My mortgage was refinanced with American Pacific Mortgage in XXXX XXXX. In less than XXXX months American Pacific Mortgage transferred my loan to XXXX XXXX. ( See File 2, File 4 ). When my mortgage was initially refinanced with American Pacific Mortgage they made a payment of XXXX to XXXX XXXX XXXX to pay my homeowner 's insurance premium on XX/XX/XXXX. ( See File 5, File 6 ). This left a balance of XXXX in my escrow account. ( See File 1 ). XXXX XXXX returned the payment of XXXX to me in the form of a check because the bill for the premium was not due until XX/XX/XXXX and the amount American Pacific paid was incorrect as the XXXX was the amount that was due for the previous year. ( See File 3 ). I called the loan officer that refinanced my loan and explained the situation and that the check had been returned. He explained that since my loan was going to be transferred to the new mortgage company by the time the premium would be due that it would be best to cash the check from XXXX XXXX and deposit the funds from the check into my escrow account before the loan was transferred. So, that is what I did. I cashed the check into my checking account and made a payment of XXXX to my escrow account on XX/XX/XXXX. The funds were deducted from my account on XX/XX/XXXX. ( See File 8 ). After I made the payment of XXXX to my escrow account which already had a balance of XXXX, my new escrow balance was XXXX, XXXX. File 7 is a copy of the transaction and new escrow amount that was provided to me by American Pacific Mortgage. My mortgage was transferred to XXXX XXXX on XX/XX/XXXX. On XX/XX/XXXX, I went online to set up my monthly payment and noticed that my escrow was short XXXX. ( See File 9 ) On XX/XX/XXXX, I contacted XXXX financial to inquire about the negative balance in my escrow account. A representative explained that my homeowner 's premium was paid which left my escrow account short. I explained that my escrow account should have had a balance XXXX when the mortgage was transferred which meant that even if they paid my insurance premium of XXXX, my balance should be XXXX. The representative stated that American Pacific Mortgage only transferred XXXX when the mortgage was transferred. I then called American Pacific Mortgage and inquired with them about the missing funds. A representative from American Pacific claimed that they transferred XXXX to XXXXt when the mortgage was transferred and I was told I needed to call XXXX I, instead called XXXX XXXX with American Pacific Mortgage ont the line during a three-way call. The rep. from XXXX claimed that American Pacific only transferred XXXX and American Pacific claimed that they sent XXXX upon the transfer. Basically it was a finger pointing session and nothing was resolved. I asked American Pacific Mortgage how were the funds transferred, through check or wire. The representative from American Pacific responded that she did not know if it was a check or wire, but she knows the funds were sent to XXXX. Towards the end of the conversation both parties claimed they would look into the situation. I followed up with both companies on XX/XX/XXXX. My escrow account was still XXXX with XXXX. A representative from XXXX stated that they still had not received XXXX from American Pacific Mortgage and to date the only amount they had received was XXXX. I called American Pacific again with XXXX on the line and yet again American Pacific still claimed that they transferred XXXX on XX/XX/XXXX via a wire transfer, when the loan was transferred and therefore did not know why XXXX was missing. On XX/XX/XXXX, I called both companies to follow up on the issue and there has been no change. Both companies are still pointing the finger and playin the blame game, meanwhile no one can explain why my escrow account is XXXX. It is beyond me how a financial institution can loose over XXXX and are not able to trace the funds. I am not understanding why it has taken over a week to locate money that mysteriously disappeared from an escrow account. Either American Pacific transferred the funds to XXXX or they didn't. It should not be this difficult to resolve. They have to have some record of when and how the funds were transferred. XXXX should have some record of when the funds were transferred. XXXX claims they received XXXX in XXXX of XXXX, however, they weren't servicing my mortgage in XXXX so how could they have received funds for an escrow account they weren't even servicing at the time. According to documentation from both companies, the mortgage was not serviced by XXXX until XX/XX/XXXX. One of these financial institutions has my missing escrow funds and quite frankly I am tired of the finger pointing and the blame game and just would like my funds to be placed in my escrow account. This is horrible customer service. I have been a homeowner since XXXX and have never experienced anything like this until I refinanced my loan. I'm not sure who is responsible but one of them needs to step up to the plate a resolve this issue.

I was contacted by XXXX XXXX manager licence # NMLS XXXX at American Pacific Mortgage XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, OR XXXX. On XXXX ( XXXX XXXX messages provided ). Our son XXXX XXXX used his services in XX/XX/XXXX XX/XX/XXXX to get a loan for a home purchase, a VA loan. He was very happy with him, being that it was my son 's first home, he really has had no experience with buying a home, I on the other hand do, having purchased XXXX homes prior and now with a construction loan, I do have some experience with loans and the process. My husband and I were going to have to re fi our construction loan through XXXX XXXX, and since we had lot 's of problems with XXXX, we were looking f We were not ready to start a re fi loan due to problems with getting our home finished and all paperwork completed so that we finally moved into our home on XX/XX/XXXX. Then I contacted XXXX back to tell him we were ready to start the process. we sent him our financial information over a secure site and ok 'd him to run our credit after I filled out an application. This was on the XX/XX/XXXX and sent over part of our personal information. Along with this I asked him to send me rates and information on different loan options, he never did send this information to me, even though I asked him several times and which he told me in writing that he would. We had to re send information several times to them and checking back over our records we had sent them and they stated we did n't. Granted this has always been an issue with loan companies so not too worried, except when it happened for the third time. We were contacted the next day and had to re-sign the SS release paperwork because we did not put our initials in the correct part of the application. Our first credit was pulled on the XX/XX/XXXX. On the XX/XX/XXXX we received notice on our XXXX XXXX and on my husbands " XXXX XXXX XXXX '' that there were changes to our credit information/ scores upon opening it we found they ran our credit XXXX time, first on the XX/XX/XXXX and the second time on XX/XX/XXXX. And the real confusing thing is that they were down by what it looked like two different credit places " XXXX XXXX '' and " XXXX '' which I found out that they had been one in the same, but confusing as to why the would use their old name as well as the current one? So I contacted XXXX and confronted him, and he stated that I ( XXXX ) gave him the wrong ss number for my husband XXXX, now it was a possibility that could have happened, that I made the error, but when looking at this situation logically, I questioned " why where they able to pull up the first one, if I gave them the wrong number "? I sent you each copy that XXXX sent me, and I ca n't see where that happened. My husband called XXXX on the phone and chewed him out, mainly for blaming me that they did this. Then it turned into " Oh no it was our fault '' and we are sorry. Then later XXXX stated in an email '' that he really does n't like to place blame " I asked him to remove one of the hard enquiries on our report, he stated " he could not do that. Later after I sent him a letter/email telling him he was fired and to stop everything and that I was going to report this, he apparently spoke to counsel at the home office and stated that they would remove it. ( in closed is the letter ) I want XXXX removed so that I can start over and get another mortgage. I should not have had this happen nor be blamed for this either. And why on the front of the verification of the credit info done on the XX/XX/XXXX, on the XXXX XXXX summery it states that my husband score is XXXX with XXXX, my husbands score are not that low, My husband and I just paid off his XXXX student loan last year, my husband makes almost XXXX a year and our income to debt ration is very low. No where else does it show my husband scores this low. Is this some sort of a scam? so that if they drop your scores down they can give you a loan with more fees for them? I mean what I am supposed to think? We had a difficult time with XXXX because we had to have XXXX hard pulls for our construction loan, our project was made more difficult because we had a loan officer that was not familiar with placing a manufactured home on land, which she told us she was, plus we had to wait over two months for an appraisal so we had XXXX hard pulls on our credit that we did n't expect. ( inclosed are those reports too ) I just want XXXX of these off our credit and to be able to make sure they are not pulling a scam, because in all my years of getting mortgage loans, i have never had to deal with something like this. My husband and I work very hard at paying our bills on time, keeping good to excellent credit and we deserve the " perks '' that go with this, now our scores have gone down and we have no mortgage started, and no plan to unless we can clear all of this up.

I applied for a mortgage loan in XX/XX/XXXX with American Pacific MortgageXXXX XXXX XXXX I was given a pre-approval and pre-qualification letter by the lender. Fast forward to XX/XX/XXXX we found a house and made an offer on it. The lender received the documents and supposedly began to process it. I paid {$500.00} for earnest money. The Realtor arranged an FHA inspection which cost {$350.00}, and the appraisal was done and repairs were made by the seller and re-inspections were done. The Realtor reached out to the lender to make sure that we were on track for the closing date of XX/XX/XXXX. XX/XX/XXXX came and the lender delayed the signing to XX/XX/XXXX because she needed more documentation. The documents were submitted the day they were requested and we waited and waited. XX/XX/XXXX came and she delayed it again, i reached out to the lender to find out what was going on because I had already given my current landlord my exit date, the lender emailed back and said to tell them XX/XX/XXXX. I informed my current Landlord with the new date and the utility companies. XX/XX/XXXX came and she emailed stating she was submitting the documents to the underwriters and that was where the Realtor became worried because this was supposed to be submitted to the Underwriters before the inspection was done. Now I have an insurance company calling for the payment and the lender has been fired along with her assistant and her supervisor. I spoke with the President of the company on Friday and he was " blown away '' trying to figure out exactly what happened. She informed me that I was denied and he stated I was denied because she ran my FHA loan under the USDA guidelines which caused the denial and he stated he would have everything fixed and I would sign for the home within 7-10 days. I explained to him that the sellers were ready to make a move and they have given me more time than they should have. We disconnected the call and I reached out to my Realtor and informed her of everything that was going on. Shortly after that I received another call from the President of the company ( XXXX XXXX ) who stated that because of a bankruptcy from XXXX that was dismissed he would not be able to help. I explained that because the bankruptcy was dismissed by me and it was over 2 years ago it shouldn't be a factor. I did not let it go because of all of the time and money we had put into this. He finally worked it out and told me I was approved for $ XXXX ( which is $ XXXX from my original pre approval ). He told me to reach out to my realtor and let her know and he sent the approval letter. I began looking again for another home and could not find anything. 3 weeks go by and nothing, I informed XXXX XXXX that I had to move out of my current home because his former employee had told me to tell them I would be out by XX/XX/XXXX which I did. He had no sympathy no anything, he said there was nothing he could do about it. I reminded him about the negligence of his former employer is the reason I was in this situation. 2 more weeks go by and still no home, I was still working on my credit at that point and I began to email XXXX XXXX to let him know that my score had went up several points and could we see if I could qualify for my original amount, my emails went unanswered. 1 week later he finally responded by saying he was no longer with the company and was stepping away from lending all together. I was furious, I asked who should I contact now since he is gone and I still have heard absolutely nothing. XXXX XXXX became irate when he learned that I wrote a complaint about the former employee and listed the company in the report and told me. Which I really did not care at that point because he was not the one who was about to out of a home with no where to go and if he wants better reviews he should train his staff to do better. All of the money I put into the home that I was supposed to be in, back in XXXX should be reimbursed to me since it the error of their staff that caused me to lose out on the home. I had appraisals, inspections, purchased a refrigerator, door bell system, art for the walls, kitchen and bathroom decoration and now I'm still stuck in the same position just with a lower credit score, because the former employee ran my credit multiple times through their company and other companies without my consent. This is not right at all. It is legally a crime. All of this is negligent on their behalf I don't know if you know anything about any of this but I was just trying to see if this is normal. I will be requesting my money back because his previous employee handled this entire situation the wrong way. And I corresponded with her and her associate via email so I have documents of her telling me when to give my landlord notice and various other topics.

