XXXX and XXXX XXXX XXXX XXXX XXXX XXXX XXXX, Tennessee XXXX After 19 years in our home, we decided that it was time to downsize. We found the perfect new house for us, and put our house on the market XX/XX/2020. Our realtor held an Open House on Saturday, XX/XX/XXXX and Sunday, XX/XX/XXXX, and we received five offers. Our realtor was extremely cautious about vetting the lending agent and lending company, in order to ensure that we would get to closing. After speaking with several realtor friends, she assured us that we were safe to accept the offer. We entered into contract with our buyers on Monday, XX/XX/2020. The following week, we had an inspection on our home, and we contracted to repair the items requested. Our closing date was scheduled for Thursday, XX/XX/2020. Because the offer was significantly over our asking price, the appraisal was essential. As the time got closer to our closing date, we began to question when the appraisal would be done. The buyers assured their realtor that they had requested an appraisal with their lending agent, XXXX XXXX, on or about XX/XX/2020. On XX/XX/2020, our appraisal had still not been scheduled. Many phone calls were made to Mr. XXXX regarding the status of the file. Im still not sure what transpired, but we were contacted on Wednesday, XX/XX/2020 by an appraiser, who told us that she had been asked to expedite the process. She conducted the appraisal the following day, XX/XX/2020. She told us that she would try to get the completed appraisal to the lending company by Monday, XX/XX/2020. On Monday, our realtor contacted the lending agent to get an update. He told her that he was working on it, and that everything looked good. But he told our realtor that closing on Thursday, XX/XX/XXXX was not likely. Our realtor asked him to contact us to explain the delay. At XXXX XXXX, Mr. XXXX contacted my husband. He said that we had strong buyers, and that we just needed to calm down. He said that we were going to close, but it would not be Thursday. We agreed to a one-week extension, based on his assurance that everything was moving along as expected. During the week of XX/XX/XXXX, Mr. XXXX stopped accepting phone calls from our realtor or his buyers. It was later discovered that he had changed jobs on XX/XX/2020, and had taken the file with him. Because of this, no work was begun on this file until he had settled into his new company. He lied to his buyers, their realtor, and our realtor about the status of our closing information. With no communication from Mr. XXXX, the second closing date passed, and our only way of knowing that we would not be closing was not receiving closing documents three days in advance. Because we felt that none of these issues were the fault of our buyers, we extended the closing date one more time, to XX/XX/2020. It was made clear that, if closing did not occur, we would be forced to put the house back on the market. In order for us to not lose our new house, we have moved into it and are paying rent until our house closes. To date, we have paid {$940.00} in rent, plus utilities on two houses. Mr. XXXX incompetence has caused great emotional stress and inconvenience to four families. To date, we have still not closed, with no communication from Mr. XXXX. On Friday, XX/XX/2020, we received notice that the buyers had gotten their Clear to Close statement, and that closing was set for today at XXXX XXXX. My husband and I both took off half a day of work. At XXXX XXXX, our realtor texted us that we were delayed again, as the closing package had not been delivered to the lending company. It was rescheduled for Monday, XX/XX/2020 at XXXX XXXX. Our initial thought was that the lending agent was the reason for the endless delays and lack of communication. However, as the process has gone on, we now believe that the lending company, American Financial Network, is just as responsible as the lending agent is for the massive incompetence. It is now Monday, XX/XX/2020 at XXXX XXXX We have called our realtor, our lending agent, and XXXX XXXX about todays closing. No one can give us any further information about the status of the closing, other than to tell us that we are on the books for today at XXXX. My husband and I are beyond frustrated. We dont know what our next step should be. Our home has now been on the market for 67 days, all of our furniture has been moved out ( or given away since we are downsizing ), and the real estate market has cooled significantly since XX/XX/2020. We arrived at XXXX XXXX XXXX this afternoon. The closing attorney was well aware of the situation, the delays, and the lack of communication with the buyers lending company. He had also been assured that the closing package was going to be ready for our buyers when they arrived at XXXX XXXX Because of our doubt, he called their closing attorney at XXXX XXXX. and was told that the documents had not arrived. We had signed all of our paperwork for the purchase of our new house and half of the paperwork for the sale of our old house, when another staff member called the attorney out in the hall to tell him that the closing package for the buyers had not arrived. All paperwork signing ended at that point. At XXXX on Tuesday, XX/XX/2020, I received a phone call from XXXX XXXX informing me that our buyers were signing paperwork at that time. They wanted to know the earliest date and time that we could get there to sign our paperwork. We took more time away from work and got there at XXXX XXXX. This time, the process was seamless, and we were assured that our settlement money would be in our bank account the following morning XXXX XX/XX/XXXX ). We began checking when we got up Wednesday morning, but it was not there. Either I or my husband called the bank every hour. At noon, we called XXXX XXXX and was told that it would be in our account by XXXX XXXX. At XXXX, it was still not there. We finally called our realtor, who told us that American Financial Network had shorted our money, and it had to be redone. By XXXX XXXX., the money was in our account. The purpose of this narrative is to save one other family from going through this nightmarish experience with XXXX XXXX and American Financial Network. If anyone would have told me this story, I would not have believed them, but we are living it. We are XXXX years old, and have worked extremely hard to buy the home that we have enjoyed for 19 years. We asked for a preapproval letter before accepting any offer to purchase our home. We thought we ( our realtor ) fully vetted the lending company to insure that we would get to closing. We did everything that was asked of us, including signing all paperwork in a timely manner, completing all repairs before the deadline, and leaving our home in pristine condition when we moved out. Although we will not be financially compensated for our experience, we do believe that this blatant incompetence or apathy should not be allowed to continue. OVERVIEW ( XX/XX/XXXX ) In early XX/XX/XXXX, my wife and I found a home to purchase in XXXX, TX. We were referred to XXXX XXXX in XXXX, TX for mortgage lending and specifically to XXXX XXXX, mortgage loan officer to secure a non-conforming loan. My wife and I have collectively purchased over XXXX homes in the past 25 years and are very familiar with the typical mortgage lending process involving both conventional and jumbo or non-conforming loans. Following initial introductions, XXXX XXXX requested information to verify income, run credit reports, etc. in order to start the loan process. All documents were submitted on XX/XX/XXXX and the prequalification letter for our home purchase was issued by XXXX XXXX on XX/XX/XXXX. Following receipt of the prequalification letter, standard documentation requests were received by XXXX and promptly responded to, typically within 1-2 hours, by my wife and me. Additionally, as requested by XXXX, my wife and I continued to send new paystubs and/or bank statements as they arrived. During this process we received congratulatory emails stating that our loan had been approved and that all was on track to close on XX/XX/XXXX. There were no additional requests made until late in XXXX, which we felt was different than our many previous experiences with home loans. While the new requests seemed out of ordinary, my wife and I quickly supplied all requested documents and were again reassured in writing that the process and closing date was all on track. On XX/XX/XXXX, XXXX days before we were scheduled to close, we received a request from XXXX XXXX to delay the closing by one week to XX/XX/XXXX as the XXXX XXXX underwriter needs more time. We obliged and delayed our trip from XXXX to Texas by one week costing us airline change fee penalties. Again, we were assured that this was only to allow a little extra time and that there were no concerns, etc. It wasnt until XX/XX/XXXX, the day prior to the scheduled closing, we received an email from XXXX XXXX requesting a statement from my XXXX divorce attorney providing a status update on the division of assets, an opinion about the XXXX divorce case, and an update on the spousal support that is being paid. It should be noted that the spousal support was disclosed in the first week of the lending qualification process including a signed copy of the divorce decree and spousal support order. This request was extraordinary and extremely over-reaching. However, after normal business hours, my XXXX divorce attorney obliged with a written response that she sent directly to XXXX XXXX at XXXX XXXX time. XXXX XXXX did not acknowledge its receipt until the following day, Thursday XX/XX/XXXX XXXX scheduled closing date XXXX at XXXX noon. On XX/XX/XXXX XXXX scheduled closing date ) at XXXX, a conference call was held between my wife, myself, several representatives from XXXX XXXX and our realtor. During this call XXXX XXXX began challenging the validity of my XXXX XXXX divorce decree, my marriage to my new spouse and co-applicant in XXXX of XXXX, and other nonsensical allegations including quoting " XXXX XXXX XXXX XXXX '' as a reason why my divorce decree is in question. This call was outrageous, unprofessional, and a clear discriminatory attack against my marital status. As I was outraged by the position that XXXX was taking at this phase of the process, I insisted that a video call with all parties take place including my XXXX XXXX divorce attorney. Both the realtor and my divorce attorney had never heard of the " XXXX XXXX XXXX XXXX '' that was being referenced by XXXX and my attorney reiterated that many California divorcees purchase homes and get funding through Fannie Mae without any issues. When asked to provide the exact code, regulation, clause, or section from the XXXX XXXX XXXX XXXX for the requested non-conforming loan, XXXX XXXX was never able to or refused to provide despite numerous requests. At the end of the video call, and having missed the rescheduled closing date, the seller relisted the home the evening of XX/XX/XXXX. My wife and I were in a hotel room in XXXX, TX without a mortgage, with a vehicle full of personal effects that was moved from XXXX to Texas in anticipation of this rescheduled closing. XXXX XXXX stated that they would continue to try to find another solution for us. The seller insisted that if we wanted another two week extension to the purchase and sale contract to allow us time to work with a reputable lender, it would cost us another {$5000.00} in cash which we gave him the following day. On Friday XX/XX/XXXX we contacted another lender, XXXX in XXXX, TX. After the initial telephonic meeting, all standard and typical financial information ( income, debts, etc. ) were supplied to XXXX. The process was completed, and our mortgage was funded in 7 business days without any delays, over-reaching requests, discrimination, or unethical and unprofessional behaviors as displayed by XXXX XXXX. This expeditious approval is what we have been used to in the numerous previous lending transactions we have experienced over the past 25 years. On Tuesday, XX/XX/XXXX, my wife and I received letters from XXXX XXXX that our loan was denied as our " income was unverifiable ''. Once again, complete untruth, change in position, and contrary to the numerous previous communications in which pay stubs, tax records, W2 statements, and the opportunity by XXXX to verify, from our respective employers, our employment statuses and income. XXXX had a duty to verify both of our incomes and it appears that they chose not to verify my income, but they verified my wifes income. It is worth noting that I have been employed with my current employer for XXXX years and my wife has been employed with her employer for approximately XXXX years. Due to the unethical, unprofessional, and discriminatory actions by representatives of XXXX, my wife and I have logged every phone call, email, and communication on a matrix with supporting evidence which are available upon request. In summary, XXXX XXXX and its representatives discriminated against my wife and I due to my prior divorce status in XXXX and displayed unprofessional behavior, untruths, and unethical lending practices. I filled out information online in XXXX of 2018 to be connected with a loan officer who could do a one-time FHA construction to permanent loan. I was then contacted by a loan officer, also in XXXX of 2018, from American Financial Network ( AFN ). I began working with the agent through the application process and received information of pre-approval and continued the process. It was at time the agent left AFN and the " Regional Manager, '' XXXX XXXX XXXX NMLS # XXXX, took over the process. Concurrently in XXXX of 2018, I secured a contractual bid on 10 acres of land for {$75000.00} which was disclosed to AFN as the land to be included in the one time close construction-to-permanent loan. The due diligence period for this contract before closing was approximately 50 days. XXXX explained that they would be able to make this deadline after reviewing my prior approval and credit scores. He provided my with a Loan Estimate for the loan to cover the land and construction and I signed the document and requested he move the process towards close. These documents were provided to me by XXXX in XXXX of 2018. After review of my selected and contracted builder, XXXX informed me the builder did not meet requirements set out by the FHA program and I was able to have another builder step in within 48 hours to assume the contract and cost of build. The builder provided all needed paperwork requested to begin approval and I was informed by XXXX that the builder had been " approved 100 %. '' Over the next several months, my realtor and I were continuously told final cost estimates would be available and that a closing would be able to be completed within a specified timeframe by XXXX. Every single time, XXXX was unable to fullfil these timelines andcited a new and different reason for the delay. I have retained all emails and documents to illustrate the continued conflicting statements and ever changing requirements set fourth by XXXX despite our requests for a clarification of the process. Finally, in XXXX, when it had become apparent that XXXX was either too negligent or unqualified to complete this loan as requested and promised on his part, I reached out to the AFN customer service line. At this time I had been advised by XXXX, with my realtor on the phone, to simply purchase the land on my own and remove the seeler from the equation because we had now requested, and paid an additional {$1000.00} each time, 3 extentions to the original land bid contract. The sellers had stated that there would be no additional extentions and I was now at risk of losing approximately {$10000.00} invested into ernest money, soil surveys, and land surveys to this point. At the advise of XXXX, I put down 20 % of the total land value vs. the originally anticipated 3.5 % and incured the {$60000.00} loan to secure the land. XXXX explained that he would roll the loan into the FHA loan and would offer lender credits to ensure the entire down payment would not exceed the 3.5 % estimate he had previously provided me and that it would take no longer that 30-40 days to close. I had also withdrawn the down payment money from my 401k program which allows for a one-time withdrawal for a primary residence. I provided the 401k with the loan estimates I received from XXXX but were never actually utilized for a loan now. After contacting the customer service line 3 times and to request a supervisor provide oversight of XXXX 's work to this point as well as oversight of any further process with AFN, I was contacted a week and a half later by XXXX XXXX. From my first interaction, it was apparent that XXXX had not looked into the file or process by XXXX up to that point and was unable to provide any insight into why the process had taken almost 6 months and I was still without a closing date or loan estimate. I explained to XXXX what I wanted to know and accomplish as well as what was needed for me to consider the matter appropriately handled to a point that I would be willing to continue forward with AFN in the loan process. XXXX never provided insight into why the process had drawn out for so long. I provided XXXX with clear documentation of XXXX asking for documents that he had previously received from the builder as well as statements provided from XXXX that directly conflicted with other statements made by XXXX on different occasions. It was apparent to me that XXXX was not alligned with my concerns as a consumer and was only concerned with not losing the sale of the loan. I can not provide every example in this letter of the complete negligence XXXX managed my financial documents with and ultimately cost me extensively. My credit was run multiple times throughout the process because it could not be completed within a timely fashion and I had to stop XXXX from running it again. I was promised and assured dates of completion for certain benchmarks on XXXX 's behalf that were never made and without explanation. I have all the email and voicemail documentation necessary to illustrate that XXXX was not appropriately managing and submitting my paperwork to underwriting at all and continued to promise delivery of documents that would never be possible without submission. I have contacted and reviewed this with a Real Estate Litigation Lawyer and been assured that none of the actions on XXXX 's part are were responsible management of my interest and were beyond negligent in with delivery of information and timelines that he knew were un-deliverable. In addition, the involvement of AFN management was a worthless endeavor and only further infuriated me as he completely disregarded my concerns as a consumer and never addressed the irresponsible actions of his employee. I have extensive emails illustrating the problem and there are far too many to attach as requested below. I will have to provide them to you in a different format. As an XXXX XXXX I dont have much documentation to provide for additional income. After approval for an equity loan from a XXXX I thought Id shop one more option. I called a loan officer Id spoken to previously that dealt with people who were proof of income challenged. The loan officer, XXXX XXXX said he no longer worked for the same company however AFN dealt with my circumstances often. As long as I had good credit and 2 years of tax documentation that would basically be all Id needed, same with the other lender. Throughout the process he informed me of the many shortcomings of the opposing lender as well as the benefits AFN. Understandably, more and more info was needed. Once all of my documentation was verified it was at the point of appraisal. I asked repeatedly if my loan was definitely approved and if they were positive they had everything needed. I had to be sure there would be no issues to haunt me to prevent having to pay another appraisal fee. I was assured repeatedly by XXXX and XXXX that they received everything, the approval was definite and no problems would arise. In the meantime I had been quoted, many times, a payment amount and general fee range at closing. Though they said everything was obtained, AFN then asked for one last thing once the appraisal was complete. Though they already had the forms, they needed tax verification directly from the IRS. I was assured again that was the final piece of documentation before funding. Time to meet with the notary. Going through the paperwork, the first things that jumped off the pages were the increased payment amount and the increased fees. The notary advised me to go ahead and sign the docs as I had 3 days to rescind the loan. She dog-eared the pages referring to my legal rights. Immediately, I called XXXX XXXX regarding the payment increase and fee increases. He nonchalantly said that he quoted only the principle payment. What? The fee increase was because my loan was so small so the fees and interest would be higher. Just the nature of the business as they get their money any way possible. These were the very things XXXX warned me about regarding the other lender. So I had 3 days to decide what to do. It was too late in the process to start over, not to mention having to pay for another appraisal through another lender. I had been out of town dealing with serious family matters during this crucial time so the thought of going through it again was daunting. In that 3 day period I had the added pleasure of receiving a termination of insurance notice because AFN gave my insurance co the wrong information. Then AFN sent me new docs to sign because my payments were to increase again. Asking why, they explained that I hadnt given them the correct annual insurance rate so they had to recalculate my terms. Calling my ins co, AFN had asked for my annual rate plus what my rate would be from that day until the end of the term, then they added it together! These are the people calculating my 30 year loan. My annual insurance had been paid in full already. There was nothing owing and nothing incorrect on my part. I had to make several calls to rectify the problem as AFN did nothing but attempt to raise my payments again. XXXX, the AFN loan processor acted as though this was no big deal. She couldnt have been more condescending when I asked her to send email confirming that the matter was taken care of. By this time the many inaccuracies, discrepancies and recalculations by AFN were making me extremely nervous. I tried checking and double checking to make sure there would be no more awful surprises before the loan was funded and closed. They were completely annoyed by my diligence, however assured me that unforeseen problems were over. However they werent done ripping the rug out from under me. XX/XX/2018, almost 2 months after my loan was funded and closed, I received a phone call from AFNs director of credit risk, XXXX XXXX. He said that they needed more documentation. I had already made my first payment! As they knew from day one, I had given them everything XXXX possible could already. The loan officer and processor were fully aware of that from the beginning. Why were they asking for more now? Because theyre having problems selling my loan. Now my nightmare begins. So, after Mr XXXX said hed figure something out, ends up it was not to help me. He then made the loan officer call me XX/XX/2018. XXXX XXXX had been let go before my loan had closed ... the second mortgage company in less than a year. At first XXXX was awkward and uncomfortable, then he became very agitated. He began to threaten me with rescinding the loan ... he said it was not their problem, it was my problem. The closed loan that he repeatedly reassured me about, and that had already been disbursed to paying off a note, credit lines, and materials and services to improve my home is going to be taken back. Or they will sue me for default. Which most likely ends in foreclosure and mutilating the credit. AFN should have warned me that there could be any possible issues down the road and that something like this was even possible. I should've had the chance to choose a major lender that not only approves, but can afford to honor and keep the loans they fund. Ive worked so hard to buy my home, make improvements to build equity and achieve an equity loan. Now they are going to take it all away from me because they apparently made many mistakes. Now I'm forced to hire an attorney I can not afford. They have discontinued mailing me payment coupons to solidify their claims of default. I could very possibly lose everything. Not because I have bad credit or dont pay everything on time. My credit and payment history is excellent. I could lose the home I literally put my blood sweat and tears into, and continue to, because AFN, wants to sell a loan they approved based on legitimate, verified facts by their own requests and criteria.

