XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, MN XXXX XX/XX/XXXX Re : American Account & Advisors , Inc To Whom It May Concern : I have previously sent you a request to validate my debt under the Fair Debt Collection Practices Act and all I received was an itemized list of the alleged charges you claim I owe you. This does not meet the Federal Trade Commissions guidelines of what constitutes proper debt validation In addition, in the case of XXXX Vs. XXXX ( IN THE COURT OF APPEALS OF INDIANA, No. XXXX ), the court ruled that : 15 U.S.C. 1692g ( b ) ( emphasis added ). On XX/XX/XXXX, nineteen days after the date of XXXX debt collection letter, XXXX counsel XXXX sent XXXX a letter declaring that XXXX disputes your debt collection-related allegations, denies the same, and demands strict proof and verification thereof. Record at 21. As such, XXXX should have ceased his debt collection efforts immediately upon receiving that letter. Instead, XXXX proceeded to obtain a default judgment against XXXX on the debt collection claim before he had mailed XXXX the necessary verification and, thus, violated 15 U.S.C. 1692g ( b ). XXXX maintains, however, that there was no violation of the FDCPA because he sent adequate verification of the debt [ to XXXX ] in the XX/XX/XXXX notice of claim. Brief of Appellee at 13. Specifically, XXXX claims that a copy of the consumer credit contract between XXXX and XXXX XXXX attached to the notice of claim provided sufficient verification of the debt within the meaning of 15 U.S.C. 1692g ( b ). We can not agree. The contract in no way provides sufficient verification of the debt. A review of the document reveals that it identifies only the terms of XXXX loan, including a 17.99 % annual interest rate and the original loan amount of {$2500.00}. The loan agreement contains no accounting of any payments made by XXXX, the dates on which those payments were made, the interest which had accrued, or any late fees which had been assessed once XXXX stopped making the required payments. Indeed, the existing unpaid contract balance at the time XXXX sent the debt collection notice was at least {$350.00} more than the original loan amount. Therefore, XXXX violated 15 U.S.C. 1692g ( b ) when he failed to cease collection of the debt by obtaining a default judgment against XXXX after XXXX had notified XXXX in writing that he was disputing the debt but before XXXX had mailed verification of the debt to XXXX. We reverse the trial courts entry of summary judgment in favor of XXXX on this issue. I notice that you are still reporting this collection on my credit report, which is considered to be a collection activity. You are now in violation of the FCPDA, and are now subject to fines of {$1000.00}, plus actual damages and attorneys fees, which I may collect from you by filing a claim in small claims court. These collections on my credit report are causing me severe problems in trying to purchase a home and the damage could lead into the $ 1000s. You should also be aware that reporting such invalidated information to major credit bureaus might constitute defamation of character, as the negative marks on my credit report harm my credit and prevent me from enjoying all the benefits of good credit. In addition, the Fair Credit Reporting Act ( FCRA ) does not allow the inaccurate reporting of information on my credit report and under this act. Therefore, if you do not immediately remove this account from my credit report, you are subject to another {$1000.00} fine, plus punitive damages. I'm sure your legal staff will agree that non-compliance with this request could put your company in serious legal trouble with the FTC and other state or federal agencies. I had an emergency XXXX last XXXX at XXXX XXXX XXXX in XXXX, MN. Payment from my insurance company ( XXXX ) was held up because XXXX had only sent anesthesiologist bills and not the bill for the actual XXXX. I was sent large bills but I knew they were incorrect as my insurance is a very good one. My insurance had to call the hospital to get them to send them the XXXX bill so they could process the claim. I was told by my insurance NOT to pay those bills and to wait for an accurate bill to be sent out. The correct total I owe ( according to my insurance company ) is {$150.00}. I'm more than happy and capable of paying that immediately but to date I have still yet to receive a correct bill from them. I've tried calling multiple times but they keep telling me I don't owe them anything! In spite of this, a collection agency keeps calling my cell phone and harrassing me. They have also sent a couple letters. One time I spoke with them I made it very clear that all I needed was an accurate bill from XXXX and I would pay it immediately. The collection agency was trying to collect over {$700.00} from me and I had to inform them it was only {$150.00}. I'm at a loss as to why XXXX would send a collection agency after me in the first place. The delay was caused initially because they didn't bill my insurance correctly and later because they didn't send me a correct bill showing what I truly owe them. I'm starting to wonder if this collection agency is even legitimate? I'm writing you now to complain because I saw 2 derogatory marks on my credit report from American Accounts AD and the original creditor is XXXX XXXX XXXX Nurse Anesthesiologists. and XXXX XXXX XXXX. I don't know what to do here. I have tried calling XXXX numerous times, hoping to get someone there to either send me an accurate bill or take my credit card over the phone to pay it. Neither happens because they say I don't owe anything. I could pay this collection agency but l question their legitimacy. I have had to correct them on the amount and told them that I wanted an accurate bill sent by XXXX but they only send me their ( American Accounts ) letter showing the amount they want to collect. How hard is it for XXXX to send me an accurate bill? I want these derogatory marks off my credit report. I've never had any and my credit is stellar. I'm not late on payments ever and XXXX should be ashamed of themselves handling their affairs in this manner for what amounts to a nice pair of shoes. Totally ridiculous. The attached documents show a few things. From the collection agency they have 2 charges that add up close to the amount I owe but one of them is XXXX more than one in my possession. I'm guessing it is one of the ones in question but the total is different. The 2nd bill I sent is for XXXX but the assumed corresponding bill is for XXXX. Quite the difference, looks like a decimal point. The post it note on there is the person I've phone tagged with and who says I don't owe anything. You'll also note that both bills are the same address but differently named outfits. When I call the number on the bill I get sent to the hospital and they say I don't owe anything.

