On XX/XX/2020 American Financial Resources, my mortgage company, received my payment for XXXX of {$490.00}. They did not attribute this payment to my mortgage correctly. I have been in communication with the company since XX/XX/2020 after receiving an automated phone call telling me to call them. Per the notes in the letter below, I have sent in a copy of the canceled check to them as requested, showing they deposited the payment. I have continued to send in my monthly mortgage payments in a timely manner as I always have. They have not, as of XX/XX/2020, corrected the mistake. I have received letters from AFR stating that I am delinquent by the amount of {$480.00}, with 2 late fees added of {$14.00} each for a total of late fee charges of {$28.00}, which will continue to accumulate until they correct their mistake. They have also notified the 3 credit reporting agencies, saying I am delinquent on my loan. The only reason that would appear to be true is because they will not credit my XX/XX/2020 payment correctly. The following is a copy of the letter I am sending to my mortgage company, American Financial Resources. I am removing my personal info as instructed by this website. " This is a qualified written request under Section 6 of the Real Estate Settlement Procedures Act ( RESPA ). I am writing to dispute the statement that I missed a payment in XXXX of 2020, this year. I sent a copy of the canceled check your company deposited, but never credited to, my account. I am enclosing a copy of that check with this letter as well. I emailed your company at : XXXX and received a reply message, giving me the ticket # : XXXX redacted ) Furthermore, I have been making my payments with your company through my banks billpay system for years. I received an automated phone call from AFR on XX/XX/XXXX telling me to call them. I did and the person I spoke with told me that you needed a copy of the front and back of the check sent to the email address XXXX. I was also told I would receive a ticket number when they received the email. I continued receiving phone calls, so I would call back to follow up. This is a list of the people I spoke with and the gist of the conversations. XXXX XXXX spoke with XXXX, he explained the phone calls would continue as the research was not completed. XXXX XXXX spoke with XXXX. He said it would take 5 days to complete the research. It had been 6 days, but he didnt have an explanation for why it wasnt completed. When it was completed it would be backdated to the correct date and any late fees would be removed from my account. I should call back in a few days. XX/XX/XXXX spoke with XXXX. He could see it in the system, it looked like it was almost finished, should be corrected by Monday XXXX XXXX. XX/XX/XXXX spoke with XXXX. He said I had not sent any information in and that I had not made the payment. I gave him the ticket number which I dont think he even made a note of, then I told him the 3 other conversations I had with other people in the company. He didnt see any notes about that, and stated that I should have uploaded documents to their website. I gave him the email address I sent the evidence to, pointing out that I wouldnt have known about that email if someone with the company hadnt told me about it. He was very short and dismissive about it all. We ended the call. XXXX on XX/XX/XXXX I called back and spoke with XXXX. He said he could see I just spoke with someone, but no other notes. I asked to give him my ticket number, he said he didnt need it. I went over my notes with him for each phone call with dates and names. Finally he asked for the ticket number. With the number he found the correct notes. He put me on hold to talk to a manager, but would not let me talk to a manager. He came back and said the manager was entering the rest of the information and it would all be corrected, again by Monday, which is XX/XX/XXXX. You have since added a note to my credit report with all 3 agencies stating potentially negative delinquent account, which continues to be on my credit report because this mistake has not been corrected. I have hired an attorney to help in the resolution of this mistake your company has made. ( redacted his information which I included in the actual letter to AFR ) I will be forwarding a copy of this letter to the credit bureaus and the Consumer Financial Protection Bureau, referred to me by the FTC I understand that under Section 6 of RESPA you are required to acknowledge my request within 20 business days and must try to resolve the issue within 60 business days. To the Consumer of Financial Protection Bureau ( CFPB ) I first became ill in XX/XX/XXXX. I was off work for three months which I returned to work in XX/XX/XXXX. However, I became ill again in XX/XX/XXXX in my mortgage began to be late in XX/XX/XXXX besides the inaccurate loan statements that were given to me due to the American Financial Resources and XXXX XXXX not working together to estimate my taxes correctly. The American Financial Resources and XXXX XXXX has caused me suffering damages of predatory lending practices while using coercion practices on me by forcing me into a extended repayment plan that they knew will further strain my ability to get back on track with my mortgage payments. In addition, no one called me to discuss this matter of me being delinquent on my mortgage payment. Instead I received an enormous amount of phone calls from the number XXXX which is American Financial Resources but when I answered the phone call will immediately hang up with no one on the line. In addition, I would call the number back at XXXX during business hours however I would get a recording that stated I reached them during non business hours which may it very complicated for me to discuss the situation. Finally, I used a different prompt with the same phone number to reach someone. However, when I spoke with the person I was told I can see if I qualify for an extended repayment plan for 6 months and this was around XX/XX/XXXX. Unfortunately, since I did not have the bill information she needed she told me I can call back to see if I qualify. I called back around XX/XX/XXXX when then I was told I do not qualify for an extended repayment plan. In addition, I told the person that I have been ill which has caused me increased in bills. I was told that I can try loss mitigation but if I do that understand it is a one time over the life of the loan so make sure that it is really needed at this time. Therefore, once I was able to reduce some bills I called back around XX/XX/XXXX. At this time I spoke to XXXX who was very rude on the phone. I told him I wanted to see if I qualify for an extended repayment plan that earlier I was told I did not qualify for. XXXX took my information and stated that I can make a payment and for XX/XX/XXXX and XX/XX/XXXX payment would be over 1800.00 dollars I explain to him that I could not afford that and I plan to get back on track with my mortgage payments very soon. However, I explain that I receive a letter threaten to proceed with foreclosure procedures as of XX/XX/XXXX. He stated well do the extended repayment plan I said I would like to do the one for over 6 months, XXXX stated that they no longer over a 6 month extended repayment plan. Before I knew it XXXX put me into an extended repayment plan for the higher payments for over 1800.00 a month. I stated to him I told you I could not afford that and XXXX told me it is too late he cant change it. Therefore, I was forced into an extended repayment plan that I told XXXX I could not afford. As a result, they used predatory coercion practices on me forcing me into the plan they knew would further strain my ability to repay. XXXX did not educate me that since my mortgage was on about 40 days past due that my mortgage will not be escalated to foreclosure on XX/XX/XXXX. Instead XXXX force me into a plan breaking the CFPB regulations according to the strong protection of struggling borrowers servicer must not make the first notice or filing requiring foreclosure process until a mortgage loan account is more than 120 days delinquent. In addition, nor did XXXX XXXX or American Financial Resources make phone contact efforts to help me with my situation instead they sent a letter threatening to start foreclosure procedures. In addition, both of these agencies make procedures more of a runaround than given me the customer service I needed to resolve my situation. I would like to be compensated for such predatory unfair and illegal practices for my suffering from XXXX and American Financial Resources. Last but not least American Financial Resources also consistently calculated my taxes incorrect causing me to pay a higher mortgage payment to later find out they owe me a refund. I was put through suffering of straining my ability to pay my mortgage during that time too. Please inform me how I will be compensated just as many other consumers are for predatory unlawful and unfair regulation practices. I look forward to your help with this matter. Currently my mortgage is only past due for XX/XX/XXXX which is about 11 days past due. P.S. Please also make sure they remove the extended repayment plan that I was forced into for XX/XX/XXXX and XX/XX/XXXX.