In XX/XX/XXXX I did a refinance of an FHA backed government mortgage with American Financial Network. During this refinance I did a 2 hour drive to XXXX XXXX Connecticut for a closing with XXXX XXXX who did the closing without any notary at around XXXX XXXX and in no way legally. The closing costs were massive or over XXXX From this time Covid hit and my income dropped, which required a forbearance and a loan modification to be applied for thereafter. I have recorded every call and communicated with American Financial Network countless times and then was told that I needed to talk to XXXX. My secretary who is no longer employed would send in the required documents with my help over, and over, and over. Also in XXXX my mortgage was actually paid off or paid down substantially by my now deceased father in law. This was looked into by American Financial Network and XXXX and they have to this day given me the run around about the mortgage being paid off in full. Every time the required documents were sent in I was told that they either didn't have the documents ( that were sent numerous times by email and can't be disputed ) or I was continually told that I needed one document from one worker and another worker said that the paperwork was already submitted and all set. I had numerous issues with workers telling me how to talk, what tone of voice to use, and they regularly transferred and never told me specifically what they needed. This happened countless times as I have a XXXX wife, XXXX XXXX, and am a XXXX veteran. I recently, in XX/XX/XXXX submitted documents that were requested which are not normal loan modification papers, or namely proof of payoffs related to contractor liens for work done on property. I was told that because there was a mistake or a draft of a document done by previous counsel in the paperwork that was sent in late XX/XX/XXXX that they would not do the loan modification and the workers who called me from blocked numbers also said that they intended to foreclose on my property because they know I don't have the back payments for many months and that they will have an inside foreclosure buyer they know buy the property for a kickback under the table to XXXX. They ( XXXX ) said that they will do as they want, make whatever claims they want without any need to hear my side, and are not required to follow the terms and Federal regulations about forebearences and loan modifications related to covid. XXXX said they are the largest and most powerful loan servicing company in the country and have more than enough money to squash a fly speck nothing like me. I need loan modification done or to start regular payments without my credit being decimated as well. In this XXXX promised to deliver. Please review all the calls and you will see that i CONTINUALLY CALLED XXXX and American Financial Network continually in order to stay on top of loan modification and get on regular payments per the covid rules and save my house where I as a XXXX Vet raise my XXXX child and care for my wife who has a medical condition. Cenlar workers have continually given me conflicting information as phone call records will show. It is 100 % guaranteed that they will claim that I called numerous times unnecessarily and that as a result there are countless inconsistencies by workers at XXXX and XXXX XXXX XXXX. They would never break it down and specifically tell me if there was a problem and how. I sent them everything that they requested every time within a few days time. They had a vendetta against me because I spoke up about workers being inconsistent, telling me what tone of voice to use, not giving me the information that I needed and then making issue with a draft sent by my lawyer to me of a document which was not intended for the loan modification. This document was sent accidentally by wife in XX/XX/XXXX and violating my attorney client privellidge allowed for Cenlar to get the justification they were seeking with malice and premeditation to deny me modification or full forbearance in line with the Federal Law in order to get kickback taking property and also silencing me in retaliation for me making complaints at the management team at American Financial Network and XXXX. I want the mortgage paid off in full or forgiven for the following reasons 1. The American Financial Network loan was done with predatory means of bait and switch. XXXX XXXX of American Financial Ntwork continually by email and text, told me that the initial refinance would be at 75 % Loan to Value and that at the closing or right thereafter there would be a 15 % Heloc for me to button up my house which suffered from a fire in XX/XX/XXXX. 2. The closing done in XX/XX/XXXX was done late at night and without a notary. 3. I had communicated with and sent in documents with previous services about how my mortgage was paid off by my now deceased father in law in XXXX. 4. There have been numerous contradictory information given to me during numerous recorded calls, and I would always send American Financial Network and everything that XXXX requested numerous times. I was reguarly abused on the phone by being told what tone of voice to use, how to talk, and given contradictory information over and over. This was done with pre-meditation and bad faith. 5. XXXX and AFN have asked me for documents between me and counsel to be sent and documents that have nothing to do with loan modification in a pre-meditated attempt to deny loan modification and forbearance back payments with pre-meditation and conspiracy as a result of speaking up about my rights under Federal laws and Covid forbearance program.

My daughter XXXX XXXX and began working with XXXX XXXX in early XX/XX/XXXX as our realtor who is employed by XXXX XXXX XXXX XXXX XXXX in XXXX Ca. We decided to make an offer on the home on XX/XX/XXXX. The original purchase price of the home was {$280000.00}. XXXX was able to talk the seller down to {$270000.00}. XXXX XXXX at American Financial Network was our assigned loan officer who helped us purchase the home under FHA. We began escrow for the home on XX/XX/XXXX with XXXX XXXX Escrow. XXXX XXXX at XXXX XXXX Escrow was the assigned escrow officer. On XX/XX/XXXX the buyer requested for items in the home to be fixed. These items include replacing the tiles on the roof where there was a leak, electric splices outside of junction box in the attic, the ground natural wires, fix the hole in drywall subpanel/damaged electric box in garage. On XX/XX/XXXX the buyer requested a reduction of {$8000.00} on the price of the home due to the missing tiles and electrical damages see The sellers agreed to fix the missing tiles and the items listed in the inspection report that were damaged. On the XX/XX/XXXX a document was prepared by XXXX that stated the seller did not fix the damaged sub-panel in the garage as agreed see attachment 10. XXXX assured us over the phone that the items would be fixed and we can proceed with signing documents to close the deal. Escrow was closed on XX/XX/XXXX. On XX/XX/XXXX a service request was made to XXXX XXXX XXXX XXXX regarding electrical issues in the bedrooms see attachment 12. The ceiling fans and lights were not operating in any of the rooms. XXXX XXXX XXXX XXXX only serviced one of the bedroom because each separate room would be an additional request. XXXX XXXX sent XXXX an email on XX/XX/XXXX asking for receipts from the seller confirming that the repairs have been made. XXXX stated he does not have receipts for repairs because the seller never sent them they only signed off on the repair requests which were not repaired. On XX/XX/XXXX XXXX XXXX contacted XXXX supervisor XXXX XXXX by phone about the mailbox key we did not receive and the issues in the home. XXXX sent an email to XXXX about the phone call regarding the issues in the home. XXXX responded to XXXX about the concerns and XXXX never responded to back to XXXX email. On XX/XX/XXXX XXXX began to smell gas in the home. The home was red-tagged as a hazard by XXXX XXXX due to an internal gas leak. XXXX XXXX was able to resolve the leak. XXXX filed a complaint on XXXX to the Department of XXXX XXXX and got a response on XX/XX/XXXX. On XX/XX/XXXX a claim was made with home the warranty service XXXX XXXX XXXX warranty for failure to the ductwork located in the attic. XXXX XXXX XXXX XXXX was not able to repair the damages because the ductwork is collapsed or crushed which is not covered under the home warranty see attachments 16 & amp ; 17. On XX/XX/XXXX XXXX contacted XXXX XXXX XXXX XXXX about the electrical issues in the bedroom which they were not able to cover. On XX/XX/XXXX the Department of Real Estate stated this issue will need to be handled in court because it is a civil contractual matter. On XX/XX/XXXX it snowed heavily. It took about four days for the snow to melt. The walls were cold in the bonus room which is illegally built. We began to notice what looked like water behind the walls. On XX/XX/XXXX an insurance claim was filed with XXXX home insurance. On XX/XX/XXXX XXXX stated they will cover {$2300.00} for water damage in the bonus room. On XX/XX/XXXX XXXX also claimed they are not responsible for repairing the rood because this is excluded under the policy. XXXX contacted the loan service XXXX XXXX to complain about the damages and the roof. XXXX stated they are not responsible for the damages as they were not the loan servicer when the home was purchased. The loan servicer at the time of purchase was XXXX XXXX XXXX who stated they are not responsible because they no longer have the loan with us. On XX/XX/XXXX XXXX spoke with HUD about the issues and conditions of the sale. The HUD representative XXXX, stated it would be best to speak to an attorney regarding the issue. On XX/XX/XXXX XXXX stated they will be closing the case for water damage. On XX/XX/XXXX XXXX stated they will not be responsible for repairs to the roof and instructed us to file a claim with our FHA loan or home warranty see attachment XXXX. On XX/XX/XXXX a claim was filed with XXXX regarding an additional leak behind the wall in the living room. Their document has the living room listed as master bedroom by mistake XX/XX/XXXX. On XX/XX/XXXX Wawanesa issued a check for {$2200.00} for the water damage in the living room. On XX/XX/XXXX we were assigned a Real Estate Special Investigator named XXXX XXXX by the Department of Real Estate who suggested we seek legal counsel. The windows in the home are drilled in and we can not open them. We had to purchase a new roof which costs us XXXX dollars. This home was supposed to be purchased under FHA but it had many hidden damages which are expensive to repair. We are still trying to figure out how we will be able to afford these fixtures. This is unacceptable under an FHA loan.

