgage companies were offering relief options I inquired with my lender, American Portfolio Mtg, however all they were offering was a few months of a break with a balloon payment at the end. This wouldn't do me, nor anyone experiencing a hardship any good. If I wasn't able to make a XXXX payment in a month what makes them think I'll have XXXX dollars 4 months from now? So I said " No thanks '' and it didn't make sense for me. Fast forward to last week when I'm applying for a new loan on an investment property and the lender tells me they can't give me a loan because my current loan is in forbearance. I was shocked and furious and called AMP. I was told that my loan had indeed been put in forbearance and that to come out of forbearance it would be around XXXX. That money wasn't an issue and I immediately wired them to bring my loan current through XXXX. The problem is that they put my loan in forbearance and now it shows that I wasn't able to make my payments. They advised me that they just turned off my ACH on my bank payments and that they get 10 calls a day from people in similar situations that were put into this program without their consent. Now I am unable to get a loan until AMP produces a letter stating that I did not agree to enter forbearance to resolve my issue with my current lender. Is this something that I can sue for?

I have a fixed rate mortgage with American Portfolio Mortgage Corporation. My fixed payment including XXXX is {$800.00}. The company is claiming they paid me too much out of my escrow reimbursement and withdrew {$1300.00} out of my checking account without my authorization. I called my bank immediately and disputed the charge and had it reversed. Then the mortgage company sends me a letter saying I owe them {$1400.00} as my next monthly payment and are trying to charge me a late fee and an NSF fee. My funds were not insufficient and the payment was on auto pay and was not late. They were not authorized to take any amount other than the {$800.00} agreed upon in my mortgage contract. I feel this is fraud and bullying and I 'm not going to tolerate it. If they want to provide proof that they overpaid my escrow and a full accounting of all my loan payments and it all checks out I 'd be willing to set up a payment plan with them to pay back their error but to take out almost double of my mortgage payment would have put me in a terrible financial position.

XXXX has received numerous letters from creditors XXXX XXXX and XXXX XXXX XXXX XXXX stating that the negative information on my credit report was false. In addition to this, I also have email correspondence from the creditors and XXXX has still not removed the negative information. I am a XXXX XXXX XXXX XXXX veteran in a wheel chair that will not be able to buy a house as a result of this!!

American Portfolio Mortgage does tax fraud by reporting late payments and dalinquincies that do not exist. They did this with my mortgage and said that I was late with payments after the mortgage was already paid off and for a period of time where the mortgage was already paid off and could not have been late.

I have letter from creditor directly and email correspondence, about the mortgage being late and inaccurately reported. The mortgage company also has a mortgage for XXXX XXXX and I've never bought a house for more than {$400000.00}. This negative information needs to be deleted immediately.

I have repeatedly reached out to American Portfolio Mortgage ( XXXX ). To transfer my LIN and they refuse to do so its been over a month. Which has hindered the progression of my court ordered refinance. XXXX XXXX has been very rude and will not comply. ( XXXX ) XXXX