I refinanced my loan for 2 reasons. 1 ) to add my husband to the loan in case of my death and 2 ) to remove this loan from XXXX XXXX XXXX XXXX XXXX. During this process the Streamline was set up through ELend.com which is a division of American Financial Resources XXXX Inc. At the time this loan began I insisted that this loan not be sold to XXXX XXXX XXXX XXXX XXXXand wanted it in writing! I have an email from : From : XXXX XXXX Sent : Monday, XX/XX/2020 XXXX XXXX To : XXXX Cc : XXXX XXXX ; XXXX XXXX Subject : RE : [ Internal ] FW : [ External ] Re : Clear to Close Hi XXXX and XXXX, I can not amend any closing documentation as the loan will be sold by American Financial Resources/eLEND after closing to be serviced by another company. If your loan is sold in the future, I can not guarantee who they sell the loan too. However, per your request, this loan will not be sold by us to XXXX after closing. We will have another company ( likely XXXX XXXX XXXX who we will have service the loan. XXXX XXXX Vice President of Origination I then receive a letter a month after my first payment that the loan was sold and it was SOLD to : XXXX XXXX XXXX XXXX XXXX. During this process like the previous loan has the same problems. I paid a closing cost and I am the one doing all the work as the servicing company does not do their work nor the closing company do their jobs. I have to find out only by accident to get the exact property tax from the county. During the call I told them about the new loan and they had nothing from the title company paid by American Financial Resources or ELend from my loan. No New Quick Claim Deed which was wrong at closing and put closing off for another day until the corrected document was prepared correctly. That Quick Claim deed was never filed along with the Mortgage credit filed with the county .This paperwork was paid for and I should not have to babysit to be sure this loan was done and closed properly. I have since spoke with XXXX XXXX Chief Administrative Officer NMLS # XXXX American Financial Resources , Inc . XXXX XXXX XXXX, XXXX, NJ XXXX Company NMLS # XXXX XXXX XXXX called after a complaint was filed with Mr.XXXX XXXX Vice President of Origination at ELend. This is his response after a phone call he stated that it was their fault and he had tried to buy the loan back but could not do it. He also said he would in 6 months pay to have the loan redone. I suggested that they can refund me my closing cost of {$3500.00} and leave the loan as it is. I do not need to babysit another closing and follow up with the county over and over. So we can go two ways with this. 1 ) you offered in 6 months to pay my closing cost to do the new loan or 2 ) we leave it as is and refund my cost in doing the loan that was not done according to what I had ask for and agreed upon in writing. This began in XX/XX/XXXX. My monthly payment has changed so many times I can't keep up. American Financial Resources and/or XXXX XXXX has not calculated my escrow correctly from the beginning of the mortgage process in XX/XX/XXXX. They tried to do a correction in XX/XX/XXXX and pulled about {$500.00} additional out of my account without notice! I stopped auto " pull '' from my account and set it to auto " push '' for the same amount of my previous payments. I tried to contact someone to find out what happened but the phone numbers they provide give the customer the run around in an effort to make you give up and just pay what they say to pay!!! The next month the push started and they did not get what they wanted and then the threatening phone calls started and well as the collection service letters!! When I finally got in touch with someone, which is extremely difficult with this company, they stated that they had mailed me a statement in XX/XX/XXXX, but I never received the notice and after about 6 weeks of calling and trying to figure this out, a representative told me that it was mailed out to my former address ( an address I hadn't lived at for 2 1/2 years )! I find it suspicious that they can mail me a debt collection notice to my current address, but sent this change notice to a previous address. In an effort to pay down the escrow deficit, I made 3 additional payments to be applied to the escrow account. They applied it to the principle and sent collection notices to me for unpaid mortgage payments for the next 3+ months. It took nearly 6 months of calling weekly if not more to get this straightened out and I never talked to the same person twice! I couldn't get answers and the reps that I spoke to had only partial information from previous calls. I had to go through the whole series of events with each representative. We finally ironed out the issue and they reversed the additional payments and applied them correctly to the escrow, fixing the problem, but they did keep the late fees that were NOT my fault!! Everything has been fine for about 6 months. But now they are saying that my payment is going down ... .how is this possible when I just received the tax appraisal for XXXX and my homes value has gone up and so has my property tax rate?? Again, I did not receive any notice prior to my normal monthly statement. Normally, one wouldn't complain about a payment going down, but I know that this company does not know how to manage escrow accounts and they will blame me for any mistakes they have made and months of threats and phone call run-arounds are just ahead. Not to mention the late fees they will charge my account and NOT retract after they acknowledge a mistake was made. I understand that payments will change slightly when property tax rates change and home 's appraised values change. What I have experience was a $ XXXX/month change with very little tax and appraised value changing. This has been ridiculous! I believe they tried to take advantage of a single woman. And now I am back to trying to contact someone about this recent change using their web site contact numbers. Good luck with that. Here we go again!! This is an unacceptable business practices! As a XXXX XXXX XXXX how can I promote lenders that are doing this to their customers? American Financial Resources, who will not talk with their customers, needs to insure correct calculations are made AND reevaluate their communication processes with their account holders. Not being able to talk to anyone who cares within that organization is frustrating. They redirect you to XXXX XXXX which is filled with misinformed and unprofessional representatives that place any concern squarely on the customer.

On XX/XX/XXXX yes, almost 1 year ago I applied for a refinance and have been patiently communicating with various individuals at Elend Mortgage LLC with no resolution. I received a formal loan estimate on XX/XX/XXXX with a rate of 3.5 % and a 2nd loan estimate on XX/XX/XXXX with a rate lock of 2.75 % During the start of this process there was a two months delay, at fault of your company, where my Loan Processor missed vital information in her email that further delayed my refinance and inevitably caused a second hard pull of my credit. My Loan Processor repeatedly claimed the appraisal company had never submitted her the report and that she would follow up, and get back to me. This statement is one I found myself hearing every time I called and often it left me waiting for extended lengths of time with never any return phone calls as promised. On XX/XX/XXXX, I took direct action myself and called the appraisal company to find out that they had completed the appraisal on XX/XX/XXXX and actually submitted the report in a timely fashion. It has been in my Loan Processors email the whole time. Following that confirmation I called back my Processor to only hear her brush off accountability for the delay. Later on during this refinance process, as my appraisal expired due to lapsed time, my Loan Processor promised she would have your company pay for the re-appraisal but to this date there has not been a second appraisal requested, further delaying my process. After the initial appraisal delay was resolved, your company indicated there was an issue with the XXXX XXXXoad Maintenance Agreement ''. Again and again I was told by my Loan Processor " I'll follow up and give you a call back '' at which again, often left me waiting for extended lengths of time with never any return phone call. It was only after I myself emailed XXXX County and submitted images off the public GIS system did this get resolved. Now, for the last two months there has been a hold up because of " Proof of Owner Occupancy ''. I have submitted everything they have asked, including written explanations. But still Im being told that Its my responsibility to prove I live at the residence with no further guidance on what other documentation I should be submitting. I have lived in this home as my sole residency since XX/XX/XXXX, renting it for a year before purchasing the property with XXXX XXXX in XX/XX/XXXX. Aside, I have worked at the XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX that borders my property for 6 years. I feel as if your company is directly calling me dishonest. For the last two weeks now, I have left emails and voicemails for my Loan Officer, Loan Processor, and Processing Manager with 0 return calls. I am now getting 0 responses from your company representatives. I am under the full assumption that your companys representatives are trying to brush me off and just get rid of me. I was provided loan estimates with rates locks on 2 different occasions within the last year. I have continued to pay my mortgage payments of which approximately {$380.00} every month is interest on the current interest rate of 5.125 %. At this point I feel I am being discriminated against for being a single father living in a rural area. I have been subjected to severe neglect, blatant dishonesty, and unfair lending. In addition, I have been under severe financial hardship through the current pandemic crisis in America ; I need this new interest rate. After making regular payments for approximately a year on my mortgage with AFR they suddenly started placing notes on my account that my payment was not due. I noted this during my online payments for a couple of months and then received a more obvious note on my web portal that showed that my account had a positive balance. I called AFR and asked them to explain. I was told that when I made my first mortgage payment it was a month early and subsequent payments had also been early. The interest savings and escrow schedule had been moved back which accommodated approximately a {$1000.00} ( or about 2 full payments ). Since my account was a full two months ahead, per the recommendations of the AFR agent I spoke with I stopped making mortgage payments for 2 months. After a month and a half I started receiving collections phone calls suddenly and when I looked at my account it was badly past due, much more than the two payments I had skipped. I called AFR and after many subsequent calls and nearly 10 hours of hold and wait time they told me that another borrower had been making payments by mistake to my account. They told me there were approximately {$3500.00} of payments made to my account over the last 8 months. These payments were then removed at the exact same time I stopped paying because my account was ahead, despite the review that was done prior to stopping payments. The numbers I was given did not add up and the account ledger still does not add up. My escrow account was also adjusted and the money was removed from it reduced it to more than {$600.00} below what I had paid into it. When I brought this up with AFR they told me it was not my money that had been placed in the account, however, if you add up my payments and simplify their incredibly complicated account ledger it is easy to see that hundreds of my dollars are now missing. I also tried to explain this to AFR, however, they continue to point me back to my overly complicated account ledger and explain that it is correct despite the hard facts. In order to avoid foreclosure I borrowed money from another institution and paid off all of the bad debt on my account and brought it up to current. My escrow account deficiency was added to my monthly payments for the remainder of the year and caused my payment to rise by more than {$50.00}. AFR continues to threaten me with action against me even though my account is current. They also have assessed payment fees ( NOT LATE FEES ) that are being applied to my payment every time I make one. This has effectively raised my payment by more than 10 %. This is fraud. This company has been impossible to work with and has intentionally attempted to sabotage my mortgage using false claims that another lender was making payments to my account. I believe they have pre-screened mortgages that have more than 100 % equity and are " Rocking the boat '' to see if they can get some to sink and make money for themselves. I also believe they have intentionally overcomplicated their account ledgers to confuse borrowers and hide their fraudulent activities. My account is very simple. Every payment I make has principal, interest and Escrow. This is not how the ledger reads. Additionally no presentation of the escrow account has ever been made to me to show that the funds are being held accountable and applied in accordance to my mortgage terms. Please investigate this organization, they are ruthless and incredibly shady. Thank you!