( XXXX XXXX XXXX XXXX XXXXXXXX XXXX, XXXX, CA XXXX. Our loan officer was XXXX XXXX # XXXX ( phone : XXXX email : XXXX ). Her managers name is XXXX XXXX XXXX XXXX | XXXX ( XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, CA XXXX ) ( phone : XXXX email : XXXX. Through XXXX we were pre-approved XX/XX/XXXX with XXXX XXXX XXXX ( XXXX XXXX XXXX XXXX. XXXX XXXX XXXX, CA XXXX ). On XX/XX/XXXX with the help of our realtor XXXX XXXX ( XXXX XXXX, phone : XXXX, email : XXXX ) we were in contract for a home at XXXX XXXX XXXX XXXX XXXX XXXX, CA XXXX. On XX/XX/XXXX we put {$5000.00} in escrow for our Earnest Money Deposit with XXXX XXXX XXXX ( XXXX XXXX XXXX XXXX XXXX XXXX, CA XXXX ). On XX/XX/XXXX we paid XXXX XXXX XXXX {$390.00} to conduct a home inspection on the property. The same day we also paid XXXX XXXX XXXXXXXX {$150.00} to perform an inspection. Our expected date to close was XX/XX/XXXX. On XX/XX/XXXX the deadline to close escrow was extended to XX/XX/XXXX. On XX/XX/XXXX the sellers sent a document demanding to close escrow by XX/XX/XXXX at XXXXOn XX/XX/XXXX the contract was cancelled by the sellers due the inability to close. The problems we experienced were lack of detailed and timely communication pertaining to our loan, the loan process, and the financial obligations such as our down payment costs, mortgage payments and interest rates and poor customer care. Through this experience XXXX and I never had a clear understanding of what loan program we were actually in. We both expressed several times to XXXX that we wanted to know the details of our loan in order to understand how much we were expected to pay for our down payment and mortgage and either, we didnt get a response from her or when we did the numbers and information fluctuated from {$8000.00}, {$15000.00}, {$3000.00}, {$7500.00} and so on to where we never got a clear understanding. A week before escrow was suppose to close she said her assistant XXXX XXXX ( phone : XXXX email : XXXX ) was going to send me an email of the final documents XXXX and I needed to submit. I called frequently that week to see if it had been sent and it eventually came XX/XX/XXXX which is after the date we were suppose to close. Due to the communication challenges we faced with XXXX, my husband took action to complain to her manager XXXX XXXX in attempt for better service. So, we began communicating with XXXX more and had less communication with XXXX. Whatever information was required we provided to him and were ensured we would close and that it was okay to put a 30-day notice in at our current apartment, which we did XX/XX/XXXX. However, our experience with XXXX got worse. Our close date continued to get pushed back every week and it got harder to get in contact with either XXXX or XXXX. Due to the problems we were experiencing, our realtor XXXX XXXX got more involved and became our primary source of contact as she tried to communicate with XXXX and XXXX in regards to closing, but she experienced the same treatment which resulted in her company XXXX XXXX filing a complaint against XXXX XXXX and Pacific American Mortgage Company as well. XXXX and XXXX were not upfront or honest nor on the same page about the loan figures which caused extreme confusion and frustration. Both of them relayed different information to us as if they werent working together or communicating with one another. When the sellers demanded on XX/XX/XXXX for escrow to close by XX/XX/XXXX at XXXX, that same day XXXX reached out and said they needed one more day to close. 5 more days went by and the transaction did not close forcing the sellers to cancel the contract XX/XX/XXXX, thus leaving our family of XXXX ( including XXXX children ) with 1 week and 4 days to find a place to stay because our 30-day noticed expired XX/XX/XXXX. This experience was extremely stressful and heart-wrenching for our family. There was no sympathy or apology from XXXX or XXXX, we never heard anything else from them. We would like this matter to be resolved with a refund of {$5500.00}, which is the money we lost from this transaction. Your help is greatly appreciated. Thank you, The XXXX XXXX

I am a XXXX veteran with a XXXX XXXX child. I am partially XXXX waiting on a determination for XXXX XXXX. My spouse works full time but only makes roughly {$3000.00} a month. I acquired XXXX VA home loan but because of the housing market we had to move away from XXXX and ended up here in XXXX XXXX WA. We are 100 % certain the victims of a predatory loan company and I have filed complaints. My experience started back around XXXX of XXXX when i met XXXXXXXX XXXX XXXX XXXX XXXX out of XXXX WA. This quickly spiraled into a stressful and horrible experience. Over the months of apply for a Va loan, XXXX groomed us. She made us feel subhuman by telling us how horrible our financial situation was and how no other loan company would even consider us. She said many times how her company was only considering us because we had a VA loan. We got approved around XXXX of XXXX after a grueling process. We could not find a home in time and by the time we did in XXXX of XXXX XXXX negleced to inform us that the loan had expired and we had to start over, when we had located a house. We got approved again but around XX/XX/XXXX of XXXX she ignored my emails for days, I then got a call from her telling me that she didnt have to work with us, she threatened to walk and told me i can find another loan officer. I was perplexed and confused, she then called me screaming at the top of her lungs on my phone, so loud that my spouse and son heard it. She told me how horrible of a person i was, that i was agressive and hard to work with which was just the oppoisite. This woman scrared us with her unstable behavior, threats, making us feel subhuman about our financial situation and gave us a loan amount just {$10000.00} shy of being able to buy a nice home that was problem free. We finally got a home but we got suckered on a {$270000.00} mortgage and the home has a collapsing roof, black mold all throughout the attic, and other issues. I am partially XXXX and have an XXXX child. We will never be able to budget for these repairs, our Va appraiser that XXXX sent out also missed every problem that VA demands a home be free of. I told XXXX many times we wanted a solid and safe home. We were new to home buying, she also had our inspection report and promised to look out for us. Instead she treated us like filth and left us in this mess. I filed a complaint with the attorney general, I complained to her boss and the XXXX XXXX XXXX. They do not care at all. It does look like they fired her or she left the company based on this incident so that proves there is guilt. I can not even find an attorney local because northwest justice has none in XXXX XXXX. What happened to us is unacceptable. She also liesdd many times about what our monthly mortgage payments would look like and she misjudged our property tax by XXXX a month ( she said {$400.00} ) in the closing docs. This was such a horrible experience and now living in an unsafe home we are stuck in makes us never want to attempt to buy another home again. We were taken advantage of. I am looking at {$45000.00} or more depending on the company in repairs and having just gotten into a {$270000.00} mortgage, there is no way I can pay or even budget for this. my loan company cares about is 30 years in payments from me and is essentially laughing at me. I have reached out to the federal weatherization program and they tell me they have a year or more waiting list and that commerce is telling them not to take applications. I looked into the federal emergency home repair grant and all of the packagers on the website do not assist with forms anymore or they are disconnected numbers, that program also has too many tedious forms and will take over a year to get anywhere. We do not have that kind of time. I reached out to habitat for humanity local office and havent heard anything, XXXX XXXX, my local XXXX, the XXXX veterans program, XXXX, and XXXX charities. No one has any idea how to get me help. The federal programs are tedious and broken. We are stuck with no options to make our home safe to live in and no where to go. We thought we were getting a step up in life but now we are worse off than when we rented. XXXX XXXX and her company are predatory and caused this burden and crisis.

Hello!!! and PLEASE HELP!!!! My Husband and I purchased our home on XX/XX/XXXX On XX/XX/XXXX We received a supplemental Bill That was showing INCORRECT Amounts ... OUR PROPERTY TAXES SHOULD BE {$6300.00} give or take on the change... They are telling us it is {$8000.00} ... NO WAY ...... On XX/XX/XXXX We called and spoke to our Broker a man who we processed our Loan Application with at American Pacific Mortgage. We went through the Bill together, He mentioned that the Total Amount was incorrect, and it didn't make sense ... he told us to contact our County and the Tax collector 's office, because they calculated our NUMBERS WRONG ... after speaking to both sets, they are set at a RATE of 1.25 % they clarified it was NOT their mistake. When we went back to the Lender our Broker, however he NEVER called us back. We spoke to XXXX of his counterparts who told us SHE is reaching out on his behalf .... She called us on XX/XX/XXXX and we told HER what happened the CLOSING Department in XX/XX/XXXX when processing our costs and fees etc... to close our loan and have our documents submitted for signing Made a HUGE MISTAKE.!! WE WE'RE CORRECT... We spoke to the Woman who is a Counterpart of our Broker and she mentioned she will speak to her team hat handled our loan and also speak with our Original Broker. She called us on XX/XX/XXXX at XXXX AM The call lasted XXXX Minutes, She ADMITTED!!! on this call that The CLOSING Department made the MISTAKE!! she says When they calculated our total fees and costs they made the mistake and miscalculated all together!!!!! and it's incorrect which is why the Supplemental Bill does not ADD up!! She was quiet for a few moments and then she said to my husband and I that she can't say much it's above her position but, perhaps her Manager a VP could help us and go forward to fix this matter, she told us she will have her call us back to talk to us. Later that day on XX/XX/XXXX at XXXX the call lasted 27 Minutes ... we spoke to the VP as mentioned of the LOCAL office and the SAME team called me, and she said they can adjust the Property Taxes for the Year XXXX and Plus 6 more months but, AFTER that they will adjust and DEFAULT back on us to take responsibility of their Mistake.!!!!! I said NO WAY!!! NEVER!!! .... They need to take 100 % RESPONSIBILITY of their mistake and fix it, The VP said, " I have to ask '' " What are the options or solutions you want me to discuss further? We gave her 2 Options Possible 3 options ... She tells me that she has to take this higher it's also above her paygrade... She says she will have to possibly reach out to their Legal Department... I said... I think you need to do the RIGHT THING!! I told her Mistakes happen but, they need to fix it and learn from this perhaps in a RoundTable and Coaching for their team or Department Staff! The VP called me on XX/XX/XXXX at XXXX AM Left a message saying they are still working on it and she doesn't have more news for me .... We have a XXXX Daughter who is in Kindergarten and Her and I both Have had a bad cold. What a way to spend the XXXX XXXX. I was not able to pick up but, she left a message and I still have it. The Big ISSUES are as follows : 1. When we reached back out to our Broker to get more answers, he no longer answered our calls or texts. I believe ONCE he realized THEIR OWN mistake, he chose to no longer have contact with us ... that is why he placed this MASSIVE ordeal on his Coworker/ Counterpart, she says she herself is returning OUR calls on HIS BEHALF .... REALLY??.... We tried for XXXXver a week to reach him and he is ducking and dodging our calls and messages. I also have EMAILS pertaining to this Matter. Please help! We are not getting any answers I had spoken to our Male Broker and his Female Coworker and their Manager the VP, and I told them ... Our ONE Year into this HOME HAS NOT happened yet, Lets reverse this TRANSACTION, they are running out the clock and Not Taking FULL responsibility. We did not create this issue and most certainly did not CAUSE any, miscalculations. My husband and I had hoped they would FIX and CORRECT THEIR MISTAKE but, they are avoiding taking responsibility at all costs.