Good morning, My official complaint, On XX/XX/2020 I paid 2 debts in full to the original company, XXXX XXXX. I sent a letter and proof of payment to the creditor, American Accounts & Advisers , INC. on XX/XX/2020. In that letter I requested proof of removal from my credit report within 30 days of receiving my letter and proof of payment. I never received anything from them to this date, XX/XX/2020. This debt continued to be reported unpaid by American Accounts & Advisers , INC. for the next 4 months, I attempted to dispute this with XXXX multiple times during that period but due to COVID there we not taking care of disputes due to staffing. On XX/XX/2020 I called XXXX and was able to talk to a person that submitted the dispute for me. I asked XXXX to direct me to a place where I can make formal complaint against American Accounts & Advisers , INC. inability to do their due diligence in removing a paid debt from my report that they knew was paid. I called the number and it was American Account & Advisers , INC. I was quickly directed to XXXX 's voicemail. I left an extremely professional message indicating this debt is paid and their lack of response is to say the least disappointing to blatantly ignore a paid debt and not do their due diligence to remove it from collections. I received a call this morning to say it is now reported paid. I asked what caused their lack of due diligence to report and why it took them 4 months. There was silence and I was given no reason at all, none. The phone call was recorded. I have been in the process of trying to get approved to buy a home, build my credit portfolio and been denied multiple times due to this debt not being reported paid. It has directly affected my life and what I am trying to build for myself and my family. These companies will harass you night and day but the moment we need them to report a payment, no response. It needs to stop and there should be consequences for companies that do this. Thank you, XXXX

I called American Accounts and Advisors regarding a letter I received stating I owed a debt of {$670.00} regarding a charge from XXXX XXXX XXXX on XX/XX/2021 at XXXX XXXX. I spoke with a representative, provided the File # listed on the correspondence and was transferred to the line of an individual named XXXX. My call went to voicemail, at which point I left my name, call back number and the File # listed on the letter. As I was ending the call I received another. I switched calls and was informed the person calling was XXXX and she had just missed a call from my phone number. I informed XXXX that I had just left her a voicemail regarding a letter I had received. She proceeded to ask if she was speaking with ( my name ) and I said yes. She then disclosed the name of her company and read me the mini-Miranda. I had asked why she would do that without proper verification. She informed me that all she needed to proceed with the call was to verify my name. I stated, " Not according to the FDCPA '', at which point she told me I was incorrect and that she was required to disclose the name of her company and that the communication was from a debt collector on all calls, including voicemails, and did not require verification to do so. When I questioned this again, XXXX then said, " Ok then, is your date of birth ( my DOB ) '' to which I verified. XXXX then proceeded to XXXX for payment. She continued to inform me of her company and XXXX XXXX credit reporting process. Additionally, the notice I received does not include any information about my right to dispute this debt. I feel this company is acting in an unfair and deceptive way. I have since checked my credit report and as a result, my credit score has dropped 61 points.

American Accounts & Advisors resources , Inc. is reporting unverified medical information to Credit reporting agencies in the amount of {$52.00}. I initially contacted American Accounts, in writing ( see Attachment # 1 ), and requested proof ( documents bearing my signature ), that the debt belonged to me because I have not personally conducted any business with any of the parties involved in this debt, and know this debt does not belong to me. American Accounts responded to my request for a signature bearing document with a letter ( See attachment # 2/3 ) stating the debt was verified and it belonged to me. None of the information provided by American Accounts bore my signature or any other validating evidence linking me to the debt. I responded in writing again ( See attachment # 4 ) to request a signature bearing document as proof of this debt but never received a response. Both XXXX and XXXX have investigated this account, deemed the information unverified and invalid, and have subsequently removed this account from my credit report. Yet American Accounts continues to report this unverified debt to XXXX in violation of both the FCRA ( Fair Credit Reporting Act ) and the Health Insurance Portability and Accountability Act of 1996 ( HIPAA ). I also reached out to American Accounts by phone and left a message for XXXX XXXX and have yet to receive a response. I am trying to purchase a home and this item is negatively affecting my credit report. American Accounts ' policies and actions are highly predatory and violate the FCRA and HIPAA and should be investigated. I have made attempts to resolve the matter and have been met with staunch opposition which is the reason I am filing this complaint.