PLEASE DO NOT USE American Financial Resource Inc. ( AFR ) for your loan application!!! They will screw-up your credit score due to their mis-conduct. They should not allow to do business anymore!!! Here is my true experience with American Financial Resource Inc. ( AFR ) recently. XXXX XXXX : XXXX Name : XXXX XXXX. Property in CA. XXXX I am writing this complaint to share my experience on my re-finance with American Financial Resources Inc. ( AFR ) and XXXX XXXX Bank did not handle my loan transfer/purchase correctly in XXXX XXXX which cause a very bad impact to my current credit report ( Down from XXXX to XXXX ). I had requested American Financial Resources to correct this immediately and also report the correction to all credit bureaus at once. However, they repeatedly screw-up their mis-conduct. This was what happened : 1. I had Cash-Out Refinance on my property in XXXX XXXX. The loan was closed on XXXX XXXX, XXXX with American Financial Resources Inc. 2. I received a letter from American Financial Resources in XXXX XXXX stating that the loan had been purchased by XXXX XXXX. 3. American Financial Resource continues to send me the mortgage statement monthly even the fact is the company no longer hold any lien to the property and request payment from me. 4. I have been paying XXXX XXXX bank on time every month since the loan transferred over to XXXX XXXX. XXXX. On XXXX statement from American Financial Resource, it stated I have been XXXX months behind on my mortgage payment. 6. I called AFR in XXXX and questioning about this misconduct and the customer service who I was on the call with me was very unprofessional and she told me that I need to contact XXXX XXXX to clear this issue. At the end she told me that she will report this to other department in American Financial Resource Inc. She then hung up on me. 7. On XXXX XXXX XXXX, the I checked my credit report monitoring service and noticed that American Financial Resources IncXXXX reported two months late payment to credit bureaus even American Financial Resources Inc. did not hold any lien on the Property since XXXX XXXX. 8. I called XXXX XXXX couple days later to report this serious mistake and the customer representative asked me to Fax in a written request to XXXX XXXX so that they can follow-up on this matter with American Financial Resources Inc. 9. After months of phone calls and emails between American Financial Resources and XXXX XXXX, American Financial Resources finally sent me a letter on XXXX XXXX, XXXX and acknowledged their misconduct on their end and will send the correction to the Credit Reporting Bureaus. 10. I saw the updated correction on XXXX/XXXX/XXXX of my credit report and my score went back to XXXX again. 11. However, in two weeks later, American Financial Resources once again sent late payment of 120 days report to Credit Bureaus and my score then down to XXXX in couple days. 12. I sent email again to American Financial Resource ( AFR ) again on XXXX XXXX, XXXX again to ask them to fix the issue. This time, no follow-up AT ALL. I am still looking forward to hear an update very soon on this matter from American Financial Resource Inc. A very upset customer with American Financial Resource ( AFR ).

My wife and I are in the process of building a new home on our property in XXXX ( county if that matters for some reason ). We have contracted with a local company called XXXX XXXX XXXX to build the home. XXXX does not offer a turn-key home, so we were looking for a bank that would allow us to act as our own GC. A friend got involved and referred us to a Loan Officer at XXXX XXXX named XXXX XXXX. We gave him all the information including that XXXX has a draw schedule that is different and that they don't deliver a turn key house. The friend that referred us ( XXXX XXXX ) and the Loan Officer figured that XXXX was a contractor and that we would step in as the GC. We had many issues with the Loan Officer but eventually we closed out our one-time close conventional loan in XX/XX/XXXX with the financial institute AFR. When we tried to get our first draw from AFR we ran into problems, which started in XX/XX/XXXX. AFR determined that XXXX XXXX was not actually a licensed or insured GC like he told us, but was using information from a company he was affiliated with ( he told us it was his company ), XXXX XXXX XXXX XXXX AFR admitted they did not vet XXXX at all, even the Contractor License he supplied them with was expired prior to closing. In XX/XX/XXXX when this came to light AFR said we were still responsible for the loan and we had to find a new GC and pay out of pocket for them. We were able to find another GC to work within our budget. Last week we spoke to yet another person at AFR who was very supportive and talked about how it seems that XXXX XXXX and XXXX XXXX committed fraud and said they were going to review our contract to get us more time to finish the build instead of the XX/XX/XXXX date ( 1 year from closing ). Earlier this week they called to say the only options to us are to pay off the {$10000.00} outstanding on our mortgage with them ( which only includs closing costs from our closing with them, we have been paying the amount due of {$50.00} every month since XX/XX/XXXX ) and start again with a new bank. Or we can refinance with them and pay new closing costs on the refinance. We have paid out of pocket up to this point. We have permits for the septic and building permits that were required that we get before they would close, and we paid out of pocket for the excavation and building of the pad because they said they were working on getting the draw situation organized. When I told them those options weren't acceptable they said they have zero responsibility to vet a builder and it's our fault for hiring the loan officer and they will have their lawyers contact us and hung up. We are now in a position where our permits will eventually expire, we will be out of contract with our builder and just have additional debt for construction and building permits for a home that does not exist. I have no clue where to even start with finding a lawyer.

We are a title company. We deal with many lenders. The Buyers chose XXXX XXXX Mortgage as their lender. This was a FHA loan so XXXX uses AFR XXXX American Financial Resources XXXX to service the loan. We had a closing date established for over XXXX weeks, but AFR could n't close and did not tell us until day of. Buyers had to rearrange their work schedules. Attempted to close a week after and on date of closing, AFR took issue with our Deed. The Deed language was legal and correct ( we are also a law firm XXXX but they refused to allow our closing attorney to speak with underwriting to discuss the issue. This went on for 3 days and delayed closing due to the loan processsors refusing to provide contact information for a manager or an attorney in underwriting. Our closing attorney finally looked up their website and found a number for the VP and spoke to him. This was after we already were suppose to close. VP instructed the processors to provide contact information and the issue was then resolved. Also, AFR kept changing their figures on the HUD and refused to approve it. Even attempted to add their own origination fee, which they can not because original lender XXXX XXXX XXXX XXXX was only XXXX allowed. XXXX XXXX and AFR went back and forth for almost a day until finally AFR changed the wording of that particular fee. Mind you, XXXX already sent the loan documents and it closed but this was 2 days later they said they were not approving the HUD yet! XXXX XXXX demanded they keep the closing date so Buyers did n't have to redo the loan. So for almost 3 days I went back and forth with AFR on figures, XXXX of which was XXXX cents they were changing, which changed the entire HUD!! XXXX XXXX tried to resolve the figures with AFR through numerous email exchanges but XXXX was funding so ultimately it was up to them to approve. Finally, on almost day XXXX, they approved the HUD a full TWO DAYS AFTER CLOSING. I almost missed payoffs and other figures that were date-sensitive on the HUD on our end for Seller. AFR refused to work with us, refused to communicate with us and only did so when their own VP stepped in. XXXX XXXX stated they have this issue with them a lot on FHA loans. Not sure why they still use them, but we had a XXXX closing lined-up right after this XXXX that we terminated due to AFR servicing it. We lost almost 3 days worth of billable hours, not to mention delayed closing by a week to begin with, due to AFR. We will NEVER work with them again.

I am writing in an effort to get my mortgage servicer, and by extention, my PMI provider, to automatically cancel my monthly mortgage insurance premiums. I have been in touch with AFR-American Financial Resources on many occasions over the past several months. Initially to request that my PMI be cancelled once my LTV reached 80 % and then, because they were making my life so difficult, I decided to wait until it would be automatically terminated. Or so I thought. My understanding is that, as long as my account is current, and my payment history has been clean, and my Loan to Value ( LTV ) breaches 78 %, the PMI is required to be terminated immediately. I called at the point that it reached 78 % and was told many reasons why it was not applicable. One representative told me that I had not reached the chronological midpoint of my amortization schedule, and that until that happened I would not have the PMI automatically cancelled. Another told me that they received some indication that the value of my home had decreased in value from the point I had taken the mortgage, and for that reason I would not be able to cancel or terminate the PMI. My understanding of the Federal Law is that once I breach 78 % LTV ( it is now 75 % ) they are obligated to terminate immediately. I do not believe either of those reasons are relevant in this case. Those are items that come into play if I am requesting that my PMI be cancelled ( at LTV 80 % ) My fear is that this is not an isolated incident, and that many other folks are having the same experience, perhaps less able to pay this unfair and added charge, Even if it turns out to be 1, 2, or 3 additional payments past the 78 % LTV mark, if you consider the number of potentially affected mortgages, we could be talking about tens of millions of dollars in unwarranted payments. Thus the size of this potential windfall might be a motivating factor in delaying the required termination process, which of course sets up the possibility of a class action offense. There is much more detail that I could provide, and several unkept promises from the service desk during this unending process, but the information mentioned above are the key facts.