On or about XXXX XXXX, 2015 a woman came to my home and handed my caretaker a card saying your mortgage company would like for you to call them. She too began taking photos of my home on the outside without permission. I reviewed the notification and did not recognize the telephone and upon googling it came up with a company called XXXX XXXX XXXX . I did not recognize this mortgage company, I did not return the number listed on the door tag. I later received a call from a representative identifying themselves as American Pacific Mortgage company. Upon returning this call on about XXXX XXXX, 2015, I was notified they were calling in efforts to collect a debt. They indicated at the time that their records did not show payment for the month of XXXX 2015 as being made. I had set up Direct Pay ACH payment via my bank account and the monies were withdrawn and paid on or about XXXX XXXX, 2015, I faxed over proof of ACH electronic payment, ( no reply ) On or about XXXX XXXX I received an alert notification from XXXX XXXX XXXX, of a change to my account. Upon review, a company identified by XXXX /null was reporting on my home mortgage " record as no more than two months past due ''. Apparently as of XXXX XXXX, 2015 they were reporting 2 months in arrears on my mortgage loan with American Pacific Mortgage which was current per my records. Again, I contacted American Pacific Mortgage via fax providing record of payments and copy of the XXXX ( XXXX and XXXX ) reporting error, I received no reply. On or about XXXX XXXX I received an email from my loan broker XXXX XXXX, saying it was an urgent matter for me to contact a XXXX XXXX at American Pacific Mortgage. I contact XXXX and explaining that all payments beginning XXXX 2015 had been paid via electrong ACH, and forwarded her copies of on line bank transactions, along with a copy of the error in reporting being made to the credit bureaus. I requested her immediate attention and resolve, to include notifying the credit bureaus of the reporting error. I was told via email, that she had stopped all collections and reporting to the bureau on my account. A week later XXXX requested additional proof of payment of the electronic record showing where the monies were sent. After contacting my bank and their ACH Payer, I received proof of payment via electronic receipt from the payee 's bank, incl ( s ) payee Name of XXXX, and Payee ID # date and time of receipt of payments on all payments ( now currently XXXX 2015, XXXX 2015, and XXXX 2015 ). I emailed this information to XXXX XXXX and faxed it to collection fax number given. XXXX XXXX requested me to stop ACH electronic payments for XXXX 2015 and to try calling in my payment On XXXX XXXX, I again received an alert from XXXX XXXX XXXX ( XXXX/null reporting 4mths past due ). I emailed and telephone XXXX XXXX to make XXXX 2015 and she refused to take it over the phone. In summary, as of today a credit for " missing payments '' still have not been credited - XXXX has a XXXX party collecting and reporting on my account e.g, ( sending letter as XXXX, telephoning, and individuals to my home. ) I have been denied credit, denied the ability to make loan payments for current months ( XXXX and XXXX,2015 ), currently being charged late fees since XXXX 2015 and now facing foreclosure to include legal fees ) as XXXX and XXXX are not to acknowledging the XXXX parties ( my bank and it 's affiliate XXXX XXXX XXXX ) ACH electronic as a valid proof of payment. These electronic proof of payments are received encrypted by the Payees Bank and acknowledge the payee ID #, date and time all payments received. I 'm requesting immediate credit for all payments made, to include reversal of all late fees to date and the correction of the credit bureau ( s ) reporting without further delay.

I had been working with XXXX XXXX at XXXX XXXX XXXX XXXX XXXX XXXXXXXX, TN as my preferred lender for my first-time home purchase in XXXX of XXXX. According to XXXX XXXX, I was approved for the loan up until one day prior to closing, in which, XXXX XXXX had told me I no longer qualified and had to use his buddy XXXX XXXX as a private investor for my loan to close. XXXX XXXX highly encouraged me to close with XXXX XXXX with the understanding that we would refinance 60 days after closing due to the 10 % interest rate. I agreed only due to the 60 day refi. XXXX XXXX did not assist in the refi process until mid XXXX. When I asked XXXX XXXX what was the hold up, he would not give me a firm answer because he knew I would not qualify for the refinance due to my DTI. In speaking with XXXX XXXX, he placed me with XXXX XXXX of XXXX, TN because he was receiving more money for the " origination '' of the loan from XXXX XXXX than he would from the bank he was representing. I expressed to him that this was against RESPA regulations and he agreed that after " 7 or 8 years of doing these transactions with XXXX XXXX '', he would no longer do similar transactions, even though he only received {$400.00} from XXXX XXXX for my loan ( of which I have in writing ). XXXX XXXX also forced me to sign over an $ XXXX refund check to him after the initial closing of the cash purchase of my home. I asked XXXX XXXX for a detailed account of where the $ XXXX was allotted to, which he could not produce. It is my firm belief that he pocketed the $ XXXX that was supposed to have been given to me as a refund for overpayment from the closing. XXXX XXXX also misrepresented the terms of the agreement with XXXX XXXX and would not initially provide a copy of the settlement statement to me. I have documentation of XXXX XXXX admitting to me that he received a " monetary kick back '' from XXXX XXXX for placing my loan with him instead of with the bank as originally planned. I contacted XXXX XXXX XXXX to get copies of the initial closing estimate and closing disclosure. Upon speaking with XXXX XXXX with Preferred Rate, she let me know that there was no loan ever started by XXXX XXXX for me and the only thing they had on file was my consent to run credit in XX/XX/XXXX and my home address. She asked numerous times how I closed with XXXX XXXX b/c there was absolutely zero record of anything from their side. She also told me that XXXX XXXX had been fired from Preferred Rate for doing shady business dealings as of XX/XX/XXXX ( XXXX XXXX has since moved to XXXX XXXX in XXXX, TN ). It is my firm belief that XXXX XXXX had zero intention of providing a loan to me, lied about it the whole time up until the day before closing knowing I wouldnt have time to seek a new loan. He also provided information to me that we were good to close and the amounts in which to bring to closing. XXXX XXXX refused to give me the information I needed and answers to my questions and he had every intention of putting me with XXXX XXXX from the beginning so he could make more money from his " cut ''. It is also my firm belief that XXXX XXXX was in on this shady business deal the whole time as well as XXXX XXXX of XXXX XXXX in XXXX, TN. This is completely illegal, and I am requesting that XXXX XXXX XXXX # XXXX be revoked. I have sought an attorney and am in the middle of gathering documents ( of which I have everything in writing ) together to take XXXX XXXX, XXXX XXXX and XXXX XXXX to court in the very near future due to his unacceptable business behavior. This complaint is concerning our loan under American Pacific Mortgage. American Pacific Mortgage Servicing Office XXXX XXXX XXXX XXXX XXXX XXXX XXXX, IL XXXX XXXX The error is an inaccurate amount of property tax on the Escrow Analysis dated XX/XX/XXXX, which raises our monthly payment from {$2000.00} to {$2400.00} ( {$470.00} increase/month ). Please see attachments for the Escrow Analysis and 3 property tax bills. Bills # XXXX and # XXXX are supplemental bills and total {$2600.00}. Their total amount was paid from escrow on XX/XX/XXXX. Bill # XXXX totals {$1700.00}. The first installment of {$870.00} was paid from escrow on XX/XX/XXXX. The second installment of {$870.00} is due in XX/XX/XXXX and not the {$3500.00} that is indicated on the Escrow Analysis. Lastly, these three bills total {$4400.00} and are for an entire fiscal year. Therefore, half of this total, {$2200.00}, would be the first installment due in XX/XX/XXXX for the XXXX fiscal year and not the {$3500.00} indicated on the escrow analysis. We have been calling customer service at XXXX, 1-2 times per week, every week, starting late XX/XX/XXXX. We talked to various general customer service representatives, tax specialists, and escrow specialists under the mortgage company. 1. XX/XX/XXXX When we first called we were told to email XXXX, attach our 3 tax bills, and explain the situation. Please see email attachment dated XX/XX/XXXX. 2. XX/XX/XXXX, 2 different calls speaking to 2 different people. We called back to follow up on the email. The first representative to which we spoke didnt have any knowledge of the XX/XX/XXXX email. We called in again and put in a request over the phone with another person to have an escrow re-analysis done and we resent the XX/XX/XXXX email on XX/XX/XXXX to XXXX. 3. XX/XX/XXXX, 3 different calls speaking to 3 different people. We called to check on the re-analysis request and the first representative told us that the request showed no change from the original analysis. We called back a second time, talked to another representative, and put in another request to have an escrow re-analysis. We called back a third time and my co-borrower, XXXX XXXX, was the one speaking during this phone call. We were told by this third representative that this analysis request will be finished at the latest on XX/XX/XXXX. 4. XX/XX/XXXX We posted a physical letter via certified mail, to the following address, with copies of our 3 property tax bills for fiscal year XXXX and a letter explaining the property tax error and requesting the escrow analysis to be corrected. American Pacific Mortgage ATTN : Escrow Department 1 Corporate XXXX XXXX XXXX XXXX XXXX, IL XXXX The letter was received on XX/XX/XXXX. Please see attached tracking printout. XXXX. XX/XX/XXXX We called in to check on the request and were told it was still in progress and being researched. XXXX. XX/XX/XXXX We called in to check on the request again. We talked to a customer service representative, who actually pulled up our tax bills and went over them with us. Unfortunately, he only saw the supplemental tax Bills # XXXX and # XXXX and the system was missing the Bill # XXXX, of which half had already been paid by the mortgage company. This was odd. He then apologized and told us that we had emailed the wrong email address ; the correct address was XXXX. Please see the email attached dated XX/XX/XXXX. Based on our experience with this company, we are concerned this error will not be corrected soon enough for us to make our XXXX mortgage payment on XX/XX/XXXX with the correct amount.