I applied for a refinance on my home and was approved. The loan closed on XXXX XXXX, XXXX. During this time I have had nothing but problems. Funds on this loan were not disbursed to me until XXXX XXXX, XXXX. The loan company was to pay off credit cards, but this did not happen until XXXX XXXX, XXXX. On XXXX XXXX, XXXX, I received a letter from the Flood Insurance company that my flood insurance was being cancelled due to non payment of premium. This was to be paid through escrow. They closed and funded the loan with no insurance. Then when I called, I found out that the insurance company was with a company that I did not authorize. The lender decided to use another insurance. I was told that Flood Insurance had to equal the appraised value of the home, which my insurance did. The insurance that they approved the loan with did not even cover the appraised value of the home and was more than double in price. I called the company and escrow, and they stated that I could use my insurance as it was an oversight on their behalf. I paid my insurance out of pocket in full. I had asked escrow to readjust my impounds, and payments in which I have confirmation that she sent it to another person on XXXX XXXX, XXXX. To this date, nothing has been done. Also, I wanted to make payments ahead of time due to the holidays. I had submitted XXXX XXXX payment, and XXXX XXXX payment. Both cleared my bank account on XXXX XXXX, XXXX. I reached out to escrow and they told me that I would be getting refunded for the difference in the payments, and impounds which never happened. Now ... the loan was transferred on XXXX XXXX. The new company told me that they do not have any payments and I owed for XXXX XXXX, and XXXX XXXX. I told them and sent proof that these payments had been made to the first company. They told me to contact the original lender to make sure that these payments were sent. The original lender told me that both payments were sent. I called the second company and they stated that they did receive XXXX XXXX payment, but not XXXX XXXX payment. I was told to contact the first lender, again regarding this matter. In the meantime, I contacted my bank for proof as well. I was afraid of being late because of the holidays and such, so I went ahead and made a second XXXX payment to be safe. I finally got a call from the first lender and an email stating that both payments were made, also received verification proof from the bank. I cancelled the second XXXX payment because now the loan had been transferred to yet another loan company. This is the XXXXd loan company since closing the loan on XXXX XXXX. I was in compliance as both XXXX XXXX, and XXXX XXXX payments were made by me. I cancelled the second payment made for XXXX as to not have two payments for that month. Also, I did not want to have to worry about trying to get a refund from a third company. I am trying to get my impounds adjusted to the correct amount, and also my payments to reflect the changes. I have called all three loan companies, but everyone is giving me the runaround. I supplied all three companies with everything - payment information, proof from the bank, insurance, etc. Today,, I called the third company and the representative is telling me that no payments have been received, but yet she shows that a refund is due me, but she is now telling me that my payments will be more. I do not understand what is happening. During the call our call was dropped, so I called back. The new representative told me that she tried to call back, but I never received a call. I just want what is right. I want my payments posted correctly, I want my impounds corrected, and I want my payments to reflect the corrected impounds. I am scared because this loan was not done properly. The first company had assured me that this was being taken care of on XXXX XXXX, XXXX in an email, yet they transferred the loan on XXXX XXXX, knowing it was not taken care of. Now XXXX XXXX, XXXX to another company. I 'm afraid that I will have bad credit when my credit was good, and the possibility of losing my home. I 'm not asking for anything unreasonable, just what is right. This is causing me so much stress on what was to be a simple process. I do not know how an underwriter can approve a loan without verifying information, and how a funder can fund and close a loan without proper information. I feel like this loan was done with fraud on behalf of the lender. I paid good money to do this loan, and yet nothing was done proper.

In XX/XX/XXXX I did a refinance of an FHA backed government mortgage with American Financial Network. During this refinance I did a XXXX XXXX XXXX to XXXX XXXX Connecticut for a closing with XXXX XXXX who did the closing without any notary at around XXXX XXXX and in no way legally. The closing costs were massive or over XXXX From this time Covid hit and my income dropped, which required a forbearance and a loan modification to be applied for thereafter. I have recorded every call and communicated with American Financial Network countless times and then was told that I needed to talk to XXXX. My secretary who is no longer employed would send in the required documents with my help over, and over, and over. Also in XXXX my mortgage was actually paid off or paid down substantially by my now deceased father in law. This was looked into by American Financial Network and XXXX and they have to this day given me the run around about the mortgage being paid off in full. Every time the required documents were sent in I was told that they either didn't have the documents ( that were sent numerous times by email and can't be disputed ) or I was continually told that I needed one document from one worker and another worker said that the paperwork was already submitted and all set. I had numerous issues with workers telling me how to talk, what tone of voice to use, and they regularly transferred and never told me specifically what they needed. This happened countless times as I have a XXXX wife, XXXX child, and am a XXXX veteran. I recently, in XX/XX/XXXX submitted documents that were requested which are not normal loan modification papers, or namely proof of payoffs related to XXXX liens for work done on property. I was told that because there was a mistake or a draft of a document done by previous counsel in the paperwork that was sent in late XX/XX/XXXX that they would not do the loan modification and the workers who called me from blocked numbers also said that they intended to foreclose on my property because they know I don't have the back payments for many months and that they will have an inside foreclosure buyer they know buy the property for a kickback under the table to XXXX. They ( XXXX ) said that they will do as they want, make whatever claims they want without any need to hear my side, and are not required to follow the terms and Federal regulations about forebearences and loan modifications related to covid. XXXX said they are the largest and most powerful loan servicing company in the country and have more than enough money to squash a fly speck nothing like me. I need loan modification done or to start regular payments without my credit being decimated as well. In this XXXX promised to deliver. Please review all the calls and you will see that i CONTINUALLY CALLED XXXX and American Financial Network continually in order to stay on top of loan modification and get on regular payments per the covid rules and save my house where I as a XXXX Vet raise my XXXX child and care for my wife who has a medical condition. XXXX workers have continually given me conflicting information as phone call records will show. It is 100 % guaranteed that they will claim that I called numerous times unnecessarily and that as a result there are countless inconsistencies by workers at XXXX and American Financial Network. They would never break it down and specifically tell me if there was a problem and how. I sent them everything that they requested every time within a few days time. They had a vendetta against me because I spoke up about workers being inconsistent, telling me what tone of voice to use, not giving me the information that I needed and then making issue with a draft sent by my lawyer to me of a document which was not intended for the loan modification. This document was sent accidentally by wife in XX/XX/XXXX and violating my attorney client privellidge allowed for XXXX to get the justification they were seeking with malice and premeditation to deny me modification or full forbearance in line with the Federal Law in order to get kickback taking property and also silencing me in retaliation for me making complaints at the management team at American Financial Network and XXXX.

I am the seller of XXXX XXXX XXXX, XXXX VA XXXX. I received a contract on the property with a preapproval letter from loan office XXXX XXXX and American Financial Network. I spent 22 years in XXXX so when reviewing the preapproval, I could see it was dependent on me paying closing costs and little to no down payment so I was skeptical. When researching the lender, it seemed they were an online lender and the loan officer potentially worked out of their house so I initially said no unless they at least go prequalified by a local lender as a back up and confirmation that the first lender was solid. They agreed to do that but were told they didn't qualify so I then said I would not sign. Then the lender called to assure us the loan was fine. I still have the voice mail but I quote him in saying " I hear you are concerned about the loan, we can do this loan. I did the income calculations, reviewed the income docs and the credit scores looks good. We are ready to do this loan. I can have my manager call you, our company did over a half billion in loans last month, we know what we are doing '' Given his assurances, I signed the contract for a XX/XX/XXXX closing. Two days before closing we are told that we need two more weeks to get the loan closed and we needed an extension. Without knowing why I call XXXX. He informed me all was good, just needed more time. When I pressed him for why he stated he made an error and did not charge the origination fee so they needed to redo the loan. I informed him that if they missed the fee in early disclosure then they were obligated to honor the fee. He said no he was fixing all of that and the buyer was fine with it. I stated to him it is not really up to the borrower and asked that his manager call me. He never did but I did sign the extension as again Mr XXXX assured me there were no 'deal breakers '' just process stuff. About two days before the second closing date, we get another message that we need to delay a few more days. So again, I called the lender and he again assured me everything was good, they just had a VOE to track down prior to closing. I then asked him if this was late VOE that simply verifies the borrower is still employed or a VOE that could break the loan. He assured me that I had not impact on the loan. The next day, I followed up with another message to ensure that everything was fine and whether the 3 day disclosure was going to be met. He stated they had already met that requirement. I don't think that was compliant either but he assured me they were in compliance. At that time I also asked him if they had a clear to close and he stated they did. Docs were done, termite was done etc. all based on what appear to be a pattern of misleading statements by the lender. I again asked why the manager had not called me and asked him to have him call me. Mr XXXX said his manager had a pipeline of loans of his own and it probably was not his biggest priority. Still assured that all was fine, I signed yet another extension. The day before closing we get an email to all parties. This is the quote from the email that I still have : 'This loan is going to fail. I never received all the detail on XXXX work history and he has zero stability over past two years, having been at 9 different jobs. The bank can not do the loan. I am so sorry. I qualified XXXX on the recent positions and due perhaps to language I never actually had his full work history. I did not understand he had so many different positions. '' So, in reality from the very start there were misleading statements to all parties involved and most likely complete lies and non-compliant processes. That has resulted in the home being off the market in prime season and considerable time investment by cooperating Realtors, buyer and seller. I know loans get delayed and sometimes do not close when going through processing and underwriting but no lender has a right to take people through a process like this. I have let the lender know that I am not happy and I have yet to receive a call back. In my experience these are exactly whey the CFPB and XXXX were created were to hold lenders accountable and protect borrowers. In my view Mr XXXX, his manager and AFN have failed to comply.

I contacted XXXX XXXX a Sales Manager with American Financial Network , Inc. ( AFN ) based on a referral from a relative in late XX/XX/XXXX early XX/XX/XXXX. I contacted XXXX as I was looking to refinance my mortgage for a lower interest rate. In the beginning, we spoke about the streamline FHA refinance and on XX/XX/XXXX I received an email saying, Congratulations on this new loan, please send in the list of documents for the FHA streamline loan. The information was sent in and then he decided that maybe a Conventional loan would be a better option even though I have an FHA loan. This process went on for a few weeks and he assured me that if we pay for an appraisal, we would get a better loan and the price of the appraisal would be credited back once the loan closed. I agreed to have the appraisal done after he convinced me that this would be a better option. On XX/XX/XXXX I paid {$440.00} dollars for an appraisal that took all of 5 minutes. During this time, I was sending him pay stubs, bank records, tax records and any additional information requested. He also advised to skip the XX/XX/XXXX mortgage since we are close to closing the loan. On XX/XX/XXXX I sent a follow up email asking for the status as it is now the end of the month and as instructed, I had not paid the XX/XX/XXXX 's mortgage. He responded and said to now pay the mortgage as he is still trying to find a program to fit me in due to my student loans not being deferred even though I was still in school. I paid the mortgage late with a {$45.00} late fee which did not make me happy as I 'm trying to save money and not pay unnecessary late fees. XXXX then advised that due to the student loans, I would need approx. 2k to close the conventional loan. I expressed to him how upset I was as this situation with the student loans should have been anticipated before I spent the money for the appraisal fee. AFN ran my credit multiple times and was well aware of my student loans which has since been deferred as they should have been at that time. After going back and forth with this and XXXX advising me that they really do n't deal with small loans like mine and he was doing me a favor, I get an email update on XX/XX/XXXX that from his assistant advising that we should be ready to close by the end of the week. I continued to reach out to XXXX with no response and on XX/XX/XXXX reached out to his assistant who advised that they are now working on this as a FHA Streamline where we started in the beginning. I expressed that I was upset as I spent the money for an appraisal that is now useless but XXXX assured me that once the loan closes, I would get a credit for the cost of the appraisal. Well, the loan never closed. This went on and on for months. XXXX would disappear for weeks at a time and them contact me again to restart the process and since I had spent money and received nothing in return, I continued. Each time we re-start the process, he would advise to skip the mortgage payments. This happened at least 2-3 times in which I would then have to pay a late fee. He would reach out to restart the process and then I would n't hear any thing for weeks. I seemed to me that when sales were down, they would reach follow up with me again. This went on and on with each time promises of closing the loan. They then had XXXX XXXX reach out to me starting in XX/XX/XXXX and pretty much the same thing. He would start the process again and then disappear. They would disappear for months and then start calling and emailing me with updates and promises of closing the loan this time. In XX/XX/XXXX an email from XXXX advising he did not forget about me but working on getting everything in line. I did not hear from him again until XX/XX/XXXX when he sit a keep in touch email? I ask for reimbursement & why AFN ran my credit multiple times without my permission. No response

To Whom It May Concern : On XX/XX/XXXX, I signed a contract to purchase my first home. The home is in a XXXX development and they offered to cover {$8000.00} of closing costs to if you utilized their on-site lender. I tried to negotiate an exception with the same structure using my lender, as I trusted him ; however, the builder would not except. I secured my lot with {$1500.00}, with the understanding that it would be refunded at closing. The lender, American Financial Network, approved my loan as an FHA 30 year fixed with monthly payments ; including p and I, taxes and mortgage insurance and home owners insurance. My payment was negotiated first at approximately {$1400.00} with a 4 % interest rate. I provided all requested documentation and satisfied all debt paydowns. I was approved for a grant to assist with my down payment ; including the additional {$8000.00} from builder. My house was scheduled for completion in XXXX. Due to uncircumstantial situations, the move in date was delayed until XXXX XXXX. About a month prior to closing of escrow, my lender, advised me that I needed to complete a new application as there was a system glitch, to pay off additional debt in the matter of days which was not acquired after the intital approval. Im addition, I had to come up with {$3000.00} to place in an account for three days to get approved. A week from closing, I was asked if I had selected a home owners insurance provider ; which of course I hadnt, as it was my first time hearing of it. I scrambled on a Friday afternoon obtaining three different quotes and realizing I needed my appraisal to generate the quote ; which I had to go back to my lender to get. Monday. And quickly and my lender contacted me for the insurance selection. I provided her the with my selection and she then informed me that the fha guidelines required a limitation on the fees which I wasnt aware of. Therefore ; I was obligated to proceed with their insurance provider. To make matters worse, I receive a call to sign loan docs on a Friday afternoon which was supposed to be that following Monday ; which my mom was going to to attend to explain things to me. Anyhow, I quickly rush over to sign, thinking Im going to meet with lender to review documents and explain them to me as again this is my first time buying a home. Comes to find out when I arrived that the hired notary was the only one there. The documents indicated {$700.00} was due at closing. Unbeknown to me, I was completely confused as I was supposed to be receiving my deposit back, not owing. My payments and APR increased to {$1700.00} per month with a 4.75 % APR. I was advised if I didnt sign I would not receive my keys. Time was of the essence as I had to be out of my rental so with hesitation and confusion, I signed. The lender said she would revise the closing instructions. I received {$320.00} back and a payment which is unaffordable. I tried to contact my lender, the company no longer existed, my file was shipped to XXXX, my agent no longer worked at the location and no one could talk to me. After reviewing my loan documents with an educated individual, I realized that a new application was unnecessary, I was not granted the closing costs as stated, I paid for the warranty that my builder was supposed to pay for. I feel completely taken advantage of and upset at myself for not taking the time to educate myself on the process. On XX/XX/2021 - I was in the room with my father as he received a call on his cell phone from an unknown number. My dad answered, and the caller ( human voice ) identified himself as " XXXX XXXX '' in a very casual way and immediately asked to speak with me, the biological daughter of the cell phone number called. I took the phone and told the caller he was speaking with her. The caller said that he is calling about my FHA mortgage for a specific address. I told him I did not have this loan. He said he received information from the state courthouse that my name is on the mortgage deed for this address- which is my parent 's property. He made representations about the specific rate I was paying. He said several times that this information was obtained from " public records '' from the " civil courthouse in XXXX, Louisiana. '' He tried to make it seem like I was unaware of my name being on a legal document and that he could help me by using his company. He refused to say that he was actually a telemarketer for AFN. The telemarketer referred to me by my nickname-XXXX- which is not even my legal name, meaning it wouldn't appear on the supposed legal document that XXXX referred to repeatedly. I asked to speak with a manager to sort this out and understand where this data is coming from. XXXX said to go to this website - " XXXX '' This website is not a working site. It also seems to be some sort of data trap. I asked for his manager 's phone number, and after back and forth he gave it to me. ( -- -- ) ( XXXX ). I spoke with XXXX/ XXXX XXXX . XXXX- told me that he searched his data list and did not see my name or my father 's phone number on his list. He called me back and said that the company buys data from companies. XXXX XXXX found my family 's information this way. He essentially blamed the incident on XXXX. It's clear AFN is training telemarketers to use this deceptive tactic. The problem is at the top. I'm asking the FTC to reprimand this company immediately to prevent any future incidents. AFN has this disclosure on its website- " As prohibited by federal law, we do not engage in business practices that discriminate on the basis of race, color, religion, national origin, sex, marital status, age ( provided you have the capacity to enter into a binding contract ), because all or part of your income may be derived from any public assistance program, or because you have, in good faith, exercised any right under the Consumer Credit Protection Act. The federal agency that administers our compliance with these federal laws is the Federal Trade Commission, XXXX XXXX XXXX, Washington, DC, XXXX. American Financial Network , Inc. is an Equal Housing Lender. '' I'm very concerned about this incident as it seems like it is contrary to FTC prohibitions cited above, especially : 1. the targeting of my father- an elderly man who is in debt and has a mortgage 2. the representation that the daughter of the phone number called has a legal mortgage deed with a specific interest rate that she needs help paying/ could be lowered through AFN services 3. the ways in which my family 's data has been located, used, distorted for a federal program My father is an elderly man suffering from a XXXX XXXX. AFN is using the government and citing to fake legal documents to scare unassuming people in debt that they need to use AFN financial services. We worked with our local lender to get preapproved for a $ XXXX mortgage. After finding a property and our offer being accepted, our local lender started working with XXXX XXXX based out of XXXX, CA to close our loan. It was about 4 weeks into the 6 week closing process that we noticed issues with XXXX XXXX. We were being asked to gather information on previous employers, go to the IRS office ourselves for tax transcripts, told after the set closing date that our current FHA loan needed to be paid down when we were told originally that this new loan was not dependent on selling our previous property, etc. All of which is not appropriate. It became clear about a week prior to our close date ( XXXX XXXX ) that our loan would not close on time. Even though that was the thought, there was no guarantee it would n't close on time thus we were given the run around for that entire week, asked to scramble to get certain documents to them in order to close on time and our sellers were not told until the day prior to the scheduled closing that it would not close on time. Our failed closing date held up XXXX other sales with our sellers and the sellers of their new property. After the missed closing date, it became a complete nightmare. XXXX would sit on our submitted documentation for 3-4 days at a time when they claim they will look at it within 24 hours of receiving it. We were told our file/loan had highest priority since we already missed our closing date but " high priority '' to XXXX meant nothing as our paperwork continued to sit on someone 's desk. The individuals our local lender worked with are XXXX XXXX, XXXX XXXX ( account manager ) and XXXX XXXX ( underwriter ). This group of individuals needs to have their work flow and ethic looked at within their company and by an outside source as it is completely unacceptable how they treated us and our loan. Our local lender even went to the effort of contacting XXXX XXXX ( VP ) with no resolve at that time. We were finally able close our loan 3 weeks late. Even with that happening, we were not given the guarantee that it will close until the morning of and were not aware of our payment to close the loan until noon that day with closing at XXXX. Completely unacceptable and negligent on their part. The 3 weeks between the initial closing date and the real closing date consisted of daily emails from XXXX stating they had " one more thing '' that was needed from us and then we could close. That " one more thing '' sat on their desks for days and then they came back and found " another one more thing '' for us to scramble to get. It was a very unorganized process and documentation that was being requested this late in the process could have easily been submitted weeks prior without needing to scramble. I do not believe that this group of individuals has the best interest of their clients at hand. It felt like they were papershuffling and could care less that it took 20 extra days to close a loan that should have been closed on time if it was n't due to their negligence. We will also be submitting a complaint against our local lender. Even through XXXX seems to be the main individuals holding up the entire process, we also paid our local lender to be the " expert '' and to get this done and on time. He completely threw everyone at XXXX " under the bus '' and put all blame on them when some blame/responsibility needs to go to him for working with them as well as not having the " pull '' to get this done when it really needed to happen.