On XX/XX/XXXX we signed a contingency form providing our $ XXXX. deposit. On XX/XX/XXXX we, my sister and I submitted an application for a mortgage. As of today 's date no definite response has been provided from the mortgage company AFR, American Financial Resources. On XX/XX/XXXX our contingency date was up on our mortgage commitment. We were told that the appraisers had sent an incorrect form, then there was a problem the AFR could not open the file sent from the appraisal. Our realtor applied for a two day extension with the sellers, as we were told that the appraisal had held back the commitment of the loan. On XX/XX/XXXX we signed a second contingency form as there was still not commitment forth coming. The reason given for the lack of commitment was the underwriter was on vacation and the loan was sent to another examiner. On XX/XX/XXXX we signed a third contingency from the reason given the loan processor required a change in the insurance policy of the complex. I would have thought the insurance policy of the complex should have be reviewed at the beginning of the loan origination. My sister and myself have signed numerous letters of explanation as well as provided numerous pay stubs and bank statements, employment verification 's. I do realize that this is part of the loan process. However, my sister received a phone call from one of the examiner 's he said he was calling the utility company to verify her balance with the utility company. When all parties were on the line he asked the representative if she was delinquent on her account. It turned out she was on a payment program. She lives on the east coast and heating raises the bill during the winter months. My addresses were verified as far back as XXXX. Almost twenty years ago .... I was also asked if I was ever married. Then I was asked how many times. I am applying for a loan based on my income. My marriage ended in XXXX. We have both felt under excessive scrutiny, and delay tactics. The complaint is about two things : First the length of time for the approval Second, is there a scrutiny tactic at work here based on sexism? On XXXX XXXX, 2021 I had my bank XXXX XXXX XXXX XXXX electronically pay for my XXXX XXXX, 2021 payment to AFR, serviced by XXXX XXXX. The payment was in the amount of {$3000.00}. My account was sold to XXXX, serviced by XXXX XXXX on XXXX XXXX, 2021 per AFR. I did not receive correspondence in the mail until after I had made this payment. All the letters came long after my payment was late even though they were dated prior. AFR claims XXXX XXXX, 2021 ; and at least XXXX other time around XX/XX/XXXX and XXXX, 2021 that they accepted payments on my account until XXXX XXXX, 2021. AFR only transferred my initial payment made to them which they show posted and cleared to their account on XXXX XXXX, 2021 which was intended to satisfy my XXXX XXXX, 2021 payment. XXXX XXXX, my new servicer has been contacted several times, most recently on XXXX XXXX, 2021 where XXXX XXXX from AFR and a female rep from XXXX XXXX which ended with a fourth promise from AFR to send the payment to XXXX XXXX. This time however, a the female XXXX XXXX Representative said she would note the account that AFR agrees they have received my payment intended for XX/XX/XXXX in the amount of {$3000.00}, that it had cleared my account, and that they would arrange to have it sent. At the beggining of XXXX I also forwarded a copy of my bank statement and the check showing it had cleared to XXXX XXXX so they could follow up with AFR. They also never did. My concern is, this has been said to me since the beginning of XXXX by AFR and they have done nothing about it, but make promise to do so. Both AFR and XXXX XXXX are reporting incorrectly. I had been looking to refinance by home mortgage as the interest rates are now lower than it was when I had purchased my home. I found a company called " Elend '' or " American Financial Resources, Inc '' who offered me 3.375 % interest rate and a lender credit of {$800.00} among other costs that were mentioned in the loan estimate which was provided to me by the representative of Elend. A copy of the loan estimate is available with me in the email format which can be provided if needed where the above costs and credits are mentioned. Based on the comparison of rates from other providers I went with Elend ( or American Financial Resources, Inc. '' ) solely because they provided a lender credit of {$800.00} which was higher than other competitors and hence the total cost of closing would be less. However, after my loan application was processed ( nearly 2 months after the initial rate lock agreement was signed ) I received a " Closing Disclosure '' document from Elend 3 business days before the closing date in which lender credit was reduced to {$65.00}. On questioning the representative from Elend about why the lender credit was decreased I got a response that it was not something they could do anything about. In this case the creditor ( Elend ) has not complied with XXXX XXXX XXXX ) ( XXXX ) ( i ) because the actual amount of lender credits provided is less than the estimated ''lender credits '' disclosed pursuant to XXXX XXXX XXXX XXXX, and is therefore, an increased charge to the consumer ( me ) for purposes of determining good faith under XXXX XXXX XXXX ) ( XXXX ) ( i ). In the hindsight if Elend had let me know from the beginning that the lender credit that they would provide would be {$65.00} then I would have never chosen them as my provider because I had better offers from others. I think that this tactic of mentioning a higher lender credit was used by Elend ( American Financial Resources , Inc ) just to get me to use them and not to actually provide the credit that they promised. They are also in violation of XXXX XXXX XXXX ) ( XXXX ) ( i ). I hope an appropriate action is taken.

I was approved for a loan modification with three trial payments. The fourth payment would be my 1st payment of modification which began in XXXX. My payment for XXXX I attempted to make XX/XX/XXXX, but my bank did not honor it so it was returned ; no fault of the mortgage company. I made another payment XXXX XXXX/XXXX which was accepted. I then receive a telephone call from representative XXXX on XX/XX/XXXX to advise that because of the bounced payment I would have to reapply for loan modification. I asked her why she said because the condition of the " trial '' is that I do not miss a payment. I then went on to confirm payment was made and honored with my bank and that as of XXXX I am no longer in " trial '' as now this is it. She said that there is nothing that can be done except me submitting my paperwork all over again to Loss Mitigation in order to prevent it from going to the attorney for foreclosure. I complied via fax and email, but then after reviewing my modification paperwork there was nothing in the correspondence to this effect. As my trial payment was over and now my initial payments began in XXXX so therefore, this should no apply to me. She then went to a " lead '' for confirmation and they confirmed that I was in " trial '' and could not miss a payment. I again became confused because my payment was honored and the representative who took payment failed to provide me with any of this information. Also, the XXXX payment portal is not working as it does not reflect the loan modification. I feel like they are doing everything in their powers to foreclose on my home, when I am doing everything necessary to stay in it. I am a single mother working extremely hard to provide for my family. Granted you are not responsible for the life situations that occur, but since then I have pulled myself up gained new employment and doing everything in my power to make sure I resolve this issue to ensure me or my family aren't faced with this dilemma again. This is extremely stressful, I am losing sleep over this and not eating.

In XX/XX/XXXX we changed homeowners insurance from XXXX to XXXX XXXX. We sent all documentation for the change to the mortgage company and were told that when they got the refund from the insurance company for the payment that they had just made the change would be made. We contacted XXXX and they told us they would send the refund to American Financial Resources. We heard nothing else on the matter and were under the impression that everything was handled until we went to file a claim for storm damage to our home in XXXX, and found out that our mortgage company did not pay our insurance and then they proceeded to apply their own insurance company from our escrow. So we found another insurance company to take our business and American Financial still wanted us to pay for their insurance. We do not feel that we should because we did what we needed to inform them that we changed insurances. Then the end of XX/XX/XXXXwe sent our monthly payment to American Financial and were notified that they did not receive our payment .So we contacted XXXX XXXX about whether the money order was cashed or not and when. We were informed that it was cashed on the XX/XX/XXXX. We then sent for a copy of the money order with XXXX XXXX and found out that our payment had been stolen from the united states postal box and altered with another name in the pay to line. XXXX XXXX told us it could take up to 90 days to deal with the bank that cashed it to get a refund. We have caught up on all of the payments that were missing and we are receiving notices stating that we are in default of our mortgage payment after they have received the payments, and it very frustrating. We do not want to move we have been here for 12 years and just want to make our normal payments and continue on. But we are also feeling like we are being harassed when we know we made our payments and we get all of this mail stating that we are in default. Plus they keep giving us the run-a-round.