My husband and I were referred to XXXX XXXX to purchase our second home and for the sale of our first home. We were told by the lender everything looks great with our income are taxes and we got our credit score exactly where it needed to be. We put our home on the market and got multiple offers after speaking with our lender they advised us to sell the home and reassured us that we would successfully purchase our second home no problem. Just a few days before our first home was to close we contacted our lender just to make sure we were still in the clear and they said yes sell your home. The game plan was to sell our first home and collect our profits and put it down on our new home. We would be out of our previous home and into our new home seamlessly. Well last minute they said they had a problem with our XXXX taxes not having enough income so they personally hired a CPA to adjust our taxes. Being that we already handed over our keys they said we had no choice but to do this and made us pay for the CPA. The CPA is actually XXXX 's personal tax professional. The owners of the company XXXX and sunny spoke to me personally and said go to the IRS office in stockton and try to amend your taxes for XXXX to say you made more. Looking back now I realize they would of had us do anything so they could get this loan in their pocket. Being in a terrible position now renting a home we cant buy and everything in boxes. The sellers of our new home let us rent for a few days until we were supposed to have our documents according to our lender. Well the underwriter said it was a red flag that our taxes have been adjusted and denied us the loan. Once the sellers of our new home found out the situation they told us to be out of the house in 30 days so at this point we would be homeless. We have XXXX baby girls XXXX is XXXX and XXXX baby girl and we had just finished moving all of our belongings into what was supposed to be our new home. XXXX XXXX XXXX basically told us there was nothing they could do and refuse to take any responsibility. We now owe an extra {$15000.00} in taxes that they adjusted so we are very frustrated. My husband and I met with the sellers of our new home and had to beg that they would please lease to us until we did our taxes for XXXX. By the grace of God they agreed to lease to us but they charged us an extra {$20000.00} for the house and they wanted it upfront. We planned on using this money for upgrades and remodels the house desperately needed done. You can imagine how stressed we were to be told we had nowhere to live and I lender that have no answers. Our family would have much rather stayed in our previous home and not have to go through all of this disaster. We have already spoke to an attorney about the matter then we will be pursuing this in court as soon as we purchase our home with a new lender. We would like for them to make this situation right with us. We now have to pay {$15000.00} extra and taxes {$20000.00} extra for our home and we paid {$1000.00} for their CPA. We also paid {$20000.00} cash out of our money upfront for rent and inconveniences. We also have to pay our real estate agents and for a new lender. XXXX XXXX XXXX, specifically XXXX XXXX ( NMLS # XXXX ). I started an FHA streamline with XXXX XXXX over 8 months ago! Yes, it took this man the better part of a year to close a streamline refinance. I was lured in on one of those XXXX cash to close refinance ads XXXX had mailed out to houses in the area. Sadly, XXXX failed to complete my loan under the conditions he promised and my deal ended up changing MULTIPLE times. My cash to close went from {$0.00}, to $ XXXX~, to {$700.00} to over {$2000.00}. I was informed on THREE separate occasions we were closing ; those closing dates came and went, and not even a single peep from XXXX. At one point XXXX had failed to keep my loan active, so the lender cancelled and deleted my file entirely, yes, at month six we had to begin this process ALL OVER. During this entire process I maybe spoke to XXXX on the phone a handful of times ( he heavily preferred email/text ) and hed only ever call me to give me bad news. Right around month six, I received a call from him letting me know that the lender cancelled the file due to inactivity and we had to begin this WHOLE process over. I think, as most people would be I was furious, though, I stayed calm with XXXX, but I demanded answers. Well XXXX did not have any answers, and in-fact he yelled at me over the phone and tried to shift blame onto me. XXXX was completely unremorseful of the situation. He simply did not care. In the midst of all this, we were able to track down the VPs phone number, so we gave him a call. While XXXX is clearly, a well-educated and professional person he remained distant from the actual issue. The position he took was more of a coworker who had no power to discipline XXXX. However, we were told XXXX was yelled at I will say, XXXX explained more about my refinance, and lending in general in two limited phone calls than XXXX did in 8 months. I appreciated that. Finally, it is time to close. Documents have published and all I need to do is sign and wait the three days. But wait, my closing cost is showing as $ XXXX~. Well that is not right. Last I spoke to XXXX I was told $ XXXX~. I then received a phone call.. ( if you guessed it was XXXX, you win a gold star ). XXXX did indeed confirm the bad news, but said, I was going to make it right, you have my word. He instructed me to sign the documents so the clock could start and we could close. In my gut, I knew better, but at this point 8 months later, I just wanted this over. I signed the documents, and soon found out that XXXX was going to cut me a whopping {$500.00} check. Well thanks, after eight months of XXXX, multiple cash to close changes, failed closing this what their way of making it right. I proceeded to pick up the phone and call XXXX. As mentioned earlier, XXXX is clearly well educated and knows how to talk to people. While the phone call was uneventful, I did ask them to up the amount. XXXX was a master at dancing his away around that, but ultimately he revealed two things. XXXX does a lot of business for us and We have no fiduciary duty to you. So that explains why XXXX gets away with what he does, he makes them money so why possible harm that.

On XXXX XX/XX/XXXX, I received a letter in the mail from American Pacific Mortgage stating that they did not receive my XXXX mortgage payment. I immediatley called them and advised them that I paid my XXXX mortgage payment on XX/XX/XXXX. They told me to email them by bank statement showing that the money was deducted from my account, which I did while still on the phone with them. They told me they would review it and send me a letter in the mail regarding their findings. I asked that they please call me back as I was obviously concerned. I waited a couple of days and called them again on XX/XX/XXXX, I told them I needed to make my XXXX payment but I was concerned about paying online again because they had lost my previous month 's payment. They agreed to take a phone payment for my XXXX mortgage, I also asked if they had credited my payment for XXXX yet, they said that the review was still with their " research '' team and they legally had until XXXX to get back to me. I told them I was concerned about my credit score and about the late payment fee that they charged me. They said not to worry that they would not report anything negative against my credit score. In the meantime, I had sent them 3 emails asking if they had received my bank statement ; they never responded to any emails. I called back again on XX/XX/XXXX ( which according to them was the legal amount of time they had to research ). After being told the matter was still not resolved, I asked to speak to the customer service supervisor. The supervisor told me that they had my XXXX payment because it was paid on XX/XX/XXXX. I told him that the XX/XX/XXXX payment was for XXXX and gave him the back story of them losing my XX/XX/XXXX payment. The supervisor then transferred me to his supervisor. The supervisor 's supervisor said they had found my missing payment but it was with their cash deparment and had to be posted by them. He said he was escalating the situation and said it should be resolved by the next day ( which would be past the legal time limit ), he also reversed the late fee they had charged me. I reviewed by account online the next following days and still did not see my missing payment being refelcted in my statement. I called them back on XX/XX/XXXX and once again spoke to a supervisor. The supervisor told me that they were very far behind right now and I had to wait 24 hours so they could email the cash deparment. I told the supervisor that the last supervisor had told me he escalated it and it would take 24 hours on the 9th and by this point it had been 72 hours. She said she would email them again. I asked if she could please take ownership and call them. She said that they do not have a phone number to the cash deparment. As of today XXXX XX/XX/XXXX XXXX American Pacific has still not posted my missing payment. I have spent several hours calling American Pacific and asking them for a resolution and still have nothing.

On XX/XX/XXXX, I submitted applications to refinance mortgages on two homes to Vault Mortgage XXXX based on representations by one of their lead agents, XXXX XXXX ( NMLS # XXXX ). XXXX and his associate, XXXX XXXX ( NMLS ID : XXXX ), were vehement that they would be able to fund the loans based on asset depletion since I am retired. They convinced me they could fund the loans because they could place the loans with their parent company, American Pacific Mortgage XXXX. AmPac is not a bank and not bound by banking regulations/limitations on loans, so they said. At first, it appeared that they were processing the application. Because of their delays, updated supporting documents had to be resubmitted on XX/XX/XXXX. Again, it appeared some action was happening, but no. On XX/XX/XXXX, applications and documents had to be submitted again. Still no approvals even though XXXX continually claimed that he could complete the refi 's. At his and his associate 's urging, they ordered appraisals for which I was charged {XXXX} and {XXXX} for my home and investment property on XX/XX/XXXX and XX/XX/XXXX, respectively. ( As a side note : the quote for the investment property was {XXXX} and I was promised a {XXXX} at closing. ) Later in the process, it appeared that XXXX and his associate were trying to process my loans using the traditional income method ( not asset depletion ). I insisted that was not viable and that they had promised they could successfully refi the mortgages using asset depletion. They continued to reassure me that they could refi the mortgages. Throughout, I was provided quotes for both loans and asked to choose. Updated applications were submitted as requested by XXXX and his associate through XX/XX/XXXX. At that time, I was again assured that with the revised thresholds for conventional vs jumbo loans, I was sure to get approved. Then all went silent. After almost three months of no contact, on XX/XX/XXXX via email, I requested reimbursement for the appraisal costs totally {XXXX} since the costs were incurred under false representations. They have not answered the email. I feel defrauded. They should not have asked me to incur the costs until their underwriter required the appraisals for confirmation of values. ( As a side note : the loan-to-value ratios were approximately 25 % and 40 %- clearly sufficient equity. ) It is not like the underwriter should have any doubts about value. The Vault Mortgage XXXX offices are in the same zip code as both my properties. My single family homes are in a prestigious area of XXXX XXXX XXXX and they are/should be very familiar with the area. Reading more current online reviews, it appears that other individuals have had the all talk, no action results that I encountered. I hope you are able to get them to reimburse my out-of-pocket costs and get them to improve their practices to not deceive customers and not have customers incur charges needlessly.

