I sent American Credit Repair a written request for proof of their surety bond and registration certificate from the California Department of Justice. I sent my written request via e-mail, however, the company willfully and deliberately ignored my request. I have the e-mail chain as proof and the e-mail was successfully delivered and sent to their correct e-mail address. XXXX XXXX responded through a previous CFPB complaint admitting they were in receipt of my e-mail complaints to their corporate e-mail address. It is against state law to conduct a credit repair company without : 1 ) a {$100000.00} surety bond filed with the California Secretary of State and ; 2 ) apply for and receive a registration from the CA DOJ. Violation of each is a misdemeanor. Moreover, American Credit Repair indicates in their contract that theyre a registered non-profit 501 ( c ), however, there is no record of not for profit status with the IRS XXXX This is also against federal and state laws. Additionally, on XX/XX/XXXX, there were 11 illegally posted credit repair advertising signs posted on government property without a permit. This is a misdemeanor in California. American Credit Repair is also illegally affixing their advertising signs on telephone poles. We have photographs as evidence and percipient witnesses that signed under penalty of perjury that these illegally posted signs are new and recent. In XXXX and XXXX, we filed complaints against American Credit Repair for the same reasons on innumerable occasions. The owner XXXX XXXX, is knowingly and willfully, systematically violating federal and state consumer laws. I also called the company and asked they cease and desist their illegal adverting, however, employees XXXX and XXXX disconnected the call attempting to escape accountability. Disconnecting a phone call on a member of the public is poor customer service. It was egregious.

This business is a scam ( the owner is XXXX XXXX ). They sent me a written contract asking for an upfront payment of {$590.00} to dispute a few inquiries. Charging upfront fees is against federal and state laws. Also, the contract states : American Credit is a non-profit corporation organized under the laws of the state of California, having duly filed an application with the Internal Revenue Service, operating as a tax exempt organization, pursuant to Section 501 ( c ) ( 3 ) of the Internal Revenue Code. This is false. The IRS website has a Tax Exempt Organization Search Tool You can check an organization 's : Eligibility to receive tax-deductible charitable contributions Review information about the organization 's tax-exempt status and filings. The IRS has no record of this company as a nonprofit. A private foundation can not be tax exempt. Certain credit repair practices are illegal. I seek to hold this company accountable for violating consumer protection laws. This company doesnt have a surety bond and did not register with thXXXX XXXX XXXX as required by state law. The written contract they sent me does not mention the name and address of their business bond as required by state law ( Credit Services Act of 1984 ) This is a criminal misdemeanor. Their written contract instructed me not to communicate with the nationwide consumer reporting agencies. Their written contract also mentions a non-refundable fee which may be against both federal and state laws.

I previously filed a complaint against this company on XX/XX/2022, via XXXX : this illegal company is posting signs unlawfully throughout XXXX XXXX XXXX XXXX XXXX ( on traffic signs and utility poles, etc. ) in violation of citywide regulations and municipal codes. I emailed the owner on innumerable occasions to cease and desist their illegal advertising. Moreover, on XX/XX/2022, I received a response through the California XXXX XXXX XXXX XXXX XXXX XXXX from the owner admitting guilt : I terminated our relationship with the company we hired to hang these signs for us. They were instructed more than once to not post these in the manner they have been hanging them. However, on XX/XX/2022, new bandit signs were affixed in the XXXX XXXX XXXX XXXX on XXXX XXXX and XXXX. I have percipient witnesses that will testify these public nuisance signs were posted recently. About a month ago, these illegal signs were not posted in that area. The owner is deceitful to the core and systematically violating California state laws. It is a misdemeanor to advertise on public and private property without a permit. It gets worse, I filed several complaints and received a response from the owner via the Consumer Financial Protection Bureau, where he lied to a governmental entity stating he would stop breaking the law. Despite these valid complaints, he continues to advertise in this unlawful capacity.

I have previously submitted a complaint against this company for posting/affixing illegal bandit signs on private and public property. The owner XXXX XXXX acknowledged my complaint and indicated he would cease. However, shortly thereafter, this company is still affixing these signs unlawfully on telephone poles, traffic signs and fences. This company does not have a permit to advertise in this capacity. This company is systematically violating California state law. The company is in violation of 2007 California Penal Code Article 2. Unlawfully Placing Signs On Public And Private Property CA Codes PENAL CODE SECTION 556-556.4 It is a misdemeanor for any person to place or maintain, or cause to be placed or maintained without lawful permission upon any property of the State, or of a city or of a county, any sign, picture, transparency, advertisement, or mechanical device which is used for the purpose of advertising or which advertises or brings to notice any person, article of merchandise, business or profession, or anything that is to be or has been sold, bartered, or given away. These illegal signs are a public nuisance.

I own private property in XXXX XXXX. I own several parcels of land which are bordered by a fence. This company placed credit repair signs on my fence. I removed these signs, but new signs were placed on my fence again. This has happened several times over the past year. This company is trespassing onto my private property and placing signs without my permission. The sign reads Fix Your Credit XXXX XXXX. When you XXXX the number, its comes up as American Credit Repair I called the number and they identify as American Credit Repair. I asked them to stop advertising these illegal signs, however, they keep putting the signs back up. Moreover, this company has admitted guilt on the XXXX website ( they also have an F rating. ) Placing signs on public and private property without permission is a misdemeanor in the state of California. Please sanction this company. Also, their contract states they are a non-profit corporation, however, they are not a registered 501 ( c ). I have a copy of their contract. This is a violation of consumer protection laws.

Credit Services Organizations that operate in California are required to file a registration application with, and receive a certificate of registration from, the Department of Justice before conducting business in this state. The registration for all Credit Services Organizations in California expired on XX/XX/XXXX. Beginning on XX/XX/XXXX, as new registrations are issued by the Department of Justice. American Credit Repair is not on the list and does not have a DOJ certificate which makes illegal to operate their business without it.