As a first time home owner. I purchased my home XXXX At closing i paid everything i was obligated to pay including insurance premium in full for a year. In XX/XX/XXXX my mortgage company American Financial resources ran an escrow analysis in which resulted my mortgage increase from XXXX to XXXX. a {$290.00} increase MONTHLY. after reveiwing the escrow analysis - i found numerous errors in XX/XX/XXXX they paid the wrong insurance comany not even 3 months after i closed on my house, and paid my home owners insurance in FULL at closing. I found they disbursed payment to tax collectors office for sellers owed taxes. Which was not part of my closing agreement. I ended up paying {$4200.00} in taxes in XXXX when my taxes were $ XXXX Yearly. REGARDLESS of if tax collectors office was attempting to collect payment it was two different owners, two differnt account numbers- no communication was made to notify me in regards to their request for payment. My escrow account was - XXXX due to these errors. I feel like ive been taken advantage of and no one wants to be held accoutable this has become my issue and has effected me & my loan in great deal financially. And Mistakes like this shouldnt happen, and could of been avoided, if they were more thorough and rechecked before just sending out someones money. from XXXX to today XX/XX/XXXX no escrow analysis was ever re - run. after numerous phone calls, numerous fax 's. This is my 2nd complaint against American Financial Resources , Inc. within 4 months for the same problem. I received a notice in XXXX stating my escrow account was low and to either pay a full payment of {$750.00} to escrow or it would be added to my payment amount. I paid the full amount before the deadline. I got a new insurance policy at the end of XXXX, same terms with a cheaper premium. Sent in all of the required information within 2 days. Paying the full escrow amount and changing our insurance carrier reduced my overall payment amount. AFR did not make any changes to my account and I was forced to pay what they said so that I would not have any late payments on my credit report or even risk dealing with a foreclosure notice. After everything was finally updated in XXXX, AFR has still neglected to reimburse the overages paid. My last complaint stated to reimburse the overages of {$120.00} and pay directly to principal. I sent an email to customer service on XX/XX/XXXX and there has been no response. Nothing has been done.I am paying AFR more money by paying interest on a mortgage balance that is incorrect. Since it seems impossible for AFR to transfer the extra money to my principal balance, I want the overage sent to me either in a check or direct deposited back into the account in which it came from. If this is not done in a timely manner, I will be forced to hire an attorney and sue for damages. I have experienced nothing but problems since I was approved to buy my house. The application process is a drawn out joke and financing through American Financial Resources , Inc. is just the same. Customer Service Reps do not know what is going on but they will argue with you to the death. I had one lady argue with me to the point that she was actually screaming at me.

I have American Financial Resources Inc ( AFR ). as the mortgage company, with XXXX as the servicing company. The company charged a late fee based on when the check cleared my bank. The payment is due by the XXXX of the month and was received by the bank on the XXXX. It cleared the bank on XX/XX/2015. I called and spoke to the AFR and they credited me the late fee. My regular payment is {$1700.00}. I made the payment due as indicated on the XX/XX/XXXX statement of {$1800.00} ( {$1700.00} + XXXX for late payment ). In XX/XX/XXXX the amount due was {$1600.00} per the statement which reflected the late payment credit for {$62.00}. I sent a Payment of {$1600.00}. Now in XX/XX/XXXX, AFR charged me a late fee of {$64.00} for paying the statement balance of {$1600.00} in place of the regular payment of {$1700.00}!!! I paid what the statement showed as payment due and I got charged another late fee for not sending in the regular payment. My Complaint : 1. Per the AFR XXXX XXXX supervisor ( XXXX XXXX ), they will charge me late fee based on when the check is cashed by them and not when the payment is due. SO if my payment is received by them on XX/XX/XXXX and clears my bank on XX/XX/XXXX, they will charge me a late fee because the cleared on XX/XX/XXXX. This is a violation of the terms of contract which state the payment receipt is due by XX/XX/XXXX. 2. For making the payment as stated on the statement as minimum payment due, AFR charged a late fee stating the charge is due to me not sending the regular payment due. I paid what the statement asked for and still got charged a late fee for sending partial payment!! American Financial Resources and XXXX are making their own rules and charging fees that are not legal. Please help!!

In XXXX I had trouble using the automated system, which resulted in me having to pay a fee by the time I got it to work. I assumed this was my fault. In XXXX, I attempted to pay by phone sometime between XXXX XXXX. I was then contacted by letter, saying that there were non sufficient funds for the payment. I checked my account to make sure there was n't a math error and to confirm that there were funds available. Once I confirmed this, I attempted to pay my payment again on XXXX/XXXX/15. I was contacted around the XX/XX/XXXX by phone, by the company and they stated that they had not received payment. I explained to them that I had tried to pay twice and that the funds are in my account. At that time, the representative told me that I entered my checking account number wrong ( both times, the exact same way ). I told him this was impossible, because I do not even key my checking account info in, and that I always just use what is on file. He refused to admit that there was any kind of glitch with their automated system. When I called to pay my payment in XXXX, I made sure to listen to the automated system when it asked me how I wanted to pay. It does not read me the entire account number, it only asks if I want to use the account ending in XXXX. There is no way I could have entered the information wrong, all I did was say yes that I wanted to use the account that is on file. Now they are trying to charge me {$15.00} for each time that the payment did n't go through ( even though it never even touched my bank account ), plus a late fee, plus they charged me extra to pay by phone because the payment was late. In all the total fees are nearly {$60.00}, even though I tried to make my payment twice before XXXX XXXX.

On XXXX/XXXX/16, I submitted an online application to refinance our 1st and 2nd mortgages to reduce our APR and shorten the term of the loan from 30 years to 15 years. When the appraisal came back $ XXXX under estimate, we were presented with a couple of options to proceed. Since continuing 'as is ' would cost us {$270.00} add'l per month, we chose to increase our rate and use the excess funds ( originally intended to payoff the 2nd mtg ) to payoff cc debt and do some needed home improvements, saving $ XXXX in pmts and leaving us with some cash in the bank. I called to inquire about changing the loan details for the payoffs and was told we 'd receive the check anyway, so no changes were necessary. At closing, I confirmed with the notary that the check would be sent to our home address. I called title prior to closing to confirm that the check would be XXXX XXXX to our home address. We did not receive a check because eLend wired it to our XXXX and paid off our 2nd mtg - saving us ZERO in monthly expenses. We are still left with existing cc debt at $ XXXX, the add'l pmt for the XXXX at $ XXXX, outstanding home repairs, and no cash cushion in the bank. Had it been made clear that we would not be receiving the check for $ XXXX, we would not have included this in the refi, and would 've simply refi 'd the 1st mtg only. I feel that we were mislead, either by miscommunication or omission, with regard to the final steps of this loan process. Had the closing disclosures specified to whom the payoff would go ( ie : '2nd mortgage ' or XXXX & XXXX XXXX ' ) it would have been an easy correction to make when we signed with the notary and could 've easily rescinded and restructured the loan during the 3-day ROR period.

My mortgage loan was modified in XXXX by XXXX XXXX at that time an escrow analysis was completed and my payment increased {$17.00}. My loan was transferred to American Financial Resources in XXXX XXXX. I recently recieved a statement from this company advising that I have an escrow shortage of {$2000.00}! I called and spoke with a customer service rep who was rude, and basically told me yes the previous servicer did not complete an escrow analysis which is a direct result of the large shortage but we cant do anything about that now as the new servicer and the funds were already advanced to pay your taxes. This is a clear RESPA violation that no one wants to take responsbility for and put it on the consumer. This money should not be only me to come up with this is the servicers error and they should take full responsibility and take the loss! I then emailed the servicer requesting an escrow spread as I do not have the funds to pay the shortage in full and beginning XXXX/XXXX/XXXX they are increasing my payment {$180.00} to cover the shortage over 12 months. I can not afford this error that was not mine I pay my mortgage payment and it is the responsibility of the servicer of my loan to pay my taxes and insurance out of my escrow account and to also review annually to ensure funds are available for these advancements. I am a single mother, living paycheck to paycheck and i refuse to be taken advantage of my money is hard earned! I have not heard anything back from the request to spread the escrow shortgage over 5 years and the request was sent XXXX/XXXX/XXXX. I will not stop here with the complaints I will make a RESPA complaint as well as go to the media and social media if necessary, please help!

I have a home equity loan with American Financial Resources ( aka eLend.com ), serviced by XXXX XXXX. My loan allows additional principal payments. However, submitting additional principal payments proved to be quite difficult. On a number of occasions, XXXX applied my payment intended as additional principal, to the next month regular monthly payment instead ( which obviously defeats the purpose of making an additional principal payment ). Each time I reached out to them to request a correction, using their web site ( XXXX ) and/or the customer service line ( XXXX ), and each time I had to make one or more follow up calls before correction was made. What 's worse, at least on two occasions the correction was made in a way that made the payment history section on their website for my account very difficult to understand, and on one occasion my account was about {$900.00} short. While those errors eventually got corrected, I am in a similar situation once again. On XXXX/XXXX/2017 I made a payment that was intended as additional principal payment. XXXX applied it as my XXXX payment. On XXXX I reached out via their website and requested a correction. Their website said someone will respond in 5 business days. On XXXX there was still no response, so I called their customer service line. I was told the correction will be done within 8 days. Yesterday XXXX - still no correction, I called the customer service line again. Same thing - no explanation why it was n't done in 15 days, and they ask me to give it another 3 business days. This is obviously unreasonable, and amounts to denying me a possibility of making additional principal payments.