American Pacific Mortgage, ( APM ), is making a Demand for {$13000.00} in Insurance Premium. APM is stating on XX/XX/XXXX that the Property Owner 's Casualty Insurance underwritten by XXXX XXXX underwriter XXXX XXXX in California is " Canceled. '' APM asserts that it called the Insurer XXXX by telephone and has documentation from said insurer that the casualty insurance policy is canceled. APM refuses to share this documentation. XXXX XXXX has provided documentation on XX/XX/XXXX that all Casualty Insurance was paid in XX/XX/XXXX and is in full force through XX/XX/XXXX or paid in full for the entire contract year. We have all documentation showing that Casualty Insurance is paid for the entire Annual Premium into XX/XX/XXXX, that no lapse in insurance coverage has ever occurred, that APM assertions are erroneous due to either their inattention, inadvertence, neglect or willful negligence and fraudulent conduct. APM actions violate Federal and State laws, may constitute consumer fraud against the insured and attempt to EXTORT premium inappropriately from a Senior Citizen and USA Veteran of XXXX XXXX. This is easily elder abuse and consumer fraud. This conduct on the part of APM, XXXX XXXX XXXX, XXXX XXXX, Texas XXXX, is exactly the same conduct that the separate XXXX XXXX XXXX XXXX of XXXX XXXX XXXX in Minnesota and its XXXX XXXX, Iowa customer service department engaged in around Year XXXX. These Federal Mortgage Lenders are engaging in EXTORTION of Egregious Insurance Premiums from consumers who have already paid for their own Casualty Insurance. We understand that the current Federal Administration has fined XXXX XXXX XXXX in the amount of {$8.00} XXXX dollars in around XXXX for similar actions. We were attacked on 2 properties in XXXX with excessive Insurance Premium Demands, which is extortion. In one case at XXXX XXXX XXXX, XXXX, CA XXXX, the payments were prepaid by over {$15000.00}, while XXXX XXXX demanded another additional {$13000.00}. Noone in the Obama Administration, nor California government, did anything to stop the criminal fraud and wrongdoing that occurred from XXXX forward. We still seek redress for the theft of our XXXX, CA homestead where over {$400000.00} of 30 years of hard-earned equity was outright stolen from us, with foreign nationals now living in our custom built homestead. This fraudulent pattern can not repeat. What APM is doing to XXXX XXXX, USA Citizen and USA Veteran, is exactly what happened in XXXX : A Demand for Over-payment of Insurance Premium with an egregious Demand amount. I was referred to XXXX XXXX ( XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, CA XXXX ) by the XXXX website since they are handling low to moderate-income families who obtain loans with down payment and closing cost assistance. XXXX XXXX XXXX # XXXX, who was the assigned consultant reached out and assured me that she will be able to assist me with my needs. As a first-time homebuyer, I made it very clear upfront that I only prefer pre-approval using soft inquiry to learn how much I can get qualified for, how much I can afford, and also have a better understanding of the entire process before diving in with the actual buying process. During the pre-approval process, I was trying to avoid any mishaps or headaches correcting something posted on my credit report which will be a hassle to correct. According to XXXX, she did a soft inquiry and provided a pre-approval via email, however, she provided a pre-approval letter to the selected real estate agent ( referral by XXXX ) bypassing me. I received the pre-approval from my real estate agent and not XXXX. This kind of threw me off. After my pre-approval, it appears XXXX did not want to deal with me ( not sure why ) In the meantime, I reviewed the pre-approval and nothing details on that letter made any sense. I typed up all my questions and emailed them to XXXX for answers ( XX/XX/XXXX ). When I did not hear back from her, I called her on XX/XX/XXXX. Right before that phone call, I received an email from XXXX informing me of a credit inquiry on my report. I did not think of anything at that time. During the call, I repeated each of the questions that I had on the pre-approval for XXXX to answer, and I also asked her if she by any chance might have done a hard inquiry on my credit. Her answer was Yes because I think you are ready. I was shocked, and told XXXX, as per our conversation, that I did not consent/permit her to run a hard inquiry yet since I was still making decisions on whether to move forward yet or to wait a little longer. She was upset about the situation, making me feel it was my mistake. She told me she can take the hard inquiry off my report. I circled back to her on XX/XX/XXXX checking to see if she did make that call, and her response was I will initiate the process. I followed up again on XX/XX/XXXX requesting an update, and her response was, XXXX, this is not an overnight process will take a while. I dont get updates.. At this point, I do not trust her. I am not even sure she did initiate the process to correct my report. This is the type of situation that I was not looking forward to but yet I am going through it. We contacted a gentleman by the name of XXXX XXXX who works with American Pacific Mortgage about a VA loan to purchase a house. The escrow was originally set to close at the end of XXXX XXXX. It was then pushed back to XXXX XXXX because we had a short sale on our prior home XXXX of XXXX and for the VA loan it had to be 2 years. That was all fine but then the escrow date moved to XXXX XXXX, XXXX according to XXXX " just to make sure we can make the deadline. '' XXXX XXXX rolls around and we find out that XXXX had not ordered a termite inspection which is mandatory with a VA loan. Our agent called an inspector who was gracious enough to make us a priority and come out the same day. Escrow finally closed on XXXX XXXX with no help from XXXX but by the assistance of our realtor and his mother. When we went to sign the last of the loan docs and the statement said we would be receiving over {$2400.00} back in the form of a check and we questioned that since we had only put down {$1000.00} in good faith. When we got the check for {$2000.00}, we again questioned our escrow agent and she informed us that the mortgage company had given us a credit and this was how they were accounting for it. Just after XXXX, I received a call from XXXX saying that and internal audit had been done ( again, later in the process than normal ) and we had to return the extra money and he would e-mail me with details on how to do that. He never did. I did get a call from our escrow company saything that they had heard from American Pacific Mortgage about the extra money but she said she told them that she could not be sure if we still even had the money. She never mentioned bringing her a check. On XXXX/XXXX/XXXX, I received an e-mail from XXXX as a " follow-up '' about the Overpayment and he said that the VA was aksing for it and the escrow company said they did not have a check. I replied that he never e-mailed me to give me direction on what was to happen. He responded that the escrow office said they called me and that the check was to be returned to them. Thereby, in my option, blaming the escrow company for not informing me when he said he would. I did give a check to the escrow company in the amount of {$1000.00} that this morning, XXXX/XXXX/XXXX. It seems to me, that the mortgage company and XXXX XXXX should have been on top of this situation and not put us in the position of having to return money we questioned not once but 2 times. Buying a house is a stressful enough process without the loan officer forgetting things and then the loan company making a huge mistake. On top of that, founding out that we are responsible to return money the mortage company give us. This is just a poor way to do business.

Buying your first home should be one of the most memorable experiences ; however, ours was one of the WORST experiences I have ever experienced. The lender, XXXX XXXX, who works with American Pacific Mortgage Company has been the worst customer service experience of my life and is completely inept. To begin with her communication skills are atrocious. She would ignore phone calls and respond via text message or email usually after a few days of us calling and repeatedly messaging her. Certain days she would message us around XXXX with a task and if we called to ask for questions, she would claim that she was not near her computer. Having a phone conversation was like pulling teeth and she was very abrasive via text. Secondly, she never explained anything to us, we were XXXX or reaching out to friends, our realtor, and everyone else to get answers. She herself on several occasions told us to look things up on XXXX. She gave us a pre-approval for a set amount in which we paid the home appraisal fees and additional fees with it all our efforts being futile. She additionally requested tedious tasks from us which we completed within an hour of her asking for them, and they were time consuming paperwork tasks. In return we just wanted open and honest communication ; however, she failed to do so, and would go days without returning our emails. At one point she claims her phone could not receive phone calls, but she could text and still email from the phone. Specifically, it was XXXX XXXX, and we called her and finally got a hold of her, and we expressed our frustration and our concerns, in return she told us She spent enough time on us. These comments were repeated in the presence of our realtor, who was astonished that she made such a comment. She is completely insensitive and inconsiderate of her clients time and money. The delayed communication caused our process to go over the time frame, with frustrations from the seller, the listing agent, and ultimately, we did not receive the home. She would procrastinate on her side then harass us to call our managers and HR departments to get documentation sent over ASAP. The constant calling and pleading to employers to get the documents to her last minute soured our relationship with them. Our realtor worked with us as if we were family and we felt our concerns were heard BUT NOT with the lender who in turn gave us such a headache we were in tears throughout the entire process. We personally believe that we were discriminated against based on our XXXX and XXXX background.

On XX/XX/XXXX I entered into a purchase Transaction with a buyer who supplied a conditional approval with her offer for acceptance from her XXXX XXXX XXXX XXXX XXXX American Pacific Mortgage signed by XXXX XXXX XXXX XXXX # XXXX. On XX/XX/XXXX XXXX XXXX communicated that all was on track for closing and borrower released loan contingencies for a presumed loan closing of XX/XX/XXXX. on XX/XX/XXXX Escrow officer reached out to XXXX XXXX again at XXXX XXXX and was advised that a closing disclosure had been requested and documents arriving to escrow soon. After missing the closing date XXXX XXXX stated she was working to have the loan close on XX/XX/XXXX. On XX/XX/XXXX it was stated XXXX was out of the XXXX and XXXX XXXX XXXX XXXX took over the loan on XX/XX/XXXX. On XX/XX/XXXX, Branch Manager communicated that the loan had never been approved or submitted to underwriting violating potential Reg B. requirements and UDAAP in order to secure a home purchase transaction for an individual who had not received a loan approval. The seller was deceived into accepting an offer and made to believe lending had been procured by XXXX XXXX. for the purpose of financial gain by XXXX XXXX. Branch Manager XXXX XXXX communicated to seller that he was not sure how the borrower was looking for homes as there was not a loan approval issued. He then asked for more time to obtain financing on the borrowers behalf and to add additional borrowers to the loan. On XX/XX/XXXX after the borrower being served an escrow cancellation request XXXX XXXX once again asked for additional time close the loan adding additional borrowers. As a result of the lenders inability to procure a loan for the agreed upon borrower the sellers have experienced financial harm, and have not been able to cancel escrow as a result of the unethical, Unfair and deceptive loan practices from the institution, that could not have been reasonably avoided by the seller due to the misrepresentation from XXXX XXXX, in having had procured loan financing. To date, at the direction of XXXX XXXX the Borrower has failed to acknowledge any loan cancellation or correspondence from the seller in attempt to coerce a loan closure between additional parties that have not been agreed upon. I formally request that the CFPB evaluate XXXXXXXX XXXX Sales Practices, as well as their adherence into Reg B, Fair Lending and UDAAP compliance.