Dear officer, I was provided a very competitive 30 yr fixed mortgage quote by AFN when I first started searching for lender. We were given GFE and numbers and interest rate shown on the GFE were very promising. Based on those numbers we decided to proceed with AFN. During the loan process interest rates went up and I asked AFN to provide both 30 yr and 15 yr loan option to us. Comparing those XXXX options I decided to proceed with 15 yr loan. I requested AFN representative ( branch manager ) on phone to confirm the lender credit to which he confirmed to me that credit will be .XXXX % of the loan amount ( Also confirmed lender credit in the email ). After this discussion when the loan was approved AFN never sent me any documents directly as should have been done. Instead I received a call from XXXX that what time I can be available to sign the paper work. I was shocked but had to keep moving forward as we would have lost the house if we did n't close the loan. So I requested the escrow company to mail me soft copy of the HUD so I can confirm numbers and know what I am going to sign. When I received the copy through email from XXXX to my surprise numbers were not matching. I called and emailed AFN and mentioned it to them. They never responded to my email on that specific question, but next day on phone AFN representative told me escrow did all the numbers wrong and they have sent escrow a new copy. Again this time around also I was not sent anything directly from AFN, so I again requested XXXX to please send me the new documents so I can verify numbers before I sign them. After receiving the documents I checked and although numbers were changed they did n't match the numbers we talked and credit was significantly less then discussed. Since we were in a tough spot I went ahead and confirmed to AFN through email that I am signing the document and we can get the numbers corrected in the closing documents. Again there was no official response from AFN to my email on this topic. They will communicate with me on other topics but not on the numbers and as matter of fact none of the HUD documents were sent to me by the company directly and I had to request escrow time and again to send the documents. Hud documents have a column where it shows comparison to GFE in my case that clearly shows an increase of 44.84 % while stating that numbers can not increase by more than 10 %. I believed that once the lender corrects the credit numbers will match. So, I waited for loan to close and to receive final check from XXXX, after receiving the final check after closing, it became clear to me that AFN has not corrected any numbers. I stared communicating with them about the situation and at one point was told by AFN representative that I signed the paper so I agreed. At this point I realized that they are not dealing fairly and bumped up the numbers knowing that I did n't have an option to contest as the house was on the line to get the loan closed. I am reaching out to you to make this wrong a right. I am hoping that this kind of behavior of pushing the borrower with arbitrary credit and closing cost and lack of information is stopped. I am optimistic that after the resolution of my case AFN will improve its practices with other borrowers. Resolution to me would be : Refunds me the amount they owe me and commit to more transparent approach towards borrowers.

On XX/XX/XXXX I worked with American Financial Network to obtain an FHA loan. We locked a rate on XX/XX/XXXX of 5.25 %. I paid {$570.00} for an appraisal with my debit card. On XX/XX/XXXX I was instructed by American Financial Network to have my employer send a gift letter for the {$8500.00} I was gifted. On XX/XX/XXXX, I was instructed by American Financial Network to have my employer rewrite the gift letter because it was on my employer 's letterhead and the lender did not want it on letterhead. On XX/XX/XXXX The lender requested a letter of recommendation from my employer stating that the gift was indeed a gift and why I received the gift from my employer. On XX/XX/XXXX I was told that we would need a structural engineer to go look at the house since the appraiser noted something about the foundation. On XX/XX/XXXX I was told by American Financial Network that they needed a new letter from my employer removing the recommendation and other positive information about me as an employer and just to state the gift was for the purchase of my primary residence. This was already stated in the initial gift letter given to them on XX/XX/XXXX and the rewritten one on XX/XX/XXXX. On XX/XX/XXXX I was sent and returned an initial closing disclosure to sign from American Financial Network. On XX/XX/XXXX my closing was delayed by American Financial Network for a final appraisal after the home had some of the structural engineer 's recommendations done. I paid {$200.00} with my debit card for the reappraisal. On XX/XX/XXXX I was given instructions by American Financial Network that we were cleared to close on XX/XX/XXXX at XXXX XXXX On XX/XX/XXXX at XXXX XXXX I arrived with my family at XXXX XXXX to close on our house. We waited until XXXX XXXX to receive the closing documents from American Financial Network. The title company gave me a refund of {$720.00} for the funds I paid for the initial appraisal and reappraisal. We signed the closing documents, shook hands, received the home keys and left, assuming everything was complete. On XX/XX/XXXX, XXXX XXXX, Closing/Funding Manager, with American Financial Network, contacts XXXX XXXX at XXXX XXXX. She states to XXXX XXXX, " We were unaware that the gift came from the employer and FHA guideline state the borrower can not have the cash back ''. XXXX XXXX from the title company calls me and I tell her that I paid for the appraisals out of my own pocket. XXXX XXXX reiterates that back to XXXX XXXX. My loan officer calls me and tells me that XXXX XXXX and the underwriter had changed my closing disclosure just before closing and that I was to receive more than just the {$720.00} I was given.They had removed from my closing disclosure the {$6000.00} the seller agreed to pay for closing cost. On XX/XX/XXXX, XXXX XXXX with American Financial Network emails a revised closing disclosure to XXXX reflecting the {$6000.00} that I was entitled to and that I should have received {$2600.00} at closing. Per XXXX XXXX email : Attached is the revised cd reflecting the borrower receiving {$2600.00}. " please have this executed and return to the borrower the difference of the {$2600.00} minus the {$720.00} already given. This was our first time buying a home and we put our mortgage needs in the hands of American Financial Network in XXXX XXXX with the help of XXXX XXXX which is a great broker. He helped us with every paperwork that had to get submitted and wrestled with the incompetent loan processors at the branch and the arrogant branch manager XXXX XXXX. The basic facts about the dis-service of this branch to us was the fact that the file went through at least XXXX different loan processors requiring that it goes through underwriting XXXX times. We had made all moving arrangements with our landlord and the moving company since the file was approved and XXXX had assured us that everything was going great. On Wednesday, XXXX XXXX at XXXX the day before our closing ( XXXX XXXX ) we find out that we can not close until next Wednesday ( XXXX XXXX ). This was mostly due to a few items that were skipped on our file and fell through the cracks. Our realtor sent a complaint email to XXXX XXXX ( President ) and XXXX XXXX ( CEO ). Then today I receive notice that due to your branches merging and numerous personnel changes ( we have been through XXXX underwriters ) that they just dropped the ball and due to their inability to perform their function they want to delay closing until next Wednesday. Per my credit report pulled on XX/XX/XXXX there are 2 late payments being reported to the mortgage company, American Fiancical Network , Inc. I have attached the report for all payments made to the mortgage company holding the loan on my home in XXXX, OR. I have made all payments within the 30 day period of time from the due date of the XXXX for the month and have even made early payments and overpayments. When I first got my loan I was working with XXXX XXXX NMLS # XXXX from Accelerate Mortgage LLC ( XXXX ) XXXX, I was told that as long as payments are made within 30 days of the due date, the XXXX of the month, then I will not have a late payment reported to the credit bureaus. I also made early payments as my signed contract explicitly states that there is no penalty for early payment. When I received my first, and only, prewritten checks for my mortgage payments it said to send the checks to XXXX XXXX XXXX XXXX XXXX, XXXX, CA XXXX and that is where I sent my payment for XXXX. When I received a letter from American Financial Network Inc. saying my payment was late in XXXX I called, ( XXXX ) XXXX and was told to send the checks to a South Carlina address. During the call in XX/XX/XXXX, I informed them that I would be making my XXXX and XXXX payment together to make sure the XXXX payment would not be late. I was told at this time that the early XXXX payment would be fine. I also called in XXXX about getting my payments set up for online payment due to COVID shutting down my bank where I got my cashier checks from. During the call in XX/XX/XXXX, I set up the XXXX payment and the XXXX payment for XX/XX/XXXX and XX/XX/XXXX. With all of the miscommunication between myself and American Finanical Network Inc. I believe my credit has been negatively impacted unjustly. Upon closing I noticed a XXXX k figure in the closing costs. When I inquired as to what it was I was told that my current lender was not going to pay my property taxes so the new lender was basically financing it into my new loan and once I got my old escrow refund I could turn around and put it on the new loan or consider it cash out. I did have a couple project I had been considering around the home so I agreed. The next day I got email confirmation from old lender they had paid my taxes so I contacted new lender provided email proof as well as got XXXX XXXX XXXX involved and advised them not to pay the taxes with that money as they had already been paid by old lender. XXXX XXXXXXXX XXXX was supposed to stop payment on their check which should not even have been sent at this point since loan was still in rescission period. Loan closed XX/XX/2021 this conversation happened XX/XX/2021. Both XXXX and XXXX XXXX XXXX were negligent in handling this issue. On top of the negligent actions they are extremely unprofessional and have no regard for the customer harm they have caused. Several unreturned emails and ph calls have left me completely frustrated. I finally took it upon myself to contact the tax office and found out that indeed the taxes were paid by new lender and old lender. Now I am left paying interest on XXXX dollars that I do not have possession of. The county advised me that they can not refund XXXX XXXX XXXX their check because it actually posted first before old lender and by law the refund goes to the last payer which will be my old lender. I have been advised by old lender that it could be 60 days or more before I see that money back from them so again left paying interest on money I dont have access to. Add on the time stress and energy lost into trying to solve for a resolution to all of this with absolutely no help or regard from the lender or the title company and you get one very frustrated consumer. I do believe there is customer harm here in regard to the handling of this issue as well as the fact that I basically was forced to finance my taxes when I was escrowed by my old lender and had proof that they paid said taxes. The new lender and the title company need to be held accountable for their poor handling and lack of communication and their overall disregard for the consumer. This whole situation could have been avoided had people done their jobs correctly. And furthermore, I get that everyone makes mistakes and drops the ball but to not take any ownership or even acknowledge said mistakes or offer any solutions for remuneration is unacceptable. I am quite sure if this kind of negligence and lack of customer service happened to me from both the lender and XXXX XXXX XXXX that they are both harming other consumers in same or other ways. On XX/XX/2020 I went to American Financial Network to apply for a loan to purchase a home. I spoke with Mr. XXXX XXXX, who was the loan specialist assigned to my application. He pulled credit reports for my daughter and I, and informed us that we did not qualify for a home loan. He specified that we needed to undergo credit repair and could get approved for the home loan within four months. He recommended that I go to a friend of his that he sends a lot of customers to for help with their credit. He assured me that Mr. XXXX XXXX, one of his close friends, could fix my credit within four months, and I would qualify for the home loan. He had access to my credit report at that time. He knew what items were causing me to get denied for the home loan. I believed him when he said that Mr. XXXX could help me get approved. Mr. XXXX then called Mr. XXXX while we were in the office and told him that we needed to use his credit repair services. He also told him that we were willing to come to his office right then. Mr. XXXX told me the service would cost {$1500.00} for both me and my daughter. Somehow he knew the cost of the service without asking Mr. XXXX. Mr. XXXX then asked if he could meet us at a nearby XXXX 's XXXX XXXX parking lot as he would in the neighborhood, and was on his way home. I told him that I did not mind going to his office, but he insisted upon meeting at the parking lot of the store. I met him in the parking lot of the appliance store, and he ran my debit card for the {$1500.00} payment. Then we submitted financial records to him via email. We never saw his actual office. He then asked us to sign up for XXXX monthly credit monitoring for a fee of {$29.00} per month. I thought he would pay for any additional expenses from the {$1500.00} he received. A month later we called him and asked why we needed to have credit monitoring when we were paying him to fix our credit. He stated that he did not have time to monitor our credit because he was the owner and operator of a used car dealership, XXXX XXXX XXXX on XXXX XXXX. I continued to call him to ask the status of the credit repair. He told me to stop calling him. Now it has been over a year, and he stopped taking my calls and communicating with my daughter via email. I spoke with an attorney, and she advised me to contact CFPB. Mr. XXXX never submitted any disputes on my behalf. He never gave me any instructions on which bills I needed to pay off to improve my credit score. He never did anything. I don't even know if he ever even looked at my credit at all. I contacted Mr. XXXX XXXX to discuss the problem, and he also gave me the run around before he no longer accepted my calls. I believe that Mr. XXXX and Mr. XXXX are involved in a bait and switch operation where they bring people in to apply for home loans, tell them they need credit repair, and then scam them for the credit repair fee of {$1500.00}.