I paid for a house appraisal in XX/XX/2016 asked for by AFR doing business as Elend. I had applied for the Refi loan in XX/XX/2016. I submitted all documentations they asked for. It took them so long to process the loan papers that the " 4 '' months window for the validity of the appraisal ( per their loan employee ) they gave me, expired. In XX/XX/2016, they demanded that I re-appraised my property again. I objected as it was on their end that the process stalled. I asked for a refund for the appraisal costs as I found a more reputable company to process my loan. The loan officer I spoke to at eLend refused to reimburse me. I, then, contacted a law firm, gave them the factual information and they wrote a demand letter to eLend on my behalf asking them to reimburse me for the appraisal fee. The law firm for the eLend, AFR, company emailed me a legal letter stating that they do not refund money. When I received the letter from AFR, I contacted the law firm I asked for advice and they advised me to contact yours and other agencies who could be better able to help me to file for a complaint. The company information in question is- AFR American Financial Resources , inc. doing business as eLend. I would like to file this complaint as a warning to other borrowers who may want to do business with this company. I researched eLend online and found that there are also many other people who lost money the same way I did dealing with this company. If legal documentations, emails between eLend and I, etc., of the facts stated above, needs to be presented please let me know and I 'll provide it.

On XX/XX/2016 I began the process to refinance through " eLend '' and signed the initial mortgage disclosure package. I agreed to a XXXX year loan fixed rate of XXXX %. I provided all requested documents in an expeditious manner and satisfied all requests from the lender to include an appraisal they directed me to use. On XX/XX/2016 I received an email from processor XXXX indicating my loan has been conditionally approved and the rate lock of XXXX % would be expiring on XX/XX/2016. In addition the email requested documents within XXXX hours. I immediately sent all requested documents, satisfying the request and sent an email to XXXX indicating the documents were sent. I did not receive a response until after the rate expired on XX/XX/2016. I was informed the rate would be extended. After several attempts to contact XXXX to once again check on the status of my loan, I received an email indicating the rate lock had expired again on XX/XX/2016. I spoke to origination XXXX XXXX and explained I have sent all requested documents and did everything on my part to satisfy the loan, but " eLend '' has allowed the rate to expire twice. XXXX apologized, but said the best they could do was increase the rate to XXXX % and charge me fees. I pleaded my case once again and XXXX called back explaining he would waive the fees, however could not give me the original rate of XXXX % even though it was " elend 's '' fault for the rate expiration. As a result, I have lost credits paid towards closing costs and have an increased rate due to elend 's lack of ability to process a loan.

This is my second complaint submitted in which my first complaint was regarding my mortgage servicer reporting my account late in XX/XX/XXXX in which I have not received written response from the servicer regarding resolution and my account is still reported late for XXXX. This current complaint is in regards to my escrow. AFR is in violation of regulatory servicing requirements as an escrow analysis can only be done once every 12 months. AFR completed an escrow analysis and mailed me a statement dated XX/XX/XXXX for analysis period of XXXX in which there was an escrow shortage of XXXX and my payment would be increasing XX/XX/XXXX {XXXX}. I now recieved another escrow analysis dated XX/XX/XXXX in which they claim I now have a shortage of {XXXX} for an analysis period of XXXX. I called them today XX/XX/XXXX and got a very rude unhelpful representative whom couldnt and wouldnt answer why another analysis was completed and questioned if I requested the XXXX statement multiple times as I told her I dont call in I just pay my payment every month I did not request anything from them. She ended my call with muttering an email address to send a request for research my escrow issues. I had a loan modification in XXXX in which ever since then my escrow has a shortage. I believe my modification was done incorrectly which is causing these escrow shortages to occur. I want a written response from the company regarding both complaints and resolution. I have already put in XXXX complaint regarding this company. They reneged on the interest rate lock period. However in communicating with XXXX XXXX, he sent me the following information about the procedure of setting up the loan and getting an appraisal. As you can see, XXXX states that '' we lock the rate for 45 days. Once we receive your documentation that is when we move forward with the appraisal and ultimately bring the loan to closing. " XXXX, I followed XXXX 's instuction and had the appraisal done. However, all of my information was not submitted before the appraisal. I paid, I believe {$420.00} for the appraisal and yet, my XX/XX/XXXX tax returns were not turned into XXXX. I actually did not get my XX/XX/XXXX tax returns until XX/XX/XXXX The directions were not followed. XXXX XXXX then rescinded my 45 day interest rate lock and I lost my money and the ability to get the loan that I wanted. I sent XXXX an email telling him that the proper timing for the appriasal was not followed, but I have n't heard anything from him regarding a return of my appraisal costs. I have a mortgage through American Financial Resources ( AFR ) and was offered an IRRRL through eLend, which I agreed to complete. It has been a nightmare since inception. They XXXX around and the rate went up, then was finally locked in. Then, my escrow was half ( per month ) what it was supposed to be. XXXX XXXX provided the excuse that since wind coverage is n't a required coverage, they forgot and left it off. Keep in mind my original mortgage was through AFR and they had the wind in the escrow. I live in the XXXX - where we have hurricanes ... which means high winds. I asked for the escrow to be recomputed and now my payment is $ XXXX/month higher than my ORIGINAL payment. Keep in mind, my insurance and taxes have not increased more than {$100.00} in a year, my financed amount went from {$250000.00} to {$240000.00}, and my interest rate dropped XXXX basis points ( .5 % ). So my original payment was roughly {$1800.00} and is now at {$2000.00}. With my principal amount at roughly {$1100.00}, the $ XXXX+ escrow amount per month puts the escrow around $ XXXX- $ XXXX/year. Last year, my flood, wind, liability coverage and taxes were {$6800.00} ( roughly ). I want AFR to fix this once and for all. Getting tired of dealing with these XXXX as they think I am stupid and will pay an additional $ XXXX/year for them to hold on to. My first payment will be considered " delinquent '' by XX/XX/XXXX so I would like this fixed before then. Thank you.

My current loan servicer is American Financial Resources ( AFR ) also known as XXXX. I tried to submit a payment on XX/XX/XXXX and was not able to log into the system. I received a letter on the same day ( letter dated XX/XX/XXXX ) that the loan was being transferred effective XX/XX/XXXX. After that date the new servicer would be collecting payment which meant that my current loan servicer would still be collecting payment until that date. The letter stated to contact the current servicer and new servicer if I had questions. I have contacted my current servicer via 5 different telephone numbers, one of which was provided in the letter and others I found online, and via XXXX which is where customers usually go for account information. I am getting nothing but recordings that state either the agents can't access accounts or the systems are down and please hold for a representative that never comes on the line. I have also tried to reach out to my new servicer and they have no information because I am not yet their customer, technically. I am afraid now that my account will be in default because I have no way of accessing my account while their transition is taking place and today is XX/XX/XXXX ( 3 more days until my loan is 30 days late ). I feel that AFR/XXXX is still responsible to their customers up until the date specified in the letter.

Loan Assumption closing on XXXX XXXX , XXXX This has been a horrific process! Original Loan f rom XXXX and XXXX XXXX XXXX AFR/ XXXX . We requested an assumption package from AFR per their request and was completed per their request in XXXX this process took approximate 5 months with numerous paperwork requests from both parties. I have contacted XXXX and left numerous messages with no return calls. I have been receiving bills still on this home from AFR mortgage XXXX when XXXX XXXX XXXX has received bills from his assumed loan from AFR and is making payments, but yet I am still receiving bills. When I called AFR I was told they needed a copy of the Recorded agreement, XXXX , and XXXX . This should have all been taken care of through their own company/title company and subcontract company. I spoke with a supervisor XXXX who stated he was unable to assist me through customer service. Please Help! We closed on XXXX XXXX , XXXX and this is still an issue. This company - American Financial Resources- is a repeat violater of the " Periodic Statement Rule '' of the " Dodd-Frank Wall Street Reform and Consumer Protection Act ''. " The Consumer Financial Protection Bureau ( CFPB ) implements these rules. Under the periodic statement rule, your mortgage creditor or servicer must provide you with a mortgage statement each billing cycle ( usually monthly ) that meets certain timing and content requirements. In most cases, the statement must be sent within four days after the end of the courtesy period of the previous billing cycle. A " courtesy period '' is the time period between the date the payment is due and the date the late charge kicks in. '' In my case the grace period is the XXXX of each month, after which late payments kick in. So, that makes the latest that AFR is supposed to have my eStatement available online as no later than the XXXX of each month. They have, on four occasions since XXXX XXXX, 2016 failed to provide me with my eStatement by the time period required by law. I have had to email them about this each time and they are always late in getting the eStatement to me. The last eStatement that is available to me is for XXXX XXXX, 2016. At this time they still do not have my XXXX eStatement available for me to download - and today is XXXX XXXX, 2016.