I spoke with XXXX XXXX in XXXX on Tuesday, XX/XX/2022 at XXXX XXXX. XXXX advised that she would provide the proof of my payment and proof that my payment had been applied to my mortgage loan.. She told me that I couldnt have account access to review my payment and how it was applied because my loan would be transferred and once it was transferred I could have access to my payment and account through whatever company that may be. XXXX advised me of this after I submitted the complaint below : My husband and I paid our mortgage on XX/XX/2022 using the mortgage statement that was sent to me by American Pacific Mortgage and the loan number provided on the statement. The mortgage payment has been deducted from my account. I called American Pacific Mortgage to confirm payment was applied to account because they didnt provide an online portal to review account. When I called I was told there was no record of an account in my name or my husbands name, I was told that mortgage number did not exist and that they have no record of a payment. I asked them how was that possible and I was told they didnt know and now my money is not accounted for and Im told we do not have an account but on all of our closing docs and our mortgage statement all have this loan number we were told doesnt exist. I have not received a notice of transfer and its been well over a month since closing. That notice at least requires 15 days prior to transfer, its XX/XX/XXXX and I have no notification of such transfer and I need access to my account and payment history and detail in full accuracy. XXXX advised that she would send all requested proof via email, as well a vial mail. It has been over 48 hours and I still do not have the email she advised she would send with proof that they received it ; I have not received any documentation via mail either. XXXX stated that they applied the payment that was made on XX/XX/2022 to our mortgage loan on XX/XX/2022 ; its XX/XX/2022 and I still have no proof that it was actually applied when received as required by law. Waiting until the loan is transferred to provide proof of my payment is not acceptable for our records. I need the requested proof provided to protect myself and my husband from anything that will undermine our investment.

Dear Staff, My name is XXXX XXXX. I recently bought a home that I went through American Pacific Mortgage to finance. The mortgage company forced me to put into escrow more than {$8300.00} extra in payments during closing, on XX/XX/2016. That money was to be used to install flooring and for a range. When I ordered the flooring from XXXX, American Pacific Mortgage at first refused to pay the company, telling me that I must pay out of my own pocket first then I get reimbursed, which is bizzare, since the escrow money is placed there for the purpose of paying for the costs of flooring and range stove, however, they want to withhold that and not pay. However, after some intervention, they sent {$4300.00} of payments to the store, and it got delivered. That took 2 days for them to process and send the payment. XX/XX/2016, I made another request to XXXX XXXX who handles escrow payments for American Pacific, for another approximately {$810.00} to pay XXXX for more materials. However, they did not reply, and thus, after leaving many messages and emailing over the last 3 weeks, I decided to contact in person the branch manager, XXXX XXXX, in XXXX XXXX XXXX, on XX/XX/XXXX, of American Pacific Mortgage but each time, they had ignored my request, no response or replies to my emails or call, causing tremendous problems with the flooring installer, having to return and wait upon the materials to come and not knowing when the rest of the materials will come. They made me sign an agreement to be finished at a certain date, which has way passed, but they have been the biggest problem in withholding the funds. Not being able to wait any longer, I decided to pay out of my own pocket the order on XX/XX/2016. Around late XXXX to XX/XX/2020. We started to apply for a home loan for a SALE BY OWNER ( FSBO ) Property. We were given the priority by seller to purchase this home up front. We initiated the process with American Pacific Mortgage, turned in all documents necessary, started escrow, started and paid for inspections, paid for septic clean up, etc Everything came downhill when the property was inspected, the report came back saying it had a 2nd home on the property, and simply right off the back was not considered a single dwelling. The company failed to package the loan properly and therefore failed to investigate the status of this property, after we asked for a second opinion, hoping to get another home loan elsewhere, our second loan officer told us that the verbiage used to describe this home was incorrect. It should have been a single dwelling with an accessory. All along this property qualified under the title of a single dwelling, that small house shouldnt have been an issue. The issue then became the down payment. They wanted us to shell out 20 % when ultimately the buyer that bought the home after us put down the minimum 3.5 % down. The excuse was that the property had 2 houses & was not considered a single dwelling BUT our second loan person told us THOSE FINDINGS were an error. This is our problem .... WHY did this company give the " proper '' loan to the current owner of the property in question with ONLY 3.5 % down? Did they give him priority to purchase said property because he was a current customer of theirs already and was in the position to get more loans with them in the future? ( it was his second loan w/ them, and he planned to refi with them and possibly go for a 3rd home loan ). Wouldnt this behavior be considered questionable if we were as qualified as much as the current owner was? Why him and not us? We where already the chosen buyers to acquire this property, by seller, other buyer came after our loan crumbled with American Mortgage. Given the facts we know this transaction has more of a fraudulent tone than just an error this deserves an explanation of what REALLY transpired American Mortgage can only answer to this.

APM FUNDED AN UNINSURABLE LOAN On or about XXXX I applied for a refinance of my RanLife FHA with American Pacific Mortgage. I closed on the refinance on or about XXXX/XXXX/XXXX. On or about XXXX XXXX I was informed that there was an error in my title paperwork ( a date that was dated after some critical date it should have been dated before ) and all I was told was that a ) it was impossible to re-sell the loan on the secondary market (? ). I was told it was a " scratch and dent loan '' ; and b ) APM would have to service the loan itself. I paid 11 months mortgage payments to them without receiving benefit of a positive credit line. APM WOULD NOT WRITE OUT OF UNINSURABLE LOAN On or about XXXX XXXX, APM said they wanted to re-finance my loan to be able to " write me out of an FHA '' to drop the PMI. On or about XXXX XXXX they told me that not only were they unable to refinance me into a conventional loan ( even though I am appraised well over 80 % ). They blamed the fact that I have a HERO loan and they could not " do a conventional loan '' on the loan, but they also could not do an FHA streamline either. The rules on FHA not refinancing did not change until XXXX XXXX and HUD said any loan pulled within 30 days of their XXXX XXXX announcement would be okay for a HERO or PACE loan. APM has elected to do neither. FHA SAYS I DO NOT HAVE AN FHA LOAN BUT BANKS SAY I DO This brings me to my biggest legal issue ; do I have an FHA loan or not? FHA says " no '' and I have called them twice. Another lender pulled an FHA case number for me. This means I have an uninsurable FHA loan which no one ( and I am assuming APM knows this ) else will touch because its not FHA insured in the first place. Moreover, I am supposed to have an assumable loan, which it is not, and I certainly can not apply to FHA if I have a case that is uninsured.

Everything started around the end of XX/XX/2017. We met XXXX at an open house where we also met the agent, who would then became our real estate agent. We were working with somebody else but the agent made us understand that would've been easier to work with somebody she knew, and that XXXX worked for a really good company and that he could help us get the loan we needed to buy the house of our dreams. Everything started few days later : we provided him with info he needed to start processing the request for our loan. Short after that, he gave us the pre-approval letter, with the loan amt we were approved at, an appealing interest rate, a down payment amt.. Everything we needed to start shopping for a home. We found a home. Everything was going OK until he sent as the final documents, I believe it was the good faith estimate : but wait, a few information were NOT what we got disclosed at the beginning.. the interest rate went from 4 % to 7 % .... When we have requested explanation on why that happened, he told us that our case was different. I asked in how come this is coming up now at the end, when she knew that case was a little bit different.. At the point our communication broke up. He started by saying that we could sign docs with that interest rate, and 6 months later he could refinance me at a much lower interest rate, and that was good for me, as he would have been a much higher tax deduction. From that point we had to look for a new lender and honest one. P.S. At the beginning of the all process, I even recommended him in to a friend of mine and guess what? she call me a few days ago and without knowing what happened to me she told me that it happened to her too. Sorry, But I thought I was dealing with a shark, and I do not gamble my money and my happiness..

XXXX XXXX told me I had not been given the proper time to review documents associated with my original mortgage loan. Also, he told me APM would refinanced my loan at no cost to me. My analysis of the documents follows : 01 ) I had not seen any of these documents before. 02 ) All documents had an interest rate of 4.250 %. I was unaware of a potential 4.250 % interest rate. 03 ) All the documents electronically signed with my name are forgery. 04 ) All the documents electronically signed with my name have the same date and time stamp. 05 ) All the documents electronically signed by XXXX XXXX have the same date and time stamp. 06 ) All electronic signatures look like they were written by the same person. 07 ) The XXXX has an extra blank page with an electronic signature of my name. Months ago I inquired about Mortgage reprieve options, like adding a current payment to the end of your mortgage or refinancing, I was told they dont add a mortgage to the end of your loan but they have a forbearance program and asked me if they could explain it, I said sure, after hearing the info I said this is not what Im looking for, but you can send me information, I NEVER gave my consent to enter into forbearance & signed no paperwork for this!!!! I continued to pay my mortgage on time monthly!!!! Recently I go to purchase a home & they say my mortgage is in forbearance, I was furious as I never authorized this!!!! I asked my mortgage company to issue a Letter stating I was not or never had been in forbearance, the letter they issued said forbearance canceled this is UNACCEPTABLE because you cant cancel anything that wasnXXXX AUTHORIZED!!!!! I then asked for an addendum stating my mortgage was never in forbearance and this was a miss understanding on the behalf ofAmerican Pacific Mortgage! My deadline for this addendum is today XX/XX/22 and I was told repeatedly no one could help me until XX/XX/22, I was on the phone literally 8 hours trying to get the simple addendum I need to submit to my underwriting department, at the end of the horrible unproductive customer service, they left me on hold for 2 hours 28 minutes and 54 seconds! I then called back to only be told all managers are gone for the evening!!!! This is absolutely litigious & XXXX will purse that I asked for my recorded phone calls to be produced & they have not performed! I want a letter delivered to my email by XXXX am XX/XX/22 stating my loan was put in forbearance mistakenly by American Pacific Mortgage & a new letter reflecting that & stating my mortgage payments are in good standing!

I filed another complaint about American Pacific Mortgage awhile back. It had to do with the removal of PMI from our mortgage. They responded and began to try to help me, but it seems they are back to dragging their feet and doing a half XXXX job on top of it. After they did a reappraisal, I disputed it stating that they compared our home unfairly. Im quite certain there is a conflict of interest as the reappraisal was quite low compared to homes sold around our area at the time of the appraisal. They have asked for a list of comparable homes, which I have sent, and not heard back on any action taken on their part. The only thing I received are letters with outdated financial numbers or letters stating that I should fill out the attached form and send it back ( there was no attached form ). It seems to me that they have protocol letters that they do not even bother to read to verify accuracy and send them out blindly. The last email I received stated I need to pay a certain amount to remove my PMI, which was completely inaccurate since it did not account for the latest appraisal. This company is the most incompetent and half assed group of people I have ever delt with. I have attached the last letter I sent to them disputing our reappraisal. Its been over a month and it seems they took no action and never even updated the first appraisal to give me an accurate number to pay to remove my PMI. Please investigate this horrid company and take necessary action to address any conflict of interest and the long wait times Ive had to endure resulting in outdated information given on their part. They steal peoples money and refuse to do their job. Period.