Note that with last complaint submitted earlier today, I forgot to upload the primary document with essential information. It's enclosed herein. Today XX/XX/2022 at XXXX PM I got a call from American Financial Network from XXXX and was told that I needed to call them and upon pressing buttons, I got t a live person who promptly hung up on me after saying " ha ha your going to lose your house ''. Upon calling back after hangup at XXXX PM, a worker for American Financial Network said " XXXX XXXX when you lose your house and are on street with wife will she stay with you ha ha ha. '' I have enclosed completely contradictory letters produced by American Financial Network in the attachment section of this complaint. This cements what the audio phone records show and what I have been saying during original complaint and followup. American Financial Network violates all rules and constantly gives me inconsistent, misleading, and contradictory information. There dishonesty and deception is exemplified by their complete lack of transparency and deceptive practices as outlined with the following. American Financial Network asks me to give them information on loans that they had or have with me and when I said that I didn't have anything that they didn't they would be deceptive and not speak to me or work with me honestly and transparently to try and clarify. The loan needs to be dissolved to zero balance because American Financial Network has continually changed requests, terms, and has constantly given me contradictory and misleading information. They have also been predatory and recently had someone from their associate XXXX XXXX XXXX come to my house and demand that I give them {$5000.00} cash in order to keep my house and avoid foreclosure. XXXX XXXX XXXXXXXX and American Financial Network should be stripped of their rights to lend and sell on the secondary market. I want the CFPB to publish this description on consumerfinance.gov so that others can learn from my experience. The CFPB will take steps to remove my personal information from this description but someone may still be able to identify me. Learn how it works. At a minimum the mortgage should go into a loan modification, which is an option for borrowers under the covid regulations passed with banking and lending institutions. This would be a good start for giving the incentive to American Financial Network and XXXX XXXX services for avoiding the total loss of their lending rights and rights to sell mortgages on the secondary mortgage market.

Without full disclosure, American Financial Network ( AFN ) converted my promissory note for a mortgage into a hypothecated security then sold it forward, destroying the original note. Per UCC 3-309 and UCC 3-418 ( d ) they have refused to provide or prove up the securitized note. This is a type of fraud. Further, AFN has refused multiple times to return the fraudulently stolen promissory note of issuers in an unaltered, original condition to disprove securities were liquidized without original creditors consent which is securities theft ( 18 USC 3301 and 1348 ). Further, per UCC 8-102, UCC 3-305 , UCC 3-306, and UCC 3-105, when AFN securitized said note to sell it forward to Planet Home Lending ( PHL ), a debt collector, to satisfy the mortgage, no taxes were paid on the gain of that secondary issue ( the mortgage as a security future ) by either AFN or XXXX. This is tax evasion and tax fraud. Further, AFN has filed a 1099a with the IRS claiming my security interests in the promissory note were abandoned, without providing a copy to me, despite the fact I did not abandon it. Further, XXXX and XXXX are committing multiple types of fraud in representing multiple specie of currency as XXXX type on the promissory note, defrauding myself and the XXXX XXXX XXXX XXXX XXXX ) who is also a party to the mortgage note instrument sold forward as a hypothecated security. However, in the documentation provided to the VA, the specie of currency was correctly listed in a USD $ format, in all other places of the promissory note they noted the amounts to be paid using the XXXX XXXX symbol for Mexican Pesos ( $ ) without adding " USD $ '' before it. Further, additional fraud was committed by XXXX in that a " loan was provided '' but they've refused to provide a receipt for said loan to determine whether the loan received was a loan of the credit of XXXX or OTHER LENDERS, or a loan of money, as described in the National Currency Act, sections 27, 28, and 53. Refusal to provide this documentation is indicative of fraud. Per 12 CFR 226.32 and 16 CFR 433.2, AFN refused to include necessary legal notices on the mortgage note instrument. Failing to do so, by law, constitutes unfair and deceptive practices in consumer lending, defrauding myself and the XXXX Further, without permission or a court order allowing them to, they fraudulently sold personal identifiable information ( in violation of 16 CFR 02 ) to PHL , who was also defrauded by AFN for refusing to include this necessary legal verbiage which allows seller to sue. Further, in opposition to and in direct controversy with multiple State laws in California and Tennessee, as well as a violation of the Sale of Goods Act, and, without full disclosure, agents of XXXX XXXX ( Seller ) were at the time of the generation of the promissory note, also agents of AFN.

On Wednesday XX/XX/XXXX I called XXXX back from a call that I missed from them. The call was at XXXX PM and the call lasted for just under 39 minutes. During the call I was given numerous false and contradictory information. A : I had filled out a complete loan modification form and emailed it to American Financial Network and was told that the application only had 2 pages and was sent on XX/XX/XXXX. In fact all pages were filled out and submitted in the application sent. B : After resending exactly that was sent on the XXXX of XX/XX/XXXX, I went over with the worker how I sent every required page in the loan modification application. The answer now from the worker was that it was not acceptable to have the loan modification in 2 attachments within email sent. This is another layer of deceit in order to deny me my rights as a consumer and the Federal Covid laws. When caught doing fraud in stating that I only emailed 2 pages of a 13 page loan modification documents, the answer was not to admit to being deceitful in claiming that I only sent 2 pages on XXXX XXXX XXXX but rather the approach was to claim that sending ALL the required loan modification application documents was unacceptable because it was contained in 2 attachments with email sent on XX/XX/XXXX and then again on XXXX XXXX, XXXX. C : I was told by phone that I sent 2 pages of Bank statements on XX/XX/XXXX, but in reality I sent the full loan modification filled out by email. This was another layer of deception and contradictions within the same call as INDISPUTABLE call recording will show. D : I was given a random list of documents that I was supposed to provide in addition to the application, but there were no specifics and nothing was sent outlining the items that I needed to provide. E : I was then asked to send documents that I previously sent numerous times. I was asked to send tax returns for XXXX and XXXX, but I explained countless times that I was not required to file taxes for that year and as a result my XXXX XXXX did Profit and Loss reports for XXXX, XXXX, and XXXX. I previously was told to continually add to these documents such as signing the documents myself, having additional language added, and more. After having previously provided every document required by American Financial Network and then asked for more and given contradictory lists of information when making calls to American Financial Network the tasks became inconsistent and impossible to follow. This is all a pre-meditated and malicious scam by American Financial Network which is now clear from all of the previous calls and now these absolutely absurd contradictions and claims by American Financial Network when talking to loan expert XXXX who worked for the company.

Update on mortgage that was closed in late XX/XX/XXXX late at night in XXXX XXXX CT without a notary and without a lawyer for me or American Financial Network, INK. To add to the existing issues reported I got a call from American Financial Network at XXXX at XXXX PM and said for me to call them by automated dialer. I responded by calling them back at XXXX PM a minute later and spoke to someone that I have spoken to previously. I was placed hold for about 4 minutes and was hung up on when I asked about loan modification and documents. I then called back at XXXX PM and was hung up on again. I have submitted documents that have been requested for approximately a year and every time I submit what is requested of me, I am told a month or 2 later that a paper needs to be updated ( which is good for a month such as bank statement ), then after 1-2 month review the response is over and over, and over again. There is more as the workers 1. Give me contradictory information everyone I call as documented in recordings that I have done and the company is required to do. 2. The workers give me no information that is helpful. The firm issue the workers do is demanded which tone of voice I use when talking to them and talking in a passive and subservient tone. I've accommodated a few times in return for the loan modification getting done and no luck. 3. I was told to get the right documents in and that it's like a program for approval. When I told the manager 2 months ago that a program is " only accurate if the right data is put into program '' she got mad and was short with me. I have continually asked XXXX what documents they need and when I present them they say they need something else and the process never ends. For instance I submitted a Profit and Loss for XXXX and then after a month plus of review XXXX tells me that I also need to sign the document ( after a month plus review ), and then after I submit the new document I was told that I needed something else about old mortgages that I no longer have and on and on and on. The contradictory information with every call is made worse when I'm told by XXXX that American Financial Network is not handling the loan modification and then I'm getting calls from American Financial Network and no there just hanging up on me since these Consumer Finance Protection Bureau complaints. THIS company and or XXXX has no process or consistency that I can follow and are RANDOMLY making policy and making demands to me as is FINANCIALLY and most feasible action as this complaint is in the works.

XXXX XXXX XXXX applied for a mortgage in XX/XX/XXXX with American Financial Network. XXXX XXXX a entrepreneur had to amend his tax return after it was discovered that the previous tax preparer took more unwanted deductions that he desired. XXXX XXXX was instructed to amend the returns by XXXX. XXXX waited months on end for the IRS to receive the documents and initiate the process of amending the returns. In XX/XX/XXXX XXXX received his pre-approval letter and starting the process of searching for a home with his realtor. After months of searching with his pre-approval in tow he secured a contract on a property. XXXX found a property that was half of the pre approved amount. XXXX went through the entire process and did and paid everything that he was instructed to do by the mortgage lender XXXX. Inspections, appraisals, earnest money, which alone was nearing 8k or more. XXXX XXXX only went through the process because lender gave the pre-approval. Then the amended tax return was received by the IRS but not processed and the transaction stalled. XXXX was told by XXXX that if he could get something showing the that the IRS had received the return we could move forward. The IRS could not per their internal rules and regs send anything in writing but we obtained and audio with the IRS agents id number, name and they stated that XXXX XXXX XXXX XXXX tax returns were received but had not been processed due to the global pandemic. Once the condition was satisfied they still didn't move forward but came back with another condition. Now we were told that this file went up to the highest underwriters within the company and they were they ones who said this condition would be satisfied with evidence of the return being received. Nothing, no traction. Then guess the tax return gets processed and that was the one thing that we had been waiting on and when that happens still no traction. The mental anguish, and financial burden this puts on a person is very taxing. Most of all XXXX XXXX was trying to provide a home for his XXXX minor children but since he was not able to receive the financing he wants to be reimbursed the money that was tied to this property based on the pre-approval and underwriting process which he feels he met every condition and leaped over every hurdle. This is not a practice that a mortgage lender should engage in because it may look like a individual is being singled because he met every requirement that was asked of him,

THESE ACTIONS ARE ALL TO PUFF THE PRICE OF MORTGAGES ON SECONDARY MARKET OR WHAT CAUSED THE XXXX CRASH THAT ALMOST PUT US INTO A DEPRESSION. See attachment herein. American Financial Network recently or yesterday emailed me and asked if I send email attachments in PDF only. This request was after over a thousand emails of correspondence which I had to do because I was continually told different stories about whether I had the right documents by XXXX and American Financial Network. I was told different things even by the same representatives during single conversations, in same day by 2 different representative, and continually every time I called with few to no exceptions. It's 100 % certain that American Financial Network and or XXXX are going to complain about and use the volume of my emails as an excuse for their actions but the reality is that due to constantly being told different stories/statements about what I had and didn't have, I had no choice but to send voluminous duplicate emails because of continually being told certain documents or all documents that I mailed or emailed were not received. Also look at the SECOND ATTACHMENT. Here I was sent contradictory and confusing documents ON THE SAME DAY!! HOWEVER, although both documents are dated the same day of XX/XX/XXXX THE DOCUMENT WITH the XX/XX/XXXX deadline was mailed to me on XX/XX/XXXX and of course never emailed. This company is EVEN doing fraud and deceptive practices IN ORDER TO put me in a bad position and make me fight and be in a compromising position when negotiating. Kind of like coming to an agreement as someone is hung outside a 30 story window in some ways. See there new defense they are concocting herein, in attachment. They want to claim that what I sent previously by word was not acceptable. To make this right, the mortgage should be dissolved to a XXXX balance and company trained in having consistency that customers can follow. I believe that due to concerns about the price to sell mortgages at on the secondary market, these companies or American Financial Network and XXXX are using deceptive business practices to avoid doing loan modifications and forbearance of mortgages. This is done so that the mortgages are sold for a significantly higher price on the secondary market such as with the XXXX inflated price scam that put us into the crash.

Back in XXXX of XXXX, I applied for the Florida state Homeowner Assistsnce Fund ( HAF ) to help me be able to make my mortgage payments. I called my mortgage lender in XX/XX/2022 to request a Covid forebearance and they applied the forebearance to my account. HAF approved to pay my mortgage for the next 18 months starting in XX/XX/2022. HAF has sent checks directly to the morgage lender American Financial Network and their subsidiary XXXX. Checks were mailed to the address on my mortgage statement which is the one I make payments to usually. American Financial Network or AFN and XXXX have not been able to locate or apply thise checks to my account. They accept HAF payments but are not taking the necessary urgent steps to ensure that my checks are located and posted. Since XX/XX/2022 until now I have made so many phone calls and spent at least 20 hours on the phone and I got absolutely no resolution. I was told every excuse as to why the checks have not been posted. Things such as that they are backed up, or that I havent sent the document to the right email even though I sent to all the emails that they told me to send to. They tried to blame me and say that I did not send the email showing the letter from HAF when I have proof I have been sending the same letter since XXXX and they finally acknowledged and posted the letter in late XXXX. There is no sense of urgency and I dont know what else to do anymore. I called yesterday and was told that HAF needs to contact them directly. I called HAF multiple times and they told me over and over that there is never a need for them to contact the lender because all necessary documentation have been provided to me and I uploaded thise documents to XXXX or AFN. HAF told me they have never experienced such issues with any other mortgage lender and they can not understand why AFN or XXXX are refusing to post and locate those checks. I looked ar XXXX consumer reviews and they were frightening. I read a lot of the same issues and complaints that I am dealing with. That is why I am reaching out to you to please help ensure that they do what is right. It is beyond frustrating knowing that my approved funds have been sitting there untouched when they should be applied to my account. This is my life and home in the balance and they told me this was not an urgent matter.