dear sir/madam : I am fed up and sick to my stomach from hearing and reading about equal opportunity and anti discrimination laws for the last twenty years since I came to this country. after many many incidents over the years, this is the latest incident : I send full application for home refinance to elend.com ( new jersey ), on XXXX within 2 days they provided the credit report from XXXX agencies with score of XXXX, and accepted the income requirements and sent someone for appraisal and charge me {$420.00}. for four weeks after that I was sending emails and making calls with no result. on XXXX they called me asking to provide 1- statement to explain why I got my social security card on XX/XX/XXXX ( the time I came to USA ), 2-documents from XXXX party CPA accountant to show the XXXX for past years although I provided them with complete tax returns from my accountant with there name and signature and contacts. 3-wait for additional possible requirements, although the application was sent with over XXXX pages that include every piece of information any lender would ever ask for. when I got angry about that they called next day to tell me they withdraw the application. up to this moment I have not got copy of the appraisal, and I called the guy who did it, and he said they should give it to me not him.

As I described in my complaint from XX/XX/XXXX ( and this happened again on XX/XX/XXXX ), American Financial Resources ( via their loan servicer XXXX ) do not accept additional principal payments payments exceeding 20 % of the current outstanding balance. This is a violation of my mortgage terms. 1 ) They responded - they claim this is because of the risk of " the funds being returned as non-sufficient funds ''. This is absurd, because they would accept {$10000.00} payment if the balance on my loan was {$50000.00}, but not if the balance on my loan is {$10000.00}. The risk for them is exactly the same in both cases, so they clearly have other reasons for this policy. 2 ) They advise to mail them a check instead. I tried doing that about a year ago, using my online banking. They consistently misapplied my additional principal payments as my next monthly payment, so I do n't have much confidence in this workaround they are suggesting. 3 ) Their web site just gives the error message " Additional principal must not exceed 20 % of the current principal balance '', without any explanation or a mention of the other ways to make this payment. I think CFPB should demand that the bank and their loan servicer change their policy and abandon this limitation on additional principal payments.

In XXXX XXXX I refinanced my manufactured home with acreage through American Financial Resources , Inc . This mortgage agreement stated that my payment would be {$1100.00}. In XXXX XXXX the papers were assigned to XXXX XXXX, XXXX which also states that my payment will be {$1100.00} will be due beginning XXXX/XXXX/XXXX. I then receive another XXXX dated XXXX/XXXX/XXXX stating that I have a new payment beginning {$1000.00}. My last XXXX dated XXXX/XXXX/XXXX was actually a closeout statement as American Financial had reassigned my papers to XXXX, XXXX. I was informed in a letters from XXXX and American Financial Resources that this reassignment was to be completed XXXX XXXX, XXXX. My payments were to stay the same. All along I have paid an amount of {$1200.00} trying to decrease the balances ( P & I and/or Escrow ). If I had an emergency ( which happened in XXXX XXXX ) I would have a little extra in the budget to pay for the emergency. I then received an XXXX from AFR dated XX/XX/XXXX stating that I have a shortage of {$1200.00} and they want the money by XXXX/XXXX/XXXX or my payment beginning XXXX/XXXX/XXXX will increase to {$1200.00}. This most recent statement shows negative balances beginning XXXX XXXX. It would have been much easier for me if I would have known about it sooner.

We had our mortgage thru American Financial Resources and was paying {$1900.00} on XX/XX/XXXX our new statement went to {$1600.00}. In XX/XX/XXXX our mortgage was sold to XXXX XXXX XXXX and payment remained the same {$1600.00} until XX/XX/XXXX we received a letter from XXXX XXXX XXXX stating as of XX/XX/XXXX or payment was going to increase to {$2200.00}, unless we paid a shortage of {$4000.00} plus add PMI back on which would still have our payment go back up to {$1900.00}. We had no clue what was going on so we called XXXX XXXX & they said there was a shortage on our escrow which they paid when they took over loan in XX/XX/XXXX, so we then called American Financial Resources and they acted as if they had no clue as to why, then after several attempts to talk with someone concerning our loan they said there was a computer error back in XXXX that dropped our PMI and lowered our mortgage payment so for a year we paid what was in our statement each month from American Financial and also XXXX. In XX/XX/XXXX we paid XXXX the {$4000.00} plus took our mortgage payment from {$1600.00} to {$1900.00}. We was told by both mortgage companies there was nothing we could do nor was either willing to work with us on a problem on there behalf. Is there anything that can be done about this?

I filled out forbearance paperwork with American Financial ResourcesXX/XX/XXXX due to COVID-19. XX/XX/XXXX at XXXX in a recorded conversation I was told that my account was in Forbearance and that they would switch my Forbearance to COVI-19 Cares Act program. XX/XX/XXXX XXXX, I called and spoke with a manager that confirmed I was on the Cares Act plan even though I received a letter stating they were going to report it to my credit. XX/XX/XXXX XXXX, I spoke with a manager after it was reported to my credit and they confirmed it was a mistake and removed it from my credit. XX/XX/XXXX XXXX, I spoke with another manager and stated that they need to remove it form my wife 's credit as well because we are both on the loan and he agreed. XX/XX/XXXX XXXX, I spoke with a manager to find out why it was put back on my credit and why it was reporting late. The manager realized they made a mistake and never properly switched me over to the COVID-19 plan and I was still on a regular forbearance plan. Manager stated that he would correct the error. The error since has not been corrected as I've had multiple conversations with American Financial Resources supervisors and managers. It is still reporting negative on both our credits.

Approximately on XXXX XXXX, 2016 I contacted XXXX. The were very eager to help me re-finance with money out. I completed all their paperwork with in about 7 days. They then told me it went to the underwriters. At this time I paid {$490.00} for an appraisal for my house to qualify for this loan. My appraisal came in at {$320000.00} and I wanted to take out all I could which meant I wanted my loan to be {$260000.00}. I then waited for the rest of XXXX, XXXX, and XXXX calling them approximately every 10 days to find out where my refinance was at. And everytime I called they said it was at the underwriters. By this time I contacted another mortgage lender and closed within 3 weeks. I think they should refund my {$490.00} for my appraisal fee. AFR ( American Financial Resources ) was the lender on my refinance. They were supposed to pay the XXXX Insurance and never did. I have tried to call, left messages and tried to contact the corporate office with no response over the last 4 months. The loan was transferred to another company and they can't get the company to respond to them either. My house closed on XX/XX/2022 and within my closing cost AFR was supposed to pay the XXXX Insurance invoice. They never did. On XX/XX/XXXX the XXXX Insurance provider ( XXXX XXXX XXXX XXXX ) canceled the policy due to non payment. The invoice for the flood insurance was required by AFR to get my refinance and is listed in the closing cost for them to pay. They also had a copy of the invoice ( required for refinance ). I requested a copy of my file that shows what they paid so I could find out if they didn't pay anything else. No response and no file. I had to get another flood insurance policy from XXXX and that has been paid. My problem is because AFR didn't pay the policy so there was a lapse in coverage which is costing me an additional {$300.00}. I do not think this is fair. Maybe you can get an answer for my problem. Past Story : We get a discount on our property taxes. Each year we go in for review. XX/XX/XXXX review showed we had to pay more, there was an adjustment for XX/XX/XXXX & XX/XX/XXXX. XXXX/XXXX # XXXX were sen adjustment bills. They were late in paying, interest & penalties were added, but they did make some payments. There was a balance due by XX/XX/XXXX or more interest & penalties would be added, as of XX/XX/XXXX that balance has not been paid. Our prop tax account reads in big red letters : DELINQUENT STATUS. I have contacted them by phone & email several times. They told me my taxes would be paid when due, I told them they are past due, they would not give me a date when they would be paid. For me not to worry I would not be responsible for any of those interest & penalties. So far the payments made include interest & penalties taken out of my escrow account. XXXX XXXX at XXXX Co Assessors Office has called them and sent paperwork trying to get payment. There are 2 attachments. Per the information on PMI posted to there web site provided at attachment, it states that the PMI requirement for the mortgage will be automatically canceled when the loan to value ( LTV ) of the mortgage reaches 78 % of the original property value of the mortgage. This occurred after the XXXX XX/XX/2018 mortgage payment. I called the lender to discuss this approximately on XXXX XX/XX/2018 and was informed they would look at it. I was again charged PMI in the XXXX payment so I called the lender again around XXXX XX/XX/2018, to advise that the PMI payment was not in accordance with the information posted on their website and why were they still collecting it. Again I was informed they were reviewing it and would advise me shortly. On XXXX XX/XX/2018, I received the letter from the lender provided at attachment advising me that I would have to pay {$100.00} for a Brokers Price Opinion ( BPO ) on the property before they would considering cancelling the PMI requirement. This new BPO requirement is not addressed anywhere in the lender 's PMI information and is in direct conflict with the information that is posted.