I applied and was preapproved for a mortgage with American Pacific Mortgage group in XXXX or XXXX. They provided misinformation advising that my XXXX money was never and would never be in jeopardy as long as they issue a denial letter. We scheduled closing more than 4 times and completed XXXX amendments with the sellers keeping the home off the market for over XXXX months. We terminated the contract as of XX/XX/2022 due to their underwriting issues and the seller not being willing to wait any longer. At which time the mortgage company advises that I will not get any of my money back even though the denial was no fault of my own. I requested to pull out of the contract several times through the process due to their underwriters getting upset with me for contacting their offices. They knew I am a first time home buyer. I wasn't aware I am not allowed to contact their office. Instead of telling me they decided to punish me by drawing out the process. There is no reason it should take them over XXXX months to underwrite a loan when are being provided all requested documents in real time. The broker later advised my realestate agent that the initial loan officer was taken off the loan processing due to him accidentally leaking the underwriters information and the underwriters decided to " punish '' me this way and probably in causing me to lose the home I was under contract for also. This was a nightmare of an experience for a first time home buyer. I attached the communication between myself and the broker as proof of my complaint.

In XX/XX/XXXX, I entered into a sales contract to purchase a home in XXXX, CA with my VA entitlement. The sales price was {$390000.00}. During the process, I was told that the seller had some liens and in order for him to pay them, we had to lower the sales price to {$350000.00} and then the seller would carry a second mortgage in the amount of {$40000.00}. I am a first-time homebuyer and didn't understand what was going on and put complete trust in my realtor and mortgage lender. I followed their direction. The transaction closed in XX/XX/XXXX and that is when I realized that I also had to make payment on the XXXX mortgage. The combination of both mortgages was more than I could afford. I subsequently contacted a HUD approved housing agency. They are helping me with this complain process. It appears that the mortgage lender ( American Pacific Mortgage ) was unaware of the XXXX mortgage as it was not recorded until later. I believe that the real estate agent ( XXXX XXXX - XXXXXXXX XXXX XXXX, CA XXXX XXXX ) and the loan XXXX ( XXXX XXXX, XXXX XXXX ) knew that XXXX didn't qualify for the VA loan based upon the purchase price of {$350000.00}. By creating the second, XXXX now did qualify for the VA loan based upon a purchase price of {$350000.00}. The underwriter was not made aware of the XXXX mortgage payment. XXXX and XXXX are husband and wife.

Our payment due each month is {$760.00}. Our XXXX XXXX payment was also by check and was received XXXX XXXX also for {$1000.00}. Our XXXX XXXX payment was made electronically on XXXX XXXX and received on XXXX XXXX for {$1000.00}. They are saying we are behind one payment which is incorrect. We have been calling this company since XXXX to get this situation resolved. We have sent to them copies of the checks from our bank and a list of our electronic payments from our bank. We are constantly being told that they are researching the issue and that it will be resolved. The problem is that every time we call we are told of a new date that it will be resolved and this has happened numerous times. They have also applied two late payment fees. We have spoken to supervisors and this is still not resolved. We feel that this should be an easy situation to resolve since we have only made 5 payments. We are beginning to think that they just don't care to resolve.

We were the sellers and we were set to close on the house on Friday XX/XX/19. On Wednesday XX/XX/19 the loan officer forgot to have a closing document signed by the buyer, which is required to have 3 business after the signature, in order to close! Tuesday XX/XX/19 was the 3rd business day. We get a clear to close from the buyer but now were told signing wont happen until Wednesday XXXX. So now 3 different families have been waiting a week to close and 1 family has been XXXX this entire time. Does American Pacific care? No!! Wednesday morning comes, we are physically at the signing table, the buyer is not clear to close anymore?!? The buyer sits at the title office for 9 HOURS! on Wednesday waiting for closing paper work. Meanwhile, no one is getting a call back or any kind of communication from American Pacific! Neither the buyer or us, the sellers. Any communication we do receive is someone passing the buck and blame on someone else. No answers to why these closing documents were not ready or being sent. 5 times this happened!! We demanded calls back. That never happened! Worst customer service in the United States!! We did not close until Wednesday night at XXXX local time and this was only done on Wednesday, because the title company stayed late for us, waiting for these documents. American Pacific Mortgage Company frauded me and refuse to rectify the situation despite acknowledging they are at fault. As a first time homebuyer using an FHA-government program through this lender, my partner and I signed multiple closing documents for our home on XX/XX/2023 where the interest rate for our second mortgage ( covering down payment ) was 0.00 %, and were shown multiple instructional/cover sheet documents explaining the 0.00 % rate we were signing for. Shortly after we closed, American Pacific Mortgage Company and their subsidiary XXXX XXXX XXXX sold my mortgages to XXXX XXXX, in a deal that said our second mortgage has a 6.25 % interest rate. This will result in over {$11000.00} in charges and dinged credit score to us as we wait for this company to rectify their error with XXXX XXXX. Despite multiple pieces of evidence to prove American Pacific Mortgage Company/XXXX XXXX XXXX is in the wrong, they refuse to rectify the issue or even answer my calls or my government-assigned mortgage counselor 's calls. From their lack of communication, I can only assume American Pacific Mortgage Company/XXXX XXXX XXXX is attempting to profit off me and the government using predatory and fraudulent, illegal lending practices. I hope they do the right thing and fix this issue asap, considering my only home and well-being depend on it.

ALthough some information has been removed, unfortunately not all the information was removed and therefore is causing a halt and sometimes negative affect on my reporting. We closed on a mortgage with American Pacific Mortgage XXXX in XX/XX/XXXX. We pay additional money toward principle and we began attempting to work with them in XX/XX/XXXX because they were putting the additional funds in unapplied funds. They have passed us on to at least 7 people, all who respond with statements such as this is a mess, I will work on it, have blamed the problem on their service company, and have assured us that they have notated in our account that any additional funds should be applied to principle. We have begged them to sell our mortgage ; I have had many mortgages with many companies/banks, and have never experienced such inability to one, apply funds as requested with a simple straightforward mortgage, and two, and most concerning, to fix an issue in a timely manner. As of this morning, they applied our extra payment to unapplied funds and upon contacting them, sent us an email asking what we wanted to do with the funds. It is as if we have not sent at least 100 emails and spoken to at least 7 people about this very issue. We have no trust in this company and, in fact, have begun to wonder if there is fraud involved, as Im quite sure there are borrowers who do not attend to their account as we do. Hello, Thank you for your time. I did a re fi for my house in late XX/XX/2021. I was not due a payment until XXXX. I made a payment in late XXXX to ensure it cleared by the XXXX due date. This payment was never received per American Pacific Morg. I have the cashed check for {$960.00} and proof from my bank that it was endorsed. My bank has also stated the check cleared on XX/XX/2021. Note that first payment that was missing is XXXX cents short -- and I have paid additional principal each month. I called about this issue and the XXXX and XXXX statements that seemed like I owed 2 months of payment. I called and often no one answered or I was hung up on. I finally got a person who stated my account and escrow was set up wrong. That was not the issue. I have tons of emails and spreadsheets and copies of payment that I can provide. And in the meantime my loan was dumped over to XXXX and they are making me go through all of this all over. It has been highly irritating and I have spent hours on this now. I received a supplemental tax bill from my local county tax collector in early XX/XX/XXXX with a bill for {$300.00} that is due on XX/XX/XXXX, XXXX. I called my mortgage servicer, American Pacific Mortgage and was instructed to scan and send the bill via email to their email address, XXXX. I emailed the bill to them on XX/XX/XXXX. I did not receive a response from them confirming that they received or paid the bill. I sent an email on XX/XX/XXXX to follow up to see if they had received my request and again I didn't receive a response. I called again on XX/XX/XXXX and was told that in order to process the tax bill, I need to hand write a letter, sign it, scan it and email it to the same email address provided. I sent an email with the letter of authorization on XX/XX/XXXX and did not receive a response. I called again today, XX/XX/XXXX and was told that the tax bill was still not being processed and that there is a 7 day turn around to get it processed, the 7 days starting today, and it may be sent late. The story starts when I find a house and started an offer. I was already pre-approved for the loan with XXXX and locked in at 4.6 % for a 30 year loan, but wanted a little bit better interest rate. My realtor recommended XXXX XXXX for a speedy close. I contacted XXXX and told him all the details of the loan and house and he convinced me to go through the loan application process and would be able to for sure get me 4.2-4.3 % interest rate without points. Once all my financials were cleared with underwriting about 2 weeks from close he said that the interest rates had gone up and it would be 4.6 % for the loan and that he would check every day until close to try to lock me in at a lower rate. That never happened and about 1 week before close he send over loan documents and they had {$1900.00} in points listed. XXXX send me a screenshot of his computer saying those would be covered through lender credits, which he had gotten approval for that morning. I was told to sign them and he would fix it before close. He didn't, and I had to choose between closing on time or going to another lender and possibly losing the house.

I was informed be the loan officer and compliance officer of American Pacific Mortgage that in closing a VA home loan I had to sign my signature with prejudice to my rights, an act I was not accustomed to. Furthermore, it was asserted that I could not sign without prejudice because it was VA policy and that such policy prevented me from doing so. After further inquiry I discovered no such policy exists and the company will not disclose the code they claimed applied which effectively deprived me of my right to defend my rights from an unconscionable contract. It was also reinforced at closing by the notary officer and so I signed in a manner I was not accustomed to but I verbally stated that my signature was only being provided " under protest '' specifically cause felt I was being deprived of my civil right especially with such confusion and mistakes in the process regarding what I paid for my credit and whether there was even a loan or an exchange of negotiable instruments and if the property deed was defective or even marketable. This was acknowledged by both the loan and notary officer present during closing.

My original FHA loan originated in XXXX of XXXX at a rate of 4.75 %. We did a streamline refinance in XXXX of XXXX to a rate of 3.25 %. I made the XXXX and XXXX payments XXXX XXXX was skipped due to streamline ), these were on time, actually 2 weeks early each but irrelevant. I received a call from my loan officer who stated they canceled my FHA case number by accident and would would need to re-sign. She then had another loan officer contact me who stated we must do a full re-fi as the case number was canceled and can't be re-instated since it was canceled before closing. He stated the company is not able to sell my mortgage now since there is no case number. They are offering a no cost re-fi and a lower interest rate but I have to go through full credit pulls and the entire process. I have reluctantly agreed but am skeptical. Am I obligated legally to do this? If I refuse do they have a right to keep the monthly PMI I am paying for an FHA loan that technically doesn't exist since there is no case number? I have not signed or closed anything on a full refi yet as it is just getting started.