Initial date of contact withXXXX XXXX with afncorp ( American Financial Network ) in XXXX XXXX, Oregon was XX/XX/XXXX FHA Loan amount {$320000.00} A letter of approval for a FHA loan was submitted by XXXX at AFN, stating that I had been approved for the loan, all my records were reviewed by underwriting, and even my short sale of XX/XX/XXXX was approved, and we were good to go with loan proceedings. The only reason I proceeded with him and his company was the initial approval letter. If you speak to my realtor, he will have more stories that ended in deception other than mine. An offer was placed on a house, a price was agreed at XXXX. I was putting 45-50 K down. Each step we took in the process, we were told that we would fine that " we would never be this far in the process if underwriting had not been given the original approval ''. We had a 30 day escrow, I was to move and start a new job, 2 hours from where I resided at the time of original contact with XXXX. We lost {$2000.00} of earnst money due to we were told all was good, after having to push escrow out a few times. After many weeks of damages from the lender, and storage unit payments/comittments /work notices, home notices where I was moving from, a {$30000.00} student loan that was paid off ( Underwriting stated we could move forward once we showed that it was paid. This loan was in default and was on the credit report originally, we were told in the beginning it would not present a problem with underwriting, they were well aware of all issues ). Several events took place, the day escrow was to close at XXXX XXXX on XX/XX/XXXX, we were notified by XXXX XXXX, a manager from the same company, that underwriting had declined our ( my ) loan. A home insurance policy was purchased, several hoops were jumped through, all of them documented, the area I was moving to had zero rentals, home appraisal paid for, home inspection paid for, septic inspection paid for. We ended up getting the house, closed escrow XX/XX/XXXX, we had to pay {$370000.00} due to agent wanted nothing to do with us, due to all the deception, none of which we caused. For several months, I worked with XXXX XXXX, a loan officer for the American Financial Network. He pulled my credit 4 times, got me pre approved for an FHA loan and gave me some advice on how to increase my credit score. In the end, I could not be approved because I had a federal student loan that was in default. This was a fact that he should have known in the beginning, when I explained to him that I was in default and would be for 9 more months. He pushed anyway, telling me that the federal loan default would not prevent me from getting a federal loan. By the time that the loan was rejected because of the student loan defaults, XXXX supposedly ran a credit simulator and instructed me to call several creditors with debts I had paid off and have them removed from my credit report. At my time and expense, I did, and was rewarded with a 105 average drop in points on my credit scores, due to having less credit accounts and length, and to the many inquiries. After talking to all 3 credit agencies, at even more expense to get counseling on why my credit score dropped so drastically, I was instructed that the only thing I could possibly do was to get some of my inquiries removed. I contacted XXXX, he apologized profusely for not realizing his error with the student loan default before wasting 7 months of my time house searching and all, and agreed to seek deletion of my inquiries that he made. We had a conference call with an agent of the credit pulling company they use, and she instructed him to write a letter, which I would submit to the agencies, and the agencies would contact her to get the deletions done. He wrote the letter and sent it to me, however, he was mistaken, again, this time about how many inquiries were made. The letter he sent me reflects to delete XXXX inquiries, however, there were XXXX. XXXX XXXX no longer works for AFN. I was forwarded to a XXXX XXXX, where I explained the damage done to my credit by XXXX. XXXX said that he would not help me with a letter deleting the inquiries made in error.

We applied for a pre-approval in XX/XX/XXXX with XXXX XXXX 's Company under American Financial Network. We received our pre-approval letter from one of XXXX 's account managers. Her name is XXXX XXXX. We originally wanted to go with, what they disclosed to be a first time home buyers grant that would account for 3.5 % of the home purchase price for a down payment. Come to find out later it that we only would qualify for this if the seller contributes to the closing fees. This was not disclosed to us up front. After that, she advised that we put down the 3.5 % ourselves, within the FHA program. She never considered that a XXXX conventional loan would be a better fit for us provided our good credit and income. A GFE or Loan Estimate was promised to us but never sent. We never felt comfortable in going with them as we felt they weren't being completely honest. On XX/XX/XXXX, one of her underwriters called asking for more information, I kindly informed him that we were looking at other lenders that would provide a better interest rate through a conventional loan. She then immediately emails me back stating the following. " I just called and left you a message. XXXX on my team let me know you are shopping with another lender for conventional financing, which is what we can offer too. Please note, your credit scores will drop if you allow other banks to run your credit which can hinder your financing. Please let me know what is going on, so I can reach out to XXXX as I went through questions and verification for your offer to be accepted '' Note, this statement about our scores dropping is untrue and she may be in violation of the dodd frank laws. This was a scare tactic in order to keep our business. This was poor form and bad customer service. My concerns is that XXXX contacted the seller 's realtor in efforts to jeopardize the deal.

'm being approved for the XXXX Assistance funds for XXXX futures mortgage payments. This is a federally funded and regulated program - overseen by the XXXX Treasury. Mortgage companies and are required to comply with guidelines set forth by the Federal Government in terms of reporting and communication. HAF are sending the bulk checks and they aren't applying on time to my account. As of today, my XXXX and XXXX payment are past due because they aren't applying the payments on time. They send me a letter letting me know that I'm past due but in reality, I'm not because they had my monthly payment the problem is that they are holding it back. It's a nightmare every month dealing with late fees that are unfair since the payment arrive on time. Last month on XX/XX/XXXX after multiples calls and emails, they posted the XXXX payments for XXXX and XXXX after they email back with the following explanation. The checks never came to XXXX and were instead applied by payment services as the loan was current. We thought that the payments we were seeing for those dates were paid by the borrower as we never saw the checks. The XXXX achs I have just applied the amounts to the XXXX on XXXX XXXX loan. They should show in the XXXX by Friday the XXXX. This should hopefully clear up everything that was missing on this loan. This is so frustrating because they cashed the checks but not apply the payment to the mortgage loan. And charged late fees when in reality the checks get on time to the company. I spoke with the contact from XXXX, and she sent me the following, XXXX XXXX We show both payments made. XXXX was paid on XX/XX/XXXX, and XXXX was just paid on XX/XX/XXXX. Was conditionally approved in XXXX of XXXX for {$650000.00}. Started house shopping and signed a contract on a house with XXXX XXXX. Put down a XXXX XXXX at the end of XX/XX/2022. There was delays in construction so we could not close until end closing of XXXX. The underwriter that had worked on my file was fired on the XXXX of XXXX, my file was passed through several different underwriters until 2 weeks later they told me I was disqualified from my conditional offer with information available to them since XXXX of XXXX, I provided them with all of my income, employment information and documentation. Their negligence, and intentional deceit has lead to me losing thousands of dollars, becoming temporarily homeless and unable to purchase my home. The whole point of conditional approval was to have the peace of mind that the financing was evaluated and accurate information to shop with. At most i were anticipating a probable delay due to the build. Had you been notified that the condintional approval was an issue, you could have looked at other options or avoided making an offer all togerher. No one informed you of an issue with the conditional approval until too much time had passed to react effectively. The loan Officer helping originate was working off the impression the application was conditionally approved as well. However the processing side prolonged the review almost 2 weeks full of request for documents that mostly had been sent. All after the original processor was terminated for having creating issues with other files. When asking for feedback and review status you and the loan officer were delayed whole business days in between submitting documentation for review and response. Leading him to work on satisfying other conditions and losing precious time you and XXXX XXXX focused on other potential options.

Ive been under contract on a home since XX/XX/2020 and working with American Financial Network for the mortgage loan. On XX/XX/2020 I was informed by my mortgage rep XXXX XXXX that the underwriter was going to deny my loan with only 13 days left to the closing date. She offered no solutions after making so many promises but as a first time home buyer, I guess I didnt know any better. Needless to say, I immediately asked for the denial letter and started shopping for another lender. I have found another lender and need to have the FHA case number/appraisal transferred as well as the denial letter from American Financial Network. I am not only being ignored by loan officer but she then had the nerve to say the loan hasnt actually been denied and that Id have to wait for the letter before she could transfer the file. It is now 12 days till closing, I have sent numerous emails to her and others such as managers and branch relations. If my loan was denied why is it that Im not being provided with the official denial letter to protect me and my earnest money deposit that was given to the seller. Why am I being so mistreated. Its starting to make me wonder if the loan officer has a personal issue with me based on my demographics because she has been non responsive and our communication has been horrible from the beginning of our business transaction. She also had the nerve to ask if I wanted to just cancel the loan with them and risk losing my earnest money ( her words and yes, I have the emails ), of course I replied NO, do not just cancel my loan. At this point, I just want the denial letter to be issued and to be done with this company. I am now 12 days away from closing and I need to move forward ASAP. Maybe by making this complaint, Im shedding light on the injustice thats being done to people like me, people of XXXX.

I was a victim of predatory lending by American Financial Network XXXX XXXX XXXX XXXX. He baited me with a low interest rate before and after my loan process with a 3.625 % mortgage finance rate. This was on a 30 year conventional fixed loan with 5 % down. He ran my credit and I had a XXXX credit score which is the highest bracket I could be in. I applied for the mortgage loan with AFN on XXXX/XXXX/XXXX and on the closing disclosure estimate it stated 3.625 % rate. However when asked if it was locked he XXXX XXXX XXXX XXXX stated I had to sign the loan application and disclosure estimate. He also replied in a separate email on XXXX/XXXX/XXXX that it was indeed " locked 3.625 % with our # XXXX top investor. '' I have proof of that email as well as documentation of the underwriter also approving me at the 3.625 % fixed rate and credit score. So XXXX strung me along the whole mortgage process until XXXX/XXXX/XXXX ( after expected close date ) when he revealed that his investor backed out of the promised 3.625 % rate and that I would have to accept a 5 % rate! He stated to me and my agent that he purposely avoided telling us sooner since he was 'nauseated ' at the news. He waited until after the election to tell me and by then rates had skyrocketed to 4 % and above. He eventually told me 4.5 % is the best rate he could get for me! Since I had no other recourse I had to accept. The rates did indeed go up everywhere and I was at major risk of losing the home. So he had me cornered. I was offered a free refinance certificate in case the rates dip well below 4 %. I want justice for the bait and switch scam AFN is running. The fraudulent scam that XXXX pulled on me will cost me about {$86000.00} over course of loan and $ XXXXmonth extra ( $ XXXX ). Please refinance me at the " locked '' rate of 3.625 %. Thank you.

On XX/XX/2020 We went under contract on a home located at XXXX XXXX XXXX XXXX GA XXXX. We sent all the paperwork as soon as the underwriter requested it. We have provided everything immediately. All our record were in order. I paid for the appraisal on XX/XX/2020. The appraiser scheduled the appointment 2 weeks later and we had to send an amendment to ask for more days on the appraisal contingency. After waiting forever the appraisor gave a report that was messy. This made the underwriter ask for more documentations which prolonged the closing. We spent 5 days trying to contact the appraiser to fix the errors. After the underwriter noticed that the appraiser was not cooperating they dismissed it. After not being able to close on the agreed date of XX/XX/2020 we push the closing to XX/XX/2020. We were happy that all the conditions were met until the underwriter started taking more than 72 hours to respond. The lender would call the account manager and underwriter at Orion Lending and send emails and they would not get back to us. On Monday XX/XX/2020 the underwriter ask us to send the proof that the earnest money was deposited. I mean really at this time in the process they want to ask for something so simple and prolong the closing evening more. We have to give a 60 notice to our apartment complex and now we are living in our car with our XXXX year old son because of the underwriter fault. Today is XX/XX/2020 and we have not heard from the underwriter that was supposed to respond back to us immediately. My lender has been calling them and emailing them every hour on the hour and they have not reached back out to us. This is pitiful and this company should be shut down for negligence. We even had to make an agreement to give the seller XXXX months rent to allow them to wait for us as we close.

Back in XXXX of XXXX I initiated a mortgage application with American Financial Network , Inc. the mortgage broker I was in contact with is named XXXX XXXX. The application I submitted requested a 30- year loan for which on XX/XX/XXXXI received a Commitment Letter with an interest rate of 5.125 %. Additionally, earlier in XXXX ( XX/XX/XXXX ) I also received the loan estimates which showed the interest rate at 5.125 % on a 30-year loan as well as no points for closing costs. However, when the loan estimates document was reissued on XX/XX/XXXXthe loan was now showing 5.253 % ( or {$12000.00} ) in closing points. At this point I informed XXXX that this was not what we had agreed to. That same day he informed me that the documents were not final that and the lender credit would be applied before closing. On XX/XX/ he issued me another loan estimates document. The new estimates had now changed the loan from 30-years to 15-years. The closing points had also changed to 3.032 % ( or {$7200.00} ). On XX/XX/XXXX, I informed XXXX that I had not agreed to a 15-year loan to which he again replied that the documents were not final. Eventually I did agree to the 15-year loan, but XXXX himself told me that the points of 3.032 % ( or {$7200.00} ) would be applie half in terms of lender credits at closing ( which was fulfilled ) while the other half I would receive in the form of a check 2 weeks after closing. I closed on XX/XX/XXXX and after XXXXo weeks had passed I wrote to XXXX asking for an update. He informed me that he was working on in. Since XXXX of last year he has been dragging this issue by proving different excuses and and at this point I have decided to file this complaint. Today XX/XX/2022 at XXXX PM I got a call from American Financial Network from XXXX and was told that I needed to call them and upon pressing buttons, I got t a live person who promptly hung up on me after saying " ha ha your going to lose your house ''. Upon calling back after hangup at XXXX PM, a worker for American Financial Network said " XXXX XXXX when you lose your house and are on street with wife will she stay with you ha ha ha. '' I have enclosed completely contradictory letters produced by American Financial Network in the attachment section of this complaint. This cements what the audio phone records show and what I have been saying during original complaint and followup. American Financial Network violates all rules and constantly gives me inconsistent, misleading, and contradictory information. There dishonesty and deception is exemplified by their complete lack of transparency and deceptive practices as outlined with the following. American Financial Network asks me to give them information on loans that they had or have with me and when I said that I didn't have anything that they didn't they would be deceptive and not speak to me or work with me honestly and transparently to try and clarify. The loan needs to be dissolved to zero balance because American Financial Network has continually changed requests, terms, and has constantly given me contradictory and misleading information. They have also been predatory and recently had someone from their associate XXXX XXXX servicing come to my house and demand that I give them {$5000.00} cash in order to keep my house and avoid foreclosure. XXXX XXXX XXXXXXXX and American Financial Network should be stripped of their rights to lend and sell on the secondary market.