I applied for a mortgage from ELend.com. Part of the reason I picked this company is because they offered a {$500.00} check if your loan did n't close on time. Over the course of a month and half their representatives asked me for information covering every conceivable thing imaginable. I provided college transcripts, signed contracts, explanation letters, tax documents, and mountains of bank statements. Each time I provided what they asked for, they came back and asked for a new set of documents. Nothing seemed to satisfy their desire for more information. After over 45 days of meeting their demands I finally realized that they simply did n't have any desire to fund my loan. This has caused me to lose the ability to purchase the house I wanted. They are making excuses to why they should not pay the {$500.00} they promised. I feel like they did n't make a good faith effort to fund the loan. I also believe they are not fulfilling their obligations in providing me a with the {$500.00} guarantee. I respectfully request they credit me the {$500.00} that is guaranteed on their website.

In XXXX I requested a review of my escrow account because it is an FHA loan and the amount owed has dropped below 20 % so that the PMI should not be charged to my account. I was told they would conduct a review and that I would receive a letter within 30 days. I contacted them again in XXXX to follow up and I was told they had conducted a review and that I was entitled to a refund and that a check would be mailed to me. I contacted them again on XX/XX/XXXX and I was told they stopped charging me the escrow payment but they needed to conduct a review and that a request for review and refund had never been submitted and that a review would take until XXXX at the end of the year. This makes no sense. How did they determine to remove the escrow unless they completed a review. It seems they are holding onto my excess escrow for some reason. American Financial Resources is my mortgage servicer. My monthly payments includes an amount paid to escrow for insurance and property taxes. American Financial Resources debits my escrow account for disbursements, such as the property tax bill, but the tax assessor does not actually receive the check payment until 25-30 days after when the disbursement was taken from my account, meaning AFR is floating the payments to their benefit. Most recently they disbursed my tax payment on XX/XX/2016 for a bill that was due on XX/XX/2016. I called AFR customer service and they stated the check had been mailed on XX/XX/2016, yet as of XX/XX/2016 the tax collector has not received it. This is creating a problem for me as I am refinancing with closing the week of XX/XX/2016. The new escrow agent is reporting the taxes as up-paid and requiring me to pay twice, even though I have shown them AFR claims the payment was made. AFR should not be allowed to float the escrow payments as is their practice.

It is the second time since I refinanced my mortgage with AFR. Since I got my very first statement, I tried to register my account on their website ( provided in the statement ) to set up automated monthly card payments. I keep getting " No Records Found-Error '' and unable to register my account. I have called AFR multiple times, spending at least five hours total on hold. I was told by at least four representatives that my problem will be resolved in the next 48 hours. During each conversation they prompted me to pay by the phone which I don't like doing. Still, after two weeks that my issue hasn't been resolved, I paid by phone. Now, a month later, I still am unable to register my account. I refuse to have to call AFR every month to make a payment and not have access to online payments as they state to view the status of my loan and set up automated payments. This is blatant disregard for the services they are meant to offer as a loan servicer.

I have applied for a home mortgage with American Financial Resources. They asked me for information in regards to some properties that were included in a bankruptcy, which was discharged and I was no longer held accountable. AFR is claiming they were foreclosed on after my bankruptcy ( keep in mind no longer my obligation ). I know the law states I once the bankruptcy is discharged I am no longer responsible financially for the properties. I provided all the documentation and explained to them the process. They are now asking for documentation that does n't even exist and asking for letter from my accountant that he legally ca n't document. American Financial took two payments from us during transfer of mortgage to XXXX. They sent one payment to the new mortgage but not the second. I obtained a first mortgage a little over 3 years ago. In the closing documents, it stated that XXXX of 2021, we would be able to cancel the PMI. I tried for 2 months to get this done and they never even acknowledged my concerns. I complained to the XXXX XXXX XXXX and eventually, the company did send a letter stating they needed {$100.00} for a " Broker 's Price Opinion ''. I paid {$100.00} extra each month towards the principal on my loan, on XXXX, XXXX, XXXX and XXXX/XXXX/16. There is no prepayment penalty and I am trying to reduce the amount of interest and pay the loan off early. Instead of applying the payments to the principal each month, on XXXX/XXXX/16 the company applied {$350.00} to the XXXX payment and only {$42.00} to the principal. I also had scheduled a payment for XXXX XXXX and again on XXXX/XXXX/16. The company now says I do n't need to make another payment until XXXX/XXXX/16. This will not reduce the amount of the principal, nor will I save on the interest or pay off the mortgage early. We applied for a VA construction loan through our broker ( XXXX XXXXg ) and AFR was the lender. We had an issue with AFR from the beginning when AFR refused to agree on a draw schedule for our builder. The builder says they have never in their 20 years of building experienced this so we naturally were upset and we sent a complaint to AFR regarding the issue asking them to please work with our builder. Then we were days away from closing and AFR decides that they have refused to accept our garage ( built new in 2011 ) as equity. Which the appraiser, broker, and builder all said that in their 20 years of service they had never seen a lender not accept a garage as equity. Also, in the VA Loan Handbook the lender is required to give value for buildings on the property. The lender was made aware of the VA policy but still refused to consider it as equity.

I paid a one time payment on my house loan. The next month they tried to take another {$40000.00} from my checking it was to be a one time payment not two months in a row. The money not being there bounced causing {$75.00} in fees. Its been going on for to long over 3 weeks. They tell me theyre working on it now I have a letter that says I owe them the {$40000.00} back. After I paid the first {$40000.00} I didnt owe that much. The are telling me that the payment I made of {$70000.00} bounced and it did not I have never bounced a check in my life. I monitor my credit report & score thru XXXX XXXX & XXXX-I recently applied for a mortgage thru complete Mortgage of XXXX who sent to American Financial Resources. My XXXX score from XXXX XXXX, creditwise shows XXXX my score for XXXX from XXXX shows XXXX. My XXXX score from XXXX shows XXXX but when I got my scores back from the mortgage company, they had my XXXX score as XXXX & my XXXX score of XXXX. I know there is some difference in scoring but it makes me think that the mortgage company is trying to get a higher interest rate. I am applying for a XXXX year fixed rate mortgage with eLend also doing business as XXXX. On my original loan estimate that I received and signed the total cash to close is {$1900.00}. I received the updated closing documents showing the new closing cost of {$4600.00}. I have made multiple attempts to contact eLend and resolve this. I am trying to complete a refinance on my home mortgage, changing it from an FHA to a conventional loan. I ordered a payoff on XX/XX/XXXX good through XX/XX/XXXX since this is an FHA loan I have to pay interest good through the XXXX of the Month. When I notified I was not going to be able to close on my refi by XX/XX/XXXX, I called on XX/XX/XXXX and requested a payoff good through XX/XX/2017 knowing I would have to pay a full month interest to close out my current FHA loan.

I have spend the last 6 months under contract on a house. I was pre-approved for financing on my purchase. We had a clear inspection, appraisal, structural engineering report, everything was supposed to be good to go. Finally at the end of the line we were supposed to close, until my lender notified me that the underwriter would not accept the appraisal. My mortgage company " American Financial Resources '' has charged me {$5.00} to {$10.00} extra for my monthly mortgage payment, depending on which day I pay. I was served with eviction paper from a man claiming he bought MY home from American Financial. I have tried several times to contact American financial several times with no response. American Financial claims to have loaned money to my deceased husband. But all papers filed were dated after his passing. They refused to work with me because I was not on the note. I have an escrow account with my mortgage. The mortgage servicer, American Financial Resources , Inc has failed to pay my property taxes from the escrow account. A home in a community I manage is in foreclosure during which portions of siding have fallen off the third floor side of the unit. Over a year has passed and nothing has been done. I applied for a mortgage refinance. I was approved. I went through all the disclosures, paid for an appraisal and submitted all my personal financial documentation. As the loan was getting near the end of the lock-in period the lender representative called me and told me that within the previous month the company put in place an internal policy whereby they no longer do loans of the type I was requesting.

My mortgage servicing company has improperly calculated my escrow payments. I have repeatedly told them that they have n't calculated my escrow account properly but they will not change it. I currently pay about {$110.00} per month than what I should. The mortgage servicing company has inflated the tax basis of my property.