My lender ( American Pacific Mortgage ) has been dragging their feet since I requested our PMI to be removed. House prices have gone up in my area, along with us doing some renovations to our home. I had to call them to check on the status 3 times before they even sent out a letter asking for the list of home improvements and a check for a new appraisal. In the previous 2 calls, they said the letter would be sent out, which was a complete lie since it was not even sent out yet the 3rd time I called. All the calls were a couple of weeks apart so they wasted a bunch of my time. After receiving the letter from them and then sending back the required items, I have not heard back for a month. I called them to see whats going on, in which they responded that they have not received anything and can not check with their appraisers. They are literally dragging their feet and stealing peoples money. I had a friend who removed his PMI seamlessly with another lender so Im not sure why my lender is giving me such a hard time. I was pre-approved for a conventional home loan XX/XX/XXXX by All Pacific Mortgage. I provided bank statements, pay stubs, and showed adequate funds for the down payment and closing costs. At that time I was XXXX. I did not find a house to purchase before XXXX. I then found a house XX/XX/XXXX. My pre approval letter expired while I was XXXX. My realtor spoke to the lender who sent me a new pre approval letter since my employment, income and savings had not changed since I got the last letter. On XX/XX/2021 I contacted XXXX XXXX ( a mortgage broker XXXX XXXX ) for the purpose of obtaining a home equity loan. They put me in touch with American Pacific Mortgage loan application # XXXX ( file # XXXX ). I was dealing with XXXX XXXX one of their loan officers. I spent close to 6 weeks gathering massive amounts of my personal financial information for the purpose of securing a home equity loan. Some days, I would spend upwards of 6 hours trying to obtain, scan and email this information to XXXX at American Pacific Mortgage. Just when I thought I was ready for closing more and more documents and explanations were required. I complied for each item requested. On XX/XX/2021, I first received a good faith estimate of the closing costs. I was under the impression that I was supposed to receive it within 3 days of applying. After doing all the work for about 6 weeks, I then was told that I couldn't qualify for {$160000.00} loan. Work for 5 months with loan officer to get a Bank statement loan. I was quoted 7 to 7.5 % interest, high for this market but I am self employed. I was told she would wait to lock in a lower than 7 % as there would be some better deals around XX/XX/XXXX.The lenders final interest rate on the final disclosure was 8 % I was told due to a credit line from XXXX that stated last reported XXXX which upon my own investigation is a typo on the XXXX report . I closed my loan and while signing the papers, was told I was buying down the rate from 8.25 % to 8 % for {$750.00}. I was never told in any disclosure or even verbally anything about a 8.25 % rate. I, the title agent and my realtor were shocked. I had to close today as the seller was also in contract on another home and moving to XXXX tomorrow. My complaint is about American Pacific Mortgage ( XXXX XXXX XXXX, AZ XXXX ) assessing a flood insurance fee of {$2300.00}. However, when closing came there wasn't any mentioned on their part to get flood insurance in a area that doesn't flood. I have spoken to FEMA ( unfortunately ) and FEMA wants me to do an inspection and obtain an XXXX XXXX which cost {$4500.00}. Furthermore, I received a phone call from FEMA ( XXXX XXXX, 2021 ) indicating that my subdivision where my house is didn't require an XXXX XXXX. Go figure! Now, American pacific Mortgage wants me to pay that amount, but I will not. XXXX should have known I didn't have the flood insurance at closing, but XXXX waited 4.5 months to now assess me with this high flood insurance fee. As far as I know I am allowed to choose my own insurance. However, I did contact APM a couple of times about this and I never heard back from any one. I CAN NOT AFFORD to pay {$200.00} + XXXX + {$160.00} = {$1900.00} per month when XXXX should've told me this before closing. This is ridiculous!

I received a notice from Mortgage company American Pacific Mortgage stating I did not have any hazard insurance on my property. My hazard insurance has been current since loan was opened on XXXX and is good through XXXX. It is paid in full and is part of my escrow payment. When I called in on XXXX the representative I spoke with just said " we will take care of it '' and didn't ask for any details, not even the insurance company I am with ( which they have right in their records ). We feel that due to the lack of integrity of our loan officers and their team we were forced to pay {$1800.00} in extra costs associated with securing our mortgage from Pacific American Mortgage DBA XXXX Home Loans. We were told that they were familiar with HUD FHA XXXX Streamlined Loans. When in fact they were not. They were not honest with us on more than XXXX occasion. I'm trying to set up bi-monthly payments with my existing mortgage provider, American Pacific Mortgage ( XXXX ). I went through their setup process in XX/XX/XXXX and confirmed with my mortgage provider that everything was done correctly on my end. This was supposed to start with my regular XX/XX/XXXX payment, after I made my regular monthly payment in XX/XX/XXXX, which I did. Now I'm being told that I have to make a regular payment in XXXX and in XXXX before this starts. This is 3 months past the point I was previously told that this would start. I don't trust what American Pacific Mortgage is telling me and I feel that I'm not getting a straight answer, or any sort of confirmation when my bi-monthly payment will actually start. On XXXX we received a paper letter stating our mortgage was in collections so we immediately called the company. We were concerned because we had made our payment on time and in full. They told us that our escrow had started up and we hadnt made the right payment amount therefore it went into collections. We never received any communication on our payment going up and when it would. So we called immediately and made the payment. We kept watching our account and it never debited. Then received a phone call yesterday, we called back and they informed us that the payment didnt go through. They listened to the recorded call and learned that their representative typed in our account numbers incorrectly. This company has made so many mistakes since we started using them. Their customer service is horrible

My husband and I paid our mortgage on XX/XX/2022 using the mortgage statement that was sent to me by American Pacific Mortgage and the loan number provided on the statement. The mortgage payment has been deducted from my account. I called American Pacific Mortgage to confirm payment was applied to account because they didnt provide an online portal to review account. When I called I was told there was no record of an account in my name or my husbands name, I was told that mortgage number did not exist and that they have no record of a payment. I asked them how was that possible and I was told they didnt know and now my money is not accounted for and Im told we do not have an account but on all of our closing docs and our mortgage statement all have this loan number we were told doesnt exist.

I was mislead from the loan officer in stating and guaranteeing my loan would be approved.I was told on several occasions via text, email and phone conversations was loan was being approved however the day before closing my loan was denied. This has caused a hardship for my family and I. My loan officer also shared private personal credit information to my ex husband, real estate agent and sellers real estate agent without my consent. I feel my loan officer acted in an unethical and unprofessional manner. The loan officer did numerous, sometimes daily credit checks significantly lowering my credit score as well making in virtually impossible for me to apply elsewhere at this time

Mortgage was paid in full on XX/XX/2021. Escrow refund was issued and mailed on XX/XX/XXXX as verified by the lender. Refund never arrived, suspected mail theft. Called and spoke with representative on XX/XX/XXXX who transferred to supervisor. They refuse to do anything until XX/XX/XXXX, won't even check to see if it has been cashed. I informed them there have been at least 2 known theft cases in our neighborhood where we and neighbors mail was stolen. American Pacific refuses to reissue the check as requested. They said they will not accept a request to do so until after XX/XX/XXXX, then it will take a minimum of 30 business days to reissue the check.

Please see my previous complaint XXXX. I have attached the letter I received from American Pacific Mortgage. As I stated before, they do not read what they send out. They state that my current home value is {$820000.00} ( low estimate because the home directly behind me just sold for {$900000.00} ). They say I need to pay {$60000.00} to get my LTV ratio to 80 %. Last I checked the principal I owe ( around {>= $1,000,000} ) divided by their new estimate {$820000.00} ( again low ) is 80 %. This company cant even do basic math. Please investigate them for failure to do their job, incompetence, stealing from clients, and conflict of interest. Thank you.

I took mortgage forbearance in accordance with the CARES act beginning in XXXX of XXXX with American Pacific Mortgage. The account was in forbearance until they sold the loan to XXXX XXXX in XXXX of XXXX. Mine and my wife 's credit report now show a 120 day delinquency from American Pacific Mortgage even though our account with them is closed. I have called and emailed American Pacific Mortgage about the issue and they say that the account was in forbearance and that they never reported the account as delinquent but my credit score and report show otherwise so I am now unable to get another mortgage.

An electronic debit transaction payment was made to American Pacific Mortgage for the amount of {$1400.00} on XX/XX/20 for the first payment of loan # XXXX and the wrong account number was entered but payment was processed by this mortgage company and I had to make another payment that was due before it was considered to be a late payment. I made the second payment to APM on XX/XX/20 and the mortgage company has not refunded my overpayment. They continue to give excuses and have not sent me my money. I had a mortgage from American Pacific Mortgage, but they sold it to XXXX XXXX in XX/XX/2016. Since then, I make all payments to XXXX XXXX. I just got a notice from American Pacific Mortgage in the mail which says : " We would like to discuss your American Pacific Mortgage loan. Based on current records, you may be eligible to refinance your current adjustable rate mortgage with no application fees and no appraisal fees. '' On top of this very misleading message, I've never had an adjustable rate mortgage. This is trying to get me to refinance by scaring me about a mortgage I've never had!

I am not able to pay my mortgage due to COVID-19. I requested from my mortgage company, American Pacific Mortgage for Forbarance provided by the Cares Act. Called them in early XXXX. I followed up about 4more times. On XXXX XXXX, I called again and they said that they finally put me on Forbarance. They told me it would not getting reported on my credit, that it would be on freeze. As of today, XX/XX/XXXX, i hav I have a delinquency report on my credit and I believe that they did not put me on Forbarance. We refinanced our home with American Pacific Mortgage and the first payment was due XX/XX/XXXX. I mailed a check in on XX/XX/XXXX that was cashed on XX/XX/XXXX. Shortly after the check was cashed, I received notice that the loan was sold to XXXX XXXX XXXX. My Husband and I have entered into a contract to sell our home. We accepted an offer and relied on the information that the party was prequalified to purchase our home. The mortgage broker for the buyer did not perform due diligence and verify that they qualified for the loan prior to closing escrow. The day escrow was to close they found various red flags and now we stand to loose out on our deposit on the house we are trying to purchase. There must be remedies for this in regards to companies that prey on people and do not follow through.

Hi, On XX/XX/2020 someone pulled a hard inquire from my credit and from my wife credit. After reviewing the report through XXXX and XXXX XXXX, we got their name. It's American Pacific Mortgage. I reached out to one of their officers to remove this inquire. She said she did submit a letter to her company to remove it within 30-45 days. Now we passed the 45 days and looks like it did not remove it. American Pacific Mortgage does not have my authorization nor my signature to obtain this inquire.

I refinanced in XXXX and the old mortgage servicer has not refunded my Escrow balance. I've contacted them over a dozen times and each time they claim checks have been mailed, but I've received only two letters from them : An escrow summary ( with no check ) in XXXX and an acknowledgement of a request for investigation on XX/XX/20. We took forbearance with American Pacific Mortgage in accordance with the CARES act. As such, the loan should NOT have been reported as delinquent to the credit bureaus. I have spoken with American Pacific Mortgage and they said that they never reported it as delinquent but all three credit bureaus say other wise. The loan has since been sold to XXXX XXXX.