American Accounts and Advisors are reporting the same debt from the same medical creditor for the same date of service seven times under different amounts. The collection agency via a phone call admitted to knowing the date of delinquency was 6 years prior however they are reporting the debt as new from the date they bought the debt which was years later. I tried to resolve this with the agency who in the same phone call admitted they know the 21 collection accounts ( some as little as XXXX cents they reported ) are from one date of service with the creditor and that the date of service is 6 years old, they admitted that they report the debt monthly, and that they know the creditor creates new " accounts '' under the patients name per line item on the medical bill when they send the patient to collections for one medical date of service. Despite knowing this the collection agency representative tells me that they are compelled to report this as multiple debts because thats how it was reported to them, this violates the reasonable person standard for reporting. As any reasonable person would know that a patient is not seen 21 individual times on one date of service. This seems fraudulent to me both on the collection agency 's side AND the reporting medical creditor. Additionally, the Collection agency sent one notice informing me of one amount due for this creditor, again, this shows that the collection agency is aware that there is only one debt owed but is complicit in reporting it multiple times for maximum negative impact to my credit.

I have been receiving telephone calls on my mobile phone from American Accounts & Advisers ( AAA ) out of XXXX XXXX Minnesota. Today someone who identified themselves as " XXXX XXXXXXXX '' called my mobile asking for someone else. He proceeded to tell me about how they did not have a good number for this person and " thought they would call me ''. I asked why he would call my cell phone when I was not this person. He again said " we do not have a good number ''. I asked if I was listed on the account as a contact and he said " no ''. I asked him " then why are you calling my cellular phone '' and he said he had a personal business matter with the person ( and again gave their FULL name ). I asked if it was a collection and this was " skip tracing '' and he said " yes '' - illegally disclosing that this was a collection. He then ended the call without allowing me the chance to get a word in edgewise to tell him not to call my mobile number. I called back and he would not answer the telephone. I called the company and asked for the supervisor ( who turns out to be the owner XXXX XXXX XXXX but he also would not answer the telephone. I have been in contact with the person they are calling MY mobile number for and have been disclosing information about and let her know what happened and the violation of her rights that has taken place. I was in an auto accident that was a workman 's comp matter. There was some medical bills that were missed in the process, by the workman 's comp insurance provider ( XXXX XXXX ), as well as the original provider, didn't submit any outstanding personal medical bill to my insurance carrier ( XXXX XXXX ). The matter should have been resolved in XX/XX/2015. In the process of his engagement and attempts to resolve outstanding balances, American Account Advisors placed the account as a negative collection on my credit report- dropping my score more than 30 points. I received a bill from XXXX XXXX for anestesia that was provided for my daughter at XXXX 's in XXXX. I contacted XXXX XXXX to let them know they filed the insurance claim against me, not the patient, my daughter. My daughter had already met the XXXX deductible, thus, the cost would be borne by my insurance company. I received a call from American Accounts and Adviosrs from phone number XXXX on XXXX/XXXX/2016. The man/woman i spoke to asked to speak to my first and last name, i acknowledged that was me, they preceded to state the bill I owed and asked if I had means ro pay it today. I said no, my husband was in a XXXX and we have many bills. They then made what I considered a very rude comment, so nobody is getting paid? That is not what I said, they got irritated when I questioned their demeanor. I then stayed I work in XXXX and they should verify more than my name and should state the mini Miranda. The person I spoke to was rude and accusing, I was not dealing with them and advised I would be reporting them and ended the call. I always pay my bills, it may not be timely for some but I always make good on my accounts and do n't appreciate someone teying to down grade me. I received a demand letter for a payment for a medial expense that I paid. I went into the portal, printed the documented payment and sent the payment information with a copy of the demand letter to the company. Months went by. I assumed all was taken care of until 8 days ago I was sent another letter which suggest that legal action could/would be taken. I called and was sent to someone other then the person on the letter. I was told to submit everything via email which I did as requested with an attachment of the paid invoice with a request that they confirm the receipt and the I told them if I did not hear from that the matter was cleared up I would file a complaint. 7 days later, I received a very odd phone call from them today, so I called back and was told about the dept and it needed to be paid.