I contacted my mortgage company, American Financial Network Inc. at the beginning of the month of XX/XX/XXXX. I made contact with American Financial Network Inc prior to my late payment date of XX/XX/XXXX in attempt to work with them on how to avoid a delinquent payment that month, due to hardship. I was transferred to several departments including the mortgage refinance department whom failed to provide me with assistance or information needed in order to avoid delinquency. Aside from several transferred calls, I was hung up on and put on hold for long wait periods. Eventually I was transferred to an outside collection agency that informed me that they could not help me because my payment was not yet late. The customer agent stated that I must be in delinquency in order for American Financial Network Inc. to provide mortgage modification options and that they could not proceed with a forbearance or any other type of loan modification over the phone. I was instructed to fill out a generic set of modification forms that did not apply to my circumstances. I was also advised that the loan modification was not guaranteed. Due to the fact that my husband and I are XXXX XXXX XXXX whom rely upon contract XXXX work and are at the mercy of the flailing economy, we contact our mortgage lender as soon as we foresee any loss of income that will enable us to pay our mortgage. We lost our home in XXXX due to being denied mortgage modification thus we are terrified of a repeat scenario and weary to participate in any mortgage modification that requires that we are in default or delinquency in order to qualify.

Hi we were pressured into a mortgage we can not afford. When we started the conversation with American Financial Network we had gotten a letter stating we didn't have to pay mortgage insurance anymore and could refinance because we had insurance long enough. I thought I had heard something like that so we talked to XXXX XXXX. He told us he could save us a bunch of money and pay off some things. As the process went on he took more things off the table he had promised. Every time I questioned or changed my mind XXXX XXXX talked us out of it. In the end only a few things were paid off and the mortgage payment was approximately {$500.00} more. My husband and I are XXXX and XXXX. I feel we were taken advantage of and the loan should never have been approved. We gross {$5100.00} from social security. Our expenses without food or car gas are {$3300.00} and the new mortgage is {$2000.00}. The first payment was last month we paid it on the XXXX. The month of XXXX is due and we don't have the money because last we started {$2000.00} in the hole. American Financial Network sold the loan before the first payment was made. Also there was a lien on our house and they said it was a balloon payment coming due and needed to be paid. We have since found out this wasn't true. This all started approximately XX/XX/2023. We did know how to cancel because it had gone so far. We contacted an attorney and are following their recommendations. Will be contacting the XXXX XXXX XXXX next. We some how would like a lower payment. This loan should never of been approved.

We closed on our loan with AFN on XXXX XXXX, 2023 and the 1st payment was due on XX/XX/XXXX. On XX/XX/XXXX, we received an email from our home insurance company that they received notice to change the loan servicer to XXXX XXXX Prior to this email from our insurance company, we were not notified that our loan had been transferred as required by law. When I called AFN on XX/XX/XXXX, I was told that it was transferred to XXXX XXXX Mortgage and given a Loan Number ( but still was not given a transfer date or copy of letter ). XXXX XXXX XXXX disputes that they purchased this loan. I spoke to our insurance company again and they confirmed that they received notification from AFN that it was transferred to XXXX XXXX ( I have a copy of that letter ). XXXX Mortgage also disputes that they purchased this loan. I spoke to XXXX XXXX on XX/XX/XXXX & XXXX, and their records indicate that it was transferred to XXXX XXXX XXXX XXXX. I spoke to AFN again on XX/XX/XXXX and finally gave me a Transfer Date of XX/XX/XXXX and was told a letter was mailed on XX/XX/XXXX ( we never received ). I requested a copy of the original letter with the XX/XX/XXXX mailing and was emailed a copy showing a date of XX/XX/XXXX ( same day I requested ). Our payment is still showing a Due Date of XX/XX/2023 but all parties have told me not to send payment as they have no record of holding the loan. I still have no clue who the actual loan servicer is since everyone has given us a different company and nobody has record of servicing the loan!!

In XX/XX/XXXX, American Financial Network INC . Upon asking me about mortgages my father, my brother, my son have taken out, I realized that I had been compromised, that another characterization of my name was being used other then the one applied under, and my identity compromised. On XX/XX/XXXX, I received a appraisal listed under the name of XXXX XXXX, of which per the social security administration I haven't used since XXXX, which goes along with the other requests. Additionally they in their efforts to create a denial ask for a bankruptcy from XXXX, which is outside the requirement for justification by the VA, in such its almost six years old, the VA justification is at two years. XX/XX/XXXX my husband and i applied for a house loan through American Financial located in XXXX. At the time the rates were fair and our credit was decent. I advised them that we would be working on our credit so that we can get a better rate when it was time to close. We worked on credit and end having a high XXXX 's for both my husband and I but still ended up receiving a 5.125 interest rate, when at the time they were 4.22 closing XX/XX/XXXX. The company never offered to buy the rated down or pull the credit to see the improvement to offer a better rate. Also the initial closing doc was a different amount and I thought when we closed the amount couldn't be higher well the note went up an additional XXXX which was not acceptable. When I brought this to the lender XXXX XXXXXXXX XXXX attention and the processor it was like I didn't know what I was talking about and they told me they underestimated different amounts. For two years we paid our mortgage with a 5.125 interest rate. I attempted on several occasion to get home refinanced and was given the run around with XXXX XXXX. I feel as though we were scammed by American Financial. The loan was sold to XXXX XXXX in XXXX. The document provided was the first closing doc and out not was not XXXX, it increased to XXXX, there was never a mentioning of a rated lock especially not at that high rate. my wife and i applied for a loan on our property in XXXX tennesee in XX/XX/XXXX after approx 45 days i received a request to pay off $ 50+K in debt, and close an account so that the loan would go through and i would receive docs the next week. we paid off the debt within 24 hours and provided all requested documentation to XXXX XXXX NMLS # XXXX OF AMERICAN FINANCIAL NETWORK INC. within 72 hours. this included letters from creditors. approximately 10 days later i then receive another request from the XXXX XXXX to pay off approximately 90 % of all of our debt in order to get the loan processed. my wife and i have now paid off over 50 thousand dollars in debt as requested and now they want us to pay off another 200+ thousand in debt. between these two amounts this exceeds the loan amount requested. some of these loans are also 0 % interest which they want to provide a loan for approx. 4-5 % which financially makes no sense. ( get rid of a zero percent loan to obtain a 4-5 % loan? ) after questioning XXXX XXXX he stated that 's what underwriting has requested. this process has now left me with approximately 3-5 hard inquiries on our credit which were NOT authorized and wasted 90 days of our opportunity to obtain this loan. the ramifications to me from the above is : XXXX of debt paid off for no reason and cash flow loss as requested by XXXX XXXX 90 days of time for a refinance on the property excessive AT LEAST 4 hard inquiries on my credit personal loss of time

There are 3 companies involved : American Financial Network ( AFN ), XXXX XXXX XXXX ( XXXX ), and XXXX XXXX ( XXXX ). AFN agreed to complete a Streamline VA Refinance for my family, as a free service. The final paperwork had our new loan set at approximately $ XXXX higher than what we were told our old loan closed out at. When we inquired about this we were told that the $ XXXX was there to cover our new escrow account, and that the reimbursement from our old escrow would be used to pay the new loan back down to where it should be. We received our reimbursement from our old escrow and insurance, and now are being told to deposit that money into our new escrow account, because it only contains around {$800.00} and is short. When I ask again why the new loan is sitting at over $ XXXX higher than our previous loan, we get no answers. Now our yearly taxes are coming up, there 's not enough money in our escrow to cover the amount, and our loan is sitting at a higher amount than it should be while gathering extra interest that should also not be accruing. Attached is an email from XXXX with AFN stating that our increase in our loan is to cover our new Escrow account. My credit report shows multiple " hard inquiries '' on multiple dates. The company name that shows is XXXX XXXX and the dates are XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. I can not find information on the company called XXXX XXXX. I have attempted to open disputes with the credit reporting agencies. XXXX online service is not operational and they tell me it is a technical problem so I called in to get a status on the dispute. The agent told me that I need to contact the company directly to have it removed and gave me a different company name of American Financial. I have called American Financial - I have no idea who they are - and they are not helpful. I would never, nor would anyone authorize a company to perform hard pulls on your credit 5 times in a row. I don't even know what this is, but multiple pulls have not been authorized by me. So now, XXXX is telling me that even though I have informed them that this information is incorrect and I did not authorize this that I have to somehow go figure it out and get it fixed or removed. This is complete XXXX XXXX. This is why we all know that credit scores and the agencies are nothing more than a way to attempt to substantiate taking advantage of consumers and charge them higher interest rates. XXXX sucks and everyone knows it. Complete garbage that they are allowed to report inaccurate data and even when informed do nothing about it.

Company : American Financial Network , Inc . | NMLS # XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, CA XXXX Company personnel failed to conduct themselves in a professional manner that proved detrimental to my refinance process. Lending company utilized a 3rd party appraisal company and failed to follow up when appraisal was not only inaccurate, but misleading. instead of working with buyer to rectify situation within the 24 hour period, company negligently sat on accurate property information, which was requested to address the inaccurate appraisal report. Loan officer advised appraisal was already submitted on Wednesday XX/XX/XXXX with 24-48 hour turnaround ; however, after I had to chase down leads on XX/XX/XXXX to gain an accurate status to eventually speak with the actual appraiser whom informed he'd never received any request to redo the appraisal. Company then displayed ineffective and egregious communication tactics which caused the required comps to refute the original appraisal of property to become invalid. Company was aware of the inaccurate appraisal report and overcharge of said report and informed me to " deal with it, as appraisal company does not have oversight ''. When I informed that was unacceptable, company responded in aggressive tone and demeanor, with the attempt to gaslight into silence. I have attempted multiple emails to cancel this process and am actively being ignored by the company.

I was trying to get refinanced because I need some cash out and I have an adjustable rate montage and applied to American Financial Network with a XXXX XXXX loan officer. They promised me XXXX cash out and that they would pay off a judgment against my daughter also. I had told them repeatedly not to go ahead with an appraisal unless all this looked good which they assured me that it did look good for me to get a loan with them .I had backed off them once but they persisted and so I gave them my credit card for the appraisal to be completed which it was costing me XXXX dollars but when they sent me papers to sign they money was not there that had been promised to me so backed off the loan and backed off the deal. Since XX/XX/XXXX I was approved for the XXXX XXXX XXXX for XXXX future payments. The months of XXXX to XXXX with a little delay but were applied to my account with no issues. Since XXXX no XXXX payment has been applied and when I contact XXXX they tell me that they send the checks every month. They also told me that they send checks in large amounts since several accounts are included to be paid. I have contacted almost every day since XXXX ( almost XXXX months ) loss mitigation, and they tell me that XXXX is having issue with the process of applying the payments also that the only things they can do is an escalation to the department that deals with applying payments as well as send a email to the XXXX department for more details. But unfortunately to this day I have only received the same response. We came in contact with Mr. XXXX XXXX, who's a loan officer. Mr. XXXX asked us for our financial documentation unlike other mortgage lenders who would simply ask for SSN, name, and DOB to pull credit information. He demanded that we must provide him with our 2 years of tax returns, W2s, and latest pay stubs in order for him to pull our credit and qualify us for a mortgage. However, after we followed up with Mr. XXXX for the mortgage estimates, his demands gotten more absurd. He now wants us to sign a commitment letter before he shows us the figures he is offering. The commitment letter states, that after signing if we happen to find a lower interest rate and decided not to pursue the financing with Mr. XXXX, we will need to pay him {$1000.00} in fees. We have spoken to Mr. XXXX several times but he never mentioned this was supposed to be their company policy. Even when he was pushing us to send him all of our financial and PII information he did not mention that we had to sign a commitment. I'm being approved for the XXXXXXXX XXXX XXXX for 17 futures mortgage payments. This is a federally funded and regulated program - overseen by the U.S. Treasury. Mortgage companies and are required to comply with guidelines set forth by the Federal Government in terms of reporting and communication. XXXX are sending the bulk checks and they aren't applying on time to my account. As of today, my XXXX payment is past due because they aren't applying the payment on time. They send me a letter letting me know that I'm past due but in reality, I'm not because they had my monthly payment the problem is that they are holding it back. It's a nightmare every month dealing with late fees that are unfair since the payment arrive on time. On XX/XX/XXXX XXXX sent the check for XXXX payment. The mortgage company applied the payment on XX/XX/XXXX more than 30 days after multiples calls and emails. On XX/XX/XXXX XXXX send the XXXX payment and as of today nothing is applied in my account. I have experienced extremely poor service. The first instance was difficulty in securing an appraisal, this process was delayed which resulted in jeopardizing my ability to complete an inspection within the 3-week window of having funds transferred to escrow. Next, I have received multiple conflicting and inaccurate closing disclosure documents. The first is dated XX/XX/20 where I noticed that the sales price of the home was incorrect. The second dated XX/XX/20, inaccuracies were detect by me that included the loan amount. Finally, another disclosure was issued XX/XX/20 where the mistakes appear to be corrected however I feel extremely uncomfortable working with this leader following the blatant negligence. More importantly, on Friday XX/XX/20 I spoke to a manager regarding my concerns that these errors will result in delaying the close of escrow as well as my document timelines. To which I was assured that the closing disclosures would be corrected the same day and resent however this did not occur. Also, a nominal fee reduction was discussed and is not reflected on the XX/XX/20 disclosure. Escrow was expected to close XX/XX/20 however due to this company mistakes, I am at risk of my rate lock expiring and losing my {$3000.00} escrow deposit.

I have been given false hopes or discriminated or treated unfairly. I have been working for 5 months with AFN with a senior loan officer who has been misleading me and getting information with no result twice after telling me I was prequalified preapproved for a refinance cash out which I have been trying to accomplish. Twice she pulled my credit causing me to get my numbers lowered or questioned by credit bureaus unnecessarily except the first one. Later, she revealed to me that her company was pressuring her personally to submit applications and she admitted that my loan is rejected but the company would not give me the real reason for the denial. She is leaving the company and she would like me to apply with her new company since it is a better company. She revealed that my separation agreement is a concern and that the dots do not connect she was told verbally and via internal email she could not share. I submitted a legal document regarding my separation and gave all the information required. I was treated unfairly with no good faith to make this a reality. I spent a lot of time losing time and money with false hopes and till date I have no written reply from the company. The loan officer has left to another company supposedly.

The lender paid my property taxes late, and this resulted in an overpayment to XXXX XXXX County, VA. By the time the lender had paid, the delinquent amount had been paid by my closing company for a refinance. The County confirmed they had sent two checks ( returning the funds sent by AFN/XXXX ) to AFN/XXXX on XXXX XXXX and XXXX XXXX for {$54.00} and {$5000.00} respectively. I have repeatedly contacted AFN since mid-XXXX, with the most recent attempt on XXXX XXXX XXXX. They refuse to refund the returned amount stating they do not have a record of receiving it. My account with them is closed ( effective XXXX XX/XX/XXXX when the settlement company paid the loan off for the re-fi ) since my re-fi is final ; and I have received the balance of my escrow ( minus the amounts above ). I got a call today from American Financial Network from the phone number of XXXX at XXXX PM. The call lasted XXXX minutes and XXXX seconds and the person who I spoke to was named XXXX XXXX who has an employer ID of XXXX. She agreed to allow me to record the phone call conversation I asked why American Financial Network is now calling me and asking for information, while 2 weeks ago they told me to speak to XXXX and how i have continually received different information from each of the businesses and the many issues that I had with the company. I was told that my loan modification request was under review whereas during last call about a week ago with XXXX I was told that I could not apply for a loan modification or the Covid relief plan. I'm a prospective home owner that engaged American Financial Network ( " AFN '' ) for a mortgage. The first few weeks were smooth sailing until we approached closing - AFN charged me over {$6000.00} for an interest rate fee lock and this was not previously disclosed. I had a conversation with my loan officer and I asked what closing fees would be associated with the mortgage and they said a fixed flat rate ( which was under {$2000.00} ), and now that I'm XXXX with the deal with a large due diligence amount, they decide to add a $ 6,000+ charge for an interest rate. I'm not a legal expert when it comes down to mortgages, but this just does not seem right. Further, my loan was supposed to close on XX/XX/2020. It is now XX/XX/XXXX and the loan still has not closed. Every few days I receive an update that the " loan will close tomorrow '' but it has not closed. I have been living with a friend since XX/XX/XXXX since I was relying on AFN to close the mortgage on time. Loan officer goes MIA for 7-12 hours at a time without responding. I've tried contacting their production manager and they do not respond either. Very unprofessional company as a whole.

