I have a account with American First Financial and due to a natural disaster ( Flood ) in XX/XX/2016 and circumstances beyond my control my account became behind in payments. I sent the company a agreement and check stating in exchange for payment in full they will agree to remove the account from my XXXX credit report. On the check I wrote in cashing this check you agree to remove from XXXX credit report. American First cashed the check but did not uphold the agreement and remove the account from my XXXX credit report. The company did not return the check or notify me that they would not accept the agreement. FCRA does not demand all accounts be reported therefore a company does have discretions and permission to remove any account it chooses on a credit report. I sent agreement letter and check and American First did not uphold the agreement or notify me prior to cashing the check that they would not honor the agreement. In cashing the check they accepted the terms of the agreement.