I am a real estate agent and our buyers were pre-approved through American Financial Network , Inc. We went into contract on a home on XXXX XXXX and I kept in touch with the lender throughout the process to ensure a timely closing by XXXX XXXX. When I checked on the loan the lender admitted to starting the loan process late and then had a few tax lien conditions to work through. We were told that the underwriters were based in California and were not very responsive to the lenders. The lenders, in turn, were slow to contact us and often required multiple calls, emails, and texts to check in on the loan process. We had to extend the contract two times to try to close by XXXX XXXX. We were finally given the clear to close on XXXX XXXX and we scheduled the closing for XXXX XXXX at XXXX. We officially closed today, XXXX XXXX at XXXX. At XXXX, we received a call from the lender that the loan would not fund because the person who issues the funds found out today that one of our clients had lost their job on XXXX XXXX and would receive severance pay for 1 year ( not the the 3 required for FHA loans ).

In XX/XX/XXXX I did an IRRL with American Financial Network Inc- XXXX . Since Covid19, I was on a forbearance for 4 months. Before being removed I applied for a loan modification. I've talked to someone in the Loss Mitigation Program. I received a letter stating that I was in the Loss Mitigation Program and could not have two active homeowner program at a time. This is incorrect. I have only filled out one application to have my mortgage payments modified and added to the end of the loan. I have called several times, no one can give me a correct answer I don't know the status of the only loss mitigation application that I applied for, please can someone assist me. This has been the worst mortgage experience. I've tried calling and emailing, and mailing no one seems to know what they are supposed to do. On XX/XX/XXXX, I was told they would do a modification by increasing the loan from 3.125 to 3.3 %. I told them I would not accept the new terms, that was not what I applied for, I was applying to lower my payments with a lower interest rate. They have yet to fix or communicate with an answer.

I requested American Financial to drop my PMI and they responded with email instructions- for me to either send check for {$100.00} for a BPO appraisal or a check for {$320.00} for a full appraisal. I followed the instructions precisely and mailed a check for {$320.00} along with a letter requesting the full appraisal as well as the email request with the full appraisal instructions highlighted. They cashed my check for {$320.00} and I received a call from an appraiser that he is coming to do a XXXX appraisal. This is not what I requested or paid for. I called American Financial to resolve the issue and was told they offer no phone support. They sent an email which could take up to XXXX for a reply. I would like to speak with someone as soon as possible to resolve the error. And I would like them to schedule a full appraisal ( as requested and paid for ) immediately. I would also like to note that I have so many problems with American Financial. They never pay my homeowners insurance correctly or on time. I have to call them constantly to fix mistakes and their customer service is awful.

My documents have my name misspelled. My name is XXXX ( one word ) NOT XXXX XXXX ( XXXX is not a middle name ) I was very specific with the mortgage company regarding the spelling of my name and was assured that it would be spelled correctly. I brought it to their attention numerous time and was assured each time that it would be correct for the filing. When I receiving the documents to sign in front of the Notary I again expressed concern regarding the spelling of my name. we called the loan agent and was assured that it was not a problem and would be corrected. I have received my documents from the new mortgage company as sell as the grant deed from the title company. As of today, I'm 65 days late with my mortgage payments. I was approved with 17 future payments with the Homeowner Assistance Funds. Since XXXX XXXX is sending the bulks check to the mortgage and they always took couples of days to apply the payments. The purpose of the Homeowner Assistance Fund ( HAF ) is to prevent mortgage delinquencies and defaults, foreclosures. HAF is a federally funded program administered by the State of Florida and the responsibility of timely payment falls on the state and NOT the applicant. Theyve reported my acct as being delinquent for XXXX and XXXX to the credit bureau. The representative stated the accounting dept is behind. My account is coded as a code 3 which means I applied for the HAF program and was approved so no late fees will be applied. I also received a letter with the steps for foreclosure. I'm missing payments for XXXX, XXXX and now XXXX I contact HAF and they told me that they are sending the checks every month. My mortgage told me that they open an investigation since XXXX and Im being calling every day and nothing yet.

Good Afternoon, I believe that American Financial Network Inc. is making false and misrepresenting statement 's to the buyer 's of my house, as to whether they can be given a mortgage loan or not. They keep asking for extensions without an explanation as to why settlement can not be reached, resulting in an over month long delay in closing so far. Only recently have they started communication with me and my realtor and keep giving different, contradictory reasons to different people as why the loan can not be granted. This is apparently a pattern of behavior, as my realtor has agents under her who are dealing with the same problem with XXXX with different real estate deal 's. After purchasing a home with a VA loan my wife and I have received a number of refinance letters from American Financial Network Inc. We have never had any business dealing with American Financial Network Inc. and do not desire to. My wife and I both completed the opt out process at optoutprescreen.com, as provided by the Fair Credit Reporting Act, on XXXX XX/XX/2021. American Financial Network Inc. has ignored our opt out and continued sending refinance letters. After giving adequate time for any letters already in the mail to be delivered we directly contacted them on XXXX XX/XX/2021 at XXXX EST. They agreed to stop sending letters. However my wife and I have continued to receive letters from AFN. We filed a compliant with CFPB on XXXX XX/XX/2021. After dragging their feet AFN finally responded two weeks later claiming they would put us on their internal do not contact list. AFN however has continued to brazenly violate the Fair Credit Reporting Act and still to this day ( XXXX XX/XX/2021 ) sends us unsolicited mortgage offers.

As pointed out in my response to the general, unspecific, inaccurate, and contradictory response by American Financial Network the company continues during interactions to not follow basic regulations and fundamentals for staying licensed and legally selling mortgages and lending. Today I had a 30 minute plus discussion with American Financial Network or subsidiary named XXXX ( XXXX and now XXXX ). The phone call was at XXXX XXXX. In the discussion I was told that there is no way that I would be given a bank statement for a payment due in XX/XX/2022. This contradicts the enclosed statement from American Financial Network and the proposal by implication. American Financial Network was mailed a payment that arrived on XX/XX/2022 - see enclosed tracking. The check has not been made and yet the bank gave me a deadline for making XXXX payment and getting on regular payments. I'm fine with that and they make promise in writing enclosed, but then as usual I am given contradictory information as happened by phone today.

I am a XXXX XXXX XXXX in XXXX, NY. I am representing the seller. We accepted an offer from a buyer on XX/XX/2020 not contingent on the sale of her home. I called the mortgage broker at American Financial Network Inc. to varify and confirm that the buyer was qualified and the purchase was not contingent on the sale of the home. They said it was not. Along the way they asked for 2 extensions and the sellers granted the extension. We we suppposed to close before the end of the year. My sellers are in a contract on a new home based on the sale of their home. Yesterday over two months of dealing with this buyer and mortgage company, her agent and the mortgage broker are now told that she was not approved. Her home is closing this week, so it's beyond the cale of her home .The sellers are devestated, this bank never should have pre-approved her for a mortgage and dragged us along for all this time. After purchasing a home with a VA loan my wife and I have received a number of refinance letters from American Financial Network Inc. We have never had any business dealing with American Financial Network Inc. and do not desire to. My wife and I both completed the opt out process at XXXX, as provided by the Fair Credit Reporting Act, on XXXX XX/XX/2021. American Financial Network Inc. has ignored our opt out and continued sending refinance letters. After giving adequate time for any letters already in the mail to be delivered we directly contacted them on XXXX XX/XX/2021 at XXXX XXXX. They agreed to stop sending letters. However my wife and I have continued to receive letters from XXXX, with the latest received today ( XXXX XX/XX/2021 ). Furthermore American Financial Network Inc. sends its letters in the format used almost exclusively by DFAS ( the military pay office ). I signed my Final ALTA Settlement statement on the XXXX of XX/XX/2020 via remote closing at my home. When I received copies if my closing documents and my settlement check I noticed that the dollar amount was different than what was on the statement that I had signed. I noticed that the first position mortgage lien amount was different but I attributed that to interest, although that should have been properly accounted for but there was also an increased amount of {$50.00} for the remote closing above the amount that was on the ALTA that I signed. I then emailed the mortgage company to find out why the numbers were different and was told that it was due to interest. I asked about the increase to the signing fee and was told that they would look into it and get back with me. They did not. I inquired two more times and was never given any follow up or reason as to why I was charged more after I signed the ALTA or why the ALTA that I signed did not match what was in the final loan docs.

On XX/XX/2019 lender company called " American Financial Network Inc '' given a quote with XXXX $ credit with 4 % interest rate. In the initial CD they removed the lender credit. When I asked about the lender credit they mentioned that i will get that lender credit added in the final CD and asked not to worry about it. Final CD handed over about 3 to 4 hours before the closing date ( XXXX XXXX ) and again they have not added the lender credit. I was getting some realtor credit also but asked them clearly use only the amount you can and remaining you do not need to use it. There were seller home HOA issues and closing got postponed by couple of weeks. So when i have asked about my lender credit to the lender they were saying we had to pay rate lock extension and you will not get more than few hundred and if we add the credit now closing will be delayed ... etc. So they literally blackmailed me and corned me to close it without lender credit which they promised.

American Financial Network called me yesterday XX/XX/2022 and I called back at XXXX PM and the call lasted 10 minutes and 23 seconds. During the conversation I was told nothing about the company needing any additional information, I was told nothing about what the status of the loan modification was, and then during the end of the call, I was told that my mortgage was under review and pending approval for a loan modification. Trying to refinance our home through American Financial Network INC, XXXX # XXXX. We were told we qualified for a VA Loan, my husband is retired. Throughout the entire process this company ( American Financial Network Corp in New Jersey ) has been misleading, negligent, and void of communication. They told me to get insurance for Friday ( XX/XX/2020 ) because we are still closing on that date. I asked multiple times, " are you sure we are still closing on Friday. Received a letter concerning refinancing my VA home loan. The letter stated that it was a pre-approved loan. It gave specific numbers concerning dates, interest amount and cash out amount. It also stated that it was a firm, guaranteed offer. Almost from the beginning of starting the process, everything began to change. The interest rate, the closing date, the cash back amount all changed. I discussed this with them and they offered ways to manipulate the numbers to get me more money, including skipping payments and discounting fees. It eventually became clear that it was a classic bait and switch but by that point I had paid for a VA appraisal and termite inspection. I notified them that I was cancelling and requested they reimburse me for my costs, which they refused. They denied the facts of the letter they sent and requested a copy, which I sent them but basically said to bad.

On XX/XX/2022 a check of {$17000.00} was sent to the lawyer of a person we are trying to buy a house as agreed. While waiting for the loan to be process, my cosigner back off the buying of the house after she released the price was higher done we were told that exceeded our budget. This complaint is in regards to American Financial Network ( AFN ). I am trying to complete. A supplemental equity loan using XXXX XXXX XXXXXXXX. I initially reached out to my loan officer at AFN by the name of XXXX XXXX. At first he answered my call. But when u sent him the form that he needs to sign to afield he that I am pulling equity from my property he started avoiding me. For the past month I have called American financial network twice a day to get the form signed. They told me to upload electronically in their system and that someone would review it in a week and a half. After the given time period the form was still not signed. We are the home sellers. The buyers are getting a VA loan through Orion Lending. VA inspector did the VA inspection on XXXX XX/XX/2019, closing was supposed to be on XXXX XXXX. Heard nothing from the lender so closing was delayed to XXXX XXXX. We were not informed of repairs necessary until XXXX XXXX. All repairs were completed by XXXX XXXX. Re-inspection was done and repairs approved on XXXX XXXX. Orion Lending didn't get the closing disclosure sent out until XXXX XXXX, then their systems went down for a day. Now documentation corrections are needed for the title company and closing was again delayed to XXXX XXXX. This entire process has been one delay and error after another. It is probably too late to get this incompetence fixed for our house sale, but this could serve as a warning to anyone else who wants a mortgage through Orion Lending.

As of today, I'm 50 days late with my mortgage payments. I was approved with 17 future payments with the Homeowner Assistance Funds. Since XXXX XXXX is sending the bulks check to the mortgage and they always took more than days to apply the payments. The purpose of the Homeowner Assistance Fund ( HAF ) is to prevent mortgage delinquencies and defaults, foreclosures. HAF is a federally funded program administered by the State of Florida and the responsibility of timely payment falls on the state and NOT the applicant. Theyve reported my acct as being delinquent for XXXX and XXXX to the credit bureau. The representative stated the accounting dept is behind. My account is coded as a code 3 which means I applied for the HAF program and was approved so no late fees will be applied. I also received a letter with the steps for foreclosure.

I received a pre approval letter from XXXX and now that i already paid my ( {$3500.00} ) Earnest money deposit XXXX is saying that i dont qualify for the loan that they already pre approved me for. We tried to buy a duplex in 2019, this mortgage lender promised us they can close the loan in 15 days and they had a loan we were already approved for. They charged us {$970.00} for the appraisal and continued to ask for more documents such as pay stubs, forms to be signed, etc. The loan was denied. I went to XXXX XXXX with the American Financial Network for refinancing. He advised to go to the AFN site online to apply which I did. They sure did send me the non disclosure documents which I signed. My problem though is that he-my agent : XXXX ordered a {$600.00} XXXX XXXX dollars appraisal which I thought was very expensive. However, not too long after they got all the documents they requested, they turned around and told me that my income to debt ratio disqualified me. I worked breifly for a mortgage company that made many misrepresentations about their pricing and funding times. I quit the company XXXX/XXXX/XX/XX/2014 and asked when they were going to pay me my final commission. They told me on the following pay period. When the following pay period came, they changed their story to say that I never originated the file. I have a sworn statement from the borrower saying that I was the only one who originated the loan. This mortgage company is committing fraud by saying someone else originated this loan. After multiple calls and emails finally, my account is current. XXXX was able to resolve the delays in the process of applying the payments. My monthly payments were always received on time. I am trying to refinance through another company and my current company has not provided me with the documents that I need for 21 days now. I have tried every avenue to get this information to no avail. I dont know if there are rules in place about this.
